They have that as it stands right now. There's an additional $330 million that is setting in a restricted reserve account. This body put that money in two years ago. This would be, we would need additional monies, obviously, to be able to fully appropriate or fully spend in this appropriation. We're working with the House right now on how we would do that. That will come a little later in the session. One of the things we want to make sure that we do in that process is have an accountable plan with the Department of Corrections so that we're able to, during ALC, make sure that we're tracking, monitoring, and understanding the process and the progress of the prison construction.
Anything that we do to let money out of that fund to go into, you know, be utilized by this appropriation would require a three-fifths vote by the ALC membership. Again, so we will have a funding bill later on when we get into session, hopefully not too long from now, that will be separate and apart from any other funding bills that we have, and that will, those monies will be collected into a three-fifths vote account and as money is needed and requested by the executive branch for the prison construction,
they'll come, make a letter, and we would let that money out if the legislative auditor council

No, that's correct. This is, if you have a capital project,
the state has a capital project, I should say, that we want funded, You are supposed to file an appropriation for a capital project in the amount of the anticipated construction cost. That's what this is. It is only a vehicle to spend, the appropriation threshold.
On the second part of that, you have to fund it. Funding is typically a 51% vote threshold. And so we as a body will dictate how we want to fund this prison. So we may do some set-asides, restricted reserves. The vehicle that we've used in the past, in the 330, is a restricted reserve account. that can only be used for prison construction that requires first a letter from the governor and then approval of three-fifths of the legislative council for money to be let. So what I would anticipate as we move through the construction process,
where the state moves through the construction process, the governor will issue a letter requesting an amount for that stage of construction. We will review what's happened, we'll see what's going to happen in the future to the best of our ability, and we'll choose or not choose with the three-fifths vote to let that money be utilized and be spent by this appropriation. Madam President. I appreciate Senator Dismang going through the process.
And this is just the beginning of the process, So I'm going to talk about a few things in this because I was elected in 2006, back when we did not have the crime crisis that we have and the overcrowding. It was still a problem back then, but it was not to the mega crisis. And I've learned in life, and it's like my grandfather taught me, there's the deal and there's who you deal with. You can make the best deal in the world on a bill that sounds great
and go down a process and then there's who you deal with and how it turns out. And basically what happened was when Governor Beebe got in budget trouble, as any governor would do, tries to look at saving money, he started letting people out of jail, prison, that shouldn't have been let out. It was called the Public Protection Act. You can go through this handout right here in 2011, but the Public Protection Act was not about protecting the public. It was about letting people out of prison that should have never been let out of prison. They should have stayed. But once again, it comes down to money.
Every decision we talk about down here comes down to money. This is what Senator Dismane talked about, was basically the process for the money for this. But in 2011, as you go through the handout, you can see it did not protect the citizens. You can see that violent crime continued to go up significantly in every part of the state. You can see in 2015, Senator Jeremy Hutchison comes in with his big ideas, and you can see through the bill title that it's going to protect the public.
It's going to reduce crime, reduce overcrowding. Once again, what got promised to the citizens? That never happened. We spent millions on a consultant that was going to tell us all these great things, that was going to solve these problems, and wasted millions of dollars. You can go through the handout. Arkansas prison population, among the fastest growing. Inmate growth outstrips prisons. With prisons over capacity, earlier approval released for more than 700 inmates. At that time, some of these legislators were getting on the Board of Corrections and it really wasn't their fault because they were funded, not funded correctly with the money to take care of the problem and the issue by people in this body and governors.
You can see the FBI crime statistics go up. Our violent crime, property crime went up. If you look at, and I always go back to the dollar, if you want to see where politicians prioritize things, see where they spend the money. You can see where education was at. 44% of the budget in 2007 went to education. Public safety was 1.9% of the budget. Corrections was 8% of the budget. Look at county turnback. Every one of these percentages.
Look what happened in the last budget. You want to see where the money and priority? I talked about in 23 about the budget in RSA. There was not enough money for corrections. 8% of the budget. Corrections budget never changed 8%. If we'd have been serious about funding corrections two years ago, ten years ago, five years ago, corrections should have been 10 or 12 percent of the budget. Public safety should have been 2.2 or 2.5 percent of the budget. That's why we're in the crisis, is because of money and who's funding it and the lack of funding.
If you look at the graph, whatever you want to say, whether you want, learns the spending is going to go up. You look at the Medicaid spending is not going to go down. Corrections and all these other ones have stayed flat, which is essentially a cut. Our county turnback, city turnback dollars as a percentage is less than when I first come in. That's actually a cut to our cities and counties because the cost of everything going up. Medicaid was the big winner in it, 24% to 32%. Our state budget's like a balloon. It's pretty simple. You expand in one area, you're going to contract in the others, and that's what happened.
So when this process started in 2017, I proposed that if you went to corrections, it's got sentence four times, you serve 80 percent of your sentence. It was time to get tough on things and provide the funding. At that time, we passed the bill out of the Senate. Governor Hutchison opposed it. We got down at the end of the budget. We do with the funding and everything. I proposed at that time Amazon was remitting the internet tax voluntarily. They estimated it's probably four or five times that now as a revenue stream to take care of this problem, but that was
rejected by many of the members here. Once again, if you're not going to appropriate the money, then what you say out does not matter. So when this process started on the prison part, I can tell you that the $470 million figure for 3,000 beds was a total farce. That's $156,000 per bed. And folks, I know I'm talking a lot and we're doing it, and hey, it's early in the day and we're going to get a lot of the talking out as we go through the process and I won't have to repeat these things. $156,000 per bed, irresponsible, farce, never would happen.
Other states that even started pre-COVID price explosions were much more than that, 285,000. Utah was going to build a prison for 500 and something million. It wound up being almost a billion dollars. Let me tell you something, folks. You can talk about process, three-fifth votes, whatever you want. You get in this process, once you get down the path with these mega prisons, Utah, Alabama, every one of these mega prisons are mega financial disasters. Every single one of them. Just look at Alabama. Look at Utah. You want to see what the real problem is in our state, where it's coming from?
