about 25 years ago, I served on the election commission. I was a Republican back when it was all Democrats and uh one of the big issues that I took on over the years was fighting voter fraud, which we were told for years didn't exist here in Arkansas and it did.
Uh, you know, I look at what gerrymandering is the term gerrymandering came from our founding fathers that purposely drew lines for their own purpose and not fairly is that it is no simply no less than trying to manipulate the drawing of a district to change voting here in the state of Arkansas, and it's happened very clearly. If any of you remember Linda Collins who uh went through, they gerrymandered her district and then they gerrymandered our Senate district. So I think the line should be drawn fairly and if If you're going to draw it for
your own purpose and have a specific result, it actually impacts every vote for the next 10 years. Now the board of apportionment is made up the governor, attorney general, and the Secretary of State, which makes it very difficult. I've been down here in 2011 when everybody was uh not everybody, people would go down and want their districts drawn for them. You had special interests and it goes down to those three people. So what Senate bill basically does is to say, much like a jury, like when I'm sat on a jury situation, uh, the The evidence that's considered
is in a courtroom. This follows basically like a jury system where communication would have to be written electronic or in a public meeting. And basically what it's to do is to stop all the backroom deals, stop all the, the uh uh communication that can manipulate or influence the drawing of a district and make everything public. There's been some communication that they think that this violates free speech. I don't think it does. We have rules and regulations that that go through public meetings and public comment. We have uh free speech
is limited here when we limit debate, this would not abolish free speech because anybody can say anything. It would just make it where some of us that's been around Arkansas politics a long time, know what happens when the backroom doors uh get closed and districts are drawn or manipulated or there's purposeful things to do it. President. Members, I, I wanna start off, uh, saying thank you. I want to thank the General Assembly for everything that this body and our neighbors at the house and are sitting governor gives to veterans and
thank and thankfulness for their service. Uh, as I presented this in committee, several members asked the most profound question. It's a question that I, as a, as a veteran often ask my veteran associations whenever they have asks of the General Assembly, which is how much is enough? If you keep coming back to the well, there's got to be a point which the General Assembly says no. So with that, my first thing is, is to really want to apologize that this is yet another ask.
Um, I am very sensitive whenever I make these ass because I know that there is a cost to everything we give to our veterans, and for me, something as simple as a license plate being waved that I can put my Marine Corps emblem on and and waive the $35 a year. That while it's just $35 it's impactful that the General Assembly recognizes the service that I've given because it is all About time. So what this bill attempts to do is recognize our employees of the state for their years
served. It doesn't give more leave to that individual, more than just a state employee that doesn't have military service, but it allows them to have their time recognized to be aware of to to have your leave gained accrue faster. So the example is if you are a 2-year state employee by the OPM Sanders Office of Personnel Management. You were awarded 8 hours. per month. That's 12 days a year. Everybody gets that. In my case, if I were to become a state employee, I have 5 years
of military service, so they would credit those 5 years to my time in or time in service to the state and therefore I would be able to bump up in the years 4 through 5 and be awarded 10 hours of pay period, which is an extra 3 days per year. I think the question is asked is it's just, it's just leave. I mean, there is, there's obviously going to be a cost to the state, whether that is somewhat negligible because you can only accrue up to 240 hours of leave and then it rolls off and the rest of it falls off, and then whenever you go to
separate from service or to retire from service, you could be compensated for that time. But whether you gain that as an advantage for the accrual system where you were gonna gain it naturally. That's not the point. The point is to attract and attain military members. to our state workforce, because there's several members of our workforce that want to serve our state, but they also have the very uh easier ability, I say to go to the federal government because the federal government will award and recognize that time.
