Thank you madam president members Senate bill one seventy two this bill really came about due to teachers that have been struggling with the recent recess taken as a designation change that made recess instructional time instead of non instructional duty time so what this does is it takes reset the reset session the recess section from the school day legislation in code six sixteen one two and adds some parts of that legislation six sixteen one thirty two physical education it also require the day recess to twenty minutes per day that would be considered duty time for teachers while allowing schools to count up to hundred forty minutes per week as part of the school day without one thing that school day so one of the other issues that we discovered as as I was working through this from one as originally filed to today is when we made the change several years ago We didn't want in the school day. But with county recesses instructional time it actually shorten the amount of academic instructional time per class period the teachers are now struggling to try to get all the content into each academic class Academic class so this will help give districts more flexibility in their scheduling and the ability to for teachers to try to get all that instructional Instructional academic instruction into their classroom periods more happy try to answer questions. Thank you about a president Senator Dawson I got her email March fifteenth and so that's why the party at a time I just I remember and it said this bill cuts recess time in half and I just wanted to verify that's really what it does so so it does right now the law says forty minutes of recess mandatory per day. This makes it twenty minutes mandatory per day so does cut the recess mandatory period of time in half so that's absolutely true the it does increase the physical education from ninety minutes to a hundred and forty forty minutes per week so you increase some physical education time for students but you also allow for that instructional time the way that the minutes are counted throughout the day when we made the change several years ago to make it a hard forty minutes a day of recess only. The The designation of what recess was was changed from. Non instructional duty time to instructional time so now the kids on the playground are considered part of the instruction day and so The challenge with this is non instructional duty time are things like Carlijn lunch duty. Used to be recess so kind of the way the calendar can work is did you can be scheduled for duty time in the morning for car line and go to class that's instructional time then go to recess that's instructional time and come back to class instructional time. Lunch duty not instructional class more recess instructional and then at the end of the day Carlijn duty and so. The the flexibility of lesson planning trying to make sure that they're getting through all their lessons throughout the day it's but a lot of stress on some of our teachers. So. Talk about physical education so someone has a physical education class like a nine through twelve is that class actually require them to have physical education. So actually. I believe. Each time or walk around both of time it is going to have free time so I understand what the teachers are concerned about that as far as the kids are they having more or less free time have reached a true recess will throughout the day they would have twenty minutes of. Activity level for kids movement getting around on a consistent basis hi but also keep making sure that instruction time is is working for the teacher's. I'm is working for the students the students are getting the instruction actual instruction academically but teachers are also not getting stressed out in the process and they have more time to to manage their their daily flow. Senate bill two thirty five by Senator Tucker to create the Arkansas absentee voter integrity active twenty twenty three to amend the law concerning counting absentee ballots to amend the law concerning elections and to amend the law concerning the duties of the secretary of state. Senator Tucker you're recognized thank you manager this is a bill to update the process for counting absentee ballots It does a few things the first thing is that it says NO one can count absentee ballots before election day that the County Board of election commissioners has to start on election day and then they have to count absentee and early vote continuously until they're finished before they start counting election day votes that's really the first change and then there's a a change to the way in which absentee ballots are counted there's really kind of two phases to it the first is by poll worker and then the second is by the County Board of election commissioners one of those significant changes that the bill makes is that if a bill is marked as provisional for any reason under the current law there is no obligation to notify the voter that their ballot may not be counted and sometimes some clerks notify some voters and not others and so what this says is that if if your ballot is marked as provisional for any reason then the County Board of election commissioners has to notify the voter that there is a problem with their ballots what it says is that they have to do it as soon as possible but no later than forty eight hours after it's marked as provisional and then there are really two categories of deficiencies which requires a different type of queue or if it's a serious deficiency. Then the only way to cure your ballot is to show up in person I'm at the county clerk's office and verify that that's your ballot the more serious deficiencies are if you don't include your voter ID with your absentee ballot voter statement if your signature doesn't match or if there your address is different on your voter statement that it is on your absentee ballot application if it's a more minor deficiency in your ballot that's that causes it to be marked as provisional for example if you just leave it to a digit off your zip code then you can cure that in writing and no later than noon Monday after the election which is the current deadline to cure and the current law so that's what it does it just provides a process to make sure that