Um, so this bill, I know we discussed during learns that once we implemented EFAs and allowed all the different groups to participate, that we would probably need to come back and Uh, modify some things, tighten some things up, just based on how the program was going, make some changes where we saw that we needed to make improvements. So that's what this bill is about making improvements to what we have in place with EFAs, um, so it does a few different
things. It defines what a co-curricular is it defines it as arts, music, and STEM. It updates the qualifying expenses, what does qualify, what does not qualify. And it allows the department to collect money when there has been evidence of fraud, so they're able to go back and collect those funds when there has been fraud. Um, it also says that 25% of the funds, um, allocated to a student can be used for transportation, up to
25% can be used for extracurriculars, um, so we put some parameters around that just to ensure that money was actually going um towards education. Related items, um, and it put in a window of when parents can apply for the EFA funds that ends May 1st, um, which is a month before school choice applications and happy

Um, I was fairly frustrated in committee yesterday with this bill that was dropped the end of last week, and then a large amendment was added in committee
trying to get through it, um, it did help a little bit with a few of the issues uh that were, uh, Quite a bit throughout the bill, so help narrow down some of my specific objections, but
conceptually, Let me go through a couple of things on See here, just, just in relation
to um we, we have what's called education freedom accounts. The middle word in education freedom
accounts is, is freedom. We, we said a couple of years ago that we would trust parents with the ability to to for the dollars to follow their kids and for them to make educational choices. We determine what eligible expenses are that they can use those funds for and then within that they are responsible for Making sure that their kids are getting the education that they need, utilizing those funds. Now, if we want to put parameters on, on things, obviously we can do so. Um, but at the same time, we
also send a foundation funding to uh Schools that is unrestricted and I don't always agree with how they allocate those funds at a regular traditional public school with related to sports activities and extracurriculars, but sometimes those expenses might exceed these thresholds that were in this bill. Um, so that's,
that's one point to consider. Specifically on page 4 lines 8 through 10. This is uh defining homeschool in this
section and then if you go to page 6 of the bill. Section 4 of the bill, it further talks about um The applicant and whether they attend a private school or file a notice of intent to homeschool and if you go to page 7, it talks about an applicant changes from one participating school to another participating
in school, a homeschool to participate petting school or participating school to a home school, it
seems to start delineating and differentiating between different classes of students, and I thought EFAs were actually the class of students that we're talking about here in the fact that We're funding education freedom accounts and then they get to decide whether they're going to use those funds to buy curriculum and have an a la carte educational expenses, or are they going to go to a private school? Are they going to go purchase uh uh educational services from the local public school district, how they are
going to allocate those funds for the education
of their student is what the point of the education freedom account was for, and then
Finally, um, it talks about account closing on page 6 if a participating student is expelled from a participating school. So if, if a student gets expelled from a school, uh, their account will close. Well, there might be some, some more stringent requirements at a particular school that they got
expelled from, but we're going to shut them out from the program, if, if they go and are are expelled from that. particular school choice program, they won't have access to these funds, they'll have to go back into a traditional public school setting at that point, uh, another school, another private school, another option for them, utilizing these funds would be off the table. So for these reasons, um, I'm opposed to the bill continuing to be opposed to the bill. This thing needs to have a little bit
more vetting than the last few days of session. should have probably been over the course of the

They've started to open up, open up and say, OK, well, we're going to tip our toes in the water, see how this goes, and as soon as they first year, this is gonna be the first year it's available. They start to get on the bus, so to speak, or like, oh, let's change the rules on so What I'm saying is it needs to be done in a more thought out, methodical way over time like we do with anything else, put a pause in this for the next couple of years, take a look at it and uh uh like I said, those

you want to close, Senator Davis, you recognized clothes. Thank you, Mr. President. I'll speak to a few of the questions, um, Senator Payton, your question on the 50% on travel and sports. No, we don't. No schools doing that. In fact, based on the funding matrix, we're getting 72
$72 per student to schools in the matrix for extracurricular activities. This would allow up to 25%. We had before the amendment said 16 funding, it's sort of to mirror the Tim Tebow law that we had years ago, right? If you homeschool, but you go to a public school or whatever to take a class, um, or do participate in extracurricular, then once 6 of the funding follows, because they, the school is educating in that class. So that's originally what we had, but in getting feedback and
people saying that's too narrow, we should allow these students to do more. We just said 25%. So, I mean, the majority of the money should be going to educational expenses. Now, I feel like it's fair to say that extracurriculars do factor in the educational experience. So I think that's fair, but what I want to say to your, to your question is Right now, they could spend 100% of the funds that we give in EFAs on extracurriculars or on travel.
