Speaker Shepherd you're recognized explained resolution Mr chairman with the chairs permission I'd like to invite a few former speakers and other dignitaries to join me in the well. And the parliamentarians family. Mr chairman members it's my privilege to present House resolution ten eighty this resolution honors are parliamentarian finest be Buddy Johnson on the occasion of his upcoming retirement in on his thirty eight years of service to the General Assembly more specifically the house of representatives just gonna hit the highlights here but but he began his career with the house on may thirtieth nineteen eighty five and after thirty eight years will retire on June thirtieth twenty twenty three but a graduate from the University of Arkansas with a degree in journalism he worked for several news organizations before beginning his tenure in the house first as information director and then as coordinator of Legislative Services in July of two thousand twelve but he was promoted to the position of house representatives parliamentarian and since two thousand fourteen he's been an active member of a number of national organizations particularly related to services parliamentarian during his time as as parliamentarian he served with four different speakers of the house six general assemblies and is served each member obviously during the past eleven years and of course we hate to lose buddy but he looks for his retirement and spending more time with his wife Elizabeth and their two sides let me just say it for maybe an opportunity for the former speakers to say a few words but I can tell you that buddy has been a valuable member of the house of representatives I can particularly tell you with when we faced some of the issues surrounding COVID and how the house would operate and how the state would continue to transact business in the midst of a global pandemic that body was a big part of those decisions that were to be made and his counsel and advice no matter the time of day no matter you know we're we track him down it he was always very much appreciate. Did and is something that you know I relied on very very heavily you know one of the things I think I've heard chain Broadway say that Randy's father Boston mass now a long time parliamentarian I think told change at pawn to coming Speaker that it's ninety nine against two. But he likes his odds and you know every it's. A I will say that that obviously body is somebody that I trust immensely I've only heard him tell me I don't know one time over the past four and a half years that but he is always found the answer and I know that if buddy gives the advice I can take it to the bank and so I'd like to provide just a few moments for each of these former speakers to say some words. Thank you Mr Speaker members of the house representative and thank you Mr Speaker you your team for pulling a celebration of but he's a contribution to the House representative together allowing me to be a small part of it but in I have a unique relationship I got the opportunity to string together thirteen and a half years with them both as a house member Speaker of the house as an issue for Stafford chief operations officer and you can count on the resilient he's dependable and I'll tell one quick story nothing humorous about it but it was quite an undertaking and the bald headed guy to my left hand is doing. So. He sent us to Austin Texas to figure out how to put your work. In front of all the constituents of the state of Arkansas at that time we were we were just broadcast to Comcast it was not stream the wasn't across forty two other cable companies and it was bodies job and my job to figure out how to do that to convert the old northwest committee room which is where rules used to make way back in the day to your control center and body not be some heavy lifting and did a lot of work together got a chance to travel together and really become close and and bond together as friends and I enjoy unique relationship with buddy buddy you service pal. Bill brings up an interesting point when I was Speaker we did the webcast and all that we know we're doing this bill set up with the to them in charge of it but he organized a trip over to Tennessee at the invitation of the Speaker of the house over there so we went over insure their facilities and kind of figured out how best to go about this course of the day the Speaker of the house over there said Hey guys is a concert at Bridgestone tonight I want you to go with me to we said who is it he said yes buddy and I looked at each other and we're like oh yeah. Like I think we still have our kiss army ID cards at home somewhere so anyway we went to the concert that night and the Speaker knew somebody who knew somebody and we found ourselves backstage got to see the band come out of the dressing room and then they are service to the front row so we're on the front row of the guest concert and I learned two things on that trip the first Mister Speaker is at the time it was a lot better to be Speaker of Tennessee then Speaker of Arkansas. And the second is that Buddy Johnson knows how to rock and roll. There was some head banging that night sure but to buddy I just want to add my congratulations and my thanks to your service to the state to this institution and most of all personally for your friendship to me and my family we love you you've earned every bit of this enjoy your retirement. Research breast. We actually got the hang of an engrossing we are you gonna do what we were Stricker. All me so many memories that come flooding back when you think about Buddy Johnson and many times we either played pitcher played golf on what we call the charity tour that's where I got the name tiger in the woods and I think he was. Really responsible for that for that nickname but today I will always remember about Buddy Johnson was nine eleven. I was Speaker of the house that day phone lines were down governor was in Kentucky we didn't know where everybody else was and there were still reports that an airplane was headed for our capital had been hijacked out of Dallas and we had gathered body it was buddies idea everybody all the staff obviously we were all very upset but he had the idea to bring everybody in the speaker's office with the little bitty TV that we had so that we were all together and that was bodies idea that to pull the staffing together that day. You can imagine what that day was like but it was moneys calmness in responding to the things that we had to respond to that day that I'll always remember buddy you that was a tough day for all of us and you helped us pull through and do the things that we need to do to take care of our staff to respond to the people of Arkansas and and one of our darkest days and so I'm just grateful to you for all you have done for this body obviously it means a lot to all of us to have the honor to have served