Whereas, Walmart Stores Incorporated was founded in Arkansas by Sam Walton in 1962, and whereas Walmart has continued to call the state of Arkansas home for almost 50 years with its world headquarters located in Benton County where it was founded, And whereas, today Walmart operates 97 retail locations and 20 distribution centers throughout the state of Arkansas. And whereas, since its founding, Walmart has become the world's largest retailer with more than $419 billion in sales
in its fiscal year ending in January 31, 2011 from Internet sales and at 4,400 facilities in the United States and 4,300 international facilities. And, whereas, Walmart employs more than 48,000 associates in local communities across the state with access to health insurance, retirement savings options, bonuses, merchandise discounts. And, whereas, according to Dunn & Bradstreet, Walmart purchased $10 billion in merchandise and services from Arkansas suppliers, supporting more than 53,000 supplier jobs across the state in 2010.
And, whereas, Walmart collected $375.7 million in sales taxes on behalf of the state and paid $143.2 million in state and local taxes in its fiscal year ending January 31, 2010. and whereas in fiscal year ending in january 31st 2010 walmart stores sam's club locations and the walmart foundation contributed more than 33.5 million in cash and in-kind donations to local organizations and communities across the state combined with donations from customers and associates to total 36.1 million and whereas the state of arkansas and walmart work together to

It's the Arkansas Insurance Department's Amendment to Holding Company Act. I'm going to give you the short version. I'm on the wrong page. I don't think you want the long version. The Insurance Holding Company Regulatory Act requires domestic insurance companies to notify and receive approval from the Department of Transactions for transactions with their affiliates in order that the department can make sure that these transactions are not harmful to the insurance company's financial condition.
The Act also requires the Department to approve any acquisition of a domestic insurance company. The Act currently does not apply to Arkansas domestic insurers that only conduct business in Arkansas. This bill this bill would remove the current exemption from the Holding Company Act for single-state domestic insurance companies. The Department believes that the protection afforded to consumers of non-single-state domestics should also be given to policyholders of single-state domestics. The bill does attempt to accommodate the smaller single-state domestic companies
by allowing for an exemption for single-state domestics that collect less than seven million in gross premiums. This is a consumer protection measure that will help the department better

Thank you, Mr. Speaker. Members, HB 1814 is Arkansas Insurance Department's withdrawal from health insurance market. Currently, the law allows health insurers to withdraw from the state in all of its individual major medical plans by simply sending out a written 90-day advance withdrawal or cancellation notice to its policyholders for withdrawing a particular type of individual major medical product
or a 180-day advance withdrawal or cancellation notice to policyholders for withdrawal of all individual major medical products. The cancellation disrupts current health coverage for such treatments, leaving many previously insured persons without insurance after the withdrawal date, and thereafter not able to buy health insurance due to pre-existing condition, exclusions by prospective insurers. Many previously insured under the policies are relegated to obtaining coverage under the state's high-risk pool in CHIP.
This bill would give the department the authority to adopt rules which would govern the conditions under which a health insurer could withdraw completely from the market. The bill would specify that the rules would require withdrawing health insurers in the individual market to demonstrate to the department that the terms of their withdrawal are fair and reasonable. This is a consumer protection measure that should provide more stability to policyholders in the individual health market. Members, I would appreciate a good vote on this bill. 2048 is an Arkansas jobs bill. I think we are all convinced that creating new job opportunity in our state is one of our biggest jobs. And quite frankly, I believe it's rooted in the new technologies of the 21st century. One of the goals of Accelerate Arkansas over the years has been to achieve the national standard in per capita income.
That means we've got to create a new high-wage, knowledge-based job situation that helps us build a, quite frankly, a brighter future for our economy, for our people, and for our state. Since 2005, the Arkansas Science and Technology Authority, along with the Economic Development Commission, they've worked on developing a new economic development package, one that supports the growth of entrepreneurial skills, knowledge-based, and high-technology jobs.
Out of that work by ASTA and by AEDC, programs like Innovate Arkansas and the Arkansas Risk Capital Matching Fund have, quite frankly, helped us move some very innovative research at our institutions of higher education to move that innovative research out of the classroom and into the real world of commerce, the world where products are made and people are employed, new jobs are created.
Creating the Arkansas Acceleration Fund is the next step in that effort. Under the umbrella of the fund, ASTHO will select seven individuals to guide the effort. Over the last two to four years that the Acceleration Fund and Innovate Arkansas and some of the other programs have been in place, there have been multiple efforts that may have been somewhat varied. The Acceleration Fund will attempt to support and bring all of those under a common umbrella
to focus that knowledge-based support, that acceleration of our economy. To do that, the seven people that will be on this guiding board, if you will, have to demonstrate a strength of knowledge that is really rooted in experience. Knowledge, but mostly experience in how to mentor young businesses, young entrepreneurs to become achievers of job creation goals.
We all know, I think, that we've got to be more competitive in our economic development effort, and the governor's 2009 economic development plan did that, a new approach. He dedicated general improvement money on the governor's side in 2009 for that. And let me give you some statistics that came out of that. About 80 companies were served. Roast payroll after two years was $17.5 million. Annual sales of 31,300,000 employees, a wage scale that increased almost 70% in that two-year interval.
The investment, private sector investment, state investment was $41.1 million after two years. Of that, only a little less than $3 million with state funding that incentivized $38 million in private sector investment. That's what this Accelerate Fund will help us do. I would appreciate a good vote. There's no new money involved in this. It's all general improvement monies that might come from the governor at his discretion, and I would appreciate a good vote.

