Thank you, Mr. Speaker. Members, I'm very happy to bring you this bill today. It's an education bill whose time has come. Very briefly, what this bill says is, in the past, our public schools enacted that they must apply textbooks to all students. All we're doing in this bill is we're enlarging what the public schools can provide. It's very permissive language. They can now do one of the three. They can either supply textbooks, instructional material, or digital resources.
This has a physical impact with it. It's variable. Of course, if the school districts want to stay with the textbooks, they can. Of course, if they want to buy computers or laptops for those children, they understand that that would come out of their school district expenses.

to explain the bill. Thank you, Mr. Speaker. Members, today I'm here bringing House Bill 1369. This is the sales tax holiday bill.
I understand I'm just the latest in a number of representatives through the years who have brought this bill, but I think this is a bill whose time has come, and I'd like to thank Representative Vines and Representative Wright for early on working with me on this bill, and Representative Bell as well. As most know, all surrounding states or states surrounding Arkansas have some form of a sales tax holiday, day. And certainly in my district in South Arkansas, many of my constituents head to
Monroe or Shreveport, Louisiana or Dallas, Texas or other places to shop for back-to-school items and take advantage of those sales tax holidays. And I believe that given the size of our state, virtually every point in Arkansas is within about a two-hour drive of a neighboring state and and of locations where they could they could shop for back-to-school items i believe that it's in the best interest of our state to likewise adopt such a sales tax holiday
i believe that there is obviously a fiscal impact i provided that at each of your desk this bill has been narrowly tailored to accomplish its purpose which is to provide some relief which with regard to clothing and to certain back-to-school items the clothing is capped at $100 per item clothing accessories are capped at $50 an item I think that again this is a bill whose time has come and I would appreciate a good vote members heard an explanation

House Bill 1429 by Representative English to exempt from ad valorem taxation industrial facilities owned and financed by the Arkansas Development and Finance Authority and to provide for agreements for payments in lieu
of taxes as to these industrial facilities. Representative English,
you are recognized to explain the bill. Thank you, Mr. Speaker. This is an Arkansas Development and Finance Authority bill. And in 1981, at 497, the legislature passed that act to allow securing of industrial revenue bonds
and allowing a payment of lewin taxes to be negotiated by local cities and counties. At that point in time, the Arkansas Development Finance Authority had not been created. They weren't created until 1985. What this bill does is it gives them, the cities and counties, the opportunity to use the Arkansas Development Finance Authority to be able to bundle their industrial revenue bonds.
Costs are lower. Cities and counties still do all the negotiating on their payment in lieu of taxes. Appreciate a good vote. Representative

The bill itself raised questions in my mind when I first saw it because the Arkansas Constitution prohibits the state from passing an ad valorem tax. That's left to the local governmental authorities. We do not have a statewide property tax. If we don't have a statewide property tax, how can we give a state agency the power to reduce those property taxes, those ad valorem taxes?
So I wasn't on the committee, but that was just a question that I have and I still have about the bill. And so I'm just not sure it's good public policy to exempt the ad valorem taxes at the state level when that should be a local government decision.

The only thing this does, which is already taking place, but the Arkansas Development Finance Authority and the Arkansas Economic Development Commission Both have the ability to guarantee these bonds, and what it does is it just makes it much simpler for the Arkansas Development Finance Authority to bundle a lot of these smaller industrial revenue bonds together and get them sold, and the cost for issuance is a lot less.
Cities and counties have always done their own negotiating and payment of lieu of taxes, and they will continue to do that. The state will not be involved in that at all. I'm close with my

Thank you, Mr. Speaker. For those of you that
were here two years ago, you remember that we had a fleet bill at that point in time, and it was basically a fleet bill for commercial vehicles in the private sector that had 50 vehicles or less. And it makes it a lot easier for these companies to register vehicles all at the same time at a certain time of the year. And it also saves them a lot of money if they can pay for them for two or three years in advance.
And so it's kind of a government efficiency bill in that respect. And obviously, that bill passed, and that program is up and running, and it's a very successful program. Now then, the nonprofit organizations with a fleet of 25 vehicles plus are asking for them to be included in this act as well, where they can voluntarily renew their license tags for multiple years. And this particular one would just allow the agencies eligible for the federal transit programs through the AHTD,
which is rural transit systems, senior centers, developmental disability schools, to renew their license tags in the same month of each year and pay for one or two years in advance. So obviously this saves a lot of time and paperwork. It doesn't cost the state any money. In fact, the state might even make a little bit of revenue out of it. They've got a $10 license plate fee that they pay per tag, so that helps a little bit. So anyhow, I'll be glad to take any questions.

which, by the way, is now the fourth largest motorcycle event in the nation. I expect this bill to allow a great tourism primer and a really beneficial revenue generator. I'm not aware of any opposition to this bill. Current law says that if a sex offender files an appeal, his or her level is reduced by one level during the appeal process. Once sex offenders are assessed, they have a right to an administrative appeal.
If they still do not agree, they can file a civil appeal. These proceedings can take months. One case in the county that I represent, Baxter County, took 15 months. 15 months where we did not know where that sex offender was residing. This is not an incentive. In fact, there is a reason to delay the appeal, because in many cases, by reducing the level by one, law enforcement cannot tell the public where a predator is living because they are on appeal.

Speaker. This is a agreed-upon bill by the Pharmacy Association, the Medical Association, to allow pharmacists to lower the age on people. They can administer flu shots, immunizations, or allergy shots. It's been in laws already for several years.
They could do it 18 or older. This lowers the limit from 18 down to 7. It's a agreed-upon bill. The system has worked very well. You're all familiar with driving past a pharmacy and says, get your flu shot here. That's all we're doing is moving the age from 18 to 7. Any shots given under a prescription has to be reported back to the doctor so that that particular person's record will show that they've had that shot or a vaccine.

It makes two changes, and they are both as a result of some IRS rulings. rulings. The number one, the first change relates to a situation where you have someone who leaves his or her IRA to a trust. In order for the exemption to apply, the marital exemption to apply, the surviving spouse must have the right to require that the income be distributed
to the spouse. This change makes that technical change to bring it within IRS compliance. The other situation arises where a trust is vested in some shares of a closely held company, and this change also brings it into an IRS ruling that the trust has to first pay the necessary taxes and then distribute the mandatory income to the surviving spouse. This is a bill that's been approved and is part of the Arkansas Bar Association legislative package, and it's a bill that the Alzheimer's Association has supported.
And here's what it does. It has Arkansas adopt the Uniform Guardianship Act for adults. What this act will do is that if, for example, someone who had been in Arkansan at one time in their life and was carrying through a guardianship order for an adult loved one in the state of Oklahoma, for example, and they move back to the state of Arkansas, the adoption of this bill will help our courts have an easier time to have that guardianship order clarified, adopted, and ratified in this state.
