love and righteousness and wisdom and knowledge and and justice, and we bow before you because we understand or who you are. We bow before you and do something that is very unnatural for us, and that's to pray because pray means we depend upon someone else. It, it means we cannot be dependent upon ourselves. So we trust You, God. We lean upon you. And upon your plans and upon your wisdom. Lord, we pray, knowing that we have lack, we pray, knowing that we have need, but we pray knowing that you can provide all things and your word says when we lack wisdom, ask, can you grant it liberally? That if we seek you, you will be found if we knock, you open doors for us. And so Lord, we pray today for the men and women in this, in this hall, Lord, we pray for the unique challenges that they face as senators of this great state. God, we pray that you would give them insight into the communities that they represent and discernment to make decisions that would lead this state well. And Lord, on the authority of your word, we are confident that you have sovereignly put each and every one of them. in this place and have marked their days for your purposes, and I pray they would know you, revere you and serve you first and foremost. Father, forgive us where we failed you. Help us to bow bow our knees before you, knowing that one day every knee will bow and every tongue will confess that you are Lord. May it be today in the name of Jesus, our Savior. Amen. the United States of America and the.

Senator Hester. OK. Thank you, members. If I can have your attention, uh, I get to sit in a lot of meetings, uh, we're all busy and spread out, but uh from time to time I get updates on things that I think are just really good news that uh it's good for all of us to hear good news. It's good for us to be able to share good news with our constituents. And so I've got a few members lined up to just, uh, you know, one today, one Wednesday, one next week to just share an update on something that I just want to call good news. Sometimes good news is we've got a bad situation that's getting better, or just something good happening, but I ask Scier Leding to give a first update on just some good news happening in Arkansas. former colleague Senator Keith Ingraham pulled together a task force to look at implementing rapid DNA technology in Arkansas. It's a way for law enforcement to be able to get much quicker results on DNA tests so they can make quicker decisions about whether to pursue a lead or drop it. So with everybody's help in this chamber in 2023, Representative Carlton Wing and I passed the enabling legislation along with an appropriation to establish a pilot, and I want to thank the state crime lab for this thorough update. I'm only going to read just a couple of lines from the very end of it here. The state crime lab remains dedicated to working closely with our pilot agencies to ensure that the program is successfully implemented and continuously evaluated. They are looking for to continue the pilot, find some additional funding to expand the pilot with a goal of eventually making sure that every county in Arkansas has access to this technology because, as I said, it's something that can really help law enforcement to make faster decisions in important situations. So I just wanted to appreciate, thank everybody for the support on this legislation and hopefully if we need further funding in the future, he'll be there to support it. Thank you. Thank you, Senator

118 streamlines the referral process by eliminating unnecessary visits. There is no financial gain for audiologists with this legislation. This bill will allow them to order necessary scans and blood work when when referring for additional special care. Veterans can wait 30 to 60 days for specialty appointments, SB 118 insures by the time they meet with the specialist, the test results are ready for review by that specialist. Today they have to go to the specialist order tests and then make a follow-up appointment with a specialist, uh, to have the results reviewed by that specialist. So this, this expedites uh care in Arkansas, and it allows Just to streamline the process and cuts down visits for patients. Senator Clint Penzo Chair Unverified 29:19
good idea. It's the, the specialist, uh, ultimately is the one that needs to review the results and determine if there is an issue, but a lot of times I know, I know when I worked in healthcare, a lot of times I would pick up on things and reported up the food chain to the higher qualified individual to determine if it was the issue or not. I know 11 time I caught a um aortic aneurysm it ruptured and of course, I can't tell the patient I think I know what it is, but I went to my supervisor and and he came over and checked out the patient, and they called the doctor to come evaluate it, and they got him immediately to the emergency room, so, um, and then, you know, so I do, I do think that they are trained to preliminary. If they have an idea what it might be to order the tests and then, then of course the ENT or whatever specialist they're going to to determine if the results of the test.

Senator Crowe, you're recognized for a follow-up. So, and I like the way he explained it that we're just trying to get them to the specialists, but there's some things in this bill that are kind of alarming, you know, it talks about removing foreign objects and stuff and where is the line between instrumental and surgery because it's a, it's pretty blurry in this thing and when you're dealing with somebody's ear, I, I mean, I don't want somebody that's not trained in surgery to put any device in my ear to pull
▶ Play Suggest a correction Report an error

something out. Well, I appreciate you bringing up that that specific. A concern and uh that was actually addressed uh uh I don't remember if it was a debate with the Medical Society before or during the committee, uh, but they uh stated that is currently within their scope of practice, um, and so this is nothing that, that particular portion does not add anything new to their scope. They already are trained to do this. So So you think that the 4 years
▶ Play Suggest a correction Report an error

