one thousand seven bath representative waiting in Senator Rapert you're recognized January twenty second is the day of tears in Arkansas. Senator Rapert members one think Senator Sturch for handling this and public health this but for some reason this resolution went into an orphan stage over there but I appreciate chairman Bledsoe and representatives receive excuse me Senator Sturch for getting it out this simply is our concurrence in the joint resolution that established the day of tears that the house voted on earlier in the year and that would establish that in
perpetuity every year that we recognize the damage that abortion is done in our country in the encourage people to honor that is a national day of tears and this resolution's been passed and several States appreciate your vote. Any questions all those of favour say aye. Is haven't the resolution is adopted. Transmit to the House senator Bledsoe house concurrent resolution ten ten by representative all.
Thank you thanks Congress to establish a maximum limit of a beauty alkaloid contamination of poppy seeds and ensure the safety of imported copies state and the issue an important record requirements and conduct a testing to ensure the imported saints do not exceed the maximum threshold about contamination. Senator Bledsoe thank you for. Thank you Mr president ladies and gentlemen of the Senate this house concurrent resolution from
representative Hey is to encourage the youth and to issue import Rick requirements and conduct testing to ensure that imported The contamination this all started of when a young man named Steven Patrick had a heck a law hello the son of Stephen and Bette hat hi Colonna died due to morphine in talks it intoxication to drinking poppy
seed tea and the source of the morphine was from commercially available unwashed poppy seeds in partnership with Sam Houston state university Ann wants poppy seeds that were similar to those found in Stevens apartment were tested and found to be thirty times a lethal dose of morphine. This wonderful young man who had graduated from Bentonville high school with high honors and who was a gifted musician died from something he order from a
popular website that most of those used to get many of our products. When the Colletti's learned that this was the cause of death they decided to partner with medical professionals academic institutions state and federal agencies and legislators advocacy groups and other impacted families to research educate and drive change to stop the importation and distribution of more contaminated COMMTTEE seeds and these are available
like I said commercially and they were doing this in order to save lives and to spare others the pain that they had in during I do have a statement here from our US senators and from the a congressman from the third congressional district of Ballinger to do something about this importation of contaminated poppy seeds but we have a current resolution on the floor and I just like to read just a little bit of it.
Whereas in two thousand sixteen Stephen Hackley died at twenty four years of age for morphine intoxication at the drinking poppy seed tea without being aware that the poppy seed coats were contaminated with the leaf lethal amounts of morphine. Also known as opium latex and we're as Stephen heckling junior's parents Steven Beattie tackle the who were residents of Rogers Arkansas desire to raise
awareness of the dangers of unprocessed poppy seeds and to advocate for change in policy control and enforcement to stop the unlawful and dangerous importation and distribution of morphine contaminated poppy seeds and whereas consumption of opioid alkaloid contaminated poppy seeds poses. A substantial public health threat that has been overlooked as a component of the larger opioid epidemic.
Therefore resolved that upon adoption of this resolution an appropriate copy be provided by the chief Clerk of the house of representatives to the United States Food and Drug Administration the United States Drug Enforcement Administration the Majority Leader of the United States Senate the Speaker of the United States house of representatives in the members of the Arkansas congressional delegation and I would appreciate a good vote. specific needs and this you know this includes I have no children and adults and and when the line is here and with us in the gallery miss Osborne is in so I just appreciate her long term advocacy for this and she herself is has a craniofacial abnormality that she has lived with that quite beautifully this whole time and so she is very passionate about this and I would appreciate a very good vote on this bill thank you

have a question Loures question go ahead Senator flowers yes Hester this is the state of Arkansas received a sales tax on on these up cigars sold online. Yes. So how do we collect them up as we pass legislation to do that. Well we we did two years ago the state of Arkansas and the federal government did online sales are or taxable now.
So Arkansas is collecting sales taxes now for online sales yes ma'am we are. Okay thank. Any other any other questions Senator you have a question about survival as a question. We will collect the sales tax for these cigars ago out of state correct that's correct will is a reciprocal agreement in place for the states that are shipping cigars into Arkansas must submit the sales tax as well.
