led by Representative Lane Jean. Man, let's pray. Father God, we begin today by saying thanks and, uh, we have so much to be thankful for. We could occupy all of our time just saying thank you. Uh, we're thankful, uh, that Ms. Gayle Wing is doing better as we prayed yesterday, and she has done better and we're so thankful for that prayer, can you for, uh, Representative Eubanks and uh his successful surgery this morning. And God, uh, they're in a very critical time now in this recovery, just watch over him, pray God that he would continue to do well. Uh, we stand today mindful of the prayer of Moses, uh, it's recorded for us in Psalm 90 when he very famously prayed that our days are 70 years, 3 and 10. And if by reason of strength they might be 80 years, 4 score, he said. Uh, then our days are still like a tale that is told, just a story. And God, it is a short, like every story, our lives have a beginning and a storyline and an ending. And since these days are short, God, they're precious and so Moses prayed, Lord, teach us to number our days that we can apply our hearts unto wisdom. And then when we do that, He prayed to you, God, what I would pray over this chamber today. Uh, that God may your beauty then shine upon us. And by the works of our hands be established. Not only for our lives but also for the lives of our children.

colleagues, it's my privilege today to recognize my neighbor. And his family, Jacob Laughlin, which is up here in the North gallery, who you may know better as Cooper in Landman. And since bringing him down here, I've had never had more people wanting to spend time with me. than ever before. And again, uh, you know, and just being honest about this, it's not only a privilege, but it's also, you know, taking a little thing here for possible career change someday, and that in one of these movies, they may actually be looking for a humble servant of the people, and I'm here ready to fulfill that role if they need that. Jacob is here with his fiancee, Whitney Powell. His little daughter, Amy, Annie, Annie. I've been calling her Amy, I've called her everything but her name, but it's Annie. She's 4 years old and she's been a just a little treat to be here today, well behaved. And then, of course, it's very important person in his life, and that's his mom, Deborah. And At the very first time I met Jacob was actually coaching him in peewee basketball. And Looking at him, I thought, well, I don't know what his career is gonna be, but I don't think it's going to be the NBA. But I'll tell you this about the guy. We, we went over, I took him over, we were playing Danville. Danville had never been beat. The peewee basketball team had never been beat. And by Bush Valley, and they were undefeated during this season. We show up, we start playing, we get to halftime, and we're behind, just by a few points. So, we're within striking distance of this unbeaten team. We go in there and, and I, I tell them a couple of things that they need to know. And one of them is, we're not going to let the fat boy beat us, OK? I know those are mean words. But I wasn't as sensitive back then as I am now. But anyway, I wanted them not to look at this, this bearded 6th grade kid. As this full grown man that he was, I wanted to look at him something that's just a little less intimidating. And so trying to get their mind prepared for this, because in reality, I truly believe that this particular kid was a junior college transfer who had come back to the Danville Elementary in order to work on his academic qualifications. On this because that's how big this rascal was. Well, we went out the second half, and I'll say this about Jacob here. He was about the size of a shrimp back then, but he pasted himself on this big old kid like a, like a stamp. And we ran them to death, and we ended up winning that game. And what I learned about Jacob during that particular time was he's gonna give you what you asked for, and he's gonna give you more, he's gonna give you all that he's got. And I think his mama knew this because when they, when they did the screening of mud. Getting ready to look for people to do that, she read in the paper to come down here to Little Rock and brought Jacob down here because they needed somebody that could drive a, a, a dirt bike. They needed somebody that could run a boat. And he could already talk Southern country, so he had it made as far as that goes. And McIlroy, would you come down here and join me? Come on down here. Here's the other mud man. But Sure enough, he was the guy that they picked for that and and he was neck boned in that particular movie. That was his start. And you watch them in that, they didn't have to coach him, they didn't spend any time. That kid did a great job. Well, that kid has turned to a man, and these are the things that he's been in. He's been in mud, he's been in little accidents, and that's one a lot of people don't know about. But really, He did a super job in demonstrating the emotional trauma that a kid that knew the things that he knew about a friend. would actually go through. And, and it was one of the best things. He's been in Justified Texas, uh, rising, Maze Runner, 12 mighty orphans about the football team. Uh, house on the bayou. Scorch trials, Free State of Jones. Now the Free State of Jones is a very small part. But he nailed it. He got shot right there in the beginning of one of the battles, and, and I've never seen anybody play being shot any better than he was. I mean, except maybe the real guys that get