What you been learning and my own children when they have been off for a few days they head back to school and now they're facing that test and they've already forgotten what they've learned in this allows them to have some work at home. Right it also says that a student could take the traditional computer science classes required or they could take one that's related to the career path. All right so that's that's what you probably heard the concerns I'd like to address two concerns at that too far first is that we're removing the computer science requirements not the case to graduate you will still have to have the computer science requirement just like before this bill does nothing to change that all it does is it says that you can take the traditional one or you could take one of these ones that's developed by for the career technical path the other thing is that there were some concerns with some of the people that the computer science initiative group which are the people who developed our regional computer science classes are there's a concern that these classes these related classes could be watered down the bill so what we did in that case you went back amended the bill in the bill actually now says I think it's Page four lines seventeen through twenty one it requires that the Department bad consult with that group consult with the very group that set up the initial computer science classes for us as far as you're developing these computer related classes and with that I'll. Thank you Mr Speaker members you may recall of something in the paper about individuals who had been in prison and that the current department of corrections had told him for seven years that they were eligible for parole this is before a burglary and told them they were eligible for parole in seven years down the road they find out they're not and then suddenly they're having to spend all their time in so that the Department corrections had been giving that advice to folks that a residential burglary was not a violent offense and that they would be eligible for parole and then on April twenty third of last year they decided maybe that rules law wrong and you may have seen in the paper people were getting rearrested reincorporated so actually what this is doing is fixing that part and it only really affects about two hundred ninety inmates and earlier last year J. P. R. joint performance review had an extensive hearing on this matter to flesh out what was wrong and so this is what is correcting what happened in that and so the very last paragraph of this bill really explains this is not going to affect anything else better residential burglary and it says unless the sentencing order expressly designates that a defendant was convicted under this section a violent felony offense or any felony sex offense does not include residential burglary so all this is letting these folks rely on the plea agreement the state offered in that they agreed to and it fixes what happened. R. was that these people had relied on this bargain and then all of a sudden it's like oh sorry not going to happen because we didn't understand the law. Representative Scott you're recognized to speak for the bill. good evening colleagues we met with the secretary of corrections maybe a year ago when this issue was brought to us and JPR it was several colleagues Democrats and Republicans and we actually had the family members come and talk to us about these issues this is if an inaccurate and inconsistent application of the law by a state agency for seven years it is not right we hold ourselves to a standard as a body and we have to do the same for the agencies in the state of Arkansas this is not a soft on crime bill this is doing what's right and these are not repeat offenders these are individuals who have done their time I'm not saying there are not repeat offenders they've done their time and they have been released and they have not ended or done anything since then we say honor that now if they do something you they need to go to their time you lock them back up that's not what we're talking about we're talking about a small window of gap when a state agency when prosecutors and other people reached out to them we thought documentation from the department of corrections where they were advising these people on how to you know of determine what their arrangement with gonna be they were depending upon the department of correction to give them information and they gave an inaccurate information according to what their interpretation of the law was until may of twenty fifteen two thousand one when we got the AG opinion so I'm just saying that we need to do the right thing I ask you to support this bill. And the father who didn't know he was the father was had to pay about a hundred and eighty thousand dollars in back child support my constituent had to pay about thirty thousand dollars in back child support but that wasn't the issue the issue was my constituent lost eighteen years of knowing his daughter. What can we do to fix that he asked. Sadly there's nothing we can do to compel a mother of a child to tell the father they are the father but these two bills try to fix it where a. It presumed father. The they can only go back three years for a retro active child support we're not talking about child support or past due child support we're talking about retroactive child support in a paternity case where the father. Did not know they were the father of a child. So in other states we did a fifty state survey there's always a limit to the number of years that can go back. So this bill three eleven says the limitation is they can go back three years from the time of the initial petition. Four of record recognition of the paternity or to three years from the time the alleged father is served. This is agreed to language from the administrator