Yeah you don't I can answer that specifically but I do know that that most states we do have we have a reciprocal agreement I can't say that we do on all states thank you. Yes please. Twenty plus years ago that if you're retailer in Arkansas you have to charge sales tax over the internet. in Arkansas outside Arkansas where ever you sale of is it two years ago that we pass the internet sales tax and we may have had if you're under three hundred dollars worth of sales tax or some there may have been some small amount I don't think there any exceptions but there could have been just to be from tell the truth but other than that anybody's anybody's ship in

Senator Hammer this press one personal privilege before president this bill. Thank you our doctor the day had to leave for an appointment and he was not able to be in here when I was able to recognize and by our doctor of the day is doctor ball of Simon medical or family medicine of Little Rock in our nurses today is Sherri Bernard and so expressed appreciation to our doctor the day and orders of the day thank you.
Senator Hammer thank you Mr president this piece of was still legislation comes in response to HR fifty three thirty which is running at the national level at this time what HR fifty three thirty would do if passed at the national level will put a two year moratorium on the collection of medical debt for two years the problem with that is in Arkansas the collection of that is for two years if that bill passes in essence what it means is that no medical debt would be able to be
collected and all of our providers would be put at a very unfortunate disadvantage you'll notice that this is in a do not codified form so that piece of national legislation does not pass this bill is still relevant but if it does pass it allows for the two years to pass and then they could resume tried represent our providers and collection medical debt I'll be glad to answer any questions. I wish to speak against or for I have a question Senator flowers
recognized for a question. So does senator Hammer Does this bill. What would limitation expired Some point sure is it becomes effective because of the consumer protection for medical debt collections act that you're talking about I'm. The five years.
I'm sorry Senator flowers I didn't hear the very last part your question I'm sorry. I would it be permanently a five year statute of limitation as opposed to the two year. The the bill actually has the date of January first of twenty twenty six and the reason that date is in there that is a five year date so let's say that the law passes at the national level and that moratorium kicks in we currently have a two year limitation here so what this would do is by that additional
three years for business to be able to be conducted as usual we would be back in general session before that date would expire so that we could take up the matter in the event that bill passes at the national level and that that is also why this is not an permit law and that's why I had to put is do not codified to make sure it would go away and it would not be in effect if the bill at the national level doesn't pass.
I'm trying to understand how is it just a temporary measure it with the the contingency that you. Have described. Well this bill would only go into effect if that bill goes into effect up there and the only reason this is being brought up is because we will be out of session possibly when that bill up there is determined and it for out of session in that bill passes then that puts our providers in a position
where they could not continue to work with debtors to pay their medical debt again if that bill up there does not pass this bill is null and void and then we can take it up there in the next general session. I'm just concerned that the the way the bill is drafted it's not that clear that you're just a. We're doing this on a temporary basis and a provisional bases
with the expectancy that this bill in Congress may or may not pass any school district in two years I mean could you not have included language that would be more clear I'm not familiar with just because is not codified that. It's not a continue with a five year statute of limitation.
I mean how did you come to that information somebody and tell you that. I worked with the debt collectors association as far as crafting of this and this was just the the language that was offered because nobody intends for us to be permanent in the event that bill up there should not pass it goes way if it does we come back in the next general session and again it just read section one of this act becomes effective only if the consumer protection for medical debt collection practices act HR five
thirty of fifty three thirty becomes law by January first twenty six so if it doesn't become law by the twenties judge of twenty twenty six the same evaporates. It will become law the twenty twenty six date they would. Let. Back to the your staff to look of limitation on medical debts. If if that's what you're saying.
If it would become law then we would come back because it would if we have that three year buffer in there in order to be able to address it when we come back in the next general session and it would get as pass at two year that two year moratorium that they're putting on their if we don't do this and it passes then providers are not going to be able to work with debt collectors continue to collect that debt and they're just going to be out a lock. But my question is and that is
asking for yes or no answer you it would take additional legislation. To get us back to the two year statute of limitation provided this act of Congress is passed. Yes ma'am it would take additional legislation which would become that would be on the agenda for the next general session only if that national law passes. All right. I'm just trying to understand why did you put that in the bill
that that the statute of limitation after this pandemic we are hand and depending on whether or not the. We're Act becomes law from Congress what could you just say it would revert back after twenty twenty six. Center I'm going to take this position if that. Provide you comfort this is a Senate bill when it gets to the house and I'll have amended down
there you can come back and I'll bring clarity to. So that you will be assuring the people of Arkansas that they would not. I have a debt lingering beyond two years for medical Services. I thank the bill. Specifies that but for the sake of clarity and for the sake of peace of mind I'd be willing to do what I said and will amended on the house and so come back we can concurrent. Thank you thank you.
