great to see you. I, I won't give the entire story, uh, friends, but back in 20014, I was going through a very challenging time politically and a friend of mine was singing at a revival at a little Methodist church. And Cersei County and I got this terrible news on the the way to that revival and the and it was Mike's church that I was going to and that going to that revival that night probably kept me out of jail and the reason why I was able to be elected attorney General, now Lieutenant Governor. So thank you, pastor, for being here today Ladies and gentlemen in the galleries, welcome to your Arkansas State Senate. It is our expectation that each of you will exercise proper decorum and govern yourselves. Accordingly, during today's proceedings without objection, the rules will be suspended and the Senate will dispense with the reading of the journal. The morning hour has now begun. I'd like to recognize Senator King, who will introduce our pages for the day. Senator King.

about 25 years ago, I served on the election commission. I was a Republican back when it was all Democrats and uh one of the big issues that I took on over the years was fighting voter fraud, which we were told for years didn't exist here in Arkansas and it did. Uh, you know, I look at what gerrymandering is the term gerrymandering came from our founding fathers that purposely drew lines for their own purpose and not fairly is that it is no simply no less than trying to manipulate the drawing of a district to change voting here in the state of Arkansas, and it's happened very clearly. If any of you remember Linda Collins who uh went through, they gerrymandered her district and then they gerrymandered our Senate district. So I think the line should be drawn fairly and if If you're going to draw it for your own purpose and have a specific result, it actually impacts every vote for the next 10 years. Now the board of apportionment is made up the governor, attorney general, and the Secretary of State, which makes it very difficult. I've been down here in 2011 when everybody was uh not everybody, people would go down and want their districts drawn for them. You had special interests and it goes down to those three people. So what Senate bill basically does is to say, much like a jury, like when I'm sat on a jury situation, uh, the The evidence that's considered is in a courtroom. This follows basically like a jury system where communication would have to be written electronic or in a public meeting. And basically what it's to do is to stop all the backroom deals, stop all the, the uh uh communication that can manipulate or influence the drawing of a district and make everything public. There's been some communication that they think that this violates free speech. I don't think it does. We have rules and regulations that that go through public meetings and public comment. We have uh free speech is limited here when we limit debate, this would not abolish free speech because anybody can say anything. It would just make it where some of us that's been around Arkansas politics a long time, know what happens when the backroom doors uh get closed and districts are drawn or manipulated or there's purposeful things to do it. When you have these Senate districts drawn and then you have these sprigs and stragglers, as I call them, these little bits and pieces that go out, they're almost Always for a special reason instead of just drawing the lines fairly. If we cannot draw the lines fairly, then how can we trust the process? So with that, I will take any questions. Questions for Senator King. Anyone wish to

free speech argument and state agencies, we've limited free speech. If you want to look at that way, we limited debate. Many times we have to. There's people still lined up to testify. So if that is the reason that some of these people get it free speech, this body and a lot of the actions we've done have limited more free speech than this bill will ever do. This just ends the backroom doors, the personal vendetas and makes a realistics more drawn fairly and brings everything to a transparent process. Thank

