We did that to address the Emergency that we face in our state regarding adults that don't even have a high school diploma, approximately 300,000 of those. We used an approach that's used in many other states, uh, that's different from the traditional model of
reaching this population in two really important ways. Number one, it's paper for, for performance. And number 2, it, it allows for an open provider model, as with a lot of the legislation that we pass, uh, in any given session as it's being implemented, it necessitates coming back. and making a few tweaks, and that's what this bill does. Uh, most of the changes in the bill are just simply definitional in nature or they're aligning the statute with the rules that we approved during the interim. The one change that is substantive,
uh, just to be upfront with everyone about us, we're in increasing a couple of the reimbursement requirements, uh, that is to align those with the best practices that we're seeing in other states, but it doesn't change the overall amount that's being spent on the program, nor does it change the average cost that the providers have to. here to, uh, in the legislation. So that's what the bill does. There's no fiscal impact on the changes that we're making here, um, and I'll be happy to take any questions, seeing none, we'd appreciate a good vote.

who also struggles breastfeeding, you'll know that it turns out that breastfeeding is not one of those things that comes easy to every woman and can be uh a real difficulty, especially when you're trying to get used to motherhood and all the sleepless nights and everything that comes along with it. Um, what this bill does is ensures that our new moms have access to like lactation consultants who can help guide them, um, assist them and trying to figure out how to get the latching right and how to do pumping and. And to do all the things that make sure that they get that, that good start for
breastfeeding for their children. Um, we know because, uh, we have a lot of science that supports this, that breastfed babies, um, have very good outcomes, but breastfeeding also has a lot of great outcomes for mom. Um, it can help lower the risk of SIDS infections, and chronic illness in babies, but it can also reduce the risk of breast cancer, ovarian cancer, and postpartum depression for the moms, um, lactation support can increase breast breastfeeding success rates and also reduce
complications for a mom and for babies. So this is a, it, it's a very pro-mon bill, very pro-baby bill. I'm very excited about it. I appreciate all the help that we received from a lot of the stakeholders, um, from Medicaid and from some of the private insurers and giving us some input on how best to make this happen. They're supposed to fund themselves. Thank you, Mr. Speaker, colleagues, last session, I ran a bill to, uh, move the penalty for fleeing from a police officer from a Class A misdemeanor to a Class D felony, been brought to my attention by the Arkansas State Police that More frequently than it should during the pursuit that, uh, these individuals that are driving these, uh, fleeing from the law enforcement officers are actually leaving the vehicle while the vehicle is still
moving. So when that occurs, uh, the reason they do that is to try to evade the officer because they know the police officer, the trooper, whoever has got to stay with that unoccupied and uncontrolled vehicle and get it off the road before they can pursue the person that was driving it. So that individual that just gives them more time to evade the law enforcement officer, and, uh, what we're doing with this bill here, we're just saying, hey, if they ask you to be here while it's still moving in attempt to evade arrest, then that penalty will be in, uh,

Thank you, Mr. Speaker. Colleagues, House Bill 1848. Um, is a revision to our joint custody law that we passed a couple
of sessions ago that is meant to clarify what it means, um, in a situation in which there is a domestic uh allegations of domestic abuse and how we handle custody determinations in those situations. So what it does in the first place is it creates a definition for domestic abuse. There was not a definition for domestic abuse in the original,
uh, joint custody law so this gives us a definition that judges can look At, um, what we discovered after the joint custody law was in place for a couple of years is that the judges were seeking some additional guidance and clarification on what should be considered domestic abuse in these cases. So this bill provides that clarification, um, and gives a specific definition as to what domestic abuse is in these cases and also requires that in a situation in which one of the parents is asking that the other, um, not have, uh,
unsupervised access to their child that there has to be an actual, um, hearing on the merits as to whether or not there has been domestic abuse. So merely making the allegation to the court would not be sufficient in this case to, to rise to the level of not being able to seek custody or visitation. Um, the other thing that it does is that even in situations in which there may have been a finding of domestic abuse. So say for example, maybe mom and dad have had, have gotten physical with each other or maybe it's something that didn't affect the child, or
maybe, uh, mom has gone into treatment. has come out and is in a better position, um, to, to have cus or unsupervised visitation with the child. It provides the judge with the ability to make certain findings, um, to allow that visitation in those limited circumstances, um, so they can make written findings as to whether or not the parent poses an ongoing risk of harm, um, whether they do not, uh, pose a risk of harm to the child, and they can, but are not required to order safety conditions, um,

