So this bill, I know we discussed during LEARNS that once we implemented EFAs and allowed all the different groups to participate, that we would probably need to come back and modify some things, tighten some things up, just based on how the program was going, make some changes where we saw that we needed to make improvements.
So that's what this bill is about, making improvements to what we have in place with EFAs. it does a few different things. It defines what a co-curricular is. It defines it as arts, music, and STEM. It updates the qualifying expenses, what does qualify, what does not qualify. And it allows the department to collect money when there has been evidence of fraud. So they're able to go back and collect those funds when there has been fraud. It also says that 25%
of the funds allocated to a student can be used for transportation. Up to 25% can be used for extracurriculars. So we put some parameters around that just to ensure that money was actually going towards education-related items. And it put in a window of when parents can apply for the EFA funds. That ends May 1st, which is

So, we did not update the definition of extracurricular, and that's, this has been part of, you know, the debate that we've been having over the last several months since that was in the news, is what should qualify as an extracurricular activity. And our definition in state law was great pre-learns, but it caused some issues post-learns when looking at it in a new light. So instead of changing the definition though, we just put a cap on how much could be
spent on those extracurricular activities, which is 25 percent of the funds that students would receive. put different we changed the qualifying expenses and uh said if you look on page three that what does not qualify um like like we had before television video game that kind of stuff and also now to say a telephone cell phone or other communication device unless that device is used for a student with a disability who's unable to communicate or if, you know, you were told by a clinician that you needed some type of communication device. So we've updated that and I think there's
some consternation over that. And changing, you know, like we said, putting the 25% on there, I think there's concern that parents, you know, can't spend the money on whatever they want. If They wanted to spend all $7,000 on transportation alone, or all $7,000 on, you know, private hitting lessons. Like, they can't do that. And I'm not saying anyone was doing that, but it's important for us to make sure right
now on the front end that we have those guidelines in place so that that does not happen. I think there's other groups that are probably upset that at the end we kind of say, hey, if we meet the cap, because we decide how much money we put into this program to fund, and if we decide only a certain amount, that means a certain number of students. And so we say, if we meet that cap at any point in the future, here is a list, here's the order in which students will be accepted into the program when they apply.

to be brief. I was fairly frustrated in committee yesterday with this bill that was dropped the end of last week, and then a large amendment was added in committee trying to get through it.
It did help a little bit with a few of the issues that were quite a bit throughout the bill, so it helped narrow down some of my specific objections. But
conceptually, And let me go through a couple of things. Let's see here. Just
in relation to, we have what's called education freedom accounts. The middle word in education freedom accounts is freedom.
We said a couple years ago that we would trust parents with the ability for the dollars to follow their kids and for them to make educational choices. We determined what eligible expenses are that they can use those funds for. And then within that, they are responsible for making sure that their kids are getting the education that they need utilizing those funds. Now, if we want to put parameters on things, obviously we can do so. But at the same time, we also send foundation funding to schools that is unrestricted.
And I don't always agree with how they allocate those funds at a regular traditional public school with related to sports activities and extracurriculars, but sometimes those expenses might exceed these thresholds that were in this bill. So that's
one point to consider. Specifically on page 4, lines 8 through 10, this is defining homeschool in this section. And then if you go to page six of the bill, section four of the bill, it further talks
about the applicant and whether they attend a private school or file a notice of intent to homeschool. And if you go to page seven, it talks about an applicant changes from one participating school to
another participating in school, a homeschool to a participating school or participating school to a homeschool. It seems to start delineating and differentiating between different classes of students. And I thought EFAs were actually the class of students that we're talking about here
in the fact that we're funding education freedom accounts and then they get to decide whether they're going to use those funds to buy curriculum and have an a la carte educational expense or are they going to go to a private school or are they going to go purchase educational services from the local public school district How they are going to allocate those funds for the
education of their student is what the point of the education freedom account was for. And then,
finally, it talks about account closing on page 6.
If a participating student is expelled from a participating school. So, if a student gets expelled from a school, their account will close. Well, there might be some more stringent requirements at a particular school that they got expelled from, but we're going to shut them out from the program. If they go and are expelled from that particular school choice program, they won't have access to these funds. They'll have to go back into a traditional public school setting at that point.
Another school, another private school, another option for them utilizing these funds would be off the table. So for these reasons I'm opposed to the bill, continue to be opposed to the bill. This thing needs to have a little bit more vetting than the last few days of session. It should have probably been over the course of the last
year or two as we've been talking and I would hope that we could park this and study it further over the next couple of years. See, there's a question.

