of the Arkansas House of Representatives. Uh, thank you for this recognition. Uh, I truly appreciate your kind and humbling words. But before I begin my remarks, I want to take a minute to say to our fellow citizens affected by this current weather. And tornadoes that our family praying for you, and you will continue to be in our thoughts and prayers. Uh, I know Governor Sanders and everyone in this room is trying to assess the situation. And provide every resource possible to assist you. And your families in this time of need. I have great pride in being in Arkansas. Uh, where my, Arkansas heritage as a badge of honor. Which makes being, being recognized by my state's elected officials so special and meaningful. For being here, being here in the house has a little extra significance to me. Is my late uncle Whit was once a member of this distinguished body. As was his father, my grandfather. And I'd forgotten about it till I walked in here, but my father served as a page. I don't remember the years, but somewhere around here, there's a picture of him, uh, up, up, up on the wall as a page. As the resolution referenced, I count my family as my greatest blessing in life. I want to thank my family for their steadfast support and love throughout this process. I'd like to introduce them to this honorable body. My wife Harriet and I have been married for 43 years, throughout which she has given me her unwavering support. She is the backbone of our family. I love her dearly. I'm grateful that she is with me today and every day. Harriet and I have 3 adult children, Miles, John, and Laura. All three of our children are married to wonderful people that Harriet and I consider our own. Katie, Mary Olive, and Cliff. Our children have blessed us with 6 grandchildren, Harvey, Rawlins, Lillian, Parker, Caroline, and Warren. And above us, uh, uh, in the, in the section above us, uh, our, our son Miles, his wife Katie, and their 4 children, Harvey, Rollins, Lillian, and Parker, as well as our son John and his daughter Caroline. They, they tell me young Warren's nap time is right now, so that just wasn't a good time for him to be here. And I would agree with that. It's an honor to appear before you today as President Trump's nominee to be the ambassador to the court of Saint James's. I'm grateful to President Trump for placing his confidence in me to fulfill the important duties and responsibilities of this, of this storied position. Arkansas has given my family so much, given me so much. It has been a wonderful place to raise a family. We have an incredible atmosphere to own and run a business and beautiful outdoors to enjoy with our loved ones. When asked what is Arkansas's greatest strength, Harriet and I always say our people. We truly have made wonderful lifelong friends and there is no other place we'd rather call home. Particularly to our elected officials. I cannot tell you how many times I have heard from my counterparts from different states about their decisions to relocate their businesses due to the terrible economic conditions and strangling regulations that make it challenging for them, for their businesses to grow and thrive. They did not want to leave their home states, but the unfriendly business regulations force, forced them to do so. There is no joy in hearing their troubles, but it is a sense of pride when I tell them that my family has never thought once about leaving Arkansas. Honestly, we could not ask for a better place for our family business. This is all because of your steadfast dedication to implementing laws that reward hard work, which in turn encourage our citizens to remain in Arkansas and attract those who weren't fortunate enough to be born here. For that, you are to be commended. And although we will be moving to London upon confirmation, Harriet and I will always keep Arkansas's success in the forefront of our minds, particularly since our children and grandchildren will remain here. And have no doubt that I'll be cheering on the Razorbacks and UALR Trojans from the United Kingdom. I just hope my hawk calls in London. Don't startle our British friends and neighbors. Thank you again for this recognition. God bless you all. God bless our great state of Arkansas and may God bless the United States of America. Thank you.

Can I have the lady cougars, uh, please stand. So today I have, um, the resolution to congratulate the Edred County High School Lady Cougars basketball team on winning the 2025 Class 2A state championship after defeating the Barton High School Lady Bears by a score of 72 to 66 on March 13th. The lady cougars earned their spot in the state championship by winning their last 24 games of the season and defeating the top 4 ranked teams in the state during the regional and state tournaments. The lady cougars completed the season with an overall record of 32 and 4, and one, the George Cale Memorial Classic, the 2A2 conference code championship and the 282 District tournaments. Um, the two I region 2 tournament and the Class 2A state championship tournaments. And Quinn Johnson was named the Most Valuable player in the Class 2A state championship tournament. The Lady Cougars were led by head coach David Harmon, an assistant coach, Kyle McCandless, uh, Mr. Harmon has achieved a very rare feat of coaching both a boys state championship team in 2008 and a girls' state championship team in 2025 for the same high school, and I would like to point out that I was one of the lucky ones that got to be on his team in 2008. operation and the promotion of a democratic ideals and any deliberative body. And whereas the General Assembly throughout its history has depended on its constitutionality, given the authority to develop and exercise its own rules and procedures to deliver representative democracy in the governance of this great state. And whereas in recognition of the importance of parliamentary procedure and maintaining democratic institutions, the National Association of parliamentarians by standing rule has designated April as parliamentary law month. And whereas the National Association of parliamentarians designated April as parliamentarian law month and part of to recognize the birthday of Thomas Jefferson, who wrote the first American manual of parliamentary procedure in 1801 at the dawn of the American Republic. Whereas the observance of the parliamentary Law Month offers the opportunity to recognize not only the importance of parliamentary procedure, but also the contributions of individuals whose careers followed the example of Thomas Jefferson to define and give form to formal parliamentary procedures, including Henry Martin Robert, author of Robert's Rules of Order, and Paul Mason, parliamentarian of the California Senate and author of Mason's manual of Legislative procedure. government. And no one else. It prevents government from taking away religious freedom. Religious freedom is at its core. Everything that means to be an American and an Arkansan. A couple of things that this bill does. It keeps religious organizations safe from persecution should a church camp that's Baptist run, let's say cause I'm Baptist, so I can pick on Baptist, wants to hire Baptists, they have that right. It doesn't allow discrimination when it comes to age, gender. It only allows for those church camps or those churches or those religious organizations to be protected from persecution. It protects religious freedom. When someone's seeking a license. For example, a marriage license. If that person that is issuing the license, doesn't wish to do that, they must recuse themselves ahead of time in writing. They cannot do it at the time of action. That's been tried and that person has still paying over $100,000. So there is a way that we can take care of both. It protects religious organizations regarding employment. And it prevents government from organizations. With that, I would appreciate a good vote. Representative Blundstrom has explained

