I pray that you would help them to experience your grace and your peace in their lives. I know they also bring uh weight with the concerns with them about the people they love. I pray, Father, that you would show your grace to them as well. Lord, I pray that you'd help these men and women to be guided by your wisdom. Give them wisdom to make good decisions today, but also uh with the things they face in their own life. right, good afternoon. So I bring your resolution recognizing March 21 as World Down Syndrome Day. Um, this resolution was brought to me or the idea was brought to me by a constituent who runs our Down syndrome connection of Northwest Arkansas, and they are remarkable organization. They're a very small group of parents, but they have a strong network. It's over 250 families, business leaders, educators, and therapists, all supporting individuals with Down's syndrome. They are there from day one. They have a collaboration with Mercy Hospital, and if you have a child with Down's syndrome, they are there that day, supporting you from that time until your child is 40 years old and older. They make a lasting impact. The volunteers have put in nearly over 1000 service hours and this year alone, advocating, educating and uplifting the Down syndrome community. World Town Center Day is observed on March 21st. A date chosen to represent the triplication of the 21st chromosome, which is the cause of Down syndrome. This resolution reflects the incredible work done by the Down syndrome connection of Northwest Arkansas in the incredible families across Arkansas. So I ask you to approve this resolution. Thank you. We'll, we'll applaud them in just a minute, but in the year 2005, Mr. Jim Davidson, along with the Conway police chief at that time, and some other members from Conway decided they would do something to make a difference in the kids' lives in Conway. So each, they started by making 50 bookcases for the kids in the Head Start program. Met with the superintendent, see the kids that really needed, uh, the books in that community, brought them, gave them a bookcase with their name engraved on it, a little, uh, reading buddy and a stuffed animal and some books, and since 2005, this group has done 1000 bookcases from 2005 to now. Done a great job in the year uh 22,020, the Kiwanis Club decided to step and helped Mr. Jim Davison, so now we have the NAB Hos Company in Conway building the bookcases and this group gets together with the library. I've been honored to go there when they give the kids the bookcases at the library and the whole group there in the in the library does a great job encouraging those kids to read and really making a difference in illiteracy in our state, um, and with that, I would like to have the, uh, clerk read the uh resolution and title only, please.

Thank you, Mr. Speaker. Colleagues, back in the 90s when NAFTA was created, this allowed for trucking companies to transport goods into the United States and onward to Canada and backwards. Over the course of the past 6 years, according to the highway police and state police, we've seen a large increase in fraudulent Mexican CDLs that are in the marketplace. Currently House Bill 1745 is a, is a solution for that. This bill requires Mexican and Canadian trucking companies to get a work authorization form prior to driving our. saw roads. This form would be obtained through the federal government. The Arkansas State Police and Arkansas Highway Police said in committee yesterday that this will be a great tool to help valid to help validate the identity of drivers and their driving privileges. I want to be clear on this bill. I know that there's been some things passed out, some text messages that have been sent. We are not expanding driving privileges for illegal immigrants. It's not happening. All we're doing is providing another layer of protection for Arkansans. Yesterday in committee, we also heard that we weren't going far enough, that this bill was not going far enough. The reality of this bill is we're going as far as the federal government will allow us to go. We've worked with the Arkansas State Police. We've worked with the highway police. We've worked worked with the attorney general's office, and this is as far as we can go. The state of Texas passed this bill, something similar to this bill, 2 years ago, and it's working right now. your bill. Thank you, Mr. Speaker. Colleagues, this is a bill that has become very important to me. I was hoping it'd be the first bill heard by the new Veterans Affairs Committee, but since it addresses a tax issue, I think there were some rules that prevented that, but I do appreciate Speaker Evans' consideration and assistance with trying to assign it to that. Friends, HP 1072 makes what I believe to be a much-needed clarification for disabled veterans. Who as a result of their service connected disability are exempt from payment of property taxes. This idea was brought to me by a constituent in my district and I thought, Arkansas code 263306 states, a disabled veteran who has been awarded special monthly compensation by the Department of Veterans Affairs. For the loss of or the loss of use of one or both, one or both, one or more limbs for total blindness in one or both eyes. Or for service connected 100% total and permanent disability shall be exempt from payment of all state taxes on the homestead and personal property owned. The law goes on to state that the 100% totally and permanently disabled veteran desiring to claim this exemption. Must furnish to the county tax collector a letter from the Department of Veterans Affairs, verifying the veteran is in fact 100% totally and permanently disabled. The law does not state how often this letter should be provided to the collector. And we found that collectors have been making these rules and determinations themselves and requiring that the letter be submitted annually. Or on some other semi-annual basis, even though there's nothing in the law that requires my constituent and his peers have asked if this letter could be submitted only once. Since a 100% total and permanent disabled status is very highly unlikely requiring annual submissions can be burdensome on veterans who have a difficult time getting to the collector's office. Or can't remember to get a letter and to submit it. Especially those who are elderly. Or with mental health concerns or with physical disabilities. I thought this was a reasonable while working on this bill and visiting with veterans, I found that many find this annual requirement difficult. And many face difficulties getting the letter that they need from the VA. We've also found that these issues have been going on for many years. I found an attorney general opinion from 2010 that addressed this issue. Bear with me just a minute here. I want to read parts of this AG opinion to you. I think it's very important. This was an opinion requested by the then director of the Arkansas Department of Veterans Affairs. He said, we would like to know whether ACA 263306 requires eligible persons to provide a letter from the