If you'll look at this, when it comes to inmates and incarceration in county jail backlog, eight counties, eight counties contribute two out of three inmates to incarceration in county backlog, according to Border Correction facilities. Benton, Washington, and Sebastian County alone contribute almost one out of every four inmates to incarceration. Look at the figures. What is really happening here is you have counties. We have border correction facilities in Pulaski County and Jefferson County.
The eight counties are Pulaski, Jefferson, Faulkner, and Saline, Sebastian Crawford, Benton, and Washington County. Pulaski and Jefferson already have border correction facilities. And I will say this. I've told the people in Northwest Arkansas, we've got to build them up there. That's where the population growth is, somewhere up there. But what has happened is in my counties, we pass jail taxes and make sacrifices, either that or that in the budget, to fund these jails. And this wouldn't be as bad a crisis had these bodies and many of you been funding corrections to 10%, 12% of the budget and up public safety to 2.5%.
But police officers and that, they don't fund big PAC checks and money to contribute like they do in these other areas like Medicaid. That's just the truth of it. If you look at where the process went with this facility, I said all along $470 million was never going to do it. Board of Corrections came out with a consultant that said $1.2 billion last year. Now we've jumped around like a frog on a hot rock. Every time the rock gets hot, the frog's got to jump. We went from $470 million, what?
Now we're at $825 million, even more, with no details or specifics. This part of Franklin County, it is in Center of Suffolkville's district, not my part. There is no way you're going to get 800 people to work out there. That is so ridiculous. It wouldn't matter if it was Texas Instruments building out there. No company of employing that many people would look at a location like this. I'm a real guy. As I said, there's the deal and there's who you deal with in this. Look at all the promises that we've made, jumped around on millions of dollars, no specifics.
If a school did that for a building, you'd want them investigated. Let's talk about Joe Perfieri. First off, he says to this body, legislative, that the community needs to embrace it. That happened? No, that didn't happen. You know, he doesn't care about that. He says one thing in front of a committee, doesn't matter. You know what he said? He said, well, the road structure's fine. The highway department came back and said, no. When you do a construction project of this thing and you're talking concrete trucks,
cranes, and everything like that, you're going to have to redo a lot of these roads before you even get started in the process. They never even called the electric cooperative and found out what it took to get power in there. This place is on a mountain of rock. There's no water. You're literally conceivably trying to build a 3,800 population city way out in the country where there's no road running structure, no water, no sewer, nothing. Didn't even call the electric cooperative. There's a guy in construction that said, I wouldn't let my wife build a she shed in the back without checking that out.
That's how incompetence level that this really is. If you want to go to really who we're trusting in this, if you want to really keep going in this, Joe Perfieri at the April meeting in 23 up in Batesville, I got the transcript of it finally, said we were going to expand Calico Rock where you already have 100% staffing up at Calico Rock, 525 beds. They were going to have to up it from the 75 million to 115 million. Joe Perfieri shut that down.
That decision alone, folks, cost taxpayers 40 to 50 million more dollars in building in this mega prison, mega financial disaster when you talk per bed. We could have been 525 beds already two years down the road had Joe Perfieri not shut down. I'll share the transcript of the meeting. That's what we're getting into right now. When you start this process, going down there and look at what else happened. This has been riddled with lies, deception, and gross incompetence. And you want to trust people like this that make a decision?
The Calico Rock expansion was a no-brainer. Easy decision. You know, they would sit there and say, well, what are we going to do if we do nothing and not get nothing? That's ridiculous. I've heard that threat all the time down here. We've got other options, and I would love to have the Senate floor debate at some time, my option versus the other option. If we don't start controlling the crime on the front end, we will never get out of this mess. If you have high crime rates for a while, the next steps are you have public defenders overburdened,
your court system overburdened, your jails overburdened. The only way to financially get out of this, instead of this financial death spiral, that one side wants to go down, is to reduce crime before it even happens. Because once you reduce crime before it even happens, you save so much money. because if you have a high crime rate, which we already have a high incarceration rate, embarrassingly, once you arrest somebody, you have to haul them to jail. You take them to jail. Guess what? They have a booking. They have a stay in jail until they either get bonded out
or stay to their court date. They have a public defender in the process. Then they have a court date. And then they get sentenced to incarceration at cost us. And then you turn around and have to rehabilitate them and then turn around and have probation parole, which we're not funding. They are overworked and overburdened and underfunded, and they will be five years from now. This, keeping people that have the serious crimes and, yeah, it's going to help out some, but it will not step into the crime rate.
Little Rock is 7,500 officers short right now. We need to be hiring public safety officers and paying our public safety people and these officers more and get more people in and doing positive situations out here to actually reduce the crime. That is the only option that we have to get out of this. Going down this mega-prison, mega-financial death spiral built upon lies, deception, and gross incompetence is not the first step in the process that we should do. We will never get out of that. The other part of my plan is to help county sheriffs
and equalize the pay in deputies so they're not losing. Every county out there, all 75, county deputies make less in cities. My plan will actually equalize that pay and let them keep from losing deputies. So many times they pay for the training, two or three years later, they're gone to a city or somewhere else. There are a lot of things that we can do, folks, that we need to debate and look at before we step into this mega prison, mega financial disaster death spiral that we're going to go into. Let me add, the three counties I mentioned, Benton, Washington, Sebastian counties
that contribute almost one out of every four inmates, they're not passing jail taxes. Every one of my counties, Senator Stokeville, Franklin County, passed a jail tax. Is this a crisis with state backlogs? Yes. But it's only when they don't pass jail taxes we're going to let these three counties continue to run over us with prisoners. Why would any county in the future pass a jail tax expansion or new jail? Why not just do like Benton County? Keep dumping more people in the state system. This will bankrupt us, just not in this process alone,
which has never been explained. I cannot imagine letting go of almost a billion dollars without any detailed specifics The reality is this prison for the amount, if you look at other states and everything, whatever they want to promise, you know what? They'll be lucky to be 2,000 prisoners up there in six, seven years. You'll be lucky to have 400 or 500 people working up there. You look at 2,000 prisoners with the amount of money, that's 400 and something thousand per bed. There are a lot of options that are better than doing this. And for Joe Perfieri to shut down that Calico Rock expansion
literally cost taxpayers $40 to $50 million more that we could expand it right then rather than go down this path of this mega prison and cost us more money. So I'd ask for a no vote and let's stop this process and look for a more physically responsible way that's actually going to lower crime. Anyone wish to