of the department of finance and administration and the office of child support enforcement. The administration the Office of the Courts. And the judicial council has signed off on this and other judges that were part of this and the parents for advocates for parental equality or also in favor of this bill. It is not safe you still can't be a member of any labor union that you want to be or any professional association that you want to be and that you can't contribute in the political fund that you want to contribute to you still have all the same rights you currently have it just says that you can automatically deduct that membership or those funds directly from employees paychecks. When senator Bryan ran this bill in committee he talked about his own personal experience having been a federal employee. And himself feeling the pressure to join the union saying others pressure to join the union seeing some different promotions or a certain privileges and perks for joining the union. And just share that is on personal example of feeling that pressure to join the union as a federal employee. Senator I also talk about how every sector many teachers that he knew personally and asked some of them if they were members of any of these organizations some of them were some of them weren't he asked them if they ever felt pressured into joining these organizations and many of them said that they did feel pressure especially when other school staff was involved in the process asking if they're gonna join these organizations or if they're gonna be doing payroll deduction. I know I talk to myself to a good friend of mine who's a teacher and I asked if she was a member of it of one of these organizations and she said she was and I asked why did you join and she said she thought she had to for the liability personal liability protection. Until it wasn't exactly true but I asked if she knew what this organization stood for an advocate for the state and federal level. And she wasn't aware of a I told her some of what I knew and she was pretty shocked but even still even though she didn't agree with a lot of those positions you still felt pressured. To remain a member of the organization. And I think this is just common sense when this law was put into place there may not even many options. But there are plenty of other ways that these membership dues can be collected you can use a debit card a credit card or check you can autograph from your bank account all the ways we all pay for everything else in our lives every day I know I paid most of my bills with auto draft credit cards debit cards there are plenty of other ways to collect this money and I know these organizations I will find a way to collect money from these people if they really want to the only explanation I've heard of why this is important some of these groups is just the convenience the convenience for their members and I'm sure it's a convenience to have the government the government collecting these organizations do is for them. But for me that convenience well maybe convenient is coming at the expense of making others feel pressure to join on clarified this does not affect retirement contributions only private organizations so your Your contributions to the Arkansas teacher retirement system anything like that is not affected us to still be deducted from your paychecks these are only private organizations it's really what this is is the government collecting money for private organizations what I would say is if you if any of these organizations are doing good work and providing value to their members those members will continue to pay their membership without our public institutions serving as the middle man and using our public employees time and resources to collect this money for these private organizations which too often makes other people feel pressured to join so with that I would appreciate a good vote. And the answer was no but something else you have to remember is that we are singling out teachers we are targeting teachers not only is. Two state employees have the benefit and the convenience of taking advantage of these organizations. But also firefighters law enforcement who by the way also make political recommendations to the benefit of their organizations. So I would ask you. What do you think is going to happen when you're looking at retired teachers who also get to make a decision. As to whether or not. They want to have the to join an association and have their payroll tax payroll deducted for these Jews. But we're not doing it for anyone else. I'm standing here on behalf of teachers who want this I want the freedom and you want the choice to be able to take advantage of member benefits pre tax and for the point that is made about there are other ways of joining and paying for these dues. If any of you have ever had a job where you get to make a decision about financial products. About your health insurance about your life insurance about associations being deducted from your check. Imagine being told tomorrow. That we're not going to deduct your payroll I mean we're not going to deduct your health insurance you have to pay that on your own you have to send a check. You have to do that for every deduction including federal taxes made out of your check the convenience is important. And you may not hear me you may already know how you're going to vote. But I promise you you must listen to the teachers in your district. The largest constituency. Our professionals in this state are nurses and teachers and if you choose to ignore them. Go ahead. I am excited to be the house sponsor of Senate bill for twenty one as a mom of two boys that were very involved in every sport they could be has young athletes athletes it's very important to me that our young athletes are safe and we equipped our volunteer coaches with