Uh, House Bill 1830 comes from the Attorney General's office, uh, and makes a simple change to allow contingency fees to be calculated in part based on, uh, civil fines that are awarded civil fines or penalties that are awarded. As a practical matter, uh, many of the deceptive trade practice cases that are brought by the Attorney General, uh, they utilize outside council because outside council has developed expertise as to, um, as to how
to prosecute those claims and practically it's some of these cases require, uh, the expenditure of really large amounts of money on the front end. And so if there's not the ability to pay a contingency fee on that, the opportunity to bring those cases. is going to uh deteriorate actually, some of those cases may not be brought because outside counsel is not willing to uh take those on when they can't potentially recover, uh, the contingency on these fines and penalties. The other
alternative would be for the AG's office to handle those cases in-house, and that would be very expensive because that would require hiring many more attorneys and trying to develop the expertise in-house and so this makes sense. Again, it comes from the Attorney General's office. It's what the attorney General is asking for and ultimately it will be a benefit to the citizens of Arkansas. Be glad to take any questions. It's a measure crafted as part of the, uh, as part of Governor Sanders' packet of legislation, organized to protect our natural state from the encroachment of the CCP and the People's Republic of China. Uh, this bill was written with careful consideration to to protect the integrity of our
legislative process, lobbying, as we all recognize, is a protected exercise of the First Amendment, a vital form of political speech that allows individuals and organizations to petition their government. But like most other types of political speech, it is not limitless. It is subject to reasonable regulation to safeguard our democratic institutions. The rights enshrined in our Constitution, including speech, are guarantees for those who reside in our country and our citizens. Across our state and nation, we have long established protections within political, legislative, educational and research functions to shield them from
undue influence by foreign entities. This bill aligns with that practice, addressing a specific vulnerability in our system while respecting the foundational principles that we hold dear. Uh, pardon me. What this bill does, this bill makes it clear, uh, it makes it takes a clear and targeted step. It prohibits lobbying on behalf of a covering foreign entity. Um, so what does that mean? This bill defines covered foreign entity as an individual, foreign government or party listed on the US Consolidated screening list or entity list. Uh, domiciled in nations like the People's
Republic of China or the Russian Federation. Under their influence, control, or operating as their subsidiary. This is not a vague or overbroad category. It's zeros in on entities with documented ties to adversarial foreign powers that could undermine our state's interest. This bill establishes a straightforward rule. No person receiving a monetary benefit for lobbying can do so on behalf of these covered entities. Uh, to enforce this, it sets graduated penalties, uh, first offense carries a maximum fine of $3500. A second offense
escalates to an unclassified misdemeanor, uh, with up to 6 months of jail time and a $5000 fine or both. And the third or subsequent offense, uh, the violation becomes unclassified felony, punishable up to one year in prison and a $10,000 fine or both. Uh, these penalties are designed to deter violations while ensuring accountability, protecting Arkansans from uh foreign influence peddling. In our legislative halls. What this bill does not do, it does not create a vague dragnet, um, to capture entities or businesses um that aren't as a
part of these foreign entities. Uh, this bill's scope is narrow and precise and it does not create uh or penalize innocent interactions with foreign parties. Instead, it focuses solely on paid lobbying efforts tied to specific foreign entities identified as a risk to our national and state security. It respects due process by clearly defining terms under the influence or control of. and relies on established state and federal designations to guide its application. This is not about silencing

So, again, I mean, there are probably some people that would be caught up here that we may want to address and we may have a valid reason to address. There may be specific speech that is in need of being addressed. But that's not what this does. This is
a very over-brown, very vague, and likely unconstitutional

struggling financially to maintain their home and other certain assets while they work to get a fresh. Start. Courts in Arkansas are very clear that the homestead exemption is of the homeowner. But because of the easy access to online further on their home in a limited liability company for privacy reasons. In Arkansas, if you own your home and your personal name, or in a trust where you are the trustee, uh, it's very easy to look up
where you live, personal residence, domestic abuse victims, high target individuals such as prosecutors and judges might want to protect their privacy, uh, from these online records and owning the home in the limited lives. You might recall that last session we passed a law that allowed individuals who own their home in a limited liability company to take advantage of the homestead tax credit. So under our current law, someone might put their personal residence in a limited liability

