a felony input and putting them in prison we've had a lot of discussion recently about the best use of our prison beds and I don't think someone who was on drugs and who doesn't hurt somebody if you hurt somebody you're going to prison or even if you intend to hurt somebody but you don't hurt them you're going to present but if you just come in because you don't know what you're doing because you're hired on on drugs we need to put that person in treatment and not sent to prison so I don't really think this bill fills a hole in the law and and I'll be vote no for the rest.

Fine used an under utilized public school property. So that. A municipality the city where public school facilities land is situated that's unused or underutilized our a county. Where that public school property is situated we have some places where the school district is not in a municipality but rather in a county such as over in Cross County there's a cross county
school district as well as we and school district so what this bill seeks to do is give the first option of of as a gift to that municipality or that county that unused or underutilized property it also establishes that fair market value should be determined by an independent appraiser third party appraiser.
it does retain the charter schools right of of refusal but puts them in second to the municipality or the county the county or the city can waive that right to that unused or underutilized property and but the window is still there for charter schools to do that sale our lease of the property as well and if not.
The school district can steal sale to a third party as is currently done so with that I'll be glad to take any questions. Questions for Senator flowers. And. You're recognized. Yes. A committee. the Bill with school calendar and the status of the school system that would otherwise violate or institution.
That that's not a conversation well yes but the current law Clearly the. Hold that. Property that's unused or underutilized can be sold does not have to be use for up educational purposes. The constitution that article fourteen in our constitution it talks about property that is a part of the public school fine so once is designated I'm used or under utilize it's no longer a part of that.
The purpose and and the reason for me bring in this bill is because taxpayers pay regardless of the new buildings where the property is old still owed for twenty five meals that's pursuant to the constitution Arkansas constitution that does not go away. Extra money in the way of the extra meal could be voted on by the taxpayers in those
municipalities are counting for the purpose of maintenance and operation but there is a time limit the sunset on that so I would argue that this does not violate the constitution of Arkansas. At. The current law works will. We worked long and hard to get the current law which is that uh want to school designates a building as not being used at charter schools get first refusal in the constitution. Buildings of school buildings of are to be used for that purpose for the purpose of education. There would be nothing wrong with.
as far as I can tell with it to be in the opposite direction the charter schools had first of choices they do now and then of the local community. But. Everybody in the everybody in the community pays taxes everybody in the community pays property taxes which goes towards schools which goes toward education and that includes those who participate in public charter schools. And we when we first did this
and like I said we didn't get to we didn't get it through in one session you know we have kids meeting and trailers. we're we had perfectly good buildings falling down and we don't want the war I would concur with Senator flowers is that we don't want perfectly good buildings falling down but there is no reason to change the law from charter schools having first refusal that those who are trying to educate kids should have first choice of using that that building. two could to educate kids before it's considered to be
used for anything else and I would of there was a thought I thought that this bill was going to be amended in committee but it was not of and as it currently stands I would appreciate you voting no because you'd be sent a terrible message About The public schools of charter schools in their access we have to take questions. new open enrollment charter schools is that correct correct okay well that's why I was wondering why at this time we want to to limit the availability buildings form and tell it that my time this might be a good bill but at this time I think it might be a serious mistake would you agree I would agree and I would would add to that it's I don't believe that it's legal to sell these buildings charter schools actually pays a fair market value that's what's in

To give this facility to the municipality. That scenario yes it would and they sell it to the charter school at the same price that the charter school for the bottom from the school from the