the appropriate training and tools to be successful in keeping them safe I think we're all very aware of what just happened the Buffalo Bills player demarre Hamlin and how very important it is to have a training a good plan and quick reaction can save lives the coach safely act provides you injury mitigation training to youth sports coaches those that coach youth athletes ages fourteen and under these are youth athletes that participate in high risk activities such as football soccer cheerleading except ram Education of coaches and parent awareness is estimated by the CDC to prevent fifty percent of the injuries that currently happen to our youth athletes the training will be approved by our department of health and they will provide training on the field following subject matter but not limited to things such as emergency preparedness concussions extreme weather heart defects like Senator I'm the volunteer coach would be required to take the training which is an online course on an annual basis. The course is actually already developed by the coach safely organization which has already been approved through the state of Alabama this bill is endorsed by the triple lay the Municipal League Arkansas athletic trainers association and with that I would appreciate a good vote president Richardson for what purpose. This is African American. Hispanic American. Asian American. Made in America. Pacific Islander American. Senate service differ disabled veterans. And women. I must talk about women. This bill. Came out of the Senate. No female Senate bill vote for this bill. May be the reason why. They didn't vote for the bill because they knew that the bill would be detrimental to programs that benefit the mails. That's the reason for why the building full that's about veterans. My dad wasn't that. And when he went into the army. This is what the he got up one morning. Less family put on his clothes and shoes and reported for duty. And do you know what they're told him. Thanks so we're glad to hear. Now we can't guarantee you you're going to come back home to your family. But you know what he did the service contract for four years he fall for this country he also people like you and me will have our freedoms that that is that we could come in this chamber and voice our concerns. My dad in the hit that and when he came back. From the military. He have to fight. To get a job. You have to fight for his benefits the full benefit because the person at the death would not allow him to have his benefits but yet he was disabled he got hurt in on any change to this country he fall for that. Also thought to get a job with benefits for you know what else is awful. He fall for the right. When the polls to vote. Allow him to vote. You know why they would not allow him to vote. Because he was an African American. You know what else. He will settle with our. It's called. Maybe you don't know what a poll tax but you have to pay a poll tax if I would have to vote. About affirmative action. Many years ago. I accepted a job at a pharmaceutical company. I was the first African American the House. Cause for the action. In a white female. She was the first white female to be heard in the south and I'm the first AfricanAmerican behind and so. Yes. What we reported to work. We would. Because of affirmative action. And I say to you today. That's the reason why I'm here. In many of my colleagues are here is because affirmative action if you look at the women in this time of the day. Twenty five years ago we wouldn't have twenty six women sitting in here. We've made some progress in our state we made some progress in this country we now in the first time in history Arkansas has a female. We also have of female into. So we made some progress and we will continue to make progress but this bill here. It's not going to. Post move forward is going to hinder us. From moving forward and not only that. This bill is not going to bring us together. This bill will divide us and that's exactly what this bill is due. Now The although the bill. I'm sure we will have another meeting. But we didn't have that. And today are we see test text messages from several institution saying that this was going to hurt the accreditation they start me last week saying the same thing I told to. Gonzales about. We're friends and I'm not gonna take it personal and I hope we don't take it personal. But. What we're doing here today. Is not right. And that my mother used to tell me when we were going up she's a assignment's NO one best all right we do wrong. And I don't justify them out for the House beards this is not what this country is all about this is not one Arkansas phone that. And we show inventory analysis about sales. If you pass the bill. They give us. Free tax we could go out and buy stuff on the weekend before school free tax review and then have to pay taxes on. Thank you Mr Speaker thank you members this may surprise you that when I went to dental school in nineteen seventy six I was only the third class of women accepted into dental school and I was an affirmative action candidate there only six women in my graduating class and it is really important that we have people in the communities that look like the people of the communities is important that we have women it's important that we have blacks Zetian's it's important that we have people accepted into professions across all aspects of the community that look like community because they better relate to the community I I am eternally grateful that I was accepted deal school nail there about fifty percent of women that are accepted to middle school but it is really these affirmative action programs have been very successful and I've been very important to the balancing of the admission requirements and the work requirements in the work place of when I look at our physicians in our