present your resolution. Thank you, Mr. Speaker. With your permission, I'd like for Representative Warren to join me in the well. Members, we all know. And have people in our districts who serve others, lead others, contribute to society and
enhance the lives of all those people around them. And Lawrence Bearden was just such a person. That's why it's my solemn honor today to bring this house memorial resolution before you. I'm gonna keep my comments purposefully brief because I want the highlights and details that are included in the resolution about his life to speak for themselves. He, you will hear though that he was a servant leader. He served his university, he served in the Army reserves. He served on the
local school board. He served his city in different municipal positions. He served his state by multiple different governor's appointments, and of course, he served his wife of 63 years in the family that they built together. And all of this, he did with unwavering dedication. I did not grow up in Smackover, but I did have the privilege of getting to know Lawrence Bearden, in particular, uh, by way of the education system, uh,
and his service to the local school board and even as president of the school board, and I can tell you firsthand that he was a man who passionately and, uh, from personal experience, I saw fiercely at times, stand for what he believed was right and against what he thought was wrong. Uh, yet he was one of the kindest, most compassionate friends and supporters you would ever want to have in your corner. Uh, Representative Warren did grow up as a buckaroo,

Where is Lawrence Irving Bearden, formerly of Smackover, Arkansas, passed away on Monday, February 3, 2025 at the age of 86, and whereas Lawrence Irving Bearden was born in Chichester, Arkansas on April 4th, 1938 to Walter and Ruby Bearding, and he graduated from Fairview High School before earning a bachelor's degree in Business Administration from Southern State College, now Southern Arkin Southern Arkansas University in Magnolia in 1961. And whereas during his time in Southern State College, Lawrence Urban Bearding served as
president of the Student Government Association and was active member of Wesley Foundation, where he met Anne Oliver, the love of his life, and whereas Lawrence Irving Bearden and Anne Oliver married in 1961 and shared 63 years of devoted marriage, and whereas Lawrence Irving Beard and honorably served in the United States Army Reserves completing basic infantry training at Fort Benning, Georgia in 1957 and later commanding the 238th Transportation Company of Camden and the 458th United States. Army Research Laboratoryto Control Company of El Dorado.
And whereas Lawrence Irving Beard and retired from the United States Army Reserve as Lieutenant Colonel after 28 years of service and whereas Lawrence Irvin Bearden had a distinguished career in the oil industry working for BHP as a production foreman and later as an independent producer contributing to the economic growth of Arkansas for more than 4 decades. And whereas Lawrence Bearden was a passionate advocate for education, serving 12 years on the smackover School District's board of directors, including serving as president of Smackover School District's Board of Directors and whereas Lawrence Bearden later.
4 times on the Southern Arkansas University Foundation Board of Governors, including 3 years as chair of Southern Arkansas University Foundation, the Board of Governors, and whereas in 2016, former Governor Asa Hutchinson appointed Lawrence Irvin Bearding to the board of trustees of Southern Arkansas University, where he played a key role in advancing the university during a period of significant growth, including the construction of new residence halls, the president's house, the poultry education facility, and the renovation of the Alumni Center at both Southern Arkansas University and Southern Ark. Kansas University Tech. And
whereas Lawrence Irving Beard's generosity and commitment to education led. To the establishment of the Endowment for the Southern Arkansas University ban Program, resulting in the naming of the band hall in honor of his father-in-law, Richard O. Oliver, Southern Arkansas University's first band director and whereas Lawrence Irving Bearding was appointed to the Arkansas Workforce Investment Board and adult education Study Committee by former Governor Mike Dill, Mike Huckabee in 2005 and was reappointed in 2008 by Mickey Dale, Mike Beebe,
Demonstrating his lifelong commitment to workforce development and economic progress in Arkansas. And whereas Lawrence Bearden was deeply involved in his community serving as president of the Smackover JC's The Smackover Library Board of Trustees and the Board of Administration at Smackover First United Methodist Church, where he was also a Sunday school teacher certified lay speaker and president of the Education Board, and whereas his unwavering faith and compassion led him to participate in 6 mission trips to Haiti, where he worked to improve the lives of those in need and Whereas Lawrence Bearden was a
loving and devoted husband father, grandfather, and great-grandfather who survived by his wife and Oliver Beard and his sons, Richard and Shirley Bearden, and Mark Bearden, his grandchildren, Ashley, Alex Campbell, Jordan, and Tyler Bearden, and James and Anna Bearding. His great granddaughter, Aubrey Campbell, his sister, Linda Dick Mosley, and many extended family members and friends who cherish his presence. And whereas Lawrence Bearden was preceded in death by his son David Beard and his parents, Walter and Ru. Bearden and his brothers Frank
and Larry Bearden. And whereas Lawrence Bearden's legacy of leadership, service, and Integrity will endure for generations to come. Now therefore be it resolved by the House of Representatives and 95th General Assembly of the state of Arkansas that the House of Representatives remember Lawrence Irvin Bearden, and recognize his lifelong commitment to public service, education, economic development, and faith, as well as his invaluable contributions to the state of Arkansas and the nation. This member or this bill only affects, um, members of, uh, EBD Employee Benefits division, so there's a situation happening now where state law prohibits a retiree who leaves our plan from being, being able to come back to our plan at a later date. So, the way CMS works with the Medicare Advantage plans leaves the enrollment and and administrative power to CMS. So if a member has inadvertently, Uh, signed up for a Medicare Advantage or a Medicare Part D
plan outside of the state due to telemarketing or some late-night TV ad or a sales, uh, effort, then they will be automatically disenrolled from the state plan. So that member now has the ability to appeal that unintended, uh, enrollment to CMS, uh, uh, to CMS and then CMS can agree that the enrollment to the new plan was under false pretense. Uh, when CMS agrees with the member, they will unenroll them from the unintended plan and automatically enroll them back into our plan. So EBD here will
receive a weekly report from CMS that notifies us of that decision, uh, to put the member back on our plan. So the problem is EBD gets caught between our current state law that prohibits that member from uh getting back on our plan and CMS trying to allow that to happen. So what this bill will do, we'll give the director of EBD the flexibility. to allow members in that situation to come back onto our plan. It still maintains state law around retirees who knowingly and on purpose, leave our plan. So I'd be happy to

Colleagues, SB 181 is a very narrowly tailored bill. This does not apply to all librarians or school librarians across the state at all. Um, currently, Arkansas law requires that a candidate for a position of the state librarian or the director of a regional library system have a degree, a master's degree, a graduate degree from a program that's accredited by the American Library Association. So we have approximately 16 regional, uh, library systems across the state and of one state librarian. This
bill only applies to those positions. And what it does is it says that the board of trustees that oversees that library system or the body that oversees the state librarian can decide for themselves what combination of education and work experience would qualify somebody to hold this position. You might be surprised to find out that in Arkansas, none of our colleges or universities offer a graduate program that is accredited or approved by the American Library Association. However, University of Central. Arkansas does offer a Master's of Science in library media,
University of Arkansas, Little Rock offers a Master of Science and Information Science. We've got other programs, graduate programs in our, in our schools in Arkansas that combined with work experience could qualify somebody to serve in one of those limited roles that I just mentioned. You need to be able to manage millions of dollars, and I'm not sure that that particular experience can happen in the other librarian positions. I also know that it has been a problem in that you have to go out of state to get this particular degree. And I, I'd love for some of our higher ed universities to offer this at
some point. But since they don't, it used to be more of a hardship. It's not as much of a hardship now because you can do these online. And there are scholarships out there. And I think this is important, these are important positions and I still think that getting the most education to get the most, um, Information that you have to help you do the best job is important.