under utilized school properties. This year. That list. Is fifteen pages. All across the state of Arkansas. Mostly down in south Arkansas. Crawl south Arkansas but also it goes up north. West and north east. I distributed a copy of the list to the members of the Education Committee you can go online to
the Division of academic facilities and transportation and see the list for this year. I also got from that and Division. List for the last several years. And they to. Our multiple pages of unused and under utilized properties. I know for certain in some of our communities across the state. Properties belonging to school
districts that have been paid for by the millage is that the taxpayers in the cities and counties living in. Have been sitting there rotting four years. Wasting no way. Fair market value according to the Division of academic facilities and transportation under their rules. Means the price at which the property would change hands
between a willing buyer and a willing seller. Neither being under any compulsion to buy our to seal and both having reasonable knowledge of relevant facts. That could be a dollar. If the buyer and the seller agree on it. There is no appraisal done. There is no nothing that. I know to be fair market value
determination is whatever these parties decide on. And in my area I have a specific instance. Where a lot of small well it's not small it was a elementary school campus. Less than a block from the lake lake pine bluff. Was sold for fifteen thousand dollars no appraisal. And then a couple weeks later I drive by. And there's a commercial listing
sign on it. I have someone call the realtor and they listed it for four hundred thousand dollars. School district is not getting anything back that was an LLC a private company. That got that. Property. I went to school with that property when I was in the sixth grade carver elementary school it had to. Classrooms from one to six great
had a cafeteria. Place for gathering playground and then to top it off. It's less than a block from a lake. That's a choice piece of property. And it should have been appraised especially if you're selling it to a third party taxpayers have paid and still pay like I said our constitution requires twenty five meals regardless of whether there's a
bond still outstanding our weather new buildings are being built our property's being no quiet here taxpayers have to pay twenty five meals. Any additional millage is because of maintenance and operation. I ask you for a good vote for those reasons I don't think that this it disadvantages of charter school charter schools haven't been getting these properties
but not not thing is this. As a taxpayer. We should be able to expect in our communities that the dollars we put out for school buildings and school properties if they're not used for that purpose we should have the first option to determine what should they be used for. counties has never yet approached me on this bill I have gone through intermediaries to the county clerk's association they have never come to me but I learned in committee. What their problems with the bill or an offer to fix them they turned me down out of hand I fixed him anyway which is what we're a couple days later. The all this bill does is allows. Someone who wishes to vote on a
paper ballot to be able to vote on a paper ballot we have pared this down because they talked about expense etcetera we are paired is down to only in those counties that have a vote Senator that leaves out twelve of our smaller counties it hits ninety ninety five percent of people but so would be a burden on them everybody that has a vote center has a printer already that's part of that vote Senator with a touch of a button you can
push you can the ballot for me or anybody else that structure to vote in a print the correct ballot of people already trained how to do that because they already have the printer they already do that and. The the cost that we can see is paper and counting the ballots. And I think or I think this assuming that the machines are being used in garland county our water being used a wide and I don't know that to be true
but the I have confidence in the system mainly because it ends up being a paper ballot that is held in can be recounted. But people have concerns citizens have concerns voters have concerns and I think that those concerns should be honored and. I was reminded of my first election and I share this with the Judiciary Committee the other night and I apologize for getting emotional but this is the week that I lost my dad two weeks two years ago and
And. He called me into his office. A month before the election and said son I know you're excited. But I don't want to be disappointed. They cheat. And he told me how he had run for the up. The democratic committee. And somebody came in at noon he had not gone to vote yet somebody came in and told him that he didn't even have a lever by his name. And.
And I said that I know they used to do that. I had sat down with numerous candidates who told me their horror stories but I said we fixed all of that. And I believe that we have. So I got to the polls. On that election morning. And a relative who we had a certain to was in my district had gone into the of voting
machine and there were three J. P. races on the machine and she couldn't pull the lever by my name. In my district have been locked out although she was definitely in my district. We projected that we will get senate five percent of the vote in that precinct we had to get something for a person to vote in that precinct for me to win it wasn't an accident so out of every four people who voted. I lost three votes to my opponent lost one. She said when she couldn't pull
the lever by my name she told officials outside the curtain because she was in. I can't vote for Alan Clark. And they said with then you're not supposed to be a little for Alan Clark she said no I am supposed to be able to vote for Alan Clark we've checked and it this is this he's running in my district option available for him well they told or all kinds of things including just pull the lever and come on out and she said no I know when I pull the lever my vote is done and I'm not coming out and talking about for Alan Clark with the
line was out to the road. And twenty minutes later they finally handed her a paper ballot. For her to vote on and she left. I get there that's seven thirty I get there at nine. So it's fixed right no the line still out to the road. And three out of four voters that would have voted for me. Or not voting at all. Two one for my opponent. And so we call the Election Commission.
And we had them to come out and they said there's nothing we can do. They don't get there till eleven thirty. This continues to go all there's nothing we can do about it so there's got to be something you can do. These people supposed will vote for me and they can't vote. Nothing we can do. And then they said my heart sank because all of these people who talked about the what the horrors that it happened in their own election had told me this thing.
The election commissioner told me that tomorrow morning you can follow a complaint. And challenge the election. That wasn't true. I had to have twenty notarized complaints. Turned in at the close of the polls that day and I came in the next morning they would tell me it's too late sorry. But they were the ones that were supposed to know the rules. Then I had no doubt it was on
purpose I spent hours in the school office it was a school where we were voting hours in school office with attorneys. with the Republican Party trying to get things something done. What they did do was come in more than once and tell me that I had to leave. Or I would be arrested because I couldn't be in the poll turns out I know the law at that point turns out the laws so that the one person who can be in the poll with no permission to be a poll watcher is the candidate
himself but they said you don't want to have your paper to do your picture in the paper tomorrow for being arrested because I refuse to leave us a note behind a closed door nobody even knows I'm here. They said we will be in the paper tomorrow having been arrested I said I don't care what happens tomorrow the elections will be decided today and we stayed on the phone with the Republican Party and finally at two thirty. That afternoon. They close that voting machine and begin to allow people to vote on paper ballots. Two thirty.
I had my twenty complaints more than that. I'm glad we had paper ballots. But also learned a lesson that day that I know very well from the heart. Then that's what taking time today to share with you. Is dad said. Watch it. And I was convinced. We had it fixed because I'm convinced today we haven't fixed as many of you are convinced we
have it fixed but the people who don't think we have it fixed may be smarter than me that's what that's what I have learned they may be smarter than me and we're not asking for something big. We have worked with the county clerk's ever way we know to work with the county Clerk would lessen the penalty we said one place yeah I mean if you want to vote by paper ballot you gotta go to that one place the machine for the all it requires is extirpate FOR and besides the fact you know I don't like the fact that it any group any time
doesn't come to a senator and try to work with them and so I didn't keep the bill or it was a change to to make it the best all that we could it's good law I appreciate a good vote. But when you're talking to folks on my side it sounds like not all voting centers have these
printers and so there would be a casa sounds like to get these plans I just want some clarification there don't make me feel better. It's all right does your the does your county Clerk shall have the printer. What was told me they have a printer that is for absentee ballots it's the same printer. But not all counties have that same printer sounds like the we have not been contacted by any county who said they did not have the printer by the way several accounting clerks now are either neutral on the bill for the bill the association still has not