in here and you you have served it well and as I always say you lead to better than you found a prince. There's. We go on telling stories the from the trenches but I just want to thank buddy for being a rock for his integrity he exemplifies everything that's right about this institution. And it meant the world to me to have him by my side through my two terms as Speaker and I'm so proud that he's getting to to have this new chapter to be able to enjoy it and uh they were gonna miss you but you're always going to be a part of this institution thank you. The company team of you representing the state of Arkansas to twenty twenty three national high school mock trial competition which competition is being hosted this year I'm excited to announce right here in Little Rock Arkansas at the competition our team represent the state of Arkansas compete with teams from forty six other states and countries is actually international competition any attorneys listening the market surely use volunteers are encouraged to contact the bar for those not familiar the mock trial competitions among trial competition students were given a fictitious court case completely Dockery evidence witness statements jury instructions the whole nine yards and like a real court case there logically polls there conflicting statements of some witnesses are out right line the students have to put all this information together they play the roles of attorney and witnesses and they try the case in a real courtroom before a real judge and a panel scoring judges and if that's not hard enough the students are held to the same standards as a licensed attorney so they have to play ball the court rules including the rules of evidence and let me tell you what having seen many these competitions these kids are not cut any slack and I have personally seen far better lawyering out of high school kids at these competitions this summer court rooms. I would also like to make a special recognition of the team's coach missed Casey Griffiths you please stand up. Choose a forensic debates teacher Conway high school. Miss Griffith has dedicated countless hours of her time her mock trial students trying to cram three years of law school into three months of practices which can only be held after school and on the weekends and all that she does not being paid a dime for it she also has to cover the expenses of the that this is simply not money in the budget to compete to cover her hard work in her dedication has shown off this program is high schools only eight years old one of the last four years this this team the team before it has won the state championship three times and came in second the other time. Why does she do it is certainly not for fame or recognition but she does it for the kids schools across the state are lucky to have such a dedicated and selfless teachers like Mr Griffith I know Conway is. Coach west swift said this group of seniors man I love all of them there there's something I'm going to miss them. The championship is coach swys six in fourteen seasons. At Jonesborough and is eighth overall including one et using one LOL senior guard Dion Buford Westen earned MVP honors in the tournament after scoring fifteen points to lead the hurricane in championship game the team finished with the season record of thirty and three. I'm not familiar with this type of loss so I'm just help me walk through this so if a stay at home mom for twenty years is traded in for younger model and say only gets ten years of alimony is that what I'm hearing. If my memory serves me correctly child support is what really determines help to take care of that child alimony isn't for taking care of the child alimony is for what you agree to that the judge decided that the other spouse deserved because of what they put into the marriage so why are we sticking aging majority on a child to reduce someone's alimony. Well here's here's kind of how it works there's a multitude of factors they're taking into consideration of the time the divorce happens in in determining how essentially how to make a person whole and that includes the Division of the assets during the marriage sometimes you know that in order to rectify the situation the judge has the ability to make an unequal distribution of the assets in other words may give one party who didn't earn as much or or wasn't or didn't work may give them a bigger portion of the of the assets. and another way that you kind of look at the overall did you know the big picture of what's fair in the totality of circumstances child support does come into that calculation and so you know if there's no longer a child involved that would certainly be a factor that the court to consider a modification follow up is recognized the things you talk about they can already do the judge can already look at the factors when they doing it so why are you actually added it into this bill well so that's a good point many of the factors that are mentioned there are mentioned in the case law but they're not set out specifically and the statute so this would take factors that are already typically consider should be considered by the judge actually riding them into the law so that they would be considered one more follow up Mr to Mr you're recognized when you talk about reducing how long someone might be able to get alimony by fifty percent is there any other states that do that yes absolutely yeah there are there state spent states are all over the board on how they address the situation some do it by link the marriage other just limited by a certain number of years we certainly would be the first put limitations on alimony thank you. Representive enters for what purpose you're recognized. The thing respect your reserve Gazaway like the bill does this affect any existing for alimony payments or is just everything going for. So I think that. Many of the factors for modification that are already listed are things because it's in the case law as factors that can be used for modification would are things that people can already use this just sets them out very specifically in the bill for purposes of of modification now it orders that have already happened you know as far as the limitation goes I think they're going to be under the law at the time but you know certainly going forward that limitation would apply thank you. The representative brown for what purpose question you're recognized representative Gazaway I generally like to build but I do have a concern what about the situation where one of the spouse's receives a devastating medical diagnosis or becomes disabled and the other one says look I just or fiddle with this and and and just abandons. Their spouses With that. How would that work in this situation. Well so there's any. The judge has some discretion I guess what I'm asking have absolutely this doesn't settle limitation on the amount of alimony