Members so in a lot of discussion let's bills been through quite a bit of changes but I just wanna walk through the language of the bill first and I'll get to the reason behind it so I'd be one of the bill requires that still school districts have disciplinary policies in place that require an administrator or there is a need to make a reasonable request for information related to adverse childhood experiences prior to implementing disciplinary action that would exceed ten cumulative days out of school so this only deals with those expulsions that in excess of ten which I've been assured are are not all that eighty one on page two provides for the definition of adverse childhood experiences to be used for the implementation of the act B. three on pages two to three outlines potential sources of that information C. one requires that the findings be considered and that the proper behavioral supports are considered and then six dash eighteen five eighteen detail as possible put positive behavioral supports and also requires the Division of elementary and secondary education to develop a model of positive behavior supports and resources that so the deal is this I mean resume removing a student from what is potentially the only safe harbor they have oftentimes does not make sense and if we're not asking the right questions were not trying to seek understanding we don't really know the origin of that behavior what this bill does just ask us to ask those basic questions so we can understand what is happening with that child and also making sure that we get them to support that they need there is nothing in this bill that prohibits someone from being expelled or child being expelled for ten years it just says they have to ask the questions additionally there's exemption for someone that brings a weapon to school they don't fall underneath this and with that you know when things I've heard I would say is that this is just too hard it should never be too hard we should always seek to try to understand and help I mean if it by removing a student. From school for an extended period of time you are guaranteeing that you're going to taint change the direction of their lives I just wanna make sure before we do that we do everything we can thank you. Senator Rapert you're recognized thank you and Mister president members agree this is a second layer of protection for our girls athletes in protection of their athletic opportunities and abilities and what this bill does is it and ends at different section of code that allows for the Attorney General to bring a cause of action for injunctive relief and any other relief available under the law or in equity against a covered entity and at a school and it deals with their funding so again it gives the Attorney General the opportunity to bring a cause of action and and in order to enforce what we of our state has passed and what the governor has signed and I think it's important to note that unless this is actually specified by statute and by this legislative body then that would allow for the Attorney General to take action but it has to be done by our permission via passing statutes that allows that to happen. So if the colleges to. Complying with NC double a rules and those rules are in conflict with the state law. This would make it where a college could lose their funding for a year under this cause of action against the Attorney General has the ability it says may bring a cause of action for injunctive relief and it does deal with the funding mechanism to provide those schools with the shield that says this is the state of law this is what the state of Arkansas has that and this is the law that they have to follow in our state so they would have to make a decision to risk the wrath of the NC double a or litigation from the state of Arkansas I think they have to make a decision whether they're going to support young girls athletic opportunities on an equal and fair like playing field that's the decision that they have to make yes of the city of the question was I I'm still I'm not an attorney but I still struggle with this because I know we've seen U. Attorney General file lawsuits over lots of things that aren't in state law so we have outlawed this activity already. And you're saying that the chief law enforcement officer of the state has no authority to bring a cause of action I Mark I'm repeating the testimony that was given in the Judiciary Committee as a answer to your question in committee so and you say that is the case and the case the the Attorney General cannot bring a cause of action without this legislation even though someone violate state law again I'm repeating the answer that was given to you and Judiciary Committee okay thank you. Consideration that this could impact down the road that we not be able to have a regional basketball tournament in Little Rock because of the NCAA and their position that's that was my problem. What we're dealing with is the fact that there are clear advantages when a biological male is competing against a biological female we have seen that case very clearly in the state of Connecticut where you had to biological men competing in track events and a couple weeks later they switched over to identify as a female and competed against girls these young girls have been training their entire lives. In order to win their competitions. And all of a sudden two weeks later they find themselves in a competitive disadvantage with stronger faster more athletic more muscular biological meant that they were competing against. I don't think that's right I don't think that's fair I think that we have bands performance enhancement trucks I think when Lance Armstrong got his titles taken away from him because of. The measures that he was taking in order to gain an advantage of actually putting oxygenated blood into his system. And the bands that they took away his titles why because he was trying to gain a competitive advantage so you can't have that then allow this. And so I do believe that girls should have the right to have an equal opportunity for an athletic events it is so hard to try to even get your foot in the door sometimes when you're a young female athletic person I know because I fought hard just to try to get