you're recognized. Thank you, Mr. President. Members, what this bill does is it allows our developers to request for a third party inspection from our municipalities or counties that have plan review programs or
inspection programs. So currently, most cities or counties that have this, you submit your plans. Per their application requirements. You wait for them to approve your plans and issue you a permit that could take 2 days, it could take in some cases up to several years is what I'm being told by a few developers, and in that process you're going back and forth trying to get them satisfied maybe to code, maybe not to be the code as far as what the code requires, and you, you got
relationship issues but the whole time what is suffering is the development of that project, and all the soft cost that goes along with it, the money's borrowed, waiting to be spent, um, accruing interests, so there's a lot of, a lot of delays that can occur in that process. So just speaking of the, of the permits authorized portion. What this bill would allow is when you submit that to the city or the or the county. They have 5 days to tell you if your application is complete. That's an existing fast track permit.
If they can give it back to you within 60 days. And agreed that they can get you to your inspection requirements within 2 days, they will tell you this, hey, we can, we can meet these requirements at any time though, you can say I want to provide my own third party at my cost. Or you can ask them if they say we can't get that, you can ask them to provide a third party at their costs. I don't see foresee any city absorbing those costs for you when you can pay for it yourself. So what they will do is they will then allow you to
go hire your own third party reviewer. Then you at your cost as an applicant engage that third party. Now that third party can be a registered architect, which is governed by our architectural control board, uh, it can be um A registered engineer, which has its own engineering board, or it can be a third party that is approved by the city that meets their requirements that maybe sits in their own office. So that's actually a good change that was recommended by the municipal League itself. So once you engage in that
contract at your cost, they will review the plans. They will certify the plans meet all code requirements, whether that's international code, whether that's local ordinances, it meets all requirements because typically, that's what the plans are designed to do. So they submit that to your local municipality or the county. The county or the city has 10 days to determine if everything that was reviewed is accurate and reflects the intent of the codes. If it does not, they submit that
back in writing with specifically what the problem is. And then that can go back and forth until everybody is satisfied and it moves forward. Therefore, it takes the burden off the local group and puts it on the applicant. If they come to a dispute, there is a mechanism in here that allows them to petition it to the city council if it's a local rule or ordinance or to the Department of Labor and Licensing, which is over all these regulatory boards, and they will promulgate a rule that says which which area it gets
funneled into and then that problem will get resolved and it'll move towards permit. So the permit gets issued. We can start building. It shortens that time frame. It gives clarity, it gives consistency, because when you have builders that do this consistently among multiple communities, there's different requirements for different cities and different relationships and different personalities, and this will provide consistency for our developers or our builders. So once the project is underway, you go into the inspection
space, same thing, third party inspectors authorized at the cost of the applicants or the builder. So the third party, you call the third party for inspection, they will have a set time and date that they will then in email or in writing, send to the city where the city has the ability to be on site present for that to occur. They can choose to be there, they can choose to not be there, but regardless, uh, that report, that inspection report will be sent to the city saying this is what we've got. Then the city has one day to
determine if that meets their requirements. If they do not say anything, then the build moves on. If they do say pause, pause what you're doing, then they can start having that investigation into that that failed inspection. So that process goes on, there, there are some exclusions in the bill. You cannot use this process for certain of our of our larger facilities such as hospitals, healthcare centers, nursing homes, jails, penal institutions, airports, buildings or structures that affect national or homeland
security or building defined as a high rise to exclude tenant infills within that high rise. So secondary piece of it that I think is uh really beneficial for our developers and builders is the the insurance requirement. Currently, if you have a builder, build to what they think is code. Spector comes out, specs it says it's two code, and it fails. The applicant or the owner of that, if it does fail, has to pursue. The builder, ideally they'd like
to the builder will actually defer that to say, hey, this was inspected, here's my my approval. This is all, it was too code, but in the day, it becomes a circle of cities are not liable. This bill does not change that regardless of the third party or home, it is the cities are still not liable for anything that goes wrong because they have their own immunity. But the third party inspectors required to have uh ENO insurance. That way if there is an issue and the applicant can prove that he failed his due diligence and his duty. They can
file against his ENO and be compensated to get that damage repaired. So That is in essence what the bill does, um, I, again, I, I think uh I told the story in committee, you know, I was in at Georgia Tech, whenever I was watching the process and the amount of building and growth that goes on in Atlanta and I happened to just be in awe of some structures going up. I had a visit. They actually said that that Georgia passed something like this, and it's been very successful within that state. I looked up the bill. I sent it to
VOR. VLR amended it. When I filed it to Missleague reached out and said, Can we look at it and maybe make suggest some amendments, and I said absolutely, that's, that's reasonable. um, when he came back, he had really just reorganized and restructured it to make it seem better and fit better. So while, while municipally probably didn't come and speak for it. I believe that this is a good bill and it'll do great service to our developers and ideally keep costs down amongst the community. years old. When she was 7, she set her first state record, OK. One day she woke up when she was 16 years old. And she had blurry vision, and ultimately that led to a diagnosis of multiple mitochondrial gene deletion syndrome. Did that stop Olivia? No, it did not. I'm gonna, I'm going to give the punch line first before I read her other accolades, but at the Paris Paralympic Games
in 2024, Olivia won a gold medal in the 400 m freestyle.
Yeah, pretty, pretty incredible. She won 2 silver medals at the Olympics last year as well. And the year before, and the world championship in Manchester, England, she won 2 silvers and 4 bronzes. She currently holds 7 pair of swimming American records and two pair of swimming world records. She's an 8 time medalist at World Paris Swimming Series meets. She's an eight-time champion at United States Paralympics swimming national championships. She graduated from Mount St. Mary's same institution as
Senator Irvin, and she now goes, she attends the University of Northern Iowa. She's not just a world class athlete. Thank you, members. I appreciate the conversation about this, and I to Senator Petty's point, you
have mental illness that causes this type of a behavior. You also have medical conditions that cause this type of behavior, and what needs to be clarified to a physician that's dealing with a patient that's coming into the ER or into a clinic or whatever, they need to have the same level ability to deal with that patient to protect, to protect the patient or others, whether it's mental or medical derived.
That's the purpose of the bill. So yes, this does happen, dementia, dementia is not a mental illness. It is a medical condition, encephalitis is another medical condition that can cause severe behavior problems and issues. They literally have an infection in their brain and their brain is not able to function clearly in order to determine and logically understand and reasonably understand that this behavior is
acceptable or not acceptable. And so encephalitis is a very clear infection of the brain that does result in type of behavior that we're talking about here. And these medical doctors and professionals absolutely do have the ability within their power. to treat that medical condition. Part of treating a medical condition is being able to step in and uh and, and, and do what they need to do for the patient
and being able to hold them until they can get that infection under control, so they're not displaying behavior that is uh harmful for themselves or for others is really critical into the care that they're trying to administer for that patient. Just like Senator Petty said, sometimes it's a matter of medication, and I know for I deal with the same thing with my mom and dementia. If she does not have that medication can become very combative and very
hard and difficult to deal with. And so I, I think this is a very narrowed bill. I know that they went through their due diligence on the bill to make sure it checked all the different levels of concerns, um, and I think that's why you see this. On page 2 and page 3 that you have very, very, very tight controls there. Um, to Senator Hammer's point, yes, like if, if the APR and is working in that, in that setting, then they are working under their scope, and
this would fall under that scope, yes, um, but I'm happy to try to answer any questions. Legislation needs to be passed to treat players as exempt
salaried professionals by providing a narrow narrowly tailored exemption from some aspects of the state's wage and hour laws, including minimum wage, overtime, mandatory meal periods, mandatory rest periods and recordkeeping requirements. The MLB and the Players Association are in joint support of the proposed legislation, a co-signed letter from the MLB and the MLBPA expressing support for a legislative fix in Arkansas has been placed on your desk.
Applying wage and hour statutes to minor league baseball would be, would dramatically alter how players are utilized and how games with minor league players are played in Arkansas. Under the terms of the new CBA players are treated as salary employees and receive weekly salaries throughout the calendar year. This includes for the first time, salary during spring training in the offseason, a significant new increase in regular season salary.
There are approximately 59 minor league players assigned to teams playing in Arkansas each year. Uh, this agreement will overdo their current salaries. Other benefits that minor league players receive under the new CBA include but are not limited to. I know y'all like that language, don't you, Peyton? Um, Uh, health benefits, housing benefits. Meals, tuition assistants, retirement benefits,
And salary continuation in the event of disability resulting from a work-related injury. Given the unique nature of the work performed by minor league players, neither teams nor players would be well served if players were forced to have their hours tracked or saw their playing practice or training time limited to avoid overtime, a legislative fix is needed.

