speaker i'd like for representative wilkins representative ferguson to come and join me please and when they're coming down i'd like to talk to you a little bit about heroes with amongst us and they come in all say shapes and sizes as all of you know but we have here today honor a man that went above and beyond what he's required in his daily duties he's a wildlife officer and I want to talk to you a little bit about wildlife officer and the representative Wilkins will give the scenario what happened that day but you know our wildlife officers were mostly supported by sportsmen before we passed the one-eighth one percent sales tax those of you that remember that but they were they patrol our streams rivers lakes woods take care of a lot of the wildlife issues that we've had. But since then, they've evolved. We gave them full police powers in the mid-90s, early to mid-90s, and they've become a big part of our law enforcement community, a big part that we solely rely on a lot of times in rural parts of Arkansas. little nervous when John starts talking about all the things that's going on with the game fish over the years, because it was approximately 45 years ago or so when I went to work, and I think I was there for every one of them. Of course, my body's starting to show that. But on May 20, 2010, an extraordinary event occurred in West Memphis, Arkansas. Many of you in city, county, local that was able to see this, see the video of this event as we presented the bill to the committee, the resolution to the committee, saw what an event it was. A group of anti-American, anti-government activists on Interstate 40 were stopped by a couple of city police officers from West Memphis, a drug interdiction bunch. These guys were able to kill the two police officers and proceeded to a West Memphis, Arkansas, Walmart parking lot where several officers surrounded them. And Officer Michael Neal, which when y'all saw the committee, y'all probably saw in committee, y'all saw something different than I did. I saw the training. I was familiar with the training he had been through, and I saw his training take place. Recently, he has been honored by many over the last two years, and recently he received the Presidential Medal of Valor, pinned on him by Vice President Joe Biden. And this young man is a well-trained law enforcement officer, but he is also a very brave man. I don't know how many of us could have done what he'd done. But it is without doubt that he saved many lives in West Memphis, Arkansas on that day, including other police officers, including citizens. We had people loose on a Walmart parking lot with automatic or semi-automatic weapons that were very dangerous and had no regard for the law, had little regard for human life. And without the interdiction of this officer here, it would have been a much worse scene than it turned out to be. Mr. Speaker, would you have the resolution read, please? Whereas Arkansas State Game and Fish Commission Wildlife Officer Mike O'Neill was presented the Medal of Valor by Vice President Joe Biden at the White House ceremony on February 20, 2013, for his heroic acts on May 20, 2010, in West Memphis, Arkansas, and whereas on May 20, 2010, two West Memphis police officers were killed during a traffic stop on Interstate 40 after stopping a van driven by 45-year-old Jerry Kane, who had his 16-year-old son Joseph with him and whereas Officer Neal strapped on his heavy armor, loaded his Bushmaster M4-223 rifle and headed to the scene and whereas the gunmen had made their way to the Walmart parking lot and were approached by two more officers who were subsequently also killed by the Canes and whereas Officer Neal pulled into the parking lot where the Canes were trying to get away from authorities in their van and with one hand on the steering wheel and the other on his rifle, rammed his truck into the van and stopped it and whereas 12 officers fired at the vehicle, killing both Jerry Cain and Joseph Cain and whereas Officer Neal has received more than two dozen awards since the incident and whereas Arkansas State Game and Fish Commission Chief of Enforcement, Mr. Jeff Crowe, said we are very proud of Michael and appreciate the administration's acknowledgement of his bravery and the valor he displayed in this incident. His extraordinary service is a testament to the dedication of all those who serve in law enforcement in the state of Arkansas, and whereas United States Senator Mark Pryor noted that Officer Neal showed extraordinary bravery when he put his life on the line. He is a true hero, and I can think of no one more deserving of this great honor. Now, therefore, be it resolved by the House of Representatives of the 89th General Assembly of the state of Arkansas that the House of Representatives commends Officer Michael Neal on his extraordinary service to the State of Arkansas and his selection as a recipient of the Medal of Valor. And I think, not speaking for her, but I'm sure that she would agree that we learned the close ties that they have between Arkansas and Taiwan. You learn a lot of educational values there. to explain the amendment. Thank you, Mr. Speaker. This bill began with allowing everyone who casts an absentee ballot to have it count, even though they died before Election Day. The reason for that is that you can early vote, and it counts, and it doesn't matter whether you live or not. Out of some concerns of Secretary of State, we amended it to cover only soldiers. We got down to the Senate, and everybody got together in a room. They worked out the language where we can restore this privilege to everyone that votes absentee, provided that they have completed their ballot and had it delivered before their date of death. The real impetus for this is the soldiers are allowed to cast their ballot even though they die by federal law, Military Overseas Voter Act. That leads to possible equal protection problems for those that are still here on the stateside. So this bill takes

