Quick explanation tricare for life is a program that provides health coverage to all military
retirees their spouses survivors and other qualified dependents tricare for life is Medicare wraparound coverage for tricare beneficiaries who have Medicare part a and Medicare part B. regardless of age or where they live tricare for life provides comprehensive health care coverage in a bi annual report from the Congressional Budget Office it took payment tricare for life offering to proposals among its options to cut the deficit would to be significantly increasing the
costs for seniors who use the T. F. L. benefits like to read an excerpt from an article from the military officers association officers association of America. In a January article TSL beneficiaries pay Medicare part B. premiums but TEFL enrollment is automatic and there is no enrollment fee or monthly premium for TSL coverage a CBO proposal would require Medicare eligible beneficiaries who choose to enroll in T. F. L. to pay an annual enrollment fee of
five hundred and seventy five dollars per individual or eleven fifty per family. The enrollment fees would be indexed to grow at the same rate as the average Medicare costs in later years so again this is a benefit that was free and promised to our retired military individuals and their families and this administration is trying to increase those costs from zero and index it at Medicare raises so the intent of this resolution is for the house of representatives to oppose any

approximate seventy one percent of the Arkansas counties lost population between twenty ten and twenty twenty an average loss of nine percent interest six counties but lost over fifteen percent. In those counties live about our eight hundred fifty thousand Arkansans. Many of you represent these areas the rule areas you see the stress on municipalities counties and regions indecline.
If we don't do something we're going to conduct we're going to develop our own food desert's we're going to develop lack of elder care general health care and even pressure on the schools and we've already heard in previous bills. Real economic development projects moved slowly it takes wall it takes relationships it takes people on the ground in the locality our Arkansas Economic Development Commission has done a great job at what they do they do a wonderful job that got a wonderful system have
wonderful people but we have a lot of areas that are falling through the cracks we need people their local areas they suggested we work to the local planning and development districts we have put together a program that puts some very strict guidelines for them and it talks about what the order to do one of the key words in this is initiate not responding now waiting on a phone call on already on email but initiate economic development in those local communities that are
closely tied to jobs. Many times we have to have people in meetings in the evening we have to have people at the local levels for the city of the city council's core courts economic development groups this is tied to properties that are owned by the city by the county or by an economic development group again we have a great eighty de system they have been great and helping with research we're trying to
fill in some gaps here and with that I'm going to take some questions or I will be talking for the next twenty minutes. in part two of my question is is this going to require more staff more employees to an issue so much so basically to fill in these gaps to get people from local level you're either looking at adding a tremendous amounts that are quite a few staff to ADC putting them on the road during the lodging trying to get them out moving back and forth all of those type of areas we have eight planning and development districts scattered around the state that already have a staff that might just need one more rule economic development specialist so the
funding would actually if it's available and we get the funding is actually goes to ADC planning and development districts work through ADC then it comes back to any projects of a president would be approved by legislative counsel finding and development districts will also be coming back to Legislative Council two times per year to be having of report sports not one of these really coming to vote in the special is going to be doing we have a category or catalog of buildings or facilities are
vacant all over the state that right now I'm not be use some of them might be passed be someone might just need a little bit of a touch that would be one thing that we could use it for the other is eighty percent of all job creation over the last twenty years has been on what we call business retention and expansion working with the businesses that are there to expand again sometimes it might be a road sometimes it might be simple things it might be workforce training so we're doing a lot of good things we're just trying to help stabilize
the economy and some of these areas it's not that ADC is not capable of doing they're more capable of doing this is simple boots on the ground at the local level local supervision local relationships and us being involved. What the program date is eliminated the need for each of those entities to purchase certi bonds in the exemption from needing certi bond coverage was very explicit in the language of that act the fidelity bond program protects each of these entities by providing a manage pool of resources that pays a
