Has been an established tradition in school districts throughout the United States but few people seem to know how it started the idea a teacher appreciation week came from in Arkansas and who was an African American woman who taught in a school in the segregated south during the early nineteen forties Maddie Walbridge an Arkansas teacher decided that educators should be recognized for their contributions they make to society and make this
one the permissions miss what rich road every governor in the United States and corresponded with a host of politicians and leaders in education stressing the need for a national day to honor teachers in nineteen forty four one of the many letter she wrote with rabbi First Lady Eleanor Roosevelt. Miss Roosevelt acted upon this letter asking for the eighty first United States Congress to consider setting aside one day per year to acknowledge and
honor the work of our teachers miss Woodridge gradually saw her plan to honor the work of Arkansas teachers materialize as she continued to work as an educator in Arkansas Delta eventually serving as a principal in a north in elementary school and Helena Arkansas in the nineteen fifties that in the United States Congress initially declared March the seventh nineteen eighty S. national teacher day but only for that one particular year.
When teacher appreciation week was established in may nineteen ninety nine representative rush Holt a congressman from New Jersey delivered a touching speech as he discussed national teacher day before the one hundred sixty eight United States Congress on August fourteenth nineteen ninety nine just three months after representative press call gave his speech many would risk died at ninety years of age. Thank you Mr Speaker I'm colleagues today I'm bringing HB sixteen ninety seven to amend the law concerning no fault divorce I know no divorce can be a difficult topic we've had to talk tackle it in a lot of different formats in the session. This bill doesn't change any of the existing grounds for divorce.
There are still grounds for a separate living separate and apart for eighteen months for drunkenness for insanity for general indignities which is the most common ground for you have to plead that your spouse subjected you to such general indignity so as to render your life intolerable. This bill will also not affect covenant marriages covenant marriages as you will now have a different statutory requirement if you would like to get a divorce. What this does to.
Is it allows parties who don't wish to plead specific grounds to avoid doing so. The reality is anybody who wants a divorce in Arkansas is going to get it there aren't judges who are denying divorces because of the grounds plaid so this is not going to either encourage or discourage more divorce in the state but there are certain situations for example if you are concerned about your children reading of pleading that says
that you subjected their other parents to such general indignities so as to render their life intolerable there are people who don't want to have that in a public record they don't want their children to be able to look up at those pleading some day they don't want to have to explain what general indignities are or they don't want to have that public record at all because they don't want it in the community all of these records are available online now. In addition as part of the General indignities pleading what you have to do is go into
your final hearing and testify now some judges will go ahead and sign off on the divorce without requiring testimony but many do require testimony and the weight that exchange goes on the stand is that as the Attorney I look at my client and I say were you subjected to such general indignities so as to render your life intolerable and my client says yes and then I say explain them. And so then there's a second public record that is created in which the party seeking the divorce now has to verbally
provide examples of general indignities so there's two public records. This affects people who again don't want their children to read these it can affect people who are concerned about their standing in the community or about future job opportunities in the bill the ability to access these types of public records. And there are a lot of reasons that people would want to make sure that rather than having to plead a specific ground that they simply say we have
irreconcilable differences and we require a divorce so again this is not a bill that affects any of the other grounds parties may still plead those grounds this is not a bill that affects covenant marriage this would not apply in those situations this is simply for that small subset of parties who would prefer not to make a public record that requires a statement of grounds I take any questions if anyone has one. Of a covenant between two people that have made about where one person can break that on that hard day. Without a reason without an excuse without having to work through anything it's going to happen more. That is a fact. Statistically proven in every state in this country the no fault divorce has been an active. As many as eighty percent increase in divorces after noble no fault divorces have been passed.
I don't think that's the direction we want our state to go it's certainly not this direction I want our state to go personally I don't think that's the way we as policymakers one our state to go and it's not just about marriage or the two people that are involved in the marriage they're often. A lot of kids that are affected by a divorce and. I'm sure for some of you may have had a divorce some of you may not have.
Kids are dramatically affected by divorce not only. On immediately. But for future generations as well. Heads of divorcees are more likely to divorce themselves. Let me give you a few statistics. Children of divorced parents experience lower lower school scores in school higher absenteeism and dropout rate rate a drop out rate of thirty one percent compared to only
thirteen percent for children from intact homes. Children who experience divorce are fifty percent more likely to help to develop health problems. Children of divorce suffer higher rates of depression addiction an arrest. Eleven percent of boys from divorced parents ended up in prison before their age thirty two compared with only five percent of boys from intact homes. Thirty three percent of girls from divorced parents become team mothers compared with only
eleven percent of girls from intact tones. The adult children of a divorce of divorce are eighty nine percent more likely to divorce than those raised in intact families. I think I've got a lot more statistics to go through but. I think. Can you get the idea an impression that this is not good for families this is not good for our state and this is definitely not good for the