Colleagues, the Arkansas CASA Court-Appointed Special Advocates Association represents 20 local programs across the street that recruit, train, and supervise volunteers to advocate for children who have been abused and unelected and placed in foster care. Juvenile court judges appoint these volunteers who research the children's cases, monitor how the children are doing, speak up for their best interests, and make recommendations in court. With the help of a CASA volunteer, a child is half as likely to languish in the foster care system and that much more likely to find a safe and permanent home. In 2012, 1,113 volunteer advocates served 3,398 children in foster care. Arkansas' CASA's goal is that every child placed in foster care will have the benefit of a qualified, compassionate adult speaking up for them. Establishment of the Arkansas CASA license plate will increase awareness of and raise local funds for CASA programs. Please show your support of Arkansas CASA and vote in favor for House Bill 1781 to establish the Arkansas CASA license plate. I appreciate a good vote. The Alcosa is a good organization. We've got a really, really good chapter of it in Harrison. A great organization, great purpose, as is Following Soldiers. I think we're going to hear about it later. And the Arkansas Tennis Association, good group. I like them, too. The problem we have here is years ago we established Code 27-24-1404, which is an application process for additional special interest license plate decals. There's a difference between statute and rules and policy. And we are, right now, we're using statute to create every license plate out there, where years ago we established by statute some rules for our Department of Finance to put together special license plates with decals, which allows CASA and the Tennis Association and the following officers and every other organization that comes before us every year, that opportunity to honor the people that make contributions and to also differentiate yourself with that special decal on the back of your license plates and to send the same amount of money to these organizations without having to buy as many license plates as you have to buy. So it's actually easier for the organization. Every time we pass one of these bills, whether it's costs or, again, following officers or whatever, what we're doing is we're overriding the previous General Assembly that put together this statute, put together these rules, which makes a very simple process that allows people to honor themselves, honor the groups that are giving money. The money goes to the same place. We're still supporting costs. It's a very simple form to do. They don't have to run up here and do statute. What we've done instead is we've put this body, the General Assembly of the State of Arkansas, whose charge is to run government for the State of Arkansas, into the bumper sticker business. Let me just begin by telling you, first of all, that what I'm going to share with you today comes with the full blessing of the Hospital Association, the Arkansas Department of Health, the March of Dimes, the Arkansas Children's Hospital, and the American Heart Association. Congenital heart defects are the number one killer of infants of birth defects. Pulse Ox is an easy and inexpensive method of being able to detect heart defects to assure that when babies go home, that they are going home as healthy as possible, and if there is a problem, it can be detected as early as possible. In the committee the other day, there were two mothers who came and shared stories about their babies. One of them has their baby home, but yet a Pulse Ox would have helped them get home quicker. The other one, her baby is still in the hospital, and we are not sure about how long the baby will be in the hospital. A simple pulse ox test would have helped to assure that the defect that the baby had would have been discovered before the baby was released. This bill would assume or assure that every newborn that is delivered in a birthing facility in Arkansas has the pulse ox exam. In fact, the Pulse Ox test is now the fifth criteria for helping detect heart disease in newborn babies. This bill brings accountability and sets in motion the methods to gain information and share that information with all parties of concern. And as I mentioned, this test is now considered the fifth screening to assure that heart defects are detected in babies. Now, you have always known that if I knew something when I stepped up into this sacred spot, that I always would tell you all the information that I would know. The other day in the committee, a situation arose that drew some attention and some concerns about the working relationship with the Arkansas Department of Health and the responsibility that passage of this bill would impose upon them as possibly an unfunded mandate. I will tell you standing here today that after that meeting, and as recently as 1245 this afternoon, that the parties that I mentioned a while ago all came to the table and have all agreed that this bill is a good bill, but it will require an amendment before it gets to the Senate end. I would respectfully ask, and I'll be glad to answer any questions that you may have, but I would respectfully ask that you would grant me the right and the privilege, and for the sake of the babies, not to slow things down, that we could pass this bill as it is out of the House, knowing that there will be an amendment that will be added on the Senate end. But this is all agreed upon by these five parties that I just mentioned a while ago, and it resolved the issues that were brought out in the meeting during the public health, and good issues at that, and issues that all five of these entities have come together and said that this is fixable and we can pass this on so that we can get this out as soon as possible. You recognize? Is the additional cost that they're concerned about for the equipment itself or something else? Because I would guess probably 80-plus percent of the hospitals in the state already routinely use this. Currently, over half the hospitals in the state of Arkansas that have birthing facilities already do this test anyway. And what this bill is going to help assure that this vital test continues to be one of the tests that is incorporated into making sure that when babies leave, they are as healthy as possible. the cost of which the original fiscal impact had it labeled at $75,000 was composed of two key elements. Number one was the electronic portion of being able to take that information, track it, and make sure that it was passed on to all responsible parties. And the health department said that they will be able to absorb that cost and are willing to do that. The second one was the training aspect of it. And in the bill, in the way it's originally written, said that they would be responsible for going out on-site and doing the training. And through a partnership with some hospitals, Arkansas Children's Hospital being one of them, that issue has been resolved, and they are in agreement that they can move forward. So the impact has been greatly reduced, and the Arkansas Department of Health has had a great Pepto-Bismol pill added and has resolved their indigestion. Thank you.