Any other questions Senator Tucker. Thank you senator I'm sure you covered this I just missed it in that federal law that's mentioned in your bill it says that you cannot collect the medical debt for two years is that what it says. That that's what I've been told by the debt collectors association Arkansas and that's why they brought it was because I realized if that passes our providers are going to be in a bad way. Because our our statutes two years so there would be no time for them to collect sensually that's that's the issue right.
I'm one more time center Dr our our statue limitations on the collection medical that is two years right so if the federal law says you cannot collect within two years that's the issue that they're trying to resolve that that that is the issue yes Sir thank you Sir thank you any other questions anyone wish to speak against. Six forty seven by Senator Dismang to amend the law concerning the annual audits and procurement of water and sewer systems so does my the governor members actually a constituent reach out to me regarding this issue so the way it sets right now that if you service over more than seven hundred fifty meters or one thousand meters in relation to this is for water and sewer systems then you're subject to an annual audit I have a friend actually the performs these audits and others also does the degree to procedures that's what the people that are under those
amounts have to comply with the cost difference for someone that's doing agreed to procedure that may run about fifteen hundred dollars roughly at that full out on it would take about eight thousand dollars to complete and so I mean I ask my my friend is able why why you're cutting your pays the bills like the right thing to do is usually set for some of the smaller providers under two thousand you could go through everyone of their transactions in three or four days but again because of the costs associated with the audit and compliance to goes along with that insurance this then also tell or dovetails with
an audit you have this increased cost I've worked with legislative audit who oversees this they're the ones the proposed the limit at two thousand for both of those we were actually only seeking to look at it the water they recommended to do it this year also they said that they would probably do some adjustments to their agreed to procedures in lieu of the audit and I feel like this is a good compromise and and I think it's something that's good for us as we have to take any questions any questions

common sense bill that enables our paramedics and EMTs to better care for patients with rare disorders as classified by the National Institute of health this bill will allow medics to administer patients on medication as prescribed by the doctor without having to call ahead to ask permission made patients have rare disorders and have specialized medications critical to their care in emergency situations which may not be carried on the ambulance should them does have to come and pick them up it removes an unnecessary delay in the treatment and also allows patients to request to be
transported to a hospital where the doctor that specializes in their treatment practices and provides guidance for care coordination with local ambulance services and the patient's physician now the words the requirements are now that you might have to stop at the first house bill this would allow the patient that say they are going to a hospital that is specializing in their particular kind of illness that they could request by pass at first hospital to get to the one where all their medical records doctors are and that has a
history of treating a patient for that rare disease it's a permissive bill that doesn't require participation for ambulance services but just creates a pathway for better care if they want to participate has the approval of the Arkansas hospital ambulance association and the hospital association note known no opposition and Dr representative Dr Lee Johnson is the house sponsor of the bill appreciate a good vote. Stubblefield Sturch Sullivan Teague Tucker Wallace anyone wish to change their vote. Yes of the ballot thirty five Yeas zero nice bills pastoral House senator mark Johnson and House Bill fourteen twenty six by Senator Mark Johnson represented Lundstrum established the Arkansas fair food delivery act. Sir John. Thank you Mr president of house bill fourteen twenty six is bill
worked on with representive Lundstrum this put some limitations on the. The services that deliver food there's been some problems of them delivering food without the permission of the restaurants from which they're picking it up. this requires that they actually have an agreement with the restaurant that they're picking up the food from and delivering it the industry had a problem they were saying it would they need more time to implement it so representative Lundstrum agreed
to an amendment that will make this bill effective on or after January one twenty twenty two so I appreciate a good vote be glad answering questions questions Senator Trent Garner thank you so. Eighty. Restaurant they want to buy food from the I go to now enter and remain with. To purchase their food for somebody else that correct well. They don't have a right to go to my restaurant pick it up and not tell me that it's being delivered to a third party this
way I have quality control over it and I'm able to say. We've had some cases Senator where a service would make a photocopy of somebody's menu and they put it on the website they might that mean you might not even be valid anymore they may have changed our menu or drop things when the restaurant gets complaints that while you're if you change your committee or your food what any good or it was late it was you know that they have no didn't even know that it was delivered so this
just means that you're it's that food is proprietary that's their product and for someone to basically be reselling it without their permission then it creates a whole lot of problems now it's certainly up to individuals we're not jumping in the middle of what that agreement might be is another reason why we're given a longer time to implement it but to this is between two private firms but it keeps the delivery firms from taking the proprietary product
of of that restaurant and just reselling it without that restaurant even knowing even potential liability. At all I mean there's there's multiple civil and other fines compared right so only if you buy something from restaurants. I can deliver somebody else they want to. You me me personally or this is a commercial service. I'm sorry Senator still have a little trouble hearing you. I'm sorry thank you senator garner.