it is there's not anything like that certainly judges have wide discretion in these cases and that's that's going to continue I'm and you know you raise a good point we can come up with any number of circumstances that that can happen and judges have the ability to provide for those you know given the case and they can do that three asset allocation in the divorce so if there was it during the divorce they may award that spouse a significantly increased portion of the assets to account for a situation like that and they often do so at the end of there's any number of ways it can be addressed. Follow up you're recognized I realize he's a rare cases but they do occur and I would just like to be assured that if somebody becomes tragically disabled that the judge would have the flexibility to not limit. S. specs of the family as a whole they look at with the debts are they look at all of those different things when they determine what alimony might be awarded in all my years of practicing law I was only successful and get an alimony one time so it's not one of these things it gets a lot of happens a lot of times but it does it would give that we give the court the to talent the chance to look at all of that because they're the ones looking at the evidence there the judge is the one who is looking at what has been presented what's what is for a what's against this particular bill that I'm going to vote against completely shifts that. And just like representative Lundstrum was asking about you have a stay at home mom or a stay at home dad and they've contributed to that they're only going to get half and maybe that's not a fair assessment and the court would have that but this bill is going to tie the ports hands to be able to look at the totality of the circumstances so I would urge you to vote no. Thank you Mr Speaker colleagues I don't practice law in the domestic relations area in fact actively tried to avoid it everyone saw you to get involved in these cases under current law the primary factor to be considered by a court in awarding changing an alimony award is the need of one spouse and the ability of the other spouse to pay full stop that is the primary factor now courts may consider secondary factors including the financial circumstances of the parties there earnings capabilities they're turning to pass city current anticipated income and other factors but there is no requirement that courts consider the secondary factors as long as they meet the primary factor full stop they're done and what this means in real life is under our appellate rules once alimony is set in a case it is virtually impossible to get a judge's refusal set aside Allen because of a good reason that happens later reversed on appeal I believe that this bill fixes that ever so slightly by simply giving courts which are bound by the case law has evolved and in our case law by giving the flexibility judges the fledgling out the able to consider the secondary factors when a request is made to change alimony in the factor that actually makes me the most excited about this bill is the fact that under this bill a court can now take a look at the fact that someone has retired aged sixty five I've been involved in the case personally where alimony was awarded it was awarded for life or until the wife remarried as per current law but the problem is there is no out in that award for what happens when the gentleman turned sixty five decides to retire he must literally work until the day he drops dead or he'll be in contempt of the court because this was a factor that was known could have been anticipated will some point you will retire the court says that's not a material change so therefore we don't look at it so I think that actually this is a good bill that gives our judges and flexibility be able to look at some the secondary factors when they're really good secondary factors to be able to change an alimony award winning things in the future change as to the outside limit I do think that it's and reasonable outside limit on alimony the Bill meets the goal of our committee which is to rectify. We put reasonable limitations on child support we say the child support the legislature did this child support ends at the age of eighteen or whatever the child graduates from high school whichever occurs later now there would be some people who say that that takes away so much discretion from a judge maybe the judge ought to be able to work child support the child still in college if the child still living at home even if they're twenty one or twenty two or twenty three but the legislature said no it can't go on forever it ends at eighteen or whenever they graduate from high school not twenty one not twenty five now when they graduate from college think about this in the criminal context we have a whole statutory scheme for all of the criminal offenses that we define that it's a C. felony carries three to ten years this conductit is a Y. felony carries ten to forty years this conduct is a D. felony it carries zero to six years we put limitations on everything. I believe at some point representive eleven has explained that districts are no longer no longer funded for their health insurance contribution but that amount doesn't account for the entire gap between what was recommended and what is being proposed here we also see very smaller flat increases for important funding categories like enhanced student achievement funding when switch schools and districts use for struggling learners and students in poverty a small increase is better than no increase at all of course but this proposed amount doesn't even cover inflation and will not be adequate to meet the divisional cost and requirement schools and districts have. We continue to hear from districts across the state that they're worried about how they will be able to fund all of the new requirements from the learns act as well as for their on going in increasing cost that they continue to have year after year. Related to some of our reporting requirements for candidates for office you can see I walk you through the bill section one basically moves the filing date from the fifteenth to the twenty eighth of each month I believe this also matches up with the federal reporting calendar as well and then the next several sections deal with moving the threshold aggregate amount for individual candidates from fifty dollars to two hundred dollars and per pax from five hundred to two hundred and so that the audience there that we have. If a pack is also giving money to individual candidates should we have it simply the same threshold between both packs individual candidates and so we kinda met somewhat in the middle between fifty and five hundred we've settled on two hundred and so that's been applied across the various reporting sections additionally it does provide for A citizen complaint to be filed in a