Whereas on October fifth twenty twenty detective Kevin Collins of the violent crime division the pine bluff police department was killed in the line of duty the first department officer to be killed in the duty since nineteen eighty five and where as detective Collins was working with two other officers on an ongoing ongoing local criminal investigation that was related to the shooting and one of the other officers was injured but survived and whereas detective Collins was hired by the department in twenty fifteen it was an excellent officer according to police chief Kelvin sergeant and we're as a career in law enforcement long been detective Collins dream beginning in his childhood influenced by his closest the public service since the stepfather Charles Hobbs was a captain with the Jefferson County sheriff's office and whereas he had an unwavering dedication to his goal starting out of the department of correction and the metropolitan emergency communication association before re lit realizing his dream of becoming an officer and we're as the unwavering dedication to his goal led to an unwavering commitment to his job and within two years of higher detective Collins was named twenty seventeen officer of the year by the department for rescuing a ninety five year old woman from a burning building and whereas in two thousand nineteen detective Collins participated as a member of the panel for the domestic abuse and violence awareness conference held on the campus of the University of Arkansas at pine bluff in a twenty twenty was honored and remembered at the conference and we're a detective Collins grew up in pine bluff and graduated from public high school in addition to his employment at the department he also served as a security officer the church she attended the pine bluff campus of life new church where he did everything from protect the church to rock babies to talk to teens and a detective Collins the pastor said Kevin was the kind of man you want your son to be like tall handsome generous kind but tough as nails and we're as detective Collins was known to all for being deeply committed to the community down to earth strong the compassionate steady and constant support and perhaps most of all a police officer who exemplified the role of to protect and serve and we're as mayor Shirley Washington said he was one of the finest officers you could ever hope to have he was committed law enforcement wasn't just a job to him it was a mission now therefore be it resolved by the Senate of the ninety third General Assembly of the State of Arkansas that the Senate. Including without limitation modifications to the class one milk pricing formula adjustments to pool qualifications criteria stricter limitations on producer milk receipts. And the jury transportation credit should be eliminated by reducing the credit by twenty percent over the course of five years and the referendum approval therefore should be modified to require a two thirds majority of the voting producers and two thirds of the voting milk volume to amend the issue a federal milk marketing order and the United States department of agriculture should develop an improved method to determine the class one price mover base price which is not approved. A method to determine which is an improvement to determine the class one price mover which is not relied solely on manufacturing dairy products to better reflect lower milk condition of market conditions provide more appropriate economic incentives to fluid milk producers and processors recognize the cost in servicing of fluid milk market and continue to ensure fluid milk consumers have a quality an adequate supply of fresh fluid milk and pulling requirements under felt federal milk marketing orders should be changed so that the shipping costs are allocated to the exporting area and the only mail delivered on the specific milk marketing order should receive pulling benefits from that order. As I'm sure most this chamber no legislative districts are drawn by the state board portion at which is the governor secretary of state the Attorney General the General Assembly draws congressional district lines and the line the boundaries for quorum court districts are drawn by County Board of election commissioners in Arkansas the only entity that draws its own. Districts are city wards and this bill would would change that to where we would have anyone drawing their own district some external third party that is not affiliated would be drawn now the bill is a little longer believe it's ten pages but that's only because we have Incorporated towns cities of the first class cities of the second class we also have very forms of government within those kinds of of other classes of cities. How we have city administrator we have city manager we have mayor council so that's why the bills along with the bill is really simple and what it does it It allows the cities to make recommendations so it's not like they're left out of the process thank may officially or unofficially by resolution say we think these boundaries should be this based on the latest decennial census this the second thing it does is it allows the. Or or mandates that the city that the the collection commission draw those boundaries to the greatest extent possible contiguous with precincts so you don't have as many split precincts therefore you don't have as many ballot styles in each county I lost track of it but there's hello many of you know your counties have many many different ballot styles and it gets very confusing for the Election Commission and other officials that are dealing with that so this is hopefully going to simplify that and the last thing that this bill does is it postpones the effective date that is the election at which these new ward boundaries would take effect and it would not take effect until the twenty twenty four election so the bill itself becomes effective in twenty twenty two but that's to give