Members I rise this afternoon to present some comments about a distinguished businessman, a philanthropist, and a very benevolent native Arkansan, now as the nominee to be the ambassador of the Court of St. James, our Arkansan, Mr. Warren Stevens. Throughout his storied, successful career, Mr. Stevens has demonstrated exemplary leadership in driving unprecedented economic development in Arkansas as the Chairman, President, and Chief Executive Officer of Stevens, Incorporated. He has been recognized for his outstanding achievements in business and leadership as a member of the Arkansas Business Hall of Fame. By his extensive experience in finance, business, and international affairs, Mr. Stevens is well prepared to strengthen both diplomatic and economic ties between the United States and the United Kingdom. I truly appreciate your kind and humbling words, but before I begin my remarks, I want to take a minute to say to our fellow citizens affected by this current weather and tornadoes that our family are praying for you, and you will continue to be in our thoughts and prayers. I know Governor Sanders and everyone in this room is trying to assess the situation and provide every resource possible to assist you and your families in this time of need. I have great pride in being in Arkansan. I wear my Arkansas heritage as a badge of honor, which makes being recognized by my state's elected officials so special and meaningful. For being here in the house has a little extra significance to me, as my late Uncle Whit was once a member of this distinguished body, as was his father, my grandfather. And I'd forgotten about it until I walked in here, but my father served as a page. I don't remember the years, but somewhere around here there's a picture of him up on the wall as a page. the resolution referenced, I count my family as my greatest blessing in life. I want to thank my family for their steadfast support and love throughout this process. I'd like to introduce them to this honorable body. My wife Harriet and I have been married for 43 years, throughout which she has given me her unwavering support. She is the backbone of our family. I love her dearly. I'm grateful that she is with me today and every day. Harriet and I have three adult children, Miles, John, and Laura. All three of our children are married to wonderful people that Harriet and I consider our own, Katie, Mary Olive, and Cliff. They tell me young Warren's nap time is right now, so that just wasn't a good time for him to be here. And I would agree with that. It's an honor to appear before you today as President Trump's nominee to be the ambassador to the Court of St. James's. Arkansas has given my family so much, given me so much, it has been a wonderful place to raise a family. We have an incredible atmosphere to own and run a business and beautiful outdoors to enjoy with our loved ones. When asked what is Arkansas's greatest strength, Harriet and I always say our people. Particularly to our elected officials, I cannot tell you how many times I have heard from my counterparts from different states about their decisions to relocate their businesses due to the terrible economic conditions and strangling regulations that make it challenging for them for their businesses to grow and thrive. They did not want to leave their home states, but the unfriendly business regulations forced them to do so. There is no joy in hearing their troubles, but it is a sense of pride when I tell them that my family has never thought once about leaving Arkansas. So today I have the resolution to congratulate Euderd County High School Lady Cougars basketball team on winning the 2025 Class 2A state championship after defeating the Barton High School Lady Bears by a score of 72 to 66 on March 13. The Lady Cougars earned their spot in the state championship by winning their last 24 games of the season and defeating the top four ranked teams in the state during the regional and state tournaments. The Lady Cougars completed the season with an overall record of 32-4 and won the George Kell Memorial Classic, the 2A2 Conference Code Championship, and the 2A2 District Tournament, the 2A Region 2 Tournament, and the Class 2A State Championship Tournament. And Quinn Johnson was named the most valuable player in the Class 2A State Championship Tournament. were led by head coach David Harmon and assistant coach Kyle McCandless. Mr. Harmon has achieved a very rare feat of coaching both a boys state championship team in 2008 and a girls state championship team in 2025 for the same high school. government and no one else. It prevents government from taking away religious freedom. Religious freedom is at its core everything that means to be an American and Arkansan. A couple of things that this bill does. It keeps religious organizations safe from persecution. Should a church camp that's Baptist-run, let's say, because I'm Baptist so I can pick on Baptist, wants to hire Baptists, they have that right. It doesn't allow discrimination when it comes to age, gender. it only allows for those church camps or those churches or those religious organizations to be protected from persecution. It protects religious freedom when someone's seeking a license. For example, a marriage license. If that person that is issuing the license doesn't wish to do that, they must recuse themselves ahead of time in writing. They cannot do it at the time of action. That's been tried, and that person is still paying over $100,000. So there is a way that we can take care of both. It protects religious organizations regarding employment, and it prevents government from discriminating against institutions or organizations.