number of different formats hand delivered mailed but in particular by email or fax to be followed up with the original and then finally at the back we have a few additional provisions you can see over on page six the delinquent report section it requires that the commission to review the timeliness of reports and then if a candidate for office fails to file a report they should be notified in writing by the ethics commission of the factor delinquent and upon the third and subsequent time that they're delinquent with an election cycle they would be subject to a fine and so this kind of tries to address the situation that often times folks find themselves in which is. As a candidate your timely filing your reports but maybe there's someone else out there that's running for office that doesn't file reports or doesn't filed them timely in the past the burden is somewhat been on the candidates themselves to file the complaint or range for it to be filed against their opponent will then when you when that occurs people think oh well that's you know picking on this other candidate this just puts a little more authority on on the behalf of the ethics commission so that they can police this and they can take the initiative to call this out and to alternately find those who do this not just one time or two times but three times during the election cycle and then finally we have that the ethics commission shall issue a reporting calendar just for ease of understanding for all the candidates to propitiate reporting calendar that's been worked on the passive think with secretary of state but this actually will require that the commission to develop that reporting calendar so that you don't have to guess when you're supposed to file and and a candidate doesn't have to guess that you can actually go in you can see the reporting calendar and it'll tell you straight forward what those reporting dates are. Thank you Mr Speaker colleagues this is a product of a lot of hard work center here when I server work with far services folks about four months ago to try to consolidate our services our state government currently the duties of the far more store house and to the state police in there is a board under state please call the fire safety board there's some redundancies between that board and a board call the fire protection board of this house with the rest of fire services under Adam what we're doing is we're consolidating off our services under Adam so we're moving the fire marshal duties from state police to Adam this is all been together she added without any state police there's no opposition to this that I know of and this is a good way to streamline our governments will get rid of one Commission consolidating it to another ratting Senator D. the fire protection services board so we're giving them the authority now to create a registry farm so one of the issues we have in the state as we don't have a registry or fireman so if you wanted to try to incentivize someone to be a volunteer fireman differences you through some sort of you know it Parker incentive if we wanted to like we did with our companies want to give them some sort of bonus seconded to the medics and nurses there's really no way to do that because there is no registry of license fire folks or certified by folks that this is going to create that mandate this would create that registry it's also creating grant process so we fund fire through ACT eight thirty three this is a bill passed in nineteen ninety one to create some funding for our fire services right now there's some money that's been sitting ACT eight thirty three young claim for as long as several years that we can't really do anything with we're taking that money that's been sitting there for a long time moving that over towards the fire protection board so that they can have a grant process to try to support fire services and another far exceed your throughout the state we're also creating some funding mechanisms for the farm Marshall so right now the farmers was a shared duties to the person that does the farmer city is a person does a lot of things so we're creating a dedicated far more so as well so this bill does allow. A lot of things if the consolidation of a lot of good hard work it's supported by the firefighters the fire chiefs are marshals and I'd be happy to try to answer any questions about the bill. Persons our Mall ruled volunteer fire departments how much are they going to be given up because a lot of them survive only on this money yes is the total amount of the growth that is being moved over to if if it's three percent which is what has traditionally been one point five percent of that amounts to about two hundred fifty thousand dollars total so that that would be divided among all the different fire services of each individual fire services would be given up to a pretty insignificant amount of money compared to. Thank you madam Speaker. So colleagues. I have probably. Approach to you at some point during the session about my bill and if I have it I'm pleased to present it today so. This past this pathway. Started over two years ago when I got a call from a constituent. Who asked me to do something about this he himself had committed and then convicted of a nonviolent felony and it had been over twenty years he wanted to protect his business and his family I began work on the bill and found out that Senator Stubblefield and senator called what we're working on the bill and we began working on it together. We were able to pull together group of folks who helped us with the language including the attorneys from a C. I. see as well as the state police at that time then we worked with the prosecutors Association who worked with us extensively not only at that time but also more recently this session so there've been many many many amendments on paper and off I'd also like to share with you that I never in a million years thought that I would stand before you and the president saying what some would call a gun bill other would call a second amendment rights bill but as I dug deeper into this issue. And discovered that nonviolent offenders. Including and especially those where there was never any presence of a weapon. There was never any violence committed in the conviction. Also basically. We're subject to a lifetime ban. In the state of Arkansas the only way in which someone can get their rights restored whether or not they're they're conviction was for a violent or nonviolent offenses through the pardon process. We know full well that that process can be expensive and is not available to most people we also know that politically speaking a pardon is not going to be granted to everyone who made the service. This section. We went through about. Two or three. Versions in terms of amendments. I presented the bill at the very beginning of February. And the Bill failed by two votes. Since