Thank you colleagues as I opened with this I know that divorce is a difficult topic representative Pilkington my mother I was baptized Catholic my mother was Catholic when she got divorced my father and I realized that's a difficult issue in the Catholic faith and and I respect that and I know it's a difficult issue in many face One thing that we do have to remember that when we're legislating is that were legislating for people of all faiths in Arkansas and of all circumstances we often don't know what those circumstances are for people behind closed
doors and with regard to the divorce rate in Arkansas it is it ten point seven percent per thousand Texas which is the US state whose law I model this after has an equal divorce rate New Hampshire which was the other state that had a good clean no fault divorce statute has a seven percent divorce rate so I'm not sure that we can say that making a no fault divorce
available is going to cause more divorces. And. I appreciate that many of us have had to make difficult decisions on these in our own lives or our parents did and I've mentioned before that I was a child of divorce and my parents divorced when I was about two years old and I was very lucky to be raised by for parents who cared about me and it didn't affect My ability to seek education at it did make me apparently make
this very odd choice for vocation but you know divorce is like many other things have good and bad outcomes a lot of that is dependent upon the people who are involved in it and how they handled the situation and that's true whether or not they plead grounds this bill is simply that another way to plead a way in which to not dear air dirty laundry if a parent or a spouse chooses not to and and nothing more so with that I would

I don't think I have to tell you all we've had an unemployment issue in the state and I'm sure many of you have gotten email after email after email and you've probably driven by some unemployment centers in your area and you've seen people standing outside in the cold in the rain. And wondered what's going on well I can tell you are department of workforce services people have worked long and hard I've gotten emails sometimes returned at four o'clock in the morning so and I have looked at what time those emails have been
returned. I'm first of all like to thank our employees at department of workforce services for their hard work this year it has been a long year for them and it's been a long year for the citizens of Arkansas. service children's jim Hudson they have worked long and hard in the been some very unseen employees that have worked and return phone calls for our constituents and help them unlock and get them out of unemployment jail and you know what I'm talking about when they worked and worked and worked with that system and try to get out of that system well part of
the problem is that system is very old I almost let the cat out the bag on how old the system was in committee it's almost as old as I am and it's a been a patchwork some of it is older than the cell phones that we work on it's kind of a mainframe some of you are as old as the system. Part of the problem is we've never updated the system we dispatched it over the years it's up to pot tire that's been patch so long we don't even notice the tire anymore. I want to give you some
statistics I think are important last year alone we had eighteen million dollars in fraud. It let that sink in we've only been able to recover one point three million part of that is our system is so old it's easy to get into they have worked with very little. In ninety two thousand nineteen they saw twelve hundred people average of twelve to seventeen hundred people a week in two thousand and twenty at the
height our department of workforce services. With this system. Ereli hanging on they saw fifty one thousand people at the height in one week that's amazing it's a wonder we didn't have more fraught with this bill we will update the system using tax dollars that are already coming in to update the system it'll be about thirty five million and yes I know that's not probably not quite enough but we need to squeeze that every single time out of that before we ask for anymore and we
will get a system where you can actually find out how many people are needing it every day you'll have a dashboard it will be something that we can actually use detect fraud early prevent fraud early find out how many people are on benefits the governor the Director anybody including citizens of Arkansas can see a dashboard it will be something that we can be proud of and actually use and get the job done it's time for nineteen sixty eight system to be kicked to the curb and have a new system that we can count on that's what this bill does it

somebody was in prison I'm not getting unemployment benefits but. If there was somebody that lost their job right right they won an apply for unemployment benefits and for some reason they got arrested. Incarceration is incarceration correct in so are you saying that that person would not qualify for unemployment benefits no I'm saying if somebody's incarcerated still has to go through the process. You have to eat until proven guilty.

may be used by teacher throughout the course of education as a supplement this method does not a court program the department education has twenty four core programs and list on the website the district may choose from in addition there's fifteen supplemental programs and they have until two thousand twenty three twenty four school year under this law to comply with that additionally as you know we have to push back the requirements for the right to read legislation for two years your covid teachers have to show proficiency awareness depending upon their level licensure in efforts to help the
state the Department acacia requested the position of an ombudsman so we can assure that deadlines met as children do not have time to wait currently is no group that monitors compliance with literacy programs the existing team is currently available for support and professional development for example the department has one dyslexia specialist for the state of the state has a population of as many as about ninety five thousand students with dyslexia their job is not to fix things the R. their job is to help and support with professional development the
ombudsman is tasked with ensuring the districts as a whole comply with the right to read you work directly with the secretary of education in fact this position was approved I just this morning by joint budget personnel subcommittee. the supplemental help or working with with individual teachers and and districts to provide support and education don't need to be able to be the people that are enforcing the legislation that this one is already passed and that's the goal of this ombudsman. What happens is positions are we going to have to continue to and reinforces and and check on this for decades are they permanent positions thank you for your question as established as one position and it is appropriate as a a current position because
the it's not just limited to only literacy there we had a number of other things that they have opportunities work with school districts enforcing current law and so my understanding is that that is an ongoing physician yes ma'am thank you represent Murdock for purpose question you're recognized. we discussed this issue stated for wild Education Committee yesterday in my question remains the same because I did not get a satisfying answer on page three I think lines six through nine