In fact, based on the funding matrix, we're giving $72 per student to schools in the matrix for extracurricular activities. This would allow up to 25%. We had, before the amendment, said one-sixth funding. It's sort of to mirror the Tim Tebow law that we had years ago, right? If you homeschool, but you go to a public school or whatever to take a class or participate in extracurricular, then one-sixth of the funding follows because the school is educating
in that class. So that's originally what we had, but in getting feedback and people saying that's too narrow, we should allow these students to do more, we just said 25%. So, I mean, the majority of the money should be going to educational expenses. Now, I feel like it's fair to say that extracurriculars do factor into the educational experience. So I think that's fair. But what I want to say to your question is, right now, they could spend 100% of the funds
that we give in EFAs on extracurriculars or on travel. If they buy, you know, some curriculum, you can get free homeschooling curriculum. If you buy, you know, a $1,000 homeschooling curriculum, that means you can use the other $6,000 on transportation alone. Right now, that's how it is. So, because there are no, there's no guidance and no, you know, caps, for lack of a better word, within the EFA program on what they can spend money on.
And that's one of the adjustments that we need to make. we need to ensure that going forward, we are spending money on educational materials and tools. So if you think that that is too much, then I would say I think you're for this bill on that issue alone, because right now they can do 100%. They could spend $7,000 on baseball lessons right now if they want to, because there's no cap within it, okay? So this is trying to rein it in to do something that makes a little bit of sense. I want to speak to the expelled part in closing the student's account.
Right now, in EFAs, when you open an account, it stays open until you graduate. It doesn't mean you have to use it the entire time, but it just stays open with your name. If you're expelled, like the bill says, your account is closed. Guess what you can do if you want to continue participating in EFAs? Go online and register for a new account. This just doesn't let them keep it open if you're in sixth grade and you get expelled or you, you know, then you can't just keep this
account open for the next six years. They kick you out, shut your account down, and then if you want to go back to a different school the next year and participate in EFAs, then you can go online and open a new account. We're not banning them from their educational life from EFAs. Senator Dotson said that the middle word in EFAs is freedom. But I want to point out that the first word in EFAs is education.
EFAs have an explicit purpose of improving educational outcomes. While flexibility and freedom is a core feature, we must ensure that funds are being used primarily for academic growth and funds are being used for a reason that is central to academic learning. While freedom is a core feature, education is the main feature. What we know, this is pulled from the Department of Ed, is in this year, 61%, the homeschool families have used 61% of their funds allocated.
So this is the first year, they've used 61%. 44% of that money is being used on education-related items. That means 56% of the funds are not being used on education-related items. Research and outcomes consistently show that the most impactful use of funds are those directly tied to learning. Things like high-quality curriculum, specialized instruction, and access to educational tools and support.
We have got to put metrics in place to ensure that funds are being used for educational purposes while still allowing flexibility for parents and families that choose to participate in this program. And that's exactly the nerve that this bill strikes. I understand that people do not always like change, but we voted on this in hopes that EFAs would be a long, sustainable program. And in order to ensure that that is the case for kids to come, we have to ensure that we are spending money prudently

