There's an additional $330 million that is
setting in a restricted reserve account. This body put that money in 2 years ago. This would be we would need additional. moneys obviously to be able to fully appropriate or fully spend in this appropriation, uh, we're working with the sen or the House right now on how we would do that, that will come a little later in the session. One of the things we want to make sure that we do in that process is having an accountable plan with the Department of Corrections so that we're able to during ALC make sure that we're tracking, monitoring, and understanding
the process and the progress of the prison construction, um, anything that we do and to let money out. Of that fund to go into, you know, be utilized by this appropriation would require a 3/5 vote by the ALC membership. Again, so it will, we will have a funding bill later on when we get into session, uh, hopefully not too long from now. There will be separate and apart from any other funding bills that we have, and that will, those monies will be collected into a 3/5 voter account and as money
is needed and requested by the executive branch for the prison construction. They'll come make a letter, and we would let that money out. If the legislative auditor council chooses to do so with

is, this is, if you have a capital project, uh, the state
has a capital project, I should say, that we want funded. You are supposed to file an appropriation for a capital project in the amount of the anticipated construction costs. That's what this is. It is only a vehicle to spin. The
appropriation threshold. On the second part of that, you have to fund it. Funding is typically a 51% vote threshold and so we as a body will dictate how we want to fund this prison. So we may do some set asides, restricted reserves, the, the, the vehicle that we've used in the past in the 3:30 is a restricted reserve account that can only be used for prison construction that requires a first, a letter from the governor and then approval of 3/5 of the Legislative council for money to be let. So what I would anticipate as we move
through the construction process where the state moves through the construction progress uh process, uh, the governor will issue a letter requesting an amount for that stage of construction. We will review what's happened. We'll see what's going to happen in the future, the best of our ability, and we'll choose or not choose with the 3/5 vote to let that money be utilized and be spent by this appropriation. and going through the process and this is just
the beginning of the process, so I'm going to talk about a few things in this because I was elected in 2006, back when we did not have the crime crisis that we have and the overcrowding. It was still a problem back then, but it was not to the mega crisis. And I've learned in life and it's like my
grandfather taught me, there's the deal and there's who you deal with. You can make the best deal in the world on a bill that sounds great and go down. process and then there's who you deal with and how it turns out. And basically what happened was when Governor Bbe got in budget trouble as any governor would do, tries to look at saving money. He started letting people out of jail prison that shouldn't have been let out. It was called the Public Protection Act. You can go through this handout right here in 2011, but the Public Protection Act was not about protecting the public.
It was about letting people out of out of prison that should have never been let out of prison. They should have stayed, but once again it comes down to money. Every decision we talk about down here comes down to money. This is what Senator Dismay talked about was basically the process for the money for this, but in 2011 as you go through the handout, you can see. It did not protect the citizens. You can see that violent crime continued to go up. Significantly in every part of
the state. You can see in 2015, Senator Jeremy Hutchison comes in with his big ideas and you can see through the bill title that it's gonna protect the public. It's gonna reduce crime, reduce overcrowding. Once again, what got promised to the citizens. That never happened. We spent millions on a consultant that was going to tell us all these great things if it was going to solve these problems and wasted millions of dollars. You can go through the handout. Arkansas prison population among the fastest growing. Inmate growth outstrips prisons
with prisons overcapacity earlier approval release for more than 700 inmates at that time, some of these legislators were getting on the board of corrections and it really wasn't their fault because they were funded, not funded correctly with the money to take care of the problem and the issue by people in this body and governors. You can see the FBI crime statistics go up our violent crime, property crime went up. If you look at, and I always go back to the dollar, if you see where politicians prioritize things, see, see where they
spend the money. You can see where education was at 44% of the budget in 2007, went to education, public safety was only 1.9% of the budget. Corrections was 8% of the budget. Look at county turnback. Every one of these percentages, look what happened in the last budget. You want to see where the money and priority I talked about in 23 about the budget and RSA there was not enough money for corrections. 8% of the budget corrections budget never changed 8%. If we'd
have been serious about funding corrections 2 years ago, 10 years ago, 5 years ago, correction should have been 10 or 12% of the budget. Public safety should have been 2.2 or 2.5% of the budget. That's why we're in the crisis it is because of money and who's funding it and the lack of funding. If you look at the graph, whatever you want to say, whether you want learn to spending is gonna go up. You look at the Medicaid spending is not gonna go down. Corrections and all these other ones have stayed flat, which is
essentially a cut. Our county turn back, city turnback dollars as a percentage is less than when I first come in. That's actually a cut to our cities and counties because the cost of everything going up. Medicaid was the big winner in it, 24% to 32%. Our state budget's like a balloon. It's pretty simple. You expand in one area, you're going to contract in the others, and that's what happened. So when this process started in 2017, I proposed that if you went to correction, it's got sentence 4 times. You serve 80% of your sentence. It was time to get tough on
things and provide the funding. At that time, we passed a bill out of the Senate. Governor Hutchinson opposed it. We got down at the end of the budget, and we do with the funding and everything. I proposed at that time Amazon was remitting the internet tax voluntarily. They estimated it's probably 4 or 5 times that now as a revenue stream to take care of this problem, but that was rejected by many of the members here once again, if you're not going to appropriate the money, then what you say out does not matter. So when this process started On the prison part, I can tell
you that the $470 million figure for 3000 beds was a total farce. That's $156,000 per bed. And folks, I know I'm talking a lot and we're doing it and hey, it's early in the day and we're gonna get a lot of the talking out as we go through the process and I won't have to repeat these things. 156,000 per bed irresponsible farce, never would happen. Other states had even started pre-COVID price explosions were much more than that, 285,000. Utah was gonna build a prison for 500 and something million. It wound up being almost a
billion dollars. Let me tell you something, folks, you can talk about process 35 votes, what do you want, you get in this process once you get down this path with these mega prisons, Utah, Alabama, every one of these megaprisons are mega financial disasters. Every single one of them. Just look at Alabama, look at Utah. You want to see what the real problem is in our state where it's coming from, if you look at this, when it comes to inmates and incarceration in county jail backlog a counties, 8 counties
contribute 2 out of 3 inmates to incarceration in county backlog according to border correction facilities. Benton, Washington, and Sebastian County alone contributed almost 1 out of every 4 inmates to incarceration. Look at the figures. What is really happening here is you have counties, we have border correction facilities and in Pulaski County and Jefferson County. The 8 counties are Pulaski, Jefferson, Faulkner, and Celine, Sebastian Crawford, Benton, Washington County. Pulaski and Jefferson already
have border correction facilities, and I will say this, I've told the people in Northwest Arkansas, we gotta build them up there. That's where the population growth is somewhere up there. But what has happened is in my counties we passed jail taxes and make sacrifices either that in the budget. To, to find these jails and this wouldn't be as bad a crisis had these bodies and many of you been funding corrections at 10, 12% of the budget and up public safety to 2.5%, but police officers in that they don't fund