department annually. Or should one letter issued by the department be kept on the county collector's file from year to year. The director said, it is my contention that the code requires one letter be furnished by the veteran and retained in the tax collector's file from year to year, not a new letter each year. We request your opinion as to whether the code is written requires persons eligible for the exemption to supply the county tax collectors with an annual letter from the department. In response, the Attorney General said, in my opinion, A conclusive answer to your question. Probably requires legislative clarification. The AG went on to state. There are a few textual arguments supporting the reading that a single letter will suffice to establish the exemption indefinitely. The statute requires the veteran to file, quote, a letter, which may indicate that a single letter is sufficient. Are their veterans are only eligible for the exemption if they have a form of permanent disability that is described by the statute set out above. So presumably, the legislature had in mind that when a veteran became eligible eligible for the exemption. Here she would always remain eligible. In my opinion, the combined force of these two textual points, the use of the indefinite article and the permanent nature of the disability. Add significant weight to the argument that the legislature intended for one letter to suffice indefinitely. The AG concluded, as noted above, one can make a strong argument that the statute contemplates a one-time verification. But given the statute's context, I cannot confidently predict how a court would resolve your question. Legislative or judicial clarification is warranted. Colleagues, HB 1072 does just that. It provides that clarification suggest, if you look at the bill with me, it simply states, A letter from the department required under this subsection. is required to be submitted only one time to establish eligibility for the exemption provided under this section. Annual submission of a letter from the department is not required. If you look on section C, this is an amendment I added. After having some conversations with my county tax collector, this amendment was added to address concerns that she brought to me. A taxpayer shall notify the county collector if he or she has previously submitted a letter under this subsection, but no longer qualifies for the exemption provided under this section because he or she is not a disabled veteran as provided in subdivision A1 AI of this section. This is a permanent Disability Very highly unlikely to be revoked by the VA. I've heard of one example. Uh, and a veteran had cancer. Uh, that would have been tied to his service with that he went into remission, so he lost that status. Section C would cover that issue. It'd be very rare for that to happen, but if it does happen, section C will cover that. The veteran loses that exemption. They're required to report that to the collector and resume paying. Colleagues, I think this is a good bill to solve this issue for disabled veterans as mentioned, state law does not clarify how often this letter should be submitted. But I believe by reading of the law that the original intent was for the letter to be submitted, submitted once to establish eligibility. The assessment coordination division has no rules on this issue. The AG's opinion said that legislative clarification is needed, which is what I'm trying to do. Essentially, the collectors have been left to make their own rules on this and theoretically 75 counties could handle this 75 different ways. I think bringing consistency across the state to this issue is also a factor and a big forensic bill was brought to me by disabled veterans, and I believe that it's a reasonable request. We're trying to help these women and men who may be mentally or physically unable to acquire this paperwork and get it filed in a timely manner. There's really no great reason to require them to file this paperwork annually when they have a permanent disabled status that is highly unlikely to never change. Um, this is a continued protection of moving school board elections to win voters actually vote. Which uh has created record uh voter turnout in every district across Arkansas. Uh, as long as we govern our schools by elections, we should do everything in our power to maximize participation in those elections. Uh, school board members should be elected to even number years like every other elected office. As nonpartisan position, school board members should be elected with all other nonpartisan races during the preferential primary with runoffs in the general election. Um, the annual school election has provided uh by the con the Arkansas Constitution will not be impacted. School districts will save money by no longer having to bear the entire cost of odd year elections. Uniform 4 or 6 years will provide 2 years of consistency, no change in those school boards while allowing for individuals to still enter into a board that uh that they wish to stand for election for. Uh, treatment of those existing terms are prescribed to uh ensure fairness and as nearly as possible that can equal number. of positions are are uh equal the number of positions that are up during every school board election. Um, this bill we collaborated with the Arkansas Association of Educational Administrators in the Arkansas School Boards Association to make this bill better. We have addressed their concerns and adding in that local that that local opt-in of 4 to 6-year terms. Um, And the additional concerns with uh the, the single disagreement of the timing of the runoff elections. Um, if we are starting from scratch to create uh to create school board elections, we would not create our current system, um, of alternating high and low turnout elections and holding elections when there are no others. Colleagues, today I bringing House Bill 1782. You'll recall a couple of weeks ago, we acknowledged eating disorder awareness week and one of the cool things about this bill is that it came from discussions following that week among some of the women who, uh, spoke about their experience with eating disorders, including, in particular, Representative Denise Garner and Representative Deanne Vaut. Uh, what this bill does is it restricts the sale of diet pills for kids under the age of 18. Um, this would only apply to build the pills that are actually marketed as diet pills. This doesn't, this doesn't include dietary supplements. It doesn't include laxatives. It doesn't include protein powders and shakes and muscle milk and all that stuff. It's just diet pills. And one of the reasons that this is important is actually sort of laid bare in a study that came out just this year in January of 2025. Um, and what the, what the researchers discovered was that laws restricting over the counter diet. s found that over 30 years, the age restriction policy would prevent over 57,000 eating disorder diagnoses and 22,000 diet pill-related adverse events in the, in the state of Massachusetts. Obviously, Massachusetts