The biggest opposition we have right now is the cure period for some of the big data companies. companies happy and make it to where the AG can do his job. So I had to choose between making Google and all the big corporations happy, Apple, all of them, or making it to where the AG can actually do his job. And that's what we've done with this bill. I ran this the other day, and I think there was some information floating around the chamber about where this bill started. This was a constituent-driven bill.
No organization asked me to run this. This was increasing the amount you can contribute to a county committee from $5,000 to $10,000. It was tied to a group, I believe. A constituent in my district was disappointed he could only donate $5,000 to the county committee. He wanted to donate a little bit more. His argument would be if someone can write a half million dollar check
to the state party, how come he can only give $5,000 to a county committee? He doesn't want to give it to the state party. He wants to give it to the county committee because he believes that the county committee is more effective at doing their job within the district than the state party. Now, that's his position, but he makes a good argument when there are people who have donated hundreds of thousands of dollars to the state party, and that's okay. But we restrict, and I know there's a movement to silence the county committees,
and I think that we ought to be able to allow them to vote or to donate a little bit more money to the county committees if that's where they choose to send it instead of having to send that extra money to the state party if they choose not to. sir. Thank you, Mr. President. This bill is very simple in what it says. It's a little complicated in how we get there. This is a bill that will utilize Article 5, Section 1, that we may amend a constitutional amendment by IBL.
So this is under the Edgemont issue. And I brought General Griffin's opinion with me to the well, so if any questions come up about that, we can refer back to it. well all this bill does is it adds this to our Constitution it says that in a ballot title and let's make clear this is not the whole amendment but the ballot title of an initiated amendment the title shall be readable clear and
concise and shall not exceed 500 words and then it further says the General Assembly may enact laws establishing a standard for the readability of the title. And we recently passed House Bill 1713, which did set that readability standard. But under this amendment, we could change that standard. We currently set it at the eighth grade reading level by the Fleish Kincaid standard, which is an objective standard, but future General Assemblies could modify this. But this would limit the title to 500 words. Now, one of the most
important things I want to mention is that the whole Bill of Rights to our U.S. Constitution, the first ten amendments are 482 words and our framers when they did that I think were wise in keeping it simple that people could understand what they were voting on because the states did have to ratify that. So that's what the bill does and

by saying none of my comments have anything to do with the ballot title being 500 words or less, but I want the members to be very clear that this bill is explicitly saying that we as a General Assembly can amend the state constitution if the part that we're amending was generated by the people, okay? I think that's a
very important thing for the members to understand because it's a very important statement that we're making. This has only been ruled on in 1951. We've talked about it a few times in the chamber this session. In that opinion, the Supreme Court of Arkansas said it's inconceivable that the amendment that was drafted that allowed citizen-initiated constitutional amendments would be drafted in a way that the General Assembly could change the constitutional amendment by a two-thirds vote. It's inconceivable. And there's a lot of reasons for that. I'll just give a couple. How about this
one? If you interpret the Constitution that way, then what that means is the constitutional amendments that we generate through the legislative process and that we refer out to the people, we can't amend our own constitutional amendments with a two-thirds vote. We're prohibited from doing that. But we can amend the constitutional amendments generated by the people with a two-thirds vote? Make that make sense for me. It doesn't. And if we could just amend everything generated by the people, whether it's an initiated act or a constitutional amendment with a two-thirds vote,
then why do we pass all these laws regulating how people can get things on the ballot? Why does it really even matter? Because we can just do whatever we want with the two-thirds vote once it gets here. It doesn't make any sense in that broader context. Senator Clark raised a point in committee that I would have liked to have responded to, but I didn't get that opportunity, nor did any members of the public get an opportunity to comment on the bill in committee. But he said, you know, we pass bills and then in subsequent sessions we amend those
bills. We fix them. That's true. We do do that. But you know what we don't do that with? Joint resolutions that we refer out and that the people vote on at a general election because those are amending. Those are not laws. Those are not code. They're amending the Constitution. We can't change that two years later. Just like we shouldn't be able to change constitutional amendments adopted by the people of Arkansas. So there's really two questions for us about this, right? One is whether we can do this. Senator Johnson and I have a difference of opinion about whether we can do
this. The second question is whether we should do this. Should we amend the state constitution with a two-thirds vote by members of the General Assembly? And we, I don't want to paraphrase, I don't want to put words in Senator Johnson's mouth, but we had this conversation in committee this morning where if you know he said sometimes people get things wrong sometimes they're confused and so i asked so is it up to us as the general assembly to decide when the people were right and when they were confused and he said yes i've heard some stunning things down here in my decade
at the general assembly but that is pretty much at the top of the list we know best is what that this
bill is saying. We know when y'all were right about the things that you voted on, and we know when you kind of
got it wrong or when you were confused. That's the wrong approach for the legislature to take with the people of Arkansas. So my comments don't have anything to do with the ballot titles being 500 words or less, but we should not take the position that we can amend the state constitution with a two-thirds vote of the General Assembly. for citizens to do initiated acts and constitutional amendments. It was something new, something that hadn't been done. And in that law, they said the legislature, by two-thirds vote of both chambers, how often do you get a two-thirds vote of both chambers? That's not an easy thing to accomplish, but they said if we get, so it's, was it not at all hard to figure out that the legislature didn't, when the Supreme Court said it was inconceivable, of course it was conceivable.
That's exactly what they meant. So you have what the legislature originally said, you have what the Supreme Court said back in the 50s, and then you have what the Attorney General is saying, which is that the amendment or initiated the act back, I think, in the 20s, but whenever it was, said exactly what it meant. And I think a Supreme Court decision today will say exactly that. As Senator Tucker pointed out, I said in committee,
we make mistakes and we come back and we fix them. We are the people's branch. And as I pointed out in committee, not this last time around, but when the people voted to allow two casinos in Arkansas, Jefferson County and Russellville, what the people did not know was in the text of that ballot. They were voting for gambling. They were voting for casinos. What they didn't know was in there was a $17 million tax cut for Oakland and a $17 million tax cut for Southland
and some of the lowest taxes on casinos, because the new ones were going to be at the same rate, in the country, put in the Constitution. They had no idea. And so to say, well, their will is sacrosanct because they wanted casinos doesn't mean that they looked at any of the other things. And certainly, since we are representing the people, it is extremely proper for us to be able to come back with that very tough two-thirds vote in both chambers and say, this needs to be fixed.
This is not going against the will of the people. This is representing the people and come back and say, the people know this needs to be fixed. They've spoken to us. And it's going to take a full two-thirds of the Senate and a full two-thirds of the House to do it. It's something that we should definitely pass. Okay. Anyone else? Anyone want to

