Currently Arkansas law permits certain non citizens to obtain a driver's license with required documentation renewal periods this bill clarifies and extends eligibility to additional non citizens who provide documentation of their identity Arkansas residency taxpayer status through I. T. I. N. and three years of taxpayer history. The bill is needed for a couple reasons. Having additional licensed drivers improves public safety for our community and for our law enforcement. Employers need employees to be able to travel quickly safely to and from work. This bill only extends eligibility to non citizens who are able to provide legal documentation of their identity the Arkansas residency and they're valid tax history throughout I. TI in and three years of taxpayer history. DO FNA will work to design the new license in a way that makes it clear that the ID cannot be used for voting purposes or verification of citizenship. Currently there are over fifty thousand our Kansans who will immediately be eligible and will be charged a fee of a hundred dollars per license. That could bring roughly five million dollars in revenue went up to ten million for this hundred thousand that we think are currently there. This bill is a bipartisan support. Because the immigration status has nothing to do with whether they can drive at night this is a driver's license in only that. Colleagues I think that we need to really be circumspect and we're talking about limiting the access these driver's licenses I know that there are concerns about cost hand whether or not that applicants are here legally what their status is but there's a couple of things that we do need to keep in mind one when we go and visit other countries often as part of being a guest in their country they require that we get a driver's license during the time that we are there when I visited Australia I wasn't allowed to drive until I went and filled out the paperwork to get a temporary license issued by their equivalent of the DMV that not only made sure that they knew who I was where I came from and where to find me if I got in a wreck and left that bunch of damage behind but it also gave them an ability to track where I was and what I was doing on their roads. this is an ability that we have if we give driver's licenses that are not used for travel or to prove citizenship it gives us the ability to make sure that we're keeping track of people who are here whether they're gas in our country or whether they have some other reason they're getting a license under this so that we have a way to contact them we have documentation of where they are and as someone who has also been in a car accident in the past where the other driver didn't have proper identification or insurance it would have been real nice for me to be able to have that police officer put that person's information down so that we could figure out how to get in touch with them to tell them how much damage that caused my vehicle so just a few things to keep track of I know that this is a big in fraud issue but I did want to bring this to your attention. They have the paperwork as the process follow up recognized for my understanding that process is an immigration court process whereby there might not necessarily be if so there wouldn't be a visa that you're you're applying for that you have and paperwork so I could finish from sorry yes and so if you if you have the paperwork to show that that is happening you may not necessarily have citizenship yet but may still be working again there's sort of a gap or no man's land for people who are not citizens or have green cards but they are here going through a legal process seeking refuge which is many people who will come and seek refuge from whatever kind of violence or whatever kind of international issues. Five an opportunity for them and for those of us who are on the road with people to engage a legal process so that if there are accidents or for them to be able to identify themselves as someone who's going through a process that couldn't this process serve as that given that it's not prohibiting law enforcement from doing their jobs whatever that is I would respectfully disagree they go through a process at the embassy they get their paperwork I have folks that are going through this right now in my own area it's difficult but they do have the paperwork to show that they are here as a guest of this country and that they are being welcomed in this country which is very important that they go through that process and they go through the court process but they have the documents to show that they are a legal guest of this country and that's part of the welcoming process I regret that it takes so long right but they do go through an embassy process and they are welcome in this country and they have the documentation to show it and they have been able to get a license right now that once they get their paperwork then they can go get a license just like everybody else thank you representative Cavenaugh. Good afternoon colleagues I am really excited just to bring this bill to you today Arkansas remains forty eight the nation and health we have been working for years trying to prove Arkansas's health we look at with the things that are decreasing the health our state one of the biggest things that we have skews me is over three hundred sixty thousand our Kansans are suffering with diabetes as fourteen point eight four percent we have another eight hundred thousand have pre diabetes in our state. Another thing that is decreasing our records are our numbers here in the state as a high rate of infant and maternal mortality in Arkansas seven twenty nineteen in this house we passed a bill to allow a maternal mortality review committee we look to the things water causing the problems that are increasing our maternal mortality in our infertility so we look at our instrumentality one the one of the top reasons for our high rate of infant mortality this is and I will look at a maternal mortality the hybrid weather's dinosaur hypertension or cardiac problems so I bring this bill to you today because my hope and my desires that will improve the health of our Kansans that will decrease our infant and maternal mortality and will decrease diabetes in our state what do all these things have in common