So this is, we're about that time of session, right, where the difficult things come before us. You know, I was looking at our calendar. I don't know, we got 50, 60 bills on today, maybe a dozen of them. I have a principled position for or against. Most of them, I can take it or leave it, right? Now, I think we're here, most of the members in this room have a principled position for or against a prison and funding one.
Most of us do. And so I'm going to talk to our members right now that say they understand and they're for the prison, but they have some technical reason why they don't think they can vote for it or some personal choice. I wish it was like this or I wish it was like that. Well, there's 50 or 60 bills in our calendar today that I wish were different. but I don't get that option. We work in a representative republic democracy where it doesn't get to be the way that I want it. It doesn't get to be the way Senator Hill wants it
or Senator Dismane wants it. It gets to be the way that the group comes together with a
decision. So when I started thinking about why would I vote for this, I called my local prosecutor in Benton County. I said, hey, I remember a story from just not long ago of a young lady that murdered a police officer. And I remember some horrifying facts about that. Can you refresh me? So her name was Shawna Cash. And if you'll listen to me, there's a Shawna Cash or a dozen Shawna Cashes in every one of your districts.
She was arrested in Grant County and released in May of 21. She was arrested in Washington County and released for no room in May of 21. She was arrested in Benton County and released in May of 21. In April of 21, she murdered Officer Apple. Three times she should have been in county jails. Three times she was released because no room. Now we have a memorial highway in northwest Arkansas named Officer Apple Memorial Highway.
What I'm trying to tell you is there's many shana caches in every one of our districts right now. They should be in prison, but there is no room. And I hope the rest of you don't spend the rest of your lives driving down an office or Apple or an office or whatever, or just maybe it's a friend of yours, maybe a schoolmate, maybe a co-worker, and maybe they don't get the privilege of having a highway named after them. But I'm telling you, the Shawna Cashes are in every one of our districts right now.

I think we've had that problem for years, as demonstrated by Senator Hester. But I had an employee that stole money and we prosecuted her and she was sentenced to prison. And they said there's no room to put her in the prison. And I call up her at Newport and there's plenty of room in the prison. They didn't have a staff. I think I remember a few months ago when our governor took the reins of the state of Arkansas. And she had a pretty good dust up with the Board of Corrections about expanding prison beds, adding prison beds.
And the dust up was because the Board of Corrections was saying, we don't have the staff. They had the building, they had the bed space, but they didn't have the staff. I've been in business all my life. And location, location, location. And I don't have a dog in a fight up there in Stubblefields District. It's not going to bother me if he's got a good place to put it and the people don't want it. But if we're putting it, if we're fixing a vote on an appropriation for three quarters of a billion dollars because we decided we want to build a 3,000 bed prison,
then we need to figure out where in Arkansas we have the logistics to support a 3,000 bed prison. And if Arkansas is a rural state and we want to put the prison out in a rural area, then maybe we should build three 1,000 bed prisons. Senator Irvin and I are very familiar with Calico Rock the people in Calico Rock wanted it and it's been doing great in Calico Rock but we didn't go up there and try to build a 3,000 bed prison
it's 500 or 600 beds and it could probably handle an expansion what I'm saying is this is not a good plan it may be a great location for a smaller prison but there's no population to support an 800 person workforce from what i understand in this in this area uh i think we should be considering where you're going to build it if you got if you're going to build a 3 000 bed prison then that's going to narrow down your
selection sites if you're going to build three 1 000 bed prisons then you can probably stick them out in the middle of nowhere and get away with it. But I can't vote for this appropriation. Senator Davis, you're recognized. Thank you, Madam President. This is the state employee pay plan. We have had multiple meetings on it in personnel and have had opportunities for questions. We've worked with all groups, including the State Employee Association, to ensure that it was meeting expectations. I want to be clear, this is a labor market rate plan. So there's a little over 16,000 state employees that will be getting raises so that they will be paid in line with labor market rates.
There are some employees that will not be getting raises, and that means that they are currently being paid labor market rates. So this bill does a couple of things. First of all, it reduces the current number of classifications. There's around 2,500 right now, different job titles. It reduces it down to 850. And it establishes a new grade structure with six new pay tables instead of four, which is what we previously had. There's no connection from the old tables to the new tables.
So it's entirely different when people try to compare grades where they're at now versus the grade they will be. There is
no connection or line strong. It's entirely new. So it also creates groups and jobs into job series and job paths so that there
can be a way for career advancement to encourage people to have a career at the state and be able to be promoted within their job series. And lastly, it creates a student loan program
to help assist state employees in repaying student loans, and that will be up to the different agencies to come up with the rules
to determine that. And we do have monetary caps within the bill on that. With that, I am happy to

