have representative Charles Blake come up here with me too because the family I'm about to introduce you to actually lives in his district so we're glad to have them here, Ebony
and Alpha Coben. When we think of stroke, we often think of someone older, but
stroke can actually happen in the womb. When Ebony Coben was about three to four months
pregnant, along in her pregnancy, she went and had an ultrasound done, and measurements were not exactly looking right. And they had more testing, and they discovered that her daughter Maddie had a stroke in utero. But Ebony knew that God gave her this beautiful little girl and brought her into the world and brought her to the most loving home that you could ever imagine for this little girl. I had the pleasure of getting to know her through a nonprofit I run
called I Can. We offer dance classes to kids with disabilities, and Maddie was one of my dancers. Mom and dad had Maddie in lots of activities, and even though Maddie never got to take her first step and never got to say her first words other than uh-huh or maybe give a thumbs up at times, Maddie was able to tell
her parents every day through her eyes I love you right amen right she said it she
spoke a whole lot through her eyes unfortunately she passed away on June 5th
of 2018 that was three days after her birthday her 13th birthday and that happened to be the same week that she was supposed to be in Disney World celebrating with her family but instead she was in the hospital and passed away. So her family really would like to bring awareness to pediatric stroke and especially in utero stroke and has asked that we declare this year on June 2nd, which was Maddie's birthday, Pediatric Stroke Awareness Day. They're planning a huge

Her name is Krista Karstens, and she is from MENA. She recently competed in the Special Olympics World Games in Abu Dhabi with over 7,500 athletes from 192 nations competing. She was the only athlete from
Arkansas to be able to go compete there. Krista won a bronze medal in the 200 meter dash and a bronze medal in the four by 100 meter relay. The USA team captain said Krista has been constantly pushing her teammates to give it their all while also giving her best. She is over my right shoulder today. She is here with Eve Strother from the Polk County Developmental Center. Mr. Clerk, I'd ask that you read the resolution in its entirety.

Vaught, you're recognized to explain the resolution. Thank you, Mr. Speaker. Colleagues, the Arkansas Constitution is a sacred document. It was not meant to be easy to change or to amend. Our forefathers did not anticipate the vast level of special interest group money and outside influences used to take advantage of our citizens' right to amend our Constitution. HJR 1008 is designed to protect the people of Arkansas's right
and to ensure citizens' initiatives are genuinely citizen initiatives and not special interest purchases. This constitutional amendment, HJR 1008, does four things. Three-fifths of the House and the Senate will have to vote to refer an amendment to the voters versus the current half threshold. Three-fifths of the Arkansas counties must have enough petition signatures collected, so it will go from 15 to 45.
The number of signatures required per county is still based on the previous voter turnout ratio and will remain the same threshold as before. We removed the cure period. A deadline for submittal needs to be a deadline for submittal. Finally, we moved up the submittal and challenge dates. Initiated petitions for any statewide measure will be required to be filed with the Secretary of State no later than January the 15th of the year of election.
Any challenges to the sufficiency of the statewide measure will be required to be filed no later than April the 15th of the year of the election. In closing, HJR 1008 was developed with the input of many lawyers and staff from the Election Commission, the Secretary of State's office, the Attorney General's office, the Governor's office, and the Bureau of Legislative Affairs have spent the better part of six weeks working to develop this constitutional amendment so it will be able to stand the scrutiny of legal challenges and still accomplish the protection of our
great document, the Arkansas Constitution and with that I would appreciate a good vote. Representative Vaughn has explained