big pack checks and money to contribute like they do in these other areas like Medicaid. That's just the truth of it. If you look at where the process went to this facility, I said all along 470 million was never going to do it. Board of Corrections came out with a consultant that said 1.2 billion last year. Now we've jumped around like a frog on a hot rock. Every time it because the rock gets hard, the frog's gotta jump. We went from 470 million, what now we're at 825 million, even more, with no details or
specifics. This part of Franklin County, it is in Senator Suville's district, not my part. There is no way you're gonna get 800 people. to work out there. That's, that is so ridiculous. It wouldn't matter if it's Texas Instruments building out there. No company employing that many people would look at a location like this. I'm a real guy. As I said, there's a deal and there's who you deal with in this. Look at all the promises that we've made, jumped around on millions of dollars, no specifics. If a school did that for a building. You'd want them investigated.
Let's talk about Joe Perfuri. First off, he says to this body legislative that the community needs to embrace it. That happened? No, that didn't happen. You know, he doesn't care about that. He says one thing in front of a committee, doesn't matter. You know what else he said? He said, well, the road structure's fine. The highway department came back and said no. When you do a construction project of this thing and you're talking concrete trucks, cranes, and everything like that. You're gonna have to redo a lot of these roads before you even get started in the process. They
never even called the electric cooperative and find out what it took to get power in there. This place is on a mountain of rock. There's no water. You're literally conceivingly trying to build a 3000. 800 population city way out in the country where there's no road or any structure, no water, no sewer, nothing. Didn't even call the electric cooperative. There's a guy in a construction said, I wouldn't let my wife build the she shed in the back without checking that out. That's how incompetence level that this really is. If you want
to go to really who we're trusted in this. If you want to really keep going in this. Joe Perfury at the April meeting in 23 up in Batesville, I got the transcript of it finally. said we were going to expand calico Rock where you already have 100% staffing up at Calico Rock, 525 beds, they're gonna have to up it from the 75 million to 115 million. Joe Perfuri shut that down. That decision alone, folks.
costs taxpayers $40 to $50 million more dollars in building in this megaprison mega financial disaster when you talk per bed. We could have been 525 beds already 2 years down the road had Joelperfury not shut down. I'll share the uh the transcript of the meeting. That's what we're getting into right now when you start this process going down there and look at what else happened. This has been riddled with lies, deception, and gross incompetence. And you want to trust people like this that make a decision,
the calico rock expansion was a no-brainer. Easy decision. You know, they would sit there and say, well, what are we gonna do if we do nothing and not get nothing. That's ridiculous. I've heard that threat all the time down here. We've got other options and I would like love to have the Senate floor debate at some time, my option versus the other option. If we don't stop controlling the crime on the front end, we will never get out of this mess. It once you, if you have high crime rates for a while, the
next steps are you have public defenders overburden your current system overburdened, your jails overburdened. The only way to financially get out of this instead of this financial death spiral that what one side wants to go down is to reduce crime before it even happens because once you reduce crime before it even happens, you save so much money because if you have a high crime rate, which we already have a high incarceration rate, embarrassingly. Once you arrest somebody, you have to haul them to jail. You take them to jail. Guess what?
They have a booking. They have a stay in jail till they either get bonded out or stay to their court date. They have a public defender in the process. Then they have a court date and then they get sentenced to incarceration at Costas, and then you turn around and have to rehabilitate them. And then turn around and have probation parole, which we're not funding. They are overworked and overburdened and underfunded, and they will be 5 years from now. This keeping people that are the serious crimes and, yeah, it's going to help out some, but it will not
step in our into the crime rate. Little Rock is 7500 officers short right now. We need to be hiring public safety officers and paying our up public safety people and these officers more and get more people in and doing positive. situations out here to actually reduce the crime. That is the only option that we have to get out of this. Going down this megaprison mega financial death spiral built upon lies, deception, and gross incompetence is not the first step in the process that we should do. We will never get out
of that. The other part of my plan is to help county jail, county sheriffs and equalize the pay and deputies so they're not losing. Every county out there, all 75 county deputies make less in cities. My plan will actually equal ize that pay and let them keep from losing deputies. So many times they pay for the training 2 or 3 years later, they're gone to a city or somewhere else. There are a lot of things that we can do, folks that we need to debate and look at before we step into this megaprison mega financial disaster depo that
we're gonna go into. Let me add the three counties I mentioned, Benton, Washington, Sebastian County that contribute almost 1 out of every 4 inmates, they're not passing jail taxes. Everyone in my county, Senator Stokeville, Franklin County passed a jail. Is this a crisis with state backed folks? Yes. But it's only when they don't pass jail taxes, we're going to let these three counties continue to run over us with prisoners. Why would any county in the future pass a jail tax expansion or a new jail, why not just do like Benton County. Keep dumping more people in the state
system. This will bankrupt us just not in this process alone, which has never been explained. I cannot imagine letting go of almost a billion dollars without any detailed specifics, the reality is this prison for the amount with if you look at other states and everything, whatever they want to promise, you know what, they'll be lucky to be 2000 prisoners up there in 67 years, you'll be lucky to have 40 500 people working up there. You look at 2000 prisoners with the amount of money, that's 400 and something,000 per bed.
There are a lot of options that are better than doing this. And for Joe Perfury to shut down that calico rock expansion, literally cost taxpayers $40 to $50 million more dollars that we could expand it right then rather than go down this path of this megaprison and cost us more money. Well, there's 50 or 60 bills on our calendar today that I wish were different. But I don't get that option to do. We get, we work in a representative republic democracy where it doesn't get to be the way that I want it. It doesn't get the way Senator Hill wants it or Senator Dismay wants it. It gets to be the way that the group comes together with a decision.
So when I started thinking about why would I vote for this. I called my local prosecutor in Benton County. And I said, hey, I remember a story from just not long ago, a
young lady that murdered a police officer. And I remember some horrifying facts about that. Can you refresh me? So her name was Shauna Cash. And if you'll listen to me, there's a shot of cash or a dozen China caches, and every one of your districts. She was arrested in Grant County and released in May of 21. She was arrested in Washington County and released for no room in May of 21. She was arrested in Benton County and released in May of 21.
In April of 21, she murdered Officer Apple. Three times she should have been in county jails 3 times she was released because no room. Now we have a memorial highway in northwest Arkansas named Officer Apple Memorial Highway. What I'm trying to tell you is there's many Shanacas in every one of our districts right now. She should, they should be in prison, but there is no room. And I hope the rest of you don't spend the rest of your lives driving down an office or Apple
or an officer or whatever, or just maybe it's a friend of yours, maybe a schoolmate, maybe a co-worker, and maybe they don't get the privilege of having a highway named after them. But I'm telling you, the Shawna cass are in every one of our districts right now. Every one of us know it. We've got to have room and I'm begging you to not have something horrible happen in your district when we could have made a difference today. I'm asking you to vote yes.