Thank you, Madam Chair. Members, we have tried through the years to give our employees good raises. The one department that gets left out every single time is the Division of Ag. Everyone in this room has an extension office in their county. The only way that extension service or the Division of Ag gets a pay raise is that we manually put it there. When K-12 got their pay raises, a very significant pay raise, everybody got it.
When higher ed got their pay raises, Division of Ag is left out of that, and they are not put in there. And I have asked the governor to come back and give Division of Ag $6.5 million to get their pay raises. And now we're going to come in and give the executive branch an extensive pay raise, which I am in favor of, but not until the governor assures us that she's going to put $6.5 billion in the Division of Ag budget.
So I ask you for a no vote on this bill until we get that assurance that we will get

Thank you, Madam President. You can tell last time I was against Moore, it's about an explanation like Senator Caldwell,
why I'm a no-vote. Basically, if you look at personnel over the years, it should follow a little bit what is going on here in Arkansas. I mean, one thing is the 6,000 people that are not getting a raise at McKenzie, which I do not like.
We don't need, I don't like New York consultants trying to consult us down there. And this is, once again, another issue that I have. Nothing against Senator Davis, because any big project is never going to be perfect. So it is not against Senator Davis. But if you look at the 6,000 employees that are not getting a raise, they say at market rates, well, that may be a market where it's high cost of living. I live in a rural area. So somebody making the same amount of money will be making more than somebody in Pulaski County that could be doing the same job. That's one of the questions that I have that I don't think can raise.
If you're giving this amount of money, then there should be some more equity and fairness in looking at the whole situations. Even though I'm in a rural area where somebody making the same salary It's not the same as somebody making more in Benton County, even though I talked about Benton County last time. The biggest thing that I look at in state government that I've seen over the years is the explosion of jobs, of high-paying jobs. When you talk $100,000 a year job salary-wise, you might as well add $40,000 of it because it used to be 27% for salary and benefits.
Now it's 40%, so you're talking $140,000. So Joe Perfieri that I mentioned earlier that's making $180,000, he's almost making a quarter of a million dollars and just cost us 40, 50 million dollars on a dumb decision that should have been a no-brainer. So that's what, that's a quarter of a million dollars. In four years, you're going to pay him a million dollars. And the one thing about waste and fraud when Elon and all this is catching on is if you waste a million dollars, you really wasted two million dollars. Because when you waste a million dollars, it takes a million dollars of good to get it back to good.
You talk about two million dollars, you're almost half a percent of giving a COLA to every state employee. But if you want to look at these figures where we have not done the job that we should have done is the absolute explosion in these high-dollar house salary jobs, which a lot of them are just political appointee jobs, that it's actually the career people doing the job. And I'm four raises on nurses, and I'm four raises on prison guards and spending money on that. But if you look, in 2015, in core state government, there were 217 people making over $100,000 a year.
In 2025, 854. If you want to look at this figure right here, and you're looking at core state government and spending money, and once again, we are spending money, whatever you want to be. Learns, whatever, spending money, correction, spending money. Our revenues are going down. DFA predicts next year that I think is concerning, and I'm a farmer and pessimist, that revenues are going to get back to normal, which I don't know in this world today. We really don't know what normal is anymore, to be honest with you. If you look at the tariffs in agriculture about us continuing spending, we're not doing a careful enough job in spending.
And as I mentioned, the ProFury thing is costing us $40, $50 million more and paying him a quarter of a million dollars a year. But in 2015, folks, three people made over $200,000. Now, I'm not talking to the people down here that do the job out in the field and everything like that, that deserve raises, the prison guards, the nurses, all those. Representative Mayberry's got a nurse's bill that I'm for, spending more money on. 2015, there were three people making over $200,000. You know what that figure today is in 2025?

