you, Madam President. Colleagues, if you live up in the hills where I live and you listen to 103.3, it's one of the only radio stations you can get for that area, but it covers a wide swath. And on Sunday mornings, there are three or four good pastors and churches that have 15-minute shows.
Brother Kurt Howard from Maple Springs Baptist Church, close to a little community called Oil Trough, Arkansas. It's out east of Batesville. But he has a great church, Maple Springs Baptist Church. He has a great radio program. If you're ever up northern Arkansas on a Sunday morning about 9 o'clock, you can hear some great preaching. He preaches the word. He keeps it real. And he's got a great congregation. And Brother Shannon, his associate pastor, is here. But I'd appreciate it if you'd welcome Pastor Kurt Howard, Maple Springs Baptist Church.

I guess most of them are Baptists. They ain't got here yet. That's the way we kind of run things. That's why we take an offering later in the service, because we don't take it too early. They ain't there yet. So I asked Leslie where the offering place was when I walked in here. That's the first thing I thought of. reimbursement. Arkansas currently ranks among the bottom three states for Medicare reimbursement rates, and that needs to change. Right now, the federal government applies a uniform approach to Medicare payments across our state without considering the economic differences between regions. Operating a medical practice in northwest Arkansas is not the same as operating one in the Delta, just as rural and urban areas face different costs and challenges. Yet our reimbursement rates fail to account for these differences. This resolution urges Congress to
reevaluate Arkansas's Medicare payment structure to ensure our health care providers receive fair and competitive reimbursement. When rates don't reflect the actual cost of care, it becomes increasingly difficult to attract and retain the medical professionals our communities rely on. CMS reviews locality designations every three years and we're asking them to give Arkansas the consideration it deserves in this cycle. This is not about seeking special treatment. It is about applying a practical and data-driven approach, just as other growing states have
benefited from. Our reimbursement rate should reflect the reality of providing health care across Arkansas. I ask your support on HCR 1007 to help ensure our state's health care system remain strong and sustainable. Thank you.

We don't really have much control over what an out-of-state does, but I know with ACT is something most people are most familiar with. The SAT is as well. The CLT, I know they have around 280 institutions across the country that accept the CLT. So it kind of depends on where the student wants to go. So, for instance, if we have, you know, thousands of students within the state, but some of them want to go to even a college out of state that accepts only the CLT, they could take that assessment, and we would pay for it in-state.
And then they would be qualified for whatever. so it's kind of putting in a student's option of what they want to take to align with whatever their higher education goals
will be. Okay, and I appreciate that. I just want to make sure that you've got, you
don't have strong counseling at every level of schools and you'd have parents that have a lot of times, especially if they're first generation kids that are going to college for the first time and their parents have no clue or no idea how to navigate the system.
Just FYI, we need to make sure we have robust counseling at every school that says, where do you want to go to school? Like, there's got to be an action plan for post-high school. So, and part of that is counseling because so many of these kids, the reason why I passed this bill to begin with is that you had so many kids whose parents had never gone to college before, had no idea that their kid was supposed to take an ACT, and then they were just super behind the eight ball and could never get to college. So I just want to make
sure as you're working on this amendment or amending the process that you have really good robust
those levels. You'll just follow up with

is about opportunities for our students and being a state where we hang our hat on being the land of opportunity it's it's a great bill this is really pretty simple it mimics what we did with homeschool students allowing them to take part in triple a activities we've had a lot of homeschool students that will no longer be
homeschool students starting next year when they participate in the learns act when it becomes universal and so what this bill says is that if they are now private school students a lot of These co-ops have turned into private schools to be accredited now that they are participating in the LEARNS EFA accounts. So in the rare situations where smaller entities, smaller private school students, they don't have AAA sports and activities, they don't have choir and band, and so this would allow them to participate only in their home public school resident school district,
and it's permissive, and so the public school district would have the ability to allow, they may permit this situation to happen. We also put in where the funding would follow the student to the public school in this situation. So one-sixth of the foundational funding follows the student to the public school to help pay for any needs associated with that option. So it's just about opportunity for any rare circumstances. I will highlight that it will be similar to what we've seen with homeschool students, which is a very small amount of students.
only 96 school districts have any homeschool students participate in AAA activities in their public schools which is about an average of five students in a school district so it's a handful of kids allows them come participate in the band if it makes sense with their family and their schedules and with the funding it should make it easy on both sense in fact I've heard from superintendents how they are excited about this because it's a chance for them to get to engage with students who have not been on their campus a a chance to impress them about their facilities and their engagement on campus.
I've heard from parents how they love having more options, and we've worked with the AAA on this bill. There's no issue. So with that, I