the Election Commission and the city's plenty of time to work together city makes a recommendation the election commissioners act on that census data at that time and come up with the new ward boundaries it wouldn't change the opportunity for the cities to if they so desire felt the need to have a special reapportionment based on the census information especially in areas that have a lot of growth or perhaps even some shrinkage in their size again this would not take effect election wise until the twenty twenty four election cycle for the simple reason that it doesn't look like we're going to have the census data in time for all this to be done in a expeditious manner I think we're going to we are going to do well to get the congressional districts drawn this fall in the same for the governor and the secretary of state and the Attorney General drawing our districts so I would be happy to answer any questions for our any. Is is this addressing any issues as far as I can remember there's no lawsuits there's nothing about redrawing boundaries in any lately in the last ten or twenty years so what what what problem are we trying to solve here will center there there are no let this no litigation I am aware of it all however I have become aware that there are a cities that have not even taken a look at their ward boundaries for thirty years it's probably some that still need to do it but the lesser time but I've been made aware of some that haven't looked at it for thirty years and this needs to be updated regularly just like our districts and a congressional districts are updated after each decennial census but there was no specific instance that prompted this okay well I figure we're going to create some some real some lawsuits down the road with this but second question and one that really that is of concern is that the election commission's gonna drawn they're gonna have all the expenses but then you're going to require the this city you're going to require the city to reimburse the Election Commission of which they have no control over what they spend. To reimburse it correct yes Senator they're only gonna reimbursement for the portion of their work that was related to the actual ward boundaries are going to be doing at the same time doing the quorum court districts and it to the extent possible and that's in the bill we try to make is contiguous as possible so I would anticipate there would be a a small amount a very small amount to be charged back to the cities of the Municipal League in the association council want to make sure that that was delineated separately in other words the the county didn't want to be in position where we've got to pay their cost or vice versa so this was the language we came up with to try to address that so you're anticipating the the the dislike for a demographer but the election commissioners would not draw any salaries for re drew three drooling redrawing the districts of your your talk about hard calls for yes the monitor first printing maps things like that yesterday and and they do get some per diem or some nominal payment that but they would not get any salary or anything for doing this war thank. I just was brought to my attention that I was told by one C. council member in a city far outside my district that they haven't looked at the ward boundaries in over thirty years and so I got to check and found that that was actually the case I just thought it was inappropriate for an an entity a legislative body to draw their own boundaries regardless of who they are and should be done by someone that is at least nominally objective versus those of us to have it I had one situation where I was told that local. Member of city council wanted to include a particular building in his district and they ran a I called a pipe stem down the street and took in that building so he could have that in his district I I still think that kind of a gerrymander you think is appropriate and I'm not saying that there's not gonna be political influence I mean it is we have clearly put it in the bill that the city council can't make it on page two line fifteen sixteen says that the board of commissioners can accept recommendations from the city for redistricting Wardlaw and so they can say Hey we think it all looked kinda like this and if if after the reviewing that the County Board of election commissioners agreed then that'll be what the boundaries are but we're not cutting the city's other process we're just making sure that the final word is done by a third is interested party would you be surprised to know that I have emailed and called from several months ET feeling like they're being cut out and asked me to vote against it. I wouldn't be surprised if anything happens this session center take but I will mention of Senator Stubblefield had a mayor in his district that has some concerns about this I called him yesterday afternoon I had a great visit and we got off the phone he was comfortable what we're doing I I will say that he actually thought that it would let the quorum court draw the city ward boundaries and he once he learned it was actually the County Board of election commissioners then he would he was okay with that so I ask again these things I sometimes get confusing again this is a long bill because we had to separately cover the areas in the code of the various one. Senator Johnson I have two full questions and you may have answered it under Senator Teague but was this dealing with an issue in Pulaski County that this came about and I think I heard you say it was out of your home town that you are this problem occurred and the second real question that I have that I don't know how to answer my mayor in my city administrator is why are we taking the lord's and the drawing boards from elected officials and giving it to volunteers I didn't hear the last part of your questions why are we taking the development of districts wards the portion motherboards