If an adult is competent and they need assistance they can sign a power of attorney giving another person ability to ability to act on their behalf nothing else is needed. For an adult again either you're incompetent and a guardianship is necessary or you are competent and can take care of your affairs giving someone else the power to do so to the extent you wish. My aunt lives at a calmly develop human development center and has since he was eight years old she's now fifty nine and operates on the level of about a five year old. Second it gives a private cause of action to any student who has been did not an athletic opportunity or who suffers direct or indirect harm as a result of the violation of this bill. And then it also gives a school private cause of action sure the school suffer direct or indirect harm as a result of the violation of this bill. This bill keeps no one from participating in school sports so for female athletes I would ask for a good vote. Thank you Mr Speaker out of all the bills we've heard this session I believe I'm uniquely qualified to understand this one you see I coached girls for twenty six of thirty three years I taught my main sport was basketball the most the coaches in here will tell you that many schools are you end up coaching more than just your main sport I've also coach track cross country and softball I played basketball volleyball tennis and track in high school and went to college on a basketball scholarship for also played tennis I've got off my entire life. I'm also a member of the LGBTQ community. I'm disappointed that not one member of this body sought me out to ask my opinion on this issue. We always seek out experts on the issues we present especially in committee we have agencies organizations and others testify when it comes to this issue. We nor the experts we not do not listen to the doctors the parents the actual state and national athletics governing bodies or the trans gender use actually affected. This is not an issue in Arkansas I can do the math if you take all the transgender folks in Arkansas and then you narrow that down further to just the trans gender females and then you narrow that further to the group that are the ages that this bill covers and then you finally narrow that down to the grant transgender roles who want to play sports and then you narrow that down to the transgender girls who not only have actual talent to play but also excel. That percentage in Arkansas's non existent not one person fits this bill we've always had transgender folks and this has not been up this is not been a problem. I know many states are filing these bills and sometimes when that happens it's good and sometimes it's bad. This time it's bad it's detrimental to our youth in Arkansas and it's detrimental to Arkansas. I've been trying to ignore the mentions of power girls need to be protected or that women and girls are the weaker sex. I witnessed many women and girls who can out run out cycle and outplay men. College women's teams often practice against college men. And in elementary school often girls are more mature bigger and stronger the employee should we protect our boys from these girls. Not one trans gender female is dominating not everyone is taking away scholarships first of all there's not just one scholarship out there that everybody's competing for there are many let's take track as an example if you're running good times even if your second or third you'll be recruited. In Connecticut with the case that everyone refers to an often misuses the sister under girl ended up with the scholarship the trans gender girls did not probably due to discrimination in fact after filing her lawsuit the cisgender girl ended up defeating the transgender girls. Transgender roles are girls also in sports we must consider that skill is a factor who worked hardest is a factor who is most mentally tough is a factor the physical is just one factor of many that contribute to making an athlete superior. Also as a coach I know that most of my athletes did not go to college on a scholarship if they were deserving and talented they did but most did not we have to ask ourselves what our end goal is I wanted my kids to learn to work as a team I wanted them to learn sportsmanship I wanted then to learn that hard work and practice produced results I wanted them to learn Portuguese in pressure situations knowing that they would most certainly face pressure in the future in their lives. There's value in sports that's not just marked or measured by awards trophies and scholarships. The extremely hard to be a kid and if you're transgender kids your life even harder. Sports gives kids a place to belong a place to be included a place to succeed or learn to deal with setbacks in work to overcome them a place to be happy. We are severely under estimating or use. They can teach us a thing or two about tolerance and acceptance I've always said that is a teacher and coach I learned much more from the kids that I ever taught them. Please do not restrict and exclude kids I ask you to consider and represent all kids not just some kids not just certain kids not just your kids just as it is for our kids transgender kids mental and physical health are important keeping them in school is important the fact that one out of three attempt suicide is tragic and important. Finally I ask you why do we need this. Arkansas activities association and see date NC double a or have rules in place. This bill is also fraught with constitutional issues that lawsuit lawsuits may be referred file to address the fact will be hemorrhage of taxpayer money to defend against the lawsuits and for what fixing a nonexistent problem in Arkansas. We should teach our kids to strive to be inclusive and supportive we should want our girls to be compassionate and accepting most of all we should want our girls to work together to become strong and confident this bill does none of this for girls in fact it does the opposite I'll be voting no thank you. Just for Arkansas public schools and public school districts in the implementation of a community school approach represent Johnson you're recognized to explain the bill thank you colleagues as we know there's not one size fits all when it comes to how we educate our children and there's a trend across the country look it was something called a community school committee school is a school that takes a public school or open charter school involves other people in the community in the process of educate our kids it leans on some of these community resources shared way to teach our children it's occurring here in the state of Arkansas under grants right now and it's been successful this bill is designed to set in statute definitions for what we define as as as as community school it also as permissive language to allow desi the opportunity to set some guidelines on how that works this provides the opportunity for our schools that want to engage in this process to apply for grant money and then it will give them some guidelines to deceit used to Institute guidelines to follow again it's permissive language there's nothing mandated in this bill and I appreciate a good vote thank you. A number of questions were presented in testimony against this bill. A number of important questions like student privacy. Parent rights in terms of whether they want their child to participate in this community school approach an opt in. Many more responses of concern. About turning over to an outside entity okay whatever it is. Health clinic a psychologist. Being able to turn those students over to them without consent from the parents. Surveys you know you've got to do it you got to read closely it says it's evidence based. The community school approaches evidence based what kind of evidence is that the evidence would be surveying the students. Asking them questions about their beliefs or their attitudes or the type of home