But I want to show you before we get started, this is a young man that was at the White House for the speech. Here the United States Secret Service clearance. A picture of his Of his beautiful face right there. And his badge and I've had the privilege of holding this to this young man. I'm going to give that back to him so I don't, I don't lose it, but it was great, great pleasure that I'm here today. With this family. Special place in my heart. My daughter-in-law was actually a state trooper, great state of Texas. And my father-in-law makes it extra special to me to be able to read this. Had brain cancer several years ago. So with great pleasure I'm going to read. Read this resolution is to honor DJ Daniel for his fighting his brain cancer and support naming him an honorary state Capitol police officer and to proclaim March 17th, 2025 at DJ Daniel Day in the state of Arkansas. Don or DJ Daniel for his fight against brain cancer and supporting naming him an honorary state Capitol police officer and to proclaim March 17, 2025 as DJ Daniel Day, the state capital of. So I read that twice, I did that intentionally. I want y'all to understand the significance that this has not only to the state, but what it means to this young man here. Whereas 13 year old DJ Daniel of Houston, Texas has had a lifelong dream of becoming a police officer, and whereas in 2018, DJ Daniel was diagnosed with terminal brain cancer and given a maximum of 5 months to live. And whereas, however, in spite of his diagnosis, DJ Daniel is still fighting today and has not let his diagnosis stop him for pursuing his passion for public service and law enforcement, and we're asked DJ Daniel recently named an honorary United States Secret Service agent, which is what y'all saw just a while ago. My President Donald J. Trump and his joint congressional speech and Whereas BJ Daniel has become a face that is known and loved across the world, whereas the state of Arkansas commits to supporting and praying for DJ Daniel along with his family as he continues to fight brain cancer and whereas on Monday, March 17th, 2025, the Secretary of State will officially name DJ Daniel an honorary state Capitol police officer. Now, therefore, be it resolved by the state of the ninety-fifth General Assembly of the state. of Arkansas that the Senate Thank DJ Daniel for his passion for public service, honor him for his strong fight against cancer, supporting, naming him as an honorary state Capitol police officer and proclaimed March 17, 2025 at DJ Daniel Day in the state of Arkansas. Be it further resolved that upon adoption, a copy of this resolution be provided to Mr. Daniels' father. Of The, the, the oldest, Daniel by the secretary of the Senate. Madam President. Senate Bill 104 amends the PBM licensure Act to protect patients from unfair and deceptive trade practices performed by PBMs. It returns patient rights back to the patient to speak directly with their health care plan in regards to PBM issues, prevents ghost networks. Um, also close the gaps to exploit the profit over patients. Patients can't even get an exception to fill locally in some cases, sometimes they have to use a mail order and in this corrects that issue. It ensures adequate access to pharmacy services as intended and designed by underlying health benefit plans. This bill has the support of all major healthcare stakeholders in Arkansas. Thank you, Governor. Members, as we know right now our, our, um our primaries are different in presidential cycles versus non-presidential cycles. This just makes it consistent. They're both having the primaries in March. We've seen what a benefit it is in our presidential election cycles to have those primaries at that time and uh that's it. Look, we, we have a low turnout in our election cycles, hopefully consistency will help with that. I'm happy to answer any questions. Questions for Senator Hester, Senator Mark Johnson, you're recognized. Thank you, Madam President. Senator Hester, now when does this mean we have to file prior to the primary election. Are we still filing Would this make us have to still file approximately a year before the subsequent general election. That it would be approximately a year, so we would file in November for a March primary. That's right. Well, this thing keeps moving backwards and backwards. I can remember, of course, I'm older than you, but I can remember when the primaries were end of July and the runoff was in August, and the general election was in November, and instead of having a year of, of politics, not that I don't like politics, but is there, can you tell me what your real motivation for moving this up? I mean, couldn't we just move it forward or I mean, I know that We have to select our presidential delegates in the presidential years, but it seemed like otherwise, I mean, I would rather off in the gubernatorial years, maybe go the other direction. Could you tell me what your thought process of why we would want to keep it such a such a long season. Sure, consistency, that's it. We know that consistency matters. We, we, we have said that it, it, it matters to us to have our presidential elections at this time, so that, so that Arkansas has more of a more presidential candidates and I suspect in 4 years there'll be a lot of candidates from both sides. We hope they come here and campaign in the state of Arkansas and that we're very relevant during that process, uh, and if we value that and we want consistency, then March, March is where we land at. OK.

