supervisor that puts the immense for this bowl is because they perform some additional test it's not the fan and only other side of the state we've got a supervisor that has an employee that performs the same additional test but they don't put to me and for and i'll assure you that word travels across the state and one I don't want to see happening someone that was in state government and was a supervisor and supervised many many personal like some of you in this room for over twenty five years i'm afraid from where
you start picking and choose in winners that we're going to create a moral problem where it calls decision among state employees and we're going to call us hard failings and so representative has assured me I don't know where this bill is common if it's coming to state ages or some other committee but he's assured me and rules when I ask him and i'm telling you it was no he agreed with me that there's an age big something done about that particular part of the bill in that language obvious would

grades of gs one two three and four all those individuals are going to get a great pay race we have a tremendous problem trying to a recruit and retain a employees at that lower level so this is going to be a tremendous boost to to their ability to feed their families in and II think it will help a lot in the retention arena for our state employees that does those lower grade so that's a
good thing the recruiting and senate we want to recruit the best of the best say over the crime left we need a high quality medical examiners so we need to be able to have uh some way to have an incentive to recruit them to the state of arkansas on this while allow the cabinet secretary cabinet secretary to do that so let's talk about special compensation so coming from a guy who's been in the federal sector for many many years and a guy who was a cabinet secretary to have about
six hundred state employees the current policy right now we are very limited in being able to uh incentivise our employees for doing a great job so one of the ideas on the special compensation has taken from the federal government because if I have an employee this doing the outstanding job and I don't have the budget or the money that I can give them a a cash and set up I cannot I can give them a. Twenty seven hour time off award
or forty hour time off ward once a year but the concerns I think that representative tash mentioned those will be addressed in a you know each cabinet secretary they're going to have the required to have a panel of individuals who see all these wards and they can fare it out you know a lot of the issues in the concerns that represent of tosh a mentioned but we have got to find better ways to recognize
outstanding employees in state government and this is a great way to do it so from a cabinet secretary of you don't have the money in the bank to be able to give somebody two or three thousand dollars then you know elicit can call a minute so how you're doing a great job let me give you a forty hour time off award or twenty seven hours or a whatever it may be so there's a lot of great things and more of it'll come out when that whenever the bill goes to committee but i'll i'm i'm a hundred percent behind