bill that we passed out of the House just a few weeks ago. The definition of terminate has at that point applied to the Arkansas Public Employee Retirement System, or APERS.
This is very similar. We had to do one that applied to the Teacher Retirement System. This removes any gray areas and prevents any misunderstanding of what is meant by terminating your position in that system. This bill is meant to solidify and protect the system for the future of our teachers. I worked very closely with teacher retirement and got the wording just right. We went back and forth a few times, and they have now blessed it and said it is good to go.

amend law concerning the Arkansas State Highway Employees Retirement System. What it does, it requires that the repurchase of refunded service in Arkansas State Highway employee's retirement system be calculated at amount that's actuarially equivalent to the benefit also when purchasing military service in those occasions when a member and when a member's employment is interrupted for
active duty the system would change an amount that's actually actuarially equivalent unless the uniformed services employment employment and the Reemployment Rights Act of 1994 mandates otherwise. Section 2 and 4 of the bill deletes obsolete language. The system's actuary determined the bill eliminates any actuarial costs
that were occurring as a result of the repurchase of service time. In other words, it has a positive financial impact to the system. Appreciate a good vote.

This bill brings the State Police in alignment with APERS and ATARs on allowing a credit purchase for National Guard or reserve time. If you'll notice on your pink sheet down in other information, it talks about the problem could be alleviated if language was added so the member would pay the actuarial equivalent. If you look at the bill, it has been amended on line C, which is line 3, the second page.
The member will pay to the member's deposit account an amount equal to the actuarial present value of the credit service applied for under this section based on assumptions or recommendations. In other words, it is zero cost to the system. All of the costs will be borne to the employee, and he pays it at the present value. bill. Thank you, Mr. Speaker, ladies and gentlemen. I don't know if there's something about Conway, but our colleagues have a lot of interest in sewage systems and things like that. And Representative Tyler, I too have a whiff of this bill, but it is a premium biosolids bill, so it's only the finest.
Ladies and gentlemen of the House, this is what this bill does. First of all, it just sets up a framework for our state to deal with this particular issue. There's currently no money involved. There's circumstances where our municipal sewage systems that treat sewage, and Representative Valtas has had to help me with this before, but one of the things you have, you have solids, and you have to deal with these solids,
and there are certain solids that ends up with sludge that currently is taken away to landfills. What this bill is trying to set the framework for is there are certain cities that are looking at having a system to dry those solids out, treat those solids so the biohazard has been removed, doing so under standards set by the EPA. Once that's been done, set up a program with Arkansas Natural Resources Commission that farmers that want to use the premium biosolids can use them as soil amendments on their farms.
There would be an incentive to the ultimate purchaser of the biosolids of $15 a ton. There are certain restrictions on how this could be applied. There's a setback from Rivers and Streams. This is a bill that has been worked with with the staff attorneys and ANRC. It had some commentary in there from ADEQ to make it a better bill, and I would appreciate a good vote.

that have increases in general revenue appropriation that's anticipated to be spent The motion to send it back to joint budget is because I believe that is the best venue to debate it. I know that you can't always get what you want, and I think there's going to be a break somewhere, and I think we all know that. I think the speaker, the leadership, Representative Webb, I visit with them often. I think we're close. I think everybody knows that there's going to be a give somewhere, but until there is, I think there's a lot of hesitancy with members in this room to approve appropriations in