Hester, for allowing me to expand a little more on this. Uh, I like the idea of a compact election cycle, you know, we, we keep stretching these things out, and I think I, I, I'm gonna vote present on the bill, mainly because I'm not against it per se, but I can't be for it. It's more of the fact that we have this. Situation in Arkansas where we hold our first round of election for nonpartisan judicial races at the same time as our primary. And that basically would mean that someone wants to run for judge, they pretty well have to stop their law practice and spend a year, uh, campaigning and, and not working for
▶ Play Suggest a correction Report an error
Senator Mark Johnson Unverified 1:09:34
a living. uh, and as we know, there's efforts and and even constitutional amendments where we'll be looking at at making Judge uh judicial elections, uh, partisan again. In that case, then, you know, what would be appropriate to have it in a primary, but, uh, until that, until we change it, I, I just, I have a problem with us throwing that in there. So it gets a little complicated and as I said, I remember when the primary was in July and the runoff was in August and the general elections in November and, and it was a shorter period of time to keep the voters' attention, but Senator Hester's Absolutely right. Arkansas needs in the presidential years to be able to have an early primary so we can have an impact on who our nominees for both parties are, uh, and our party people can participate. So I just want to speak on that and uh just to kind of plant that seed in your mind as we're sitting these election dates. This might be something we might want to continue to, to look at in the future. Thank you for your indulgence, Senator Hester, and thank you, Madam President. Thank you, Senator Johnson.

President. Members, I, I wanna start off, uh, saying thank you. I want to thank the General Assembly for everything that this body and our neighbors at the house and are sitting governor gives to veterans and thank and thankfulness for their service. Uh, as I presented this in committee, several members asked the most profound question. It's a question that I, as a, as a veteran often ask my veteran associations whenever they have asks of the General Assembly, which is how much is enough? If you keep coming back to the well, there's got to be a point which the General Assembly says no. So with that, my first thing is, is to really want to apologize that this is yet another ask. Um, I am very sensitive whenever I make these ass because I know that there is a cost to everything we give to our veterans, and for me, something as simple as a license plate being waved that I can put my Marine Corps emblem on and and waive the $35 a year. That while it's just $35 it's impactful that the General Assembly recognizes the service that I've given because it is all About time. So what this bill attempts to do is recognize our employees of the state for their years served. It doesn't give more leave to that individual, more than just a state employee that doesn't have military service, but it allows them to have their time recognized to be aware of to to have your leave gained accrue faster. So the example is if you are a 2-year state employee by the OPM Sanders Office of Personnel Management. You were awarded 8 hours. per month. That's 12 days a year. Everybody gets that. In my case, if I were to become a state employee, I have 5 years of military service, so they would credit those 5 years to my time in or time in service to the state and therefore I would be able to bump up in the years 4 through 5 and be awarded 10 hours of pay period, which is an extra 3 days per year. I think the question is asked is it's just, it's just leave. I mean, there is, there's obviously going to be a cost to the state, whether that is somewhat negligible because you can only accrue up to 240 hours of leave and then it rolls off and the rest of it falls off, and then whenever you go to separate from service or to retire from service, you could be compensated for that time. But whether you gain that as an advantage for the accrual system where you were gonna gain it naturally. That's not the point. The point is to attract and attain military members. to our state workforce, because there's several members of our workforce that want to serve our state, but they also have the very uh easier ability, I say to go to the federal government because the federal government will award and recognize that time. And so this bill attempts to allow our state agencies to offer this additional perk to our employees in in an attempt to retain Well trained, well-disciplined members. I remember one of my first jobs in the federal government and my boss said, uh, I, I didn't hire you because of what you knew. I hired you because I collect marines. And Marines are able to look forward to loyalty and dedication and just plow the trail and you'll get the skills that you need, but at the end of the day, I look better in management if I hire people like you. And so that is the ability that I'm trying to give our state workforce is just to keep, retain and track our National Guardsmen, our military members, our reserve members. It doesn't allow them to double dip if they're already working for the state and they're doing other, other activities that would otherwise benefit. This does not allow them to double dip. They keep their just what they're earning naturally for the state. So with that, I will be glad to answer any questions. Questions for Senator Bryant. Senator Love, you're recognized.