five bills that aligned with the heritage report and of those twenty five twenty four hopefully by today or tomorrow will be out and those bills were taken and developed as a result of taking the heritage foundation and saying what we have to do to clear what were your objections so we work through that process and y'all may remember bill called Senate bill two fifty Senate bill two fifty had the support of the heritage foundation they got in behind it they said this was a
good bill this is what they got in and supported with regards to I wanted to give you what was given to me that out of twenty eight counties who responded only seven had a printer these workstations are about twelve thousand each you would need to back up you would need specialized trade workers motion point reportedly only having preprinted ballots that one vote Senator to create mass confusion so what I'm saying is this the bills that we worked on that
started way before last session that aligned with what the heritage foundation said we need to do in order to clear what kept us from being number one at the time that this bill is not one of those bills I wanna make that clear that is not one of those bills and so what I would ask is you not vote for this Senate bill two fifty addressed a lot of that issue and so I'm asking not to vote for. for other states would have happened but I can speak that in this state for all the audits have been conducted on those machines it's a hundred percent accuracy so far so you have to factor that into consideration also one of the other bills that we ran allowed for up to fifteen counties to be checked and we're already a hundred percent success rate and all the arguments that think we've well debated over Senate bill two fifty so really private bills down to the question what's the necessity of this bill given

Can't be annexed without a two thirds vote of the airport authority's board has nothing to do so it does not prevent the way I read it from. Therefore from cutting into hostile land. D. annexing and cut into their revenue base so my understanding is one parts fixed the other part isn't.

several years ago to have school board elections either in. During the primary or during the general election now we're saying you're going to have the election the primary but if there's a run off or something you gotta wait till November. That's not good government. If there's a run off in our elections it's almost immediately or within a couple of weeks now you're talking about waiting until November for something that happens in March one year may the next year there's no consistency.

If a kid comes home saying this is what I heard it was from a Muslim perspective or Buddhist perspective I think it's healthy but I want to make sure that you
know when we do this instead of just leaving it alone.