We have the logistics to support a 3000 bed prison. And if Arkansas is a rural state and we want to put the prison out in a rural area, then maybe we should build 3, 1000 bed prisons. Uh, Senator Irvin and I are very familiar with calico rock. The people in Calico Rock wanted it. And it's been doing great in Calico Rock, but we didn't go up there and try to build a 3000 bed prison. It's 500 or 600 beds, and it could probably handle an expansion.
What I'm saying is this is not a good plan. It may be a great location for a smaller prison. But there's no population to support an 800 person workforce, from what I understand in this, in this area. Uh I think we should be considering Where you're gonna build it. If you go, if you're gonna build a 3000 bed prison, then that's going to narrow down your selection sites. If you're gonna
build 3 1000 bed prisons, then you can probably stick them out in the middle of nowhere and and get away with it. But uh I can't vote for this appropriation. I understand it's appropriation, and it's not funding. But it's a bad business decision and, and I'm not gonna be responsible. A year or 2 years from now when we spend 3 quarter of a billion dollars. We've worked with all groups, including the state employee association, to ensure that it was meeting expectations. I want to be clear, this is a labor market rate plan, um, so there's a little over 16,000 state employees that will be getting raises, so that they will be paid in line with
labor market rates, um, there are some employees that will not be getting raises, and that means that they are currently being paid labor market rates. So this bill does a couple of things. First of all, it reduces the current number of classifications, there's around 2500 right now different job titles. It reduces it down to 850 and um it establishes a new grade structure with 6 new pay tables instead of 4, which is what we previously had. There's no connection to the old
from the old tables to the new tables. So it's entirely different when people try to compare grades where they're at now versus the grade they will be. There is no
connection or lines drawn. It's entirely new. Um, so it also creates groups, um, and jobs and jobs series and jobath so that there can be a
way for career advancement for to encourage people to have a career at the state and be able to be promoted within their job
series. And lastly, it creates a student loan program to help assist state employees and repaying student loans, and that will be up to the different agencies to come up with the rules, um, to determine that, and we do have caps, um, monetary

