Meeting — March 17, 2025 (33:14)

Thank you, Mr. Speaker. And I'm going to ask if Representative Steele will join me today. So, colleagues, today is Jack and Jill Day at the Capitol, and we have a group of individuals that are here with us today. They are up in the gallery, if you all will please stand. We have members from the Greater Little Rock Chapter of Jack and Jill, which is a part of the Jack and Jill Foundation of America.

So, uh, similarly along the lines of Senator Hester, approximately how many do we have right now that are on, it sounds like what you're describing is an employee

Judiciary Committee (House) — March 18, 2025 (1:06:30)

guess that would be what I would ask, and so that's a question, I guess. Can

Judiciary Committee (House) — March 18, 2025 (1:06:06)

So, I guess my question would be, in light of all this, would Representative Bentley be willing to pull it down and have some discussion with the AG's office and some of the members that have raised these concerns?

Judiciary Committee (House) — March 18, 2025 (53:55)

Just as a follow-up, so it's my understanding that your intent with regard to clothing and even to hairstyle is not that there would be liability for some salesperson at a department store who sold clothing. That's not what you're attempting to address. And I guess likewise, if someone goes to a barber shop or a salon and the barber hairdresser, that they do what they're asked to, they, you know, give the hairstyle haircut that they're asked to give, you're saying that you don't intend for there to be any liability in that circumstance.

Judiciary Committee (House) — March 18, 2025 (52:54)

I guess I have a question as to whether there's any thought to that or what would occur in that circumstance. Thank you. And I appreciate your concerns,

Judiciary Committee (House) — March 18, 2025 (53:01)

Representative Shepard, and I would say that a judge would certainly take that into consideration, correct, if

Judiciary Committee (House) — March 18, 2025 (52:23)

And then secondly, it provides for recovery by parents. But is there any, is that available in all circumstances? In other words, if a parent is actually taking action to assist, then does that, can they then turn around and file suit against others who they may have engaged to assist in that regard?

Judiciary Committee (House) — March 18, 2025 (51:53)

And again, it gives, this is a strict liability, essentially strict liability if harm can be shown. And I guess I'm curious as to what those provisions on clothing and hairstyle, what that would relate to, because I know Representative Moore brought it up. And the thought, I mean, clothing and hairstyle, neither of those are permanent or generally not permanent. So I guess I would have a concern related to that language.

Judiciary Committee (House) — March 18, 2025 (51:23)

That's over on page three, that there has to be liability for personal injuries or harm resulting from social transitioning or the other actions that might be taken. I guess I've shared the concerns that Representative Moore brought up on the social transitioning definition because that relates to, it can include clothing and, I believe it was, let's see, clothing and hairstyle.

Judiciary Committee (House) — March 18, 2025 (51:02)

thank you. Representative Shepard, you're recognized for a question. Thank you, Madam Chair. Representative Bentley, I guess some of my questions relate to the possibility that there could be additional amendments. You and I have talked about some of the concerns, and I'm trying to read between the amendment and the bill, and so some of these things may be addressed. One thing with regard to Representative Hudson's question, the bill does refer to harm.

Judiciary Committee (House) — March 18, 2025 (36:16)

Yes, they can. They've seen known devastation or harm to

Judiciary Committee (House) — March 18, 2025 (2:05)

Members, you'll recall House Bill 1508 was the recodification of Title 19. That was the, I believe it was 850 pages long, but there were a couple typos, or