shot. On this thing, but he nailed that particular deal, and I think he, he was shot by a Yankee. And I think that rascal was from Northwest Arkansas, but I'm not sure. Anyway, he was on Go North, Maze Runner 2, Death cure, the son, Joker, and now he's in Taylor Sheridan's. Landman, and he plays as Cooper. And it's incredible the job that this young man who back when he just pee wee basketball. Nobody had any idea what he would do with his life and, and the greatest achievement that he and his mother and and his family has done is the fact that We are so often limited by our self-imposed limitations. He did not allow that to happen to him. He overcome the environment, he overcome everything else that some kid from Fish Valley, Arkansas would have to do. To end up working in movies and not only working in movies, but being a successful actor. Here Saturday, he leaves and they start or season 2 of Landman. He told me it takes about 4 to 5 months to do 10 weeks of that. So he's going to be gone for a little while on this thing, but what an incredible story. An incredible story. One of the other things I want to share right quick though. And, and you probably don't know this, Jacob, about your dad. Now his dad lost his dad a few months ago. It's been a while that he passed away, had a long illness, and it, and it's sad, but, but his dad, I didn't know him when I first moved down to the valley. And his dad Though it turned out to be this incredible individual and the fact that what he did for me one time is we'd moved into the house, it's raining and all that waiting stuff. I look out in my front yard and I'm thinking, is that a sinkhole in my front yard out there? Well, come to find out the concrete top of the septic tank caved in. Now If you haven't experienced that, that's quite a mess. So the first thing I had to do was, of course, get that septic tank cleaned out, and then while that's going on, I'm thinking, I gotta have a backhoe. I'm gonna have to run a backhoe, whatever. Well, Jacob's dad comes driving up with tobacco. Comes in there. We work for about a day and a half, cleaning all that out, get all that mess out of there, get it pushed off, get it out of away from the yard. And I kept asking, OK, how much I owe you? Wouldn't say anything. So I finally wrote out a check that I thought was very generous check. Handed him that check. He tore it in half, put it in his pocket. And then about a month later, I saw that taped up check come through my bank account. But no, no, that's not what happened. No, what actually happened, he tore up that check and he handed it back to him and he said, neighbors don't charge neighbors when they need help. And that is the reason why when he passed away, and he was remembered, I'm not kidding. Western Arkansas and half of eastern Oklahoma turned out. For his funeral. This was a guy that worked construction, had a construction equipment, and everybody loved him. That's what kind of daddy you had, Jacob. He was a good man. Anyway, I would appreciate a good vote on this resolution. I think we got a fine example of what a young man can do here in Arkansas, and McIlroy, would you like to say a couple of words? I

Walker Sr. was an attorney and civil rights activists and a politician who served a member, as a member of the House of Representatives from January 2011 until his death in 2019. And whereas John W. Walker Senior attended Henry C. Yeager High School in Hope, one of the few schools in rural Arkansas that provided a high school curriculum to black children before moving with his family to Houston, Texas in 1952 and graduated from all black Jack Yates High School in 1954, and whereas John W. Walker Sr. was the first black undergraduate student. Admitted to the university of Texas after the United States Supreme Court's decision in Brown versus Board of Education in 1954, but he still was not allowed to attend because of his race, and whereas John W. Walker Sr. was also accepted to attend Howard University in Washington DC and where's John W. Walker Senior attended the University of Arkansas at Pine Bluff, then known as Arkansas Agriculture Mechanical. In normal college for his undergraduate degree in New York University for his master's degree, then obtained his juris doctorate at Yale University, and whereas John W. Walker Sr's first place of employment as an attorney was the National Association for the Advancement of Colored People's Legal Defense Fund in New York City, where he remained associated as a corporating attorney and later as a member of the board of directors of the National Association for the Advancement of Colored People's Legal Defense Fund. And whereas in 1965, John W. Walker Sr. began his law practice in Little Rock with an emphasis on civil rights and in 1968 opened one of the 1st 3 racially integrated law firms in the South. And whereas between 1965 and the time of his death, John W. Walker Sr. was personally involved in most of the reported cases involving racial discrimination in the state of Arkansas, many of which created new law and open doors to all races and schools and places of work throughout the state of Arkansas and surrounding states. And whereas John W. Walker Sr. was in intimately involved with the legal battle to desegregate the Little Rock School District began by the late Wiley A. Branton of Pine Bluff and a future Supreme Court Justice Thurgood Marshall and Walker filed scores of successful lawsuits in federal courts to force Arkansas school districts to integrate or provide co-equal