in the Department of Human Services. Senator Irvin you're
recognized. Thank you Madam President, members of the
committee of the Senate. This bill is by far I think one of the most extensive efforts that we've been able to address that is a really critical problem for the state of Arkansas. Systemic and entrenched issues have
existed for decades in the forensic mental health system, almost 30 years to be exact. So there's a long, long wait list and wait times for the Arkansas State Hospital, and 99% of the beds at ASH are dedicated to forensics. There are hundreds of detainees in county jails awaiting forensic evaluations and treatment while their condition is worsening. In the meantime, while these individuals that do have very serious mental health issues inside your county jails getting no treatment, their condition is worsening, but they will have a psychotic episode, and your sheriffs, your jailers, and other detainees are dealing with serious physical injuries and issues.
On the flip side, you have victims that are trying to receive justice. And this has been a tactic that has been used by the defense councils to order mental health evaluations, which has backed up the system. So if you look at the statistics, I think there's 73% of the order, 73% of the orders on mental health evaluations,
the people, the defendants, the detainee is fit to proceed to trial. And so there's this huge backup that has happened. So this legislation is a collaboration of mental health experts, the Department of Human Services, prosecutors and judges what this legislation does it seeks to and to reduce the unnecessary evaluations and ensure that defendants can be evaluated treated and declared fit to proceed and adjudicated a lot faster DHS in addition to this legislation in this policy DHS is adding 16 bed units with the
potential of adding more as I said victims will receive justice quicker as if these cases can be adjudicated faster. So I want to just take a moment and thank Senator Hammer. He sat at the table with me and his daughter and son-in-law, and they gave an incredible testimony as being a victim who kept waiting for that trial and waiting for justice for their daughter, and they shared their story that was very personal.
and so it was incredibly impactful and incredibly powerful and it just makes you understand that folks we stood in here every day with each other but there's a lot that's going on in our personal lives and there's a lot that our families are dealing with back home and I'm just so grateful that Senator Hammer and his family became vulnerable and shared that very public thing that they're going through and so I'm just grateful and this piece of legislation like I said
was a combination of a ton of stakeholders and a lot of work it's a right step forward for the well-being of all of our citizens it's a step in the process and I know we'll have more work you'll see actually two more bills that'll come through public health that are scope of practice bills, but those are to train up extra people that can do these mental health evaluations so we can add to the workforce of the people that are actually going to help
unlogjam the system. So that's what the bill does, and I'd be happy to answer any questions. Questions for Senator

and he has been locked up in a county jail for a long, long time. And that's denying him justice as well. That's right. And how will someone in his situation benefit from Senate Bill 313?
So you're 100% right. There is an individual right now that is 10 days, well, at this point, less than 10 days, short of five years of being in the Washington County Jail awaiting treatment, awaiting evaluation, and awaiting treatment.
This bill is designed to get those evaluations done much, much quicker through the judicial system. For 2023, there were 2,957 orders for mental evaluations at DHS. Again, 76% of those fitness-to-proceed evaluations the defendant was found fit to proceed. But to your exact point, I had a phone call from a Searcy County Jail sheriff
who said, you know, I've had this individual lingering in my county jail now for three years. This is inhumane. We've got to get them help. We've got to get them treatment. And so we were able to get that person to the state hospital. But so often you'll find people that do have severe mental health illnesses and schizophrenia. I have a friend, I told him in committee, some friends whose brother was a severe schizophrenic and, you know, he beat up her husband.
I mean, broke ribs. I mean, it was just horrible. They couldn't do anything other than call the sheriff, you know, and detain him. But that's an individual that is in need of some serious help and their families just can't handle it or deal with it anymore. But the county jail is not necessarily where they need to be. because they are severely mentally ill. So this bill is absolutely designed to get us mental health evaluations done quicker through the judicial system to get justice for everybody involved
and for their day in court to be adjudicated faster so they can get treatment faster. It's a

We talked a lot in the committee about how we just really need more mental health capacity. We need more beds at the state hospital. We need more mental health resources in jail, but also in the community as well.
And just since that was part of the discussion in committee, I just wanted to comment on it. And, you know,
I'll give you an invitation to comment on that as well. Yeah, that's it. Thank you, Senator Tucker, and I
appreciate it. We're still working to clarify a little bit of language on the House side, and I made that commitment in committee. There's a lot of people involved, so we're trying to get prosecutors and defense counsel and judges, the administrative office of the courts all together to figure all that out. But there is a huge, I can't emphasize this enough,
there is a huge huge need for good policy but also supported with additional options for treatment and care outside of a county jail it just the the jailers and the sheriffs the sebastian county sheriff testified and did a fabulous job of the people that are literally lingering in his jail without any treatment, any help, any services. Eighteen of the Sebastian County Jail Sheriff,
18 out of his population, fit this category. So if you think about it from a capacity standpoint of a county jail and how it's built, 18 of those rooms have to be solitary confinement because these individuals cannot be put with the general population. So you have to have 18 cells just for these individuals. And a lot of county jails don't have that capacity. They just don't have that capacity. Plus, I think Senator Clark had some good discussion about solitary confinement.
And when you're somebody going through mental health and mental illness, I mean, think about yourselves. You don't want to be isolated, but we have to isolate them. But that's not necessarily good for their mental health condition, but it is what we have to do. So we've got to get these individuals' help faster. It's just so critical and it's so important. And emphasizing the fact that DHS is adding a 16-bed unit is really, really critical.
And the final thing I'll say is that this is probably the biggest bill that the Dream Big Caucus, our Republican Women Legislative Caucus, worked on and part of our package. And so all these women signed on to this bill. They've done a lot of work in this space. Representative Vaught, Representative Moore Representative Dalby, a ton of people have done a lot of work in this space so I'm just standing here as part of the team but thank you in committee I really appreciated your questions and highlighting this

Rice for running my bill for me in committee. There was this really strange requirement to establish a non-profit corporation in order to obtain a private club permit. It was overly burdensome, and it resulted in the necessity of filing multiple tax returns and other business filings for each business location in the same corporation.
So what this bill does is it eliminates that. It basically just makes it straightforward that if you're applying for this private club permit, you're not required to form a non-profit corporation but shall otherwise comply with all the requirements of the subsection of having your corporate corporation partnership individual or LLC company. So it just eliminates that burden. It was unnecessary and that's what the bills aim

So in order to get that one extra tap room to further expand or be an entrepreneur spirit, you have to upgrade your license into the restaurant brewery at quite an expense, not only to the brewery license itself, but also the permits for the tap rooms. In talking to ABC, there's all kinds of confusion around this. They see no reason why back in the day when this was passed, it wasn't also three tap rooms when you're essentially selling the same product. The main difference between the brewery restaurant and the small brewery is Spiritus Liquors are allowed as a