community almost every physician in the delta came from the delta I mean they're not all black physician my husband was rice's the delta was race in the delta but it's important that we address of these action programs in that we allow people to be have access to the workplace and actions schools that look like. I encourage you to vote against this bill. President Ferguson spoken against the bill would anyone like to speak for the bill. Represent brown you're recognized speak for the bill. Colleagues. I grew up. In the segregated schools I attended school in Warren Arkansas when I was occurred in grade school those are segregated schools and I ask my mother. Why mom if when we go to send the school and we sing that song red and yellow black and white they are precious in his sight Jesus loves the little children of the world. And she really didn't have an answer. This is kind of the way things were done back then. And that was one of the biggest issues for my entire life as a young person always troubled me and when my father was transferred to Illinois I thought well I've heard all about these changes and how they do things right up there the schools are segregated up there to. Growing up in the military of frequently went to school with children of all races. And I'm rambling and I I'm trying to make my point but I'm saying that things today are not like they were in the forties the fifties the sixties and the seventies. Things have improved we do not have the legalized discrimination that we use to. I respect my colleagues but I don't think any of us need any special considerations I think it demeans us. And. I'm a woman and I feel privileged and honored to be in this chamber but I can tell you there was never any affirmative action for me. When I was a young. Person working in an office the attitude was pretty much well if she wears a skirt she's a secretary it didn't matter how difficult the work was or how many many and they brought in from the field to take my place. I was always a low paid office worker. Things are different today and I think we need to acknowledge that and for that reason I would ask you to vote yes for this bill. Resented Gonzalez. Said the bill on the did a couple things that removed or talked about not screaming name but. I want to talk about some of the items that it strikes out which is equity in civil rights. If we look at the definition of civil rights is the rights of citizens to political and social freedom and equality. But we struck that out. If we look at it equity. You know to help with that I'm just tell you this there's a different folks in being equal and so on equity. It's equal for me and representative Scott to stand at the top of the stairs in jump down. The equity is that she's going to need help to go as far as ideas but we had the same starting point. Equity any quality is not the same. This bill removes that. It should. Now representative love representative brown yeah we've we've come a long way and we still have a long way to go. But for us to say that we've got here that we made it. We have that. Unless you've been discriminated against unless you know what it's like not to get an opportunity. Because of what you believe how you look where you came from those are the things that we're trying to fight against in this bill. I know representative Gonzalez has a good heart I'm I really liked Gonzales elect we comes in and gets out. But the fact is this is not a good bill. I never thought I spoken against the bill. Couple sessions ago but I typically don't even like coming down here. But this means something to not only me to my colleagues to all of us because it impacts all of us we represent people that don't look like us. And this is going to impact them. I'm I'm asking you please please don't hold. Senate Richardson is spoken against the bill would anyone like to speak for the bill. Would anyone like to speak against the bill. What the bill says and what the state code says is how you shall not discriminate against or grant preferential treatment any individual on the basis of race sex says caller also I don't know what the difference there is this will effectively in my opinion in. A lot if not all of the state programs to help young women become entrepreneurs and as a business owner and the father of three girls I find that amazing that we're about to do this. This is not what I signed up for. And I'll tell you something else when you read Arkansas Code in that describes the word minority it talks about disabled veterans in a talk about women we added disabled veterans a few years back to that were minority. DO in this bill everywhere you strike the word minority you are striking disabled veterans and women. Hope you think about that when you make your vote thank you. And this bill helps people that need it the most it doesn't strike out help it puts it where we need it the most it goes where it's based on need not based on anything else I want to focus on folks that need it the most and that's one vote for the bill in committee this mobile for it now I'm a woman I don't need preferential treatment is a smart as any man can work as hard as any man and I don't need any preferential treatment and those young girls that I know what they're to me it's demeaning to say that you can't succeed but you're not smart enough. Some are you're not smart enough because you're a woman and you need some special help that appalls me I'm sorry that appalls me my daughters are smart they are sharp and they can succeed as well as any man and they don't need some special treatment we need to help those most in need based on need not based on color not based on sex not based on anything but based on the business of this bill does and I'm sorry. Everybody's. This really is a very offensive to me to think a woman need special treatment she can't do