no vote, if basically if you look at personnel over the years, it should follow a little bit what is going on here in Arkansas. I mean, one thing is the 6000 people that are not getting a raise at McKenzie, which I do not like, we don't need, uh, I don't like New York consultants trying to consult us down there
and this is once again another issue that I have. Nothing against Senator Davis because any big project is never gonna be perfect. So it is not against Senator Davis, but if you look at the 6000 employees that are not getting a raise, they say at market rates. Well, that may be a market where it's high cost of living. I live in a rural area, so somebody making the same amount of money will be banking more than somebody in Pulaski County that could be doing the same job. That's one of the questions that I have that I don't think can raise. If you're giving me this amount of money, then there should be some more equity and fairness and looking
at the whole situations, even though I'm in a rural area where somebody making the same salary. It's not the same as somebody making more in Benton County even though I talked about Benton County last time. The biggest thing that I look at in state government that I've seen over the years is the explosion of jobs, of high paying jobs. You, when you talk $100,000 a year job salary wise, you might as well add 40,000 of it because it used to be 27% for salary and benefit or benefits. Now it's 40%, so you're talking 140,000. So Joe Perfuri that I mentioned
earlier, that's making 180,000, he's almost making a quarter of a million dollars. And just cost us 40 to $50 million on a dumb decision that should have been a no-brainer. So that's what, that's a quarter of a million dollars in 4 years, you're going to pay him a million dollars. And the one thing about waste and fraud when Elon and all this is catching on is if you waste a million dollars, you really wasted $2 million because when you waste a million dollars, takes a million dollars of good to get it back to good. You talk about $2 million you're almost 0.5% of giving a cola to every state employee, but if you want
to look at these figures where we have not done the job that we should have done is the absolute explosion in these high dollar house salary jobs, which a lot of them are just political appointee jobs that it's actually the career people doing the job, and I'm for raises. So nurses and I'm for raises on prison guards and spending money on that. But if you look in 2015 in core state government, there were 217 people making over $100,000 a year. In 2025, 854.
If you want to look at this figure right here and you're looking at core state government and spending money and once again, we are spending money, whatever you want to be. Lawrence, whatever, spending money, correction, spending money. Our revenues are going down. DFAA predicts next year that I think is concerning, and I'm a farmer and pessimist, that revenues are gonna get back to normal, which I don't know in this world today, we really know what normal is anymore, to be honest with you. If you look at the tariffs and agriculture about us continuing spending. We're not doing a careful enough job in spending and as I mentioned theorfiri thing.
costing us 40 $50 million more and paying him a quarter of a million dollars a year, but in 2015, folks, 3 people made over $200,000. Now, I'm not talking to the people down here that do the job out in the field and everything like that that deserve raises the prison guards, the nurses, all those representative Mayberry's got a nurse's bill that I'm for spending more money on 2015 there were 3 people making over $200,000. You know what that figure today is in 2025. 172.
There are some serious problems going on with this. There is a reason why in Arkansas in 2015, there's a study I'll show with you, we spend more per capita than the rest of the states around us, meaning we're the most wasteful spending government around us in this in this surrounding states. Florida is like 300 or 4000 less per capita than we are. If you really want to look at that. But in 2015, 3 people made over $200,000. Now it's 172. If we don't get control of spending a bunch of these political appointees that's getting paid the job that the
real people are actually doing the job, not these political appointees. And get serious about these high-paying jobs and start recruiting. We are financially, next year, right now, revenue spending wise, I don't see how we keep up and we're headed to the red unless the economy turns around, which I hope it does. Anyone else? I

annual payment, but they'll still be rules promulgated for those programs per agency. We want people that are going to stay with us and provide services for the state, to the people, well, um, so we're seeing in over 16% increase in pay for correctional officers, over 15% increase for
pay for social services, our social work. workers that deal with our kids in foster care, a 10 over 10% pay increase for state police and an over 10% increase for nursing, and we all know we've had issues keeping and retaining nurses at places like Human Development centers across the state who deal with the most um fragile, fragile and a critical population. I'd also like to speak to Senator Caldwell's comments on um the division of Bag, the county extension officers. That is not in this
pay plan. Those employees are in the University of Arkansas Division of AG budget. If we want to take up funding for those county extension officers, then we need to be making phone calls to the UFA division of Ag and talk to them about it. Um, I've got their budget right here and if you look through, you can
see that there are maximum. Maximum pay is $199,000. Why aren't they making that? I don't know. Let's call you of a
division of Ag and ask them why they're not paying their county extension officers what they should get paid. So that is not part, that that is not an executive branch function. They are not employees of the executive branch that's not part of this pay plan, that is in UFA division of AG budget. So I want to be clear on that if we have issue and we want to give them $6.5 million then we need to call them and ask them, um, why they're not paying their employees more and what they
plan to spend that $6.5 million on. Um, in closing, um, Again, so many groups have been worked with to see this come to fruition. Um, everyone's been at the table, there's been a ton of
input over um a couple of years now, we've been meeting about it extensively, making adjustments, ensuring that um nothing is perfect, but everything is as good as it could be, and that we're doing right by the state employees who are working hard for citizens across the state of

