Representative Barry you're recognized explaining the bill thank you Mr chairman colleagues my last bill for the session so this is a good consumer protection a bill what's happening is we have a check kiting scheme basically using tobacco products among tobacco wholesalers and retailers so what's happening is tobacco retailers are buying getting tobacco products from the wholesaler and then not paying our bills and I'll go to another wholesaler and get product and not pay their bills and it's just never ending so you know we collect about a quarter of a billion dollars in taxes from wholesaler's with tobacco products and we need to provide them with some protections but the this bill will provide for notification of a if I retailers not paying their bills tobacco control board will notify the wholesaler or the the wholesaler other wholesalers that the bills are being paid so they won't sell to these particular retailers till they get their bills paid now represent a Ferguson brought up in the rules they want to see an amendment dressing the due process and that amendment is already drafted by the attorney general's office and tobacco control board working together in is down on the of the Senate in others no other opposition other than the fact that tobacco control needed a hundred sixty thousand dollars for one person and representative Wardlaw a very capability answered that the issue with D. Thank you Mr Speaker thank you colleagues so today is an exciting day although it has been a rough year for many or Kansans I would say this bill is a great opportunity to help rebuild our economy and get Ark our Kansans back to work so. What this bill does is it looks at economic conditions and it changes unemployment duration accordingly. The inherent logic of the bills when things are good. You don't need as much time to look for work when things are bad we're going to give you more time so we're at sixteen weeks right now for unemployment what this would do is change it to based off of what the unemployment rate. If things are going well right to take it down to twelve weeks things are going bad the ceiling would be sixteen weeks there's concern from DWS on this bill and mostly of most of the concern that they express was referred regarding implementation of the bill their system is very outdated we are certainly sympathetic to the position they've been in with everything they've been having to deal with during the pandemic that's why we made several amendments and public health we went from making it retroactive to change in a year to again change in a year until finally we realized that not only did they just need more time for implementation but they also need a lot of money to help put this in place so if you recall representative luncheon had a bill earlier this session that dealt with specifically the system that they have and we gave thirty five million dollars to their system to address our the modernization of the system so that we can implement smart policies like this I think I. Click click out of form and it can be depending on the economic economic conditions of the state so the ironic thing about that is when I was told by DBS is they'd rather go down it's what we're currently at sixteen weeks they would rather go down to twelve weeks what I'm saying and what this bill would do it would say depending on the economic conditions at the time when things are going well it could go down to your point down to twelve weeks but if things are bad. It wouldn't go any up it would if it would change from sixteen. So what's the necessity of this I mean why why do we need to change in the sixteen is this something that the administration brought to you doctors I mean the work force what what are they in agreement with this what is this the was a back ground on this please so one of the reasons I was interested so no no one no one from the administration brought me this one of the reasons I was interested in looking at this issue. I don't know how many of you offered from employer saying the biggest competition that small businesses have right now is the government. And the state chamber said that In public house they gave I don't know how many thousands of examples they said employer saying that ma'am we can't find the employees we need they they have and I don't blame the rationale is that it's a better deal stay on on unemployment a lot of that of course has to do with how much sweeter it's been made right now with what the federal government is doing but to answer questions on why originally started looking into it I had to deal with thinking about how to address getting people back to work the fact that employers can't find employees so after that I. I look at some case studies in other states that have done this represent Murdock and. Basically states that. Did this indexing. They spend less on the program in states that don't why do we want to do that alternately the idea would be to also lessen the tax burden on employers so in states where employers allowed enrolled enrollees to collect benefits for twenty six or more weeks they're paying an average of five dollars sixty cents on every five thousand dollars of wages so the statement of index North Carolina Georgia Florida they're only paying an average of two dollars and thirty cents on every thousand dollars of wages. Representative Cavenaugh for purpose question you're recognized for a question thank you Mr Speaker my question is this representative McCollum from being in a part of the state that's rule and we don't have a lot of businesses and when a factory shuts down it affects us drastically and it affects those people that lose their job at no fault of their own this bill with the end look at places like northwest Arkansas where employment is rampant where you can find jobs and it's going to reduce my constituents ability to draw on employment to be able to get the necessary training that they need so how was in the equity between urban and rural. Yeah I mean regards to the training I would say this