against the bill. Thank you, Mr. Speaker. Um, I Certainly respect you, Representative Lindstrom, and, um, so don't take anything different by what I say today. I, I'm not planning to say anything awful, but just don't misconstrue, OK? Um What I don't, I think what I don't understand about this is that to me, we have religious freedom in the United States. That's granted by the Constitution, and it's been granted by multiple laws that we've had. We continue, but I don't understand is that every year we come back and revisit this issue, and we continue to legislate this. I don't know of any instances of this happening and in Arkansas, and some of the things that happened have been in the past, and we've had multiple laws for this purpose. I'm not an attorney, but I feel like we have a lot of laws for this. I want to talk about one part of this bill, and I'll try to be pretty brief. When somebody plans to get married. That's one of the most meaningful times in your life. Representative Ray, I appreciated his bill that he brought to honor what marriage means to all of us. It's one of those milestones in your life. Getting born's a pretty big one. Graduating. Going to college, getting married, having a family. Lots of milestones that we have in life and marriage is one of the most important ones that we can have. Marriage is legal for everyone. It is legal for everyone and for To me, the least that we can expect for Arkansas citizens are that when they go down to the government office where they pay taxes to maintain, and they asked for a government document that is a legal process is that they not be made to feel other. That they are not made to feel like they're not as much of an Arkansan as all of us are. And this does happen, and this is harmful and this is a small group of people because that's what minorities are, small groups of people, and they don't have the same power that majorities do. I mean, we all know how the world works. I feel like this is legislating for some Arkansas, Arkansans, and not all. Yes, we all have some differences, some of them are religious. Absolutely. But I still feel like Every day I come up here, that every one of us have much more in common. than we do that are different. And I don't I don't have any preconceived notions that I'm gonna stop this today. I just am really asking you to consider these meaningful things that go on in people's lives and having this This government service that they May have access to. But they may show up and they may be made to wait. There's not gonna be a sign to tell them anything. If someone else in that office won't perform this service, they're gonna have to find someone who will, or they're gonna have to go somewhere else. And I, I'm sure that Representative Lindstrom says there's solutions to that. But I think sometimes things slip through the cracks. And somebody is gonna feel The most miserable they've ever felt on one of the most meaningful days in their lives. Um Things do happen. My, um Marriage day. It was almost ruined. Not by this, not by, not by this, something totally different, but that, that stays with you. So anyway, um, just having said all that, I'll be voting no. Thank you. Representative McCullough

Thank you, Mr. Speaker, and Representative McCullough did a great job articulating most of the concerns I have about this. I just wanna drive home the point that even though this is presented as a bill that prohibits discrimination and actually allows for it. So by protecting state employees in this way. That is effectively allowing the state. Because say employees are acting for the state, it allows the state to discriminate against members of the public. And so that's the way this bill functions and it allows the state to refuse marriage licenses, etc. And the same thing goes not just for state employees, but anybody licensed by the state. So for example, a psychologists can refuse care based on their religious beliefs and not have their license revoked. And so, and at a time when we're talking so much in this chamber and in the state about access to care, this goes the other way and will decrease access to care. And more than anything, it will increase discrimination and that's why I would urge you to

bill. Represented McCullough. You're always a lady, and I appreciate that. First of all, Imagine you're a cake baker and you've been asked to bake a cake for a wedding. And you decline. Thinking this is something I do, it's a solemn moment and I'm not comfortable participating and you wake up and find yourself being prosecuted by your own state, and then it goes all the way to the Supreme Court. That is wrong. Nobody should be persecuted for their religious beliefs, no matter which side of the aisle you're on, nobody should be persecuted. If somebody goes for a marriage certificate, they're going to get that marriage certificate, full stop. This requires somebody to ask for a recusal prior to, and if there isn't someone that can step in immediately, guess what? They're gonna get that marriage certificate. This bill protects everybody, especially the minority. And the person that needs that protection from discrimination. No one should be discriminated against ever. This is Arkansas's version of Live and Let Live, and I would appreciate a good vote. Representative Lindstrom is closed for the bill. The question before the House

Uh, colleagues, this, uh, Bill does exactly what the title says. It creates a technical feasibility study on new nuclear energy generation. Uh, the reason we need to do this, many other states. I've seen the Indiana and the Tennessee study. Uh, they've done this. Uh, basically what this does is it creates a boilerplate with, uh, you know, where sites can go, what's available, are we welcoming to new nuclear, so it creates that framework. So if we're approached, uh, by a company who wants to build a SMR or a micro, uh, then we're ready, we're ready to go and, and they can hit the ground running. So we need to do this study to maintain our advantage in nuclear energy. Uh, passed out a committee with no opposition, be, be happy to answer any questions. That I appreciate good well. Speaker. Colleagues, House Bill 1077 is a bill that was originally brought to me by the Arkansas Veterans Coalition with the support of the judicial council and assistance and input from the Arkansas Office of the courts, um, many of you may be aware that veterans comprise about 10% of our incarcerated population here in Arkansas. Of those jailed, about 70% of veterans are jailed for nonviolent offenses, 82% of them are eligible for VA benefits and 18% have experienced homelessness. Of those incarcerated veterans, many may not even be aware that they're eligible to receive benefits and that some of those benefits may help them reduce the overall time they'll remain incarcerated, connect them with resources to get needed mental health and or physical health treatment and divert them to veteran drug or other specialty courts. This bill establishes a notification system regarding incarcerated veterans and requires jail administrators, their designees or county veterans. officers to inform the VA that a veteran is incarcerated so that the process to assess their needs and facilitate appropriate assistance and services can be, can begin. The bill also requires use of a very simple existing system called VRSS or Veterans reentry Search Service, which is an online portal operated by the US Department of Veteran Affairs, which can be accessed free of charge. So when a veteran shows up in a VRSS inquiry, the VA Veteran judicial Outreach specialist or VJO responsible for that geographic area will typically go to the jail and meet with an incarcerated veteran. We already have the BJOs. This bill is not establishing them. The VJO's job is to connect incarcerated veterans with veteran services that could aid in the veteran's reentry into the community after release. These services aim to address the factors that make the veterans more likely to end up back in jail, like mental health or substance use disorders and the lack of stable housing. For jurisdictions that have an existing veteran treatment court, that BJO is an active member of the Veteran Treatment Court team and they can coordinate a veteran's court ordered treatment and counseling, arranged for beds at a VA operated inpati. facility for those veterans with more acute needs, work with the veteran to obtain housing and share with the rest of the team of veterans Progress through treatment. Using VRSS to determine whether a person being booked into the county jail is a veteran or not, triggering a visit from the VSO or VJO means that that referral process to get the veterans treatment or diversion through the treatment court or other diversion much more quickly. Research shows that the sooner you can get somebody treatment after an arrest, the more likely it is that the treatment will work and the less likely it is that that person will reoffend. The VRSS will help our treatment courts identify veterans who qualify for the program. We now have, uh, Sebastian County has one of the largest veteran treatment programs in the state, um, and so what we would like to do is use some of the data that we received from this program so we can identify other areas of the state that may need to duplicate their success and create their own veteran treatment courts. It's also better for the state overall when we can identify these veterans in the justice system because it's cheaper for the state of Arkansas if we're able to figure out a diversion program that's appropriate for that veteran, whether it's getting them into one of these diversion courts or getting them into one of the federally funded Veteran Health Administration facilities to get additional treatment instead of sending them to prison. This bill is one of the judicial council bills, uh, it is really a technical correction bill. It's a long bill, but part of that is because we're moving definition from one part of the code into this to make it easier to read and to follow. It's setting out some specific things, uh, for both the respondent in the for the petitioner and the respondent to know when they're seeking a protection order that these are things that the court Ma order, not necessarily will order. So it's just giving some clarity for the courts to be able to follow and to put everybody on equal footing. There is also a clause in there that's allowing under the Supreme Court Rule 88 to allow remote Our Zoom, uh, testimony. There still be that protection that they can confront witnesses and have all of that, but this is really an excellent bill to give everybody the opportunity to be on the same page when they're seeking domestic violence orders. And with that, I'd be happy to take any questions. Seeing no, I'd appreciate a good vote. Representative Darby has