is a lot longer or a lot larger state than we are, but you can extrapolate what a benefit that this can be for kids in the state since what the other thing the study found is that a lot of people, the majority of people really start using diet pills when they are under 18 and that the use of diet pills in kids under 18 often does lead to eating disorders. So this would require that, that, uh, retail stores, card kits before letting them get it. Obviously, if their parent wants to purchase these diet pills for them, they are welcome to do so, but it also allows parents to have a little bit more input into what their kids are ingesting and putting into their bodies. It often requires that you need anesthesia, even to have the basic. Of dental care, like a teeth cleaning. Because It's very hard to perhaps get someone who's afraid of that sound or that smell to even be still long enough to have someone put something in their mouth or maybe even just look in their mouth for a quick second. And right now, you're going to have a really hard time, especially if you're on Medicaid, finding a dentist that can treat you properly. This bill will take a huge leap towards making sure that that person can get the care. I've worked extensively with the Arkansas Dental Association on an idea with lion College School of Dental Medicine, which should be opening this summer, and it actually will potentially make the cost of that care. Less expensive because the overhead by doing some of these services at the Lion Dental School will actually, uh, the overhead will not be there as opposed to when it's in a hospital. So we could actually be finding a less expensive way to provide top quality care. On top of that, where will be training the next generation of dentists. That is a plus for anybody else in the future because these dentists will have the opportunity to work with this group and kind of learn what they need to do, so that might, they might not need, um, Uh, anesthesia when they go for those basic trips. I, all cards on the table, there is a fiscal impact with this. We spent, I, I was in public health 3 different times to get this bill through. We worked on it with DHS and DHS is now neutral on this bill. Thank you to Lee Johnson for all of his help trying to get the wording just right on this. The fiscal impact that was out there before is not what it is. DHS is not going to make a new fiscal impact because we did change some things, we limited it. So after $3750 We have limited to that amount. We expect that there would be absolutely no more than 600 cases in a year. If you factor all that in, the state match to Medicaid would be $670,000. That's it. We are providing a vitally needed service in the state of Arkansas to this group. I really would appreciate a good vote. This is very needed. I don't know of anyone against this bill now, as I said, DHS is neutral. We are finding an inno innovative way to provide quality care at a lower cost for a very special

colleagues, this bill is attempting to address a problem that I never knew existed until last year. Uh, when unfortunately my family, uh, had to deal with the loss of my father. Um, after that experience, which was not good, um, because of what happened during our experience, I started doing some digging into our walls regarding consent and the ability to revoke consent on behalf of incapacitated donor. And in reviewing these laws, I learned three things. Uh, number one, The folks of our state, including myself, when you sign up for organ donation on your driver's license, people are not aware of how extensive that consent is. Uh, I thought it meant that somebody needs my hearts or lungs or wherever to save someone, they could have them, and I was all for that. That's why it's on my license. Uh, but in fact, under the law, it allows uh agencies to take more than that, including soft tissues, bones, hair, things of that nature up to and including the entire body. The second thing I learned was that under our law, consent only goes one way. If you have consent on your driver's license or if you don't have consent on your driver's license, and you're in that situation. Your family may give consent on your behalf when you're incapacitated, your power of attorney can, your next of kin can, it goes all the way down to, and I quote, an adult who exhibited special care and concern for you, unquote. So I guess that means like probably a neighbor that took care of an elderly. However, the consent only goes one way. But I was shocked to learn was that your power of attorney under current law has no right to modify that consent in the hospital any way, shape, or form. form. So even if your loved one has changed their mind, even if your loved one has told you their wishes to not be an organ donor or to say you may have My lungs and hearts and kidneys, but please leave my skin because I'd like a viewing at my funeral home. You have no right to make that change. The third thing I learned, and this was from constituents that brought this to me is unfortunately, the experience that we had was not uncommon. Uh, there are more and more stories out there in this state concerning when this process goes off the rails and families are being treated not with compassion and kindness, but are be treating uh and Another thing that I learned was that the organ procurement agencies in this state are also inserting themselves into the decision of families of when to remove life support. So the family makes a call of we're ready to remove life support and let our loved one pass away. The procurement agency comes in and says, we override your decision, we're going to leave them on life support for another 6 hours, 12 hours, 24 hours, 48 hours till we can get up and do our thing. And they're keeping the families out of the process. And I was also shocked to learn that in these cases, the families are the ones being charged for this. So this bill is designed to try to fix this problem by making only 2 small things. The first thing it does is this bill clarifies that under the, uh, if passed, the power attorney of the of the person who's incapacitated in the hospital would have the ability to modify the consent to organ donation at bedside. This bill also provides that if there is no power of attorney, then the next of kin who have the right to consent to medical treatments and things like that would have the same right. The other thing this bill does is that it allows or requires or procurement agencies in this state to start reporting at the state level so we can start getting data on the number of transplants that are happening, the number of recoveries. Is it going for research? Is it going for education? Is it going for transplant and let us start getting data on what's going on because at the state level, this is an unregulated industry and we don't have the data to make sure that everything is going OK. Trying to explain a bill. So, um, I'll say water is not a red or a blue issue. Water is not a north or a south issue. Water is not a rich or a poor issue, and we have a major water problem