followed a handful of uh healthcare bills this session, um. One of my, my goal, my goals were to increase access, uh, lower
health care costs and give patients options in their healthcare choices, uh, SB 117 uh does all three of those, in my opinion. Um, Naturopathic physicians, this is something I've worked on pretty
much ever since I got elected to the legislature. I have um kind of a background story on why Naturopathic physicians came into my life and why they're important to me, um, there was a point in my life where I had a lot of healthcare issues. I, I had gut issues as a kid, but, you know, it was just blamed on you, you eat too fast, uh, you know, I'd get a stomachache every time I'd eat, but as, as time went on as I got older, I started having more severe problems with joint pain,
rashes, um, all kinds of weird issues, high blood pressure, um, and it got to one point where I gave up fast food and alcohol one year for Lent. Um, when L Lent was over, I went out and had a couple of cheeseburgers and some beverages, and I woke up the next morning with a fully distended abdomen. I was miserable, uh, went to multiple doctors. Nobody could figure out what was wrong with me.
Um, I got referred to a specialist. They couldn't figure out what was wrong, um, was going to a dermatologist. They were giving me, uh, creams for my rashes, special shampoos for my, my scalp. It was just a miserable time in my life, and I, I remember this girl I went to college with, she said she was going to be a doctor. So I called her up, tracked her down, and, and I said, Hey, did you ever go to medical school? She said, no, I went to naturopathic physician school, and I was like, tell me more.
And so she told me about what a naturopathic position was. I told her about my, my issues, and she said, Clint, you've got food allergies. Come in, we'll do some blood work. So I came into her clinic and at the time in Arkansas, she can't practice as a naturopathic doctor naturopathic physician, cause we, we don't license that that profession here. So she was working under a chiropractor, um, and of course she couldn't do the blood work because she wasn't allowed to by law.
She's, she's a doctor in Arizona. That's where she went to school in Arizona, she has prescriptive authority. She can prescribe drugs. She can do surgery in Arizona. But in Arkansas, she has to work under a chiropractor, um, one of the, the naturopathic physicians that helped me with this particular bill this year, uh, she works under her acupuncture license, so that's that caps out her scope of what she can do. under that, that acupuncture license. So
We do the blood work, we send it off. Results come back. And she puts me on a 4-day rotation diet. And over the course of
6 months. Within a month, I was already feeling better, but within the course of 6 months, I lost 70 pounds.
My testosterone levels went up. My cholesterol levels went down. My blood pressure went down. Everything started working better. I was a different man. All, all my numbers were better.
No drugs, just lifestyle change, eliminating certain foods from my diet that cause problems. So, obviously I was sold on naturopathic doctors. We're, we're allopathic medicine. Didn't have an answer for me, naturopathic medicine did. And I'm, I'm from the belief that We should have a holistic health care system and our health care system is geared specifically
towards drugs, surgeries, and just allopathic medicine. I see my chiropractor and my physical therapist way more than I do my allopathic primary care physician. But that's my choice and I believe all Arkansans should have the choice to, to get their healthcare where they see fit. I believe that a lot of Issues in our society can be handled.
I mean, there's a lot more information out there about food additives, uh, seed oils
being bad for people, uh, you know, the old, old, you know, Senator Penzo, I'm going to have

I left off there. The, the We're a different place in our society now with what, what healthcare looks like. Um, we, we know that food dyes are bad. We know that seed oils are bad. We know that the, the old Idea of what healthcare looks like is different now.
Um, I, I, I think of one example, um, I, I know I have a family member that was labeled as diabetic. I used to be into personal training and physical therapy back in the day. A lot of y'all know that. So I, I worked with this family member on diet and exercise, um, and of course it's family members, so that's OK, right? So I did some coaching on them, um. And they were able to get off all their
Diabetes medication. Well, years go by and their health declines again, and they ended up getting a glucose monitor that feeds to their phone. And a lot of the foods they were told to eat, it was good for their diabetic condition, we're causing Blood sugar spikes. And so that helped them kind of regulate, but With that being said, a lot of the old mentality of what is good for us. A lot of that's
changing with with new discoveries and sites. So what this bill does, it, it, it, it sets up a licensure for naturopathic physicians in Arkansas. One of the committee members didn't want to create
a new board. We initially started with putting them with the medical board. Well, the medical board doesn't really want to play nice. So I wanted to set up they're on board. Well, one of the committee
members didn't want to create a new board, which I understand. So what we did was take the
acupuncture board. And merge it with this and create the natural medicine board. So a lot, several pages of this bill are actually, you know, near the end or just striking a lot of the language from that, uh, Current board that exists and make it a natural medicine board, so it'll be made up of 3 naturopathic physicians, 3 acupuncturists, and 2 members of the public.
Um, and that's pretty much what a lot of the back end of this is,
um, and I'd be happy to answer any questions about what, what anybody might have about naturopathic physicians. Questions for Senator