then I want to thank my representative Cindy Crawford as well as representatives to be Gazaway they pledge to help in the process to make sure that we could get it right and that we did. Since the beginning of February either all three of us have met or we have met with the secretary for public safety we have met with the prosecutors association. We have also met with the sheriff's association. As as well as the attorney general's office all four of those parties. Spoke against the bill in February. Since then because we ultimately decided on a very significant amendments to the bill. That were ultimately agreed upon by the prosecutors association as well as. The attorney general's office to address their constitutional concerns which I still we and we agree to disagree but I I do believe that in the former version was not unconstitutional but. We also agree that this would work. We amended the bill and now I'm happy to say that the attorney general's office withdrew their opposition under now neutral the sheriff's association is also neutral as well as the prosecutors association. And I would also like to say that the our our our secretary of public safety is my new best friend because even though he came and spoke against the bill I feel very. Confident that I address their issues in that largely the issue that he came to the table with with the constitutional concerns that we were able to address in the amendment that was agreed upon between those of us working on the bill and the Attorney General's office. Essentially what the bill would do. Is for those non violent offenders. They would have a pathway they would file a petition. And go through a process that already exists and because that process already exist. We also Got a financial impact statement. And there is zero financial impact. Initially the bill afforded someone who was a non violent offender and completed their disposition with the state including jail or prison time including any fines or fees including any restitution. Following that initially it was a ten year as representative Tosh call the cleansing period. But in that initial bill there was also one bite at the apple they were very strict parameters including requiring the judge to determine or to to document what the reason for denying the position would be petition would be. In that initial version it was a section a code section into itself that was patterned after the first offender law as well as the drug court law. The change that we agreed upon was to instead move much much simpler language to the uniform ceiling act. But what that did was it did away with the dismiss. And just excuse me the dismiss and discharge. Component of the bill. Which was very key to the language agreement that we agreed upon. Now what you'll see is a five year cleansing period. What would it would also do is give the judge very broad latitude and authority and would also afford a petitioner if they were to not to come back after a year to come back before the judge. And that is the language that was agreed upon by the attorney general's office in the prosecutor's office they felt very comfortable with that component. I'd also like to draw your attention to the fact that this is a very good bipartisan measure. There are seven senators and thirteen house co sponsors to this bill and that didn't come easy it didn't start out that way but if you'll notice that those of us who are co sponsors on this bill run the spectrum of philosophies because I don't believe that in this bill philosophical issues come into play just what's right. I think that We make sure I covered everything that I've I want you all to be sure and understand. Yeah. I think that I'll stop here and engage any questions you might have. Representative Hart for what purpose question you're recognized so I guess my question would be so we're taking the pathway from the pardon from the got governor and putting in the hands of judges at this point that is at home hearing this I'm so glad you asked that question no we're not doing that so with the pardon and I think that that's what the concern was before with the language we had before. what was explained to me was because we were affording petitioners the dismissal and discharge of the original conviction that there was a constitutional concern there was a it was described as an end run around the pardon process once we change the language that dismissing this charge is no longer a factor and that's because the AG's office sent me a a couple of a couple of constitutional decisions US constitutional decisions to demonstrate that we didn't need to go that far and it's because of really that that we all agreed to make the significant changes that we did so what the bill does now absolutely does not take away the pardon process as a matter of fact Petitioners could go that route or they could take this one thank you for your question. Saying that city break purpose of questions you're recognized represent flowers I just I just wanna see can you expound on the non violent offenders I'm looking through kind of the definitions it looks like you list a bunch of violent offenses and and then say not pieces that is that okay yes so initially that's how we address it we and as a matter of fact initially what the prosecutor's office did was a prosecutor's association did was help us to find those exceptions because the initial language included some misdemeanors included a series of code sections that would enable us to not have to come back every time as well as specific nine five I'm a as well as specific filing offenses. And what they really asked me a long time ago to do was to put it under the uniform ceiling at because that is more of a catch all the reason I was unwilling to do that at first was because it was my understanding that we had to had to have the dismiss and this this charge language in there which would have had to put it in a separate code section now that is it is under the uniform ceiling act then it that is already covered coupled with the very broad latitude that the judge will have and the other thing that was in the initial language it was very strict to require the focus and eligibility on the conviction. And this and with this language the judge can look at any factors that the prosecutor in that given conviction relates to the judge as a reason as to why they don't agree. Environment here in Arkansas there's data centers a little being built by Arkansas companies one mile over the border in Missouri there's large billion dollar investments going into small towns in Oklahoma that could be coming here in Arkansas and so what we did was we crafted piece of legislation to provide the sales tax exemption that would That would require that it be a five hundred million dollar investments over five years pain aggregate annual compensation of at least one million dollars and has