in the state of Arkansas. And I believe that everyone deserves good, clean water. I have people that's in my district that sends me pictures quite often, uh, trying to fill up a bathtub for a child to take a bath, and there's dirt in the tub from the water. For 6 years. I've tried to work on this issue. Because the more we kick down this can down the road, the more expensive it truly does get. I want to thank Mr. Speaker, and several that have met with me the last several months trying to get this bill exactly where we need it to be. And I do appreciate each and every one of your help. I needed everyone's help because we need everybody's eyes on it, whether they were in a city, a municipality in the rural areas in Northwest Arkansas, where it's growing so fast that they can't keep up with the water issues that they have there, or if it was, um, Dealing with our nursing homes and our hospitals. This is an economic development issue. We're losing people coming to our state because we can't provide water, sewer treatments, and we can't provide the water that they need. We have businesses that would like to grow in our, in our districts, but they can't grow because we can't do the water sewer treatment that they need or provide them with the water that they need. Again, I believe water is something that everybody Should have and deserves. I think about what our schools will do when we don't have enough water for schools and we have to shut down schools because they don't have water. I think about hospitals and what hospitals will have to go through if we can't provide them with good, clean water. And then our nursing homes, what happens when we can't get good clean water to our nursing homes. And we're having to move people. Again I wanted to take a little bit of time and try to explain some background on this. House Bill 1681 and 2021, the Department of Agriculture did a survey, and it showed that we needed 5 billion with a B. Water, waste needs in our state. In 2024, that same exact, there was no change in, you know, who was working over there. The same Department of Agriculture shows that we have a $9 billion water wastewater need in our state. What if we keep at our current trajectory, trajectory, crumbling water, sewer infrastructures in most of the state. Capacity challenging, stifling growth, and, and already seeing missed economic opportunities within our own districts. Costs of capital construction continues to move out of the reach of so many of our districts. With House Bill 1681, this program will provide a source of funding to start to bend. The trajectory of our state. And get so many projects moving forward. This is truly a statewide opportunity to, to actually move projects forward in our state. $50 million as was brought to my attention in committee is just a band-aid. I understand that. We're looking at taking $50 million of the interest from security reserve funds. After all the obligations are already met. So there's 4 obligations that's already coming out of there. This would be the 5th obligation. So if There was not $50 million left in there and there was only $1 million in there, then we might have a million dollars to go toward water grants in our state. We made two different buckets. There's an 80% bucket and there's a 20% bucket. The 80% of the funding to be used, uh, in systems where there's 1200 plus, and they would require matching funds. So if we did something and say representative Burke's district. Her district would have to, her water system would have to come up with half, and then we would match the half. But for those that are 20% of funding, which is, you know, a lot of our very rural districts, very small towns who don't have the money that they need to actually move forward in projects. They would not be required to do matching funding. And they would also not have to be shovel ready, like the, the 80% would have to be. And all projects must be going forward in the first year. No system is actually eligible again. So I'll use Representative Burks again. If her community gets it, they can't reapply for it. Again, if there's less than 50 million. After we've paid the 4 priorities that already come out of there. Then, uh Then it would obviously be less than 50 million in grants available. Um, Rules would be established by the ARNC and approved by ALC. And the reason that we chose ARNC is because they already do these through federal grants. There's already these federal grants out there, and they're already used to administering these type of grants. And so that's why we thought that would be the easiest and best way to use it. Again, there's no General fund money used in this. None at all. There's no use of funds obligated from other sources, such as in the RSA and programs will sunset in 10 years. Again, I know it's a band-aid, but again, from 2021 to 2024, I want to remind you, we went from $5 billion to $9 billion. And things are not getting cheaper and people are really, uh, needing our help in this

So currently under statute, the only way a person can terminate an oral farm lease is by sending notice to the lessee by certified mail. This adds any other method of delivery, uh, pursuant to Rule 4 of the Arkansas Rules of Civil Procedure, which are all the same ways that you would serve a lawsuit. So, Primarily by a License process server, also still includes certified mail, warning order published in a newspaper, but ways that are intended and calculated to provide actual notice as opposed to just certified mail because we all know how reliable the US Postal Service and the mail is these days. It has to do with our crisis stabilization units, and I'd like to thank uh Representative Johnson and so many others that have helped us to work on this, Representative Kavanaugh and invite for a solution. Uh, basically what this does is it amends 3 sections of code and it adds crisis stabilization units. It includes them in uh the ProtE Act of 1995, the, uh, any willing Provider law and another sub statute of that. To make sure that insurance companies have to utilize and pay for these services. So we established crisis stabilization units around the state. This just requires that they follow suit with Medicaid and pay for these services. It also doesn't take any authority away from the insurance commissioner, they can, uh, promulgate or regulate the rules of this, and it says that they can't put a prior authorization on this service to try to slow the process down. Right now it's pending in 12 state legislator legislatures other than our own. Uh, this is a pretty long bill. Most of it is technical corrections. The highlights of the changes are number one, this creates a new Article 12 under the UCC, which provides the guidelines by which a bank, if a bank chooses to take collateral, uh, take, Controllable electronic records, which I think is nerd speak for Bitcoin. If it chooses to take that as an asset for a loan, it provides how they can perfect their security interest in that asset. It also updates, uh, uh, new rules for mixed transactions involving the sales of both