So all of you will see socks on your desk, um, we celebrate oral Down Syndrome Day with crazy socks, so that's from the Arkansas Down Syndrome Association. And you'll see a lapel pin, it tells you a little bit about what crazy sock day means and
why you have those on your desk, but I know that we're in an intense time obsession right now where emotions and tensions are running very high, so I just want to leave you um with a little bit of information today as we're about to leave for a week to reset with our families. Um, there was some research done in 2011 on the self-perception of people with Down syndrome. Research found that 99% of people Down syndrome indicated that they were happy with their lives. 97% of people with Down's
syndrome that they researched liked who they are as people. 99% expressed love for their families and 97% liked their brothers and sisters. So I just want to say let's take a little bit of time over the next week, um, as we're in recess to consider what we can learn from people about Down syndrome, about liking ourselves, being happy with our. own lives and loving our families and loving our friends and those around us. members. Senate Bill 83. Really critical bill for any any woman that's going through breast cancer, because after that fight for survival to be made whole again. We have insurance companies that refuse to provide the adequate care they needed to get back to their original selves as best as
possible after a long battle with cancer. So what Senate Bill 83 does is it pairs. With the Women's Health and Cancer Rights Act of 1988 to ensure that all surgeries that are required to get them back whole that are that are pre-approved and recommended by that physician will be covered by our insurance providers. Now there was a concern that the coverage was lapsed because maybe the cost was too great on the front end and insurance were just companies were protecting that revenue for themselves, but the quality of life index in all
these studies say after 2 to 5 years, the cost impacts are negligible to the two, but the quality of life is dramatically improved. on certain surgeries. So what this bill allows is for the women's right to choose which surgery is best for her and have it covered by her insurance provider. Spotty passed a record ceilings Act to allow those that are convicted to seal their record after certain steps to go through to shield their their record as a matter of law. A couple of years ago, we passed an enhancement law for theft of property that would if you kept basically kept stealing your charges would be enhanced up into the felonious areas.
What we did not do is include that issue onto the Record Ceilings Act as one item that's exempt. So we, we've included that for battery in the 3rd degree indecent exposure, public sexual indecency, DWI, anything that has an enhancement on it, you are prohibited from sealing your record until that look back period has ended. What this bill does is add that theft statute into the exempt until the lookback period is over before you can enhance the until you can seal your

One is that it's anti-transparency, and the other is that it's anti-clarity on, on transparency, the public deserves to know what decisions are being made about their lives by the bodies that govern their lives and Granted, the way the bill reads, two people can have a conversation outside of a meeting, and it takes more than 2 people to make a decision, but it doesn't limit those two people from continuing to have other, other one on one conversations with other members
of the governing body outside of the public meeting, and it's very easy to see how you could quickly have a daisy chain of conversations that take place with the entire governing body such that a decision is made outside of the public meeting, outside of the public's hearing. And that's, that's why it's anti-trans. parency, the public deserves to know not only what decisions are being made, but also why they're elected officials are making those decisions. The second reason is that it's anti-clarity and you know, I'm speaking on 376, but
we had another bill 227 that we spent a ton of time working on with every FOIA stakeholder that exists in the state of Arkansas. Association of Counties, municipal League, School Board Association, and then also, you know, the Press Association, the FOIA task force, Rob Sobug, Joy McCutchen, Jimmy Cavin, John Tow. Every FOIA stakeholder supports the other bill because it provides clarity to the law that is lacking right now. This bill 376 does not provide that clarity, and it will muddy the waters because it's, it's
virtually impossible to reconcile 376 and 227. So we worked really hard with all of the FOIA stakeholders to bring clarity to what can be said and what cannot be said in a public meeting with 227 and this would be taking a step back. Um, the point made in 227 that I think is is missing in 376, the number of people having the conversation. doesn't matter. It's the substance of the conversation that matters. If you're, if you're having as in 227
language, a background in non-decisional conversation, then you can have 8 people who are members of a governing body in a conversation, and that's permissible. But if you're deliberating about official business of the governing body, that's not permissible and that's not permissible whether you have 8 folks having that conversation or 2, because to finish where I started, if you have two people having that conversation, 2 + 2 + 2 equals 6. Now you A quorum. Now you have a decision being made outside of the public's presence, so I'm happy to take a question.

