This is a group in my district there in Northwest Arkansas that's been providing, well, really providing hope to so many in Northwest Arkansas with disabilities. This group has been around for 50 years now. I'd like to introduce to you Jacob Sheetsley. He's in our Northeast Gallery. Would you help me welcome him to the House chamber today? Jacob and his fine team there in Northwest Arkansas have been working with special needs folks for a long time, providing them an opportunity for work. Not only do they provide the jobs themselves, but they also provide training, which is a huge benefit to employers that are in the area so that these individuals can actually have an opportunity to get real jobs in the workforce to provide for themselves and to make a life for themselves. Some 23 years ago, my wife and I were seeking a place to put down our roots, kind of chase that American dream by starting our own family business, raise our family, and become productive citizen servants to our local community. We could have settled anywhere in the state, and we looked at a lot of different

because of the people, the makeup of the community, the incredible public school system, and the many amenities that it offered a young family just trying to get started. Since that time, we have seen a manifestation of the many reasons to make Cabot a family destination. And I'm honored to stand here today and represent my hometown. We are joined today in the North Gallery by several members of our local governance and community leaders. And it's because of each of them and the teams that they represent back home that made Cabot the clear choice for being recognized by Arkansas business as a 2024 trendsetter city. Now this status recognizes cities and towns throughout the state of Arkansas whose innovative initiatives for community development and economic growth inspire change and make a difference in the state of Arkansas by improving local quality of life and encouraging sustainable economic development. Just a couple of specific points that I would like to point out. Back in the 93rd General Assembly, through many of you as supporters, I sponsored a bill, and we passed that bill unanimously here in the House, which became Act 67, to allow cities the ability to partner with an Internet service provider to develop a comprehensive fiber network. Cabot took the lead on this, and with a $20 million bond project, became the leader in multi-gig fiber optic network internet cities. This spawned a huge economic development. It improved health care and provided additional educational access for our students and our faculty and our school system. Additionally, with the opening of the Game Time at the Grounds, many of you here who have visited, Game Time at the Grounds as a 128,000 square foot indoor sports facility, and Cabot generates significant revenue for our local businesses. It initiates new economic development and attracts thousands of visitors on a monthly basis. so house house resolution 1089 is to recognize the Benton high school Panthers basketball team for their first ever state championship basketball team in 5a it's our first one in school history at the championship game at the Ozark Arena and Hot Springs, Arkansas, on March the 14th, we were playing our rival Maumelle. We were behind by five points with 13 seconds left in the game. Some things worked in our favor. The boys never gave up. They fought hard. The coaches never gave up. The fans never gave up. And with four seconds left on the clock, senior Terryon Burgess made a layup and put us up for a score of 58 to 57, and we were able to hold on to that lead and win the state championship. Our record this year was 31-3. We only had one in-state loss, and that was to Representative Allen's Little Rock Central Tigers. We lost two games to out-of-state teams in the King Cotton Classic. We had some injuries during those games, but we did lose those games. So our team, our conference record over the past two years is 32-0. We hadn't lost a game in two years. Our average, we beat every team by an average of 35 points this year. We had three All-State players, four All-Conference players. We set the school record last year for 29 wins, and we set it again this year for 31 wins. Terry Onbergis was named All-State, and he was named the most valuable player of the tournament. And Arkansas Democrats' final basketball ranking has the Benton Panthers number one overall in the state. They had Bryant number two, which is a big deal, but we were number one overall in the state, and we're proud of that. coach Dexter Hendricks has had this basketball program for years and he has worked really really hard building this program and Benton has been known as a football school not a basketball school and this coach and his staff has just worked really really hard to get this program to where it is and we're very proud of him and by the way this PBS game the Benton game was the highest rated game of the year with over 20,000 people watching and guess who called that game. It puts it into state law just in case something happens to that federal rule, like it's declared to be unconstitutional or something of that nature. In a nutshell, the bill provides that if you sign up for a service, you have to be able to cancel for that service in the same method in which you signed up. So, for example, if you sign up for a gym membership at the front desk of the gym by filling out a form, they have to let you fill out a form at the front desk of the gym to cancel. Not any of this, send a certified mail to some P.O. box in some other country to cancel. If you sign up for a service online, they have to be able to let you cancel that service online. In order to do that, we've got to make some options and choices for women. Currently in Arkansas, 50 of our counties have absolutely no place to deliver a baby. In states across the nation, they have allowed birthing centers actually to open up in small hospitals and to deliver children there. And we're probably the only state in the nation that has absolutely zero birthing centers. We did have one in northwest Arkansas, but