▶ Play Suggest a correction Report an error

within their current scope of practice to remove earwax, um, and that's pretty much what, what this is addressing. So it is within their scope of practice, as long as there is no tissue removed, then it is not surgery and it falls well within their scope of practice. My wife actually uh did some ear candling on me to get my wax out here a few weeks ago, so um it's, it's not that big of a deal, but it says foreign

OK, so they're not checking other

that that I don't believe that would be within their scope to address those other types of screenings, they have the scope of practice that they have to work within, and that's, that's the screenings they would be doing on the years. So conducting health screenings on ears specifically is defined

But I will say the biggest factor in this, in this bill is it allows someone who has an elderly parent to have the work done at an audiologist instead of having Make another appointment and take off work with an elderly family member or even a friend to take them to a specialist and to take them to a follow-up with the specialist. It can be done with one visit instead of 3, so this is a good bill. Anyone else wish to speak against or

for petitions and signatures in the last election cycle, as y'all as may have happened with y'all, I got a lot of questions about what they said. To my knowledge, there's not a central repository for people to be able to find the language in these ballot measures, and so this just requires the Secretary of State to put it on their website after it's been approved by the Attorney General, not before, and once signatures are being collected, um, the way it would work is that the ballot measure sponsor would provide the language to the Secretary of State's office with certification letter from the Attorney General saying this is what we're collecting signatures for. The Secretary of State puts it on their website. It's pretty simple. The Secretary of State's office is good with it, as someone pointed out to me, you know, I'm the Senate sponsor of this, obviously the House sponsors, Representative David Ray. If you got myself and Representative Ray as the lead sponsors on a ballot measure bill. There's got to be something that it's down the middle. There's there's no opposition on this that I'm aware of. So there's a recent example where uh somebody stole a batch of tickets and they'd already been to the claim center or claimed close to $10,000 worth of lottery proceeds before they were able to identify it in their system and get those tickets out of the system. So this would enable them to have the law enforcement authority to go in, ask the questions, do the investigations, and then if, get with state police or the attorney general's office or local prosecuting attorneys to make arrests and uh you know, turn the, turn the files over for prosecution. um, want to stop and think about what we're doing here with this particular type of tax policy, um, Amendment 79 of the Constitution required us to do at a minimum $300 tax credit, OK? So now we're at the General Assembly at the time, it didn't provide a mechanism for For paying for that tax credit. It just said, you got to do it, OK? So at the time that required the General Assembly to come up with the money, so they came up with a half cent sales tax. We have the 3rd highest sales tax in the nation, the state of Arkansas does. And so everyone pays an additional 0.5%. That is dedicated to the property tax relief fund. Well, now we have doubled if this passes today, we will have doubled what we're required to do as a homestead property tax credit. Now I have no illusion that this is going to pass overwhelmingly. I mean, you say tax credit and everybody hates property taxes. It's the most hated tax out there. I agree. I hate it as well. However, we're going to get into a situation if our sales tax revenue. dip that we are now Going to have a tax credit that exceeds what we're collecting. And so We're also collecting twice as much as we're required to collect. I just want to think about this. I've filed a bill to reduce the half cent sales tax of 3/8. I don't know if I'll have any support for it or not, but at some point in time we're going to have to start lowering our sales tax in this state. While we're the 3rd highest in the nation, I'd like to see us get down to where we're not the highest in that category. Um I'm not asking you to vote against this. I'm not asking you to vote for it. I understand the politics of it, and that's why I hey, I've tried to talk to people individually throughout, throughout uh the years since I became aware of this. We are not required to have a half. We're not required to have a half cent sales tax for this. We just do, and it continues to grow in the fund balance in there, and so we go in and we rate it for other things. So if we're going to write it for something, this is just as well we might well rate it for the purpose of it, which is property tax relief as opposed to something else. I totally agree we shouldn't be spending on anything other than property tax relief. up to 15 counties. Those are selected through a random draw process. What this bill will do is if you are a county that has failed to have a 100% audit, you'll automatically be added to the list, the next cycle, so it could be 15 plus 1 if that county happened to get drawn again, it'd be 15, and what this is intended to do is make sure we get 100% accuracy if the county has the next time around 100%. Inaccuracy. They automatically fall off the list and they would not, they'd be put back into the pool, so it's intended to make sure that our counties are having 100% accuracy in their auditing process. ▶ Play Suggest a correction Report an error
Senator Kim Hammer Unverified 1:06:45
Senate Bill 295 does is allows for state monitors to be paid for out of the election fund. What it'll do is free up the general operations fund for training and staff improvement within counties before problems occur. Currently they have 3 funds through which they receive funding. They want the flexibility because they're increasing the number of monitors this last time around, I believe it was right at 60 monitors that they had out in the field, which is great because when problems arise at the polling site, the election monitor is able to be there. The story that was told was that they received a complaint at one of the election polling sites and when they asked the individual that called said, Do you see that little redheaded lady sitting over the corner. He said, Yeah, that's the monitor. You can go ask her and she'll get it. straight. So what it's allowing is to make sure that we've got more monitors out at the polling sites to be able to address issues quicker, and it does not have an increase to their fund in order to do this, and so would appreciate a good vote. I'd be glad to take any questions. Q.