you could clear that up, but the meat of it is if, if it is an LLC as it's written, if you look there, it says grant or grantee, OK, that's in, that's in section F1A. But if, and this is how the vast majority of commercial transactions happen. If It is a, let me get to that, uh, It's line 10 on page 2, subdivision F1 of this section does not apply to a deed to real estate that is presented to the
recorder by an attorney, real estate broker, real estate agent, representative of a bank, mortgage company, or lending institution, a title insurance agent. So most of the recordings are going, especially for the LLCs, even though they may or may not have individuals there are going to be recorded by those. There's very, very few that are presented for recording. outside of an attorney or a title agent or I'm not saying it doesn't happen, but those that are listed there that are exempted or excepted from that
law. And so I think what we're trying to do is capture the individual bad actors, and there may be some LLCs, but if, if, if that's the case, then they're going to have to present their information in the form of the ID under Section 2 in that subdivision. What it does is it allows the treasurer's office to get the information that they need to identify each child so of 529 account can be set up in that
child's name. It's the same information that they get from parents when parents set up a 529 account for their own child. There's the same protections in in place in terms of the data. The nonprofit organization that's contributing the money to the 529 accounts we'll never have. access to that confidential data, that will stay exclusive to the Treasurer's office, same as it is when a parent sets up their own 529 account, sets up a 529 account for their own child. So this also gives the ability of a parent of a child to opt out if they want, so there's, there's no mandate, it's just

And I have the wrong will here, but I think I'll wing it from here, around homestead exemptions for totally disabled veterans, uh, we made that, we rolled it back from whatever it was before to, uh, I believe 40 acres, which is where it sits today, and one of the unintended consequences in that was that we had a number of veterans that were totally disabled that had
acreages that were bringing them in and therefore increasing their property taxes. As an unintended consequence for these disabled veterans. We've, we've made it clear as this body and as the legislature that we want to be welcoming to our veterans and, and especially those that are 100% disabled, and what this bill would do would roll back and give up to 160 acres as an exemption for under the homestead exemption. The other issue other than
property taxes going up was around what was involved to to carve up. They had these large tracks or multiple tracks, and in order to do this, they had to uh they had, they would have to get surveying done and and and lot splits and lot consolidations and things like that, acreage, and so it was adding some administrative costs to do that. Um, This bill is uh It's kind of an extension of, of, of bill we passed in 2023 by Representative Acer, which brought consistency across the state for police officers who reached retirement age but we're not yet to Medicare age, allowing them to stay on the health department of the city or
county. They retired from. Now this bill just extends that same courtesy to retired firefighters. It simply states that a firefighter retires but is not yet eligible for Medicare. They can stay on their city's health insurance with the approval of the city, uh, until they reached Medicare age. It's understood that likely the city will, will require the retiree to pay the full cost of the monthly premium, but ultimately that's left up to the city if they want to extend that benefit to one of their employees, they
could, but it's totally up to them. And it gives us our retirees that are firemen and additional choice when planning their health insurance needs during their retirement. Now, most cities are already extending this privilege, but we just want to make this consistent all the way across the state and that they're all on the same page and no retiree is being missed, as well as to ensure that the firefighter retirees are treated the same as our police retirees were. homestead, 10% for all other property. The provision in that is though is if you have a substantial improvement, you can, they can actually tax you on your that current assessed value or current appraised value. What this bill does is align all the counties the same direction under ACD that the substantial improvement means any improvement to real property that increases the value by at least 25%. There's an issue where counties really didn't have a definition of what, what that threshold was so this
establishes 25%. Additionally, it requires that the repairs to real property during a storm, not count towards those improvements of 25% unless they use different materials. And so there's an issue with that during the recent storms we've had and then the final provision talks about determining the true market value, you can't use out of state comps unless there is no other cops and then only for commercial purposes. They go out and make a run on the interstate. They expend a lot of expenses like putting foam out on a diesel fire or something like that, and then they go to get reimbursed by the insurance company, the Federal Emergency Management Agency FEMA has a rate schedule. They use that rate schedule in order for the insurance company to know what the reimbursement rate is supposed to be since
2013, it is lagged behind by as much as 20 to 30% because in law we've got it locked in at 13, and so the insurance companies are reimbursing 20 to 30% less than what FEMA actually allows. And so what this does is allow for the reimbursements to catch up with what FEMA is reimbursing now. The question was why are we putting in or locking in a date. The reason not is so that it can fluctuate, that is FEMA rates adjust, which nobody could
remember the last time that the FEMA reimbursement rates went down, so it's unlikely that they're going to go down. Nobody could remember the last time they went down, so as they go up, they would be able to keep real real time reimbursement rates, keeping pace with the adjustments of the FEMA rates, and that's what the