is taught by MDs, DOs, chiropractors, and other naturopathic physicians,
so it's, it's, it's more of a holistic um type of health care. We're not trying to replace allopathic medicine where
we're not saying that, you know, that's what we're trying to do. We're trying to
give an alternative to to allopathic medicine. So they're, they're training, they, they don't do uh residencies like MDs do, uh, but they have Very adequate training, some of their training is more geared towards, like they have a lot
more nutrition training than they do, um, than doctors do,
MDs, um, but they, you know, they don't have all the, the Training on pharmaceuticals, that's
where a lot of the allopathic medical doctors, most of their training is geared towards more surgical intervention drugs, things like that. So it's a different type of uh education, but it's, it's very complimentary and uh if
you, um, Senator Hester, I'm sorry, uh, Ballinger, um, his wife went to get his, her uh uh cancer treatment in Arizon. Arizona and the MDs and the naturopathic physicians work together in the, the naturopathic physicians in Arizona that work with the oncologist, they, they work on the nutrition and things like that to help uh recovery. So it's, it's more of a complimentary than a than a

for the length of this bill, but in a nutshell, what we're doing is modernizing
a law that was passed back in 2013 when it was passed back then, the intention was to make an option available to the uh to the market for financing improvements to mostly commercial buildings when that was passed, or since that's passed, it's just proven to be administratively burdensome and costly, and so it's not been utilized. What we're doing with this bill is uh modernizing it.
We've worked with the Bankers Association, the bank commissioner, the Association of Counties and collectors with some amendments and things, and there's no known opposition at this time, but in short, CPAce is a financing mechanism that allows you to finance improvements, mostly around energy efficiency if you want to improve the efficiency of your windows on a large commercial building. You're not going to tear down the bank billing just because it's
30 years old, you're going to improve it. And so this is a financing mechanism to improve those Adams. And what it allows you to do is finance those by voluntary collection of of the payback of those funds, not with public money, but the the mechanism, it would be collected on your tax bill each year or what we're doing here, it also allows it to
go directly to the lender, but again, it's expanding that and it's a, it's a free market mechanism for financing improvements in energy efficiencies. No public money is involved in this. we had a little bit of debate surrounding this bill yesterday, but currently right now, the Department of Ed has standards for human growth
and development in grades K through 12. Uh, this bill allows for human fetal growth and development standards, um, in public education, and it's simply just says that the Department of Ed in consultation with the Department of Health shall determine the
appropriate grade levels for students to receive, um, this. curriculum, um, the standards
are simply that um it will include
discussion and the discussion shall include a high definition ultrasound, which shows brain, heart, sex organs, and other vital organs in early fetal development, um, and also the process of fertilization, every stage of
human development in the uterus, um, and so I know for me as a person who has had, you know,
4 babies in or 6 babies in utero rather in in birth. For that I've seen all different variations of ultrasounds, um,
from what they were 17 years ago to what they are now with those high definition 4D ultrasounds, and it's, it is life changing to see um a little heart flutter so early on when you go to your 8 week appointment to see an actual real baby, and when we talk about what's impactful in showing students things that are true and real, um, I think it's important to focus on an ultrasound, especially a high definition ultrasound where we can see a real baby and a life and a heart beating and organs developing. Um, we know that that's what changes minds when
women go to a crisis pregnancy centers, um, to decide if they're going to have their baby or have an abortion, we know that ultrasounds change minds and save lives, and I think it's important that as we're educating students um in secondary education and talking about fetal development and babies growing in utero that we show them real actual live pictures of babies in the womb, um, and talk about that development in a real way so that when they're older and grown women and men when
they go to the doctor to see, to learn about their baby, um, that what they learned in school is consistent with what they're hearing from their doctor when they decide to start a family, um, and that's why I think this bill is so important and important to focus on that high definition ultrasound. natural food stores came to us on page 2, line 22 and asked to be included with the farmers' markets, and that seemed to be a natural thing to do, uh, so we've got them included. That's a clean up that we didn't get done last time, uh, down here on 31, it changes the size of the sign that you have to have if you're selling non-pasteurized milk to 18 inches by 24 inches from 24, which is still a large
sign, but much more manageable in a store. And the, uh, and for those who are concerned about the safety of page 3, began with line 15, raw milks for raw milk products produced in this state may be sold at a location that is not the farm where the raw milk product is produced if the raw milk product is clearly labeled with the following statement. And you have some very clear labeling about the dangers and
how it should have been handled, etc. that were not there before in the interest of safety, so I think that's a very good point that we picked up running the other bill from opposition. I think it's very