So far. Senator Johnson. This is happened we're somebody we're delivery service is paid in full retail and delivering food. It It you're talking about that with the price be the same and plus a delivery fee that's private enterprise at work that's work out however the two parties involved do it it's just you can't take the the the product of somebody else and
then pick it up and go deliver and not let the restaurant know that you're doing that because it's again it's their proprietary product on I'm trying to figure out how they don't already have an agreement. Because I know in committee we heard restaurants trying to limit. The fee that could be charged to fifteen percent because we're being charged up to twenty five percent yes of that was that Senator Tucker hand and he agreed to amend that out of it but this we're not jumping in
the middle of what that agreement between the restaurant in the the delivery service is just that there has to be one before the delivery service can can do this but I'm just trying to imagine Joe blow going to the restaurant paying full retail. Because in order to get a discounted gonna have some kind of agreement with paying full retail and deliver that and we want to stop that we're going to go to McDonald's twenty big macs and dual and deliver on the charge somebody twenty Bucks for
doing that we'd be prohibiting that. If they're one of these organized delivery services I don't think we could. Prohibit somebody from saying to their neighbor Hey I'm I'm running a McDonald's you want me to bring you something not charge an extra Bucks for my trouble I don't think we regulate this is has to do with that you have the uber eats an equivalent door dash some of the others like that it's just the the problem you can imagine the problem if let's say I make a really great
custard pie in my restaurant in one of these companies comes by and picks buys a to go slice of my custard pie they don't tell me that they're going to drive around for two hours in the sun and deliver it to maybe to senator Wallace is house and he's will get sick and he's gonna say that mark Johnson's restaurant might be sick for that and I had nothing to do I don't even know it was it was gonna be delivered this just make sure that this these two private companies can work out whatever they want it
whatever terms but the delivery service can't come get someone's food from a restaurant delivery without everybody knowing what's going on okay as I read this is as defined in the bill it would apply to me. If I'm online and if I deliver it says multiple survive if I deliver food from two or more restaurants local food from Burger King and McDonald's and online then it applies to me with that yes.
Thank you senator Clark. Any other questions. Anyone wish to speak against senator garner will speak against. Thank you governor so. I'm trying understand the reason why we need to get in the middle of this one you give all the power the food facilities or need this bill because the the pain they agree to the terms of that contract an agreement or you don't get to deliver the
food in the second they try to deliver the food they have a structure in place to punish them so it's not gonna be a fair contract between the two parties which is probably how it works now it will be the food silly saying you do we want to you don't deliver our food or else and it takes all the bargaining power away from door dash and all the other ones secondly I buy food appear all time using the services I love it it's awesome I get big Donald's I get local places I do all kind of stuff I had a little messed up I've never sat there and thought
me and make dollars really messed this up typically what I do is the first thing I go to the app and I log on there they made a mistake in typically they refund the money or they get it fixed within an hour if not guess what I will use that no more I'll go to the place myself missing like the free market what approaches I mean maybe this is common industry standard to do this but I don't understand why government should get in the middle of this to dictate that these agreement happens or else thank.