and this is the key this is a very key point has received a positive cost benefit analysis from the Arkansas Economic Development Commission and essentially what that does is make sure that it for giving them this exemption that yeah it's revenue neutral so everyone's fine with this bill I appreciate at Senator Dismang for helping me with this as well as representative lessee is helping with this as well I'm really except as bill I think we're gonna see a lot of investment in when the other things I want to add was you know we're the number one state for computer programming and of Senate parties were training kids to be in this field and then we don't have jobs here to to have an exercise that and then said they're going to surrounding states okay I would love These these areas built and then have a have our Kansans who are working in this field stay here spend this money here and help our economy. And before I became an explanation of the bill I want to thank some folks who've been involved on this particular issue one this is a bill that the governor supports in the governor held a press conference on. Because of the dramatic increase in fentanyl overdoses that we've seen in our state and around the nation I saw certainly want to give a thanks to the governor for her support on this bill and also the Attorney General who was instrumental in helping draft this bill attorneys from the attorney general's office and also representative mark Perry who was working on this issue at the same time I was in and was responsible for some of the language here and also represented Lundstrum who was also involved in addressing this issue so I want to thank them for their work on this issue involving fentanyl because it is is certainly a pressing issue that faces our society today. According to the Arkansas state crime lab just wanna give you some. Give you some idea about what's going on with respect to federal before I get into exactly what the bill does. In twenty fourteen. In terms of drug overdoses there were three federal drug overdoses in the state of Arkansas the receipt of the Arkansas state crime lab. In twenty sixteen that number was eight. Last year in twenty twenty to that number was two hundred and fourteen. So you can see and then. I'm sorry last year to in twenty twenty two that was through. August there was not even data from August until December in a twenty twenty one there were two hundred eighty two so twenty fourteen three twenty eighteen I'm sorry twenty sixteen eight twenty twenty one two hundred and eighty two this gives you some idea about the magnitude of what we're seeing in terms of federal overdoses in Arkansas. And if you look at drugs sees that they're seeing at the crime lab in twenty fourteen they there were twelve. Instances of. But no that was seized in the state of Arkansas in twenty twenty one six hundred eighty six cases of fentanyl seized in the state of Arkansas. Fennel is an extremely deadly drug let me tell you this panel is dosed in micrograms that's a million of a gram it's a high powered pain reliever that's often administered to cancer patients who are enduring intense pain you also see it hospice context typically add medically it comes in the form of patches. But what we have seen recently is an influx of fentanyl illicit fentanyl coming over the border from Mexico it comes from China were shipped to Mexico the cartels bring it across the border and they're lacing other drugs with it is they bring it across the border and it's causing you know as we as we've seen From eight overdose deaths in twenty sixteen. To two hundred eighty two overdose deaths in Arkansas in twenty twenty one so this is a pressing issue it's a real issue that's affecting communities all over the state and. This bill seeks to address that so this is what the bill does. The bill creates new offenses in the homicide Code call death by delivery. And this is not unheard of is not unprecedented other states have similar statutes death by distribution this one's model of North Carolina statute other states have death by delivery states that hold drug dealers accountable for dealing this poison in our communities that is killing people. And so the way it works so we set it up in a sum varying degrees but we have at the beginning of the bill we call aggravated death by delivery. And the way that works is if you deliver fentanyl to a person and it causes their death that is a state what I would call a super Y. felony that will carry between twenty and sixty years of the department of corrections for life so if you deliver federal to a person that causes or death twenty to sixty years for life. If you deliver fentanyl to a minor and it causes their death it's an automatic life sentence we're not playing around with this there been too many teenagers and young people overdosed on the substance because these people are poisoning our communities with it and we want to send a strong message to anyone who's dealing this type of substance you need to find a new profession because if you're dealing fentanyl when our communities and causes someone's death you're gonna be looking at life in prison. So that's aggravated death by delivery. Then we create death by delivery in the first degree and that concerns what I would call the other three super drugs other for super drugs that we see in Arkansas and around the country primarily fennel methamphetamine heroin and cocaine death by delivering the first degree concerns the other drugs methamphetamine heroin and cocaine if you deliver one of those three drugs to someone and it causes their death that can be a Y. felony that's ten to forty or life so you know we once again we treat those rather harshly. There are some opportunities for there to be mitigating factors that could take the level of the charge down if the person possessed it for personal use if they didn't have any criminal history. And that sort of thing that can act as a mitigating factor in these cases but generally that's going to be a Class Y. felony then we create Act we create death by delivery in the second degree and that's for every other type of substance that's outside the for. Of the four super drugs if you will that's going to generally be a Class a felony. Which is six to thirty years if you cause someone's death that can be enhanced if you have a record of being a drug dealer if you delivered it to a minor someone who is disabled someone who's over the age of sixty or under circumstances that manifest extreme indifference to the value of human life that can make it a Y. felony ten to forty year life or they're the same mitigating factors if you have no criminal history as a drug dealer the only possessed it for personal use and some of the other mitigating factors that can reduce it to a B. felony which should be five to twenty years so we tried to build in it's kind of a sliding scale to address