A couple of points to answer. First of all, without going into the long history of initiative and referendum in Arkansas, the General Assembly, in its wisdom, referred and people voted on and passed a constitutional amendment that created initiative and referendum. Subsequently, there was an initiated constitutional amendment that codified where we are today. We know it as Amendment 7, and we know it as Article 5, Section 1.
This was initiated by the people, passed by the people, and it included the provision that Senator Tucker refers to as that we're undoing the will of the people. This came from the people. I consider it a safety valve. I consider it a backstop against something that people wouldn't want or was just plain a mistake or had an unintended consequence. And Lord knows, we're constantly in here dealing with unintended consequences in legislation.
But I want to address the statement that Senator Tucker said, and I'm really grateful to him. It's not just being a good friend, but a great debater. And he makes us all think, and he certainly makes me think. The term he said, it was inconceivable, the Supreme Court said, that they would allow the General Assembly by extraordinary majority to amend a measure passed by the voters.
And as an aside, remember, when we refer another constitutional amendment, we're sending it back to the voters, just like we had a half-cent sales tax that we made temporary for highways and then we thought we needed it we sent it back to them and said you can you want to make it permanent and we did so we were constantly doing that kind of thing that's why we have a hundred and some odd amendments in the constitution in in his opinion the attorney general had said that in the term inconceivable saying that if the
people had intended the plain meaning, they would have made it even plainer. In other words, the court could not believe that the text meant what it said. Thus it held, without any reference to the text, that the General Assembly was prohibited from amending constitutional amendments by two-thirds vote based on what the court believed was extra textual intent and purpose of Amendment 7. It said, Edgemon did not mention the absurdity doctrine in its
analysis, but it may have been why the court declined to follow the text. The doctrine, however, is inapplicable. It applies only when two elements exist. One, the absurdity must be something so no unreasonable person could intend. A judge's belief that the framers of the instrument could not intend to say is not enough. And two, the absurdity must be repairable by changing or supplying a particular word or phrase whose inclusion or omission was obviously a
technical or ministerial error. This narrow definition is to keep judges from substituting their personal policy preference for the plain text of the law. Now, I actually spoke to a former attorney general on this issue, and he said that Edgemond, and he was attorney general. He looked at it a lot. He said it was judicial activism. I think he's correct. And I wasn't there in 1952 when they did that,
but that's what they did. So with the Andrews decision, things changed. We weren't just willy-nilly re-looking at this. In Andrews, the Supreme Court said the plain language of the Constitution means what it says. And I believe they're right, and I appreciate a good vote. the law concerning runoff elections for county and municipal officers. You're right now, sir. Thank
you, Mr. President. Senate Bill 608 is a very simple bill. We have, a few years ago, passed an exception to the majority rule whereby a candidate for municipal office who received 40% plus one vote could be elected without a runoff.
In just about every other instance we've ever had, it takes 50% plus one vote to win an election, and that's why we have runoffs. This repeals that anomaly that allowed, in some instances, in a municipal election to elect a person with less than a majority with 40% plus one vote. That's all the bill does. It restores a majority rule where the runoff would take place four weeks after the general election.