you're recognized to explain your bill. Thank you, Mr. Speaker, uh, colleagues, many years ago, we had to split the state police retirement system into what's called tier one and tier 2 system because there were some financial difficulties at that time, ARS took over managing the system and we have come a long way and we have stabilized the state police retirement system. What we're trying to do right now is a first step in improving the benefits for tier 2. Tier one has 6 active members left in it. Tier 2 is where the bulk of the state police members in the retirement system are located. The benefits for tier 2 at the time that we split. We significantly less than the benefits for tier one. So what we've done in an effort to, uh, improve the benefits for tier 2 state police. is we are increasing the cost of the accident report from $10 to $25 the additional $15 will be what she used to fund the increase in the benefit for the drop program for tier 2 State police. So we're covering the cost. Of the benefit that we're giving to the tier 2 state police. So, and believe me, since the early 1990s, the cost of that report has increased significantly, sometimes they're 50 to 100 pages and take hours of time to Uh, prepare for those who've been in an accident. The people who are actually in the accident will not have an increase in the cost, but insurance companies, chiropractors, everybody else that wants a copy of it will pay the 25. Be glad to answer any questions.

to explain your bill. Thank you, Mr. Fisher, thank you, colleagues, um. HB 1657, really it's just an amendment to an existing uh structure that we used, it was used in uh 2021 to, uh, fund a uh pelletizing uh the palizing business down in South Arkansas. And what we're doing is we're just updating the, the The numbers and the dates on it, it's gonna be used for an expansion to the Green Bay Packaging facility in Conway, um, Conway County. The, uh, Green Bay is a, is a great customer. They've been our, our great industry. They've been here for 65 years. Uh, they're, they're great with the community, uh, and one of the major employers in that area. And as I mentioned earlier, 14 surrounding counties, uh, are affected by this. This is a $1 billion project. A billion dollar projects. I'm told that this is like the 3rd largest investment by private corporation in Arkansas. So it's a great, it, it, it's a great opportunity. I will tell you this also I worked as me, you know, I worked for Kimberly Clark Corporation, and we did projects and new facilities, upgrading facilities, and I can tell you, this is a 65 year old facility, and if you do not upgrade a production facility, you put it on a path. To, to slowly be shut down because newer facilities will be generated that will be more efficient facilities and when, when things get tight, the most efficient facilities get running. So this, this guarantees a long relationship and continues a long relationship with the Green Bay Packaging in Arkansas, uh, the project in summary is really uh Has some neat things. It's gonna actually use byproducts and bar to generate steam, which we use to to determine which will help with the generation of electricity for the, for the new facility also, so it, it's also kind of checking two boxes there with bringing some new generation, uh, into Arkansas and um with that, I'll take any questions. sheriff's association and the prosecuting attorneys Association. Under current law, the sheriff's department, which holds the evidence that seized in investigations is required to hold that, uh, evidence, keep that evidence in their. Uh, evidence room until the statute of limitations has ran for the longest offense. Well, in some of these cases, there are no statute of limitations and they're holding evidence on cases that they've not prosecuted. Or that have come through court for a long period of time and they would like to dispose of it. The common practice in Arkansas is that what's been happening, just to be honest, is that The prosecutors have been getting court orders allowing the sheriff to release that property or otherwise dispose of that property, but there's been no real statutory authority for that. And so this bill says that They have to keep it for that same time period as the law currently provides unless the item is released by an order of the court or released by the prosecuting attorney because there will be no prosecution. Pursuant to the felony criminal investigation. That's what the bill does. Happy to answer any questions. Seeing no to appreciate a good vote. Thank you. Representative Gazaway has explained the bill. me by the Chief Deputy prosecutor in Benton County based on his experience, uh, frequently, frequently we see victims from other states that were trying to flee their abuser and come to Arkansas, often, uh, women, and the offender then follows them to our state from Oklahoma, or Missouri, etc. And although there are repeat offender and they have arrests and convictions in other states. There's concern that we can't enhance their penalty in Arkansas based on a technical gap that's in the code. So this bill tries to address that apparent gap, uh, for previous violations of an order of protection that occurred outside of the state of Arkansas. The intent of our law is to clearly is to provide more punishment and accountability for repeat offenders of violations of orders of protection. But unfortunately, our law Uh, in our current statute says that uh those offenders, um, they have to have a violation under this section. So it's referring to that section of code. And all this is doing is clarifying that if it's under this section or if they repeat offender, um, from an equivalent jurisdiction outside of our state as well. So it's just clarifying that, that case, we want to make sure that these, uh, victims are protected and I'd appreciate a good vote. Representative Underwood has explained the