all these things have in common if we will simply increase the rate of breast feeding in our state for what it is now we can decrease diabetes and decrease our infant and maternal mortality so I'm simply asking for one class during health period so we can talk about what are the benefits for breast feeding for moms and for instance and you would say Rep why were we want high schools to learn about this well in that classroom we have future employers future co workers future spouses if they know that they'll be able to do some more support to help the women in our state to be able to press fees so that's the the future this bill reason for the bill as a simple ask for one class of health period for them to learn about the benefits and with that I will take any questions. As working for a construction company building one of our highways he was off six thirty in Little Rock when he was tragically hit by distracted driver and he was killed she asked me if we could strengthen our laws in this area and make them similar to the laws and then our neighboring states I submitted this as an interim study proposal and then I discovered that representative Gazaway was also working vote for legislation in this area so we joined forces and had a hearing at that many of you probably attended and I appreciate representative Gazaway some work on this. Most of us have notice that there are more and more work sounds out there these days and that's a good thing it's a sign of growth for our state however that means that there are more workers out there on the roads highways and bridges the up tick in work zone accidents is a national trend and unfortunately Arkansas is one of the only states were works on accidents actually increased in twenty twenty when there were fewer drivers on the road we went at forty six percent and twenty twenty we often see news stories about a driver a worker losing his or her life and works on unfortunately those are just the ones that we hear about their smaller accidents and near misses every day we heard from one road contractor who reports that on just one job on I. thirty last year there were more than twenty seven incidents including multiple drivers crashing through the barrier wall a worker being struck by a barrel that was hit by a car and the vehicle driving into this that more than sixty miles per hour and almost striking a worker and road inspector these men and women are just doing their job we should help them and protect them what I'm looking for in this law is increasing the penalties of. Yes ma'am. For hitting someone in a work zone at class A. misdemeanor for killing someone in the works on a Class C. felony. And if you've driven in Texas and Oklahoma you've probably seen those signs that say don't in our workers don't pay ten thousand dollars. Thank you Mr Speaker colleagues two eighty eight is a technical clean up bill designed to clean up some of the languages environmental statutes it also takes care of a problem we have with regards to certain permits for water permits and solid waste permits specifically some of those permits had caps in the statutes that were set in terms of nineteen ninety to nineteen ninety four dollars the problem is we had about a hundred twelve percent inflation since then so as caption outdated this bill would remove those previous caps and set a new cap which provides that these a permit fees that cannot generate more fees in a year than what the actual costs to administer the permit program centers and state can't make a profit off those permits this bill also does the same thing when it comes to the testing fee for waste water treatment licensing and facility fees currently that the cap is hard coded in the statutes had been updated from time to time right now we run into the problem that the cost of the actual test itself exceeds what by law we can charge the applicant so the state is actually losing money and of course we do have a choice on these because the EPA makes us administer these programs this again recess that fee to gives eighty Q. ability to set by rule not to exceed the actual cost to administer the test and the licensing with that I appreciate a good vote. It's not the last bill the day but a she will surely slow the emails down when the saying goes through so anyway I'd like to say with this bill doesn't do first because there's a lot of emails out there floating around not accusations but what it does it it doesn't actually do it's not gonna send all your librarians to present and it's not going to ban any books It does create the offense of of providing harmful material to minors and deals with obscene materials provided to minors it also sets up a process for schools libraries or county or city libraries to go through to challenge for for a parent or anyone to challenge of a book that is provided to kids and their and their libraries so that's a very very simple explanation of it I'll tell you what's not gonna send all your librarians to jail. For for someone to be convicted of a misdemeanor or or any crime in this providing harmful material to children number one they have to know what the material is know what's in the material no it's considered to be harmful to to minors and then to they have to knowingly provide that to minors so I've got a lot of questions about we'll what if what if an library there's a book on the shelf the somebody deems to be sane and somebody goes and checks that book out as my library and going to go to prison the answer is no they that librarian would have to know the material know what's in that book no that have been declared obscene and and in that case judicially declared to be of same so you have to get to make that decision about if it's declared to be insane or not it would have to go through a court process be declared to be the same the librarian would have to know that and then knowingly provided to a child and I say if they're doing that then they probably should go to prison because I don't think it's appropriate for for obscene material to be provided to children. We're not redefining what is obscene material in this bill if you'll look on on page two very top of the page harmful harmful to minors means the same as defined in five days sixty eight that's five oh one that definition is already in in law we are