converting it from a council to a committee. We're giving it some regulatory authority that it has not prior prior had. So Previously, if there was an issue with a medic or an ambulance service, it would come before a subcommittee of the full board of Health to get adjudicated. That might mean that you might have a civil engineer, a water treatment specialist, a cosmetologist, trying to adjudicate issues for medics. What this bill does is it requires the Department of Education and consultation with the Department of Health to come up with a plan for these preschools, uh, and how they can react if someone in their care has an anaphylactic reaction, much like we did with the emergency response plans earlier in the session. The first thing I want to point out on this bill is there's no funding attached to this bill. One of the things we've been trying to work on the last two sessions is to try to come up with the funding mechanism for our EMS services and what they provide. There are places in rural Arkansas where there's just not enough 911 calls to support an unsubsidized EMS service. So, you know, the way an EMS service makes its money
is 911 call comes in, they go out and make a run. They're able to collect on that. If there's not enough 911 calls in your district, it's very difficult. to maintain a full complement of advanced life support ambulances. Right now, we don't have any funding identified, but we have been working on quite a while with the Ambulance Association, Association of counties to come up with, with what we think is a fair distribution model. So that's what this is doing. It creates 5 different tiers of counties. It says based on populations, those populations correlate with 911 calls. We went and looked at all
the different 911 calls for each EMS district and as they apply to counties, and then we tried to look for natural breaks to create. tears, and then we gave a percentile to each tiering so that if there is funding available, this would be a plug and chug method to put funding into a system that would divide the money equally, uh, proportionally among counties based on their population and their 911 calls. We have put in guidelines, uh, for participation to qualify for these grants if we ever have money established, these
guidelines or requirements that we looked at again with the Ambulance Association to make sure that people are Providing you the
service that applied for grants through this process we'd be providing, uh,

Colleagues, this bill strives to get people to give people more opportunities and pathways to meet their work requirement for SNAP benefits. I want to be very clear though, this bill does not add any new requirements to obtain SNAP benefits. If you're an able-bodied individual and you have a work requirement, that's already the law. That's not changing with this bill. Um, but what it does do is it gives them the opportunity to
volunteer to meet the work requirement. Uh, in 2019, Arkansas passed the Employment and Training, uh, program for food stamps. And as part of the implementation, this allows the state agencies that receive state funding to accept volunteers who who request the opportunity to comply with the ENT requirement. So again, I want to be clear, it's permissive volunteers don't have to do it, they can meet their work requirement by doing it, uh, other ways, but volunteering is one of the ways you can meet the work requirement. And this gives them the opportunity if the state agency wants to utilize that work, uh, that
individual. I do also want to be clear that, um, the state agency doesn't have to accept volunteers. They only can do it to the extent that the observation doesn't interfere with the essential functions or the health and safety of employees, um, the governor, the the entity also may

prohibit a volunteer from engaging in activities, and they're also prohibited from accepting or accommodating a volunteer who negatively interferes. And

And this is someone who is getting SNAP benefits and has to either work or volunteer, but the state ag ency doesn't have a choice. It says they shall accept and accommodate the volunteer and the only ways out as Representative Underwood mentioned are that if it interferes with an essential function or the health and safety of employees, but if it doesn't, they have to take them
on. And it's not just a state agency, it's also a political subdivision of the state, which is a city or county. And so, these places that, you know, may not want volunteers are going to have to bring on volunteers, supervise them for no less than 4 hours a day, and I, I think that maybe there's good intentions behind this bill. Maybe it's beneficial for the snack recipients, but I think it's going to be really detrimental for the state agencies and really detrimental for the cities and counties that didn't even know this was passing and all of a sudden

House Bill 1801 was created through an idea brought to me by my APN, my constituent was trying to get compounded version of a semaglutide, also known as a GLP1 and was wanting to do that through these specialized compounding pharmacies. They're
a special class of pharmacy that are licensed and regulated by the FDA and must be in good manufacturing, practicing standards. The special compounders create medications that are no longer produced or are experiencing shortages. Historically, these facilities were not allowed to sell retail to retail pharmacies for them to be able to dispense these medications to patients. However, the FDA has recently changed its position on that last year, and issued a draft
guidance that now allows these specialty compounders to sell to pharmacies to dispense to patients with a valid prescription. This bill will bring Arkansas in line. with FDA guidance, which is being followed by many other states and allows our constituents to be able to take advantage of these compounded medications when the FDA allows them to be compounded, saving our constituents money. Please note that this only applies when a product is not commercially
available or is on the FDA shortage list. The pharmacy Association is in full support of this