it closed down because they couldn't get the funding that they needed to keep that birthing center open and now women in northwest arkansas are driving to missouri because they want to deliver in a birthing center actually 40 years ago i would have loved to deliver in a birthing center because when i get done with nursing school i wanted a certified nurse midwife but the only way i could have that is at home so i had a home delivery with my certified nurse midwife but i would love to have had a birthing center because it's in between a hospital and a home it gives a safe place for mom to deliver a child with a licensed certified nurse midwife and a licensed birthing center with lots of safety options that are not available at home. So this will open us up like every other state in the nation to have licensed birthing centers that actually get funding. So this makes insurance companies to pay for the delivery of a child whether it's in a licensing birthing center or in a hospital. And with that I would have to take any questions. Colleagues, House Bill 1341 is a bill that deals with workers' compensation payments as they relate to members of the lot fee retirement system. If a member is receiving a workers compensation payment for some injury or disability, they may direct or give those checks directly to their employer to be used to pay that member. This does a couple of things with respect to the system. Number one, it allows the member to get credit for time and pay while disabled. Number two, it does not change the pay for that member, but allows the credit to be contained within the system and no time missed for calculating number of years to retire or the final average compensation to be negatively impacted if that time is part of the best pay years that they have. This is not a required action by members, but it is an option members can use to give them the maximum benefits if injured or disabled. Both of these systems define certain other employers that are allowed participation in the system in the definition portion of their code. House Bill 1344 amends both their definitions so that the reference to the Arkansas School for the Blind and the Arkansas School for the Deaf are changed to be Arkansas School for the Deaf and Blind. This will put the language consistent with the wording of House Bill 1810, but only if it becomes an act. This ensures there are no legal wording issues involved in the continued participation of these employees in whichever system they're participating in. So there's no fiscal impact with this. What this bill will do, it will allow Pollution Control and Ecology Commission to set deductibles that tank owners must pay in order to receive payments for the corrective action from the Petroleum Storage Tank Trust Fund. The deductible cannot exceed $3,000 per occurrence, and the bill is in collaboration with the Arkansas Oil Marketers Association. Currently, the deductible is set at $7,500 if reported within 24 hours. What's happening is people are not reporting within 24 hours for whatever reason, and they just end up leaking and leaking, creating an ecological disaster, and then it's on the person who owns the gas station for the entire cost of the cleanup, and what's happening is they'll just leave, and then it's on the state to do the whole thing anyways. In my district, I had a man who raped his child, his stepchild, viciously for four years. And the man only got 15 years. He was in the Army, and he's an Army sniper. that young girl reached out and was like, they're worried about her life whenever he gets out. Within less than a month, I had a stepdad literally with his fist beat a child to death. After he beat the child to death, he didn't know what to do, so he took the child and he put it at the doorstep of a doctor's office. He didn't even take it to the nearest hospital. Then, less than two weeks later, a mother left to go to work, and again, another child was beat to death because he had a stomach virus and threw up in the floor. That child endured 30 minutes of beating before he died. Sorry. From someone who's been abused, it's hard for me not to put myself in their shoes and wonder what was going through their minds at that moment in time. our laws were not very strict on this the most heinous could be between 10 and 40 years for what that child endured or that daughter endured that's not much time because there's no just getting over those things that mom when she comes home every day she can't just get over that baby not being there anymore. So what we did was we made it towards a lot stiffer. I was asking committee, was I okay with taking away the right of a jury or the judge to set the minimums? After that dad raped that daughter and only got 15 years, I think I'm pretty good with that. I think there should be a strict minimum. If you're going to do the most heinous crimes in our state, that should be a strong penalty. I can't do anything to bring those kids back. And I can't do anything to give that young lady back what the stepdad stole. But what I can do, I can try to make somebody stop and think before they do it to the next child. And with that,

I do have some questions about it, so I'm just going to kind of ask the questions out loud, and hopefully the sponsor can address these. So it looks like it requires that following a complaint of cruelty to dogs or cats that that would trigger this, but I don't see anything in here that says that the complaint has to be substantiated or that the complaint has to even be legitimate. I mean, sometimes people file complaints against people for very personal, petty reasons. You know, I wonder, you know, what criteria are law enforcement going to use to determine that there's a substantial likelihood? That's the standard that is here in the bill. know, what constitutes temporary? If they can hold your animal temporarily, I don't know, is that one day? Is that 72 hours? Is it a month? I guess what legal recourse do pet owners have if their animal is wrongfully taken? These are things that I just don't know. I don't think they were discussed at length in the committee, and so