President. To answer a few questions, Senator Payton, that allotment will will be annual, so they'll determine how they're going to make the payments, but it's an annual payment, but there'll still be rules promulgated for those programs per agency. It is correct that there are, as we said, about 6,000 employees who will not be receiving raises.
Those employees, it's because they are currently making labor market rates, so they have been paid what the labor market pays in the private sector and across. Those employees are still eligible for performance money. They can still get raises, they can perform well, get increases there, and they could also potentially be on an expert differential. So there's opportunity for these employees to receive raises. But the focus really, and I think the direction from the legislature over the years, was to have a labor market rate plan so that we start employees out at a rate
that they're able to stay here with the state. When we train them, we want to invest in a high quality workforce. We want people that are going to stay with us and provide services for the state to the people well. So we're seeing an over 16 percent increase in pay for correctional officers, over 15 percent increase for pay for social services, our social workers that deal with our kids in foster care, a over 10 percent pay increase for state police, and an over 10 percent increase for nursing. And we all know we've had issues keeping and retaining nurses at
places like human development centers across the state who deal with the most fragile and critical population. I'd also like to speak to Senator Caldwell's comments on the Division of Ag, the county extension officers. That is not in this pay plan. Those employees are in the University of Arkansas Division of Ag budget. If we want to take up funding for those county extension officers, then we need to be making phone calls to the U of A Division of Ag and talk to them about it.
I've got their budget right here. And if you look
through, you can see that their maximum, maximum pay is $199,000. Why aren't they making that? I don't know. Let's call U of A Division of Ag and ask them why they're not paying their county extension officers what they should get paid. So that is not part, that is not an executive branch function. They are not employees of the executive branch that's not part of this pay plan. That is in U of A Division of Ag budget. So I want
to be clear on that. If we have issue and we want to give them six and a half million dollars, then we need to call them and ask them why they're not paying their employees more and what they plan to spend that $6.5 million on. In closing, again, so many groups have been worked with to see this come to fruition. Everyone's
been at the table. There's been a ton of input over a couple of years now. We've been meeting about it extensively, making adjustments, ensuring that nothing is perfect
but everything is as good as it could be and that we're doing right by the state employees who are working hard for citizens across the state of Arkansas and deserve to be paid a rate that is similar to the private sector and matches those labor market rates. a handful of uh health care bills this session um one of my my goal my goals were to uh increase access
lower health care costs and give uh patients options and their health care choices uh sb 117 uh does all three of those in my opinion um naturopathic physicians this is something i've worked on pretty much ever since i got elected to the legislature i have um kind of a background story on why naturopathic physicians uh came into my life
and why they're important to me um there was a point in my life where i had a lot of health care issues i had gut issues as a kid but you know it was just blamed on you you eat too fast uh you know i'd get a stomach ache every time i'd eat but as time went on and i got older i started having more severe problems with joint pain rashes um all kinds of weird issues high blood pressure um and it got to one point where i gave up uh fast food and alcohol one year for Lent. When Lent was over, I went out and had a couple cheeseburgers and some beverages, and I woke
up the next morning with a fully distended abdomen. I was miserable. Went to multiple doctors. Nobody could figure out what was wrong with me. I got referred to a specialist. They couldn't figure out what was wrong, was going to a dermatologist. They were giving me creams for my rashes, special shampoos for my scalp. It was just a miserable time in my life, and I remember this
girl I went to college with. She said she was going to be a doctor, so I called her up, tracked her down, and I said, hey, did you ever go to medical school? She said, no, I went to naturopathic physician school and I was like tell me more and so she told me about what a naturopathic physician was I told her about my my issues and she said Clint you've got food allergies come in we'll do some blood work so I came into her clinic and at the time in Arkansas she can't practice as a
naturopathic doctor a naturopathic physician because we don't license that that profession here so she was working under a chiropractor um and of course she couldn't do the blood work because she wasn't allowed to by law she's she's a doctor in arizona that's where she went to school in arizona she has prescriptive authority she can prescribe drugs she can do surgery in arizona but in arkansas she has to work under a chiropractor um one of the the naturopathic
physicians that helped me with this particular bill this year she works under her acupuncture license so that's that caps out her scope of what she can do under that that acupuncture license so we do the blood work we send it off results come back and she puts me on a four-day rotation diet and over the course of six months within
a month i was already feeling better but within the course of six months, I lost 70 pounds. My
testosterone levels went up. My cholesterol levels went down.
My blood pressure went down. Everything started working better. I was a different man. All my numbers were better. No drugs, just lifestyle change, eliminating certain foods from my diet that cause problems. So, obviously, I was sold on naturopathic doctors. Allopathic medicine didn't have an answer for me. Naturopathic medicine did.
And I'm from the belief that we should have a holistic health care system. And our health care system is geared specifically towards drugs, surgeries, in just allopathic medicine. I see my chiropractor and my physical therapist way more than I do my allopathic primary care physician. But that's my choice. And I believe all Arkansans should have the choice to get their health care where they see fit. I believe that a lot of issues in our society can be handled.
I mean, there's a lot more information out there about food additives, seed oils being bad for people. You know, the old, old, you know. Senator Penzo, I'm going to have to interrupt you.