And once they're found guilty, they, uh, they have an option uh their driver's license is suspended for 6 months, but to have an option whether or not they want to drive on a suspended license or have their license suspended, but if they want to continue to drive, they have another option they can have an interlocked system placed in their vehicle. We're not changing any of that law. The only thing that we're doing is amending that law that when that license is suspended for 6 months and you have an interlocked. installed in your vehicle that for the 1st 4 months of that vehicle if you attempt to start that over the limit that it's calibrated to, that is not a violation counted against you. But during the last 60 days of that 6 month suspension if you attempt to start that vehicle over the limit that's currently in law now that's calibrated by the health department. If you go over that, that's considered a violation. Now, I considered actually making uh. Putting a criminal offense into this, but then I got to thinking about it, decided, you know, the last thing we need is to get these individuals back before a judge and get them back in the system. So the, the, the decision I made was, is to extend the time that the interlocked system would have to be in their vehicle. I'm not looking for them to get an additional charge, colleagues, what I want to see is these individuals make a behavioral change. So there's no violation against him in the 1st 4 months, but if they're still trying to start that vehicle over the limit in the last 60 days of that 6 month suspension, obviously, they hadn't, they hadn't really, it hadn't soaked in at the seriousness of what you're trying to do. And when you consider we had 602 people killed on our highways last year and 140 of those were in alcohol-related accidents, uh, we need to do something to try to get these individuals to make that. behavioral change. So that's the only amendment we're doing. We're not changing any of the other standards in the DWI law we're just extending that, uh, for that additional 60 day period that they have to keep the interlocked system in their vehicle that I'd take any questions. in 2019, we created a National Guard tuition waiver program. It was created, uh, to allow all enlisted in officer personnel, both the Army and Air National Guard who haven't been previously awarded a bachelor's degree in residence of the state, uh, basically to allow them to have waivers for tuition at our state supported institutions, uh, for fiscal year 24, we had 447 guardsmen and women who took advantage of this. Uh, it allows, it, it actually is one of the guard's largest recruiting tools. All this bill does is it house, uh, a guards, uh, guardsman or a woman to take this and utilize it at a non-public institution. So for instance, Falander Smith or Washingtonall Baptist John Brown University, that institution has to accept, uh, Title 4 federal student aid, uh, to be able to do this, and this has zero impact, uh, zero fiscal impact with that, I'd be happy to answer any questions. Good afternoon, colleagues. Um, This bill 1847 is a measure aimed at enhancing responsible gaming practices in Arkansas. The bill authorizes the Arkansas Ration Commission to establish and maintain a statewide self-exclusion list for individuals seeking to voluntarily exclude themselves from casino facilities. Gambling addiction is a serious issue that affects individuals and families across our state. By creating a centralized self-exclusion list, we provide a vital tool for those that are struggling with gambling problems to take the proactive steps towards Recovery. This initiative aligns with responsible gaming practices and demonstrates our commitment to the well-being of our citizens. Um, under this bill, the racing commission will maintain a comprehensive list of self-exclusion, um, they will also collaborate with a multi-state list if other states create their own self-exclusion list, and they will protect the confidentiality of individuals who are on the list because we have put this under FOIA. And the point of this is that Currently, if you want to exclude yourself from a casino, you go to the casino, you have to show your ID and you're excluded from that specific casino. So, but if you want to be excluded from another casino, you have to drive across the state and go to that casino and do the same thing. And so in a moment of weakness, you may only go to one casino to show your ID to be excluded, but if they reject you, you're probably willing to drive across the state to another. And if your purpose was to not go into a casino, this will help you do that. So now you go to one casino, you show your ID and if you choose to opt in, it's good for all the ID, all of the casinos across the state. And that's the purpose of the bill. I'd be happy to take any questions. Representative Wooldridge, for what purpose? Question. You're

you, Mr. Speaker. Colleagues currently in Arkansas cities, uh, with a population under 5000 can opt in to being a city of the 2nd class. Most don't because cities are the first class, um, being a city of the first class comes with a lot of benefits, but it also comes with some costs. And so what this bill does is it ups the threshold to 7500. So if this bill passes, cities that are between 2500 and 7500 can opt into being a city of the 2nd class, um, in particular, just some examples. of additional costs or things like, um, city attorneys. City attorneys are required for cities of the first class, but not cities of the second. So this bill will just help our cities, um, save a little bit of money if that's what they want to do, if they want to, um, go ahead and grow a little bit more before making those hires. It's all the bill does, and I'd appreciate a good vote.

already a, a way for volunteer firemen, volunteer fire departments to attach their fire dues to property taxes. The, the process for that is they petitioned the quorum Court to allow that process in Arkansas now, we have some small city volunteer fire departments who have parts of their fire district outside the city limits. The way the law is currently structured, those city volunteer fire departments don't have the same opportunity to Petition the quorum Court to put their fire dews on the property insurance of those folks that are living outside the city limits. This just creates that opportunity for them that are, uh, pure, uh, non-city volunteer fire departments have. It doesn't put any extra tax on anyone. When I originally drafted the bill, there was some language that was maybe creating a loophole where municipal fire departments can come out into the county, we close that loophole. I think this is very specific now just to volunteer, uh, city fire departments that have have some coverage out. Representative Long, for what

Um, so you, you're supposed to pay your fire dues. This just is a mechanism to ensure that they get paid and we're just equalizing that opportunity. Uh, they incur expenses, of course, so they have to pay for gas. They have to have wear and tear on their vehicles. Uh, they incur a lot of expenses. The fees that they're able to charge have not been raised in 25 years, and I want to make clear that this bill does not raise those fees. What it does is it simply allows them to, if they have to make multiple trips, they get to charge. Her attempt, which is what private process servers do. I use private process servers regularly. They charge per attempt. Uh, our sheriffs are receiving far less compensation than what my private process servers charged me. And as you know, costs have gone up, gas has gone up, costs of wear and tear tires, you name it. But our sheriffs aren't getting any more money. And so this will help them out. What this does is it means certain laws concerning marriage certificates and bonds here in Arkansas, um, the bill specifies that individuals obtain a marriage license, uh, you know, you got to return it to the county clerk's office when 60 days of when they first issued it, um, if the license is, you know, execated, um, executed or signed by authorized pres person and return, um, It's it's Um Well not returning specific time frame, um, of course, it's not any good, but There are some cases where, um, it might get lost or destroyed or burned, um, and so what this does is makes new procedures for making, um, a new certificate if both parties are living, they have to submit a notarized affidavit to the county clerk stating the details of their marriage, um, loss of the original certificate if one party is deceased or incapacitated, then surviving party can request a new certificate, um, with a notarized affidavit and a part. Parties are deceased or incapacitated and the heirs can request a new certificate, um, with the proper paperwork. Um, sets a $10 fee, um, for all this and a new bond required under the existing law is waived if the replacement certificate is requested. Um The new certificate of marriage shall be filed with the with the county clerk who's gonna record it, um. I was in Missouri yesterday at the Capitol, and they envy our public lands that we have that are protected by Arkansas game of fish. And all this bill does is updates the dates of that protection start from August 2005 to January 1 of 2025. And you ask yourself what that means. What that means is our public lands have grown, so we have more acres today. than we had back then. So by moving this date, we make sure that we're protecting all of those lands. The other thing we did is we added lease lands into this protection. They had never been added before, which we didn't have any leased lands in 2005. But we added a fiduciary clause in there, that way if the leases get too expensive for the department to maintain, they're allowed to break out of those leases at that point. But they're only allowed to do it at that point. The other thing we had in this bill that wasn't in the original bill as a report to Arkansas Game and Fish. Representative Matt Brown Unverified 1:36:11
Mr. Speaker. This is a bill that was brought to us by poultry farmers. I was gonna wing it, but I'm gonna check it out. So, back in 2003, uh, the General Assembly Pass Act 1061, which helps control nutrient runoff from poultry farms and certain protected watersheds. Uh, pretty much that act requires that if you have a poultry farm in a protected watershed, then you have to comply with the Nutrient management's plan that has been put in place by your local conservation district and the Natural Resources Commission. This bill simply provides that if you are complying with that plan by which by law you have to comply with that lawyers from third parties can't sue you. Now, why do we need to do this? Well, to keep you abreast of the situation. Plaintiff's lawyers in Oklahoma have made an industry of suing these poultry farms even though they're complying with their local plans and their state law, and they're starting, we're afraid they're starting to come do it here in Arkansas, so we will protect our poultry farmers. These plaintiffs' lawyers are, to put it frankly, bad eggs. Give the rest of us lawyers a bad name. This bill also provides that if you are complying or trying to comply with your plan, and let's say you do get out of compliance, you, you put out 100, 101 units of nitrogen instead of 100 units of nitrogen, instead of suing you in federal court, the remedy is, is the state agency comes and they can find you, they can get you back into compliance, because the whole goal is to, is for compliance and protect our poultry farmers so they're not getting sued out of existence and they're growing our food. So in closing, Please don't do our poultry farmers foul. This is an eggcellent bill. Peck that green button. And give me, I really appreciate a finger licking good vote. Nice. Representative Brown