I just want want to mention those. thank you mr. speaker represent richmond i think to answer your question i should correctly so the call would be made by like an officer when they're responding to a situation and they come across an animal that is essentially is near death and going to die if they don't get it immediate care right now we don't have time to go to the judge and try to get a warrant maybe it's late at night or things of that nature As Representative Duffield, I think the kind of loophole in the law right now is, is that under the animal cruelty chapter, if you, it assumes that the owner is being arrested, and at that point, law enforcement can then seize the animal and take it into the pound. This bill is to take care of those situations where, let's say, the law enforcement officer is called out to do a welfare check on someone, 85-year-old woman that's got dementia or something of that nature, and, hey, she's got a cat here that's about to die. we can go ahead and get that cat and get it saved tonight but we're not having to put her in jail because you know obviously we need to work with her. Representative Ray you mentioned on the temporary the existing animal cruelty law it has a very strict provision in there about there's I think it's either 14 or 15 day I can't remember but there's a very short time frame that if an animal is seized no owner has to be notified it's actually a district court procedures they get to court far faster and get the animal back to them if it was something wrong for that nature but this wouldn't be a case of somebody just makes a complaint it's if an officer encounters this and again it's to catch the loophole where under current law if the animal is running loose the officer can get them if someone is arrested the officer can get the animal but if they're not arresting the person they can't actually save their cat again on a weekend night 11 o'clock so appreciate a good vote representative brown

Basically, this is going to clarify some of the admission requirements for the College of Medicine. Additionally, we've included reference to the fact that if there's not enough qualified and who have accepted admissions, what happens to those remaining slots? First off, one of the things we did in 2023 with Act 423 was we were trying to make it so GED, people who got their GED did not count as a dropout, but there were still a couple issues in the law where it's still being calculated and hurting schools if a student received their GED. We're fixing that so it doesn't count as a dropout towards graduation rates. Another thing we're doing with this is we're updating the code to actually reflect what actually happens in practice with the director, I worked with the director of adult ed to figure out how GEDs are actually applied for and stuff like that. And then secondly, we're also doing some high school dropout prevention by allowing a student to actually apply to take the GED while they're still enrolled in public schools. They talked about running a bill to define that. Instead of running that bill, what they decided to do instead was create a working group to have a better studied approach as to how much that spend should look like. And I think that's the responsible way to approach this. So this bill creates a working group of a variety of different kind of primary care providers that will look into how much money is appropriate to be spent within an insurance carrier on primary care. thank you mr. speaker members as you can see this is a Senate bill that comes to us it's going to establish a grant program for robotics competitions throughout our public and private schools it'll be housed in the Department of Education they'll decide where the grants come from and how they're equally distributed be fair and equitable across the state I want to say something too if you've never seen these 6 through 12 graders in a robotics competition it's pretty amazing these robots are when I first thought about going to see when I thought they were the ones that had the flame shooting out and the axes thrown and all that so I was a little disappointed that wasn't the case but nonetheless these things were amazing they're about the size of a washing machine maybe not that tall but they they drive the robots they do fully automated tasks and it's it's amazing and even more amazing than that is that these kids these young men and women build it from scratch on their own and I've been particularly to the facility that Harding uses and they've got lathes and plasma tables and every kind of machine that you can imagine in there and they create every single part that's on that machine on that robot they make the gears they make the frame they do it all so these kids are quite impressive and also impressive for these kids is that they created and drafted this bill and when we gave it to BLR they said that there were hardly any if any changes that needed to be made to the bill so these kids have worked real hard to come up with a program that had plenty of guardrails and would also make it fair and equitable so that we can use the grant program to fund robotics all over the state I think in the committee testimony we had students from Harding Academy we had Searcy high school I think represented painters the bombers bomb squad thank you bomb squad was there testifying so if you haven't been to one you need to check it out it's pretty cool we have to take any questions seeing none I