President. Just trying to think where I left off there. We're at a different place in our society now with what health care looks like. We know that food dyes are bad. We know that seed oils are bad. We know that the old idea of what health care looks like is different now.
I think of one example. I know I have a family member that was labeled as diabetic. I used to be into personal training and physical therapy back in the day. A lot of y'all know that. so i worked with this family member on diet and exercise um and of course it's family members so that's okay right so i did some coaching on them um and they were able to get off all their
diabetes medication well years go by and their health declines again and they ended up getting a glucose monitor that feeds to their phone and a lot of the foods they were told to eat that was good for their diabetic condition were causing blood sugar spikes. And so that helped them kind of regulate. But with that being said, a lot of the old mentality of what is good for us, a lot of that's changing with new discoveries in science. So what this bill
does, it sets up a licensure for naturopathic physicians in Arkansas. One of the committee members didn't want to create a new
board. We initially started with putting them with the medical board. Well, the medical board doesn't really want to play nice. So I wanted to set up their own board. Well, one of the committee members didn't want to create a board which i understand so what we did was take the
acupuncture board and merge it with this and
create the natural medicine board so a lot several pages of this bill are actually you know near the end are just striking a lot of the language from that uh current board that exists and making a natural medicine board so it'll be made up of three naturopathic physicians three acupuncturists and two members of the public. And that's pretty much what a lot of the back end of this is. And

it's a it's a it's a doctorate level education like I said and their their
curriculum is taught by MDs DOs chiropractors and other naturopathic physicians. So it's more of a holistic type of health care. We're not trying to replace allopathic medicine. We're
not saying that, you know, that's what we're trying to do. We're trying
to give an alternative to allopathic medicine. So their training, they don't do residencies like
mds do but they have very adequate training some of their training is more geared towards like they have a lot more nutrition training than they do than doctors do mds
but they you know they don't have all the the training on pharmaceuticals that's where
a lot of the allopathic medical doctors, most of their training is geared towards more surgical intervention, drugs, things like
that. So it's a different type of education, but it's very complimentary. If you, Senator Hester, I'm sorry, Ballinger, his wife went to get her cancer treatment in Arizona, and the MDs and the naturopathic physicians work together, and the naturopathic physicians in Arizona that work with the oncologists, they work on the nutrition and things like that to help recovery. So it's more
of a complementary than a replacement.

They're not getting the individual there and there's very little that they can do to get them there or be able to prosecute them once they're there. So what this will do is allow the prosecutors

When it was passed back then, the intention was to make an option available to the market for financing improvements to mostly commercial buildings. When that was passed, or since that's passed,
it has proven to be administratively burdensome and costly, and so it's not been utilized. What we're doing with this bill is modernizing it. We've worked with the Bankers Association, the Bank Commissioner, the Association of Counties, and collectors with some amendments and things. And there's no known opposition at this time. But in short, CPACE is a financing mechanism that allows you to finance improvements mostly around energy efficiency.
If you want to improve the efficiency of your windows on a large commercial building, you're not going to tear down the Simmons Bank building just because it's 30 years old. You're going to improve it. And so this is a financing mechanism to improve those items. And what it allows you to do is finance those by voluntary collection of the payback of those funds. Not with public money, but the mechanism, it would be collected on your tax bill each year.
Or what we're doing here, it also allows it to go directly to the lender. But, again, it's expanding that, and it's a free market mechanism for financing improvements and energy efficiencies. No public money is involved in this. It's just modernizing a bill that was passed previously, and I'd be glad to answer any questions. Any questions for Senator

development in grades K through 12.
This bill allows for human fetal growth and development standards in public education, and it simply just says that the Department of Ed, in consultation with the Department of Health, shall determine
the appropriate grade levels for students to receive this curriculum. The standards are simply that it will include discussion, and the discussion
shall include a high-definition ultrasound, which shows brain, heart, sex organs, and other vital organs in early fetal development,
and also the process of fertilization, every stage
of human development in the uterus. And so I know for me, as a person who has had, you
know, four babies, or six babies in utero, rather, and birthed four, that I've seen all different variations of ultrasounds from what they were 17 years ago to what they are now with those high-definition 4D ultrasounds. And it is life-changing to see a little heart flutter so early on when you go to your eight-week appointment
to see an actual real baby. And when we talk about what's impactful and showing students things that are true and real, I think it's important to focus on an ultrasound, especially a high-definition ultrasound, where we can see a real baby and a life and a heart beating and organs developing. We know that that's what changes minds when women go to crisis pregnancy centers to decide if they're going to have their baby or have an abortion. We know that ultrasounds change minds and save lives. And I think it's important that as we're educating students in secondary education
and talking about fetal development and babies growing in utero, that we show them real, actual, live pictures of babies in the womb and talk about that development in a real way. so that when they're older and grown women and men, when they go to the doctor to see, to learn about their baby, that what they learned in school is consistent with what they're hearing from their doctor when they decide to start a family. And that's why I think this bill is so important and important to focus on that high-definition ultrasound.