If they buy, you know, some curriculum, you can get free homeschooling curriculum if you buy, you know, $1000 homeschooling curriculum. That means you can use the other $6000 on transportation alone. Right now, that's how it is. So because there are no, there's no guidance and no, you know, caps for lack of a better word, within uh the EFA program on what they can spend money on, and that's one of the adjustments that we need to make. We need to ensure that
going forward, we are spending money on educational materials and tools. So if you, if you think that that is too much, then I would say I think you're for this bill on that issue alone. Because right now they can do 100%. They could spend $7000 on baseball lessons right now if they want to, cause there's no cap within it, OK? So this is trying to rein it in to do something that makes a little bit of sense. I want to speak to the expelled part in closing the student's account. Right now in EFAs, when you open an account,
it stays open. Until you graduate. Doesn't mean you have to use it the entire time, but it just stays open with your name. If you're expelled, like the bill says, your account is closed. Guess what you can do if you want to continue participating in EFAs. Go online and register for a new account. This just doesn't let them keep it open if you're in 6th grade and you get expelled or you, you know, then you can't just keep
this account open for the next 6 years. They kick you, they kick you out, shut your account down, and then if you want to go back to a different school the next year and participate in EF EFAs, then you can go online and open a new account. educational life from EFAs. Senator Dotson said that the middle word in EFAs is freedom, but I want to point out that the first word in EFAs is education.
EFAs have an explicit purpose of improving educational outcomes. While flexibility and freedom is a core feature. We must ensure that funds are being used primarily for academic growth and funds are being used for a reason that is central to academic learning. While freedom is a core feature, education is the main feature. What we know, this is pulled from the Department of Ed is in this year, 61%.
The homeschool families have used 61% of their funds allocated. So this is the first year they've used 61%. 44%. Of that money is being used on education-related items. That means 56% of the funds are not being used on education related items. Research and outcomes consistently show that the most impactful use of funds are those directly tied to learning,
things like high quality curriculum, specialized instruction, and access to educational tools and support. We have got to put metrics in place to ensure that funds are being used for educational purposes, while still allowing flexibility for parents and families that choose to participate in this program, and that's exactly the nerve that this bill strikes. I understand that people do not like, do not always like change, but we voted on this in hopes that EFAs would be a long sustainable program.
And in order to ensure that that is the case for kids to come. We have to ensure that we are spending money prudently and on things that will improve their educational experience and that they have access to those high quality educational materials. and I think there was some uh information floating around the, the chamber about where this bill started. This was a constituent-driven bill, no organization asked me to run this, um. This was increasing the amount you can contribute to a county committee from $5000 to $10,000. It was, it was tied to a a group, I believe, um, a constituent in my district.
was disappointed he could only donate. $5000 to the county committee. He wanted to donate a little bit more, um, his argument would be, um, if someone can write a half million dollar check to the state party. How come he can only give $5000 to a county committee. He doesn't want to give it to the state party. He wants to give it to the county committee because he believes that the county committee is more effective at doing their job within the district than the
state party. Now that's his position. But he makes a good argument when there are uh people have donated hundreds of thousands of dollars to the state party, and that's OK, but we restrict um and I know there's a movement to silence the county committees and I, I think that uh That uh we ought to be able to allow them to vote or to donate a little bit more money to the county committees if that's where they choose to send it instead of having to send that
extra money to the state party if they choose not to. Um, so all this bill does is increase it from $5000 to $10,000. And I'd ask for a good vote.