my girls the ability to have a girls soccer team and rule Arkansas and it was hard to do just for them to try to get onto the field of play it was hard and we had to fight and we had to raise money and we had to do all these other things. That we had to do in order just to have the opportunity to get to play on the field of play. You don't find that when you're a young man who's playing baseball or basketball or football but if you're a young girl who wants to try to compete in pole vaulting but guess what you're rule school didn't have the polls they don't have the coach they don't have the facility. And so they discount you. And then you fight and you fight and you fight and you earn your ability to compete at a state track competition just to have a biological man. It was ten times more capable of jumping at a higher pole vaulting height than you are. And all of a sudden all of the time and energy and all that work that you in just flew out the window. And guess what your scholarship or your recognition or your notice at the next level in college just went away because they don't look at just they don't look at you if you don't win the title they don't look at you if you don't get to the state championship they don't look at you you don't have an advantage. And so this is an important piece of what we have pass this is important to the attorney general's office presently as well as to any future Attorney General's office and I think it's important for our state of Arkansas. Yes the NC double a or does the college have to honor the scholarship that that girl would have lost or she just got a lock she's out of luck I don't know if we're and if there's anything like that but I know she's out of luck and I I can tell you I have a friend whose daughter they have to train and train and train and she is a Joplin thrower in the shot put thrower in track but you know how much money that family has put into her training and the videos that you have to do in order to get in front of the big schools in order to get the athletic opportunity in the training and she's amazing but even as amazing as that young girl is if there is a guy who her brother was a track star at the college here with my kids. I mean it would be there's no question they could out throw her easily and so no the scholarship can't be held and you're never going to be able to get in front of those schools if you don't achieve those titles and the sponsor on the podium in your high school competitions so there is no way that a female athlete who's been disadvantaged by gender altered individual can seek recourse against that institution because she was replaced by mail is that correct or that's not covered under your law now is it which the law that we've already passed gives a private cause of action to an individual and to a school this allows the Attorney General to step in to prove to prevent a school from from at embracing those types of athletes that they can compete and override and and gain an unfair advantage thank you senator Elliots you're recognized for a question. In our law for dash twenty nine dash three oh seven seems to only allow licensed physicians control of the operation of a clinic however that inconsistent. with the actual practice in our state currently about fifty percent of our physicians are employed by hospitals almost every clinic in Arkansas has at a minimum an office manager that's running the day to day operations larger clinics and hospitals have CFO's CEOs handling all the business operations this proposed bill would simply codify a practice when the within Arkansas of non licensed individuals handling the business side of medical practice okay this is not a scope of practice bill. This bill is not change who oversees medical practice this bill allows full autonomy for the licensed physician if a business owns a clinic they cannot override the decisions made by the doctor doctor physician also takes a note of that they will do what's in the best interest of their patient so an entrepreneur our business I don't think it's going to talk a doctor out of violating their oath. Of this bill it does not remove the medical care of oversight from the position as it is now only doctors can be entrepreneurs I think about that only a doctor can be an entrepreneur in Arkansas and I'm reading from a the AMA resource directory list Arkansas is one of the most restrictive and allowances for. Not a licensed medical people to be on the board and it says for Arkansas for example all the officers directors shareholders of a corporation subject to this subchapter shall at all times the person's license pursuant to the Arkansas medical practice act so again this bill would open that up. Well okay then who who is supporting this well everyone the votes for this I guess and people of Arkansas are the ones that have come to me citizens who were such as community smaller communities who would like to band together as individuals to maybe start a clinic in their in their community but I had no large corporations several people come to me it's just being driven by large corporations and you can guess the titles of those this is not true you in other words they know corporations that are behind these well I don't know if not come to me the only people that have come to me have been individuals okay all right with no requirements and if the corporations decided to come and to you know it they wouldn't have to answer to anyone that would be the sole yes or no answer physicians would not have a voice it would be like physicians work for these corporate people and they do what they're told and I think this is very bad for medicine of. And did you know that the legal profession does not allow someone who is not an attorney to help an office just like physicians do not allow that and let you all or a physician did you did you know that this is not unusual well I'm. I know that attorneys do that but that's not what this bill is about and when I know that. Corporations in our state well largest employers in our state hospitals and they're not regulate it. Was asked in committee the other day why of the medical society was testifying against it benefactor the only large group that I know that it's approach me was asked the