goods and services, updates rules regarding negotiable instruments and electronic checks, and it provides that, uh, it also provides updates for the rules regarding there's no known opposition. try and summarize this as best I can. So, um, I like a lot of y'all know, I live near a couple of border states and in In the course of the last several years, became aware of the fact that some of them offer exemptions for continuing education in the real estate field. And so I started having discussions with just people here in, in my district and around and discovered that there's lots of exemptions in other professions at some point in time for continuing education. So I started drafting a bill, I showed it to the commission, I showed it to the real estate Association and they suggested some really good changes and I made all of the changes that they suggested and just in summary, I'm not gonna go through the weeds unless you would like me to go through the weeds. It gives a a path to exemption in the real estate from real estate educate continuing education. Um, you have to make an application, the commission, um, is going to be approving it. There are different paths for the, um, for the, uh, licensees or the salespeople and for the associate brokers and there's a little bit of a higher standard for your executive brokers and for your principal brokers because they supervise people. So if their people have some infractions or if they don't do their continuing ed, the executive broker in the Principal broker, they could get their license their continuing ed waiver revoked. You also have to have 25 years of continuing experience with achievements. So you can't just get the license and then do nothing with it for 25 years and then apply for it. You have to have had achievement, some type of experience, again, that gives the commission the ability to review that. And I just really want to emphasize that if there is an infraction, if you don't do your continuing ed, if you, you know, um, get in trouble for something or one of your licensees gets in trouble for then the commission can revoke that continued education. But I think it is a really good opportunity to reward our folks who have done well in our industry, that are qualified in that industry and have done all the things right for a long period of time to be able to just seek, get that kind of reward that they get in other, um, professions as well to be able to step back from that continuing education is some of y'all know, sometimes those continuing ads after you've done it, 25, 30 years, sometimes you could teach the class yourself. And also, it doesn't mean they can. can't take the continuing ed pieces on their own if they would like to. And again, because you are well qualified and you have to have some achievements along these lines, you will have demonstrated to the commission over the years that if there's something that happens in your field during that time, you've demonstrated in the past that you are going to address that. So we have a, we have a new arkansan in me. House Bill 1802, many of you may have heard of the program already alive and working in 3 Arkansas communities. It is a talent recruitment grant program, educated people with great jobs are realizing that they can work remotely and don't have to live in large metropolitan cities. Or even in unpleasant climates. Arkansas is an amazing alternative if they need a job, we have jobs that need to be filled, and we are known as the natural state, a place that offers so much more. This program is already working without funding in 3 Arkansas cities, Fort Smith, West Memphis, and Texarkana. We want people to know that Arkansas is a great option, and that's why we need this legislation. This bill would simply set up a mechanism to allow this program to grow. There is no state funding involved or committed. It works in tandem with the state program in the future, then this bill's already there to take advantage of any state funding in the future. In the meantime, this program seeks funding from outside sources such as charitable individuals, are foundations who want to support economic growth in our state. We have parts of the state with declining populations and a need for new people to come spark revival and economic growth. This bill will be a great tool to aid many communities and regions in our state. The program would be administered by the 8 Regional Development districts throughout the state, and on a personal note, in Texarkana, we've had this program. We now have 9 new households in our town with $800,000 of new economic benefit to our region just from those 9. households. So addressing neglected and abandoned properties is an issue that's impacting every city in the town or town in Arkansas. neglected and abandoned properties have a huge impact in our communities. They endanger the health and wellness of residents, stifle economic development and impede growth opportunities. this existing law will allow cities and towns to place liens on property to recover costs spent by the city or the town when cleaning up these properties. HB 1695 will enhance and clarify what the process of, what the process is for making a handful of impactful changes to help cities and towns, but it doesn't fundamentally alter the existing process. In addition to this bill, the municipal league is conducting trainings on the lien process around the state to help cities and towns address neglected and abandoned properties. In fact, they'll be in Crossit tomorrow to do such training. This bill does not reinvent the wheel. But there are substantive, substantive changes to clarify the current legal process and options available for cities and towns. These changes do not change the fundamentals of the current legal process. County clerks have been consulted as well. The land commit as well as the land commissioner's office, and we have worked through all of their issues and made the necessary changes and as far as I know, there are no known opposition that have been made to me. This bill clarifies confusion in the existing law between cleaning up properties and removing dilapidated buildings. It gives cities and towns more time to file liens with the clerk. They still must be done within a year. Allow cities and towns to collect costs of clean up from property owners directly. Ensure cities, let the county clerk know once a lien has been satisfied, there is no, no such requirement. The, there was no such requirement like this before. And ultimate, the ultimate goal is to get clear title, so these properties can be productive again and encourage cities and towns to communicate with the land commissioner's office to identify these property owners with liens in cities and towns. So the thought is that this will bolster the city and the town's ability to address abandoned and neglected properties. Again, this bill does nothing. Nothing about this bill does anything to diminish property owners' due process and rights. It is designed to deal with unhealthy and dangerous structures only. And with that No questions.