why are we taking that away from elected officials and giving it to volunteers the Election Commission. I'm not sure I follow them being volunteers they're they're linking to to do this and they're like to do this by the two political parties well I understand that that isn't I'm elected of say. Ninety thousand people in my hometown. Well they're not directly their lectin by the parties. Individual people elect committee one to the two political parties the majority party to minority party well those are elected positions so you. They elect the majority party elects to commissioners the minority party elect one commissioner and so they're the ones that we are doing this right now for every J. P. district in the in the state yeah but they're not on the ballot they're not on a go to a polling place and vote for your election commissioners likes actually center they would be if there were they were contested. And then happen that often it's usually have trouble finding people to do that but if their work contest they would be on the primary ballots. I know that sounds unusual but it is the true Senator Hammer did you still have a question. Thank you Mr president Senator Johnson what I was wondering is you mentioned that your research should have been thirty years are there any particular situations or circumstances that have happened that kind of reveal the problem that this bill is trying to fix. Yes Sir It in particular city that I was speaking of that it was been over thirty years they had a tremendous decrease in population and so that the actual Numbers of people in each ward was was vastly different than it wanted first been drawn some thirty or so years ago so that that was that was a primary consideration the reason of course at the other levels including a legislative districts and that most of this most of us in this chamber are intimately familiar with is going to train change drastically when you've had a tremendous increase or tremendous decrease in population and that was what I had found in this example that I referred to that there had been a significant drop in population and it it was a little more it was not proportionate across the wards of the city it was disproportionate. So let me ask you if. If there is a shift in population. In a ward and somebody did not redraw the boundaries. Would that create an unfair disadvantage or what is there in place now to where the boundaries shift with the growth of the population there you're trying to address. Yes Sir it would create an imbalance between of the equitable representation within the various wards and again that could go both directions it could get it bigger or smaller and this is what having requiring a decennial of review this redistricting or a special redistricting which you know if the committee if a city ask for this let's say you see some of the tremendous growth and some of the cities in northwest Arkansas they could request a redistricting if they had a significant amount of growth and felt the need to do that plus you even have annexations we're adding up a large area at that time the city for example would still just have four wards but they need to take into consideration a large area that have been annexed and this will allow that to be done again by the the third party book County Board of election commissioners. Every ten years you must redraw the lines to reflect the population rather than this draconian method that you're talking about a take in totally away from all of the city's. Senator I don't consider it draconian to to follow the same procedure we do with every other districts drawn in the state of Arkansas including those for Senators it's done by someone other than the Senate and the congressman don't get together and draw their own districts the Senate and the house don't get together and draw their own districts we're making it consistent okay why why not just say that you have to do it every ten years rather than taking something that the city is at hand since time immemorial. And then giving it to this three person group to make decisions of the cities that are. Why didn't have any lied and leadership styles and we're going to take it totally away from them and give it to this three person group Senator U. S. B. two part question the first part of the question is. We do allow them to do it we we do. What we're making it consistent with the others that we do and we're requirements to make him look at it every ten years when we have the census data we really in this case we're we're delaying it so it would have been twelve years since we had them once they take effect but that's just the nature of the twenty twenty senses that is you know we don't have that data yet but certainly the first part that you mention of of of it being taken away I just don't think it should be there have been there in the first place in the second case we are going to require that they take a look at it regularly. P. district boundaries and they were Kunj I think they should be able to draw the ward boundaries also told him I thought to the greatest extent possible. They should follow the natural lines of another words not having a lot of overlap say between a J. P. district a quorum court district and even a of a state house district I can remember a time when the Lasky County course has fifteen JP's and there were fifteen state house districts in Pulaski County I will could make couldn't imagine the reason why those boundaries at that time anyway couldn't have been the same. But instead we have people that that are voters are tired our citizens they're not not sure who their JPS are not sure who their state representatives I don't know who their Senator is because of this overlapping multiple thing that we have and to the extent possible we want to Election Commission be able to draw where you're not splitting precincts unless absolutely necessary they're naturalized I hope and again I won't have a vote