Allows for folks that are using medical marijuana to transport a certain amount of medical marijuana and make that legal so that when they are pulled over and they're carrying a legal
amount of medical marijuana that is okay and there's no confusion in that it also allows or stops if you're bringing medical marijuana or marijuana from another state that is illegal and put some teeth in that law with that I would appreciate a good vote. Was that a student there I believe a male student wanted to be called by a female name. Okay that's fine it would they the teachers were not coerced to do that. They voluntarily did that but the administration and everyone else at the school was instructed that if the parents called the school asking for the child that they were to make sure that they continue to reference the child by its given name. That type of deception
especially when you're talking about not letting the parents know what their own child is going through shows that we have a problem. This bill does not specifically address the example I'm giving you but it does put a spotlight on the fact that it is something that needs to be addressed and so I think that's a good starting point would be to vote for this bill. bill for Senate bill two ninety two while Senate bill two nine two provides grant monies for equipment nonlethal equipment for police officers of. My body cams Senate bill three forty six provides a framework for the retention and the public access to that audio visual and audio visual information provided by those cameras the first thing the bill does is really it sets a standard for the retention of the information
currently the records are are capped. As determined really by the local departments in most cases it's around thirty days of our last this bill sets standards for retention based upon the criminal investigation information that may be on the tags style of a felony attack to have maybe it was investigation of felony when it would have to be retained longer than something that might just be a routine traffic stop but all
information would be kept for thirty days the second part of the bill addresses how an individual a law firm or private company can get a copy of the audio visual information the for your request this bill allows for an entity to get three hours. A personal or equipment time within the thirty day window so let me explain that. If an individual requested information. And in the pro and the processing of
that information took less than three hours of personnel and equipment time then and that individual had not requested information in the prior thirty days that information would be provided absolutely free to the individual. Based upon the current for your request this will address about ninety five percent of all for your request. the most of them are handled within the House ransom also the ninety five percent that would all be free so what about the
remaining five percent. If there if the request required more than three hours then the individual. Make the request would be charge the rate of twenty dollars per hour video so if it was an hi it took six hours to really put together a half an hour video the individual would be charged ten dollars if it took it took.
it doesn't matter what to for every hour video it's twenty dollars right so if you ever two hours of actual video it would be forty dollars except. So some of you may be wondering how will take more than three hours to process any of this information you know we got computers and flash drives and all that well the truth is it's quite simple. The most obvious thing that has to happen is we have to have information redacted are blurred off of these a great example would they made an officer's
body cam that captures the image of a minor in the background so much that minor's image would have to be blurred out so this video when you make a request they have to be reviewed an officer trained officers are trained individual goes to and looks at all the videos. and then. What redact any information another good example is on the video this I'm talking to some law firms would be possibly from these cameras are very high resolution and pick up some personal information while they
were in someone's house that would also need to be redacted. Another thing that requires a lot of processing time is actually finding the video segment that the request to once. If you are a routine traffic stop in the relatively easy you know that the officer that's all record at the time that that was not the body count in the dash cam could be pulled back and I'd be very easy request but if if the request actually was maybe all the interfacing with the part tickler individual that was
incarcerated for a couple days that might require a lot more time to actually find all those pieces of information where that individual requested so that's the reason that it takes a little bit longer than what you might think to do this. I like to take just a moment to review a few. Of the abuses of the existing for a city system right now as I mentioned earlier ninety five percent of all for your request are going to be just fine or gonna be handled at no charge.
The first example is what they call a fishing expedition. Someone request twenty four days worth of video from the detention center. You can imagine how many cameras are in that detention center any police officer walking in and out of that facility with the body came on that body camera video would also have to be scanned that would take days and days and days to process the fishing is expedition replies to
this the person is simply looking for a client he's looking for something in there somebody in there that possible he could use a client is using is doing this at the taxpayer's expense. Another example. These are by the way actual examples that the. Of request was an individual that was unhappy with the way the local law enforcement handled the situation so they made a major request for for you information that they didn't even pick up all that had to be
processed at the taxpayer's expense in the final one. Is an example of where a law firm our our lawyer sort of uses the for your system to get around some of the current laws if you have a client in you need information regarding the body cams a. Video or anything like that you could have avenues to get that free of charge you can go to the court's request information there's a process it's called the discovery a process for you
will get that information three but it's much easier just to put a four year requesting for a lot of information that requires a lot of time the process and then you can pick it and saw that pick and choose what you want now that so that that would be another example. I want you to imagine for just a second an officer sitting in front of a computer. At the police station the viewing hours and hours of data from a four for your request. What's happening at that point time is that officer's patrol
car sitting out there in the parking lot of the of the PlayStation. Which means it's not making patrols is not protecting the people which is where that also needs to be what this bill intends to do is to make sure that transfer this video is available to everyone but just to try to get rid of some of what we call partisan FOR your request in closing I'll just summarize in saying that S. B. three forty six set the standard for the retention of
audio visual information that most cases. Exceeds the existing local standards. it allows for the for your process to work is I would argue is intended to work. It provides ninety five percent of all for your request individuals at no charge. And finally it will prevent the abuse of the system this bill was heavily modified on on in the House Committee and that was done after I held a
meeting with the press of Arkansas press association the broadcasters association members from the for your task force for their the association accounting firms there the sheriff's association was that the. Task force the for your task force an individual for task force professor. Find out who I believe is actually the head of that task force actually endorses this bill as amended and with that

which is yet to fully recover the two things it does first allows a restaurant that already has an ABC permit to expand outdoor dining with notice to ABC rather than going and getting prior approval from ABC that's just reduces the amount of red tape that these restaurants face as they expand outdoor dining is still do have to get all the municipal or county approvals that may be required second thing it does is it allows restaurants to remit sales tax on a quarterly basis rather than monthly for just the next year that'll help them with
cash flow and administrative burdens is a get back on their feet they still have to pay the same amount of sales tax it just gets a little bit more flexibility as to when they have to remit that's all does justice two things we can do that are kind of easy things to help them get back on their feet after we've got so much of them during the pandemic appreciate a good vote Ladyman. The tax relief is only for restaurants to have a seating capacity of twenty five people or more.
Why would we allow that for all restrooms why are we why is is so narrow. And the other one is open a minimum of five days per week. Well I have a number of restaurants in my area that are mom and pop they're only open three or four days a week does that mean they can't do this I mean I wonder why this is so narrowly focused so I'm may not be able to support those questions cannot be answered. approval so it's just kind of an applicables they don't have that permit as the limitations those were just put in place so that we have a little bit of a reasonable sense of what a real restaurant as we didn't want some of these entities that came and that maybe were borderline to be able to take advantage of this this is really for established restaurants that operate five days a week and I have a certain amount of seating capacity so that's why we put those kind of guard rails and but I appreciate your questions and appreciate a good vote.