everyone gets notified if their ballot is marked as provisional beyond that it also has some provisions in there to make sure that there's a chain of custody is clean for absentee ballots so the No absentee ballot materials are misplaced but then has a an obligation for the County Board of election commissioners to retain all absentee ballots and absentee ballot materials after the election in case of a recount or judicial contest so that they can be properly challenged and then finally if there's any suspicion of fraud on an absentee ballot in the County Board of election commissioners has to notify the Attorney General of the local prosecutor I worked on this bill for a period of years a couple years ago I took a whole lot of a lot of suggestions and made amendments from former Senator Ballinger and from senator Hammer senator Hammer not sat down again on it this year and made some more changes and I've worked with a whole lot of folks quite frankly on the right even to the far extreme including election deniers to make sure that this bill complies with all of their concerns there's no rush I position that I'm aware of and and that's that's really it I'd be happy to take any questions. They are cash agency they generate to revenue for that to operate from from the sales of of state surplus equipment about sixty percent of that is electronics computers other such things and that is their only source of revenue that a I don't remember the exact breakdown by believe it's twenty five percent is there Commission for this sale they operate on twenty five percent goes back. About three sixty four by Senator Tucker to require the state board of education to establish within two years of its assigned assumption of authority over a public school district the conditions under which the public school district shall be returned to local control Senator Tucker you're recognized thank you madam president I really view this bill in large part as a clarification of existing law it has to do with the state of part of Education takeover of local school districts it's in the law right now that it's supposed to be returned within five years for a team of about five year period eighty can either consolidate annex reconstitute the school district and in large part this really just clarifies that one part I don't want to mislead you that's definitely not a clarification and it is a new development is in before a district has returned to local control from the state government there has to be executive area that's promulgated by the department of education and this does at a time line to that that timeline is two years so if the state department of education takes over local school district they have to identified and state publicly in in writing the ex gratia by which the school district could exits taking control and and return local control. and then after that that part of the bill it just says once the school district meets those criteria it will be returned to local control if after five years this the district does not meet those criteria then the department of the state board of education can either return the school district to local control or has the same three options it's in current law recounts to consolidate or an axe and then if anything is left after that then it's return to local control at that point I've communicated with the Department about this through former representative Branscum you know they're not taking a position on the bill but in my conversations with former representative David Branscum he basically said thanks to you two years and apartment they think two years is reasonable to identify those X. criteria and five years is reasonable for a period of state takeover so with that I'd be happy to take any questions. They still have to be returned within two years now there's no return within two years Senate what what happens after two years is the state board has to say schooled local school district this is what you have to do in order to exit local control just so they understand what they need to be working toward that that's all that happens within two years there's no return to guarantee of return to local control within two years I give up and I don't understand what the bill actually does so okay let me give you a little bit more context and I'm using the old terms they've been changed in the code and and that they're more technical now but originally when the state takeover law was written there were three triggers for state control everyone was academic distress one was fiscal distress and everyone was facilities to stress and that basically functionally is the same now even of the terms in the code or different so let's just say a school district has academic distress so the state department takes over the school district and then at that point presumably the district will remain an academic distress if they were they're not gonna get out overnight and so the Department specifically the state board they have two years to say school district in order for you to access they control and and be returned to local control the schools that have an F. rating right now you need to get them up to a D. or whatever the criteria are they have two years to say what those exit criteria are at right now under current current law they have to say with the express teary are but there's no time limit on that and this just says you need to do that within two years. The state of Arkansas controls everything that goes on in that school district. The curriculum standards everything they control the money they control the academics they control the facilities everything. They've had it under control for two years. So if there's anything that's wrong it's not not on the local school district is on the who is on the State. The state says I have enough sense to take you over. But at the end of two years I haven't done anymore you do in your two years that's where the problem lies my original legislation state if you take over a school district you must tell them what they must do to get out of local out of state control that's not unreasonable if I'm over here not missing up over here then you jim I got to fix this this and this I said it within the first year. Senator Tucker is bill does it