learning environments. And whereas John W. Walker Sr.s early cases often involve classes of people discriminated against by large corporations due to their race, and whereas by 1970 John W. Walker Senior had become famous statewide for his nearly two decades of prominent and tireless civil rights activism and was appointed to the Board of Education by the Governor. Winthrop P. Rockefeller, but was not confined to serve on the Board of Education, and whereas one of John W. Walker seniors later cases was the only nationwide racial discrimination case ever successfully brought against Walmart and involved black truck drivers, and whereas John W. Walker senior received numerous awards from bar organizations including the American Civil Liberties Union, the National Association for the Advancement of Colored People's Legal Defense Fund and the 2004 Southern Trial Lawyers Association War Horse Award, and he was inducted into the Arkansas Black Hall of Fame in 1999. And whereas upon his death, the body of John W. Walker Sr. lay in state in the rotunda of the State Capitol building on his pitch and his picture remains on the wall of the House of Representatives' quiet room. He came to me and he said, You've had cancer. I said, yes, sir. I I said, I understand that you've had it too, and he said, I did. He said, we'll be soul mates and pray each other through this situation with it. Not a week went by. Maybe not a day. He didn't walk to my seat over here. You say, how are you doing? How are you feeling? And you remember things like that. For those of you who've had cancer. Like right now And others suffered too. About Some of us too bout with cancer. But we're still here. Moncrief led the Razorbacks to the 1978 Final Four and a memorable victory in NCAA consolation game showcasing his talent and leadership. His incredible career continued in the NBA where he became a five-time All-Star and a two-time NBA defensive player of the year. Moncrief's contributions to the game were honored with his induction. It was very difficult for them to recruit African Americans and Sydney Monrete, Ron Brewer, and Marvin Death. They were considered the Trail Blazers. Without those guys, the University of Arkansas basketball program will still be suffering today. Sidney Marrie played a very important role in getting the University of Arkansas on the map. Not only We'll see a great ball player, but he's also a great individual. And when I was growing up, we would all go up to Dunbar Community Center and played basketball. Needless to say, uh, Sydney was a lot younger than I was, but he would still come up there and play with the guys that were older than him, and that helped develop his game. Not only that, Uh, he's become an icon in our community, and he's a guy that We all would want to have our kids to be a model just like Sydney Monree because he is an excellent, he was an excellent ball player, and he's an outstanding individual. Members, this bill provides for the recodification of Title 19, uh, as we've heard, uh, time and time again from Representative Gazaway. We have the Arkansas Code Revision Commission that reviews, uh, statutes to make technical corrections. Many of these relate to grammar, punctuation, organization. They're intended to be non-substantive changes, as we know from time to time, it becomes necessary to look back at how the code is put together because over the years, as we pass various bills, That becomes part of the code and The code revision commission, uh, commissioned a review of Title 19. So the Arkansas code is divided into, into titles, what you might consider like chapters of a book, and that is what provides the organization, the code. That's what allows citizens, the legislature, attorneys, and all folks in between to be able to find the particular laws that they're looking for. And so this working group that was put together had members of the Code Revision Commission, the Governor's office, the Attorney General's office, the State Claims Commission, legislative audit, the auditor's office, the treasurer's office, DFNA, the Ethics Commission, the Bar Association, and the Department of Transformation and Shared Services, we're all part of this recodification effort. And so this bill is intended not to substantively change the law, but just merely to reorganize and better organize, uh, that particular part of the code, and you can see some of the highlights include Uh, using subtitles, uh, for the material. It, um, reorganizes chap subchapters dealing with state treasury funds because we were actually running out of numbers and what was explained in the committee was that we number 1 through 99 and since we ran out of numbers, we had to put certain items in other parts of the code. And then finally, it transfers some material out of Title 19 to more appropriate sections of the Arkansas code. And so, Uh, with that, this is a necessary part of, of organizing our code. It's gonna provide for better organization. It's ultimately gonna be better for us as legislature, better for and better for Arkansans. I'd appreciate a good vote. Colleagues, uh, House Bill 1527 is a bill to make it easier for parents to have the freedom to invest, um, their minor settlements, um, the way it works right now is that we by statute have some restrictions on how parents can spend money, um, that has been awarded to their child, um, as a settlement for say a car accident or some other injury. And by statute, there are a list of permissible investment. 