I certainly respect you, Representative Lundstrom, and so don't take anything different by what I say today. I'm not planning to say anything awful, but just don't misconstrue, okay? But I think what I don't understand about this is that, to me, we have religious freedom in the United States. That's granted by the Constitution, and it's been granted by multiple laws that we've had. We continue -- what I don't understand is that every year we come back and revisit this issue, and we continue to legislate this. I don't know of any instances of this happening in Arkansas, and some of the things that happened have been in the past, and we've had multiple laws for this purpose. I'm not an attorney, but I feel like we have a lot of laws for this. I want to talk about one part of this bill, and I'll try to be pretty brief. When somebody plans to get married, that's one of the most meaningful times in your life. Representative Ray appreciated his bill that he brought to honor what marriage means to all of us. It's one of those milestones in your life. Getting born is a pretty big one. Graduating, going to college, getting married, having a family, lots of milestones that we have in life. And marriage is one of the most important ones that we can have. Marriage is legal for everyone. It is legal for everyone. And for, to me, the least that we can expect for Arkansas citizens are that when they go down to the government office where they pay taxes to maintain and they ask for a government document that is a legal process is that they not be made to feel other, that they are not made to feel like they're not as much of an Arkansan as all of us are. And this does happen, and this is harmful, and this is a small group of people because that's what minorities are, small groups of people, and they don't have the same power that majorities do. I mean, we all know how the world works. I feel like this is legislating for some Arkansans and not all. Yes, we all have some differences. Some of them are religious, absolutely. But I still feel like every day I come up here that every one of us have much more in common than we do that are different. And I don't have any preconceived notions that I'm going to stop this today. I just am really asking you to consider these meaningful things that go on in people's lives and having this government service that they may have access to, but they may show up and they may be made to wait. There's not going to be a sign to tell them anything. If someone else in that office won't perform this service, they're going to have to find someone who will, or they're going to have to go somewhere else. And I'm sure that Representative Lundstrom says there's solutions to that, but I think sometimes things slip through the cracks, and somebody is going to feel the most miserable they've ever felt on one of the most meaningful days in their lives. Things do happen. My marriage day was almost ruined. Not by this, not by this, something totally different. But that stays with you. So anyway, just having said all that, I'll be voting no. I just want to drive home the point that even though this is presented as a bill that prohibits discrimination and actually allows for it, so by protecting state employees in this way, That is effectively allowing the state, because state employees are acting for the state, it allows the state to discriminate against members of the public. And so that's the way this bill functions, and it allows the state to refuse marriage licenses, et cetera. And the same thing goes not just for state employees, but anybody licensed by the state. So for example, a psychologist can refuse care based on their religious beliefs and not have their license revoked. And so in a time when we're talking so much in this chamber and in the state about access to care, this goes the other way and will decrease access to care. And more than anything, it will increase discrimination, and that's why I would urge you to vote no.