medical society was asked why they are not contesting the fact that hospitals are employing doctors and they're just kind of a wink and a nod to hospitals they're not complying with it the hospitals have a minor exception hospitals are also in in the business of taking care of sick people and this is not a wink and a nod it's just a relationship. but we we we let those who are not in the medical profession of by hospitals in employed physicians then it will be those who are on the the cleaning will be in charge thank you for your answer I would disagree with that this bill specifically says that the doctor has full autonomy and when we're going to say that a large corporation like a hospital S. the same degree of supervision over doctors as a company would we also say that will hospital's medical company well if we had an individual that wanted to open a clinic in one of our rule hospitals they then become a medical facility also so I think we're being very restrictive with one of the most restrictive in the nation in regards to this and this is an opportunity our Arkansas to move forward and I think in a really good way I appreciate. If I if I am the corporate sponsored this hospital could I decide for example I'm not going to treat certain types of people or at certain ages of people or something like that going to do this. Senator Sturch you're recognized thank you Mr president colleagues Senate bill six thirteen is an effort I've been working on with the Department bag for several weeks now so so what we're doing is we're trying to streamline the funding that we currently have for county fairs we're not asking for any more general revenue which is trying to spin the dollars we already have more efficiently so you'll see through the bill most of it is clean up language what we're trying to do is eliminate to fees that really in my opinion where necessary so one was a two dollar or speak for every horse of the state of Arkansas we charge two dollars but for some reason that wasn't going to county fairs is just going to livestock and poultry so department has agreed to absorb that internally within their budget then we had a four and a half percent surcharge that we would charge on gate admissions to county fairs and that was all over the place some county fairs regularly reporting it somewhere just giving a dollar into this state so I've asked them as a way to kind of someone give a fair funding allow fares keep that themselves and anyway they've agreed to that to absorb it within their budget so mainly like we're doing like I said is where eliminating some antiquated language as far as the question goes and it was so convoluted as far as their premium funds and construction funds are trying to get all that consolidated so no fair will lose any money the same place just trying to put in one fund and make it more efficient I'll be glad to answer any questions are there any questions for Senator Sturch. Are there any questions for senator Gilmour senator David you're recognized for a question thank you senator Hammer in your conversations with your people work with on this have there been any provisions or any thing kind that that helps protect students that are just pulled out of school because their parents are mad at the school district for some reason maybe they reported abuse on them and I mean oftentimes those are the kids that just go missing involved in the cracks and while I certainly support home school and making it easier for kids people out from school what provisions are we looking at for kids who were just pulled out for no reason other than their parents abuse in the home without anyone to report them to that question this bill started as totally doing away with a fourteen day waiting period we've left it five days that was language that superintendents and other school officials had suggested I think it's very rare that you see you know. People with maybe tempers flaring remove kids so I think that with that language five days is a is a good way to the lead everything maybe cool down there's also provision as well to make sure that anything related to school property is returned as well so again I think those are very rare certain circumstances speaking as a home schooled student myself all my siblings were or home school as well so again I think if the intent is there I think the parents are typically going to move that direction so again leaving in the five days was away to I think make sure that everybody was happy with that. Thank you senator I'm just curious what and problems are being addressed in this bill like what issues are we currently having because I know that they have jurisdiction all that stuff is pretty clear and current law can you help me understand like what this clarifies what problems to solve them again so it's important to note that depending on where the school is located their jurisdiction may be in the county or it may be in the city or it may be a combination of both and some schools do you have memorandums of understanding with our local law enforcement agencies but some do not and so this is to provide a consistency of what those memorandums of understanding would look like and to make sure that you have some consistency throughout the state which right now there is not that consistency and it's really important to reduce your response time and when you have an unfortunate in incident that would occur on the school campus you want to make sure you have clear communication with all parties involved that you have a plan of action to reduce the response times you can save more kids lives that it's important that there's consistency across the state and that every school does have memorandums of understanding in place where some schools do not. Senator garner you're recognized for a question. Thank Mister Mister mark the other bill if you do not get a memorandum of understanding with the local law enforcement you cannot as a school have a school resource officer so if they don't reach an agreement or they can't come to terms of what that memorandum would look like. By this law thank you cannot have a school resource officer on campus is that correct so some of the issues also that have been address with this is that you do have school resource