529 plans do not make that list, and this was brought to me by a mom who wanted to make sure that her child's minor settlement was put into his 529 plan, um, and was told by a judge that he was unable to grant that because of the fact that it wasn't specifically listed in our code. So what this does is that it says that parents who receive minor settlements for their children have the option to invest that money into a 529. Plan as my friend Representative Ray pointed out, it also gives the parents a nice little tax break for the, um, uh, for the contribution into their 529 and it is, uh, limited to the Arkansas brighter Future program. House Bill 1291 is very simple, build narrowly tailored to minor league baseball players and what this does is simply defines them as employees within the Minimum Wage Act, um, what happened was in 2023, Major League Baseball signed a collective bargaining agreement for the first time ever with all of the minor league baseball players as well. So they have signed on to this deal. They are employees within the Major League Baseball structure. Their salaries have more than doubled. they've got uh tuition benefits. They've got retirement benefits, medical benefits as well. This is supported by Major League Baseball. It's also supported by the Major League Baseball Players Union. It's going to establish the Interstate massage Compact for the state of Arkansas, and this bill does exactly what it says it's going to do, which is providing an additional pathway to licensed massage therapists to practice in Arkansas and any member state within the compact. This compact would be completely optional for licensed massage therapists in Arkansas and in no way negatively affects a licensed massage therapist. who would seek to become licensed and practiced only within the state. The true value that this compact provides and problem that it solves for Arkansans is that it removes barriers, providing mobility and portability of their licensure, opening up opportunities for licensed massage therapist while providing safeguards to ensure that we keep the bad actors out and ensuring that Arkansas stays at the forefront of this industry. I believe the best way to demonstrate how this compact provides value is by highlighting a few examples of how it can be implemented. In the committee I talked about just last year, we had a, uh, a natural disaster. We had a tornado followed by a, a flood in my district. If a licensed massage therapist here in Arkansas was displaced due to a natural disaster such as that, or we're, uh, or where they found it necessary to temporarily relocate for any number of personal reasons, the compact would allow them to practice in a member state, providing a constant source of income and maintaining the current way of life to the best of their ability. This impact not only helps Arkansans with mobility and portability, but also for individuals seeking to move here to our great state. We know that Arkansas is the best state in the nation for people to live, work, and raise a family. And as they are coming here, many of those, uh, have to maintain households in two different locations until they fully relocate. This compact would give those individuals the ability to begin to practice here in Arkansas, coming from a member state, providing valuable service to our communities while ensuring They are afforded the best opportunity for success. The Department of Defense sponsored the research and development of this compact, due to the requirements of military families having to relocate and creating disproportionate gaps in employment compared to their civilian counterparts. The Interstate massage Compact can make positive impacts for military and civilians alike. There is a fiscal statement attached. You can see it's showing $15,000 initially with a $6000 per year afterwards. I did speak with the Department of Health after receiving the statement, and they said that was the best guess, uh, that they could come up with. Uh, they did, however, feel that the cost would be much lower. This compact has been overwhelmingly supported by licensed massage therapists within the state, some of which have said that they plan to join the compact. Others who do not uh currently plan to join the compact, however, they do see the value in it. Uh, one final item to highlight is that the Compaq's executive committee will be comprised of the 1st 7 states joining the compact, allowing Arkansas to have a seat at the table and a vote as rules are promulgated. Keeping Arkansas on the forefront of this industry, while ensuring additional safeguards. are in place against bad actors. Represent. This bill opens the pathway for anesthesia assistants to practice here in Arkansas. Uh, anesthesia assistants are healthcare providers that are trained to provide anesthesia care. They attend, uh, uh, a four-year college, you get a bachelor's degree. During that time, they're required to take certain prerequisites, the prerequisites they take are the same as what one might take to go to medical school. Upon completion of the degree, they apply to an anesthesia assistant school, uh, This requires an entrance exam. Many of these schools require the MCAT, which is the same entrance exam that medical schools take. Once these individuals are in their school, they get an extensive amount of training in anesthesia care. Uh, what they're not trained to do is practice independently, so they're different in that way from a CRNA. So CRNAs in our state are allowed to practice autonomously and they're