Colleagues, House Bill 1077 is a bill that was originally brought to me by the Arkansas Veterans Coalition with the support of the Judicial Council and assistance and input from the Arkansas Office of the Courts. Many of you may be aware that veterans comprise about 10% of our incarcerated population here in Arkansas. Of those jailed, about 70% of veterans are jailed for non-violent offenses, 82% of them are eligible for VA benefits, and 18% have experienced homelessness. Of those incarcerated veterans, many may not even be aware that they're eligible to receive benefits and that some of those benefits may help them reduce the overall time they'll remain incarcerated, connect them with resources to get needed mental health and/or physical health treatment, and divert them to veteran drug or other specialty courts. This bill establishes a notification system regarding incarcerated veterans and requires jail administrators, their designees, or county veteran service officers to inform the VA that a veteran is incarcerated so that the process to assess their needs and facilitate appropriate assistance and services can begin. The bill also requires use of a very simple existing system called VRSS, or Veterans Reentry Search Service, which is an online portal operated by the US Department of Veteran Affairs, which can be accessed free of charge. So when a veteran shows up in a VRSS inquiry, the VA Veteran Judicial Outreach Specialist, or VJO, responsible for that geographic area, will typically go to the jail and meet with an incarcerated veteran. We already have the VJOs. this bill is not establishing them. The VJO's job is to connect incarcerated veterans with veteran services that could aid in the veterans' re-entry into the community after release. These services aim to address the factors that make the veterans more likely to end up back in jail, like mental health or substance use disorders and the lack of stable housing. For jurisdictions that have an existing veteran treatment court, that VJO is an active member of the veteran treatment court team, and they can coordinate a veteran's court-ordered treatment and counseling, arrange for beds at a VA-operated inpatient facility for those veterans with more acute needs, work with the veteran to obtain housing, and share with the rest of the team of veterans' progress through treatment. Using VRSS to determine whether a person being booked into the county jail is a veteran or not, triggering a visit from the VSO or VJO means that that referral process to get the veteran's treatment or diversion through the treatment court or other diversion program much more quickly. Research shows that the sooner you can get somebody treatment after an arrest, the more likely it is that the treatment will work, and the less likely it is that that person will reoffend. The VRSS will help our treatment courts identify veterans who qualify for the program. We now have, Sebastian County has one of the largest veteran treatment programs in the state, and so what we would like to do is use some of the data that we receive from this program so we can identify other areas of the state that may need to duplicate their success and create their own veteran treatment courts. It's also better for the state overall when we can identify these veterans in the justice system because it's cheaper for the state of Arkansas if we're able to figure out a diversion program that's appropriate for that veteran, whether it's getting them into one of these diversion courts or getting them into one of the federally funded Veteran Health Administration facilities to get additional treatment instead of sending them to prison. happy to answer any questions representative

Thank you Mr. Speaker. Colleagues, many years ago we had to split the state police retirement system into what's called Tier 1 and Tier 2 system because there were some financial difficulties. At that time APERS took over managing the system and we have come a long way and we have stabilized the state police retirement system. What we're trying to do right now is a first step in improving the benefits for Tier 2. Tier 1 has six active members left in it. Tier 2 is where the bulk of the state police members in the retirement system are located. The benefits for Tier 2 at the time that we split were significantly less than the benefits for tier one so what we've done in an effort to improve the benefits for tier two state police is we are increasing the cost of the accident report from $10 to $25 the additional $15 will be what's used to fund the increase in the benefit for the drop program for tier two state police So we're covering the cost of the benefit that we're giving to the tier 2 state police. So, and believe me, since the early 1990s, the cost of that report has increased significantly. Sometimes they're 50 to 100 pages and take hours of time to prepare for those who've been in an accident. The people who are actually in the accident will not have an increase in the cost, but insurance companies, chiropractors, everybody else that wants a copy of it will pay the $25. It was used in 2021 to fund a pelletizing business down in South Arkansas, and what we're doing is we're just updating the numbers and the dates on it, and it's going to be used for an expansion to the Green Bay packaging facility in Conway County. The Green Bay is a great customer. They've been a great industry. They've been here for 65 years. They're great with the community and one of the major employers in that area. And as I mentioned earlier, 14 surrounding counties are affected by this. This is a $1 billion project, a billion dollar project. I'm told that this is like the third largest investment by a private corporation in Arkansas. So it's a great opportunity. I will tell you this also. I worked, as many of you know, I worked for Kimberly Clark Corporation, And we did projects of new facilities, upgrading facilities. And I can tell you, this is a 65-year-old facility. And if