Mr ladies and gentleman the Senate I I wanted to be joined by the members of the Pulaski County delegation to honor this particular person and I don't normally read all of the resolutions that we are presented but I'm going to take the opportunity to do that today because of the specialness of the individual we're honoring whereas Mr Joe Booker is a native of South Carolina but relocated to Arkansas attended Arkansas state university received his bachelor's degree at Arkansas Baptist college in African American community leadership and became an Arkansas. And whereas Mr Booker began his broadcasting career in the military in nineteen seventy six as an announcer in the armed forces is armed forces career network and continue to hone his
skills and broadcasting after college graduation to become a leading radio personality in central Arkansas known to many as Broadway jim. And we're as Broadway Joe has had an illustrious career full of awards in leadership roles in the industry but is always made time to give back to the community the volunteer involvement with local organizations and whereas Broadway Joe is currently the director programming at cumulus media Little Rock program
director for K. I. P. R. power ninety two point three FM host of the Broadway Joe talk show and host of the Broadway Joe video show little rock's first urban music video program and we're as Broadway Joe is use this public platform to encourage individuals across the state to receive one of the available coronavirus twenty nineteen vaccines and whereas governor Aissa Hutchinson noted Broadway Joe's influence in a
recent press release saying and I quote the vaccines are the most important tool in our fight against code it the vaccine is our big gun and if people participate widely the number of cases will decline some people are reluctant to take the vaccine and I understand that members of the black community have historically distrusted vaccines but black people are disproportionately impacted by cold it so it is all the more important they have the vaccine Joe Booker star of the Broadway Joe morning show is encouraging
his listeners to take the vaccine as well he's made a public service announcmenet by the Arkansas department of health on quote. And whereas the press release quoted broadly Joe for me getting the vaccine is the right choice because I love my family I love my wife my children I would do anything to keep them all safe right now the best thing I can do is to commit to receiving the call backs COVID nineteen vaccine but those of you who are unsure about getting the vaccine I urge you to think about your loved ones many of
you may have underlying health conditions or be at a higher risk of contracting the virus I know keeping them safe as a high priority to you just as it is to me and we're as Broadway Joe has been known to say that family is the key to all of his success and he and his wife ready have been married for over thirty years and are proud parents and grandparents now therefore be it resolved by the Senate of the ninety third General Assembly of the State of Arkansas the house of representatives concurring

Board Intermin membership of the Arkansas State Medical Board. Sturch Sullivan. Thank you Mr president over the course of time aboard ship become more more powerful controlling licenses of many professionals their income or scope and hundreds of thousands of dollars at times these boards or even more impactful and exercise greater power than the legislative bodies there are times if there's a need for a reset that's what this bill does Arkansas continues to rack at the bottom nationally and the
board has some responsibility as does the legislature and the appointing board bodies this bill recognizes the institutional knowledge and this one person that testified against the bill suggested that this bill doesn't consider that has factually incorrect this bill only re constitutes to allow the appointment by the governor the Senate and the house nothing precludes appointment of current members. To suggest that that the testimony did that there's a
personal vendetta on my part against the board is just not correct if that were true there would be no provision for reappointment. We heard testimony from a medical board that this board should not be singled out and if you'll remember the Senate passed just the other day about the ad for board and we decided that the legislature should have a portion of those appointments. And contrary to testimony it was stated that the medical society only has a very limited
consultation and that's just not true the medical society consist consultant all fifteen appointments if they so choose and there's no provision that excludes that again with this factually inaccurate testimony. Testimony also said also said that this bill is is are cutting and I assume the medical society cutting out the process that may not be the people we want it wasn't indicated to the people we what is private soon since
that was a portion a person from the Medical Society that they were referencing. The bill this will equalize board representation currently the board represents eighteen thousand seven hundred plus professionals in eleven different professions. The changes in the number of recommendations are made by one of the PA which was a confers with Senator Hamels bit hammers bill it as C. O. T. E. currently
the medical society which has four thousand members have of the eighteen thousand professionals representative that's about twenty two percent but they currently have sixty percent sixty six percent of the representation and the medical board also only represents about one third of all of our physicians. Within the medical profession
are I'm sorry This bill moves the medical society to three recommendations which is more in line with their representation and folks it's time we recognize the power and influence of the medical society a private political action group has on this board they're powerful political lobby. Contributors contributing over a hundred twenty three thousand dollars as a pack they also have many members to make individual donations and they employ multiple lobbying staff or attorneys all of this is complete completely legal
ethical and just fine it's just getting the facts on the table. The medical society also keep a scorecard of victories and losses on their website they have a bill tracker on their wills website of over fifty bills and the identifier legislative champions they promote candidates that reflect their view. With ten appointment from the board the medical societies positions are generally reflected the medical board position as demonstrated by their actions or lack there of
all this is completely legal ethical and protected by our constitution I don't question that the only question is should a group this powerful I have that because say that bigger representation on our medical board are should the appointments be proportional to their membership they represent. Members this bill is about we will branches of government considering an appointment testimony said I implied that if we're going to do this to the medical board we should do it all the boards and I think
that's a valid point just as we did for the apple board the other day I think a good starting point is with the medical board sensei I have so much influence over what's going on in health care in our state. It also strives to have equity of representation on the board so move the medical society down the three recommendations it adds an O. T. E. and it makes that board more representatives folks there's no nothing in the bill that says the medical society are members of the board
can only have three members on the board is not what the bill says it says they have three recommendations you may have ten eight or ten or nine or ten or twelve Medical Society members on the board so it doesn't prohibit that. Again the goal is for us to strive to get off the bottom two or three states in the nation in healthcare if we're going to do that we're going to have to make some significant changes and this represents one aspect with
that Mr president I think questions Senator Solomon has presented its bill are there any questions for Senator Solomon Senator Bledsoe you're recognized for a question thank you Mr president I think you started off with this but maybe didn't see any snow one other states have divided their medical board like this and of. I'm not aware within ninety that's right and you know it's for is misrepresentation of
facts I believe you started that we're talking about the medical board and the medical society and how they ask about to of sin interesting just some some things that they wanted to know and I believe in our our in our committee of representatives Steve McKee explained that he was the one that asked the medical or to find out the medical society to call the medical board to find out that information is that not correct that's correct this is