I think in this case it was a, uh, lean for landscaping, city, uh, did the ordinance, put a lien against the property, guy was from out of state, didn't get it. It got too far in the process. The city went to foreclose. They got a judgment, set it for auction. Guy finally found out about it and said, hey, here's the check, I'm ready to pay it off and the city wouldn't take his money. And they were able to use the, the loopholes in the code to essentially say, well, we're gonna play. hardball and we're gonna take your property because we don't like you. And so this bill I think fixes that problem because it makes that process more akin to a judicial foreclosure, which is uh regulated by the court every step of the way, it gives the property owner notice, it gives the property owner time to pay that judgment off and they have to take their money. So we've learned that there are some municipalities that have municipal ID cards, and they do not require that, uh, that criteria. So they will issue a municipal ID card to somebody without requiring what we require at the state level, proof of lawful presence. So there, the recipient is getting an official government ID card from the city, but they haven't met that standard. That's all this bill does. Thank you, Mr. Speaker, colleagues, so what this bill does is currently, when we file our election reports or anybody in the state does, they go to the Secretary of State's website and you do it on the portal, right? Everybody's familiar with the portal right now. All this bill's doing is making every elected official in the state, go and do the same thing we're doing with the portal. This was talked to me from our county clerks, and right now we're having a funding and staffing problem with our county clerks. Uh, right now, when you look at city councils, when you look at Quorum courts, when you look at sheriffs, anybody running for local office right now, they have to file these election reports, send them to the county clerk, and they have to file these things away and, and they're just really understaffed and if we can have a central location for anybody in the public to be able to go online and look up a candidate, see their election reports from one click, uh, that's all we're trying to do here. I talked with the Secretary of State's office on this. Uh, it's a $50,000 upgrade, which they've got that in their budget already, so there's. Thank you, Mr. Speaker. It came to my attention, uh, last year that some states have been, uh, having problem with non-citizens registering to vote. I contacted our Secretary of State's office to find out if that was a problem in Arkansas. What I found out led to the writing this bill. HB 1422, which I named the only Citizens Vote Act. Um He's trying to address this problem. Under current Arkansas law, there's only 2 documents required to register to vote. A valid driver's license. And a Social Security card. According to the Department of Finance, um, or DFA. Arkansas currently has 71,648 legal aliens with driver's licenses or state-issued ID cards. Now these cards look just like everybody else's, uh, driver's license with one exception in kind of squint print. Uh, it says limited term, which, you know, I had no idea what that meant until I started looking into this bill. But, uh, the limited term means the the driver's license is set to expire when they're, um, Immigration documents expire, their, their visa. Uh, unfortunately, uh, along with myself, I think a lot of the people that work at the polling places were not aware of what limited term means either. But if you think about it, 71,648 people or more people than we'd have in two house districts if they were all concentrated in one area. So it's, it's got quite a significant number. We don't know how many of them may or may not have been registered to vote. And the reason why is because currently under law, The um Department of Finance can't share this information with Secretary of State's office. So Secretary of State's office is quite excited to get this straightened out because they said it would help them to go through and clean up the voter rolls if any of these people had intentionally or inadvertently. Um, registered to vote. In addition, the bill also authorizes the Secretary of State's office to use other databases, um, to help them clean up the voter rolls as they may come online. They, in the past have tried to use, uh, one from, I think it's called Safe from uh the federal government, but it's not been very user-friendly. In addition to, um, Uh, setting up this sharing of the data between DFA and, and Secretary of State. Uh, this bill also requires that the driver's license be turned. Vertically in the portrait type styles such as, uh, people have when they're under 21. Uh, the reason for this. When I, I tried to just go in and make the, um, limited term a little bit larger print, maybe change the color. And unfortunately, the federal government has a specific size that it has to be and it has to be in black. And it just really doesn't stand out very well, so that's why we came up with the idea of going with the, the vertical format which so it would stand out a little bit better when a person went in and maybe tried to vote, um, The, um, the a lot of the folks that are. They work in our polling places for older people and, um, they will be trained to look for this new vertical. card and if that's the one, then they would have looked for the term limited limited term. You know what started off to be my bill. Became my first agency bill. The Secretary of State's office. I was excited about to help me to, uh, to do this bill. They even sent somebody to, um, Uh, to the community to help speak for the bill. I think we would all agree that only citizens should vote. I appreciate