you do not upgrade a production facility, you put it on a path to slowly be shut down because newer facilities will be generated that will be more efficient facilities. And when things get tight, the most efficient facilities get running. So this guarantees a long relationship and continues a long relationship with the Green Bay packaging in Arkansas. The project, in summary, is really – has some neat things. It's going to actually use byproducts and bark to generate steam, which we use to turbine, which will help with the generation of electricity for the new facility also. Under current law, the Sheriff's Department, which holds the evidence that seized in investigations is required to hold that evidence, keep that evidence in their evidence room until the statute of limitations has ran for the longest offense. Well, in some of these cases, there are no statute of limitations, and they're holding evidence on cases that they've not prosecuted or that have come through court for a long period of time and they would like to dispose of it. A common practice in Arkansas is that what's been happening, just to be honest, is that the prosecutors have been getting court orders allowing the sheriff to release that property or otherwise dispose of that property, but there's been no real statutory authority for that. And so this bill says that they have to keep it for that same time period as the law currently provides unless the item is released by an order of the court or released by the prosecuting attorney because there will be no prosecution pursuant to the felony criminal investigation. is brought to me by the Chief Deputy Prosecutor in Benton County based on his experience. Frequently, we see victims from other states that will try to flee their abuser and come to Arkansas, often women. And the offender then follows them to our state from Oklahoma, Missouri, et cetera. And although they're a repeat offender and they have arrests and convictions in other states, there's concern that we can't enhance their penalty in Arkansas based on a technical gap that's in the code. So this bill tries to address that apparent gap for previous violations of an order of protection that occurred outside of the state of Arkansas. The intent of our law clearly is to provide more punishment and accountability for repeat offenders of violations of orders of protection. But unfortunately, our law, our current statute says that those offenders, they have to have a violation under this section. So it's referring to that section of code. And all this is doing is clarifying that if it's under this section or if they're a repeat offender from an equivalent jurisdiction outside of our state as well. So it's just clarifying that case. Their driver's license is suspended for six months, but they have an option whether or not they want to drive on a suspended license or have their license suspended, but if they want to continue to drive, they have another option. They can have an interlock system placed in their vehicle. We're not changing any of that law. The only thing that we're doing is amending that law that when that license is suspended for six months and you have an interlock system installed in your vehicle, That for the first four months of that vehicle, if you attempt to start that vehicle over the limit that it's calibrated to, that is not a violation counted against you. But during the last 60 days of that six months suspension, if you attempt to start that vehicle over the limit that's currently in law now, that's calibrated by the health department, if you go over that, that's considered a violation. Now, I considered actually putting a criminal offense into this, but then I got to thinking about it and decided, you know, the last thing we need is to get these individuals back before a judge and get them back in the system. So the decision I made was to extend the time that the interlock system would have to be in their vehicle. I'm not looking for them to get an additional charge, colleagues. What I want to see is these individuals make a behavioral change. So there's no violation against them in the first four months. But if they're still trying to start that vehicle over the limit in the last 60 days of that six-month suspension, obviously, they hadn't really, it hadn't soaked in at the seriousness of what they're trying to do. And when you consider we had 602 people killed on our highways last year, and 140 of those were in alcohol-related accidents. We need to do something to try to get these individuals to make that behavioral change. So that's the only amendment we're doing. We're not changing any of the other standards in the DWI law. We're just extending that for that additional 60-day period that they have to keep the interlock system in their vehicle. With that, I'd take any questions.

For fiscal year 24, we had 447 guardsmen and women who took advantage of this. It allows, it actually is one of the guards' largest recruiting tools. All this bill does is it allows a guardsman or a woman to take this and utilize it at a non-public institution. So, for instance, Philander Smith or Washtenaw Baptist, John Brown University, that institution has to accept Title IV Federal Student Aid to be able to do this, and this has a zero fiscal impact. And the point of this is that currently if you want to exclude yourself from a casino, you go to the casino, you have to show your ID, and you're excluded from that specific casino. But if you want to be excluded from another casino, you have to drive across the state and go to that casino and do the same thing. And so in a moment of weakness, you may only go to one casino to show your ID to be excluded, but if they reject you, you're probably willing to drive across the state to another. And if your purpose was to not go into a casino, this will help you do that. Most don't because cities of the first class, being a city of the first class comes with a lot of benefits but it also comes with some costs