And so this bill attempts to allow our state agencies to offer this additional perk to our employees in in an attempt to retain Well trained, well-disciplined members. I remember one of my first jobs in the federal government and my boss said, uh, I, I didn't hire you because of what you knew. I hired you because I collect marines. And Marines are able to look forward to loyalty and dedication and just plow the trail and you'll get the skills that you need, but at the end of the day, I look better in
management if I hire people like you. And so that is the ability that I'm trying to give our state workforce is just to keep, retain and track our National Guardsmen, our military members, our reserve members. It doesn't allow them to double dip if they're already working for the state and they're doing other, other activities that would otherwise benefit. This does not allow them to double dip. you, Madam President. Members, this is a bill that's an attempt to address a growing shortage of accountants and CPAs, licensed CPAs, more specifically, uh, I talked to the Office of Personnel Management, and we have about 166 accounting and and and CPA
type positions that are currently vacant and in in our offices here in the state, but the thing that should scare you is that, uh, according to the American Institute of CPA. that it's estimated that approximately 75% of all public CPAs are set to retire within the next 15 years. And so this bill is meant to address that pipeline issue and that shortage, uh, uh, the main part of it, I'll talk about more, but for example, in, in the first
section of the section 306 1712306. The state board has a pipeline initiative whereby they're going to assist those Arkansas. saw applicants, Arkansas resident applicants, uh, with some of the exam fees if you're a college student, you can just get out of college and you have to pay to take these these exams. It's a standard exam. That's not going to change with this law, but it helps with that. So that, that will help and hopefully encourage students
to actually sit for the exam. The, the next one, which is section 309. That's the meat of it, uh, This particular plan offers an alternative pathway to licensure, um, as it is currently, uh there are uh There's one path to licensure and that is you get your bachelor's degree, then you get another 30 hours. It doesn't have to be even in accounting or
tax, and then you have 150 hours and you can sit for the licensing of the CPA exam. Again, this is not going to change the exam. What it does allow you to do is you graduate, you go to work, you get in the in the uh the work field, and then you get that 30 hours in lieu of that as an alternative. Not taking the other away, you can uh you can sit uh for the exam after a year of work experience as opposed to another year of of classroom that may or
may not be specifically addressed in accounting and tax. So that's that, that there's probably a high percentage that were licensed prior to the change to the 150 hour rule that our CPAs, they got it that under that track, which is 120 hours and then the work. Uh, there's a couple of other minor provisions in there, the one substantial equivalency, uh, basically all this is doing there is taking the any changes to the standard uniform
Accountancy Act model language that comes periodically and moving it from uh uh into a board rule so we can get those implemented faster, which again allows more CPAs to enter in the workforce quicker if they're moving. from another state or something. And then the last one is just some clarification language around quality of, of uh reports and it just defines what practice review versus quality review. Again, less to do about

We pulled it back to the committee and made some amendments and changes to this bill, and if you'll see the bill, um, that were requested, we really tried to put some clarifying language into the fees and fines of on this piece of legislation and then also make sure that any training is not mandated by any national
group or a state group, the reason for the bill again is because parents have come to us or came specifically to Representative Clowney. She worked really hard on this bill. Because there is no Arkansas presence to be able to submit a complaint about what may or may not be happening with a behavior analyst. Um, what these folks do primarily is work with potentially children that have special needs, but if you have autism, it's not necessarily that you need a psychologist or
a psychiatrist, but you actually need a behavioral analyst that's studying and understanding your behavior and then identifying that and trying to make some intentional correction. so that they can become more functioning and in our world. Um, and so it's a very, very important role that these people play, particularly with kids that have autism and um and and just help them as a as a god. The problem now is that this place is in Denver that has the certification, but we have no
Arkansas presence uh for these parents if they have a bad or poor outcome and need to register complaints. So that's, that is, that is the purpose. behind the bill, and again, I want to thank Senator Sullivan for his work, Senator Bryant for his work with me on the bill, and I'd be happy to answer any questions, any questions for Senator Urban. I think we need less regulation, not more. I call in to your
attention that the, I won't call it a battle, but the issue a few years ago where we had a lady who was a cosmetologist that had a young child that was handicapped, that was helping in her beauty shop by washing people's hair and suddenly, well, this was just a regulatory tempest in a teapot. Uh, and I'm thinking, why would we even worry about something like this. And I think it's the same thing. I think behavior analysts are, are probably good people. They
probably have a good service, but when we start creating these regulatory schemes. It's just the thing just tends to grow and grow and grow, and while in a lot of ways, you know, Arkansas it's a lot to be proud of when it comes to regulatory law, we're, we've kind of up on the upper end of this, we probably regulate more entities than most of our uh constituents would even believe. So, uh again, I'm not picking on
the behavior analysts. They're probably good people doing a good job, but if they're psychologists and they're already registered under psychologists. I just don't, uh, see a need to continue to add layer upon layer upon layer of regulatory regimes in our states. So for that reason, I would ask for a no vote. Thank

In recent years, out of state third parties have persuaded largely inexperienced circuit clerks to delegate that authority to them. Those third parties then watermark the documents as their own versus the public record that they are.