very well trained for that, and I support that. I support their practice, um, anesthesiology assistants are trained to practice under the supervision of a phy So to give you an example that you might understand that an APRN, most of us know what nurse practitioners are. They practice here in our state, and they are allowed, and I'm grateful for this, helped pass this legislation to, to have a pathway to practice autonomously and well they should. There are also physician assistants that practice here in the state. They're trained differently. They're trained differently than APRNs and they have to practice under the supervision of a physician. This is the same type of parallel. So if you can think of a CRNA as an APRN. And thank you an anesthesia assistant as a physician assistant. Currently, these individuals are allowed to practice in over 20 states, including Missouri and Texas as well as Oklahoma, um, we have a workforce shortage here in the state. We have a healthcare workforce shortage specifically, and we have a shortage in anesthesia care. Uh, there are hundreds of jobs listed on the internet available for anesthesia in our state. It's a way to collect information on physicians to try to streamline the credentialing process for both insurance companies and also for hospitals and clinics, uh, as part of that, the medical board collects certain items of information. One of the things they've traditionally collected is uh information around the provider's DEA number. That's their. Drug Enforcement Agency number allows them to prescribe controlled substances. Um, the medical board was contacted by the DEA last spring before last, and there was some question about whether that was legal to collect that and put it into a database, uh, after discussing with the AG's office, the feeling was that maybe we shouldn't be doing that. And so we're just not going to be collecting the DEA information anymore and putting it in a database for at the medical board. The information is still available to any insurance company hospital provider, anyone that wants to, uh, employ that or credential that physician. It's just not going to be in this state. This bill establishes that secretaries have to come report every year and we never met the deadline from the day that bill was put in place. One reason is you would schedule 3 secretaries per council meeting from June to August to September and October 15 secretaries, and one of them would have a sick wife. uh, vacation. And then when you reschedule them, it, it had to be the secretary. I want you to follow me here. It could not be a designee of that department had to be the secretary by this law, and you never met the deadline. So we broke the law every single year in council trying to get these secretaries in. So all this does is eliminate that. Now the chair can set up those meetings. The other thing that happened was these were always at the end of the agenda. Guess what? No one was in the audience. No one was listening. No one was there to hear the reports. It just did not work the way Representative Mark Berry thought it was going to work. And right now the way that process works is the governor does that through executive order, and there is no transparency when the governor makes those purchases under an executive order. And so when I'm talking about non-licensed, we're talking about our janitors and people that are not teachers in our schools and right now in the state of Arkansas, licensed employee if they have a disqualifying offense, meaning a DWI or a drug charge that was like a marijuana charge back in the day. They currently have to go to the state board of education. a waiver to be a non uh certified employee. If that uh waiver is granted by the Department of Education. It's good forever for our non-licensed, if they go get that waiver, it's only good for 5 years and they have to keep reliving this offense over and over and over at their school board meetings and things of that nature. And since we passed the bill just recently that we have to record all of our, our school board meetings and post it, this has to be they have to keep reliving this in their communities even though. they may be upstanding citizens. So all this bill is doing is saying once you get the waiver as a non uh certified employee that your waivers is good as long as you stay employed with the school. Now we do have safeguards in the bill. So if that employee were to say leave the school and take another job and want to come back. They've got to go back and get the waiver. The legislation addressed a critical gap in healthcare decision making, and this allows a medical surrogate to step in when an incapacitated person has no legal guardian. I want to be very clear, the word surrogacy and surrogate in this bill has nothing to do with pregnancy. This is, uh, specifically a surrogate who is able to make medical decisions for somebody who's incapacitated. Following the implementation of this law, a challenge was discovered and some financial institutions had reluctancy to provide certain financial information, uh, with concerns of federal privacy laws. This bill was designed to solve that problem, ensuring that banks and financial institutions can comply with surrogacy requests without legal risks. And this also puts safeguards in place to prevent abuse. This bill was drafted in close collaboration with the Arkansas Bankers Association and has strong support from both hospitals and long-term care providers who see this as a necessary tool.