and so what this bill does is it ups the threshold to 7,500. So if this bill passes cities that are between 2,500 and 7,500, can opt into being a city of the second class. In particular, just some examples of additional costs are things like city attorneys. City attorneys are required for cities of the first class, but not cities of the second. So this bill will just help our cities save a little bit of money if that's what they want to do, if they want to go ahead and grow a little bit more before making those hires. Colleagues, we have on law already a way for volunteer firemen, volunteer fire departments to attach their fire dues to property taxes the part the process for that is they petition the quorum court to allow that process in Arkansas now we have some small city volunteer fire departments who have parts of their fire district outside the city limits the way the law is currently structured those city file volunteer fire departments don't have the same opportunity to petition the quorum court to put their fire dues on the property insurance of those folks that are living outside the city limits. This just creates that opportunity for them that our pure non-city volunteer fire departments have. It doesn't put any extra tax on anyone. When I originally drafted the bill, there was some language that was maybe creating a loophole where municipal fire departments could come out into the county. We closed that loophole. It allows them to, in the course of trying to serve documents on someone, which is one of the things that sheriff's departments do from time to time, they incur expenses, of course. So they have to pay for gas, they have to have wear and tear on their vehicles, they incur a lot of expenses. The fees that they're able to charge have not been raised in 25 years, and I want to make clear that this bill does not raise those fees. What it does is it simply allows them to, if they have to make multiple trips, they get to charge per attempt, which is what private process servers do. I use private process servers regularly. They charge per attempt. Our sheriffs are receiving far less compensation than what my private process servers charge me. And as you know, costs have gone up, gas has gone up, cost of wear and tear, tires, you name it. But our sheriffs aren't getting any more money, and so this will help them out. House Bill 1902, so what this does is amend certain laws concerning marriage certificates and bonds here in Arkansas the bill specifies that individuals retain a marriage license you know you got to return it to the county clerk's office when 60 days of when they first issued it if the license is you know executed executed or signed by authorized person and return it's not return specific time frame of course it's not any good but there are some cases where it might get lost or destroyed or burned and so what this does is makes new procedures for making a new certificate if both parties are living they have to submit a notarized affidavit to the county clerk stating the details of their marriage loss of the original certificate if one party is deceased or incapacitated the surviving can request a new certificate with a notarized affidavit and if both parties are deceased or incapacitated and heirs can request a new certificate with the proper paperwork sets a $10 fee for all this and a new bond required under the existing law is waived if the replacement certificate is requested the new certificate of marriage shall be filed with the court with the county clerk. He's going to record it. And then the certificate will be effective from the original date of marriage and so on. And also appeals Arkansas Code 16-119-107, which dealt with restoration of marriage records and incorporates relevant provisions related to marriage record reinstatement to the amendments of other sections. thank you mr speaker members in 2005 the legislature found it very important to put to protect Arkansas's great public lands and the Commission has always honored that protection and the neat thing is is we have some of the best public lands in the United States I was in Missouri yesterday at the Capitol and they envy our public lands that we have they're protected by Arkansas Game of Fish and all this bill does is updates the dates of that protection start from August 2005 to January 1 of 2025 and you ask stuff what that means what that means is our public lands have grown so we have more acres today than we had back then so by moving this date we make sure that we're protecting all those lands the other thing we did is we added lease lands into this protection they had never been added before which we didn't have any lease lands in 2005 but we added a fiduciary clause in there that way if the leases get too expensive for the department to maintain they're allowed to break out of those leases at that point but they're only allowed to do it at that point the other thing we add in this bill that wasn't in the original bill is a report to Arkansas Game and Fish subcommittee on where we're at on these properties where those lease payments are so two times a year council will get a report on where we add and what's going on with that I'd appreciate a good vote