And this bill say is that the department of education cannot even consider such a person this is an educator. Retired or currently working has

someone who has been consistently involved within the world of literacy consistently fall within the teaching education both students and teachers with education has a specialty there and quite frankly according to how yes Secretary key put it it may be difficult for someone who's a superintendent to enforce regulations on people they may have relationships with that's not to not to say that it's impossible but it's easier for someone who may be a third party
to do so I would please. Not wanting to misquote Secretary key in this particular case I think we have to be careful on how we characterize what he see it his testimony but I will go back to the point of you saying it being a specialty person in this area I agree with that but that can be a superintendent or foreman superintendent that they are in the educational field this specialty their doctors may be in this area they may have focused on it in their in their district wherever they are you
know in a different state or wherever they are the point is I understand the need for an expert what I don't understand is to be the way we're excluding. And an excellent educator possibly they have been trained in education thank you excluding them from this position it needs to make sense on why you're doing it because it appears to be. Bias in arbitrary it does not
appear to be what we should put forth this legislation fair and equitable it does not appear to be. Thank god I don't know if that's a specific question I really appreciate your concern very much in in in your point of view as I said the Department education specifically felt that that these qualifications were what were best the with this position is on. colleagues I first and make very clear that I am fully invested all on board with the science of reading but as a former elementary school educator a policy maker in a mom of young readers and I agree wholeheartedly with this body commitment to implement the science of reading with urgency and fidelity and all of our schools and the sponsors of this bill representative Brooks and especially Senator Clark I think they intend this bill to go after districts who are not bought in the winter dragging their feet her wanting to continue with the status quo and not comply with the saints of
reading requirements that's what was stated in committee yesterday and I agree that those schools deserve accountability and perhaps even punishment but this bill goes beyond that I think it goes too far that's what impact my district no there were concerns about the impact in other districts I but I do want to speak to the specific concerns of Springdale and the largest district in our state personal I wanna make very clear that they are fully invested in and compliant with the science of reading requirements they have a strong curriculum team they have instructional specialist in every building they're doing professional
development that goes beyond what's required by the state but in tandem they're using a required probe I'm sorry they're using a reading program of instruction that would be outlawed by this bill it does utilize the queuing system what which would save you a student if a reader cannot sound out a word or if you sound out a word and can't meet meaning of the word you could use a visual or context clue to help you construct the meaning of the word so they're using additional
cues in Qatar in tandem with phonics at which is small in the science of reading this a particularly useful for language learners but I will say we heard testimony and I know as a mom of a second grader this spring the has found ways to purposefully and thoughtfully integrate their program with the principles of the science of reading they are not in conflict they are integrated and supportive they have against strong curriculum team that's making constant revisions and adjustments.
They have district created guides pacing guide instructional guides for teachers where they're taking out eliminating any of the cues that are in conflict that are incompatible with the science of reading and and this curriculum you know has reading guided quite guiding questions the medic units a work reader's workshop model all of that is in compliance with is incomplete aligned with current signs of reading standards and they're making adjustments and training teachers where it isn't and that's why I think the bill goes too far I'm I again I'm all in but I think this bill that would
deny district would reduce their funding you know to to continue to use the program structure where they are being very thoughtful and intentional to integrate the practices of the science of reading within that current curriculum I'm I think that's further than this bill was ever intended to go I know there are other concerns about the about budgets men about potential conflicts of interest and others and the minor about the particular curriculum concerns I appreciate about. Mr Speaker calling still the only reason I come down to speak against this bill is the I said in a co op meeting with my superintendents back in Southeast Arkansas and I ask the question about what is one area or one thing that we have done is a legislation that calls issue trouble our our harm that we need to address and work with. This was one of those areas they all agree that the science of reading is that an excellent program and and they endorse. One of the concerns they had
with the programs and the resources that they have to choose from the cost. And what the cost breakdown is per student one of the superintendents quoted that the cost per student with the software that they were told they had to choose from was over five hundred dollars a student in that in that in her school and that's too much these are great programs I know we we travel we learn about these programs we come back in implementing to solve a problem but sometimes we create additional problems and that's
the problem of funding these programs on on this on school campuses and super and in the school district so I'm expressing those concerns because I sat in that room for about an hour and listen to those superintendents on this specific topic so the first part of that bill. If you do away with that and you just went with on this but someone would be an excellent bill because I don't know if anyone's reached out to the school districts that are binding and to find out why.
I ask the question they told me that is the issue would be a great step forward but penalizing the districts for not implementing the program because of the cost may be a problem I say ask those districts work with them to improve the by and or or provided a less expensive resource but I think that's the reason the odds but some will find that the school district's having a hundred percent embrace this this program so with that I would ask for a. Good vote.