explain the bill. Thank you, Mr. Speaker, colleagues. So this is a really simple bill, um, in 2023, we unanimously passed the governor's natural state initiative, and one of those, one of the tenets of that bill was to expand economic growth near our state parks. So we created some opportunities zones just near the state parks, um, and we put some incentives in there. Unfortunately, we've had some interest, but we've had 0 takers, so no one's actually taking us up on the investment. So what, what this bill does is it just decreases the minimum required investment to get the opportunity zone benefit. So that's all this does. Um, again, we actually voted, we got 100 votes on this last time in 2023. This was part of the Governor's natural state initiative. It's supported by AEDC and Parks of Tourism. Representative Frances Cavenaugh Unverified 1:41:17
Thank you, Mr. Speaker. First of all, I just want to make sure everyone understands this is not a bill to burn crop residue burning. This to ban it. This is a bill that will help regulate it. Um, currently, there's no regulations on it. Uh, there were self-regulation and we have not had the best luck after that self-regulation, we've unfortunately had an accident where there was loss of lives in a multi-car park up because it's a smoke from, um, An unregulated. Improper burning. And I say that because by far, most farmers try to do it properly. And it is a valuable tool for them to be able to use in their business. But we currently have an issue with people not following smart guidelines. And what this does, it's a simple bill. It says that they shall. and report to the Department of Agriculture, a crop burn, and if they do that and follow the guidelines for the smoke voluntary program that we're developing that the ag industry will be a part of, then they will get liability protection. And that's really all this bill does. Now, let me say, There's been pushback from some farmers. Some farmers like it, some farmers don't, some industries are OK with it, some aren't. But in my district, I'm the epicenter of a problem in the state of Arkansas. It's a quality of life problem for my citizens. I have Soccer games that had to be canceled because of the smoke. I've had businesses, I've had to close down because of the smoke. I've had wedding canceled because of smoke and I could go on with the list. But I say that because if the burn is done properly, none of that happens. And this is a way that we can start the process to make sure that both sides can live together in peace. The farmers can do what they need to do, and they desperately need to be able to have the ability to burn. But we've got to have it done in a proper way where the citizens can also live in the same area. Um, we're going to be making it an amendment on the Senate, because when you talk to the state, you'll hear people down in the South say, this is not a problem for me. But you hear in Northeast Arkansas, the corner where we're at, it's a problem. So we're gonna make an amendment that's going to create a zone, and it's only gonna cover the areas that the problem is happening in, similar to what we did, and I know, I'm gonna have to say this word and everybody that's in our farming industry is going to cringe similar to what we did to the guy Caba issue. And none of us in Northeast also like to talk about that either. But, um, that's really what the bill does, and I will

impact him? If they call the sec that they call the department and report the actual burn, and they follow the guidelines that they're going to be developed through them and the Department of Agriculture, if they follow those guidelines, they will have protection. And inside those guidelines, there will be guidelines about burning close to a highway. OK, well I wonder if the wind changes and
▶ Play Suggest a correction Report an error
Representative Jim Wooten Chair Unverified 1:44:54
they approve it under the given the conditions that he's in then, and then it changes halfway through the burn. But the app that's being developed and
▶ Play Suggest a correction Report an error

the guidelines will take all that in consideration and they will start looking at meteorological information about wins and which way they're blowing, all that's going to be built into the app that they'll be using. Thank you. Thank you Mr. Representative Wooldridge,

that, that there's definitely an issue in Northeast Arkansas, and I applaud you for trying to solve it. I, I'm not sure this is the solution, but my concern is, We're agreeing to make them call and get permission via some version of guidelines through an app, but we don't know what those are yet. So when will they be developed and then would there be a way that those guidelines could have been developed prior to us making this requirement in law. Well, first of all, this bill does not require them to get approval. This bill
▶ Play Suggest a correction Report an error
Representative Frances Cavenaugh Unverified 1:45:45
does not say that. This bill says they will just call and report. That's all they have to do. They don't have to get approval from the Department of Agriculture to do it. And it says that they will, uh, follow guidelines, then they will get their liability protection. This act does not become effective until July 1, 2026. So we've got a full year to work on them. And we did that on purpose so that, that the industry could work together with the Department of Agriculture and come up with the proper

guidelines. I appreciate that that is helpful. Thank you. So, from the approval standpoint, they're going to call, they're just calling to report that they're burning. They're not being told you can or can. can't burn today. No. OK. And they, and they don't

This is a very important subject and it's, it's crucial that our farmers who practice burning, uh, do so the right way. Um, I'd just like some clarity. As to the fact that if They check in with the ag department, and the ag department Cannot and will not tell them that it's, they can or can't burn. How does this solve the problem? Because they already have the app. But it seems to me that this mandate to farmers.

Well, unfortunately, farmers have been doing this for generations, but as farming has developed and we grow different types of crops. The smoke is a lot worse than it used to be. Calling and asking the Department of Agriculture or just, they're not even asking the Department of Agriculture. They're just reporting to the Department of Agriculture, they're doing a burn. And then they follow guidelines and they get liability protection. I see this as a protection for the farmer as much as I do anybody else. And this is the way that they can continue as long as they do it the proper way. And I would say the vast majority, as we know, do it the proper way. But currently, we have a real problem in Northeast Arkansas with smoke management, and this is a way to try to deal with