You Mr. Speaker. I wasn't really sure I was going to come down and speak. I was wanting to ask a question because it seems to be very clear that it says
that the signatures would be three-fifths of the counties, 50 percent of the electors of the county, and the representation that was just made here is that it would be based on a smaller number, so I'd like some clarification of that. But again, the point that I made the other day is that really all we're doing here, we're not putting the referendum process out of the reach of big money. They're the only ones that are going to be able to afford
this kind of high threshold. So let's just talk about some of the referendums through the years that probably would not have passed if you had these kinds of thresholds. 1964 abolishing the poll tax. You think there would have been big money behind abolishing the poll tax? 1996, campaign finance reform. Big money certainly would not have been behind campaign finance reform.
Workers' Comp, 1938. That was a populist movement, but it was not one that could afford the kind of thresholds that you're talking about with three-fifths of the counties and more than 50 percent of the electors of that county. Property tax relief in 1980. 1982, setting the usury rate. Believe me, the bankers would not
have financed that one. The people got behind that one. I appreciate and understand the necessity for us to protect the referendum process but this is this is not it putting it out of the reach of average arkansans who have an issue that comes up that they recognize that they have to speak up as one voice what you're still going to have is you're going to have the out-of-state interests
that are going to be able to come out they're the only ones that will be able to afford this process and these numbers. And I understand there's a whole lot of, you know, heavy clout people that have signed on to saying that they're behind this. And I'm just going to tell you that I think it's an overreaction to a problem that we certainly acknowledge that we have. We could have fixed and I guess have tried to fix through statute of tightening up the paid canvasser process.
There have been proposals that have been out there that says that paid canvassers should have to be citizens of the state of Arkansas. Paid canvassers would not be paid until the signatures are actually verified. Those are all really good items that would make sure that our petition process is not being stolen. But from what I understand, those provisions were kind of rejected because of concerns about Commerce Clause. But those are the kinds of initiatives that we need to make.
We need to tighten up this process of our referendum process being prostituted, being bastardized. This goes way too far. It puts it out of the reach of the common person in wanting to try and have a voice in their government. And I would just ask that we would reject this overreach, that you would vote no. We're raising the counties from 15 to 45. we're raising the number of electors in that county to get things on the ballot the concern i have is we are putting ourselves in a position where we continue to tell our constituents that
we know more than them that we don't trust them to to come up with issues and vote for things that are going to affect their lives we all have our own experiences i can only speak for mine that's why we allow ballot initiatives on the ballot. It's for people from all walks of lives, from all around this state to be able to say, this is what we agree with. This is on the ballot. I get a chance to vote for this. Yeah, I can vote for you, but this is a serious matter that I have the
opportunity to vote for. By raising standards, raising the number of counties, raising the the number of electorates in those counties, we are essentially making it harder. We're making it harder for people to speak their wills. We're making it harder for people to come to the ballot box and say, I agree with this. I don't agree with this. That's not what we're here to do. We've had a lot of changes in this session.
We've sent stuff from the attorney general to the secretary of state. We've done things to ballot initiatives in this session. When the people at home realize what we're doing, they're not going to be happy. This is bigger than special interest groups. This is making sure that the will of the people is somewhat muted, giving people more obstacles, giving people more hurdles, requiring more counties, requiring more signatures.

scared to say this, but this is a DF&A bill, and so I'm just going to kind of read the summary that they had written out for me. House Bill 1932 would increase the number of filers who are required to provide tax filings by electronic method, employers with more than 25 employees for withholding, and tax preparers with more than 10 returns for income tax. So withholding requirements, 25 or more employees will require electronic filings of W-2s, 1099s,
and other records in addition to the withholding annual statement. This would speed up DF&A's ability to process returns and payments, reducing costs, and also potentially speeding up the processing of refunds. And then on the income tax side, tax preparers who file more than 10 income tax returns would be required to do this. This is the same standard as the IRS uses. We currently don't have any requirements for this. And again, this would speed up DF&A's ability to process their returns, reducing costs, and potentially speeding up refunds back to the customers.

This too is a Department of Finance and Administration bill that when we started looking at it we realized they had been referencing to a section of the Internal Revenue Code for state tax purposes. The state has
never adopted the federal grantor trust laws but has been collecting taxes on these trusts as if this section was law in Arkansas. Arkansas is one of only three states who have not done this. We need to pass this as a legislative body to allow the Department of Finance and Administration to properly tax these grantor trusts. We will be adopting those laws as they exist on January 1st, 2019,
which is the latest version of these federal tax laws. This will give taxpayers the balance of this year to plan accordingly for the effective date of January 1st, 2020. I would appreciate a a good vote representative warren has