The reason why expunge is now just as sealed is because all of these records now are moving from paper to computer and so they're electronic, and so it becomes virtually impossible to destroy that. So that's why it's reflected, and this brings the crim the juvenile code into consistency with the adult code. Uh, again, there was no opposition in committee, and this is uh work with the

the protection of those motor vehicle records. Arkansas declares them public records. Some believe that it is makes it available for FOI purposes if they wanted to FOI your vehicle make and where you live and so forth, that's not the case in practice, but this is going to clarify that while the federal government requires substantial protections, uh, SB 498 is going to resolve that conflict by providing additional protections of your voter motor
vehicle. records, uh, current law also restricts uh courts and law enforcement officers to receiving records for only related to traffic laws, uh, SB 498 is going to allow more access to those records, uh, for courts and law enforcement who need them for other crimes. SB 498 also contain or creates a single standard for releasing the motor vehicle records rather than having multiple standards

Members, I think we can all say that this session has been challenging with our municipal partners and our developers as our cities
grow and we try to compromise our what our property rights are and what what sustainable, responsible. growth looks like. What do I have here is a bill that is uh a balance between developers and municipalities. When a municipal pality or a planning commission of a city redo their land use map and generates new zoning areas within a within a municipal boundaries. What that does is once they generate that map and it goes through the planning process and all the public meetings or notices that the city does and it goes to city
council, City council does the same process before they adopt that new land use map. It stays as is until a developer or a landowner wants to go implements the change on that map. And so if you had a property that was part of the change within the land use map and you went to the city and you wanted to do something. In accordance with that land use map, you had to go rezone that property in accordance with the land use map, which means you had to go through public comment, uh, notice all the city
council meetings, the readings, just to get your property rezoned to what the city wants your land area to be used for, which is what you want it to be used for. And then once you do that, you have to go back and submit your plans and go through the exact same process. So what this bill does is it allows the city by ordinance. As a permissive action to implement an administrative process with the submittal of a landowner and approval of the city to avoid that middle process and have your land
rezoned according to the land use map. And so it also allows for an appeal process in the events um it doesn't go your way and you want to appeal it to the city council. The appeal process is allowed instead of going to the circuit courts as allowed by a code currently. So with that, I'm glad to take any questions, any questions for Senator Bryant? One of the things that I think we do really well is, is to respect and and appreciate veterans um I had the opportunity to work the last few years with some veteran organizations related to some private sector stuff also our local VFW celebrated 100 years recently. They're the oldest in in Arkansas. And in doing that, There was a lot of conversations, a lot of stories that that came up, but one thing
that that really kind of stuck to me and, and kind of pricked my heart is the fact that some, and I'll share a couple of statistics. The last known surviving World War I veteran passed away in 2011. We have 66,000 World War II veterans alive is all and only about 10% of the Vietnam War veterans remain alive. And so, the freedoms that we have today, the ability to stand here and to debate and to discuss and to do
the things we do is because of that, and the generation that is before us, uh, have, have, have made it available for us to be able to do that, but the generation that's coming up behind us. They don't know what It means to be a veteran, to, to leave your job, to leave your family, to leave a crying child to go away to war and I just think it's a, it's the right thing to do to, to, to keep that present.
In in the eyes of our educators and our students, and so this is all this is doing is, is making it uh required to have one unit about what it means to be a veteran, not who caused the war, not who won the war, but truly tell the stories of what a veteran does. Madam President, colleagues, Senate Bill 545 is a bill that helps modernize uh the higher education bond law. Uh, this was first passed. 1947 and it allows governing bodies such as the Board of trustees of our higher. Higher education institutions to issue revenue bonds. Again, these are not general obligations. These are revenue
bonds with defined revenues that will pay them off, uh, in the last century, we talked about new construction, remodeling, purchase of buildings and tracts of land that's capital costs in today's world, we have things like software and medical equipment and things that can be bonded or can be financed through these bonds issues, but Uh, it's generally agreed by the uh bond council and the other lawyers that since these are tax exempt bonds that must follow
the IRS rules, Arkansas law requires that we have a some specific procedures in place and so, uh, Senate Bill 545 makes sure that all those are set in uh in the proper procedures. These bonds are for capital assets, but uh software which is kind of intangible to me, but it's deemed to be a capital asset under the IRS rules on this. So this is to make sure that we're up to speed on keeping these issues current,
uh, so when a, a higher education institution board authorizes bond issue that it will meet both all of our uh constitutional requirements as well as the IRS requirements. I will try