I've heard from people in Northeast Arkansas just as you have, uh, that we need to, we need a solution to this because this is a serious issue. The concern that I have is about the liability protection. And it sounds like if someone calls or uses the app. And they're told that conditions are favorable and they burn. And I'm just imagining a scenario where they're told conditions are favorable and that may or may not have been a great call. There's smoke all over the interstate. We have another 5-car pileup and dead people. The farmer's not liable. Maybe we find out now. It sounds like under your bill, the farmer would not be liable. We then find out that maybe it wasn't the most favorable conditions to burn. There's 5 dead people. And the state of Arkansas has sovereign immunity. How do you see this situation

playing out? Well, I think as we develop the guidelines inside the app and with the small guidelines that we've got the ability to tweak as we're going forward, that you provide for the conditions that if you're near one of those major highways or roads, that there'll be special guidelines for burning toward those. And I assume that will be all part of the guidelines, because I'll be honest with you, most farmers already use those guidelines. Unfortunately, what happened in Jackson County. many of you may know that we have an Alzheimer's disease and dementia advisory committee that meets. for the most part. Well, in July of 23, we learned that there is a new medication out on the market for Alzheimer's disease that has not existed before. Anything that's ever been out there has been a behavior modification drug. This actually treats Alzheimer's disease by getting rid of the amyloid plaque that's in your brain. I'm not a doctor, don't ask me too many more questions than that, but we had a man yesterday testify in our committee that's been using. He started in October, and he has seen a dramatic difference in his life and so has his wife. We want to make sure and the committee agreed, um, that we want to make sure that Our public employees. State employees, our school employees have access to this medication. Right now, if you are on Medicaid. If you are on Medicare, You can have this medication. If you have private health insurance, if you have Centene, if you have the United Healthcare. You also have access to this medication. If you are a veteran, You have access to this medication. But if you work for the school district, if you work for the state, You don't have access to this medication unless you want to pay out of pocket. Now, let me explain what this means. This is a medication that few will actually qualify for because it really is only effective if it's early onset. Alzheimer's. You have to catch it at the earliest stage, OK? So imagine a school teacher. Who's 55 years old. And gets this diagnosis. That school teacher might be one year away. From getting full retirement, 27 years, she's been teaching classes. She's one year away. She gets this diagnosis, she cannot take this medication. She's probably going to have to stop working. This medication would actually allow her to continue to work. And get up to that 28 years to get that retirement. That's one of the reasons why

want to do. But kind of give you guys a little history numbers. When I got elected in 2011. We were looking at EBD and EBD 2013. This chamber was under remodel. And they called us in for a special session for one reason, and that was to fix EBD. Speaker Carter and a group of members worked really hard. And move some deductibles around, they kick some people off the plan, which was a sad thing that that happened and in a few years we ended up with a pretty large surplus at EBD. About 2.5 years. And then the following 2 years we had a number of these bills just like this, they came to to session and tugged at our heartstrings and we passed those bills and we ended up in about a $40 million loss. We have a committee over at EBD. We use UAMS. It's, that's where his committee resides. It's called EBRX. They look at these drugs and they see, you know, if the benefit outweighs the cost, and then they put them into our plan. This drug's not been through, not been through that committee yet. The other thing that happened is in 2018, we had to start a study group. We fixed EBD again. We now have a small, lot smaller. So I, I asked you to trust the system. Let the system work. Let the drugs come through the right channels, not through dictation of law here in the chamber where we're not medical professionals, let it go through the right places and let our system be solved with that I ask for no vote. And you know, we have all kinds of people come to us with issues, and we, we have to make tough decisions. But we had a coach that came to committee and talked to us. He's on this drug. And he, he said he went and looked up on the internet, what is the worst disease to live with. You know what it is? Alzheimer's. He, I think it was him, maybe I'm wrong, but somebody that spoke at the end of the table, said, when I was diagnosed with Alzheimer's, I would have much rather said they had cancer and I was gonna die in a year. That's how bad this disease is. It is the worst. Disease. And it is expensive. OK. I think there was an estimate it might be $90,000 for treatment. But folks, when I had my first bout with cancer, it was over half a million dollars. And it was caught at the 2nd stage. So if this is caught early, If my cancer, I'm just slowing that as an example, but it had, had not been caught at that stage, it might have cost a million dollars. So, if this is caught early, even though it's expensive, It could save money on the back end. We don't know that. But there are people that need this help right now. And I have tracked these two drugs. Through the process through this testing process out there for over 3 years. And this is the first drug. That has ever shown any Any Good results for Alzheimer's. So I think this is the one that we have to vote for. So I'll be voting yes. Representative Ladyman has spoken in favor of the bill.

House Bill 1150 will effectively prohibit pharmacy benefit managers in Arkansas from owning a pharmacy license. As many of you know, I've talked with several of you on this subject. I may represent more pharmacies than in any other statehouse district. Um, at one point it was 12. A lot of people have talked to me and said, this is a strike against vertical integration. And you know what, vertically integrated companies are great. That's a really great way to do business. Look at Tyson Foods. Look at so many of our excellent farmers in this country, vertically integrated operations. They create the product. But Tyson Foods does not set the price of chicken for Simmons, OK Foods, uh, Georgia's mountaineer, Sanderson Farms. They do not set the price of their competition. In this regards, pharmacy benefit managers do. The Federal Trade Commission, as you well know, has issued multiple reports talking about predatory pricing, uh, patient steering. And just robbing And lining the lining their pockets with money from the patients and taxpayers. And one particular instance. Independent pharmacists was reimbursed $97. They reimbursed their own pharmacy $19,200 for that exact same drug. crony capitalism at best and our right. It's a pretty complicated issues, and I've been over backwards to make amendment after amendment, uh, to get all parties. As much as possible on board. Hospital Association is neutral. In fact, several of their members are an outright support of this, including Carta and Highlands Oncology. If you see my rather serious demeanor today here at this well. It's because when I filed this bill 3 months ago, the very first week of session. Since that day, Why after lie after lie has been spread about House Bill 1150. I'm sure you've all probably heard from constituents, um, Gotten an email saying, hey, we don't want you to shut pharmacies down for 2.7 million Arkansans. We don't want to lose our access to our prescription drugs. I've probably had well over 100 closer to 200 constituents, reach out and ask me. Don't shut my pharmacy down. And, and when I asked them, what pharmacy did they go to? I say, oh, you're from Stuttgart. You, you must go to Coker Hampton or Berkle Drug or professional pharmacy, all of which are great friends of mine. And they say, yeah, I do. I go to 1 or 2 or all three of them. And I say, I'm running this bill on behalf of those pharmacists, because what is happening to them and their business. I could go on, but I feel like you all understand the issue pretty well.