on it but I hope that they would follow rivers and streams and streets and things that people see as natural boundaries such as you and I share a border much of our districts in one place it's highway ten nearby knows if you go out west it's north of highway ten it's in your district that south highway tenants in my district I think we need more that more consistency but but that's the the the reason for is that to try to make it consistent with the other parts of the law we're there is no entity that gets to draw their own districts. I appreciate the call and sentiment behind the bill but then the amendment is the one thing that could cause me to be able to vote for it but. Children have an I. A. It treating the children different for yet another reason I mean I realize there's a group of them sure obviously should not receive corporal punishment but then there's others sure yes I know I agree I I understand the statement and we did have that conversation because the I think the goal is to try to obviously we're trying to assimilate right school students all together and and there's the effort to do that but I do think that you know and I'm somebody who is in favor of corporal punishment you know that I'm the parents right and so I think that when you have somebody who has a child with types the different disability and I'm sorry. I think when you have a child that has certain types of different disabilities there's a difference between me executing that corporal punishment and my own children versus somebody else and and and when I say that I think there is something and you as a parent need to have always I think parental consent and guardianship we want to make sure that they're part of the conversation no matter what and so that's why we went back and put the amendment in place because we don't want to cut parents out of their right of the role so but I will say that when you have a child that has different types of disabilities they're gonna respond completely difference to any types of punishment or discipline and so and and I know that because I worked with the young man that I was in the parade with on Saturday he's a down syndrome child and that child you know when he was younger I had him at church and for an after school church program and you know he was sometimes very very difficult but it was because he could not verbally communicate very well and he couldn't and it was hard for him to connect with people because he had two difficulty verbally communicating right and so people that get frustrated in that situation may actually discipline not child when that child really didn't deserve that level of discipline and so it just takes time to court and it takes time to cultivate that relationship with that type of a child and so you know that's that's what drove me to really work on this issue when it comes to individuals with disabilities and I do realize that there's all different types of levels of disabilities there's speech therapy there's there's all those kinds of things right and I have a brother also with dyslexia and he's deaf in one ear you know so he can't necessarily here all the time and when he was little he lost his hearing and and so again you know those things do need to have some sort of consideration when it comes to corporal punishment you know and the child has down syndrome. You know spanking that child would not have been the right approach it just wouldn't have an end to it would have been really cruel to be honest with you and me as a parent can administer that corporal punishment then it comes to somebody else I don't know what they're bringing to the table it does not make sense yes you read yeah and I do appreciate the discussion. Folks being able to get the property back I wanted been stolen and they find it upon brokers and couldn't get it back turns out although lots of people are buying their stuff back from pawnbrokers that the law already says that you have to get your stuff back and most pawnbrokers are very good of I have several friends that business but there are some bad actors but what the bill is about and has been for months is that if somebody has their stuff stolen goes in a pawn shop sees it there and they do and go through the proper. UP procedure which is feel that affidavit with law enforcement and they don't get it back and then later it stolen I mean so I'm still later it sold that they have to be compensated fair market either what was what was paid for the fair market value whichever is higher you would assume fair market value would be what was sold unless or some kind of brother in law deal so so that there's no game of for keeping it and sell it I'll be happy to take any questions. So the person who had the property stolen from them still has paid the pawn broker what they paid the person who sold it to them or not. Again because we've had experiences and had friends with experiences. A lot of us believe that you have to buy it back as we read the law it didn't say that it said that. The. That they have to return to if you if it's yours and you can procedures they have to return. What this does is it they don't return it and then they sell what. Are that you can get compensated for either what they paid for it or the fair market value whichever is higher that's all it changes I'm just I'm just curious based on your. Conclusions in judiciary what about all these years that people have had to buy back their stuff from pawn brokers if that interpretation laws not been correct was that based on AG opinion what was the. Basis for that conclusion. I don't know again I was on. I was going to change the law. Until we sit there and read it and it said because again I've had friends that had their stuff stolen and we found it and we had to go by. So I know the experience but we read the law and it said was. That the that they have to return it I wish you would think would be the case because if I buy stolen property. it