this bill is very simple in its in what it says, it's a little complicated in how we get there. Uh this is a bill that will utilize Article 5, Section 1, that we may amend a constitutional amendment by a bill. Uh, so this is, is under the Edgemon uh issue. uh, and I, I brought General Griffin's. with me to the well, so if any questions come up about that, we can refer back to it. But uh
all this bill does is it adds this to our Constitution. It says that in a ballot title, and let's make clear this is not the whole amendment, but ballot title of an initiated amendment, uh, the title shall be readable, clear and concise and shall not exceed 500 words. And then it further says the General Assembly may enact laws establishing a standard for the readability of the title, and we recently passed House Bill 1713, which did set that readability standard. But under
this amendment, we could change that standard. It's we currently sit it at the 8th grade reading level by the Fleis Kincaid standard, which is an objective standard, but future general assemblies could modify this, but this would limit the title to 500 words. Now, one of the most important things I want to mention is that The whole Bill of Rights to our US Constitution. The 1st 10 amendments are 482 words and our
framers when they did that, I think were wise and keeping it simple that that people could understand what they were voting on because the states did have to ratify that. So, uh, that's what the bill does, and
I would appreciate a good vote and be glad to answer any questions. OK,

you. I want to start by saying no
none of my comments have anything to do with the ballot title being 500 words or less, but I want the members to be very clear that this bill is explicitly saying that we as a general assembly can amend the state constitution if the if the part that we're amending was generated by the people, OK? I think that's a very important thing for the members to understand because it's a very important statement that we're making.
This has only been ruled on in 1951. We've talked about it a few times in this chamber this session. In that opinion, the Supreme Court of Arkansas said it's inconceivable. That the amendment that was drafted that allowed citizen initiated constitutional amendments would be drafted in a way that the General Assembly could change the constitutional amendment by a 2/3 vote. It's inconceivable. And there's a lot of reasons for that. I'll just give a couple. How about this one? If you interpret the Constitution that
way, then what that means is the constitutional amendments that we generate. Through the legislative process and that we refer out to the people, we can't amend our own constitutional amendments with the 2/3 vote. We're prohibited from doing that, but we can amend the constitutional amendments generated by the people with a 2/3 vote. Make that make sense for me. It doesn't. And if we could just amend everything generated by the people, whether it's an initiated act or a constitutional amendment with a 2/3 vote, then why do we pass
all these laws regulating how people can get things on the ballot. Why does it really even matter? Because we can just do whatever we want with the 2/3 vote once it gets here. It it doesn't make any sense in that broader context. Senator Clark raised a point in committee that I would have liked to have responded to, but I didn't get that opportunity, uh, nor did any members of the public get an opportunity to comment on the bill in committee, but he said, you know, we pass bills and then and subsequent sessions we amend those bills, we fix them. That's
true. We do do that. But you know what, we don't do that with? Joint resolutions that we refer out and that the people vote on at a general election because those are amending, those are not laws, those are not code. They're amending the Constitution. We can't change that two years later. Just like we shouldn't be able to change constitutional amendments adopted by the people of Arkansas. So there's really two questions for us about this, right? One is whether we can do this. Senator Johnson and I have a difference of opinion about whether we can
do this. The second question is whether we should do this. Should we amend the state constitution with a 2/3 vote by members of the General Assembly. Now we, I don't want to, I don't want to put words in Senator Johnson's mouth, but we had this conversation in committee this morning where if, you know, he said sometimes people get things wrong. Sometimes they're confused. And so I asked, so is it up to us as the General Assembly to decide when the people were right. And when they were confused and
he said yes. I've heard some stunning things down here in my decade at the General Assembly, but that is pretty much at the top of the list. We know best is what that this bill
is saying. We know when y'all were right about the things that you voted on, and we know when you kind of got it
wrong or you or when you were confused. That's the wrong approach for the legislature to take with the people of Arkansas. So my comments don't have anything to do with the ballot titles being 500 words or less, but we should not take the position that we can amend the state constitution
with a 2/3 vote of the General Assembly, less votes than it takes for us to appropriate a single

to speak for it. I'm not going to speak on the 500 word part either. The We have two conflicting things. We have what the actual law that's the actual amendment that the latest act that the
