Decanting is the method whereby the assets of an irrevocable trust can be poured into a second trust, which you may want to do when unforeseen circumstances arise that you can't carry out the settler's original intent. The only way to do that is by putting it into a new trust. The Uniform Trust Decanting Act allows a trustee to reform an irrevocable trust within reasonable limits while ensuring that the original intent of the trust settler is preserved. Nineteen states have already adopted this law. I think Arkansas and two other states have it up this session. We'd appreciate a good vote.