will certainly be taken from me and given back to. Can you be charged with theft by receiving if that happened to you and what would that apply to somebody else. Good question. Again most pawnbrokers I mean that what's the name of the system. That law enforcement uses. Many of most really tried to to report stuff and we're law enforcement could I know used to in garland county when I was on the quorum court law enforcement used to check that everyday the things report and look for stolen stuff I think is some law enforcement's much better than others some pawnbrokers are much better than others of and I think in this case in one county we certainly appear to have a bad actor from the number of people who came to me but. The but. doesn't appear that they're the only ones that will ensure agree that there are some good actors out there that are all businesses in Barcelona. Lexus good friends of mine and some of very good people this would never have laws for the good people. Thank you. Thank you chairman unfortunate to speak against my good friend Senator Clark bill but this is what I think this bill will do it will destroy the pawn and selling business in the state of Arkansas right now the way it's written that is if that property is there you can go get the affidavit to have it returned to you and the pawn broker has to give you that within a certain amount of time under the current law that's we figured out like Senator Clark explained why I read this is if you as a pawnbroker sale that item even though you received it thinking it was a good item you sold under think is good item you're now responsible for paying for that actual item so you're the one who's gonna be held accountable to the persons you property stolen now you didn't still that item you didn't take that item and most the time you're not to be able to help that I was actually still or not it's a horror line to delineate between a guy who actually stole out of a walk in the store and a guy who just wants to make some extra money to pay his rent that month. If you pass this and now they're accountable for every single item. Within a certain amount of time they're not gonna give those services to people who may need you're gonna cut out a large majority of people who could use the money or use the pawn services if the required info for institution unless I had seventeen forms of ID an identification that you're the one of all that it be such a liability to do that now that might suck up unscrupulous practice what is held this pawn business is worked in Arkansas for for perpetuity and I don't think it's right to hold the pawn shop owners accountable for some I still on that item whenever they had nothing to do but regular business that could happen that's why I will not support. But I keep the books and the numbers. I got somebody that told me said there's a brand new chain saw that one of the pawn shops. And it had gas in. We looked ownership last price all we had was go. So I took the book with the numbers on it went down there and I ask the pawn shop owner if I could check the numbers he said yes you can. So checking those numbers. That was my saw. The guy even hot the long black leather coat the had the. Put under to get out of the store with. You've got as. Senator Clark said you've got good operators and you've got some that's not quite as tight as they ought to be in it this will tighten it up some and I talked to my local pawn shop owner and he said he'd been contacted by the association to be against this when I explained it to him the center I'm fine with the said I don't do these that I help law enforcement said I put my stuff online and I happened to track down the state. He has my phone number we text back and forth they never we presented the bill you just heard committee members know we presented this bill at least three times. Of I was never contacted they never came. But. More importantly I support small business of all kinds of support on brokers of and business of any kind is difficult. But you come back to. Theft by receiving there is a very important thing people who at first of all we all know how bad. drug abuse is in our society and drug abuse and stealing go hand in hand and a Senator Rice said the easier it is to sell things once they're stolen. The of the worst these things because of just in the last year and a half. we had a storage facility broke into we Downsized. And the the only things we put in there were things that were very precious to us our things from Jenna's mother things that we had for thirty years. ever brought a replaceable things. And they're all gone in the there wasn't somebody to sell them to. They wouldn't be gone. We should for the for the really good actors in any business we should not make it difficult for them. By making it easy for the bad actors. If you're going to be in this business you've got to be very careful about taking stolen merchandise because anybody who takes Turrell stolen merchandise has to return it you lose it you or me if somebody comes right now and tries to sell you a bundle three quarter CD plywood for twenty dollars a sheet and law enforcement comes along that that the next day and says where did you get this plywood. And while the things are gonna say well if you bought it for twenty dollars heated blue report used to but it would have been a normal process right now school for ninety. Yeah shoulda known that there's something wrong. And all this this bill actually will affect very little very few people are ever going to go to a pawn shop find their merchandise not get it returned and then it be sold but it is happening in a few cases and we ought to fix it. The simple as that of that's all it does is if they go a defy their merchandise they don't get it back March the stolen from them they don't get it back it says and then they turn around and sell it that they they have a claim for what the value of it is that's only right it was their