And they believe they can do that without either any cost or with minimal costs that they'll be able to absorb. And then the second part was the educational aspect, who's going to do the training, how's the training going to be done, and the costs associated with that. And I will give credit to everybody that's on this list, but the Arkansas Department of Health worked over the weekend in order to make sure that this could get out of here today. And so they have worked out the arrangement that the training that's required in order to make sure there's a standardized method of teaching this across the board can be done with little or no cost. I'm either going to have a degree to be a doctor, or I'm going to have a degree to be a lawyer. And this one is what's going to give me the degree to be the lawyer. I remember in the, you're supposed to laugh, but evidently it wasn't that funny. So anyway, I remember sitting in a meeting during the interim, and Chief Justice Hannah sitting there, and we were having a discussion, or the discussion was about trial court, administrative assistants, and other individuals who in the past couple years have had to live on the edge because they weren't certain if their paycheck was going to come through. And quite honestly, out of that meeting was born the idea that, you know, anybody that works for the state at any capacity ought to have the reasonable assurance that if they do a decent day's job and they do what they're supposed to do, that their paycheck is going to be there waiting for them when it's all said and done. We would want that not only for our state employees, but we would want that for our employees in the private sector as well. And from that came the idea of House Bill 1366, which revises the priority of distributions from the Administration of Justice Fund, requiring that available revenue be first used to fully fund the monthly allocations for the Court Reporters Fund, for the Arkansas District Judges, Counsel, and Executive Director, and the Trial Court Administrative Assistance Fund. This prioritization will ensure that the salaries of these individuals working as essential court personnel will be fully paid, and this bill protects the salaried positions from revenue shortfalls that may occur in the Administration of Justice Fund. There are a number of programs funded out of the Administration of Justice Fund, and if you looked at the matrix, you would see that over the years, it has grown as people recognize this as an avenue of revenue. And there have been much discussions about how salaries should be protected above the funding of a program that may receive benefits of this. This is the intent of House Bill 13-66. As many of you may remember, the House recently passed Senate Bill 307, which became Act 282. And Act 282 had an emergency clause and contains provisions which are intended to increase the revenue for the Administration of Justice Fund. The hope is that the provisions of this bill, House Bill 1366, will not have to be utilized, but it is necessary to protect the salaries of the individuals that are listed. And in short, I'll just say, as I mentioned a minute ago, that if there's anybody who's working for our state, that they ought to be paid at the end of the week or at the end of the month when their paycheck comes, and they shouldn't have to find out a few weeks before Christmas that their check isn't going to come. I wouldn't want to have to live like that. I don't think that you would want to have to live like that. And this is an opportunity for us to protect those individuals that are vital to our court system and to our ways of law. And I'll be glad to answer any questions that I can to my ability.

During my 24 years as an educator, I was a mandated reporter of any child abuse or neglect. Currently, nurses, doctors, dentists, police officers, a long list of people are mandated reporters of child abuse or neglect, but there is an oversight in the law. Currently, workers in reproductive health care facilities are not mandated reporters. This law would add an extra layer of protection by having these people also be mandated reporters. This bill would also do a second thing that would be helpful. It would require that in any abortion done of a minor under the age of 14, some tissue would be retained. So in case of a civil or a criminal lawsuit or civil action, excuse me, or a criminal action, we would have DNA sample. Yes, there's a possibility that this young girl might just have an older boyfriend, a year or so older. There's also a very strong possibility that this could be an adult who has offended on this child. Georgia, Mississippi, and Illinois all currently have this law. It passed in Illinois unanimously in both chambers and was signed into law with virtually no opposition. There was a bill that was passed out of last session that created an opportunity for the Department of Health to publish and to provide information in birthing facilities and at time of the birth of babies regarding shaken baby syndrome. Since that time, there have been some organizations that have come and requested that they could distribute some materials through the Department of Health. And what this bill will do is provide that avenue under the guidance and under the direction of the Arkansas Department of Health to provide information to further expand that information going out to daycare centers and to other facilities. As it is right now, as I understand it, it's provided at the birthing point of the baby. But once it gets past that point, information is limited. And as you know, unfortunately, a lot of times the shaking baby syndrome and crime, as I would call it, occurs beyond that point. But in all seriousness, I'm certainly sympathetic to Representative Link's concerns, but the fact of the matter is, we already have a number of license plates. This bill was brought to me by the Director of the Commission on Law Enforcement Standards. You think about all the license plates we have in the state of Arkansas, yet we don't have one for those who are law enforcement officers or in support of law enforcement officers. This bill would establish a license plate for certified law enforcement officers, including prosecuting attorneys and officers of the Department of Corrections. It would also establish a license plate in support of law enforcement. And then, as well, it would establish the Arkansas Sheriff's Association license plate. This bill would create the fallen law enforcement officers fund. Of the proceeds from each of those plates, 25% would go towards this fund. It would be administered by the Commission on Law Enforcement Standards. On the law enforcement plate, 75% of the proceeds would go to benefit the Arkansas Law Enforcement Training Academy. So I would suggest that this is a very conservative bill that ultimately will save the state money because we're going to be putting money not towards an outside organization, but actually putting this towards the Law Enforcement Training Academy to benefit all of the individuals in the state of Arkansas.