coverage amount of those that should be the target of internal theft or fraud. In error the Arkansas Insurance Department omnibus bill which is now ACT three sixty seven of twenty twenty one in its very early struck that exemption for those entities to purchase the certi bonds. House Bill sixteen twenty six is simply a correction bill that would require reinstate this exemption and is needed to ensure that each entity does not
have double coverage it adds a single paragraph to code which basically says it all governmental entities participating in the self insured fidelity bond program are considered of satisfied any other statutorily required bond requirements and simply takes us back to where we stood before the twenty twenty one ACT mistakenly to the exemption away this is an agreed upon bill and has the approval from the Arkansas insurance department and legislative audit. the numbers that are reported but as was also testified this morning we know that we are drastically under reporting and the other thing is that by under reporting those deaths we are leaving a huge amount of federal money on the table there are a lot of federal grants that are determined by the number of deaths that are caused by opioids in particular state and we're losing out on a lot of that money to the to our surrounding states so this bill is a solution to that problem that was reached over the course of months worked with and the
governor's office Tom Fisher Kirk lane coroners crime lab came up with this solution which would require an autopsy in the case of a suspected drug overdose that's what the bill does that be happy to answer any questions. century insurance companies I wanted to provide devices that connect to the internet and help monitor track or educate policyholders about risk these devices such as water leak detection devices are win win for the policy holder and the company policyholder reduces the risk which in turn reduces the number and severity of claims insurance companies want to be able to give these devices and services to their consumers but the where anti rebate in laws our statutes are written these devices and services can fall

session recall that we overwhelmingly passed this this publicity Rights Act last or two years ago and it is what set up the ability for our college student athletes to be able to take advantage of their name image and likeness. You know it's important to remember that there's previously there's nothing in Arkansas law that prohibited this. What prohibited the use of an I. L. we're rules of the NCAA level and then for high schools it's that the rules of the triple a.
The University of Arkansas a issue another's approaches last time about running legislation to allow name image and likeness because after the o'bannon case from several years ago this is something that became a possibility and so you have to enact the law in order for it to be allowed under NCAA rules so that's what we did as we knew two years ago this is an evolving field in a perfect world Congress would act and would take care of this and create uniform
legislation across the country and actually they had a meeting just yesterday on this but so far they have not acted in so this bill would just tweak what we previously put in place this is been legislation worked on primarily by the university of Arkansas along with Arkansas state university as you can see it expands the class of student athletes were able to enter into name image and likeness bills previously it was only those enrolled in colleges now it would be those that are enrolled
or those that have signed a letter of intent or other agreement or have been accepted to a Arkansas institution of higher education. I was I think I was asking committee or or maybe outside of committee what about if you're not going to an Arkansas institution of higher education well that's the reason this amendment this bill is here is because those that try to go out of state or going out of state schools out of state will claim that they're governed by their state's law and so right now what can happen and what has
happened is you have student athletes that maybe you're being recruited to an Arkansas in state school currently they can't take advance their name image and likeness until they are enrolled in school institutions from outside the state or third parties outside the state are trying to tempt them to go elsewhere to say look if you'll commit and go out of state then you can be governed by our state's law that allows you to immediately enter into a name image and likeness bill so
this is really in large part it's to keep Arkansas in our institutions competitive. there's some additional language just clarifies that these institutions of their foundations can assist in these in I. L. deals it also clarifies a charitable organizations can enter into and I'll bills with the student athletes and then additionally. There's some further language later on I think it's on page five that essentially creates a
cause of action that if a third party. Comes in and interferes with the name image and likeness deal that exist here with student athletes the state he creates a cause of action because unfortunately that's. Formally or informally that's what's happening college athletics right now and so that's what this bill does a big glad to answer any questions and would appreciate a good vote.