if I might, Mr. Speaker, thank you. The point of clarification, I think, on school for the deaf, during not only the fall hearings,
and I do appreciate that some of the newer members of the House were not able to attend that. That's a valid argument. But joint budget has debated since January in the seating of the new members these various bills who've been in joint budget. They've been, in many cases, to the personnel subcommittee, and I appreciate the work of the personnel subcommittee and the special language subcommittee in doing yeoman's work and looking at these. In particular, this particular House Bill 1193 is a reduction of six positions in Fiscal Year 12 from the Fiscal Year 11 authorized positions.
It's a reduction in total appropriation authority of $396,000. The general revenue appropriation increase for this year over the authorization in fiscal year 11 is $6,389. This is an appropriation that funds the school for the debt. It's 170 total employees. I question if re-referral to joint budget furthers the interest of those children or if it furthers the benefit of the institution, this House, to debate an issue that the agency has been fully
informed and has informed
the members of joint budget over a period, now four or five months.

little bit of the meeting in the middle i just i'm very hesitant to vote out these appropriation bills that do have general revenue increases uh there's an old saying that you know a few thousand here a few thousand there pretty soon you've got some pretty serious money and uh we're going to pass out all these appropriation bills and and look up at the end and our ability as a legislature to have an effect and are saying the process is going to be greatly diminished if we just pass out these appropriation bills and hope it all works together at the end so this is a this is a general revenue appropriate increase in appropriation and for that reason at this point i'm just a little uncomfortable approving it unlike the opportunity to discuss it further

Let me say that we have included COLA in the budgets for the agencies, but management of both houses has not decided on what the COLA would be. If we decide not to give a COLA, then these budgets will not use the COLA that's provided in the appropriation. If we strip the COLA, I don't know how much increase this would be, but probably not much.
But we're fighting over pennies on 170 jobs. We've already gone down in the total appropriation, and now we're fighting over $6,000 for a COLA. And we haven't even approved a COLA. So if I urge you to vote for this bill, and if we, the management, and the House decides that there is no color, then this appropriation will go down. Thank you.

down to speak four bills. They said after two years ago, they expected more of me. Today is my attempt to balance that spreadsheet a little bit. I do, same arguments, general revenue increased, a little more time to discuss.
I want to point out one final thing and that's I know that this is probably a little bit new even for returning members but new members certainly I want to point out that we're going to pass out a lot of appropriation bills today and we're just not going to pass out all of them and that's not a problem that's not a a roadblock in the system that's not an attempt to shut down anything we've passed out a lot we'll continue to pass that a lot but there's a few that really have grounds for concern is the ones with general revenue increases that at the end of the day are going amount for budget that increases state spending rather significantly and that's the issue and so

be yes i think representative Lindsay is shaking his head. For those who don't know, the state has several thousand unfilled positions. A lot of the work and personnel is centered around removing those unfilled positions for the very simple reason that we pay health insurance on those unfilled positions, costing the state, I believe, somewhere between $9 and $10 million a year paying insurance on employees that don't exist. And so people that want to say that this appropriation process has no effect
on the process, it may be the wrong fight, I challenge you to dig into the budget and realize how important this is. We're paying $9 million in insurance on people that don't exist. That's a very serious issue. It's a very serious cost to the state. That's the effect that these appropriation bills have. We don't have the luxury of just passing saying, we'll appropriate whatever and let the governor fund it in RSA and we'll figure it out later. thank you mr speaker i would very quickly go through some of these sections in the in state appropriations. Basically, Randy Young's shop operates a lot of different programs, as all of you all know. Conservation, riparian easement, conservation districts in all of our 75 counties, water planning, water quality control, the carrying out the EPA's 319 non-point
source programs, solid waste grants and loans made to many, many entities around this state. Federal funds coming from EPA and various sources are involved in this whole appropriation. There are water quality matching grants, water quality technical service grants involved in this that are federally funded. There is an appropriation for water waste and disposal and pollution abatement programs That includes $90 million in a construction fund that provides vital resource and bonding
capacity to many of our cities in this great state. The Red River Waterways Project Trust Fund is included in this project. You can keep going through the 14 or 15. You've got rural fire protection programs. You've got conservation district programs. We've got a water resource, grants to agencies, insurance.
The list goes on, my colleagues. The process is this is one of the best-performing state agencies and state government. And we need, I

FY11 to budgeted projected on the legislative recommendation. Most of the additional funding that we're seeing coming across lines is bond proceeds. The state bonding program is up from $45 million to $90 million. The general revenue portion of NRC's total budget is 3%.
The majority of their money is their bonds proceeds. They have a sizable fund balance. They also received several categories of funding from the Fed, which is 4%. Interest earned on earnings and the loans that they made is 13.5%. I'm not sure that specifically answers your question, but general revenue is such a small portion of this, and my supposition is that the 93 positions will probably, a COLA forward