That allow access to the documents for profit. This bill reinforces the circuit clerk's custodial role and brings the current statute language into the electronic age. Previously, the statute contemplates mechanical means, and this bill contemplates electronic access. President. This is a little old bill. It's only 900 pages, so don't, we're not doing anything sneaky in there. Now this is a bill that has no substantive changes to the law. This is a Title 19 recodification bill. It's
technically not a technical corrections bill, but it did come out of the code revision commission. What happened was Title 19 really got overly complicated. There were 81 sections dealing with Arkansas procurement law. So the code revision commission took it upon itself to reorganize Title 19 and do it in a way that makes sense given all the changes that have occurred to Title 19 over the years. We created a working group to recodify Title 19. It included people from the Code Revision Commission that the governor's office, the Attorney general's office, the Treasurer's office, the auditor's office, legislative
audit, DFNA, the transformation and shared services, the Claims commission, the ethics Commission, and the Bar Association. They all agreed on all of these changes that came back to the Code Revision Commission, the Code Revision Commission, again, the legislators on there are Senator Bryant. myself and then also Representative Matthew Shepherd and Jimmy Gazaway Representative Shepherd is the House sponsor of this bill. Again, no substantive changes. Mainly what it does is it reorganizes Title 19 with new subtitles, so they'll like material can be kept together.
It reorganizes subchapters dealing with Arkansas procurement law, and then it transfers certain material from Title 19 to other more appropriate titles of the Arkansas code, and then it might change a comma here or there, but again, there's, there's no substantive changes to the law. This is the repeal of the data and transparency panel of 2015 back in 2015, Meeks and Senator English put forth a proposal to try to gain access into the silos of the different divisions with the data that they keep and protect inside their own IT systems. Examples would be workforce and corrections or or workforce and education, so that panel was made up largely of executives from all the different agencies, um, fast forward to 2025, uh
executives don't need the high level engagement that was necessary back in 2015 up today. What they have is data stewards that are aligned that work those day to day operations. So what this bill does is repeals the data transparency panel panel, uh places all those activities inside. DIS data information systems division, and then they manage and keep all that data and work on the programs to make sure that we are not duplicating work across the state. One of the benefits of this was the output of the AR data, which you've probably seen the little logo

commissioner. So the first section amends Arkansas Code 23-67-304. To remove the requirement that the workers Arkansas workers' comp insurance plan maintains a physical office in the state as
far as the insurance commissioner knows, nobody has ever actually no citizen has actually gone to the office. This section 2 adds a foreign reciprocal reciprocal insurer to 23-70-110, which currently requires domestic reciprocal insurers to post a bond with the insurance commissioner, a foreign insurer means one that is outside the state but does it's located outside the state, but it does business. within the state, um, Section 3 domestic insurance companies are examined every 5 years. This
moves hospitals in line with that. Section 4, amends Arkansas 23-79205 allows for service of process against an insurer in the manner provided by Rule 4 of the Arkansas Rules of Civil Procedure. This amendment simply allows for service of process consistent with the way corporations are normally served in Arkansas and then section 5, Arkansas code 23-79501, which created the Arkansas Comprehensive Health Health Insurance pool, a nonprofit legal entity that provided
health care coverage to persons that could not obtain coverage due to preexisting conditions.