they live in. So what could that includes. Do you have firearms in your home. Is a child is a family going to be is there going to be intervention. Because firearms existed out you may have heard the case of a student that was involved in he was soon being for classroom instruction. And because he had a BB gun up on the wall behind. The local police showed up. Because the school district reported that child. Now let's just from a zoom conference BB gun. What are they gonna do with the information that is collected in a survey talking about your attitudes in your beliefs for instance. Asking a child how do you feel about a. About. Males who are transitioning using female restrooms. How do you feel about maybe a third restaurant. Would your attitudes about that and how is the school or how much the outside entity that is providing counseling services going to respond to those answers are they going to find your to your added to troubling so that there has to be an intervention. But the critical at issue here is student privacy. And parental rights. I love the idea of public private partnerships. But the question that was asked in not addressed is ten parents opt out. Would you put in this an opt in preference where you lay out for the team for the parents this is a service that we have decided that we're going to extend to our kids that have been identified as being in that free and reduced lunch group to the poverty funding group. Are we going to ask those parents can we survey your child and ask them questions about their home life about their attitudes on certain issues of the day folks I'm just going to tell you this is the ultimate Big Brother. It may have been the nine in a different presidential administrations. But it's not at all but nine in this current administration. It's a weapon. It's a tool that can be used to tell you that your children don't belong to you. They belong to the schools and we have feared for a long time the intervention of the federal government. You know there's been some presidents Ronald Reagan was one of them that's the one to do away with the United States Department of Education. Because he felt like we have to have what is the word what's the phrase local control. I hear it all the time I know I get a lot of push back on some of the legislation I try to pass because it you service local control with this absolutely this bill absolutely you service local control. Now represent Johnson said well it's permission. This anytime you take anything from the federal government it is not permissive. I found that out when we try to transition away from the park test. To the ACT which we eventually did. I tried to get us to put a hold on doing the park test because it was pretty apparent that the legislature or a task force of the governor somebody was going to transition us the next year to ACT so there was no need for us to do a one time test of the park test because if you don't have trends from year to year that information is useless in the part of the department of education said we can't do that we have to test no matter how badly. The practice testing is going in it was going badly you ask any teacher you ask any guidance counselor any student frankly students a students were coming home crying just because of the trial test but the department said bill we have to do the test will lose two hundred million dollars. That's the kind of influence we're talking about with this bill. They give you the money you gonna have to follow the rules folks this is this is something that needs to be further that it okay I think the community school approach has some merit. But it has run through this legislature way too fast way too fast the questions that were asked and in Education Committee need to be answered there needs to be respect for those that are concerned about student privacy and their data being protected and frankly there was not a good answer to any of the questions of concern. I really think that this bill needs to be reformed re referred back to committee. But if it's not I hope that you'll defeated and then maybe the sponsor will want to slow it down a little bit and I'm open for questions represent waiting for what purpose question please you're recognized and a represent what is this is for you possibly for the bill sponsor as well but you mentioned permissive language was a permissive for the school's or permissive for the parents permissive for the schools there was another no mention no issue of concern about the parents choices and about them being able to either opt in or opt out okay so that would be a big difference that with that and so then the the opting in and opting out was that brought up in committee and was that rejected by the bill sponsor it was brought up in testimony by an opponent of the bill seventy spoke against it she had a serious property was something like ten questions about the bill I I chose to not go through every one of them but I thought the most critical one was this issue about parental involvement in giving them a voice of whether they wanted their students to be involved in this extended learning or it starts extended personal development whatever you wanna call it it is not permissive when it comes to the parents thank you thank you. It also is going to try to provide integrated health and social support with authentic family and community engagement. some of the things our community school coordinator does is goes out in the area make sure that the kids have. Wifi access that they have proper nutrition. That their clothing have been assessed these that they need to benefit not only them but their family. Just two weeks ago I sat in on an interview process where internships were being given out to kids that net don't necessarily get out and and have the opportunity to find a job but they they've had jobs at the chamber of commerce for the city utilities at the hospitals this is just a wonderful wonderful program and I'm so happy we have a debate for high school in Batesville Arkansas and I fully support a community school program and after what it does for our kids because this program truly is for the kids. It was found that the law only allows a Class D. felony in this case an example of a Class D. felony would be breaking and entering. And so basically the Bill begins by defining again statewide stated disaster emergency as we did in the other bill that's it affecting at least nineteen counties are twenty five percent of the overall population if we have a state wide state a public health emergency regarding public health and we receive unanticipated funds so what are unanticipated funds those are funds that are not regularly budgeted funds that we did not expect to receive much like the cares Act money and I know that there's going to be some additional money coming into the State soon with relation to disaster relief related to covid this would certainly apply and then discretionary we're talking about funds that are already dedicated for a particular purpose from the federal government and so sometimes when we receive funds from the federal government there earmarked that have to be spent for a particular purpose and so again we're talking about unanticipated discretionary federal funds related to a statewide public health emergency if we receive those funds the way that this operates is if we're in session or if we're in a recess from a session the chief fiscal officer of the state has to submit a detailed plan in that instance the Joint Budget now for out of session that plan has to be submitted to A. L. C.. that detailed plan has to set forth the. A plan on how the state X. plans to spend the money and then that'll be reviewed by joint budget and has to be reviewed and approved if we're in session for out of session than a LC has to review and approve that plan. And so that is essentially what the bill does and I'm happy to answer any questions.