bill. Colleagues, I bring to you House Bill 1927, which is essentially a disclosure bill. It costs no money. And what this does is it's really a consumer protection bill. So I saw a 60-minute segment where a lot of the controversy around this had been fleshed out
and learned that what is already shared in terms of the DOT number, the age of the tire, is already on the sidewall of the tire. But most people don't know what that is. And so for people who buy tires from very reputable, honest tire stores, they are going to be shared that information. And as a matter of fact, those reputable stores, from a conversation that I just had, will not even sell tires that are outside of the range of the warranty.
But everybody's not honest. And everybody's not reputable. and for many of us who might purchase brand new tires in a store and we see that the tire's not used and we use that quarter test and think because the tread is what it's supposed to be that the tire is safe but you don't know how to read that DOT number so the first is usually four numbers and where we're used to reading dates that give the month and then the year this DOT
number gives the week. So if we're in the second week, it might say O2 and then give 2019. So O219. And again, if you don't know that that is the manufacture date, so if you get 5719, how would you know that that's the 57th week of 2019? And what people also don't know is there have been instances where tires have been very significantly very significant in their age
and they have therefore been dangerous again this does not set a new regulation this doesn't cost anything it is safe disclosure so people can be safe when they could put tires on their cars and with that i'd be happy to answer any questions representative what

Initially, there was a very – actually, that was another one of the amendments. So there were two amendments. The second amendment was brought to me from the AG's office to provide more appropriate language.
And it's basically – it's what they asked for, and it's a very minimal fine, fine, but it's something that would be regulated by the Attorney General's office.

the bill. Thank you, Mr. Speaker. So this bill, what it does is it provides a pathway for cost reporting for assisted living facilities with DHS.
So back at the end of last calendar year, DHS required, or actually CMS required DHS to get cost surveys done for the assisted living programs. And those cost surveys, it was kind of an ordeal. It was done not once, but they had to do it twice and get two separate Milliman studies. And so when we're doing some type of a cost survey, we need to make sure that the data that's submitted in that cost survey is accurate. it. And so what I've done with this bill, and it's been sitting out there for quite a while kind of
as we work through it, it was amended once. So what we're doing in this bill is set up, of course, it goes through definitions of cost reporting and what that will be. And then I have an audit feature in here. And one thing that we did amend out was I had an independent audit, which is still in here, but independent audit was at the cost. The cost would be to the facilities. And that was an overwhelming issue not only with the facilities but with some of the other legislators so we've amended that piece out and anytime there is an independent audit which DHS said would be rare
only if they thought there was some type of fraud it would be at the cost of the department and we go through and I set up penalties and sanctions as well for falsifying the cost reporting data I did make that amendment for some of the facilities as well the the fine that I had in there was too steep when I compared it to the long-term care manual for nursing homes. So I made it match what the nursing home cost report said, which is $500. And then, of course, the worst penalty, which is the same essentially for any other health care agency, is if you commit fraud,
you could possibly lose your Medicaid ID number and you wouldn't be able to participate in the program anymore. But that's standard across all health care providers. So I'll be glad. Let me say this. There was a lot of opposition to this at first. I believe you all have gotten one email from one facility owner that's been opposed to this. There are kind of three factions. This is the best I can tell sitting on public health. We have three factions of assisted livings. We have the one you got the email from and maybe a couple other owners. They are opposed to the
bill. They just essentially said it doesn't matter what you do to change the bill. We don't want it. Then there was another group that, or another two groups, and both of those groups I worked with to amend the language, and they both said that they are fine with the language and understand the need for the cost report. So kind of all I'm down to is those couple of owners, which you got an email for, that disagree with it. I'd be glad to take any questions. Seeing none, I'd appreciate a good vote. Thank you. Flowers, you're recognized to explain the bill. Colleagues, House Bill 1965 is an economic development bill. It's a tourism bill. It's a heritage bill, and it is a bill to help support tourism ultimately in the Delta region.
We have now seven music highways, I believe the largest number of music highways in the country, and what we endeavor to do is to create a commission that would be housed in the Department of Heritage so that we can create a framework to support scale art along the highways and within the cities within two miles of the music, the seven music highways.
All seven music highways are located within the Delta region. And if you think about the kind of similar music history and heritage-based tourism that we've seen develop in Mississippi, in Louisiana, as well as in Tennessee, we really have missed the boat, and we miss out on international tourists who come to the South for that very reason.
If you'll notice on the bill, there are several legislators who have supported this whose districts have a portion of or all of the music highways in their districts. and you know we hear a lot about what we want for the delta region in many of the counties in the delta region we see people leaving and we know what that does to the tax base for those areas for the ability to attract jobs in those areas this is an opportunity with very little investment
to be able to make a big, big change. This is an opportunity to set up a framework that could later be used to generate private dollars. That is why when we met with the Department of Heritage after several conversations, I got a call from the director, Stacey Hurst, this morning, and they are fine with the language and willing to move forward how it is because I believe that she understands, along with the governor's office, who she said she also spoke with, that they understand what could happen,
what kind of progress we could see as a result of an initiative like this that supports the arts, that supports heritage tourism, that supports our music history, and that supports the people in the Delta region of our beautiful