noise mitigation sound reduction for number one for an ownership of these entities number two and then the location though that that they shouldn't be able to proper next to a church school or a residential area I think those are things that we all generally agree on this resolution doesn't address that thankfully we do have some resolutions that do address that senator josh bryants and representative mcclurs resolution does address those
issues uh senator irvan and representative moors resolution does address those issues. Um you know as I was listening to the debate on this resolution in committee yesterday there were a couple of things that kept being said over and over the things like well it's not well understood there so much that we don't know we don't know what we don't know those were all direct quotes from the presentations that I heard and I think that passing a
law just because we don't understand something is a bad way of rushing into passing a law and legislating I kept hearing people say what about the computers uh I think someone said what about asthma what about it to tell me more asking a question is not evidence asking a question is not an argument and i've heard people say we should just approve all of these resolutions and then send them all to the committees and I don't think
that's our job here today I think our job is to figure out which resolutions address the specific problems that we know are afflicting our cansands and then pass those that resolution or those resolutions send them to the committees and then fix this issue I know the senate voted a mall through I don't think it's too much of a secret that there's a lot of political matter machinations going on down there and II
understand that but that's not a great way to make policy I think we can do a better job by vetting these individual resolutions picking one or two to refer to committee that address the issues that we know our candidates are dealing with so this resolution specifically bands computers that were made or assembled by a cover and a covered foreign entity in the bill i'm a hundred percent for addressing the foreign ownership of these entities but it's not
clear to me from. Any of the presentation in committee or any of the presentation of the bill on the floor minute ago what would be accomplished by banning computers made in a foreign country i'm open to the i'm open to the argument that i'm missing something but none of that evidence has been present most of these computers is I understand it are made in malaysia and indonesia they're run with parts made about companies like texas instruments in video and so
forth there's a lot of things there manufactured in china that run on US parts like all of our iphones I think the same goes for for testles my understanding is also the these machines that are used to mind digital assets are our single purpose machines they're not can't use them to spy on people or anything like that so just asking questions about this I don't think is an argument I would also point out
on the this resolution also makes it a felony a class definitely to own one of these computers or to use it for for digital asset mining so would just make it illegal it would make you a felon if you engage in digital asset mining and use it the bill doesn't have a fiscal emp are a sentencing impact statement that I that I can tell so I think we should absolutely prohibit for an ownership of these types of entities II just don't think we're accomplishing anything with this particular resolution because it
doesn't do any of those things so I would ask for a no vote in this resolution so that we can move on to consider the the resolutions that actually address the issues outlined. I think the winds are the the resolution by senator bryant and representative of mcclure address all of the issues that I outlined that we know are tangible problems that have been documented in our stay also think that senator urban and representative more resolution addresses some of those issues uh there pieces of those resolutions that I prefer more than others but those are the two that I think address most clearly the issues
some i'd appreciate another. Thank you miss speaker thank you colleagues I must speaking specifically for this particular resolution as this is the one we need to go with
but i'm speaking for all eight hundred it is my belief that we simply do not have the knowledge right now here in this body the go this one is the one I want to go with I think we need to take these and I know that it may take a little more time to do this but I think that time will be well invested because here about a year ago we literally squeezed one off in our foot and we have the self inflicted wound that we have to address.
In the only thing worse than doing nothing at all is doing something happened and then going back out to our constituents and trying to explain to them why we still screwed it up the second time around trying to limit this to just a couple that might be that you know one or two of us says this is great and that's great well I think there's good parts and all of them that all of them are worth looking at and doing some hard work and coming up with the best solution that we can so that
when your constituent calls you you have an answer that you can stand behind other than well we just wanted to get the heck out of here and so we pick on went with their and i'm sorry that it didn't help you and your particular situation we may come at the end of all this with all of these and go jeez this is not good enough let's put it international study less work on it and then we take care of it at the next regular session
I hope not I hope we can put a patch on this thing at least because right now there's a lot of our own colleagues here that are catching a lot of grief and one of these days one of these things are going to show up close to where you live and your people are going to be upset too I don't have any in my district I haven't really paid any tens of this until we got down here but I know it's coming and I want at least be able to say that you know we tried to work the problem the whole problem

I too because this is my district and i'm here technology chair I too had some bills ready I was ready for some resolutions but I decided after I learned about representative miller's work representative mcclerrer center brian that they had all these resolutions that I felt that I would be better served as your technology chair to be want to help moderate to bring and rain all these together to create a product that we can all go home and be proud of to regulate this industry properly so I didn't do any of that stuff what i'm going to ask for you today is the go ahead less pass
all eight of these out to give us the flexibility that we need to create the regulations in the protections that our citizens nor not only need but deserve a representative ray has brought up some good points let us hash all that out in the committee assuming all that's going to come to my my committee give us the flexibility to hash all that out in the committee to process that everybody come to the table so that we have the flexibility to do what we need to get done i'll say this was seventeen
ninety nine that's the house bill that representative richmond talked about whether we pass that or not we would still be in the same boat I know that bills getting a lot of flag better regard if we had done nothing we would still be in the same situation as we are now the cities in the counties just do not have the weight of law to deal with this properly we have got to handle it from here at the state level and that is what I am asking you to do i'll go ahead and take a question they'll have a closing
statement after representative what purpose just kind of want to understand what you think the goal is we're doing here is the idea where we want to pass all of these resolutions outside the committee and the end up with one bill with all of these ideas hashed out in committee so that I mean I don't think that the house laws where we need to be hashed not all of these different ideas that that that's my hope is that we consolidate these down into one or two good bills that we can bring back to the florida my hope is that we don't come. Back with a separate bills I want to come back with one or
two good products that we can vote on in and be good. Question so if you could help me I represent it makes a since your you represent the folks in that area what is the primary problem that we're attempting to solve noise and foreign ownership thank you and and that represent under for what purpose you're recognized at representative meeks does the
technology committee have the horse power to do what needs to be done in the next two weeks I believe so and I don't like wacamol here. Question how does this resolution are bill if and all deal. Well I think that says someone the foreign energy indigent last at mining.
And again this is just to make sure that we have this is just to make sure that we have all the flexibility that we need to get something down what I don't want to happen is for us to come up with a solution and then be hampered because we don't have the right flexibility created by having these resolutions nut pass. trying to create the most flexibility so that the sponsors in my committee have all the tools that we need in order to get this done and there's probably some of the tools here that we won't need and we won't use or that we could delay until the twenty five section but we need to have that opportunity to figure out which one which one of those we will need and what mean hawk for what purpose question you recognize representative makes you said this technology chair your hope is that all these representatives would get