the severity of the conduct the most of your conduct can be punished most harshly with the less of your conduct punished not as harshly in again in an attempt to be reasonable so that's the death by delivery section that's a new section and the homicide section of the criminal code. The next thing that the bill does is it decriminalized spent all test strips because we want people to hopefully if they're going to engage in this kind of conduct to Elise hopefully have a chance of saving their life if you're gonna take fentanyl or you're gonna take drugs you may want to test ahead of time no defendant on we'd rather decriminalized the paraphernalia and save your life and make the paraphernalia criminal and see people die so we do that Then there is a provision regarding rainbow fennel which we call predatory marketing a federal to minors if you possess fentanyl in the form of. In the shape of candy that resembles a food or beverage and that's attracted to minors if you have possession of that kind of substance that can carry a life sentence in Arkansas and a million dollar fine and then the last thing the bill does is on trafficking of fentanyl we up the penalties on that it's already a Y. felony so we got the penalties on that trafficking if it would be twenty to sixty or life in the penitentiary for trafficking in this kind of substance and a million dollar fine about it so for the cartels and for the drug dealers or trafficking in this kind of stuff you're gonna be looking at a life sentence in a billion dollar fine. So that's what the bill does and I'm happy to answer any questions. The bill under aggravated death by delivery when we talk which applies specifically to fentanyl. Concern's pure fentanyl so if the knowingly deliver fentanyl if you deliver what you thought was hydrocodone for instance but it turns out that it was laced with fentanyl but you didn't know that that's going to fall into the death by delivery in the second degree because it's a controlled substance that's not fentanyl methamphetamine heroin or cocaine you didn't you had no idea that I had sent no limit so you would be on in the second degree in that case but that's a that's a great question. Fennel bill that I just I am I do want to give some thank yous here again the representative very representative Lundstrum and prosecuting attorney Dan shoe from Portsmouth who was instrumental in drafting this legislation basically what we do here is we address the situations that are short of causing a death which is what we just dealt with in the other bill so if you expose someone to vent on it causes serious physical injury which is protracted disfigurement loss of bodily member function has to be a really serious injury if you expose someone to fennel and. Hi causes serious physical injury that's a Class a felony six to thirty years if that person is a law enforcement officer it's a Y. felony answer that's exposing someone depending on the first degree then we have exposing someone defend on the second degree which is causing is causing physical injury to that person that is a B. felony five to twenty years in the department of correction and if that person is a law enforcement first responder eccentric and that becomes a felony six to thirty that's what the bill does And I will give you an example of this this is once again part of what we're seeing this is from a recent. At the prosecuting attorney she gave me this I want to give you an idea about what's going on this is for recent media report two female inmates were found unresponsive and not breathing in the Sebastian County adult detention center detention deputies believe both were overdosing on fentanyl and and R. can was administered successfully however both were transported to the hospital statements from other inmates confirm that the inmates had obtained fentanyl when detention deputies returned to the pod area two deputies were overcome in likewise had to be transported to area hospitals finally a third inmate suffered reaction to penicillin was transported to an area hospital as well this is extremely dangerous drugs posing a risk not only to again those who are. Seeking it out but also those are not our law enforcement officers or first responders in this bill provides them some extra protection so. With that looks like we've got a question president Collins for what purpose question. Recognized so just want to go with this do you mean exposing as and bringing the fennel to someone else against their will or do you need introducing it to them or something broader than you know the example you gave in which you are kind of. Putting that on to the person somehow. Well the mental state and this is knowingly so you have to act you have to act knowingly and then of the exposure is scanned contact elation ingestion contact so knowingly exposing someone in one of those ways was subject you to criminal liability under this law follow up. Well I guess what I'm wondering about is the other persons as the other if the other person takes the final after they've been exposed and takes it in one of those ways you listed are we including that in this or we saying that that the accused person has to be putting it on the other person in one of those ways against the will of the person whose benefit. Once again it requires a knowingly exposing someone to the substance I'm not sure exactly what the distinction is that you're making I mean I want to answer your question I'm not trying to avoid your question at all I'm just having a hard time understand the distinction that you're trying to make one more follow up occurred I'm just trying to get out what you mean by expose because the word expose could mean a few different things and I think that the way that I would want to read this bill is that your meaning that somebody brings the fennel to the other person's skin or body somehow but there are other ways to interpret the word expose and that could be introduced at two AM delivered to on any number of other things I just wanna know what you intend for for the record. Well it we give a very specific definition of expose expose includes without limitation skin contact inhalation ingestion or contact with a needle stick form you because membrane including without limitation the mouth eyes or nose so if you knowingly expose someone in one of those ways or otherwise no you're gonna have to know that you that you possess the substance you have to know that someone was likely to come into contact with that substance and then of course it's going to have to cause injury to them is gonna have to cause physical it serious physical injury or otherwise physical injury to depending on the circumstance but the person's mental state is going to have to be knowingly in order to be have some criminal liability here. Okay I'll try to read the five respond this is this this bill is the new funding bill matrix