the question I have is this bill is proposing that we create a whole new commission. And as you know, there are currently over 200 boards and commissions in the state. And it seems to be a fairly straightforward project. And I'm concerned about creating a new commission that's going to last indefinitely when it seems like this is pretty straightforward. Why couldn't a current board or commission handle this, Department of Heritage, Parks and Tourism, one of them, versus trying to create a whole new board to do this project?
I'm glad you asked that. So one of the things that Director Hurst
and I talked about this morning is utilizing the current language and utilizing this commission, which would have a very new focus. I don't believe that there are any such scale art projects, especially in rural areas anywhere in the country. So creating the parameters, especially with having expertise for mural art projects, and I believe I was told in Arizona they actually have music playing along on one of the music highways in that state.
But being able to set those parameters in the first couple of years is something that the department is willing to do. And then what we talked about is in the next, after the next, or after this first two-year cycle, then the Arts Council could then be responsible for actually approving the incentive dollars. And so this is actually about a seven-page bill, but it incorporates all of the things
that Bruce gleaned from those meetings and the requests that were made by the directors and other people with regard to those boards. And so without going into every little specific change, I'll just tell you that most of these are technical changes. There are a few that reduce, a few of the changes reduce the terms of the folks who serve and where terms were reduced. almost messed up there because I don't think I actually would have gotten to have spoken on the bill when it came up because it would be immediate. So I'll do this real quick and so what I have answers to a couple of the questions that were
asked yesterday and here's what I say it is what it is if you still don't like it you still don't like it and you vote it down but I just want to give you all the information as I was ill prepared to present it yesterday so one of the questions I asked was how much money do we have outstanding so they sent me the spreadsheet which apparently had I actually been in committee and presented my own bill I would have known it's about 349 million dollars we have for tax years 2008 and prior. It was about a huge amount outstanding. Now, they do have their own collections area.
2016, they'd collected 108 million. In 2017, 131 million. 2018 was 180 million. So, they're continuing to work on their processes, but feel like this is needed to help them get that additional 350 million that they have outstanding. Real quick, to read to the questions, which I answered yesterday, this will be done through normal procurement channels. The contractor will be assigned specific periods of debt deemed uncollectible, and this would be debt that originates just for this pilot program for 2008
and before, and it's not for someone currently paying the department for other periods. The taxpayer will get no calls, they will not get calls from both DF&A and the contractor. As presented in House Committee, the debt's identified that's from periods 2008 or older, $350 million in potential delinquencies that could be subject to assignment, though not all of it will be used for the pilot program. As far as personal information, each assignment of debt will include the information that's publicly available on the face of the lien, such as the
name, address, tax type, and amount owed. There are specific limitations on what may be shared with the contractor. The additional information that DF&A may provide is limited to the current amount due on the tax delinquency if it differs from the face of the lien that was filed. The contractor will not have access to tax returns or other confidential information maintained by the department, only what's specifically authorized in this bill. And as far as what can be levied, when it says that the contractor may collect under a certain statute, it includes the following authority, which is the same as what DF&A
has. The issuance of a writ by execution by the circuit court directed to the county sheriff to levy on the real and personal property of the delinquent debtor. And then for garnishment, DF&A already has a garnishment authority and has increased its use, including bringing in nearly $1 million in garnishments alone last month. This does not preclude the use of a garnishment action. The contractor, within the time of the pilot program, if they are able to identify assets, DF&A has not already levied, and they go through the appropriate legal channels.