within the first two years then after that you are still under state control let me tell you what some of the problems are under state control. No school district has emerged from state control in better condition and wanted winning in. Okay I'm just telling you the facts. The Little Rock School District was taken over because six schools out of forty eight schools six goals. They were taken over for academic distress. When they came out they were in fiscal distress. And fifteen schools were academic distress after five years of state control. I need you to understand this they had control of every thing there. If you'll go in. Not an fiscal distress and come out and fiscal distress as the state done its job no it is not. If you go in with for schools or six schools in distress you come out with fifteen and district state has done its job. But we still under control for a maximum of one five years. What we're saying in this bill it is after five years chalice are you gonna do transformation. Are you gonna returns to local control are you gonna merges with another school district. Those are the three options the state can do any of those three. In the learn as you will notice that there is a step between at that has been put in there because they understand that the current process is not working and that is you can partner with another charter school or another school or for an entity that can help you get your kids what they need to be. But the way it is right now files is not working. Time Blevins minute academic distress for the last seven or eight years they are still in the state control and they're not doing better. They're not doing better. Lee County has been under state control since secretary was upon they still are not doing better. The process is not working. And so at the end of five years they give superintendents how many years three he they mess up what we do we get rid a superintendent with. But the state has five whole years to make this right we look to them to be the experts in education. But when school districts go into you have six an academic distress and fifteen or an academic distress when you come out there is a problem with the school district is doing so we are saying minimize it the state law says five that's what it means five not six not seven and just holding on to school districts that are getting better. That's what the bill does in two years tell me what else I need to do I've been in there two years tell me what else I need to do to get out and I'm going to do that. And then at the end of five years but has not more guess what we will do we will be the transform you into another school. Members this is one I'm sure you've been spoken to already I'll be brief the likelihood of the changing a an opinion is probably slam and I respect that I do Want to address the the contents of the bill and **** you just honestly openly listen and I happen to change someone's mind either way I respect that as well but this before fourteen is a a bill that's modernizing regional airports so what is a regional airport it's an airport created pursuant to the regional airport Act which the Arkansas code annotated fourteen three sixty two one oh two. In nineteen sixty eight these airports are owned and operated by regional airport authority. These stories are are not private entities by definition there governmental entities with choirs I municipal powers there are three of these in Arkansas. delta regional airport in cold Arkansas Arkansas International Airport and bobble slash guys now and then the northwest Arkansas airport and houseful. XNA is the only one located in a municipality that is not a member of its authority virtually all the others are located within the city or county that owns it and therefore the detachment a portion would would not really apply. This is a very narrow bill. and and likely not to happen again or create a situation again there's only three in the state of Arkansas two of which when the original airport bill was passed and and with an amendment that I read from here in just a second of nineteen ninety nine and this bill is not likely to be an issue or a slippery slope that we go down the original bill from nineteen sixty eight is been amended a number of times but I'm a read just a. Brief section from an amendment in nineteen ninety nine. Because. There seems to be a little bit of confusion or was confusion and it says this is tax fourteen twenty of nineteen ninety nine which is Senate bill seven sixty three and it was dealing with exemption from annexation and and municipal regulation what it did was it says that the intent. In here in the emergency clause for that day for that bill it is hereby found and determined by the eighty second General Assembly that president law is unclear. As it as to the authority of municipalities to annex regional airport property that the ownership and control regional airport should remain with the regional airport authorities and that this act clarifies the law so at a minimum it was unclear whether or not the annexation was in the and intent of the original law this was meant to clarify that and say going forward that would not be a part. I'm going to address a few of the key points from the bill and then move on to some of the the comments both for and against this bill this bill clarifies immunity given to regional airport authorities by replacing the phrase governmental immunity in the regional airport Act with language identical to the Arkansas code which establishes immunity for cities counties school boards and other political subdivisions in again by definition in the act it's a governmental entity anyway so it did it manages to or it creates a mirror to those that are currently in code it has a conflict of interest provision to the regional airport Act that mirrors that currently by city councils in quorum court's. Eliminates a provision in the regional airport act that gives regional airport authorities ability to create an improvement district currently under the current law eliminates that they can impose a tax for airport operations on property owners many of whom will never use the airport. It creates a process for regional airport authority to detach or D. and X. from a municipality I'm sure