not changing that Harmful to minors means that the quality of any description exhibition presentation or representation of whatever form of nudity sexual contact sexual excitement or sadomasochistic this state unless the kissing of use when the material report performance taken as a whole that's another important part they can't take things out of context this is got it the material has to be taken as a whole has the following characteristics. The average person eighteen years of age or older applying contemporary community standards would find that the material or performance has a predominant tendency to appeal to a prurient interest in sex to minors. The average person eighteen years or older I'm sorry I just read that the material or performances once it we're we're not gonna be banning classic literature either because the material performance selection it would have to meet that standard and the material or performance lacks serious literary scientific medical artistic or political value for minors. So they have again it has to meet all of those standards and then I have to knowingly provide this type of material to children as well as not sending sending because there is some librarians thought to present. Unless they do all of these things right the other part of what this bill does is it sets up a process for for an appeals and and this is not this is not a criminal part of the bill this is part of the bill that just is dealing with your local school library your local operator school libraries the set up an appeal process if there is a parent out there that has a student that is affected so in a school here it says a parent or guardian guardian of a student affected by the material so nobody from outside is going to be able to just go into every school district and say oh well I want that material out because that affects you know it I have a problem with that so you're not gonna be able to cross travel across the state to different school districts and say Hey I have a problem with that you have to have a parent or guardian of a student affected by the material to challenge it so if if they want to challenge it it outlines a challenge process that has to be in place I've been told we don't need this because there's already our schools already have that and that's true a lot of schools already do well as a matter of fact they have to because we already require that in law that they have to have the policy a challenge policy this just kind of helps to define what that policy is and some things have to be in it if they want to go above and beyond this that's fine they can do that but it must at least have these things and it the last part of it is kind of that same process for city and county libraries tax funded libraries I will be. Let us take any questions and I welcome any debate on this bill please don't come down here and say that you're sorry to come speak against it or speak on it I think that we don't debate bills enough and we passed by stuff out here because of it so I welcome the bank of bring it let's let's discuss. Represent Collins what purpose question you're recognized all representatives aus we're gonna talk about this in committee but I noticed there's no fiscal impact statement apparently you know there's estimates that it could cost tens of thousands of dollars for cities and counties if there are you know a significant number of challenges obviously someone's gonna have to review these it's gonna take man hours you have an estimate for how much is going to cost cities and counties in what is the funding going to be for the season has to you know make sure sign unfunded mandate yes I don't for see there being a cost to this and in that aspect because they can appoint people who already exist in the library or in the community and say anything about they have to be paid but they have to set up to set up a challenge process but I I can't see any fiscal impact and in that sense. President hawk for purposes question you're recognized representative gallon consolidates what's the the the chain of command on this thing so as if it if a parent find something that is you know that they find harmful do they take to the principal Superman or they just go straight to law enforcement with this. So currently they can they can go straight to law enforcement if they want to another prosecutor gets to decide if they want to take that on on any farther or press charges for for obscene material right so that they can already do that today the front the challenge process in here they they would well I mean I can first complained to the library and and then they go on about that to the principal and continue on through the steps from that point. You're recognized Ferguson Gonzales it it seems to me like you said we do already have a way to challenge this by reporting it to law enforcement so just to be back on representative roses question why do we need this separate mechanism to address this thing that we're not even sure it's happening here yet if one already exists to catch it when it does start yes so again we already your to have that option and you have the and schools are already required to have a a challenge policy but this challenge policies today don't necessarily have to be public decisions right so they can they can form a committee today or follow whatever process that they set up and they can just say Hey when we made this decision and nobody really knows why with with this process it would it would have to at some point it was in the process it would have to be publicly knowledge as to why they made the decisions I made. This bill is just for a few bad actors. Since when did we think we need to come down here for a local issue and fix it in the state level when we have elected officials back home who should be able to fix these kind of situations this bill is not necessary for terms of challenging a book and there seems to be several gray areas they could be left up to interpretation which scares me. That we don't know all the unintended situations and or consequences of this bill. So just so you know all public schools he is right all public schools are mandated already by law to have challenged policies Arkansas law through the public school media. And technology act and it's six dashed twenty five dash