bill. Thank you, Mr. Speaker. This is a bill that was brought to us by poultry farmers. I was going to wing it, but I'm going to check it out. So back in 2003, the General Assembly passed Act 1061, which helps control nutrient runoff from poultry farms in certain protected watersheds. Pretty much that act requires that if you have a poultry farm in a protected watershed, then you have to comply with the nutrient management plan that has been put in place by your local conservation district and the Natural Resources Commission. This bill simply provides that if you are complying with that plan, by which by law you have to comply with, that lawyers from third parties can't sue you. Now, why do we need to do this? Well, to keep you abreast of the situation. Plaintiffs' lawyers in Oklahoma have made an industry of suing these poultry farms, even though they're complying with their local plans and their state law, and we're afraid they're starting to come doing it here in Arkansas so we can protect our poultry farmers. These plaintiff's lawyers are, to put it frankly, bad eggs, and give the rest of us lawyers a bad name. This bill also provides that if you are complying or trying to comply with your plan, and let's say you do get out of compliance, you put out 101 units of nitrogen instead of 100 units of nitrogen, instead of suing you in federal court, the remedy is the state agency comes and they can fine you, they can get you back into compliance, because the whole goal is for compliance and protect our poultry farmers so they're not getting sued out of existence and they're growing our food. Mr. Speaker. First of all I just want to make sure everyone understands this is not a bill to burn crop residue burning. This to ban it. This is a bill that will help regulate it. Currently there's no regulations on it. There was self regulation and we have not had the best luck after that self regulation. We've unfortunately had an accident where there was loss of lives in a multi-car park up because it's a smoke from an unregulated improper burning and I say that because by far most farmers try to do it properly and it is a valuable tool for them to be able to use in their business but we currently have an issue with people not following smart guidelines and what this does it's a simple bill it says that they shall call and report to the Department of Agriculture a crop burn, and if they do that and follow the guidelines for the smoke voluntary program that we're developing that the ag industry will be a part of, then they will get liability protection. That's really all this bill does. Now let me say there's been pushback from some farmers. Some farmers like it, some farmers don't, some industries are okay with it, some aren't. But in my district, I'm the epicenter of a problem in the state of Arkansas. It's a quality of life problem for my citizens. I have soccer games that had to be canceled because of the smoke. I've had businesses that have had to close down because of the smoke. I've had weddings canceled because of smoke, and I could go on with the list, but I say that because if the burn is done properly, none of that happens, and this is a way that we can start the process to make sure that both sides can live together in peace. The farmers can do what they need to do, and they desperately need to be able to have the ability to burn, but we've got to have it done in a proper way where the citizens can also live in the same area. We're going to be making an amendment on the senate because when you talk to the state you'll hear people down in the south say this is not a problem for me but you hear northeast arkansas the corner where we're at it's a problem so we're going to make an amendment that's going to create a zone and it's only going to cover the areas that the problem is happening in similar to what we did and i know i'm going to have to say this word and everybody that's in our farming industry is going to cringe similar to what we did that guy canva issue and none of us in northeast arms are like to talk about that either but that's really what the bill does and I will be glad to take

Well, in July of 23, we learned that there is a new medication out on the market for Alzheimer's disease that has not existed before. Anything that's ever been out there has been a behavior modification drug. This actually treats Alzheimer's disease by getting rid of the amyloid plaque that's in your brain. I'm not a doctor. Don't ask me too many more questions than that. But we had a man yesterday testify in our committee that's been using this. He started in October, and he has seen a dramatic difference in his life, and so has his wife. We want to make sure, and the committee agreed, that we want to make sure that our public employees, state employees, our school employees have access to this medication. Right now, if you are on Medicaid, if you are on Medicare, you can have this medication. If you have private health insurance, if you have Centene, if you have United Healthcare, you also have access to this medication. If you are a veteran, you have access to this medication. But if you work for the school district, if you work for the state, you don't have access to this medication unless you want to pay out of pocket. Now let me explain what this means. This is a medication that few will actually qualify for because it really is only effective if it's early onset Alzheimer's. You have to catch it at the earliest stage, okay? So imagine a schoolteacher who's 55 years old and gets this diagnosis. That schoolteacher might be one year away from getting full retirement. 27 years she's been teaching classes. She's one year away. She gets this diagnosis. She cannot take this medication. She's probably going to have to stop working. This medication would actually allow her to continue to work and get up to that 28 years to get that retirement That's one of the reasons why this is so important. I'd