legislature passed, that's when they actually made it possible for citizens to do initiated acts in constitutional amendments. It was something new, something that hadn't been done. And in that law they said the legislature by 2/3 vote of both chambers. How often do you get a 2/3 vote of both chambers. That's, that's not an easy thing to accomplish,
but they said if we get, so it's, was it not at all hard to figure out that the legislature didn't, when the Supreme Court said it was inconceivable, of course it was conceivable. That's exactly what they meant. Uh, so you have what the legislature originally said you have what the Supreme Court said back in the 50s, and then you have what the Attorney General is saying. Uh, which is that the amendment or initiated the act back I
think in the twenties, but whenever it was, said exactly what it meant. And I think the Supreme Court decision today will say exactly that. As Senator Tucker pointed out, I said in committee, we make mistakes and we come back and we fix them. We are the people's branch. And as I pointed out in committee, uh, not this last time around, but when the people voted to
allow two casinos in Arkansas, Jefferson County, and Russellville. What the people did not know was in the text of that ballot. They were voting for gambling. They were voting for casinos. What they didn't know was in there was a $17 million tax cut for Oaklawn and a $17 million tax cut for Southland and some of the lowest taxes on casinos for the, because the new ones were gonna be at the same rate in the country. Put in the Constitution. They had no idea. And so to say, well, there will
is sacrosanct because they wanted casinos doesn't mean that they looked at any of the other things and certainly since we are representing the people, it is extremely proper for us to be able to come back with the with that very tough 2/3 vote in both chambers and say this needs to be fixed. This is not going against the will of the people. This is representing the people. and come back and say the people know this needs to be, needs to
be fixed. They've spoken to us and it's going to take a full 2/3 of the Senate and a full 2/3 of the House to do it. It's

want to close You recognize, sir. Thank you, Mr. President. A couple of points to answer. First of all, Without going into the long history of initiative and referendum in Arkansas.
The General Assembly in its wisdom, referred and people voted on and passed the constitutional amendment that created initiative and referendum. Subsequently, there was an initiated constitutional amendment that codified where we are today. We know it is Amendment 7, and we know it as Article 5, Section 1. This was initiated by the people, passed by the people, and it included
The provision that Senator Tucker refers to is that we're undoing the, the will of the people. This came from the people. I considered a safety valve. I consider it a backstop against something that uh people wouldn't want or was just plain a mistake or had an unintended consequence, and Lord knows we're constantly in here dealing with unintended consequences in legislation. But I want, I want to address the uh statement that Senator Tucker said, and I, I'm really
grateful to him. It's not just being a good friend, but a great debater, and he makes us all think, and he certainly makes me think. The uh the term he said it was inconceivable, the Supreme Court said that we would allow that, that they would allow the General Assembly by extraordinary majority to amend a measure passed by the voters. Uh, and, and as an aside, remember, when we pass a we refer another constitutional
amendment. We're sending back to the voters just like we had a half cent sales tax that we made. Temporary for highways and then we thought we needed it, we've sent it back to them and said, you, can you, you wanna make it permanent and we did. So we, we're constantly doing that kind of thing. That's why we have 100 and some odd amendments in the Constitution. Um, In in his opinion. Uh, the Attorney general had said that In the term inconceivable,
saying that if the people had intended the plain meaning they would have made it even plainer. In other words, the court could not believe that the text meant what it said. Does it held without any reference to the text that the General Assembly was prohibited from from amending constitutional amendments by 2/3 vote based on what the court believed was extra textual intent and purpose of Amendment 7. It's an Edgemond did not mention
the absurdity doctrine in its analysis, but it may have been why the court declined to follow the text. The doctrine, however, is in inapplicable. It applies only when two elements exist, one, the assert absurdity must be something so no unreasonable person could attend. A judge's belief that the framers of the instrument could not intend to say is not enough. And 2, the absurdity must be repairable by changing or
supplying a particular word or phrase, whose inclusion or omission was obviously a technical or ministerial error. This narrow definition is to keep judges from substituting their personal policy preference for the plain text of the law. Now, I actually spoke to a former attorney general on this issue, and he said that This, the Edgemon and he, and he was attorney general. He looked at it a lot. He said it was
judicial activism. I think he's correct, and I wasn't there in 1952 when they did that, but that's what they did. So, and with the Andrews decision, things changed. We weren't just willy nillyre looking at this in Andrews, the Supreme Court said the plain language of the Constitution means what it says, and I believe They're right, and I appreciate a good vote. Whether you like the 500 words or not, we have the authority to do this. I'm closed, Mr. Mr. President.