we'll have a lot of discussion about that but it did it provides for that ability in which the property lies while ensuring that any existing municipal debt obligations are not impaired as a result of the detachment. The process requires a regional airport authority to engage in good faith negotiations regarding other special factors and considerations that should be addressed as a condition to the detachment. It creates the ability for the regional airport authorities to levy sales tax on the gross receipts of retail sales and other activities at their airport concessions car rentals parking eccentric and to create a regional airport infrastructure and development commission to collect those taxes and expand them for airport purposes economic development construction maintenance and similar purposes this only applies this tax would only apply to the people who use the airport not other taxpayers. So. Obviously those in support of it those from the board of and board members and staff from the XNA all of which are elected officials by the five major cities and the two counties in which this read this airport supports for the region. Opposition the municipally and obviously the city of high full but the board. Of the authority is elected is appointed. By essentially seventy six members of the cities and counties so what's the what's the opposition. And an off site meetings during committee and from emails I've heard from those opposed to the bill the city of Highfill staff elected officials members from families in the community who said that their families agreed to sell their farm and and and others the bottom line is it just it comes down to a few concerns and in spite of some of the other non monetary concerns that were mentioned and and not be mentioned today I really believe all down to the money city obtains a large portion of the revenue from the sales tax generated by the airport it's not one hundred percent. But. it's about seven hundred thousand I think the only other sales tax generating is the dollar general and the there's a convenience store I realize it's a big number and that's why I believe this bill goes to great lengths to be sensitive to this type situation and under this bill nothing's gonna occur immediately it's going to take at least somewhere between eighteen to fourteen year eight to fourteen years For the the loss of the sales tax revenue to occur and I suspect they'll be continued growth in hi Phil. Currently the city uses the sales tax to to to retire debt outstanding debt issues that were issued for improvement to the city this is a unique situation here a hundred percent of the sales taxes generated by the airport and paid for by the users and only the users of the airport who have no vote whatsoever on the tax so essentially one percent of the tax on the airport. Is by those users. This is a regional airport there six hundred thousand people in this region. And so It should be a. Issue that is addressed or of that is covered for the region. There's questions in terms of the time line this was annexed the authority was formed in ninety two. The annexation began in ninety five there was options and acquisitions that that happened before the annexation for the airport there may be questions there but in nineteen ninety five when I voted annexed or a hundred and four people and half full and forty seven people vote fifty four people voted forty voted for fourteen voted against I'm not saying that the numbers are not relevant but just as information so. I realize it boils down to the money there may be some other issues but this is not gonna happen for a long long time and there will be continued growth likely because of the airport currently there's nineteen hundred we've gone from a hundred and five to nineteen hundred and twenty two they're expected to almost double that and and see in the more. A recent future here so but. This tap sales tax will continue to support the fun the the the operations of high full for a long period of time That's a long time for people on both sides to plan and and so with that I'm gonna pause and see if I can answer any questions. Got me to our districts for the bill I get is remote area. But the question I have you know of any any current state statute. And allows for of the levy of local sales tax. By the government agency without of a. In my could you repeat the question I'm trying. That allows for levy of a local you sales tax by a four year government by the government entity without a vote. I'm not familiar with the no Sir. you know how the the local you sales tax reform currently being used at this before. The locals you sales tax. being the eleven how that got what it was passed by the city of household. And then the do you know of any statute that authorized. A government body to purchase private land within the boundaries of another city. And be able to be an exit from that city without of a I'm not and and I don't think this bill or the existing regional airport bill allows them to do that and the Federal Aviation Administration also severely limits that ability for for those types of things but I'm not familiar with any situation there. One last question at the airport needs needs that land that's not currently known for this in the city limits apply. Well they have donated. I would say that they don't have to an eminent domain it but I would assume that they could negotiate at that point if that's if that's the need in the future. Thank. I think I made for you say something in your explanation but I'm not entirely certain the the timeline for when Highfill annex the airport into its city limits was that before or after their poor start of construction out the middle of nowhere. So the authority was formed in nineteen ninety two they began acquiring parcels soon there after they acquired a number of parcels they had the slat. the number one site was called sooner tend to I think they began continuing to acquire size and then in nineteen ninety five after some acquisitions of sites had been acquired the in house for annex and and as a as a follow up to that point the intention as you can imagine was to not to avoid territorial fights and that's why the five cities in the two counties got together and said this is