that this bill addressed that but as I was reading through just kind of clarify this is talking about covered foreign entity that has produced the computers themselves not foreign ownership of the digital asset mining facility sorry could you clarify if if this bill is about ownership of the facility or the production of the equipment please thank you right and and i'm trying to when i'm super speaking i'm trying to speak generally of all eight bills because I don't want to have to come back up your eight times and to sport all that
so again my hope is to get as many of these past as possible to create the flexibility we need to get this done a follow up mister share and I guess that's that's my question is is we're voting on these I would like personally be able to make a specific vote so are you saying that this particular bill that we're discussing does not cover foreign ownership from my understanding it doesn't cover the the ownership of the facility it's the equipment that. enquiry let's hear your inquiry my my question in the earth are to based on what representatives say is under under our rules like can you take all of the resolutions that are presented and prepare one bill and consolidate those or do you have to have individual bills for each of the resolutions parliament parliamentarian can correct me a part it incorrect ultimately the resolution you have to part of the constitution in the joint rules you have to have a resolution identical
resolution's pass on both ins to allow the introduction of a bill and so any bill that is filed has to relate back to a resolution so there can be no that there would be the only bills that can be filed would be a bill that ties back to a resolution has been passed and adopted by both things so there can't be some separate bill filed in a later date per the rules now if there is discussions if there's things that need to be tweaked within the confines of the resolution
has been passed that can be incorporated in that bill then that is possible uh but it's fairly limited. The ability because it ultimately has to relate back to the resolu. Some ability to make some changes to adder deteract from a bill but there can't be there can't be necessarily a a separate bill filed it may be that things.
Perhaps of ubank's for purpose question. So we have more we have multiple resol. And all of them may not incorporate all aspects of what the. More if if several of these resolutions were passed there could actually be several bills. Could possibly be passed by both in. And they could comple.
By the s. Session there are multiple bills. Then you get into the discussion about what was passed when was it when did it go into law and ultimately. And even involve code revision but with regard to them. Certainly could they also be. Each bill just gets.
Colleagues are also represented brown for what purpose question. I'm gonna ask this of representative right not when a chime representative makes I just want understand that if we pay. That there can be aspects of a each wresolution that you determine are totally unworkable
unnecessary or that by looking at all the concerns you can come up with a consensus on the best way to address an issue is that do I have a correct understanding I mean can we actually toss some of these ideas out that might be in a resolution yes matt my whole bears is that by time this process is done we can consolidate and come back to the house with two three good bills to to address this but I want to make sure because none of us knows the future that we have all the tools that we need to
handle this properly follow up it and to be sure but doing this we're going to try to come up with the legislation that does not conflict with each other is set correct that is my hope representative back for what purpose you recognize tell I think this is a question passed by for the parliamentarian the final bill that would come out the committee that we all work that got worked out the committee came back. The speaker says it would refer back to one of these
resolutions so does that mean that that final bill could refer to multiple resolutions that we pass so there would be one bill that would refer to maybe i'm a users example their six resolution. Reps and millers where they could they refer to like maybe three a half and then get some of the other resolutions how does that work I might make myself clear there are no. Prominentary can correct me for
wrong ultimately it's hard to answer these because it ultimately depends on what what the bill says and then we we have to review that myself in the parliamentarian would have to review that to see does it relate back and and a lot of it depends on the language of the resolution and then the language of the bill that is filed but ultimately the bill has to relate back to a resolution that has been filed does that mean that it multiple components could go into one I would have to we would have to see the bill
because I don't think we can sit here and answer I would say it would probably be very difficult to because quite honestly the the it's very specific to the fact that you have to pass a resolution to introduce the bill might that mean that you have that even if there was items agreed to or that folks wanted to pass there might have that might have to be separated into these multiple bills because ultimately it comes back to the resolution that has been before the house before the senate and has been bought it on
and and in that case would have been approved by a super majority so III think anything we say at this point largely speculation except that I think the parliamentary advice would be if these if this passes any bill that's failed needs to relate back as closely as possible or within reason and and be able to relate back to a resolution because the far they get away from that the there could be questions around. And that and that's why I want to try to get all these past is
to make sure we've got all the tools um in and colleagues i'll all finish up by saying this and again if anybody has any questions on this topic because I know it's a fairly complicated topics please see me afterwards or sweet work through this and i'll be happy to try to answer some of those further but the main point I want to leave you with his desk in this field like any other field there's good actors and bad actors and unfortunately in the last year we've had bad actors come into our state with complete disregard to the welfare of our citizens and our natural