▶ Play Suggest a correction Report an error
Senator Kim Hammer Unverified 1:09:11
What's said in Bill 296 does is it fixes an issue from a Supreme Court case, county clerk designated early voting must be in the county seat, mayors two county seat counties where they have to be in both county seats and also the commission must vote each election for early voting locations because they are multiple days. cannot guarantee fixture or future use without positive agreement with location owners. So the bottom line is, let's just make sure that it's done in the county seat. I'll be glad to take any questions. Any questions for Senator Hammer. Anyone wish to question from Senator King. You're recognized.

Senator Bryan King Unverified 1:09:54
So like trying to understand this, so Carroll County has a dual courthouse with two Too early vote and so if they wanted to put another early voting location somewhere. How does that how does this bill imple that, say that one in Eureka bearable and they want to put one in Eureka Springs or Holiday Island. What, what would that do? I don't think it changes as anything
▶ Play Suggest a correction Report an error
Senator Kim Hammer Unverified 1:10:16
at all except for it has to be in the county seat so that it doesn't get done outside the county seat, which would eliminate preferential placement maybe um and this would just require being the county seat. That could mean that it's within, you know, a A church or another facility, but as long as it maintains in the county seat. Yeah,
▶ Play Suggest a correction Report an error
Senator Bryan King Unverified 1:10:36
but that, and I was on the election commission a long time ago. I mean, that's designated, there are counties now with early voting being so high that I can tell you that they need the ability to be able to put early voting locations, the way cities have changed, populations have changed. I mean, you have counties now that may have two locations where you'll have 1/3 of the county will have a long way away from a polling site to make it. fair and equitable equal voting, another early voting location would be, would be great to have and make it fair. You'll have like 2/3 of the county within 15 minutes of polling sites, and then you'll have other parts of the county that will be 45 minutes away. So if you're, I mean this is just another decision where each county needs to be able to decide. What the intent is is to make
▶ Play Suggest a correction Report an error
Senator Kim Hammer Unverified 1:11:27
sure that it is done within the county seat so that there's not the opportunity for preferential placement, preferential placement for where that location may may go and the easiest way, I think, to address that is what the intent of the bill is that it has to be within the county seat. Yeah, I understand that, but I, and hey, believe

me, I understand about preferential sites, believe me, 30 years ago there was a lot of that going on, but today we're not seeing that as much. But it's still the law is still the same, allows the election board to have as many locations as they want, and it says they have to have a unanimous vote on the other locations. That didn't change in the law, but it is the law. I don't believe it did. I believe you're right. Yeah, the only change is just that the one, if there's only one has to be in the county seat. Other than that, the election commissioner still decide and it's a unanimous vote on where they're going to put a 2nd or 3rd or 4th or any others. bill is pretty self-explanatory in the title, but just for a quick summary. It fixes the problem in that cities can elect councils by ward at large i citywide or combination of by ward and at large. This requires cities to file an ordinance with the clerk so county officials know what the city selected. This was worked on with the Association of Counties and also others in order to come to an agreement. It's just bringing clarity to eliminate any confusion. this was one you're going to want to hear about, I think, and you'll understand why when I get done. We come into this chamber and we all, you know, have loads that we bear when we come in here as individual members dealing with our families and businesses and everything else, but also we need to be mindful that from time to time those that serve us, whether it's staff, but in this case specifically those that are charged to protect us while we're inside this chamber and while we're outside this chamber being the state police. You've got to be mindful that they also have families and burdens that they carry as well. And yet they continue to perform their duty even under the stress and possible distractions today is no exception, Charles, one of our state troopers back here on the left, even while we've been conducting business today, his son-in-law, who is 33 years old, Grant Taylor, and his wife Scarlett, which is Charles's daughter, who is a dispatcher with the state police, and they together they have a 15 month old son named Graham, even while we've been in here conducting business grant is at UAM. He is fighting stage 4 cancer and undergoing treatment. He is at UMS even as we're speaking, meeting with the doctors to determine what course of action, if any, there is to move forward, hopefully to treatment, but otherwise other choices will be, will have to be made. So what I'd like to ask respectfully is that we just stand and have a moment of silence and that we would lift Charles and his family, that is Grant Taylor, Scarlett, his wife, Charles's daughter and their 15-month-old grandson Graham, if we would just lift them all up in prayers and just ask that God would provide a pathway forward to give grant the best possible choice to be able to get the treatment to come out from our in battle with cancer, a moment of silence, if you would please. You'll see from the current statute that we created an exemption from divestiture if there was going to be a financial penalty that would negatively impact the state. However, several have asked that we clarify that that exemption applies to all public entities that were impacted by the bill. It was never our intent. are an intention for public entities to be forced to divest of investments of public tax dollars if they would negatively impact a public entity. This bill simply extends the exemption to all public entities impacted by the original legislation. It's, it's 50,000 to $60,000 in that range that we're trying to move outside of this, this funding, um, and so there's been, there's been segments that this is only helping a certain part of the state, and that's not true. There's 71 different counties that participate in AYE and so we need to make sure that we protect that. I would urge you to vote against this bill, and I appreciate you joining me in that.