one oh one through six dashed twenty five dash one oh six not only defines the role and responsibilities of the school librarians but it also requires a written and reviewed material section and challenge policy that are posted publicly with that said the books that they purchase are reviewed and they meet the age appropriateness of the ages that they serve. Have you ever thought about that there may be material that doesn't violate the obscenity law but may be viewed as harmful for minors by some person who doesn't agree with the subject the topic or the story line. But this is highly subjective on each case I also want you to think about this what happens when someone challenges the book that talks about god and Jesus and it gets challenged and or bang and because someone didn't agree with the contents I think many of us would probably lose our minds if that happen. At. I am not sure how many of you are familiar with song of Solomon and Ezekiel in the Bible but each of these books in the Bible have a very graphic and descriptive sex same. And that if they were in any other book I think it would be challenged also another question I have if any court in this state finds a book obscene does it have to be removed from every library in the state under this law if a book is found to be obscene it would also have to be removed from every store every home. Because having obscene material is illegal in Arkansas. I believe it was said that the library bill of rights is the real problem but their purpose is to ensure that libraries follow the first amendment so the sponsor is effectively calling the first amendment that. Intestate valuations the annual evaluations that Arkansas educators receive school librarians are required to uphold the librarian bill of rights that section for an S.. If they don't they can receive a rating of one meaning that they are ineffective educators and their contracts could not be renewed. And if we have it and we haven't even considered challenge process is going through a quorum courts and our city councils this will bog down our local quorum courts and city councils and upset the system of checks and balances now let's talk about some of these books at beer and are being challenged and or band The Great Gatsby catcher in the rye to kill a mockingbird which I figure most of us had to read to graduate high school. Thirteen reasons why. And I'll tell you that all of three of my girls read thirteen reasons why the reason that that was important to them as they want to be able to. Notice when somebody might be becoming suicidal somebody that they were friends with that might be going through a rough time they wanted to be able to recognize those things. I would actually say that the gray area for this group is rather large this is where Senate bill eighty one worries me the most if there's not a clear definition of obscene how will they determine all the gray areas and books. My daughters are avid readers they still are to this day they retire first collections of literature these books take them on journeys through the eyes of different cultures religions and experiences with that being said if this bill passes one challenge one set of beliefs could remove the book from all the community. I think we might have lost our way down here someone. Republicans are supposed to be about local control and yet here we are again taking local control away from. Our counties and cities because of a few bad actors because of these few bad actors we're willing to criminalize and harm librarians and teachers because if you didn't realize teachers that have these books but might have a book in their room it would capture them also. What we stop with the message that all teachers also bring tendons and all librarians now. Our own these have all these agendas to hurt our children because I think that is far from the truth I guess the next step is for us to tell parents that they can't buy phones for their children until they're eighteen because just in case you didn't know they can search anything and everything on those things today do I think that is good now of course I don't but we can't regulate every thing in the lives of our Kansans at some point we have to stop with the government over reach. Of course I do believe our children should be protected and that this wine selection policies are so important and again already required by law for schools. So I don't understand why schools are actually in this bill because even the sponsor stood here and said that. And if you will look that up that's ACT. One thousand seven hundred seventy six so far we address in school libraries in this bill. and just in case you didn't realize were not even touching state libraries which we should be if were at stake that's who we actually govern over. One. Either I'll finish it. Either we are for parents to have choices and freedoms and for free speech and dialogue or we aren't but we can't continue to swing that pendulum week after week on this floor saying that we are for parent choice when it comes to education and the very next week we are totally against it because we know what's best for their children to see in libraries and best for them to read. I don't have any obscene material in any of my libraries Beckham. In any of my libraries don't have obscene material. And you might say well then why are you against the bill. I don't have an issue with parents rights to control and restrict what their children can read I actually didn't even let my kids read Harry potter when they were in school because I but I would have never gone to the school and challenge that book even though I didn't believe in it and then reading it at that age I would have never kept another child from reading that book but my decision was for my child. And just in case you don't know what you got to do is call the library and tell them that you don't want your child to check out a book and they will be allowed to check out that book. I do have big concerns. When a set of parents or legislators try to control everyone else's choices we need to be more consistent either we're for freedom or we aren't we're for prince Royce or we aren't but we can't have our cake and eat it too it is time to stop vilifying all of these people. I have lifelong Republicans asking me what are