Colleagues, this is a pretty simple bill. It's a bill to try to bring Arkansas into the 21st century as far as electronic filing and stuff. This bill simply makes it permissible for the Department of the Finance Administration to implement an electronic system for lien filing, titling, and registration process for vehicles. This is an idea that technology is allowing to take place all across the country. Arkansas is one of five states that's not already doing this or implementing this as a whole right now.
And so, like I said, we're one of five states. This bill was brought to us from the Automobile Dealers Association, went through the Transportation Department. This deal does not require dealers to do any of this if they don't want to. It will be their choice. This just gives DF&A the opportunity to start doing this and changing us into a more modernized system. Leaves the door open. Like I said, we'll go for registration. The first phase is really going to be registration and liens.
Then eventually go on into titling later once they get all the kinks kicked out of the system. if they decide to even go that far. Like I said, we're one of five. DF and A is aware that they have a bunch of small dealers out here, or individual trades. You can still have a copy of your title. None of that's changing. This just gives them the opportunity to.

something from Alan Clark the other day. Please don't. This bill, I could take a couple hours to tell you all the nightmares it could cause to small, independent dealers that don't have a large staff or IT person or computers and especially private treaty,
private sales between two individuals, the title in your hand is like a $20 bill in your pocket. I mean, if you've got the vehicle and you've got the title, you can prove that you have a cash asset. If you don't have the title and you got to go to a computer somewhere to look up the status before you know if there's a lien on it or anything like that. These little bitty deals, it'll help me, it'll help the new car stores because they'll eliminate 30% or 40% of our competition.
But I'll tell you why the New Car Dealer Association is for it. About 10, 12 years ago, if you remember when these paper tags got created and they've got a little silvery looking sticker up in the corner, and that little silvery sticker is what every dealer buys from the new car dealer association and they've had a lot of revenue and I was a member of the new car dealer association I had two new car dealerships listen, DF&A didn't ask for this
a computer company, a software company called Champs has come up with this, hired a lobbyist and trying to get us to give DF&A the authority to enter into a contract. The computer company, the software company, will probably do all that for free for DF&A. And the New Car Dealers Association will get paid for maintenance on that or whatever for years into perpetuity.
There's a lot of logistical reasons why this won't work. Even though they say that they don't intend to do this now, this bill sets up a course for them to go to a title-less, paperless state. Florida did that 10 or 15 years ago. It resulted in so many headaches that none of their neighbors have done it. And I've always said, I'm for a nationwide uniform title, and I'd be okay if it was electronic,
as long as our neighboring states did it. But I've had a few customers show up out of Florida with no title. And you don't know the status. You're there late after hours on a Saturday, and you can't find out the status because there's no DMV service in Florida. And then, anyway, I'll keep

Would it be possible to consider batching bills on Monday, in particular House bills? We have a calendar right now that's in front of us. I think one of the complaints has been there's not been enough time to review.
So we just pull things out of the batch, and then we end up voting them on a roll. Is it possible that we ask members to look at the bills on the calendar and we attempt to have a batch vote on Monday with the number of these
bills in certain time? That's fair. We may have as many as 100 bills on for Monday. Now, knowing that Tuesday will be slower and Wednesday will be slower, it's not as much pressure. But if you will review over the weekend, we're going to be open to batching on Monday.
And like I say, it's 100 bills. We normally get 15 an hour, roughly, so you can do the math, but I am open to batching Monday. I've had several members ask about that, so just please take time over the weekend. You'll have the calendar all weekend long to review what you would like to be able to pull out and vote separately.