going to be the intention is to be in an unincorporated part of the county four for those reasons thank. Thank you Senator Irvin. If you have questions and I'm gonna get senator paid. All the. Yes. So. One of the questions I have been When this is enacted in the agreement was made between high school and and the airports and. I think there was an agreement that and allow the airport to not follow any municipal regulations laws and zoning excite or a in exchange then high school could continue to collect the sales tax. So I have not been presented with any agreement I'm not saying that there's not one there I'm not saying that it was just an oral agreement but as I understand it the amendment that I referred to a minute ago nineteen ninety nine amendment the axe fourteen twenty I think it's what was. Fourteen twenty that was where they made it clear that the into the regional airports couldn't be and extend to the municipalities and and not subject to their ordinances and so forth. Right so this is coming from a somebody who I work with he was the former and official I think she was of the former and city Clerk at high. And so she was in the city Clerk at that time in nineteen ninety nine women and when they try to de annex then and so I think they came to a compromise were able to work through that situation and and so I think. For me I my question is if you if you pass this bill. Then as the authority of the airport can they then go out under eminent domain and try to take in more of property who would who would they fall under for that a forty for annexation because you're creating kind of your own entity government entity so it's not just the tax issue that were kind of creating a completely new entity that can now tax without a vote but what about annexation issues what about those kinds of things when you have. The you know ability or the need to grow or expand how how is that going to occur and do your bill okay okay so to be two point two five if I counted around one with the taxation I'll I'll back up to I don't believe that this the annexation of of future growth is changing the the existing bill of the existing law that's in place now I don't think that's materially changing with this as far as the taxation goes they already have the authority to to charge fees user fees and so forth and in fact and in some of the previous discussions and and and I don't know that this is necessarily part of the compromise discussions you were talking about the the answer was we'll just add more fees to the users because the users are paying those at the airport and so I don't know that the the the taxation is going to have a net impact of of saving money for the airport and and more importantly the money that is generated over twenty five years very very very very little based on testimony by the the the administration there has gone into the airport and so that the tax that is currently being assessed is going to the city high full. It is being generated one hundred percent by the users of the airport and I've got a two hundred and fifty million dollar backlog of capital improvements none of which the sales tax that they generate from their service from their their you vendors there can be used for that. My last question is there a personal profit there are property tax implementation as their property taxes. Issue if your bill passes how would that affect the property tax. Not now are they would they not pay it in the future like how it's property tax going to be affected under your legislation that supports those school districts which then has. Ramifications for U. artsy three are finding insured so so I can impart answer that with I can look through I've got I've got the full existing and amended bill I don't know the answer to that what I do know is the projected growth is expected to almost double which is going to have household was is going to continue to expand I don't believe that there are currently property taxes paid but I don't know that for certain. Senate take you're recognized for a question I'll have your Clarke Tucker thank you Mr so your bill amends a section of code that refers to an airport authority not this is not necessarily the specific airport authority do we have others that currently exist other than this one or is it possible in the future that more would be created under this section of code and therefore this authority to levy a tax in section six. By with an authority can be created and do you know of any other authorities currently exist so there are three that are currently existing two of two of which I believe have been around for for significantly longer time but they're only color currently three that exist and the only one that has commercial service where did that the sales tax would even be applicable other than fuel tax and so forth that the smaller ones is this what the exit days the only one with any commercial services in terms of it I'm sorry it would seem that sexist six gives the authority to do any that currently exist and any future ones or form under this section of code it gives the authority to levy a tax. Yes potentially the the the other two we'll talk about the future in just a minute the other two are part of the municipalities or or county and which owns the airport. The correct under the bill they have the they already have that have the power to tax but yes they would have under this bill they would have the power to tax. I normally of game will will use water order of the division that do that want to the member to water board or commission appointed and approved by the city council or the of a quorum for there's absolutely no recourse for the city council or board come back to over rule a pay increase for a rate increase or anything of that nature that's what I'm trying to determine is whether or not this board would have would would any elected official four of four four four city council have any recourse to decision that the board would make a big. City council have have vetoed any decision that this board may I think they would by virtue of those that appoint them would would then be able to call in to question whatever that the did that they did yes thank. And just as a follow up to that too I don't know that this is any