officers that are there in a combination of types of agreements I've employments with your local law enforcement agency and a memorandum of understanding is really important to clarify who is going to cover which how that's going to be handled and so this really I see this as a protection for your school resource officer as well so you have the certain level of protection or not level protection you have a certain level of communication an organization that I address and Senate Davis's response but on the flip side you may have a school resource officer that's employed by the school but also by the agency and there needs to be clear lines about Hughes responsibilities lie where and so that school resource officers actually protected in that scenario and I know that that occasion has arise as well in certain schools and it's really important that and the schools and those at the financial responsibilities of each party is very delineated as well as chain of command in process and for training requirements just to be clear though if they do not enter into a memorandum of understanding. I don't time we try to make it we're all of our local school districts in the local police departments contracts are going to be the exact same throughout the state of Arkansas we don't want their contracts to be same because you have a different scenario that you're gonna be addressing the matter where the school is located or how that arrangement his hat you know there might be every schools going to be able to do it differently and that's good we want that to happen because every school has a different scenario where they're located in a different area so you may have a county response you may have a city response or you have a scenario where it's a small school district and so they're employing a school resource officer in conjunction with that county sheriff's office or with that city police officers right so but we need to make sure that you have a memorandum of understanding so that your financial responsibilities are really clear between the school and that local jurisdictions so that that school resource officer doesn't get caught you know in the middle of something where he's he or she is just trying to fulfill their employment but I think it's really critical important that you do have these in place also for the training because the training is going to be very specified for a school resource officer because the scenarios on a school are very very different than a scenario you would find out in the field somewhere and so the training is very specific to that school resource officer and to make sure that those people and the administration have a training as well so that they understand you have a different type of employee here than you would for your different teachers and so I think it's important that you have some consistency but that there some flexibility as well as opinion on what your situation is and your employment is. Of Arkansas criminology department this bill follows what what she uses all over this state as best practices it's based on the best practices that are out there right now which she keeps up to date that that's what was testified to the committee is not right yes senator Elliots thank you for the question yes the training goes through the criminal justice institute Dr Cheryl may end and three and you're right she works very closely with the FBI and with a lot of different other organisations but there's a consistency in that training and we we want to make sure that you have a school resource officers get the benefit of her expertise and the training that's available there and it sounds to that there was not there was not any anybody who who spoke against this bill right to work with doctor may be for correct there's no retention yes ma'am thank you senator thank god there's no opposition to the. Our that spoke against it yeah that's it thank you. Senator Ballinger did you still have a question. Thank you Mr. It my concern is not necessarily the training of the the purpose of the bill but the that exchange with you and Senator garner isn't there are currently school districts that have their own law enforcement we do the same thing for them that you could do with university what we set up a mechanism that if they could not work out something with the local local law enforcement and all that they could actually on their own create a separate force within their their school system so this requires them to have a imho you with local law enforcement then essentially you're giving the local law enforcement the veto of whether or not they continue to operate that is that correct. No we work with the department of education on this bill and and and they really helped in re writing and re shaping the bill because we know that there are schools that do have that and so we took all of that into consideration to ensure that they continue to still do what they're doing and so they're going to be components of that you know which is listed in here that may or may not apply to that situation but you know we know we know of those different schools and they're doing a phenomenal job and we want to ensure that that continues but there's other schools that don't have the capacity or the ability or the resources or the funds to do that and so they're they're relying on those other department as those those partnerships with those local law enforcement jurisdictions and so when you're relying on that type of a partnership we just want to make sure that there's some clarity there and how that's going to be operating and and also in response time you know knowing in coordinating those responses are really really important to the safety of the people on that campus okay so your understanding that an Emma you wouldn't be necessary in that situation where they have a department within the school my understanding is the department of education works you know closely on this piece of legislation and so we take into account all of those different scenarios out there is that related to school resource officers and especially the schools that do have their own law enforcement agencies that have the ability to do that That my understanding is that's not going to be affected by this thank you.