Thank you, Governor. Colleagues, I did not think I'd be running another raw milk bill this session, but this is the best one so far out of all the sessions. So it's got a lot of good stuff in it. On page 1, line 29, it changes from line 28, incidental sales of goat milk, sheep milk, and whole milk
that has not been pasteurized to sale of raw milk and raw milk products. This is mainly about goat cheese or goat milk cheese, but it allows whey, et cetera, without being so specific. And it goes on to tell you on page 2, top of the page, all those products. We also, the natural food stores came to us on page two, line 22, and asked to be included with the farmer's markets, and that seemed to be a natural thing to do.
So we've got them included. That's a cleanup that we didn't get done last time. Down here on line 31, it changes the size of the sign that you have to have if you're selling non-pasteurized milk to 18 inches by 24 inches from two before, which is still a large sign, but much more manageable in a store. And for those who are concerned about the safety,
page three, beginning with line 15, raw milk products produced in this state may be sold at a location that is not the farm where the raw milk product is produced if the raw milk product is clearly labeled with the following statement. And you have some very clear labeling about the dangers and how it should have been handled, et cetera, that were not there before in the interest of safety. So I think that's a very good point that we picked up

The Department of Education said that they'd still like to make sure that that's the case through grade 8, but 9th through 12th graders, we don't necessarily need an adult just sitting in the room to be sitting in the room. It still requires, the law still requires that if it's, the proctor has to have at least another camera watching the student during the taking of the test. But this just simply removes the requirement for grades 9 through 12 that an adult be sitting in the room like a parent during that assessment.

there are three bills that I'll be presenting. One's still in committee. These two are for working with the juvenile judges. What this bill does is it brings into line with the adult criminal code and it removes the dependency neglect cases for expungement.
And only the delinquency cases are expunged on the 21st birthday. The reason why expunge is now just as sealed is because all of these records now are moving from paper to computer. and so they're electronic, and so it becomes virtually impossible to destroy that. So that's why it's reflected, and this brings the juvenile code in to consistency with the adult code. Again, there was no opposition in committee, and this is work with the Administrative Office of the Courts and the juvenile judges and the juvenile division.

Members, SB 498 updates the state law concerning the release of motor vehicle records and driver records to correspond more closely to the federal standards. Currently, there's a conflict between the state and federal law concerning the protection of those motor vehicle records and Arkansas declares them public records. Some believe that it makes it available for FOI purposes. If they wanted to FOI your vehicle make and where you live and so forth, that's not the case in practice, but this is going to clarify that.
While the federal government requires substantial protections, SB 498 is going to resolve that conflict by providing additional protections of your motor vehicle records. Current law also restricts courts and law enforcement officers to receiving driver records only related to traffic laws. SB 498 is going to allow more access to those records for courts and law enforcement who need them for other crimes.
SB 498 also creates a single standard for releasing the motor vehicle records rather than having multiple standards across different code sections. And then finally, current Arkansas law prohibits the disclosure of a digital driver's license photos without the approval of the driver. And SB 498 will again allow that to be released to courts and law enforcement agencies. And so, with that, I'll be happy to try to answer any questions.

Members, I think we can all say that this session has been challenging with our municipal partners and our developers as our cities grow and we try to compromise what our property rights are and what sustainable, responsible growth looks like. What I have here is a bill that is a balance between developers and municipalities. When a municipality or a planning commission of a city
redoes their land use map and generates new zoning areas within the municipal boundaries what that does is once they generate that map and it goes through the planning process and all the public meetings or notices that the city does and it goes to city council, city council does the same process before they adopt that new land use map it stays as is until a developer or a landowner wants to go implement the change on that map and so if you had a property that was part
of the change within the land use map and you went to the city and you wanted to do something in accordance with that land use map, you had to go rezone that property in accordance with the land use map, which means you had to go through public comment, notice all the city council meetings, the readings, just to get your property rezoned to what the city wants your land area to be used for, which is what you want it to be used for. And then once you do that, you have to go back and submit your plans and go through the exact same process.
So what this bill does is it allows the city by ordinance as a permissive action to implement an administrative process with the submittal of a landowner and approval of the city to avoid that middle process and have your land rezoned according to the land use map. And so it also allows for an appeal process in the events it doesn't go your way and you want to appeal it to the city council. The appeal process is allowed instead of going to the circuit courts as allowed by code currently.

I had the opportunity to work the last few years with some veteran organizations related to some private sector stuff. Also, our local VFW celebrated 100 years recently. They're the oldest in Arkansas. And in doing that, there was a lot of conversations, a lot of stories that came up. But one thing that really kind of stuck to me and kind of pricked my heart is the fact that, and I'll share a couple of statistics, the last known surviving World War I veteran
passed away in 2011. We have 66,000 World War II veterans alive is all, and only about 10% of the Vietnam War veterans remain alive. And so the freedoms that we have today, the ability to stand here and to debate and to discuss and to do the things we do is because of that. And the generation that is before us have made it available for us to be able to do that. But the generation that's coming up behind us, they don't know what it means to be a veteran, to leave your job, to leave your family, to leave a crying child to go away to war.
And I just think it's the right thing to do to keep that present in the eyes of our educators and our students. And so all this is doing is making it required to have one unit about what it means to be a veteran. Not who caused the war, not who won the war, but truly tell the stories of what a veteran does. This was first passed in 1947, and it allows governing bodies such as the Board of Trustees of our higher education institutions to issue revenue bonds. Again, these are not general obligations. These are revenue bonds with defined revenues that will pay them off.
In the last century, we talked about new construction, remodeling, purchase of buildings, and tracts of land. That's the capital costs. In today's world, we have things like software and medical equipment and things that can be bonded or can be financed through these bonds issues. But it's generally agreed by the bond counsel and the other lawyers that since these are tax-exempt bonds that must follow the IRS rules, Arkansas law requires that we have some specific procedures in place.
And so Senate Bill 545 makes sure that all those are set in the proper procedures. These bonds are for capital assets, but software, which is kind of intangible to me, but is deemed to be a capital asset under the IRS rules on this. So this is to make sure that we're up to speed on keeping these issues current. So when a higher education institution board authorizes upon the issue,