It's been a long session I've enjoyed get to know all of the new members a bunch so let's start with this bill house bill sixteen ten it is a definition or attempted a definition of a public what a public meeting is written in nineteen sixty seven our current law is ambiguous at best and sets of a whole lot of controversy people have no idea really what is a public meeting
what is the number some people have sued some people have not so as a lot of ambiguity in the Supreme Court has asked the legislature on multiple times to please come up with a definition of a public meeting and what is the number so we know exactly what it is. And so in doing some research I looked at it and said well what to some other states do what is their definition of a public meeting and so in forty seven other states the definition of a public meeting is eight. Former or majority of the
members so there's a quorum up or majority of the members of the governing body they can do business they can vote and so that's a public meeting and the press needs to be there and I need to cover who votes what and what goes on that meeting so we can get a good so the people can know what's going on that's what a public meeting is so I thought well forty seven other states do that including all the states around Arkansas that's a great idea so that's the that's what I brought to committee said let's do a quorum of a pop of the era of that governing body and that
will be our definition and that will suffice of the Supreme Court has asked us to do and I brought that to committee and it failed because people were just a little concerned I heard a lot from other people that were getting the for a bill or killing it we're just running a month what is running all of our liberties an American everything's going to go astray and so the committee members asked me merry can you go meet with the for task force see we can do to come for compromise and so while we were on a wonderful spring break on Friday before we even start our spring
break I did a wonderful scene call with the for task force as they rang me out said it was horrible could not believe that I was trying to do what I was trying to do that if two more more than two people meet that we're gonna have a horrible for you and the end of the earth is on its way so but I did visit with them and and I was it was not the members of the task force that was to constituents that listened in that just to monopolize the time so I ask the four test members can we meet in person can you bring me a compromise I'm willing to
compromise and coming off with a performance what you're compromised so during spring break on Wednesday I drove up here the capital to meet with the for task force and if anybody bring me an amendment a compromise no nothing no compromise no nothing either skip it as it is or do nothing because we're not going to amend anything some I came here on Monday and brought what I thought okay so I just.
Really afraid by sick people for saying some special interest groups as to what to do now I said god help me what can we do I can't I'm trying to figure it was something good because if you come up with a number I just put a number in there is not equal is not going to be equal this is different sides of governing body summer five summer seventh summer nine so I decided as a god come help me something so. I really feel like I said some wisdom from lotus to one third of the governing body so no matter what the size of the governing bodies it will be equal amounts of the beagle representation because I didn't want this to get sued I want to have a good bill and so no
special interest came to me I came up with some I thought was a good idea Bills wisdom from the lord I just give him the credit for that so one third of the governing body if less than that gets together then we can talk what would it be like if you and I look at the members around you if you've never been able to talk to one of those members during the session could you get something done this session. But you have to get something done this session. I guess we have this imposed unless the quiet room next to be quiet with it because we couldn't even talk to each other.
I'm talking about thank you so right now in statute J. P. cannot pick up the phone and common of the J. P. in asked about concerns in a county it's illegal. Is illegal in the United States of America in Arkansas for JP to pick up the phone call another JP and ask them their concerns what was going on the county work together is that freedom loving. Is that freedom loving in America JP can't pick up the phone calling of the J. P. on the phone. No it's not I'd say that's
coming isn't. It really is ridiculous to me that they cannot do that our school board member. And I know that people are so sick and tired of washing DC I understand that I'm sick and tired of washing DC I'm discussing that what goes on up there but we can't take our frustrations from washing DC impression on our J. peas that live in our community that our neighbors they go to church with us and make no money I missed school board members get zero.