the law, when you file a lawsuit to recover money, you're entitled to the interest rate that that money bears if the contract specifies an interest rate. But sometimes when somebody brings a lawsuit to recover money, there's no interest rate specified.
After the person, the plaintiff that brings the lawsuit gets a judgment, until that judgment is paid, it will bear interest. Why? Because you had the loss of the money before you went to court and you've still got the loss of the use of money after you've been to court. So interest will follow that judgment, both before and after. There's been a continual debate for at least the 1980s. That's when I first started practicing what's a fair rate.
Back in the 1980s, Representative Warren and I were talking, 24%, 25% interest rates were being made in the bank. And that's what the loss of use of money cost you, 24%, 27% is how much. Then there have been other times in the last 10 years or so where you have to pay the bank money in order for them to take it when the negative interest rates were being imposed. So continually, these interest rates have to be adjusted by the legislature, and it's adjustment time.
The way that a lot of states have now gone to is key in that to the Federal Reserve primary credit rate. You can Google that. It's 3% today. Add 2% to it. So if you don't have a contract rate specified in the contract or the note or whatever it is, the written document, then it's going to be that Federal Reserve primary credit rate plus 2%. And if no amount is specified in the instrument, the contract, it'll be the same thing after the judgment.
And that will be a flexible, it will go up and it will go down, but it's easily determinable. Maybe the legislature won't have to mess