told there was enough interest to do it and II think we've got her sale for bigger home since then it's the there is just lots of things out there and we can set here all that but we can figure that in committee are constitutes have not had a chance to have their concerns in my opinion I think we should pass all it over not just this this is I think which apparently we can do that in our committee and we can decide what but again
II don't believe it's fair trouble constituently to leave here even though it's a principle session and not address this issue thank you for something there are spoken for the resolution when he would like to speak against the resolution would in when like speak. speaking but listening to the debate has encouraged me to do so. Many of you have heard the story of mine involvement with crypto but for those who haven't I thought i'd share it. Back in june of july I remember it was hot it was warm but it wasn't quite yet hot. A good friend of mine who is adjusted to the piece of faulter county called me up and said hey matt we're doing a noise ordinance on the crypto there are bono or trying to try to come out and see the facility and I had seen it so said sure and you said I got my kids would think that's all right so that's fine so we drove out there.
We went to the crypto facility and there's a substation electrical substation just down the highway from its feeds it crossed the highway by about a hundred hundred for the arts from the entry not even across from the property directly in front of the lady at bono whose house has been in the news. Any part distruck he rolled down the windows we sat there for just a minute we're actually wait for someone else who's going to meet us and take us to the house. We're just shooting the breeze or some of the birds kids in the back seater carrying on about pokimon or something I don't know what.
In this security guard walks out of the crypto. And he he's about us he's looking at us you know he wants us to make sure that we know that he knows where they're okay whatever he looked like he was rejected from others country fried chicken places in the gas station so that I don't know what greasy shirt the home on yards. And he had a little ford escort there in front of the facilities said security on the side. These watching us and then it goes already pops the trunk of his while I now
deem the tactical for escort then he pulls out an ar fifteen he turns around and he shows it to us he's very proud of his his rifle and he makes this big production of loading it one shell the time myself honest in any cycles the guide he wants to make sure that we know he's got a chamber. And then he gets into the front seat of his tactical for escort and pulls out his tactical gopro start surveiling us.
Now first thought they went to my mind is this is ludicrous. This is the reaction we get just for being out here to listen a second but worse is dude do you really think you're the only person that's armed in the sole situation but. Now will admit that i'm not the sharpest tool in the shared I know a little bit about crypto not a whole lot better a little bit. And I would admit that I was born at night. But it wasn't last night and I know what I saw
and I saw someone come out of a crypto facility one of these bad actor crypto facilities like representative spoke about pulled out a firearm and made a big production of loading it because a legislator and a jp had the temerity to pull in across the road down the highway just for a list. Now I haven't decided which the resolutions i'm going to support but I think I would encourage each of you let's send these to
committee let's send all of them to committee let's hash it out in committee and let's get a solution to cars constant constituents we need to stop this now and get to the bottom of this and I appreciate a good vote. Prohibits certain items for being used in our state those items may or may not we we don't have the full impact of what that looks like are they currently being used by legitimate businesses what is
the risk associated with those items there's not really any risk and if you know the technology you know that my biggest concern is that when we get out of this session after having all of these crypto mine bills come through we've created more of a problem they will be started with and we have a real risk of doing that so passing resolution sticking all those resolutions back in the committee so that they can be discussed in and considered is not the right option the right option is first to consider each resolution on its merits does it address the problems that we've considered which is noise or
potentially foreign ownership in these in these specific buildings or businesses we need to address those problems as a constituent says ask us to do and all the rest of that needs to be considered as a secondary item that's why i'll be voting now and I encourage you to do this. entity in digital asset mining would be bad why it would be bad to why should we prohibit it why should we prohibit it II don't think that we necessarily should prohibit it in this specific case most all of these technologies aren't even manufactured are created as already has been said by representative right that these are not even a manufacturer to create it in those foreign entities anyway um but there are other technologies there are other businesses other data centers that may be using these
items the other piece of that is if we're not going to address the phones that ipads the iphones those are where we really get the the the challenges the malware the infectious uh viruses and things that are associated with that's where those things could come up these devices can't even have those in a follow up better it doesn't do us any good I guess yep my last question would be you know if that concern were present do you think it should be the same concern of our government issued computers that are made in china well sure absolutely alright