House Bill 1422. has been introduced, but it's a non-issue. As I was knocking doors, running for office. One of the things that I did, and I'm sure all of you did the same. It was, you would come across people who were not registered to vote. And so I would ask them, Um, estas. Are you registered to vote? And they would say, no, no. And then, and then I would ask, I would proceed, it is Ciudoana or ciuddao, are you a citizen? Are you not a citizen? And they would say, no, I'm not a citizen. The thing is, is that If you're not a citizen, And you're in the process of becoming a citizen. The absolutely worst thing you could do is register to vote and then go vote. Why? Because on the registration form. It says The information I have provided is true to the best of my knowledge. I do not claim the right to vote in another county or state, if I have provided false information, I may be subject to a fine of up to $10,000 and or imprisonment of up to 10 years under state and federal laws. Immigrants do not want to break the law. Especially in this manner, because if they're in line for citizenship. This will totally erase that. They will never be able to become citizens. Therefore, they're not gonna go and vote and there are no documented cases at this time. I have knocked, knocked a lot of doors. Last Friday, I had the privilege of being at a naturalization ceremony at the University of Arkansas, 15 brand new citizens and all 15 were so excited to register to vote. The vertical IDs as representative Clowney mentioned having those vertical. When we use those for minors. Those are going to cause confusion. The other thing that that will cause is Recognizing, well, why is this vertical and not Horizontal Um, there are many other forms of ID to register to vote other than a driver's license, um, student IDs, military IDs, uh, state or federal employment IDs, um, Concealed handgun weapon IDs, passports, so there are a lot of other, um, other, other information that you can use when you go and vote. The Secretary of State gave Arkansas an A, Arkansas received an A in in-person voting, and our voter rolls have been purged. Making non-citizen voting and non-issue, and it's never been seen in Arkansas. So we would be singling out immigrants, non-citizens include a variety of people that would have to go and redo their license, uh, for example, who are, who would be impacted? All immigrants Such as those who have visas, green card holders, DACA students, um, TPS compact migrants like Marshallese community in Springdale, Arkansas, where I am from, um, refugees, international students, faculty, farm workers, high tech, uh, foreign workers, etc. The list goes on and on and on. For those who are, um, non-citizens, that they would have to go and get a, a different. of, of license. Yes, there is a monetary impact, $152,000. So, this is a bad bill. This bill. Places immigrants. In a situation where they're impacted, it continues to increase fear. They're being singled out, they're gonna it's gonna increase nervousness, um, so this is and and they have actually been very helpful in reducing crime and reporting crime, such as human trafficking, countering positive progress, which we have recently made. And so by having that ID as a vertical ID versus a horizontal ID for your driver's license, that, that is something that is It, it's gonna cause a major issue in our communities, and I, I would ask that you vote no for House Bill 1422. Colleagues, I'll be as quick as I can because I know it's been a long day, but I do feel like we should all just take a beat and slow down and understand exactly what it is we are about to vote on here before we take that vote. This will be changing 71,000 driver's licenses. The driver's licenses of people who are in Arkansas legally. 71,000, that is $152,000 estimate for the impact, um, as we mentioned, and, and I just, it's gonna be a big spend, however you cut it. There's one other just logistical issue in addition to what ourpresentative Gonzalez worth than just brought up. I wanted just to note that under this bill, page 6 of this bill, um, eliminates access to real ID for non-citizens, so that's, as y'all know, necessary to, um, fly now. Out of many places, um. In I, I can't remember the year, but recently, Steve Womack, Representative Womack from Northwest Arkansas, Congressman Womack sponsored legislation to ensure that the Marshallese community, a huge population in Northwest Arkansas has access to real ID. That bill passed. Uh, at the federal level with broad Republican support. I want you to know that this bill undoes that access. They will no longer be able to get access because on page 6, it says this identification is not valid for any federal ID. That's a big deal. It does work that was done at the federal level, and I just wanted to point it out as one of the many reasons why this is