Uh, HB 1455, uh, it's a constituent-driven bill for some of those who have uh come to Johnson County and to Clarksville, uh, you might, I might sometimes take you to a place called Preston Rose, which is a small farm to table restaurant, uh, located in our downtown. Well, they actually started in an adjacent county in Logan County, and we're brought in through a partnership with
the University of the Ozarks to help revitalize our downtown. Well In the course of them opening up this new restaurant, they had a private club, um, and so what they realized is that when they were selling the beer that they created at their small. Farm brewery is they would have to sell to a third party, drive it out there in a van, take it out of the van, pay the retailer, then put it back in the same van and then drive it, drive it back. And so it was, it was a ridiculous thing they were doing. And so had they been, um,
in a, in a wet county, they would have been able to do this without having to go through this system. And it's obviously made it the, made the price way higher. It wasn't sustainable. Um, and so they, they wanted a solution. Now, obviously, we wanted to respect the three-tier system. not create a way to where um we were, we were disrupting that. So working with the industry, uh, we came up with a compromise, which I think is, is, is extremely narrowly tailored, but I think it's a good compromise. So essentially what it is is they will enter in
or any small farm brewery that has that specific permit. Is able to enter in an exclusive agreement with only one private club that also has to be in an adjacent county that also has to be within an entertainment district, but also they forego selling any other alcoholic products. They can only sell the beer they make at their small farm brewery. And because that's what this essentially places, it's a farm to table restaurant where they're creating and buying foods and agricultural products from all over Arkansas, creating
menus and cuisines, uh, and then of course they want to be able to pair it with, with this, with this, with this beverage that's made here in Arkansas. So they're actually willing to forego the more profitable items because they want to be able to just be able to sell their own homemade at a more reasonable price and not having to go with this 30% markup. So that's essentially it. This is just a small constituent-driven bill to help them out with this unique program they're trying to do. And so, uh, I appreciate the industry working with me on this. It was taking a long time

Thank you, Mr. Speaker. Yeah, y'all really do look like you're, you're really enjoying this week, I can tell already, after a week off, you know, kind of come back, take a real hard day. Ladies and gentlemen, this is, um a lottery bill that we've had for a long time. And what this bill will, what this bill will do when the lottery was initially started, it was for a very good reason. The lottery began with a modified cash and accrual basis accounting system,
including to the scholarship, revenue. Uh, shortfall account. The Lottery has matured and legislate sure has changed with scholarship amounts are decided, this accounting method has created issues for the lottery and how certain accounts are carried on on the books. So this bill will correct those issues and we'll bring the lottery into compliance with GAP, which is generally accepted accounting principals, uh, Senator Hickey worked real hard on this. I'm gonna tell you, he was the lead man on this. He's done all the
work. All I did was sit and listen. So, uh, that's the way it's good because I didn't have to be involved in that a lot. The lottery director, the CFO, the secretary of DFNA as well as legislative audit and make sure this is the best way to bring the lottery accounting into the gap compliance, and now all agree on this method. This bill in no way takes any dollars away from the scholarship trust fund. In fact, has a possibility of adding more

for online marketplace guarantees and protects consumers by promoting transparency and accountability, uh, to providers of these guarantees. The idea for this bill arose out of discussions at Incoil, the National Conference Council of Insurance Legislators. We worked with the Arkansas Insurance Department on this as well to ensure that the bill works for them since it places the oversight. Of these online marketplace guarantees with that department. For purposes of this bill, an
online marketplace is an online platform for the sale of services. Examples include businesses such as Uber for selling a ride, Instacart for the delivery of groceries, Airbnb for short-term rentals or Rover for finding a dog sitter. Sometimes to make participants more comfortable with using the online platform, the provider will offer a guarantee. The guarantee is very much ancillary to the primary. that somebody would use the platform. You use it to get customers to, uh, people to give you rides or to rent out your home on Airbnb, not for this
particular guarantee. So, Codifying the guarantee is something that already in Arkansas law through case law, we've, um, we've established what a guarantee is in this bill, like 24 other states simply codifies what our case law already says about the definition of a guarantee. Guarantees are conceptually very different from insurance policies and through many of these cases, we've, like I said, clearly defined what a guarantee is versus what insurance is. In addition to defining
guarantee, the bill also includes various consumer protections. It requires that the maker of the guarantee have the financial wherewithal to back it up. If they do not, then the bill requires that the maker of the guarantee insurance, uh, purchase an insurance policy sufficient to cover their promise to pay. And lastly, the bill requires that the maker of the guarantee provides certain disclosures to the users of the platform, and this ensures that these users understand in plain language, the meaning and