When I got elected in 2011, we were looking at EBD, and EBD was broken. 2013 this chamber was under remodel and they called us in for a special session for one reason and that was to fix ebd speaker carter and a group of members worked really hard they moved some deductibles around they kicked some people off the plan which was a sad thing that that happened but it happened and in a few years we ended up with a pretty large surplus at EBD about two and a half years and then the following two years we had a number of these bills just like this that came to session and tugged at our heart strings and we passed those bills and we ended up at about a 40 million dollar loss by 2018. We have a committee over at EBD we use UAMS as that's where his committee resides it's called EBRX they look at these drugs and they see you know if the benefit outweighs the cost and then they put them into our plan this drugs not been through not been through that committee yet the other thing that happened is in 2018 we had to start a study group we fixed EBD again we now have a small lot smaller surplus than we even had when they started this before. So I asked you to trust the system. Let the system work. Let the drugs come through the right channels, not through dictation of law here in the chamber where we're not medical professionals. And, you know, we have all kinds of people come to us with issues, and we have to make tough decisions. But we had a coach that came to committee and talked to us. He's on this drug, and he said he went and looked up on the Internet what is the worst disease to live with. You know what it is? Alzheimer's. He, I think it was him, maybe I'm wrong, but somebody that spoke at the end of the table said, when I was diagnosed with Alzheimer's, I would have much rather said they had cancer than I was going to die in a year. That's how bad this disease is. It is the worst disease. And it is expensive, OK? I think there was an estimate it might be $90,000 for treatment. But folks, when I had my first bout with cancer, it was over half a million dollars. And it was caught at the second stage. So if this is caught early, if my cancer-- I'm just throwing that as an example-- but if it had not been caught at that stage, it might have cost a million dollars. So if this is caught early, even though it's expensive, It could save money on the back end. We don't know that. But there are people that need this help right now. And I have tracked these two drugs through this testing process out there for over three years. And this is the first drug that has ever shown any good results for Alzheimer's. explain the bill thank you mr. speaker colleagues house bill 1150 will effectively prohibit pharmacy benefit managers in Arkansas from owning a pharmacy license as many of you know I've talked with several of you on this subject I may represent more pharmacies and in any other state house district at one point it was 12 now we're down to ten a lot of people have talked to me and said this is a strike against vertical integration you know what vertically integrated companies are great that's a really great way to do business look at Tyson Foods look at so many of our excellent farmers in this country vertically integrated operations. They create the product, they distribute the product, they sell it. But Tyson Foods does not set the price of chicken for Simmons, OK Foods, Georgia's, Mountain Air, Sanderson Farms. They do not set the price of their competition. In this regards, pharmacy benefit managers do. The Federal Trade Commission, as you well know, has issued multiple reports talking about predatory pricing, patient steering, and just robbing and lining their pockets with money from the patients and taxpayers. In one particular instance, independent pharmacists was reimbursed $97 for a particular drug. They reimbursed their pharmacy $19,200 for that exact same drug. It's crony capitalism at best and outright corruption at worst. It's a pretty complicated issue and I've been over backwards to make amendment after amendment to get all parties as much as possible on board. Hospital Association is neutral in fact several other members are in outright support of this including CARTIE and Highlands Oncology if you see my rather serious demeanor today here at this well it's because when I filed this bill three months ago the very first week of session since that day lie after lie after lie has been spread about House Bill 1150. I'm sure you've all probably heard from constituents gotten an email saying hey we don't want you to shut pharmacies down for 2.7 million arkansans we don't want to lose our access to our prescription drugs i've probably had well over 100 closer to 200 constituents reach out and ask me don't shut my pharmacy down and when i ask them what pharmacy do they go to i say oh you're from stuttgart you must go to coker hampton or burkle drug or professional pharmacy all of which are great friends of mine and they say yeah i do i I go to one or two or all three of them and I say I'm running this bill on behalf of those pharmacists because what is happening to them and their business is awful. So I started texting to the one that had their name and their direct email. I bet I responded to a hundred emails. I asked one question, "Did you send me an email?" you know how many responses I got zero not a one I bet the PBMs have spent in these the S's I bet they have spent over two million dollars to try to defeat this bill because it's the only time in the nation we're the only one we've seen it. I've heard from the pharmacists all over the state, all over the state, that have explained to me that it's going to put them out of business. 50% of the pharmacists in Beebe have told me that they will be out of business if it continues. One shared with me, a pharmacist, shared with me that they pay $99 for a particular drug and they have to sell it for $90 because the PBM undercuts them and has a way through another pharmacist that they own to be able to meet that demand. And the reason that they do that is to maintain that customer, But he can only do so much. So I urge you to vote for this bill. And I totally understand vertical integration. Totally. Because I worked for one of the largest vertical integration companies in the nation. Or was a distributor. This is not vertical integration. As a legislator, many of you were still here when this body passed these first laws back in 2015. They fought those here, they fought them up to the Supreme Court where it was upheld 8-0. They still didn't stop breaking those laws from 2015 as recently as 48 hours ago. These entities have no respect for this body, for this state. They see no patients, they care for no patients and no matter how many times we have erred on the side of them to be good actors, they have