I very seldom come down here to talk about against the bill, but this kind of hits close to home. For one, being in Jacksonville, home of Little Rock Air Force Base, Tricare members, military members use Express Scripts. Express Scripts is a PBO, PBM owned pharmacy. If this goes away, Tricare would end up having to change all of that, which y'all know the federal government, they can't do a contract with another PBM before January 1 of 2026. So you've got thousands of military members who would end up being Totally messed up on their pharmacy. My mother being one of them. She's a retiree, uh, she's not a retiree, she's a dependent of a retiree. So, I look at this and being that it's actually in the line of work that I do day in and day out. My phone will ring nonstop from July, or actually starts in January from then on. So, I'd appreciate a no

Representative Wootton, you're I speak for the bill. Colleagues. I'm gonna try not to use my coaching voice. Coach McGruder. Let me share with you. One pack. Every one of you have probably received. These emails that represented Moore spoke of. After the 1st 3, I realized they were all the same. After the 1st 100, I realized they were all the same, saying the same thing. I bet I got 300. In the middle of the night. Early in the morning. So I started texting to the one that had their name. And they're direct email. I been responded to 100. Emails Ask one question. Did you send me an email? You know how many responses I got. 0 Not a one. I bet the PBMs have NBs uh Ss, I bet they have spent over $2 million. To try it only time. In the nation. We're the only one. We've seen it. I've heard from the pharmacists all over this day, all over and they've explained to me that it's gonna put them out of business. 50% of the pharmacists in BB. have told me That they will be out of business. If it continues one shared with me. A pharmacist shared with me that they pay $99. For a particular drug. And they had to sell it for 90. Because the PBM undercuts them. And has a way to another pharmacist that they own. To be able to meet that demand. And the reason that they do that is to maintain that customer. But it can only do so much. So I urge you. To vote for. I totally understand vertical integration. Totally. Because I worked for one of the largest vertical integration companies in the nation. Or was it distributor? This is not vertical or competitive making a marketplace non-committed in the favor. Of the floor of this bill. Thank you.

Representative Perry, I'm sympathetic to that. Um, I, I would argue that having negotiated with Express Scripts, the reason that Express Scripts is isolated themselves where they have is because they've kicked out any competition. Um, thankfully, Walgreens has negotiated their way back in. So as Kroger, um, as well as the VA is available to fill those and the fee of Boots on the ground accessed for Tricare members. I speak about this bill from, from 3 different lenses, uh, as a provider. Um As a legislator and then also as a patient and the spouse of the patient. As a provider, I can attest, these are egregious tactics wherein they are systematically removing competitors so that they can leverage themselves as a necessity when they are the reason that access has been limited. As a legislator, many of you are still here when this body passed these first laws back in 2015. They fought those here, they fought them up to the Supreme Court where it was upheld 8-0. They still didn't stop breaking those laws from 2015, as recently as 48 hours ago. These entities have no respect for this body, for this state. They see no patients, they care for no patients. And no matter how many times we have aired on the side of them to be good actors. They have proven themselves. Through the thousands of complaints that I have personally filed in the last 12 months. That they have no respect for this body. Many of you know that I You need to go through my cancer monitoring and then I My wife continues to go through her treatment. And when Carti Who isn't a pharmacy. Comes and says this has seeped into our ability to uncomplicate where we see more cancer patients than anybody in the state. And we see it firsthand that this issue has migrated into our ability. To care for patients. And when we leave here today, and tomorrow over the weekend, Tuesday morning, I'm gonna go to Kharto with my wife and we're gonna receive another treatment. And to think that these entities Who for 10 years have thumbed their nose at this body. have now reached their tentacles into that space and jeopardize their ability to simply uncomplicate healthcare. To me makes this issue very clear. And with that, I welcome your questions. Representative Hawke, for what purpose?

I respect your opinion as a pharmacist, and you know that as somebody that's on special, uh, farm like uses specialty pharmacy. So, once it goes away, the mail order goes away until Tricare is able to negotiate another contract with another provider. So, basically, we have to go, if a, if a beneficiary has to go to a local pharmacy that they been receiving these prescriptions, a lot of them at a zero copayment for 90 days, they'll have to go to a local pharmacy and pay a higher rate. That's not entirely true. So

Express Scripts is a PBM that has contracts with Walgreens, with Kroger, with independent pharmacies, with the VA, with the Air Force Base. Mr. Speaker. I'll be brief. Um, I, I detest PBMs. I think that their existence reflects uh A federally mandated government inefficiency. They are a middle man and after watching the hours of testimony. There's middlemen within the middlemen. Um. This bill does not solve that market inefficiency. This is a problem the feds created, and the feds will have to fix. This is a band-aid on a flesh wound. The real reason I'm coming down here today is because within my district, I have 2 pharmacies, both non-PBM, non-independent, two owned by grocers, um, within the area that I consider that the zone of commerce right outside of my district that most people have to do any type of shopping. There are 3 more pharmacies. Of my 5 pharmacies that I would say service my constituents. 2 will close with this bill. Patient access. We can sit here and this is often a debate that happens in between these marble walls. If we pass this bill, your constituents, my constituents will have less options. mean, this is a tough bill, but I think we're talking about what ifs about these pharmacies closing if this bill passes. You know, In committee, I talked about this. I think we're dealing with the top a monopoly or a monopolistic. Action by a by corporations where they're vertically integrated. There's nothing wrong with that, being vertically integrated. But when you control the pricing from the manufacturing to the retail store. And you control that for yourself and for your competition. That is a monopoly. Or maybe it's monopolistic, at least. And that's what we're dealing with. But when you talk about I'll just say it's CBS is an example. Everybody's talked about that. And let me say, we talk about small pharmacies, and in my district, I've got 6 small pharmacies. I've got 5 large phar pharmacies, other than CBS and I have a CVS. This is even affecting the other large pharmacies. These actions, like the Walmarts and the Walgreens. The actions that these companies are taking are affecting those other large pharmacies. It's Not competitive. They're taking a competitive advantage over other companies their size. So, but there are options for these corporations that are gonna have to divest of their retail businesses. And coach, I'm gonna use my coach voice. Because it's important. You know, when you're about to lose the game, you got to use your coach voice, right? But anyway, uh, They they We have got to Make it a fair level playing field in this industry. And folks, it is not fair and level now. I have 2 of 6 pharmacies in my district that have told me they'll close. They were closed. But the corporations, they can set up uh in uh Independent subsidiaries. And still maintain Income. They can set these pharmacies up as an independent subsidiary of their Umbrella company. Right? So there's options to this other than just closing these, these retail outlets or moving out of the state. So let's don't, let's don't vote on the what ifs. Let, let's vote on what's really happening here. For that reason, I'm gonna vote for it. Representative Wing, for what purpose? question. Representative Ladyman who