different than any other boards and commissions in that we as elected officials we in the Senate here we confirm but once once they're appointed. I kind of have a hundred rule back my mind that if if I'm the only gets ten percent of a bill that it's kind of hard for me to go speak against it was less a vote against it and I have a lot of thanks a lot of good things in this bill that senator Patty is brought and I can appreciate the fact that But not everything that that high full has done is something I would necessarily prove but and I know a lot members the body get tired of me talking about the old days but I hate to say it was over forty years ago I was involved with governor why was an office of creating the local option sales tax we were going through a time when inflation was so high between the time that you assess property and the property taxes received by the local entity the inflation so much it ate away at their the value and and cities and counties and school districts included but specially cities and counties were in a real by so his solution was to the local option sales tax and then we had certain areas that immediately jumped in and did that in Clark County I remember with the I think one of the very first ones was Caddo Valley if you're been in there you know that's the first exit driving toward Arkadelphia a lot of fast food places there and I think there's they might have a three percent I don't know but they have a fairly high local option sales tax It seems like a good idea at the time and I'm actually okay with that at the time but you know you live and learn you watch things happening you see the process evolve into a series of communities that are the haves and the have nots I was last year I was looking at my district I had one city that had a very large retail tax base and they had plenty of money and they could do a lot of things I had another city that was on the verge of losing your ambulance service because they didn't have enough revenue to pay the minimum cost I had to have to keep their ambulances going and then the domino effect if you lose your ambulance service you lose your nursing home so that we we've got this imbalance with these these local option sales taxes. The thing that ten percent in this bill that troubles me is that you talk about expanding things we're giving a non collected entity the power to exercise a gross receipts tax basically you're saying that This entity in yes I know it's a public entity and appointed by the City councils of the various member origins and I'm I'm all for that part that's fine I like the idea of a regional authority because airports serve regions not individual cities is not the Highfill airport this is in Northwest Arkansas airport. My problem is. We are granting to. A non municipality or non County. The right to and and non improvement district court granting that right to to have a sales tax and folks if we're going to continue to try to meet our goal of cutting income taxes and the taxes it but really do heart our state our economy then you know we have to have some some flexibility in this to where you know I would love it love us to change to take one of our pennies for that a level in college and if you're talking millions of dollars but it's pennies and just do it on a flat rate that all goes on a turn back basis on a fair basis to all the citizens around the state through the individual communities and therefore not the halves getting all this these goodies and all the you know the extrapolation ball fields and and water parks in the towns it can just barely pay for their ambulance service or trying to scrape by wall all those people are going to the next town that has a Walmart supercenter and leaving that tax dollars there but not getting the benefit of a model here. And now I'm I'm a little bit off subject only say that the that we expand this one more bit it's gonna be near impossible to continue any kind of reform in this regard we need to pull back from where we are resident expanding who can Create at a local option sales tax and that's really you know what this is it's an act it's. It's not a good idea to do this now like I said the other ninety percent of the things in the bill could be for I think it there actually many good things to to have a regional entity running things instead of a you know one little accidentally have accidentally being your little community so we're going to tax the heck out of you because we can do this and we've got all the money in the other spouse but extending that the authority is a to me a really dangerous and incorrect precedence so I would appreciate your voting no on the bill until that's changed thank you Mr president. Related course which the department and according to the legislation the career and technical education division within the department and the Arkansas computer science initiative will work together to develop the minimum standards of what that computer related course requirement is the minimum course requirements so we'll make sure they're still focus on computer science within every pathway but to me make that graduation requirements it'll be a career and technical education course that has that computer science component in it so I am thank hearing this right. You take what we've had the last few years and thank you senator Eric computer science courses or if it's specifically related to your career pathway that's been determined that more. I know that you guys have been contacted a lot on this bill because it's it's an organization Scala members. To address their concerns about gun email with this bill does not do is keep any educator advocate or advocate from participating in this group that also does not prevent or discourage this group from communicating within its own membership. This bill is about potentially removing any fear intimidation in the workplace I just wanna give you a few examples of that. We will undoubtedly past the most when most comprehensive bills and education history so got a lot of activity got a lot of emails a lot of discussion occurred. Now some of those calls I answered I could easily I couldn't call it was just it is what it is you can they're very passionate about being opposed to the issue some of those I