He was a young kid, he wore a size 13, valedictorian of Lone Oak High School in 1937, went to the University of Arkansas on scholarship, basketball, football, He then received his BA in journalism, was part of the Army ROTC program, graduated 2nd lieutenant. 1941, he was drafted by the Detroit Lions, interrupted by World War II, 1942, he was assigned with Company L, 3rd Infantry Division, landed in North Africa in the 3rd Army with General George S. Patton. Now listen to these next 4 acts that he did over the next 5 months. 19th September 1943, Brit and was a part of the amphibious landings in Salerno, which was Operations Avalanche. He led the assault. He destroyed an enemy machine gun position. He, he led the, uh, 30th Infantry to capture a Cerno and received the Silver Star. There's the first one. Here comes number 2, the next month, 29th of October, he led his men in the river crossing the Paterno River for his actions there, he received the Bronze Star medal with Valor insignia. Act 3 on the morning of 10th November 1943, he overcame the enemy hand grenades, machine guns, rifles, Lieutenant Britt inspired and led a handful of men and repelling to counterattack by about 100 Germans against his company because of his, uh, Courage He came into fire. His canteen filled glasses were shattered. A bullet pierced his side, his chest, his face. And his hands were covered with grenade wounds for his actions above and beyond the call of duty. He was awarded the Medal of Honor. The British Military Cross, the Italian Military Medal for valor in a battlefield promotion to captain for gallantry. Going above and beyond, despite his wounds, he refused medical treatment. Until ordered to do so by his battalion commander, following the battle, he had personally terminated 5 and wounded an unknown number of soldiers wiped out an enemy machine gun fired 5 mags of carbine and undetermined amount of N1 rifle ammunition. He resulted in the capture of 4 Germans, 2 of them wounded, enabled, and enabled several captured Americans to escape because of his courage. He repulsed a German attack. And if that would have been successful, his company would have been destroyed. Fourth act, 22 of January 1944. He directed mortar and artillery fire from close proximity over the next day, contributed to destruction of 25 German machine gun positions. He was subsequently awarded the Distinguished Service Cross for extraordinary heroism. He was just boy became abrupt and ended in February 1944 when a German tank fired a shell upon his command post, uh, blowing off his right arm at the elbow, fracturing the leg, and perforating his back in 47 places while recuperating his wounds, he participated in. In the war bond tour and For military history's sake, he became the first recipient of the top 4 combat decorations for valor in the US Army Medal of Honor, Distinguished Service Cross, Silver Star, Bronze Star with valor. He also received 4 Purple Hearts, Army commendation, American Defense Service Medal, American Campaign Medal, European African-American, Middle Eastern. Campaign medal with 4 bronze campaign stars. World War II victory medal, the UK's Military Cross, Italy's Medal of Military Honor, and the Army Presidential Unit citation. September 448, he was the dedicating honoree at War Memorial Stadium here in Little Rock. He stated the memory of her native sons and daughters who have given so much that we might have our freedom. Following the dedication ceremony, the first game ensued. It was the University of Arkansas Razorbacks against Abilene Christian and the Razor bikes was victorious, 40 to 6. In 1966, he was elected the 11th lieutenant Governor, the first Republican lieutenant governor to be elected since Reconstruction. He was appointed later, he served again in 1968 and 1970. He was appointed by Richard Nixon as administration director, district director of Small Business Administration, and he served in that capacity from 71 to 85. He served on several children's hospital, Easter Seals Federal Executive Association. He was inducted the Arkansas Sports Hall of Fame in 1972, and received the NCAA Sports Achievement Award. Uh, I was fortunate to hear the gentleman speak to my graduating class. In a ceremony at Brian in 1987, and I know several of you other people have, uh, have met and worked, uh, with him, but from Carlisle to Lone Oak or Razorback in Fayetteville, a line in Detroit, European, hero, US Army captain, World War II decorated hero, community service activists, and lieutenant Governor. We are, this bill will call for a, an amendment to the bust and monuments that are placed inside. This was brought to me by Congressman Hill's office. I worked with Secretary of State, all funds are donated. There will be zero tax dollars to, to pay for this. bill is, uh, in my opinion, a good transparency bill. So this last election cycle, this mic right, um, this last election cycle, I discovered that if you were running for a local race, city council, mayor, uh, county judge. You only have to file a campaign finance report, uh, right before the election, and then you have to file a report after the election, but basically, nobody knows what you're raising or spending the entire time you're running. Uh, originally my bill was to put everybody on the same schedule we're at, and I discovered that, uh, there's, that there's a lot of opposition to that, which is fine. So I changed this bill to um kind of strike a balance. So basically what this bill does is if you, and the way it is currently is, is this way too. If you don't raise or spend $500 you don't have a report. If you do raise or spend $500 you still have to file the pre-election report and the post-election report. This adds a requirement that if you raise or spend $5000 you then have to go on the same reporting schedule that we are on doing monthly reporting on election years, the years that your, uh, names on the ballot. On years that you're not on the ballot, you just have an annual report. So I think that system increases transparency for, uh, Arkansans, but also doesn't require those who are not really raising and spending a bunch of money to have a bunch of reporting requirements. And finally, I'll say, um, I did run by municipal League and the Association of Counties, and they were uh good with the bill. And Representative Underwood has explained the bill.