In the early grades at several of us were fortunate to be able to attend the the hunt Institute they were talking about brain development. In the research that they presented to us told us that if the students are not reading at grade level by the fourth grade they'll never catch up. And everything after that just spirals out of control you can't teach size you can't teach social studies you can't even teach math because so many math problems are word problems if those students are not reading
at grade level. We've passed several terms ago. Senator Elliot was one of the the first proponents really of pushing about dealing with dyslexia. I know we hear so many times in a representative Cozart gets tired of hearing me use the phrase kicking the can down the road. And we've done that on some issues but this is one that we certainly have done that. It's one of the disadvantages
really of only meeting in session every two years because we can say well and I heard someone say this in committee well we've got something that we're going to implement on you know but if that didn't work will come back in two years what about those kids that have gotten past that fourth grade period. And they're they're not reading at grade level. They're not gonna catch up. Member representative John Walker used to talk about some things that we do an education that are really just a pipeline
to prison. A pipeline to Under achievement pipeline to poverty. Not reading is a pipeline to all of those things. We can't quibble and should not quibble about whether the ombudsman is going to be a super two former superintendent or not because if you read the bill one of the things in the bill is that the all ombudsman also is given the authority to be able
to work individually with students if parents have given permission. I don't know you know one thing superintendents do bring to the table is that they've got years and years of experience sometimes decades. If you have to ask how long has it been since the superintendent has worked individually with the student probably a long time so we want specialist we want those who are specialized in working with kids even working with parents to help them be able to
be at the extra teacher to that child and helping them learn how to read. This cost of five hundred dollars per student don't be don't be deluded by that if thinking oh my gosh multiplied by all the students what we're talking about is identifying students who have dyslexia or have issues with reading and if it cost five hundred dollars for that student you may only have to spend that money for a couple of years. When they get to reading at grade level than they've got it for the rest of their their
years. This is far too important for us to be quibbling about the cost the five hundred dollars per child however many children it that money is covered in what we used to call of the poverty gap money or the I guess it was in SLA and now it's S. a that's money that is used to specifically target the poverty gap. In the poverty gap exist because students are not able to read
for whatever reason there's a lot of great programs out there to help reading you know Dolly Parton's imagination library is a great program of putting books in the hands of kids has their name on it their parents could read with them but you know what it doesn't solve the problem if they are dyslexic the science of reading is working. Our higher education institutions are starting to train teachers in how to teach that but what about the teachers that are already in our schools
that haven't gone through that training they need this exorcist inspire kids need this existence our society needs our kids being able to read so that whatever we spend it comes back to us in rewards so I appreciate you voting for this bill represents law for what purpose. can read in the English language and they read very well after three years I have a plus ten. In the reading scores after three years this program definitely does work so I ask Mr key Secretary key you know what they're doing the bill he said the reason for the bill is because the state wants to move forward with the science of reading and this bill takes those next steps eighty E. has committed to work with districts to address any concerns with their case through to reading
programs to make sure that they meet the requirements of the law when we pass this law in two thousand and seventeen it was to help bring our kids reading scores up. Because our scores for our state were extremely low in reading. This this program proves to work so let's continue to move Arkansas in the right direction and that's up with our reading scores and with that I would appreciate a good vote. Good Ole boy type stuff we got to be big in and just deal with
those people in those positions and make sure they're in a war so read so I'm for this program the science of reading not against it at all but it was something thrown in there to mess up a good bill. Who has dyslexia or some other type of reading difficulty. And for a lot of these young people I think a parent explained this to me today just to the. This bill is designed to help that mother. That works factory. Six days a week. Does not have the ability or the time does not have the time.
Those that the tail. This will permit a greater benefit to those young people. As a former coach I can share with you the. One of the most disheartening things is to see some of our young people who cannot ready. One of the greatest is heartening things is to see an adult in today's society who can operate.
So we have a responsibility to be good stewards of our tax money to be good stewards of the budget. And this is an opportunity of something this go on. The ability to ring.