There's a growing shortage of accountants and CPAs in our state and in the country. This has happened over the last
15 years, basically. We've worked with the Arkansas State Board of Public Accounting, Labor and Licensing, as well as the Arkansas Society of CPAs to craft a bill to address the problem. This bill does the following 3 things. Number one, the Arkansas State Board of Public Accounting, has a pipeline initiative to waive or assume some of the fees for qualifying Arkansas exam candidates, which will ease the cost of Uh, the burden for sitting for the uniform CPA exam.
Number 2, They went to a program several years ago where in order to be a CPA in the state of Arkansas, you had to go to college for a year of expense for college if you wanted to be a CPA. So you had a lot of people in the state and in other parts of the country who were like, OK, I'm not paying for another year. So we had a decline in the number of people. Who were wanting to be a CPA.
So what we're doing is going back to the way it was, uh, prior to the early 2000s. You get your degree, a 4-year degree. You go to work Certain pass the exam, then have a one-year, uh, of experience requirement prior to being licensed. Uh So, it goes back to the old way, but we think that that's really gonna help get more. And then the last thing, it also makes it easier for the Arkansas State
Board of Public Accounting to adopt changes to the uniform accounting, accountancy Act model language, uh, in their board rules. Uh, lastly, it also allows for This bill updates the statutes for CPAs, allows them to get competitive again, and

91 by Representative Ray to provide that local governmental unit shall have no authority to regulate or control the amount charged for a rental application fee or rental deposit for private residential or commercial property. Representative Ray, you're recognized to explain your bill. Thank you, Mr. Speaker. Uh, colleagues, this bill clarifies that our statute on rent
control, um, so that local government to ensure that local governments cannot regulate the application fees charged by landlords, property owners, property managers, etc. in the state of Arkansas. So Arkansas law has long prohibited rent control, um, which is essentially government-imposed limits on the amount that's that landlords can charge for rent. The reason that we prohibit rent control is because these policies, while well-intentioned, have failed everywhere they've been tried,
reducing the supply of housing as well as the quality of housing. It was assumed that this prohibition extended to application fees, but in October of 2024, the city of Fayetteville passed an ordinance that would place a $40 cap on rental applications and background check fees. That's why we're running this bill. The reasons for the bill are pretty straightforward and simple. Number one, government price controls don't work. Virtually any credible economist will tell you, uh, that they
lead to fewer housing choices, hurting the very people that they, these policies purport to help. Uh, my, my, one of my favorite economists, Walter Williams, is uh has a famous quote where he says, short of aerial bombardment. The quickest way to destroy a city is through rent controls. Secondly, uh, this area of commerce is already regulated by the state, Arkansas code 14-16-601, already prohibits rent control policies.
And Arkansas code 18-16-304, already re, uh, lays out the state's regulation of rental deposits. Um, simply put, this is, this ordinance in Fayetteville was sort of a, a way to creatively, uh, implement backdoor rent control, um, and that's what, uh, this bill would address. Third, these types of ordinances frustrate state policy and unnecessarily meddle in the free market, uh, if a landlord chooses to charge $50. or $60 for a rental application
that is a voluntary contractual consumer relationship. Uh, it's not really something the government has any business in, uh, setting the price controls for. And 4th, lastly, this practice is also is already very likely illegal. There have been two attorney General opinions in the past two years on this topic, uh, they both, uh, consistently opined that this practice was already illegal, and the ordinance that I'm referring to was repealed, um,

And, uh, I can't recall all the members of that committee or task force, but I know Representative Ray was on it and I know Senator Tucker was on it, and Senator Tucker has put a lot of work over the last couple of years in this, into this bill, he originally filed it quite some time ago, and there's been multiple amendments and, and, uh, he Met with all the, uh, stakeholders and I'm happy to say that Everybody outside of it.
This chamber at least seems to uh Be in agreement And that, that's something that's quite unusual to do. I mean, uh, municipal society, I mean, municipal league, the chamber, I mean, the association of counties. The Press association. Joey McCutchen and others have all, uh, come into agreement with this bill. What it attempts to do is bring clarity to what a public
meeting is and it, uh, a large portion of it is definitions, dealing with public meaning, uh, cybersecurity, uh, what constitutes an informal meeting, uh, what pole or polling is, and, uh, what a governing body is. Thank you, Mr. Speaker. Colleagues, um, you can see this is Representative Johnson's bill, but I think after that 20 bill run, maybe he needs to hydrate or something, so I'm gonna run it for him. Uh, back in 2005, the, uh, Governor Huckabee established what's called the A-HELP Program, the Arkansas Healthy Employee Lifestyle Program. It's a program through which employees can gain credits for things like healthy eating and exercise, and they can cash those credits in for some time off at
the end of every year. When that program was created, it was housed under the
Department of Health, um, but it really is an employee benefit that belongs in, uh, transformation and shared services. So all this bill does is house it there rather than the Department of Health.