merchandise nobody no matter what your business is should be able to get away with theft by receiving that's not what the business is supposed to be about I appreciate a good vote. When I take up Senate bill five fifty one senate five fifty one by Senator Johnson to amend the unfair cigarette sales tax Senate Johnson you're recognized to present your bill thank you Mr president this bill is really a commerce issue I know it says cigarettes in those that know me know I don't do tobacco but this is really about commerce between the Arkansas wholesalers retailers versus the national wholesalers and retailers this create some equity between those two so the Arkansas based wholesalers have the same set of rules and and work things out under the law with the out of state once it allow Arkansas all Arkansas based cigarette wholesalers have more pricing flexibility to meet competition by large national cigarette wholesalers who typically offer incentives and discounts the current rules are difficult to enforce Arkansas tobacco control board with over one hundred licensed wholesalers located all over the country and the complexity of the issue. Large wholesalers may view the penalties for violating the current prohibition on discounts is just a cost of doing business this puts the smaller Arkansas based wholesalers and retailers who are attempting to comply with the rule at a competitive disadvantage large national retailers may be receiving incentives that the smaller independent stores do not so this rule change will give the smaller local retailers the same opportunities to receive discounts that the larger regional or national retailers benefit from now what this bill does not do is not change the invoice cost of cigarettes to the retailer the wholesaler is not allowed to discount the cigarettes to the retailer for less than their invoice cost for the manufacture the US sales of cigarettes below cost are still prohibited. Retail price paid by the consumer for cigarettes will not be affected at all the sales tax collections will not be affected also there's no fiscal. Impact of this bill was amended twice in the Arkansas based wholesaler's came together to reach some agreement on this so this was a Bills pretty much agreed to by the people that it affects I'll be I will try to answer questions as I as I said in committee to Senator Clark I would be loath to even try to explain the process of how this if the pricing is done it is a complicated formula but this was agreed to by the wholesalers they're based in Arkansas please try to answer questions questions for senator Johnson's senator history you're recognized for a question thank you senator Johnson is what this bill doing currently illegal in the State of Arkansas if you do it and once this bill passes it will no longer be illegal for this behavior. I think that is a fair thing to say Senator is the illegality has maybe some. If this site is crystal clear is that what is it in a general rule I think that's an accurate statement. In in this second thing I would say that the I have heard from some small sellers that do not agree to this and the fear is basically what we. That we have a rule for a state minimum which I'm good with getting away with doing away with by the way but we currently have a state minimum this is a work around around the state minimum just for the big got a crush the little guy is that is that a fair statement. It probably is Senator I will say that this would create whatever workaround is available to the out of state wholesaler's would would allow the same. Level playing field for in state regardless of the complexity of the of the pricing system and if it would not allow out of staters out of state. Wholesalers to be in a competitive advantage over Arkansas based retail wholesalers. Senate Davis did you have questions. Members wholesalers have been illegal illegally offering rebates and many of them have been caught they've been getting caught and they've been fine we've seen this over the past several years so all we're doing in this bill is legalizing the illegal behavior that they've been participating in and one of the reasons that you have heard a lot about it and that there was and said to be no opposition in committee is because many of the larger wholesalers are essentially threatening to challenge the cost of doing business to smaller wholesalers. So what that's why they've been silent that's why most of the smaller and wholesalers you haven't heard from because what the larger of wholesalers are threatening to do is more harmful than even this bill so they've been threatened into silence that's not okay and that's what this bill does it is legalizing currently illegal behavior that wholesalers have been participating in that they have been they have been caught and they have been fined and instead of just leaving the law like it is and then obeying the law as it is they're looking to change the law so that what they're doing is no longer illegal and that's not right. That's not right to the people of Arkansas it's not right for large wholesalers get away with it and it's not right to the smaller wholesalers that are doing everything they can to stay in business and compete and if we legalize this they will be essentially unable to do so because they're smaller wholesalers they cannot compete and offer large rebates like the large wholesalers Committee this will hurt small businesses small wholesalers in the State of Arkansas I'm asking that we please do not legalize currently illegal behavior in the state of Arkansas because larger wholesalers are refusing to comply with the law thank you. Things like going to pick up the dollars going to pick up some food or going doing shopping. Right now there's been a push by the by administration to make this. A priority now do is select they're doing it through corporations a private businesses and typically I'm for what corporation private businesses