The crypto miles and that's fine i'm all for care going. Maybe we ought to look into this these resolutions simply give us the ability to do that and a draft language i'm for all eight not just mine. Simply put that is not what that is not what digital asset minors do um the securities and exchange commission for example has waiting and said that bit court people who mind bitcoin are not money transmitters.
You we have a congressman in arkansas who's the vice chair of the house financial services committee in washington DC has anybody has anybody sponsoring this resolution asked him if this would solve any problem or if this is even necessary. I do in to help be a part of the solution and solve the problems that are facing us on this issue this is just not the resolution to do it so I would again ask

it they're going to look at you and they're gonna say that you do everything in your power did you look at all the options to protect the people in your district what are you gonna save a situation what bonno happens in your district where they're dealing with that noise twenty four hours a day they're stuck they cannot fill the property it's a natment we think we're going to be down here for too long to discuss all these issues think about that lady and bonno
that has to deal with that sound twenty four hours a day we need to look at all of the potential options to fix a problem i'll say one more quick thing. I'm a small business own I know many of you are. Do you think that it's right that our businesses massage and a gravel company you're real estate business all the other business we own farmers we have more regulation than these cryptomats because right now

worries me about this resolution is that it broadens the definition of digital asset maining to include quote or business utilizing a block chain network and I think that's a released significant change there may have a lot of unintended consequences because there's all sorts of businesses that utilize black chain technology everybody from amazon to walmart visa mastercard you
name it so I worry about the unintended consequences of this particular bill and I just think we have better resolutions available to consider and I would ask for a no vote so that we can move on to considering that. I thank you mister speaker I do appreciate my friend representative miller injecting a bit of level into this discussion colleagues this bill this resolution look I understand in respect the concern about power and energy and all of those topics we have had I think over a dozen at this point committee meetings of the various committees talking about this particular topic and it's been discussed over it over and
it every single meeting that we've had entered and the coops have said that they had they do not have concerns about these particular businesses putting a strain on our energy grid in fact I called again and spoke to some of those folks this morning just to make sure that their opinion had not changed and they believe that because of the interruptibility of the service and because they have the ability to penalize and find these businesses if they do
not if they do not do what they're supposed to be doing then if you actually go back to and I know there were problems with act eight fifty one that we are going to hopefully address this session but one of the things in act fifty one act eight fifty one that was actually pretty thorough and extensive was how it dealt with energy usage it says that additional a digital asset minding business may operate in the state if
it complies with quote any rule or rate for utility service provided by or on behalf of a public entity but that's not all the bill said the bill went on to say that the digital asset mining business shall quote operate in a manner that causes no stress on an electric public utilities generation capacities or transmission work additionally your. It's estimated that texas mines
about fifty percent of all bit coin mind in america and texas has many more issues with water scarcity than we do in arkansas if you look at the states that mine bit coin or the leading miners a bit coin there are not articles generated about issues being created with water that's just not that's just not a thing that's something that came up in a committee meeting here a few meetings back and it just keeps getting repeated and repeated in the form of a question which again is not evidence that something needs to
be changed in the law so I would just ask that we focused on the issues that we know we need to solve the sound the noise the foreign ownership the location and that we move on to those resolutions thank you for what purpose question you recognize representative rate a believe he just mentioned that that you that water conception has not been an issue and what about reports from cars economy taxes where one bit coin mind is using one point five million

complicated. It can be done and it's probably the best way to do it but through a resolution through a bill and actually do it right.
