resolution. Thank you, Mr. Speaker, colleagues, good afternoon. I rise to recognize the Joe T. Robinson Senator swim team, the, uh, senators won the 1 to 4 a
high school swim championship, just a few weeks ago. And, uh, they are joining us here today in the East Gallery. A couple of really amazing things about these, uh, young athletes is that this was Joe T's first season to have a swim team. So not only did they win their first state championship in swimming. It was their first season to ever compete in that. Uh, a couple of highlights of the team. Jack Bracy, sophomore Jack Bracy was the highest performing swimmer at the meet. He had 40 total points in individual events and 4 gold medals for first place, uh,
first place wins. So I think that we've got some future Olympians up there with us and we're just super proud to recognize these, uh, these young folks. loves law enforcement, but he's become a, a national icon of what it means to be persevering, uh, and to care and to, to be an example for all of us. And so, uh, we heard that he was gonna be coming our way to the state of Arkansas. And so the Secretary of State's office, uh, graciously, uh, made him, uh, in Arkansas or Arkansas Capitol policemen for, uh, honorary Capitol policeman, uh, and then also the resolution is honoring him as As, uh, today is DJ Daniel Day in the state of Arkansas. This bill takes steps to combat the influence of China and other hostile foreign adversaries. Especially in the area of limiting their manipulation on our local and state institutions. Section one of this bill prevents Chinese Communist Party influence on our Arkansas higher education system.
Section 2 of, of the bill and primarily on section one, it requires state-supported institutions, uh, uh, to ensure that no organizations are recognized by campus officials, our existing organizations such as Confucius Institute, um, our own campus, and failure to, um, to disband those organizations will result in withholding of state funds to, uh, the institutions. Uh, the, the, the other part of that section is it, it, um,
Uh, restricts, um, higher ed investment in Chinese companies. Uh, the second part of the bill, limit Chinese and other hostile foreign influence on Arkansas municipal governments, while having a primarily as the sister city program, while having Sister City agreements, uh, with municipality in a foreign country may seem an innocent and fun arrangement, this section of the bill recognizes that such agreements, when entered into with governments of hostile foreign nations. Can be used by those nations as
cover for their human humanitarian right abuses and a way to gain a foothold, to gain influence over our local authorities and local elected officials. The third part, uh, of the bill is divesting from Chinese companies. Deemed a threat to state security. Federal intelligence and law enforcement officials have warned that an aggressive Chinese communist government is engaged in widespread efforts to undermine the United States.
Each dollar invested in China supports a regime that actively uses its growing economic power to advance anti-American agenda. Of the People's Republic of China around the world. Section 3 requires that public investment entities refrain from investing in Chinese companies and investment vehicles in China. That are known to be controlled by Chinese government by the Chinese government. Each public investment entity must identify
and report any existing investments and divest of such holdings reasonably unless they constitute, uh, a diminish de minimis investment. want to read current and existing law and then explain that this bill is simply clarifying that law and not changing it. The language states When a, what a paid canvasser is, a paid canvasser means a person. And this is existing law, who is paid or with whom there's an agreement to pay money or anything of value before or after a signature on a local
election, or excuse me, on a local option election petition, and so forth. And then we go on to say the same thing before or after a signature on an initiative or referendum petition is solicited. So, what we have done is clarify what it means when it says, when someone is, uh, agreed to pay money or anything of value. We have added some definitions for
what could be of value in exchange for the solicitation of signatures on a petition. And paid canvassers are subject to certain laws that do not apply to volunteer canvassers. This bill further ri f ies that, that receiving anything of value includes receiving payment for items like food, lodging, travel, bonuses, fees, gift cards, and other payments that are associated with obtaining signatures on a

So current state law states that ballots must be remade when they are damaged in transport or military overseas ballots are received electronically, which
is a federal law. There's laws currently on the books that say that when those are remade, they have to be matching in serial numbers between the original ballot and the new, um, redone ballot. So this bill, all it does, it requires two things. It requires reporting for the number of remake ball. so that on election day, we know exactly how many are going to be remade, and that can be added to the total, uh, when we start doing absent absentee ballots and things like that, but it's a transparency thing so that, uh, the general public will know how
many remade ballots that there are, and the second thing this bill does, it allows for the state board of Election commissioners to adopt rules to allow for the public notice, poll watchers to watch the remakes of the ballots, as well as the candidates to come and observe the recount. definitions, and then it's requiring some new reporting about how PBMs are structured. They're structured under different banking identification numbers. This, uh, new reporting system, the definitions tied to this reporting system will give better clarity for the RSL insurance department on how to enforce some of the laws that we have in place around PBMs. The other thing it does is it increases the lozener fee and requires a renewal fee. So when the PBM licenge Act was established in 2017, the fee that was established was a one-time fee for PBMs with no
renewal of $1000 in looking at that, you know, that was the first of its time, Bill, I think at the time, they really didn't know how much or how to look at licensing PBMs and looking at that fee, uh, I felt like that was a fee that was probably a little less than what the PBM's, uh, could reasonably afford and I thought it was reasonable to have a renewal fee. as well. The amounts that are settled on in that bill are amounts that were negotiated and agreed upon. Uh, that's $20,000 per PBM with a $20,000 renewal. So we currently have 47 PBMs in
the state. So that'll generate some income that'll go directly into an account specifically for PBM enforcement at AID. And I'd be happy. Seeing that I appreciate a good vote. Thank you. Representative