could I could call I could go through the the merits of the bill we can agree to disagree but we can get there have a good call rational conversation some calls I got were for the bill but I had a lot of confusion about the bill. And those those calls are probably the easier ones to have but as I discussed where they're getting their information from they let me know it was from there their labor organization. And so I said what what do you what do you pay for organization which you obviously disagree with and I was told. Well they felt like it just wasn't worth the risk to upset the veteran teachers or their co workers to back out of an organization which they. They didn't want basically to be ostracized in a little small member group and I had a personal experience with that being a member of the federal workforce and you know as a group I watched how how unions operate in a it it is what it is. You can choose to do it in choose not to do it that's that's still part of the process. They said that they have annual fairs or the the the organization or the the the the very pro labor workforce comes and talks about the merits talks about the good of the organization but if they felt like they that it would be a part of an organization they felt like they were gonna be ostracized from the group. When I say what would correct this they said well we should all just have to be able to do this on our own. Like the technology is there to easily just pay our dues direct what we have to go through and fill out a form check a box and annually let people know what we're doing what can we just take this like we do everything else and take it to our home. All we know what we're debating this I got an email last night I'm gonna quoted. They're obviously opposed to the bill. But they said I've never been pressured to join or get others to join as a matter of fact because I am a member I have a target on my back by the administration there are several in my district have to hide the fact that they belong to this organization and therefore they have to pay their dues on their own. I think of all member simply had to pay their dues on their own. Because we have modern conveniences that we can do that. Employees would not have to bother with the stress. Now you've probably heard how this takes away ploy choice or how this this is all about the sessions all been about choice so you're taking away the employee's choice or which will take away the employee's voice I just don't believe this is true employees can pay for the subscription just like any other household bill. In fact I called our state auditor to ask if I could have dues withdrawal from my check for this body to go to a labor or political organization. I was informed that I did not have that privilege but they did insurer and back to encourage me to go to my bank and have an automatic deduct set up to pay those dues forming. So I just want to restate that this bill does not force anybody to do something which they don't agree with or have a passion to support. But it does take the potential for workplace fears and and intimidation out of our workforce. So I'll be happy to answer any questions are there any questions. Area of stone something on their back thanks gonna cause them some problems I've been doing this for some fifty years now I joined the union and set not in nineteen seventy six and I've asked people to join and they told me yes and I've asked people to join and they told me no. And I respected whatever their decisions were. But to punish people. Put simply warning to be a part of something by making it more difficult I think it's unfortunate. I think it's unfair. I don't understand how a couple of people who don't like something get to change everything others who do want something this means the end of your retiree Arkansas retired educators you can't take it dues after that. Can't take it does al if you're buying a card to a credit union that may be owned by one of these entities. It is a horrible thing to just continue to bash institutions that are made up the majority of women. It's easy to just punch a button it the administrative didn't say that in one. School boards didn't say that in one it but a couple women said I just don't like it because somebody asked me to join and they make me feel good. It's a heck of a reason to do away with something that this state is allowed. For as long as I've been around. And I've been around since it was a pup and he's since died of old age so I would say to you this is very very bad legislation. It's in bad faith. We have a choice to every thing here. Parents ought to have choice kids choice but educators don't have the choice of saying I want to have some dues taken out of my paycheck by paycheck that doesn't make real good sense I think it's for public policy and I would appreciate a no vote thank you. I'm I hate to see a little misleading it does more than that so I wanted to say that on the front end what what this does members is Right now or what what the voters are done as a they had passed an amendment of course for the homestead property tax credit and it was three hundred dollars then what the legislature did as they pass they had to pass a tax of one point to actually fund it which they did it I haven't seen it. Of course that has grown over the years The I have sent has ended you all know what we do is we put to we've raised that. Instead property tax credit which we just did it the first of the set of the session from three seventy five to four twenty five. The thing is. The we have a bill in place right here we have some legislation in place that says if there's any additional money in this that the chief fiscal officer of the state will transferred that to our catastrophic reserve fund the money right now whenever it comes in it goes into what is called a property tax relief fund and does take an act of the legislature to remove it from that. In the last couple years what we did is we are trying to reworked everything because issues to go into our wall into the long term reserve account we changed the name of that to the catastrophic reserve account so that there would be independence to watch out for that that we don't take any money out because there's a lot of benefit that