$56,000 down to $5400. I thought it was 48,000, it's right in that range. do you remember? Uh, 4 years ago when AYE first became a participant in this pool of money. Every county fair got shaved in order to create that $48,000 then two years ago, we came back in and made the county fairs whole, but the $48,000 that went to AYE. Kids from all over the state, but also other states. So I think that This rhetoric that, you know, we're just wanting to defund them and that. I don't think is correct because I've obviously said that, but I think you need to look at like how much districts beers do, how much that, and maybe there needs to be some equalization more than one lump sum going to this. Than our districts, but if you don't know the answer to that, my understanding is that they're getting much more lump sum than any of our district fairs, and that's a problem.

President. I'll stay on the amendment. There was some misrepresentation just took place. I hope it was a misunderstanding or a lack of knowledge or study, but anyway, on page 21, line 33, the money is being added to the county fairs. On page 21, line 31, it's being taken away from, from the AY or it's reducing the AYE from 48,000 to 54. 100, 5400 is the level that we currently support our district fairs. County fairs are less than that. So when AYE was brought in at $48,000 it was an unprecedented number, and I'm trying to remember from back then how it compared to the state fair number, but it was very close to what we put in the state fair. I, I also want to say there's a huge difference between shows and fairs. I've, I've participated in both. I love Cattle shows, horse shows, whatever kind of shows, those are great. And what happens is you have agriculture people with agriculture people showing their animals and, and kids are getting treated great. They're getting patted on the back. But a fair is different. It introduces the urban area, kids to the country kids. They go to school together sometimes and, and that young person that has taken care of the show animals for month upon month and showed up at school with mud and muck on her shoes and on her boots and maybe been teased a little bit for that. Now they're the star of the show at a at a fair. And so there's a huge difference between fairs and shows. And, and we do currently support shows, but nothing to the tune of $48,000. So anyway, I'd appreciate a good vote on the amendment.

Anyone wish to speak against or for the amendment. Senator Stubblefield, you're recognized to speak for. I don't know
▶ Play Suggest a correction Report an error
Senator Gary Stubblefield Unverified 1:58:11
if I'm speaking for or against, but I know that I spent half the night talking to Agra teachers and I'll reiterate what Senator Deasy said. This, uh, this is for Arkansas kids. No, Oklahoma kid won this. There's 1500 kids in this. And 7070 something counties and I, and these aro teachers said this will devastate our programs over here in Western Arkansas, because these kids work with, this is prim, this is livestock. This is not going to the fair or Ferris wheels or this is livestock. And these kids work with this year round. And they love walking across that stage and get a trophy because they spent their whole life doing this. It means everything to them. And, and we throw away more than 50 $60,000. It's not worth it. It's not worth it but taking this money away from AYE. It's just not worth it, so I, I would hope you would vote against him. Well, he didn't to clarify, I believe Senator Stubblefield you were speaking against. You gave me
▶ Play Suggest a correction Report an error

▶ Play Suggest a correction Report an error

of for, uh, but the main thing like Senator Payton said that this thing, it's not a defund, it's not trying to kill AYE. I, I'm not voting for that, and it does serve a purpose and the Senator Stubenfield said these kids work hard and do that, but I do think that there needs to be some type of equalization and look at the whole funding figure to say that we shouldn't give such a one large sum to this and overlook all of our district fairs and they get a much less amount. So it's not defund it in my attitude, it's just trying to look at this whole situation and have something where district fairs serve a lot of counties and a lot of kids and this is maybe disproportionate to what they're doing and really not fair.