Thank you, Mr. Speaker. This is a very simple bill. What it does is currently in code, we have our small brewery license allows for two tap rooms for every single license holder. As an outgrowth of the success of the small brewery license and small brewery independent brewers of Arkansas, we've had a bunch of, specifically the region that I represent, the broader region around me, ask for an additional tap room, the ability to have additional tap room as a part of their license. I want to be very clear, this does not mean the opening of another bar or in essence another bar. What you can often see with a tap room is for a restaurant that does not have a license to serve either beer, wine, or mixed drinks, they can go and partner with a local brewery and have that tap room be a part of their restaurant so that you have, in essence, the existing license and that, a local product, in a local restaurant. To that end, I lost my place, I lost my place, here I am. This is, like I said, an outgrowth of success. is a pretty simple bill, it addresses an issue with testing requirements for products. As a lot of y'all know, the industry of medical marijuana is always evolving and when rules aren't clear on when products are supposed to be tested, so some products like infused flowers are compromised with different ingredients that can be tested at different times. This requirement is that you test the final product as a whole. The Department of Health set testing requirements, but this bill still sets basic standards they they have, and they have been recommended by the Arkansas Testing Labs Association. It also clarifies that marijuana products and drug paraphernalia are two different things. There was some confusion that was created in a 2017 bill, but this bill only clarifies it. It does not overrule that earlier bill. It does not authorize any new products. ABC still has full discretion on that. We amended that in the Senate to make that even more clear. ABC has been consulted on this, and they have provided us with the language for this. So in essence, this is a testing bill to make sure that these products are safe and we're being more stringent. So we're making sure that these products are good products and that they follow the law and that people are not trying to sneak in higher THCs by having some of it tested and then adding other parts to that product so that it's a higher THC level. So this is actually a way to better regulate the medical marijuana market. And I see some questions, so

So I'm gonna I'll try to be as brief as I can, but there are some things I think we need to touch on. So the central premise of this pay plan is very simple. It's to pay our state employees commensurate with the private sector. Extensive salary data and research was analyzed for every single position in state government. This plan will reduce the number of job titles from over 2,000 to approximately 850. 2/3 of all state employees are going to receive a raise under this plan. So that's a good thing and they can take some comfort in that knowing that they're being compensated adequately. So that's very important to remember for the approximately one-third who are not receiving a raise. To be clear there are opportunities for advancement based on merit for every single employee so if they didn't get a raise in this they have opportunities through career pathways and through the job series and job families that are built within this bill so everyone can advance based on merit so they do have that. Very important no downgrades no demotions and And no one is receiving a reduction in pay through this bill. So I'd like to give you some examples of the pay scale now and some inequities that I see. One thing that really jumps out at me is skilled trades. So HVAC, electricians, plumbers, et cetera. Right now they're starting out at $32,000 a year and topping out at around 50 to 54. So let me say that again, or let's really think about that. HVAC, electricians, plumbers starting at 32 and topping out in the low 50s. We all know that's nowhere near the market. And to be frank, I can't imagine how we're retaining anyone at this stage. So they're going to get a significant bump. CPAs, engineers, department of corrections are going to get a significant bump. Nurses, nurses are going to get a very significant bump in this. And I want to talk about, you know, what's more important than paying our nurses and getting the very best nurses that we can who are dealing with some of our most fragile people in these state hospitals. So they're getting a good bump. Cost, also there's been some talk about cost. The total cost is approximately $139 million. So the raises are $113 million. The match is $26 million for a total of $139. $65 million of that is general revenue, and the rest comes from federal and special revenue. So I think the most important thing that I want you all to take away from this today is that every department head has been tasked with finding efficiencies. So right now they are working to find efficiencies within their existing budget to pay for these raises. So they are doing that. So if they come and say that we cannot find the money, they have to come to us. So they have to come to ALC, or they have to come to joint budget if we're in session, and ask us for the money. So very important, we still remain, we still have legislative oversight, we still have control, we're going to do our job and make sure that they are being efficient. But they are trying to find those efficiencies. So members, in closing, this pay plan is long overdue. I want to thank Representative Wooten. he said that a couple times very eloquently in personnel that this pay plan is long overdue it's something we've been working on and talking about for years and it needs to happen so what's what's going to happen here is this is going to help us hire good people and more importantly retain good people so right now our turnover is approximately 20% so all of us who are in business all of us know that 20% turnover is not good so we know that that is expensive and inefficient so this is going to be even you could argue a cost savings in that regard but members most importantly this is the right thing to do right these people deserve to be paid a wage that they can be proud of they deserve to be compensated near the fair market and that's what this does so State Employees Association endorses this plan and I'd also like to thank the governor and her team they have worked for two years literally our hundreds and hundreds and hundreds of hours coming up with this plan they've done so much I just want to thank them for this I think this is a really good plan and I'm excited about it I think it's very good for the state of Arkansas I'd appreciate a good vote I'd be glad to take any