it on our own just going to get a little extra help this very offensive to me I've worked my tail off and that's how I am here and that's what my business is successful and I'm going to pass it on to my daughters and I'll be yes vote on this bill. The state of Arkansas leads the nation in health disparities women and infant mortality rates in teenage pregnancies. Data from the centers for disease control and prevention identify Arkansas as having the highest maternal mortality rate across all state currently black women in the United States are three to four times more likely to die from complications of pregnancy and childbirth then a white women in Arkansas maternal mortality rate is fifty percent higher than the national rate we have the highest maternal mortality our rate is higher than Iran and Turkey Arkansas also has the third highest infant mortality rate out of all fifty states there are many efforts in this great state of Arkansas that work to prevent maternity maternal and infant mortality and all the services specific to women these efforts include the Arkansas maternal mortality Review Committee thank you eight M. S. institute for digital health innovation high risk pregnancy program Arkansas state Medicaid expansion expansion program which includes programmatic efforts that improve maternity care the Arkansas minority health commission strives to ensure that services reach the gap in the communities where they're not provided for this is not just an up and down vote that you're taking black and brown women are dying at a greater rate in this state. And this is just a few examples of program will potentially be cut if we vote this bill down so this is about lives this is not about us just playing games this is going to really impact lives is so I'm telling you as I read the bill and ask I read the bill and interpret the bill the questions I have asked these programs are going to be impacted in this state and so I'm asking for a no vote. When I was on the boys club board in Paris I was the president of that board in the mid nineties there were no women on the board. I couldn't believe this there were no women on the board. I mean we change that and it wasn't because of affirmative action it was because it was the right thing to do unfortunately not everybody just does the right thing. My grandfather was a state representative in Mississippi and I've got newspaper clippings of when he served there. And he. He was adamantly opposed to women's suffrage. You know that really wasn't that long ago. So I don't even want to address the issues with the minorities and and the the situations they dealt with for a couple of years. Have we I don't know how long affirmative action has been in place but I don't know that we have corrected. All of the things that we've done wrong. And I know when people have equal opportunities when they. They draw closer together because you start. Have an. The same types of jobs you have that your kids are doing the same sort of thing and that draws us closer together do I think that affirmative action should last forever no I don't. I'm hoping that at some point in our country we're going to get to the point that we can look past that stuff and we're going to do like representative Bentley said you're looking at the individual based on their individual qualifications and merit to not have. To have a program like this. But I think we honestly have some things to correct in this country and I think this helps with that is it perfect now. I know that you know that there's cases when people are have not been allowed because somebody else took their spot okay. I don't think it's time for us to to eliminate this type of program in this country I think it does divide as and I would hope that you would vote no on this bill represent Ferguson for purpose. And. If this bill passes will be the tenth state in the nation to have have this language in our code Those are the nine states currently have this on their code they still have higher education based those they still have accredited schools and their state is not going to stop that that's another one of those things the the first time I've ever heard that argument was just this evening well what as we're in session that was brought brought to my attention. I reached out to the Attorney General who supports this bill has said publicly that he he supports it so Hey what about this you know does it affect this absolutely not it doesn't affect. Affect accreditation at all The fact is they're expecting of a Supreme Court ruling in June. That will end affirmative action in higher education selection anyway there there fully expecting that that to happen I spoke with the. Attorney general's chief legal counsel argues with before the supreme court he told me that the that they're they're expecting that to happen in June the the votes coming down and The they expect the ruling to say that that you cannot discriminate based on race sex national origin and the and college admissions we would just be one step ahead of the game. Where this bill mentions of the civil rights it is it is not affecting our Civil Rights Act the that's a reference to civil rights were not changing the civil rights act at all with with this bill. Trying to go through here and address some of the things that they were brought up remember Amazon. As I'm going. Also say it doesn't stop the recruitment of of females or minorities It's it's what it does is affects the the hiring process admissions process Penzo you can't recruit on says you can't hire or you can't and use it for admissions and higher education based on on race so what we're looking for is qualifications who's qualified don't look at the color of my skin that doesn't matter doesn't matter from if I'm male or female that doesn't make me more or less qualified of those things are.