It grants the state cybersecurity officer the authority to direct and manage all the functions related to the state's cybersecurity and information security for the executive branch. As centralized oversight to establish cybersecurity governance policies, procedures, and standards for all executive offices as functional reporting, cybersecurity personnel and those informational security job
functions will have a functional report to the cybersecurity office. However, the administrative, they'll stay within their agencies. It'll create a cyber cyber response team to allow the state's chief information office security officer to create a multi-agency response team in response to threats. provides for compliance and auditing to report its findings to the Joint Committee on Advanced Communications and Information Technology. debated it, um, before spring break at length, and so I just want to make some clarification points. This is about compensation for sheriffs who um are not certified law enforcement officers. So, um, Amendment 55 states that the Quorum Court sets the compensation for the county elected officials as provided by law. So we set the salary minimum and maximum in the legislature. law and that's for counties classes 1 through 7. So the
sheriff's pay minimum and maximum pay is different depending on which class of county you fall into
based on your population. Um, our Constitution also says that the salary of an elected official cannot be lowered during their term. So this is why we're trying to handle this on the front end, um,
this bill, to be clear, does not mandate qualifications. It does not mandate qualifications for sheriffs, for an elected official. It only discusses
salary, which simply encourages law enforcement certification. We passed a similar law to this 10 years ago for coroners. Um, again, we did not mandate qualifications, but we encourage certification via salary for coroners about 10
years ago. In the last 3 years, the Franklin County Sheriff, the Johnson County Sheriff, and the Hot Springs County Sheriff were all convicted of crimes. Those are the most recent sheriffs to be arrested and convicted of
crimes. Out of those three, none of them were certified
law enforcement. So So this bill is supported by the sheriff's Association, the Association of Arkansas Counties, the county Judges Association, and the Quorum Court Association. Simply put, this bill encourages, but does not mandate qualifications are through salary. So it does not mandate qualifications, it's simply encourages sheriffs to have a law law enforcement certification, otherwise they're
paid a minimum salary, which starts for a class one county. at a little over 48,000 and for a class seven county, the minimum salary is a little over 129,000. to

if they need to, um, and I think it's our job in um cases where we can be responsive to their issues and try to help them where it's our place and to help solve this problem, we have to do it through legislation, which is our place, and so, to me, it's responding to the needs of our constituents and people who are running our counties and keeping them in line and keeping law and order, what sheriffs do in our counties, and I think it's important to um help with out where we can.

President, uh, members, uh, two reasons I don't want to give you that I have a problem with the bill. First, I don't run that
many bills, but I do believe in process. I try to take care of
business and I know business can be done in different ways. But this body rejected this bill the other day. It was voted down. There was, it was asked. Uh, to run again and it was voted down in the chair ruled that it was over and it was said, send it back to the house has failed. Now that's not always the final deal. That's not the final deal
in this. The problem is, at the end of the day, And uh Madam Governor was not in the chair at that time. Uh, it was said, Whatever we hear every day, it after the bills are read, we are going through the process, everybody was talking, but before that, standing right here, the committee chairs, the transportation chair said transportation will meet
immediately. Everybody, a lot started clearing out. Si Irving in health said health meets in 10 minutes. People continued to clear out. The chair Again said started the term after reading of the bills and so on. A lot of talking going on. The gavel did not hit. Go watch the video, it didn't hit. I agree with that.
But I was walking through the back room, quiet room on my way out, and I hear on the speaker. House Bill 1725. And before I could get down the hall. I hear Uh, something to the effect of Without objection. We look at the video and then said, Ask for the eyes and there were
2 or 3 eyes. I don't think there were 6 people, 67 senators in there at most. From what the video shows, and it said nays and there was a nay and by the time I yanked that door open, you can hear me about a second later saying no or nay. And it was ruled, the eyes have it. That was after it says without objection, the nays were the objection. So this is kind of technical. It's not real clean. We voted
the other day to return the bill to the House has failed. That's the process I have a problem with. Now, on the bill. I've talked to two Western Arkansas sheriffs, one totally for this helped, helped put it together and felt it needed. We disagree. We disagree because I told him I can find you certified sheriffs around this country. That, that are uh failures have been
in trouble. It's not just because they hadn't had training. And I saw one the other day that had killed the judge that had been friends to him. So this is not exclusive. We may have had some in Arkansas, but these are people who are elected. By the voters. That's who they want. And I didn't hear it because I'm a little hard of hearing, but somebody evidently said the other day asked Senator Davis, and it's not Senator Davis' fault. I'm not.
anybody's fault to blame, so they said, what about Buford Pusser? I don't think some people know who Buford Pusser is or was or mythical Buford busser. But if you elect somebody to do a job and hopefully they'll get some training and I don't know what's allowed as far as online or I had one sheriff tell me they expected when he got elected to take 11 weeks off. And go get training because he didn't have law enforcement training. He said, Man, I can't do that. I've just been elected
sheriff in office. I've got people around me to do it. But we're going to tell our Kansans, the voters, you can't elect to you won't. You elect to law enforcement, the sheriffs are, are for this and certain people for, you're gonna elect who we say. That you're going to elect and this has been brought up by some of y'all. What about these other offices? I'd like to have maybe some more experience in some other offices. But this go back to voters. Let's trust the voters.
I don't think this is going to make or break Arkansas. But I think the process wasn't followed, as cleanly as it could

sheriffs are not certified law enforcement, they actually have an agreement worked out with law enforcement training that they do not have to do it all at one time in those 13 weeks, but they can do it over a period of time, so it doesn't pull them out of the sheriff's
office for a 13 week chunk. So that's already worked out, um, law enforcement working together across lines to ensure that sheriffs that do want to be certified can be certified in a practical way where they can still serve the people that they represent. Um You know, I understand that this is everyone has mixed feelings about it, it's a little contentious, but again, um, the association of counties, the county judges, the Quorum Court Association, and the sheriff's Association all have endorsed
the spill and um support it and have asked us to help them with an issue they're having with sheriffs who are not certified law enforcement. Again, we are not requiring or mandating anything. We are simply encouraging good behavior, which is for them to get law enforcement certified, so that they can do the best job representing their people as sheriff in their county.