could do in their own time this is such a dramatic invasion of privacy such a change in the norms that we live in. And I did that an American twenty twenty one you have to show papers in order to basic services is frankly unamerican. This is an anti vaccination bill. My principle is very simple I think every person should get vaccinated and I'll be dying to the government's going to tell you to do it. But that'll take any questions. My my question actually is exactly the same and it's just my reading of the bill I was contacted by anybody but my concern is the reading of the bill because a lot of times will have patients that will travel because our retirees in the travel to Florida and so we will call in prescriptions like particularly to Walmart pharmacy and then they will transfer those down to Florida and so I'm concerned about the way that it's written because you may not be able to do that without that it's design connection is when you as long as you the patient are involved in that process there should be no problem what is trying to prevent is the. You know you know what happened somebody gets sick you guys deal with this all the time you get sick your office calls into prescriptions somebody they go over there and find out that their company has intervene in that process and steered it somewhere else and yeah yeah it's not it's not it's long as you're involved in the process you should not be a problem no I understand I I understand what you're trying to do and I don't disagree with what you're trying to do what what I'm saying is though is that the way it's written gives me concerned scientifically so are causing the issue and on page yeah on page two in this area right here it really starts at six I understand and I support what you're trying to do in all sections of the bill and I understand what you're trying to do with this however I feel like there could be the way it's written may have an unintended consequence back to what Senator Ballinger is stating with presents a patient from getting that medicine transfer to another pharmacy in a different location whether it's in state or out of state and so for us and I'm speaking that's a big concern for us and our patient for a medical practice and their patients and so this is a very common practice with physicians and patients to be able to transfer those medications so I just if. If we can just get clarity on that do you mind I would I'm going to do it again for you to in in terms of of the situation because I need to get it handled right now yeah spotted but the the real reason that that this again to hit this was to prevent this patient what's called patients during which I think you would probably definitely be against when their steering people somewhere and so the the bottom line is the patient the real reason that this was all draft in the first place was to handle complaints of prescriptions being filled or stolen by pharmacies that had never heard of them before out of state PBM or health plans pharmacies were doing this okay and it was happening in some cases were physician clinic on the pharmacy and employees of the clinic or data mining patient records to steer patients to the pharmacy on by them again Senator Irvin because you get this warning the patient to be involved in a relationship here if you're talking to your doctor or your pharmacist to help in some way I don't think it's going to be an issue it because it absolutely is trying to say if you're not involved and you have for the service and then somebody tries to deny you they wanted to stop that from happening so that was it Senator hope that helps and if you have further questions will hand that when we get committee on the other in our any further questions for Senator Rapert. We can't force people to open retirement accounts in less than you want to get the state of Arkansas into this business there's another bill that sparkled a companion bill it's been found it's an end run around the same issue that's popped up since this one is there so here's what American council licensure says they have opposition to the bill it would establish this R. every Arkansas retirement plan opportunity act by creating a board within the office of the treasurer to establish implement maintain the plan and make it and making available in competition with everybody that I've already stated here. In terms of some other provisions in addition similar plans are already being offered by local chambers of commerce around the country when the secure act came in this bill was a relevant discussion point two years ago. But they pass the secure act in nineteen in January the first everywhere around the country in fact any employer that uses a paychecks plan or provider that is doing paychecks for them those plans are now beginning to offer these very same services to them thus far only two states please listen to this park point not I'll stop because you had a lot of information sent to you on this. Only two states have authorized a state run for when Kate Massachusetts. In Vermont both were passed before the secure act later authorized employers in unrelated industries to offer these types of multiple employer plans Vermont has not moved forward. So they're losing ground because it's bad policy the Massachusetts court plan for nonprofit employees took four years to set up an after three years of enrollment only eighty employers are participating according to the Georgetown center for retirement initiatives. We need to really calls here on this because the fact is people from the industry that are speaking into this issue are saying this is not necessary it's not needed. A few weeks ago it was stated we talked about Edward Jones investments. I've been speaking with Edward Jones government affairs and St Louis their company is against this bill they're finding these bills. And I don't you know when you have one person says well I don't care about the issue that will look.