we doing down here when we get back to the business of Arkansas stop with all the foolishness I'm ready for us to start running good policy that moves Arkansas in a better direction as far as growing our economy and making our lives better a better place to live here in Arkansas and with that I would appreciate a no vote. Calling representative Vaught Neier gonna disagree on this one because I believe this bill is the quintessential local control bill and I'm going to. Back that up with the story. I didn't think that there were explicit materials and my own public library Faulkner County is a pretty conservative County I was very surprised when I went down there and I didn't deed fine very explicit material. All of illustrations and I'm just gonna leave it at that. No question that it was not appropriate for five year old yet a five year old could walk over to the bookshelf pull it off the shelf and begin reading material that is completely inappropriate for that age group. So I took that book and another one that was similarly just as graphic to the librarian. Alternate local control. And I expressed my concern that these were available out there on the floor for any young child could get access to it. And I said you know what because this issue has come up and other libraries across the state. We're discussing having to do legislation we would rather this be handled locally so we don't have to legislate these things from here in Little Rock so I'm in agreement with my colleague on that and the head librarian agreed with that and said yes we need to handle that here locally we have a process in place where we can review this material just fill out these forms will need review it and see if we can get this taken care for you so I filled out that form. He took those I took the book did not hear anything else on that until last Friday. During that same time period not only were constituents contacting me about this concern they were contacting R. J. P. is about the same very is she. And R. J. P.'s felt completely powerless to do anything about the situation even though they agreed that that material was wholly inappropriate for the children of our community. That letter that I told you all that I got last Friday that complaint that originally filed was a year and a half ago. Now you and I whatever we make. Request of any state or government agency we generally get a response within a week or two something reasonable. Why did it take a year and a half for me to get a response on and the response that I got from my librarian was because of your concern we did increase our review process then he went on to say that I have reviewed the books and I have decided that we're going to keep these books and not only that he double down and bought two more updated copies with even more explicit material to put in our library so there was no review process that was done by the library board to decide yes or no whether to keep it he unilaterally made that decision. So you can imagine my frustration that it took a year and a half to get a response that's entirely unacceptable and then he unilaterally decided. That he was going to make that decision all that they had to do and would completely solve this problem is to take that concerning material put it in a room off to the side slapper rated R. on it nobody under seventeen loud without an adult that would take care of the whole problem if a parent wants to go in check that kind of material out parental control. That's up to that parent fully agree that that's parents but parents should not have to worry about whether there's five or six year old is going to going to a library and pull off something that they are not. Prepared for. And unfortunately we're getting to the point where people in our communities are just going to stop taking their children to the library because we're going to be concerned about the material that's sitting on the shelves and that's a shame the people of Jonesborough as you all know voted to cut the revenue going to that library because of this very issue so I'm fully supportive of this board because this is the essence of local control if one of these books is inappropriate. It is the eventually it'll make its way through and the quorum court the people's representatives will have the final say there will be the final judge of the values of that of that community not an unelected library board so I would encourage you to please vote yes in support of this bill yesterday we voted to protect our kids from **** on the internet today let's support this and protect our kids from **** in our local libraries. Prior to these incidents the motel was previously investigated for sex trafficking by The Little Rock PD who conducted sting operations that resulted in arrests. Another case of fifteen year old girl picked up from school by her trafficker and for three years was taken to motels in Springdale Arkansas the royal in in the economy and where she was forced to have sex for money up to fifteen times per day her trafficker branded his name. On her size of the and under the size of her entire lower back the motel owners and the site manager saw fifteen different men per day coming and going from the rooms where she was held and being trafficked another case a seventeen year old girl kidnapped from Arizona and brought to West Memphis Arkansas where she was sold for sex at the extended stay hotel across from Southland casino on multiple occasions the John who raped her was known at the motel for having sex with prostitution under age girls he had spent more than ten thousand dollars in cash at the motel on rooms to have sex with young girls and the motel did nothing to ever reported. And then I from August of twenty nineteen another case here in Little Rock Merrick as best value in on Shackleford from August of twenty nineteen through December twenty nineteen. through actual physical abuse along with threats to her life into that of her unborn child. L. woman John Jane doe will refer to was held by her trafficker at America's best hotel on Jack for little rock the planet was brought here from Texas and sold to multiple traffickers she was forced to have sex up to twelve times per day all of the money went to her trafficker ultimately she was found almost dead in the parking lot.