doesn't get in anyone's ability to go out and look for training I do understand your concern on where an employment is rampant on your example Northwest Arkansas versus maybe another district that doesn't have that what I would say is when we when we looked at these case studies and these other areas it didn't really matter what the duration was whether it was a state that had less amount of weeks our state that had more amount of weeks than us on average an individual will always go to about a week and a half before. The Max duration so regardless of what the economic statuses of the area individual go the Max amount of weeks to me it's just a question of do we value work do we value people getting back to work I get out of well Preciado S.. It's indexed from sixteen weeks down the twelve weeks depending on the entire state's unemployment rate but my district never matches the state's unemployment rate so the state's unemployment rate for February unadjusted was five point three percent that would put us at the twelve week index but my highest county is seven point one percent and so my County my highest County a lot of times we have to go outside of my district for some of that for for jobs there's not a lot of jobs within my district it takes longer to do that and so I feel like my district would be punished unnecessarily because instead of being at sixteen weeks where they currently are they be moved down to twelve weeks and personally I thought and I this is no this is a shock to the representative McCollum since I've been here we've reduced unemployment from twenty six weeks down to sixteen weeks and I just feel that at some point I'm hurting my constituents I think there has to be a balance between you know keeping the fund solvent and also helping our constituents and I just want to share what I was voting no for me from a rural part of the state thank you. Collins I'll be brief I think this is a good bill we need to help get our Kansans back to work the concept of the bill is very common sense when economic conditions are good unemployment shouldn't last as long but when economic conditions aren't so good. Maybe we provide a little bit longer run way for folks to find a job and get back to work this bill addressed some real concerns the department work for service had to provide them more time for implementation so I think it's a well thought out and craft a bill and I'll be voting yes. I don't I don't think we have a a war on poverty I think we have a war on work. I mean that's a nationwide thing not just in this state. I think works Americal puts food on our table. Clothes on our back. Roof overhead. I don't I don't want to destroy the opportunity to get people back to work and that's really what this is about I appreciate a good vote. Thank you Mr Speaker it's always funny coming from pass the bill after you've spoken to get someone else's bill. so this bill I did not run it yesterday because some of the manufacturers wanted to offer up an amendment I did look over that amendment and the amendment was essentially to strike a section of the bill in its entirety and I feel that that kind of got in the bill so I decided that I would not agreed to that amendments is why why did pass over yesterday I am so what this does it said to establish the three forty B. drug pricing nondiscrimination act Three forty B. is a very complicated federal programs and it's essentially to help rural Arkansas underserved or rural America under served America and places that don't have a lot of economic activity going on I put it that way SO three forty B. pricing is drug pricing and what it is is where the manufacturer's essentially will sell drugs to what we call covered entities at a very reduced rate we're talking sometimes about ten percent of the actual retail price that they would normally charge so it's a federal program it's been in place for many years and so. What we're starting to see as the number of three forty B. entities so like hospitals are covered entities if they want to participate FQHCs rural health clinics can be covered entities and then you can have independent pharmacies also participate they go through the covered entity I know this is confusing so you could have a pharmacy that is at three forty B. eligible pharmacy they contract with the hospital to get their medications and that hospital contracts with or works with the manufacturer to get the medications directly at that reduced price so that reduced price gets passed all the way down the chain to the pharmacy so the issue that we're starting to see last year one one main menu one manufacture in general but they decided that they would no longer ship or give medications to the contract pharmacy so you've got a hospital that contracts with the pharmacy they're both using the three forty B. pricing in order to not have to push as many drugs through the system at the reduced price what they were saying is if the hospital does contract with the pharmacy at three forty B. we're no longer going to send medications there because we're trying to limit the amount of drugs that we see and at a reduced price and six. Manufacturers that participate in the Medicaid agreed to provide outpatient drugs to covered entities at reduced prices they just are unilaterally deciding that they don't want to continue to participate and I do understand that the three forty B. program over the last ten years it's exploded it's gone from like seven thousand pharmacies there to covered entities to like twenty something thousand it has grown and it needs to be addressed probably at a federal level I don't disagree and I think there are several lawsuits across the country dealing with this issue already so all I'm trying to say in this bill is we don't want the state of Arkansas to be treated like that we want our patients our pharmacies or hospitals to continue getting that three forty B. pricing that's help keep us afloat for all these years that's essentially what the bill does I'll be glad to take any questions I can answer.