This is a process by which good performers in the way of healthcare providers could be exempt from certain prior authorizations. Uh, we based that on a, uh, retrospective look at the time. We're going to exempt you from this process for 6 months. And for the next 6 months, you don't have to go through the process of asking for a PA. Uh, under current law, a microbrewery private club, which is a creature we have in some of our dry counties is prohibited by law from engaging in any form of advertising. Uh, you may recall last session we had to run a bill to clarify that if you see a private club and you look in through the window and you see someone ordering a beer or something that's not not considered advertising. This is something similar and that this clarifies the law that a microbrewery private club restaurant can put their menu on their, uh, website or on their Facebook page. Constitute advertising. little less controversial. Uh, this is the 2nd in the state police's bill package for this session, uh, regarding the polygraph licensing, which I didn't realize we had this bill makes
several technical corrections to the polygraph licensing law, uh, the law concerning commission security officers by removing the term moral turpitude. A couple of sessions ago, the General Assembly passed uh art code in 173102, which said as a matter of policy, we should not be denying licenses based on vague terms such as moral turpitude. This bill simply gets rid of that. Uh, the other things this does some other cleanup. Uh, number one, this clarifies that for installer of a home security system, you have to get a background check under current law. This bill clarifies that if you, something pops up in that background check that would have failed you to be a licensed PI.
You now cannot be an installer as well because they are exempt from licensure rather than having to pass the background check. This also removes a 30-day law enforcement objection period for licenses for commissioned officers, um, as the state police has found that has rarely ever had any objections at all and to the extent they've had just a handful of objections over the years, uh, those objections have been based on things that were in the background check that had already been cleared by state police is not disqualifying, so it became a necessary, unnecessary speed bump and delaying licenses by 30 days. And then finally, and this bill also allows those licenses to be electronic just
like Representative Childress's bill. And then finally, this bill, uh, Fixes a uh conflict I guess in the code to bring it in compliance with the uh state police rules regarding refresher training as it is right now, a commissioned security officer has to be trained on a every 2-year basis and then a refresher in the middle. Senator Dodson and the folks with the Lottery commission have worked along and got the OK with the governor's office, Attorney General, and Colonel Hager with the Arkansas State Police. A unique situation and the need of two personnel to have the tools to, uh, necessary to investigate lottery fraud and lottery issues. The only changes are on the last page of this bill, and, and we're only giving them the authority to conduct investigations that are related to violations of the lottery law and lottery rules. Additionally, they will be required to report to the Attorney General and the state police on any investigations they conduct. One of the most problems that the lottery faces
is, uh, when there's some dealing with some, uh, some of the things in the state that sell Powerball and Mega Millions. So, uh, they're bound by the contract. It's not changing anything in the code in regard to alcohol and how you get a private permit, uh, for private clubs what this bill does, it's removing basically a legally meaningless requirement that's in our law now for a subset of private clubs in dry counties. The bill removes the requirement that there be a nonprofit set up. What's happening in practice as a nonprofit. has to sit out there for a year
and some folks have figured it out that they could Develop a lot of nonprofits and then sell them to these restaurants that are coming in that want to have a private club, and they'll sell these nonprofits to a restaurant for 10,000 20,000 $25,000 whatever. So, with that, that's removing that requirement still within that, there's still the requirement for local government approval, the requirement to buy liquor at retail, still the
requirement against prohibition on advertising the sale of. alcohol it does all the same thing that's always done, so it doesn't change that. The other thing that this bill will do is it will then just require one tax return. So let's say you have a restaurant, a corporation, and they have 6 restaurants in the state. They're 5 of them are in dry counties. They have to file a corporate tax return and 5 nonprofits. So instead of having to file 6 tax returns, they would file one. And with that, I'll be happy to answer any

What happened was, uh, a case went up to the Supreme Court. Our Supreme Court in which there was an appeal, there was on that appeal, there were 11 images of pornography images of children.
And it gets thrown out because there was not a finding that the trier of fact. Looked at this and said, it said the judges and the appeals court does not look at those facts situations so that cleans up the language and helps protect our children. bill that comes to us from Uh, deputy prosecutor out of Mississippi County based on a case that he had. Involving someone who should have been registered as a sex offender for having previously offended on someone under the age of 14. But, uh, was not required under our current law to register as a sex offender. So what this bill does is it amends the requirement to register as a sex
offender. Uh, under certain circumstances, we already had, and I should say for a lifetime registration. We already have a certain factors that if they're found, the person has to register for life, for instance. have been found to committed an aggravated sex offense. was determined by the court to be a level. For sexually dangerous person has pleaded guilty. Uh, to a 2nd sex offense. was convicted of rape by forcible compulsion.
Or has pleaded Guilty or been found guilty of failing to comply with the reporting requirements. And so what this bill does is it adds one more condition for lifetime registration. And that is if the person is over the age of 24. And they're convicted of a sex offense involving a minor under the age of 14 or under the age of 15, I should say. So, 25, if the offender's 25 and the victim is 14 or younger, and the person's found guilty, they will have to register as a sex