I think everyone's about ready to vote, and I, I hate to belabor the point. It's one of those situations where everything's been said, but not everyone said it. But I do feel like I need to at least make some remarks about this. I do want to say I, I agree in large part with Representative McKenzie, uh, it's one of the biggest problems that we have with this issue is what happened at the federal level. The merger between the insurance companies and the retail pharmacies that was allowed to create this vertically integrated business model never should have happened. And now we're left in the situation to clean up the mess. So number one, I agree with Representative McKenzie on that point. I also agree with Representative McKenzie that about this bill that What Representative McKenzie said about having less choice. However, Representative McKenzie said if we pass this bill, we'll have less choice. I actually think the opposite is true is true. If we don't have passed this bill, we're going to have less choice in my city, we have corner drug, we have City drug, we have hides, we have Walden, We have other independent pharmacies. That are on the verge of closing. We also have CVS and Walgreens. If we don't pass this bill, the city of Per will a 30,000 people is gonna have two pharmacies, CVS and Walgreens and Walgreens is in doubt. We may have one pharmacy. And so I urge you to pass this bill for choice for our constituents, for consumers to protect our independent pharmacies and to just stand against this abomination that has happened with the PBM industry. Moreover, This is not gonna mandate pharmacy closures. They can remain a pharmacy and drop their pharmacy benefit manager license, or they can sell their pharmacy and liquidate it. But I'll just read you this quote. This is from the FTC report. The 3 big PBMs reimbursed their affiliated pharmacies at a higher rate than unaffiliated pharmacies on nearly every specialty generic drug examined, period. These folks are reimbursing themselves at higher rates than their competitors and reimbursing their competitors at or even at times below the cost of the drug. It's wrong. It's crony capitalism. Thank you, Mr. Speaker. Colleagues, you ask yourself, what is this amending? It's, it's moving the cart team, which stands for child abduction Response Team out of CJI Criminal Justice Institute, back to the Arkansas State Police. You ask yourself why? Because the state police informed teams across the state. We are simply taking the education and awareness to the regions rather than the officers having to take the time off to come to get the training. And with this, the collaboration we want to have the attorney General's office, Arkansas State Police, Arkansas Game and Fish Commission, the Criminal Justice Institute, Arkansas sheriffs, Office of Emergency Management, Arkansas Chiefs, Corrections Office of Prosecutors. At one time, they were all involved, and you would be amazed at the response and how quickly That, that all of these, when they're working together in the right hand knows what the left hand's doing. It's amazing. And so that's all this bill is simply trying to do. And, uh, you have my word that I will watch this and I want our child abduction teams to be the best in the nation. So with that, I'll take any questions. Thank you. Representative Pierce has explained the bill. Would anyone like to speak against the bill?

Mr. Speaker. Today I rise to present House Bill 1896. Um, the junk Fee Elimination Act of 2025. This bill is straightforward step at reducing unnecessary costs for Arkansas taxpayers while streamlining government operations. At its core, uh, House Bill 1896 abolishes the Information Network of Arkansas. It's an outdated entity that has been that has imposed additional transaction fees on citizens for accessing public services electronically, uh, by transferring its remaining duties to DIS, the Division of Shared Services. We eliminate the redundant bureaucracy and consolidate services under a more efficient framework. This move cuts out the middle man, reducing operational overhead and that, and uh most importantly, those extra fees that hit our taxpayers' wallets, um. For example, fees tacked onto court fines, driver's records, background checks, payment processing fees, costs that Arkansas shouldn't have to bear can be reduced by paying, by voting for passage of this bill today. Um, DIS already is equipped to handle these responsi responsibilities ensuring no loss in service and service quality while delivering savings through economies of scale. This is about making government work smarter and not harder for the people we serve. Um, House Bill 1896 is effective January 1st, 2026, giving us time for our government to transition smoothly. Uh, I urge you to support this bill. I'd be happy to take any questions. Seeing none, I'd hope for a good vote. Representative McKenzie has explained the bill.

Basically, what it does is it requires any representative of a non-US entity or a foreign supported political organization to register with the Secretary of State. Thank you, Mr. Speaker, HB 1898. This combines the ABC enforcement, ATC enforcement and regulatory enforcement division, so ABC is the alcohol, ATC is the tobacco. So currently, I'll give you a prime example. Most of you guys know I own a liquor store. I also sell tobacco. When they come in and do their enforcement on me, they have to send one agent for alcohol. They have to send another agent for tobacco and so forth. These guys are already cross. trained, and so instead of sitting 3 guys out or 2 guys out, they can send it to one law enforcement officer. This also provides licensees like myself, permit holders, Industry stakeholders, clarity for knowing who they're interacting with in the field and who to call if they need assistance. It creates an identity and a unification for the agents who will work for both ABC and ATC and allows them to refer themselves to the clearer name and clearer responsibilities and also have a chain of command. It provides structure for the agency if the legislature as additional, uh, responsibilities and regulation. It does not add more personnel. It does not add positions. It does not affect GR doesn't change special revenues and it does not add any other regulations. I know the title is a little bit misleading, but that's what it does. ▶ Play Suggest a correction Report an error

Thank you, Representative McGrew. So, To answer your question, currently with dual agency. When you represent one person, so when you represent just one person, you have You have a fiduciary duty. Sorry, it's been a long day, to that, uh, client. In that listing agreement, though, when I list property, In that contract for me to sell their property, they have the option of clicking a box or checking a box that says, I do not want you to do dual agency because By and large, they checked the box that says, I want you to do dual agency because they want me to sell that property to perhaps one of my buyer clients. So when I represent the buyer and the seller at the same time. There are certain things that I have cannot disclose to either party. Um Those disclosures are not detrimental facts, but that may be the buyer's necessity of them to sell their property, uh, by a certain deadline that will potentially put their needs in jeopardy. you, Mr. Speaker. Colleagues, so, uh, this came about through the Arkansas Realtors Association because, uh, there are two codes in law currently that define a real estate agent, right? And it talks about an agent, and then it talks about a dual agent. And there's nothing that combines the two. And to your point that you were just talking about, when you have a dual agency, you are, you, you have to make both parties sign to to be OK with the dual agency on the front end, right? So both parties have to agree to allow for the dual agency to happen. And once that happens, you've got a fiduciary duty to both parties so that you can't, so if I've got a buyer, I can't say, well, Mr. Seller, this is what the buyer's gonna do. All this does is help ingrained into the law so that the courts, whenever they see a dual agency on the on a docket or something like that. We have a defined term, we have a defined law on what dual agency is in Arkansas. Does that make sense? I appreciate a good vote. Representative Hawk spoke for the bill. so Arkansas House Bill 1934 is known as the Arkansas Forward Engagement Committee Act and it establishes the Arkansas Forward Engagement Committee working group. The purpose of this group is to review state spending as well as regulations to identify and eliminate waste, fraud, and abuse to improve operational efficiencies to optimize the use of public resources and to foster a regulatory environment that supports economic growth. The working group will consist of members such as secretaries from various agencies. and departments, members appointed by the sec um, secretary of the Department of Shared Services and members of the House and Senate. All members will work without compensation, including no per diem for legislators. This working group is required to submit a final report of its findings and on the recommendations to the Speaker of the House and the president pro tem.