If I was in favor against anybody else against. Senator traded closed. Yes Sir I'll close thank you Mr president of I disagree on this with my friend senator garner and we don't disagree that much on freedom arguments of but what is who who controls this these are to private businesses and however they decide to do business then that's between them and the only thing is that this bill says is you have to have an agreement has to be an
understanding and you can't just look like your ordinary customer picking up to carry out the turn around you're actually delivering it and potentially. Helping us see this March the good name of that restaurant or or some other nefarious means this is means it's all out everybody I start say on the table that's probably not the right metaphor but everybody understands the it's it's a contract between two businesses if you've got multiple platforms delivering these things they get to compete with each other a
receipt it expands the market the rest for all these things are good but it make sure that there's transparency and everybody knows what's going on so I still think it's a good bill and I really would appreciate a good vote I'm close thank you Mr president. Left side of the chamber seeing none madam secretary please cast a ballot with thirty forty a one nonvoting house bill sixteen eighty two passes returned to the House moved to house bill seventeen oh four Senator Solomon seventeen oh four by representative Ryan Senator Solomon to amend the law to prohibit municipalities and counties from restricting the use of auxiliary containers Senator Solomon you're recognized thank you Mr president this bill does just what it says it creates
uniformity of commerce within our state on line twenty twenty nine thirty thirty one et list with those auxiliary containers are twenty five states have very similar laws of this bill went through multiple amendments in the House Committee and the Senate Senate committee and all those issues were addressed The cost for one family is estimated to be about a hundred dollars a year if people were taxes pretty simple build
straight forward I'll be glad to answer any questions are there any questions for senator solve them. Getting water yes senator a great question. Senator so as much as we like or dislike mandates from Washington come in to the state of Arkansas why do we want to consistently take away the responsibility of local government this is an issue that is a local issue of a if a city council and mayor want
to decide to to implemented this why should we be involved. The question came up in the House Committee and Senate Committee and again it comes down to the to the aspect of the people being able to purchase in large quantities rather than having multiple cities have multiple you're one taxes this one charges a fee for this product one for another product and it just allows for uniformity of commerce so that
people are buying in bulk can do that with confidence in our state that was discussed at length in the committee meetings but in fact I mean municipalities have all sorts of taxing mechanisms for a business licensing and they all are various levels for various things and we don't we don't mandate or not. We don't manage mandating uniformity to business licenses. I don't disagree with that
that's what we've done that's what this bill addresses and that's the Municipal League brought up some of those very concerns and that was discussed at length and the both these bills came out of committee with strong support thank you. All Senator Solomon. All entries. Are there any other questions Senator Solomon anybody speak against this bill. Senator Leding you are
recognized to speak against. Thank you just wanna register of the city that I call homes complaint about this particular piece of legislation Fay Advil was a believe the first city and I think maybe even still the only city in the state to have passed an ordinance of regulating the kind of to go containers that restaurants can use it's been very successful at the popular program I really thinking cities are on the frontline of your managing litter trash protecting our waterways that allowing cities to take this kind of step is something which allow it shouldn't get in the way of I
means to Senator Solomon point about business is being allowed to buy in bulk again right now there's just one city in the state's doing this I think they're still gonna be able to buy in bulk and the businesses that are operating federal again had no issue with the current ordinance I would just as the vote against the bill thank you. They are letting us vote against the bill would anybody like to speak for the bill senator mark Johnson you're recognized speak for the bill. Thank you Mr president of.
Interesting points that made specially center your question in committee we talked about this and we talk about Northwest Arkansas especially You go up in that area near the northwest Arkansas regional airport you you may be in Bentonville you might be in center turned you may be in high full you may not know where you are in each one of those places could have different things when you can have a. Capaz certain capacity come up here do you have to have a different capacity Cup over
there if we even property committee that helped you get a plastic bag in Springdale and it blows the wind blows at your hand it might blow into fatal because we're talking about a bunch of municipalities up next to each other the fact is that a hodgepodge of these regulatory bills laws ordinances in in different localities it can create a lot of problems in I hear the word local control all the time and and in the conceptually and in most cases I
think it's probably a good idea but not in something like this this is something that if you've got five different stores in one area and five different municipalities with five different sets of rules you got to buy what I can only use a. Sixty five I have a sixty four ounce Cup in Springdale button fate alone I'm only have a twenty four ounce Cup and in Bentonville I only have a twelve ounce Cup this is a cap of madness that that can happen if you don't have some reasonable controls and and restrictions I
think it's a great bill I think represent right and Senator Solomon work long time on it I think they met their restrictions with amended it to take care of business and this is a good bill I appreciate a good vote. Senator Johnson spoke before the bill is there anyone who wish to speak against the bill. Saying none Senator Solomon would you like to close for you Richard just just couple origin the the large businesses and faithful weren't necessarily in favor of it they just their testimony in committee was if
you're going to do it to everyone do it everybody so again in a business can do this on their own if the business decided to add these fees or taxes or to limit those things the greatest individual controls at the individual level and businesses can do that they want and without I'm close thank you Mr president Senator Sullivan has indicated that he's close for his bill is there any objection to rolling the vote I have an objection to rolling the.