we keep it that way and what we are also done had passed was to pass legislation that says that we keep that catastrophic reserve account at twenty percent of our budget. So the thing is we really don't want to get any a lot of extra money in that catastrophic reserve account more than twenty percent of our budget because we do that at the end of the fiscal year and the reason is is we want to maintain that balance of for several different reasons one of them is that we get the best bond rating. And the thing we don't want members to to try to take money out of that as you all also know what we've done in the past with some of our tax cuts as we've actually. put a trigger in place if we took money out of the catastrophic reserve account. That in the the tax cut would go away so we don't want to get a lot of extra money in there and then limit ourselves from being able to use at some point. I will attempt to answer any questions. They will they will stay will stay into the fund that they come into which is which is the property tax relief fund trust if I remember correctly so so this is not really obsolete language it is I mean that was kind of a thank you. That was the only question I had on whether this is really off and I thought maybe just a reporting requirement that you truly are the leading that whole section yes Sir and and the sweeping of those funds so they will begin to accumulate. For someone to try to come in and. Raise them in the future and that. Well that that would be harder because that money right there is going to be specific for that use more more than likely what's going to happen of course is that the wages of the future legislators legislatures will look at at at giving more property tax relief or is you of my you and I have discussed an option could be an option could be that that the have seen this coming in the into that phone could be lowered. The the challenge with that is my understanding that definitely that we can only lower stuff it like an eight an eight that a term so what we have to do we would have to make sure that it would cash flow off of whatever the current collections or they're coming in okay so. I don't know obviously you may look at this but. What a better option not be to start redirecting those funds into some sort of a catch also we know when we're we're getting to that point so we can lower that a cent sales tax or something with those funds or have that and restricted reserve or some other type of funds so it's not pulling their looking like we're having more and more than were actually. bring and I wouldn't think so because if we did if we did parking in a restricted reserve or something that would probably be if you did a restricted reserve of course that could be done in the offseason and a majority of the members could pull it out because we always have additional language you know that if we were to you know with the legislature wants to do it and they all say they could that's why I made mention that the property tax relief fund that actually takes us to be in session for us to get the money out of there so it's really safe and it's a it's readily available want to you know what the balances of that account or I mean I I. I would like to see is maybe do something but not just believe in the property tax relief fund I don't know if it's kinda late session to start making a lot of changes is this something that's really urgent that we do or so we're not over getting too much accumulation that catastrophic fund. Well in my opinion it is because again with the legislation that you all passed a couple years ago you know what what we've done some we've done some pretty of prudent things is pole as far as to get us in a situation that you could call the catastrophic reserve fund are true rainy day and you know conversations leadership in the house in the past and everything with the amount of money that we've got in there right now what you all know it shall be somewhere around one point three billion and as our budget increases of course on June thirtieth July first right in the in that time the first moneys if we were to be under twenty percent the first moneys of our surplus would flow into that and that's the reason that we really don't want a lot of extra money in their. I if I remember correctly the property tax relief fund is probably somewhere around a hundred and thirty million right now it wouldn't surprise me there was a little bit of talk about the possibly trying to go above the four twenty five that you all did earlier in the session personally I didn't want to do that I wanted us to go back to pre COVID numbers and make sure we cash flow is what we did but after we watch set for another couple years it wouldn't surprise me that that there will be a push to try to provide more relief to consumers. Technology detection devices are we talking about and and I mean that the judgment of an officer when someone's in an act is the concerning part of the okay this is this the first meeting so the car goes by the camera takes a picture of it it is it is not a license plate reader and that officers able to get that transmitted down the road and it would identify the speed at which the cars is traveling so is very specific imagery that the that the officer would see and the intent is that that officers parked outside of the construction zone because I can tell you with the I. thirty down here in sterling county they really don't need to be present in the work zone because it'll just absolution are left the traffic so like that camera would be in the works on it would take a image of that car record that speed it transmits it to the trooper sitting outside the work zone and then they're able to stop the car using that imagery again it does not keep the last one that trooper goes off duty all that information is wiped out of the camera so so there far enough away they're not actually witnessing personally the infraction just like it is now the trooper stand on top of that by doc dressed up like a construction worker and he's got that radar gun pointing at you and he radios to the car this two mile away the card is two mile way that didn't see that infraction it's exactly the same thing just using the technology we have available today.