proven themselves through the thousands of complaints that I have personally filed in the last 12 months that they have no respect for this body. But when you control the pricing from the manufacturing to the retail store, and you control that for yourself and for your competition, that is a monopoly. Or maybe it's monopolistic, at least. And that's what we're dealing with, but when you talk about, I'll just say it, CVS is an example. Everybody's talked about that. And let me say, we talk about small pharmacies, and in my district, I've got six small pharmacies, I've got five large pharmacies other than CVS, and I have a CVS. This is even affecting the other large pharmacies, these actions, like the Walmarts and the Walgreens. The actions that these companies are taking are affecting those other large pharmacies. It's not competitive. They're taking a competitive advantage over other companies their size. But there are options for these corporations that are going to have to divest of their retail businesses. And, Coach, I'm going to use my coach voice because it's important. You know, when you're about to lose the game, you've got to use your coach voice, right? But anyway, we have got to make it a fair level playing field in this industry. And, folks, it is not fair and level now. I have two of six pharmacies in my district that have told me they'll close. They will close. But the corporations, they can set up independent subsidiaries and still maintain income. They can set these pharmacies up as an independent subsidiary of their umbrella company, right? So there's options to this other than just closing these retail outlets or moving out of the state. The merger between the insurance companies and the retail pharmacies that was allowed to create this vertically integrated business model never should have happened. And now we're left in the situation to clean up the mess. So number one, I agree with Representative McKenzie on that point. However, Representative McKenzie said, if we pass this bill, we'll have less choice. I actually think the opposite is true. If we don't have passed this bill, we're going to have less choice. To answer the TRICARE question, I want to let you know that Tim Griffin, at our original press conference three months ago, cited how he had to switch pharmacies three times in the past two years because of anti-competitive practices with the PBM. Moreover, this is not going to mandate pharmacy closures. They can remain a pharmacy and drop their pharmacy benefit manager license, or they can sell their pharmacy and liquidate it. But I'll just read you this quote. This is from the FTC report. The three big PBMs reimbursed their affiliated pharmacies at a higher rate than unaffiliated pharmacies on nearly every specialty generic drug examined, period. These folks are reimbursing themselves at higher rates than their competitors, and reimbursing their competitors at or even, at times, below the cost of the drug. Thank you, Mr. Speaker. HB 1898, this combines the ABC enforcement, ATC enforcement into Regulatory Enforcement Division. So ABC is the alcohol, ATC is the tobacco. So currently, I'll give you a prime example. Most of you guys know I'm in a liquor store. I also sell tobacco. When they come in and do their enforcement on me, they have to send one agent for alcohol, they have to send another agent for tobacco, and so forth. These guys are already cross-trained, and so instead of sending three guys out or two guys out, they can send it to one law enforcement officer. This also provides licensees like myself, permit holders, industry stakeholders, clarity for knowing who they're interacting with in the field and who to call if they need assistance. It creates an identity and a unification for the agents who will work for both ABC and ATC and allows them to refer themselves with a clearer name and clearer responsibilities and also have a chain of command. It provides structure for the agency and the legislature adds additional responsibilities and regulation. It does not add more personnel. It does not add positions. It does not affect GR. It doesn't change special revenues. And it does not add any other regulations. I know the title is a little bit misleading, but that's what it does. The Arkansas Chiefs of Police Associations for this, Sheriff's Association for this, the Commission of Law Enforcement Standards and Training are for this, and the Arkansas Grocers and Retail Merchants are for this. And it talks about an agent, then it talks about a dual agent, and there's nothing that combines the two. So both parties have to agree to allow for the dual agency to happen. And once that happens, you've got a fiduciary duty to both parties so that you can't, so if I've got a buyer, I can't say, well, Mr. Seller, this is what the buyer's going to do. So Arkansas House Bill 1934 is known as the Arkansas Forward Engagement Committee Act and it establishes the Arkansas Forward Engagement Committee Working Group. The purpose of this group is to review state spending as well as regulations to identify and eliminate waste, fraud, and abuse, to improve operational efficiencies, to optimize the use of public resources, and to foster a regulatory environment that supports economic growth. The working group will consist of members such as secretaries from various agencies and departments, members appointed by the secretary of the Department of Shared Services, and members of the House and Senate. All members will work without compensation, including no per diem for legislators. This working group is required to submit a final report of its findings and on the recommendations to the Speaker of the House and the President Pro Tem by July 1st of 2026 and is set to be abolished by January 1st of 2027 unless the governor extends to 2029. Again, this is an efficiency bill, which is why everyone on the committee will be working without compensation and why it is indeed set to sunset. And with that I'll take any questions.