Cybersecurity personnel and those informational security job functions will have a functional report to the cybersecurity office. However, the administrative will stay within their agencies. It will create a cyber response team to allow the state's chief information security officer to create a multi-agency response team in response to threats. Provides for compliance and auditing
to report its findings to the Joint Committee on Advanced Communications and Information Technology. There is zero fiscal impact for this. I think during the committee it was said that there was 500,000 to 600,000 malware attacks pushed out on a daily basis. Arkansas is not immune to those. The analogy given that I thought was best by the House sponsor was picture an offensive line and no quarterback. This creates a quarterback for the offensive line within the agencies. for sheriffs who are not certified law enforcement officers. So Amendment 55 states that the quorum court sets the compensation for the county elected officials as provided by law. So we set the salary minimum and maximum in the legislature by law, and that's for counties classes one through seven. So the sheriff's pay, minimum and maximum pay, is different depending on which class of county you fall into
based on your population. Our constitution also says that the salary of an
elected official cannot be lowered during their term. So this is why we're trying to handle this on
the front end. This bill, to be clear, does not mandate qualifications. It does not mandate qualifications for sheriffs for an elected official. It only discusses salary, which simply encourages
law enforcement certification. We passed a similar law to this around 10 years ago for coroners. Again, we did not mandate qualifications, but we encouraged certification via salary for
coroners about 10 years ago. In the last three years, the Franklin County Sheriff, the Johnson County Sheriff, and the Hot Springs County Sheriff were all convicted of crimes. Those are the most recent sheriffs to
be arrested and convicted of crimes. Out of those three, none of them were certified law
enforcement. So this bill is supported by the Sheriff's Association, the Association of Arkansas Counties, the County Judges Association, and the Quorum
Court Association. Simply put, this bill encourages but does not mandate qualifications through salary. So it does not mandate qualifications. It simply encourages sheriffs to have a law enforcement certification. Otherwise, they're paid a minimum salary, which starts for a class one county at a little over $48,000, and for a class 7 county, the minimum salary is a little over $129,000. So we have actually differentiated salaries and continue to do so to this day here in the Senate, depending on a position you may hold. First, I don't run that many bills, but I do believe in process. I try to take care of business, and I know business can be done different ways. But this body rejected this bill the other day. It was voted down. There was, it was asked to run again and it was voted down and the chair ruled that it was over and it was said, send it back to the house as failed.
Now that's not always the final deal. That's not the final deal in this. The problem is, at the end of the day, and Madam Governor was not in the chair at that time, it was said, whatever we hear every day, after the bills were read, we had already gone through the process, everybody was talking. But before that, standing right here, the committee chairs, the transportation chair, said transportation will meet immediately.
Everybody, a lot started clearing out. Senator Irvin and Health said health meets in 10 minutes. People continued to clear out. The chair, again, said, started the term after reading of the bills and so on. A lot of talking going on. The gavel did not hit. Go watch the video. It didn't hit. I agree with that.
But I was walking through the back room, quiet room, on my way out, and I hear on the speaker, House Bill 1725. And before I could get down the hall, I hear something to the effect of, without objection, to look at the video, and then said, ask for the eyes, and there was two or three eyes.
I don't think there were six people, six, seven senators in there at most, from what the video shows. And it said nays, and there was a nay, and by the time I yanked that door open, you can hear me about a second later saying no or nay. And it was ruled the ayes have it. That was after it says without objection. The nays were the objection. So this is kind of technical. It's not real clean.
We voted the other day to return the bill that the House has failed. That's the process I have a problem with. Now, on the bill, I've talked to two western Arkansas sheriffs, one totally for this, helped put it together and felt it's needed. We disagree. We disagree because I told him I can find you certified sheriffs around this country that are failures or have been in trouble.
It's not just because they hadn't had training. And I saw one the other day that had killed a judge that had been friends to him. So this is not exclusive. We may have had some in Arkansas, but these are people who are elected by the voters. That's who they want. And I didn't hear it because I'm a little hard of hearing, but somebody evidently said the other day, ask Senator Davis, and it's not Senator Davis' fault. I'm not anybody's fault to blame.
Somebody said, what about Buford Pusser? I don't think some people know who Buford Pusser is or was or mythical Buford Pusser. But if you elect somebody to do a job, and hopefully they'll get some training, and I don't know what's allowed as far as online. I had one sheriff tell me they expected when he got elected to take 11 weeks off and go get training because he didn't have law enforcement training. He said, man, I can't do that. I've just been elected sheriff in office.
I've got people around me to do it. But we're going to tell Arkansans, the voters, you can't elect who you want. You elect who law enforcement, the sheriffs are for this, and certain people are for this. You're going to elect who we say that you're going to elect. And this has been brought up by some of y'all. What about these other offices? I'd like to have maybe some more experience in some other offices. But let's go back to the voters. Let's trust the voters.
I don't think this is going to make or break Arkansas. But I think the process wasn't followed as cleanly as
it could have been, and I don't think this bill is necessary, so

Law enforcement working together across lines to ensure that sheriffs that do want to be certified can be certified in a practical way where they can still serve the people that they represent. You know, I understand that this is, everyone has mixed feelings about it. It's a little contentious.