the bill. you, Mr. Speaker. Members, here it is, what we've been waiting for. For a year
and a half, the Tax Reform Task Force looked over our tax policies in the state of Arkansas to try to make them more fair, more efficient, more understandable, and easier to use. They came up with a bunch of
recommendations, and some of those recommendations are in this bill, Senate Bill 576. And these recommendations for tax reductions and to make some of our tax issues more fair and equitable actually become an economic development bill to treat our tax policy more fair, our businesses in the state of Arkansas more fair, to make us more attractive and comparable
with other states for businesses to relocate here and grow jobs, and also for current businesses to be able to expand and keep them in the state of Arkansas, because we don't want to lose them. There's five parts of this bill that I'll go over, and I'll try to make this fairly quick, and then we'll entertain questions. The first part I want to talk about is the corporate income tax cut. Currently, the top rate for corporate income tax is 6.5%. This bill would reduce
it to match the top individual income tax rate to 5.9% over two years. The first year It would go to 6.2 and then 5.9. That results in a tax savings to individual businesses or a tax cut of nearly $40 million. The second part, second segment of this bill,
is a net operating loss carry forward. Most states have a net operating loss. That means if a business has a loss one year, a substantial loss, they can carry that loss forward and use it as a deduction on subsequent years. Currently, we limit that to five years in the state of Arkansas. There's only one other state that has that shorter period of time. That's Rhode Island, and we're bigger than that.
So we're moving that to a 10-year period that you can deduct these net operating losses. Many states are 20 years, but this is a step in the right direction. Now, that won't kick in until after five years because we've already got the five-year period. But when it kicks in, in the second year, it would be close to $37 million in tax reductions.
Then we get into something a little more complicated. Going from currently businesses that operate in multiple states, we have to figure out how to tax them here in the state. Currently, we have a three-tier apportionment system that takes in sales, payroll, and property. Many states go to a single apportionment, which is just based on sales.
And that's what we intend to do here. It's more user-friendly. It's more fair to the businesses that operate in multiple states. it's actually kind of a wash and actually comes in at about a $700,000 increase per year, but most of the states like it because it's a fairer, easier way to figure their taxes. Now then, for the part you've all been waiting for, the car wash portion.
All right, and there's been a lot of talk about this and a lot of disagreement. Why is this in here? Because, as I said in the beginning of my little talk here, part of this package and the Tax Reform Task Force is making our tax policy more fair and equitable, okay? But previous to this bill, currently at this time, if you have a car wash that you touch
the cars, that means you wash them by hand, or you can put them through a tunnel wash, but you do additional work on them, like vacuuming the inside, you pay sales tax on that, 6.5% on the price of the sale. If you have a car wash, like these tunnel washes that you drive through and nobody touches your car, you pay no tax.
All right? That's not really fair and equitable. So that was included in here. And trying to figure out how to make it fair and equitable has been a, proved to be very problematic. I will say this. This may not be perfect. There are still some car washes that don't agree with the method that we have now. Right now, in this bill, the method would be we tax 80% of the water used at a rate
of 4 tenths of a cent per gallon on the water used in a tunnel wash or automatic and 2 tenths of assent in automatics. While it may not be perfect, let me say this, and while there may still be detractors from this portion of the bill, we have come to a compromise. This rate, this rate is half what it was in this bill when it came from the Senate. And why is that? Because
We got together with the Senate, we got together with DF&A, and we got together with some of the major tunnel car washes that currently are paying no taxes, and this was a compromise that was reached. It may not be perfect, but it's 2% of the bill, only 2% of the revenue in the bill.
this would be a reduction of $1 million per year. Finally, finally, another big fairness portion of this bill, the Internet sales tax. I think we all know all about it. Prior to, let me go back. Some people say that the Internet sales tax, taxing on the internet is a new tax. Well, let me tell you, in 1941, the state of Arkansas passed
sales tax. In 1947, we passed use tax. And use tax means if you purchase durable goods outside of the state of Arkansas and bring them into the state to use, it's your responsibility to pay the sales tax on it, and if you get audited, you will be paying those sales taxes plus penalties if you haven't already. Well, in 1992, the United States Supreme Court ruled that unless a business with the advent
to catalog sales, this was based on catalog sales, before the internet became a big retail mechanism, the Supreme Court ruled that a company had to have a fiscal presence in the state. They had to have buildings in the state before you could make them collect and remit the taxes. So we couldn't do anything. But last year, in a landmark case, State of South Dakota
versus Wayfair, the Supreme Court ruled that if you have a fiscal presence, a monetary presence in the state, and in the South Dakota case, it established that at $100,000 a year in sales or 200 individual sales into the state, then you had a fiscal presence and the state could require these e-retailers to collect and remit the sales tax.
What this boils down to is that retail technology had outpaced the state's ability to collect and remit. But today, with the Supreme Court decision, this is perfectly constitutional. It wasn't two years ago whenever I ran this bill, but it is today. And currently, 37 states have passed legislation to require online retailers to collect and remit sales tax almost identical to the language in this bill. There's 45 states
that do collect sales tax, and the other states that haven't enacted legislation, Arkansas being one of them, are about to. This is about fairness. It's not fair for our local retailers who provide jobs, who pay property taxes, who support our schools, who support our communities, to be at a 10% disadvantage over these online retailers.
By passing this, it would mean an added $35 million per year for the state of Arkansas in the first full year of collection, and about $11 million for our cities and counties who desperately depend upon sales tax revenue to manage their budgets. So you take all these together and put them in all these parts
and put them together in an economic development package and you have a total reduction. you take the income from the internet sales tax, minus the tax cuts, we'd have a total reduction of $30 million. I feel like this package is a good economic development package. It's good for our retailers. It's good for our businesses.
It's good for economic development in the state of Arkansas. And with that, I'd entertain a few

I will say this. It's already on the books. It's been law since 1947 that this tax is due and payable whenever we get the use tax. There again, retail technology has outpaced the state's ability to collect and remit. Now, there are mechanisms, there are examples of where this has been in place. If you ever go out of state and buy a car, and you bring it back into the state of Arkansas,
when you go to license it, you pay the sales tax on it, because the mechanism is in place to monitor and to collect those taxes due. you know talking about conservative values none of us like taxes but one thing for the republicans in here i'll challenge the republicans if you've got your party platform book and you open it up
and you look on the second page where it says the values of the republican party of arkansas the principles of the Republican Party of Arkansas, the next to the last line says, we believe in fair and equal treatment and enforcement of the law. And members, that's what this entire bill is about. It's about the fair and equitable enforcement of the law.
Whether it's our local brick-and-mortar retailers versus out-of-state, whether it's the neighboring states with their tax rates, this is about the fair and equitable treatment under the law. And with that, I