Thank you, man. Um, and Senator Brown, I haven't, I haven't just in depthly look at this bill, but I want to just pose a scenario to you and just so I can think through this. So say for instance I'm a service member, I just retired. I have 20 years. Of service. So I go and apply to DHS or whatever other state agency there is. So, are you saying that somebody with 20 years of service could come in and begin instead of them the cruel time, the cruel time for state employee, you get, I guess 2 weeks a year, they would go up to where somebody with 20 years of service would begin to collect and crouton. Is that, is, is that basically what you're saying? 20 years of service instead of 8

Again, it's, it's the easy vote to say yes and there is no, there's nothing that says that you are considering the impact to our state coffers. You're not voting against against veterans against this bill at all. You were just, you're voting as good stewards as what you were sent for to do, but I, I would argue that the impact to our state workforce. is far better having the attention and the attraction of our military veterans then than not. The director of production and conservation of the oil and gas commission, the state geologist and the director of the division of Environmental Quality. What the bill does is it modifies the membership. Of the Natural Resources Committee from 9 current members to 7 and it removes the energy and environment's redundant representation. The bill also consolidates its three positions down to 1, which is the Secretary of Energy Environment or his or her designee and the bill adds that all members and appoint to a designee to the committee, um, so that they can meet and get their business done. was just here, or at least it does to me, but the year is actually 2025, so we're, we're halfway to the next census at this point in the 2020 census, Arkansas was the most undercounted state in the United States. Number one, and over the 10 year period between 2020 and 2030, that's going to cost us over $5 billion in federal dollars to the state, including to some of our most vulnerable populations. So the purpose of this bill is to get ahead of that for the next census. It will form a committee. There's no, no money involved, but it forms a committee with agency heads or their designees along with members of the private and nonprofit sectors to study what went wrong in the 2020 census, how we can do better in the 2030 census and to make recommendations to the governor and to ALC about how we can perform better in the 2030 census, and I'm, I'm happy to take any questions. quick, won't take a second. I got pinned in the tunnel this morning because they had police cars in front of me and behind me, couldn't get out, so I got out and walked around front, and there is a whole group of police officers and DJ was standing there in the midst and I walked over. He grabbed my hand and he said, Are you George Washington? And I said, DJ, we, we don't have time to discuss this here. I'll talk to you later about it. But anyway, he is a special kid that is, thank you, uh. That's a hell for bringing. Anyway, Sam, Senate Bill 24 simply stipulates that the property owners who fund the improvement districts have the right to comment on any agenda item prior to the action of the board of all meetings to provide meaningful input to the neighbors and also clarifies the quarterly meetings, uh, that shall be held each quarter of each calendar year requires the meeting agendas we provided to property owners prior to the meeting day and time. Uh, it also, uh, the intent is simply to require the improvement districts commissioner to be more accountable, transparent, and responsive and more respectful to the property owners. you, Madam President. Members, this is a bill that's an attempt to address a growing shortage of accountants and CPAs, licensed CPAs, more specifically, uh, I talked to the Office of Personnel Management, and we have about 166 accounting and and and CPA type positions that are currently vacant and in in our offices here in the state, but the thing that should scare you is that, uh, according to the American Institute of CPA. that it's estimated that approximately 75% of all public CPAs are set to retire within the next 15 years. And so this bill is meant to address that pipeline issue and that shortage, uh, uh, the main part of it, I'll talk about more, but for example, in, in the first section of the section 306 1712306. The state board has a pipeline initiative whereby they're going to assist those Arkansas. saw applicants, Arkansas resident applicants, uh, with some of the exam fees if you're a college student, you can just get out of college and you have to pay to take these these exams. It's a standard exam. That's not going to change with this law, but it helps with that. So that, that will help and hopefully encourage students to actually sit for the exam. The, the next one, which is section 309. That's the meat of it, uh, This particular plan offers an alternative pathway to licensure, um, as it is currently, uh there are uh There's one path to licensure and that is you get your bachelor's degree, then you get another 30 hours. It doesn't have to be even in accounting or tax, and then you have 150 hours and you can sit for the licensing of the CPA exam. Again, this is not going to change the exam. What it does allow you to do is you graduate, you go to work, you get in the in the uh the work field, and then you get that 30 hours in lieu of that as an alternative. Not taking the other away, you can uh you can sit uh for the exam after a year of work experience as opposed to another year of of classroom that may or may not be specifically addressed in accounting and tax. So that's that, that there's probably a high percentage that were licensed prior to the change to the 150 hour rule that our CPAs, they got it that under that track, which is 120 hours and then the work. Uh, there's a couple of other minor provisions in there, the one substantial equivalency, uh, basically all this is doing there is taking the any changes to the standard uniform Accountancy Act model language that comes periodically and moving it from uh uh into a board rule so we can get those implemented faster, which again allows more CPAs to enter in the workforce quicker if they're moving. from another state or something. And then the last one is just some clarification language around quality of, of uh reports and it just defines what practice review versus quality review. Again, less to do about the pipeline and with that, I'll be happy to entertain any bean counter jokes or any questions that you guys