bill. Uh, we have a few years ago passed a, a
exception to the majority rule where whereby a candidate for municipal office who received 40% plus 1 vote could be elected without a runoff in just about every other instance we've ever had, uh, it takes 50% plus 1 vote to win an election. And that's why we have runoffs. This repeals that anomaly that allowed in some instances in the municipal election to elect a person with less than a
majority, with 40% plus 1 vote. That's all the bill does. It restores majority rule where the runoff would take place 4 weeks after the general election if there's a a uh if no candidate received a majority, then the top two candidates. would meet and run off 44 weeks later, and that's all the bill does. This bill simply makes it permissible for the Department of the Finance Administration to implement an electronic system for lien filing, titling, and registration process for vehicles. This is, this is an idea that technology is allowing to take place all across the country, Arkansas is one of 5 states that's not already doing this, or in implementing this as as a whole right now. And so like I said, we're one of 5 states.
This bill will be, this bill was brought to us from the automobile Dealers Association went through the transportation department. This deal does not require dealers to do any of this if they don't want to. It will be their choice. 30% or 40% of our competition. But I'll tell you why the new car dealer Association is for it. About 1012 years ago, if you remember when these paper tags got created, and they've got a little silvery looking sticker up in the corner. And that little silvery sticker is what every dealer buys. From the new car dealer Association. And they've had a lot of revenue in the new, and I was a member of the new Car Dealer Association. I had 2 new car
dealerships. Listen, DFNA didn't ask for this. A computer company, a software company called Champs. Has come up with this, hired a lobbyist, and, and trying to get us to, to, to give the FNA the authority to enter into a contract. The computer company, the software company, will probably do all that for free for DFNA. And, and, and the new car dealers Association or will get
paid for maintenance on that or whatever for years in the perpetuity. There's a lot of logistical reasons. Well, this won't work. Even though they, they say that they don't intend to do this now. This bill sets up a course for them to go to a title list paper, paperless state. Florida did that 10 or 15 years ago, it resulted in so many headaches that none of their neighbors have done it. And I've always
said I, I'm for a nationwide uniform title, and I'd be OK if it was electronic, as long as our neighboring states did it, but I've had a few customers show up out of Florida with no title. possible to consider batching bills on Monday, in particular House bills. We have a calendar right now that's in front of us. I think one of the complaints has been there's not
been enough time to review, so we just pull things out of the batch and then we end up voting them on a roll. Is it possible that we ask members to look at the bills on the calendar and we attempt to have a bats vote on Monday with the number of these bills since
there's time. That's fair. We may have as many as 100 bills on for Monday. Now. Knowing that Tuesday will be slower and Wednesday will be slower. It's not as much pressure, but if you will review over the weekend, we're we're going to be open to
batching on Monday. And like I say, it's 100 bills we normally get 15 an hour, roughly, so you can do the math, but um uh I am open to batching Monday. I've had several members ask about that.