Zero and yet they're being harassed with losses left or right if they sit in the bleachers at a ball game I talked to another school board member. So Mr lawsuit in because obviously talking about school board business and they didn't call a public meeting because if they don't give it to our notice and do a public meeting they can't talk to each other. We can get people to run for school board anymore because they're being so harassed and that's what I'm trying to fix with a very simple fix is not opening up deep roots are meetings. It's allow people to communicate to work together just like you
when I do. It's not just passing laws one session is over I'm gonna call Rick Beck about a problem we've got in our district and we're gonna talk we're gonna work about it we're going to meet with our senators and area we're gonna meet with our mayors or county judges and all that. We can allow our GPS to do that our school board members to do that a couple J. peace can be going to the jail without giving it to our public knows and have somebody there to watch it is ridiculous what we've done we have created an unconstitutional and balance of power with this
bill is what we've done and I'm trying to restore the balance of power these people were duly elected their duly elected to serve their constituents and I'm trying to let them do that to do a better job like you and I do. What would it be like if every time you want to do a bill you have to go get the pool of the governor and the governor swear on it with that work very well for us heavens no it's ineffective it's in the it efficient and effective and I want good county government. And for all this freedom loving people to say am I right now because I want to fix local
government I'm sorry. I believe that people are elected just because someone elected this make you wicked or evil but somehow because you get elected your wicked and evil person we can't trust you to talk to somebody else because you gonna make a horrible decision and you got to give yourself a bunch of money or both yourself and a bunch of money. So I think that you guys are getting a lot of text from people have absolutely no idea what this bill does I got a text from a local newspaper nail
County no no vote of sixteen tennis the top of the people to be able to hold a legal notices someone. This has nothing to do with legal notices this has to do with what is the definition of a public meeting so we can have a good government. I make sure I get everything covered here. What I've done. Monday in the four test for scheduled a meeting during when I was in public health insurance session I can't leave my public health committee meeting people there expect me to vote on their bills and meet with the for task force I'm sorry we were in committee I could meet with them and I knew what they were going to vote on they had already told me they were not going to support my bill I don't really think I should leave a public health committee meeting and go listen to him tell me they weren't gonna support my bill I knew they were not going to. Again this is not stop anybody from reaching out to their elected officials and hearing how they see how they feel on it wouldn't it be great J. peace can co sponsor some else's ordinance. worst bill Harford the worst statute I've ever heard of and people. People who are elected to make decisions for their county or their school board or whatever they should be able to discuss things with each other and and and that's not trying to hide things from the public because then you do meet in public at the quorum court our at the school board and that's where you can ask questions and have more discussion but I think it's great to be able to pick each other's brains I didn't know
everything there was to know about watersheds or water. There bring you Senate bill three sixty one SP three X. three sixty one make some minor changes to what we often call the ten TiVo law which has been in place for many years so currently all home school students who wish to participate in a public school sport are
required to give notice to the public school of their desire to to participate. Then they must wait three hundred sixty five days before they can play the sport. This concept is included in the original ten Tego low to prevent recruiting and to prevent students from hopping from school district to school district. This bill makes one simple change to that rule if a home school student has never played a sport in public schools they would not required to sit out for one year before they could start participating.
It doesn't make sense to require a home schooled student to sit out for one year if they've never been or enroll in a public school if it never played sports in public schools as unlikely of the students are being recruited. However we leave the protections in place in the original ten TiVo law if that home school student has previously played in the sport and public schools they've dropped out and now they're wanting to play again they still have to sit out for three hundred sixty five days even that protection in place
prevents a public school athlete that's academically ineligible to compete from transferring to a home school and then trying to immediately compete again in public school sports. So to reiterate this change only applies to home school students who have never played a sport in public schools. The other issue the bill addresses this currently home school student can participate in in athletics outside of the school district they reside in. But only by mutual agreement between the superintendents of
the resident school district and the district where the student wants to play in the sport. Under this bill if the resident school district does not offer the sport the student wants to play and then the resident superintendent would not have to give permission for that student to play the sport in another district. The approval of the superintendent of the receiving school district would still be required. The student has never been enrolled and the resident public school. The resident public school does not offer the sport they want to
play an it doesn't really make sense for the student have to consult with and receive the permission from the resident superintendent to be able to play that sport in another district this bill resolves that issue. Senator Ricky and I consulted with the Arkansas activities association and the Arkansas association of educational administrators on this bill. They had some suggested changes and we made those changes in the amendment. These changes ensure that the time the student spends and
public school each day participating in sports or sports practice. All five the school to continue receiving the one sixth foundation funding they already currently receive for the students. We've also ensure that the students will continue to be covered by triple a is catastrophic catastrophic insurance coverage. We greatly appreciate both of these organizations for working with us and coming up with this agreed upon language. All these inclusion this bill
make things just a bit easier for those home school students who have never been enrolled in a public school you've never played public school athletics to play the sport of their choice without having to wait one year to participate. Elise protections in place to prevent recruiting ensure schools continue to receive funding for the students. And ensures that the students are covered by triple a insurance. This bill is supported by the family counseling the educational lines it's agreed
upon language with a a E. a and triple a and they're okay with the bill. Was passed in the Senate with bipartisan support receiving twenty nine yes votes with the other six members of the voting present or not voting and has no known opposition.