lot and I just want to really thank Senator Sullivan and Senator Bryant. We pulled it back to the committee and made some amendments and changes to this bill, and if you'll see the bill, um, that were requested, we really tried to put some clarifying language into the fees and fines of on this piece of legislation and then also make sure that any training is not mandated by any national group or a state group, the reason for the bill again is because parents have come to us or came specifically to Representative Clowney. She worked really hard on this bill. Because there is no Arkansas presence to be able to submit a complaint about what may or may not be happening with a behavior analyst. Um, what these folks do primarily is work with potentially children that have special needs, but if you have autism, it's not necessarily that you need a psychologist or a psychiatrist, but you actually need a behavioral analyst that's studying and understanding your behavior and then identifying that and trying to make some intentional correction. so that they can become more functioning and in our world. Um, and so it's a very, very important role that these people play, particularly with kids that have autism and um and and just help them as a as a god. The problem now is that this place is in Denver that has the certification, but we have no Arkansas presence uh for these parents if they have a bad or poor outcome and need to register complaints. So that's, that is, that is the purpose. behind the bill, and again, I want to thank Senator Sullivan for his work, Senator Bryant for his work with me on the bill, and I'd be happy to answer any questions, any questions for Senator Urban. Thank you, Madam President, and I want to thank Senator Irvin for making some corrections that we noted in the bill last time it was brought up, and I think they were just technical things that maybe the drafter had made a mistake and I appreciate the fact that you corrected those, the reason I am going to oppose this bill is that I'm disturbed by the trend of finding new professions that we state of Arkansas must regulate. I think we need less regulation, not more. I call in to your attention that the, I won't call it a battle, but the issue a few years ago where we had a lady who was a cosmetologist that had a young child that was handicapped, that was helping in her beauty shop by washing people's hair and suddenly, well, this was just a regulatory tempest in a teapot. Uh, and I'm thinking, why would we even worry about something like this. And I think it's the same thing. I think behavior analysts are, are probably good people. They probably have a good service, but when we start creating these regulatory schemes. It's just the thing just tends to grow and grow and grow, and while in a lot of ways, you know, Arkansas it's a lot to be proud of when it comes to regulatory law, we're, we've kind of up on the upper end of this, we probably regulate more entities than most of our uh constituents would even believe. So, uh again, I'm not picking on the behavior analysts. They're probably good people doing a good job, but if they're psychologists and they're already registered under psychologists. I just don't, uh, see a need to continue to add layer upon layer upon layer of regulatory regimes in our states. So for that reason, I would ask for a no vote. Thank

Senator Johnson and for Senator Clowney, but that happens sometimes. We met several times on this bill, folks, what happens, these national groups that offer certification, they blow in the wind, and they are one time they're 4, next time they're against it, and they may be this way one time and that way next time, depending on what our national, who the president is essentially. This bill gives the state of Arkansas sovereignty over those issues. That's a big deal. When we give up sovereignty to the national group, that's a problem. And those those national groups sway here and there. State of Arkansas does too. However, that's what we do and this bill gives us a legislature sovereignty over the licenger of these folks. Again, it's my pleasure to speak for the bill, uh, work with Senator Clowney. She met made multiple amendments and the senator did amendments to the bill. I think it's a good bill. I hope you'll vote for it. Be be glad to answer any questions. Thank you.