is the last of the judiciary bills that I'm running today. The one of the things that it does, page 3, line 34 is beginning with line 34 is the funds collected in district court matters, the county Administration of Justice Fund may retain an amount equal to but no more than 50%.
Uh, we've had Uh, currently have counties paying 90% of that in. We have counties paying none of that in, and so this is a compromise, those that were paying 90 will very much like this bill because they're only gonna be paying 50%. Those that were paying none won't like it as much, but they're gonna be overall happy because it says that we are no longer going to pay the salaries of state district court judges, and clerks from local
uh, uh courts and city councils, but from the state. So they should all be happy and there has been no opposition against this bill. I'd be

That's 100%, but a lot of times it's 2030, 40%, and this, the new law, you said red 90, I thought it was 100, but whether it's 90 or 100, they pay a one-time fee and then however long it takes to pay it off. There is no more faith. Now if they have a new court case and new costs and new fees, there's, there would be a new $100.

years, their units have hollowed out. Where a squad should have 10 soldiers. It might have 7 or 8. And so those young men and young women, they're out like during the last weekend, working on storm damage. Where they should have 10 or 20 working in these different units, they're going to have 7 or 8. It's come to the point where it's gonna deregate their uh
performance if we don't do something to help them. Now, the recruiters are not gonna go willy-nilly into the schools without calling and making appointments. They'll schedule appointments with the guidance counselors and show up at that time and they'll use the facilities that the schools have set aside. And with that, I stand