that's where this bill that comes from in a larger way the one thing I do want to say is if you read this bill the only requirement at the governor's office have with medical science society is to consult and I can assure you that governor Hutchinson and other governors did not adhere to the request for those appointees that were you know put forward by the medical society I can assure you of that I'm also it does away with our Senate confirmation in the bill which I have some issues with additionally it
doesn't do anything to require except for consultation amongst the Speaker pro tem and governor's office at that there be statewide representation on the board and so there's just a number of issues that that I see in doing this and lastly that consultation is always going to be strong obviously there's divisions between the house Senate and governor's office I don't think that that's helpful especially when you're asking everyone to come together to make sure that we have
statewide representation. again I I just I just I think there's some flaws the other would be a minor standards for six year terms I was trying to read quickly again but these are six year terms are protein and Speaker. For most practical purposes serve two years terms. Which means that there's going to be someone that is accountable to no one on though that board that after you know that the term of the pro tem ceases to exist they will still be in place again I I just think there's some issues with the
bill I I do generally understand what you know wrecker Senator Solomon is looking to do but I'd ask for a no vote on the bill. would not do a check with the. BLR and also the medical board and the department of health in the summer the summer they presented no documents or commentary that prevents a physician from being an employee of a private business according to be alarmed according the administrative rules legislative attorney who handles rules relating to the state medical board the Department of Health they do not have rules which address these questions directly
the rules seem to assume that health facilities may employee positions notice the term health facility that doesn't referred to a hospital or clinic it refers to someone who just has a health facility so that could be an individual a private individual corporate group they applies to anybody who has a health facility. A private citizen can open a health facility just as a private hospital in businesses do. Their email for the state of
Arkansas Code does not specify what requirements or standards exist for an employment at a quote medical facility whether public private art it was not dependent on the ownership a medical facility may incorporate under the business corporations act a medical facility may incorporate under the business facility act an employee of a corporation who is licensed under the American Arkansas medical practice act which is different from the medical
corporation acts both of them and all those people remain subject to the jurisdiction of his or her respective boards generally speaking physicians former corporation American medical corporation under the medical corporations act for tax purposes and to allow for the potential or the ability to do income splitting among licensed physicians who practice medicine it's a business decision that's dependent on each corporation
medical corporations act is only applicables to physicians who format corporation. Other businesses can organize a corporation under the business corporate of nineteen eighty seven and can employ other employees as long as those employees are on life who are licensed do not interfere with the patient physician relationship but they don't have a certain tax and commercial benefits under the medical corporation and this is from the Arkansas department of health Senator Solomon it's my understanding a private business
can hire position but I'm not a labor labor or labor attorney and you might want to discuss this with one in regard to business corporations so that discussion happen with the Bill R. attorney who does that. The executive director of the medical board can correct me at the end of that email so it's a medical board director can correct me if I'm wrong and there was no communication from the medical board director. Medical board provides no
response as to why business court can import decision physician in other words was one doesn't need the permission for the medical board or the Department of Health upon to hire physician just as a private business doesn't need permission to hire physical therapist a carpenter or any other occupation it was asked why do we need this to pass as you can tell their significant opposition and one who would try to do this would certainly face opposition most likely in the courts.
And there's a lot of folks who can't sustain even when in a court battle. This bill only clarifies what's already in practice yeah we had some discussion last time I presented the bill about hospitals or private hospitals who are hiring positions folks they absolutely are they're not medical corporations they are simply hiring positions this bill would clarify that and allow those things to go on as
we're doing now. Okay it's a good bill for Arkansas it's a good bill for our communities and for commerce commerce in our state it's just another step in us moving off the bottom of the ladder Mister president I'll take any questions. a a physician there he said that he just rent space and the so I would ask you to look this over. And that you would consider the things that are already on your desk the dental society is has said because that goes far for medicine goes for physicians that goes for all those in health care and I would appreciate it thank you. have to be licensed by the department of health and that is a license that you can take away and you can revoke same with other types of organizations and so my concern is going to be always about patient safety and patient health care and when you don't have somebody that you can take and remove that license because of something that hopefully would never go wrong but that would go wrong then you don't have that opportunity revoked that license and so I

this violated the law what they testified to that is the lack of because what they do we we've been fighting against these PPL means for a long time and these PPM create a final that you don't get to do business in their sphere if you don't go through their final. And in order to get through their final there's a price to pay that's exactly what's happening here we've created a final that always goes through that professional association I'll speak to one more point we do have multiple professional
associations that's what the attorney for BLR said the purpose of the professional association is to allow equal distribution of money it doesn't have anything to do with the things that were cited today it's just to distribute the money those are professional associations to allow for professional corporation. You for example now with our old standards you can create an impression of a violation whenever a nurse's late for their shift.