This will be especially helpful during a disaster, you know, if, if we have the, you know, the big earthquake on the east or have a, a tornado on one of the, you know, around the edges of the state, it, it would give the ability for EMS and any of our surrounding states to come in and help, um. This also on page 14, it allows Department of Health access to the compact database, giving even more visibility to potential issues with EMS people who are located outside Arkansas. Madam President. The circuit clerk is the custodian of the public records. In recent years, out of state third parties have persuaded largely inexperienced circuit clerks to delegate that authority to them. Those third parties then watermark the documents as their own versus the public record that they are. That allow access to the documents for profit. This bill reinforces the circuit clerk's custodial role and brings the current statute language into the electronic age. Previously, the statute contemplates mechanical means, and this bill contemplates electronic access. The Arkansas Land Title Association, Arkansas Association of Counties and the County circuit clerk leadership agreed to this bill. I'd appreciate a good vote.

President. This is a little old bill. It's only 900 pages, so don't, we're not doing anything sneaky in there. Now this is a bill that has no substantive changes to the law. This is a Title 19 recodification bill. It's technically not a technical corrections bill, but it did come out of the code revision commission. What happened was Title 19 really got overly complicated. There were 81 sections dealing with Arkansas procurement law. So the code revision commission took it upon itself to reorganize Title 19 and do it in a way that makes sense given all the changes that have occurred to Title 19 over the years. We created a working group to recodify Title 19. It included people from the Code Revision Commission that the governor's office, the Attorney general's office, the Treasurer's office, the auditor's office, legislative audit, DFNA, the transformation and shared services, the Claims commission, the ethics Commission, and the Bar Association. They all agreed on all of these changes that came back to the Code Revision Commission, the Code Revision Commission, again, the legislators on there are Senator Bryant. myself and then also Representative Matthew Shepherd and Jimmy Gazaway Representative Shepherd is the House sponsor of this bill. Again, no substantive changes. Mainly what it does is it reorganizes Title 19 with new subtitles, so they'll like material can be kept together. It reorganizes subchapters dealing with Arkansas procurement law, and then it transfers certain material from Title 19 to other more appropriate titles of the Arkansas code, and then it might change a comma here or there, but again, there's, there's no substantive changes to the law. I'm happy to answer any questions. Yeah Are there any questions? Seeing them, Would anyone like

up a framework for what is being utilized by a lot of employers in our state, um, basically it has a framework for those who are needing their wage or their paycheck a little bit faster, um, and so they're able to draw on what they've earned, basically in advance only on what they've earned, um, and so that framework that we're creating in this bill basically has a lot of consumer protection because right now, This doesn't exist in the state of Arkansas, at least this this framework. So we're trying to make sure that there's consumer protections allowed um with this, and so I think what's also important to note is This is a mechanism that people can use moderate to lower income people can use, so as not to get into debt, not to run up credit cards, not to do a lot of things that are engaging in predatory practices that can harm them or their finances down the road. that's a great question. Thank you for that. So this is not like a payday lending type deal. This is strictly through their employer where they're, their, their employer can use a third party or even themselves to advance them a wage that they've already earned. So this is not a loan, this is not anything like that, OK, and so is there a fee for for this so all of these companies as I'm aware of, have a free option unless you need it a little bit quicker, and then I think the, the uh highest fee is like $3.50 if you want your money, if you need it a little bit faster, but all of them offer a free uh service to get your wage over like 1 to 2 day period. ▶ Play Suggest a correction Report an error
Senator Joshua Bryant Unverified 2:12:58
Uh, House Bill 1548. This is the repeal of the data and transparency panel of 2015 back in 2015, Meeks and Senator English put forth a proposal to try to gain access into the silos of the different divisions with the data that they keep and protect inside their own IT systems. Examples would be workforce and corrections or or workforce and education, so that panel was made up largely of executives from all the different agencies, um, fast forward to 2025, uh executives don't need the high level engagement that was necessary back in 2015 up today. What they have is data stewards that are aligned that work those day to day operations. So what this bill does is repeals the data transparency panel panel, uh places all those activities inside. DIS data information systems division, and then they manage and keep all that data and work on the programs to make sure that we are not duplicating work across the state. One of the benefits of this was the output of the AR data, which you've probably seen the little logo and icon on our individual executive agencies, and they manage the information and data that flows between the agencies. So with that, I'll be glad to take any questions.