that I'm working on for education adequacy. this is something we've talked about for many many years in the adequacy Committee as cation committees Senate and house so I have a working on this over the last couple years trying to find a program or a system that would work good this is kind of a copy out of Tennessee Tennessee did this and put into place a couple years ago had good luck with that. So I took their plan brought it over here with some work from quite a few different people department of the bill or the people in Tennessee have been working hand in hand with us to try to get a good bill we took the Tennessee plan adapted it to Arkansas standards that we have to use and everything that fits into it and we made a comprehensive investment in student achievement Act is what we're going to call this and that's what the bill name is HB sixteen eighty nine this bill sets up the process of structure for the house and Senate education committees to use during the upcoming adequacy study process to revamp the public school education funding system which is a big time needed based on Tennessee model this is put in place as your dollars for target to the needs of both students and schools create an education system that is able to help each student reach higher learning reach how learning levels and standards this includes being able to read proficiently by the third grade the specific learning targets throughout their school careers especially specifically the system recognize the small schools that do not have deficiencies required to make such adequate resources the schools for students facing the challenge of poverty language very special education need often need more resources to achieve the same level as our peers and who do not have to do not place that same channel of challengers this bill will have a new funding structure in which each child generates a unique amount of funding for the school district that means each student will be funded differently in a school according to their needs and what they are and who they are. First of all the students will receive a foundation level of funding was for provides all those basic elements in the student's needs in our school for adequate education secondly the weighted funding is applied on top of that to help the needs of students learning in small schools of schools was concentrated poverty and those who have special learning needs next there's a direct funding level that goes into schools based on their student population for instance additional funding is provided free student in grades K. two three and just resources to ensure students from parkland reading for grade three additional some goes to support the students in fourth grade who did not meet proficiency by the third grade money for press professional learning communities communities and for students in career and technical education tracks and ACT test and for the high school level. Considered direct that's direct funding then finally you have the outcome funding will be provided a rewarding schools when their students meet certain performance outcomes such as third grade reading score proficiently in reading high school students who are meet readiness levels on the ACT again recognize the fact the students with special challenges cost more that then Because more and support these higher levels of learning outcome rewards could be would be higher for those students schools for schools and just of our school districts who would develop an annual plan for spending these funds all unrestricted along with their performance goals and their approach for producing students of the Department of secretary of education secretary and now the desi we call it try to do that would create autumn accountability system based on these goals also to see officials said that the because of that because parents are now able to see exactly how much money they're students generate for district they will be able to hold schools accountable providing every very sore the very services their students need creating a local level of accountability and local conversations since that will be that we never have before. The timeline to build this structure appropriate Arkansas students at school during the upcoming adequacy study we're going to do that and with the new funding system to be placed in for the twenty five twenty six school year the House Senate education committees will determine the new foundation announcmenet along with the. All we have to do is hunt and fish and conservation and preservation of our great habitat and outdoors is incredibly important to me personally following the law is incredibly important to me personally and we ought to do more to stop those bad actors that are negatively affecting our habitat breaking our outdoor laws but I do think that this particular piece of legislation goes a little bit too far. On page one lines thirty through thirty two it says while knowingly hunting wildlife in a manner that creates the substantial danger of serious physical injury to another person causes physical injury to a person and it goes on and it does stipulate. having to do with alcohol but. I want to make bring up for examples that are all very. Dangerous. In another nature first duck hunting oftentimes you to come in a steel pit in the middle of a rice field if somebody forgets and in the steel enclosures oftentimes fourteen to twenty feet long somebody accidentally forgets to put on their safety the gun it gets knocked over by a dog it goes off and injures somebody else or kills them it's it's it's a tragedy that is a natural danger whether you're sober or having a beer it it really doesn't matter the funding is another example I don't know if you've done it before but you you get a bunch of people with a bunch of shot guns and you sit behind a bills in the middle of the field and you've fire way it does and it's not particularly safe but a large portion of the state every Labor Day gets together enough funds hog hunt with a knife it may seem crass but it's a cultural part of our state's history especially down in south Arkansas and I'm not even from self Arkansas but I've been down there several times and when you're all done it is not a safe it is not safe pastime and alligator hunting is also inherently dangerous and these alligator hunts involved firearms so I just think that knowingly hunting wildlife in a manner that creates substantial danger of serious physical injury is just a little too vague and broad. my second issue with this bill it says Page two line three purchases sales offers for sale barter trades any species of wildlife proportion of wildlife and it goes on to stipulate five hundred dollars more and this is not create the exception for for bears people to go out and trap beavers or any other firmware animal that sells as Pelzer hides for aftermarket purposes and for the three.
