The large portion of these victims were minors the suspect would air drop the minor's nude photos of himself and then you social media accounts such as Instagram and Snapchat to extort the victims for more photos. Additionally we have had approximately eight cases in the last year of the minor victim's being sexually extorted by suspects in other countries the suspects in these cases would pose as minors and the minor victims would send them nude photographs and then they would extort them or they would expose all those situations out. This is going on in my little town. This is happening. Kids are being preyed upon. Creditors are really attacking kids. All the time. This is not banned social media this is not a first amendment issue we are not censoring any sort of free speech at all all this does is apply the same logic that we do in a society. The same margin we think is right the same margin that we think protects kids and applies it to an online situation our culture is eroding today and it's happening online. Today the people who voted for you to come here. Thank you madam president members I'm proud to present this bill today this is part of the public safety has say for instrumental package governor wholeheartedly supports this we did a press conference about a you might remember that as you know over the course of you know the last several years we've seen a skyrocket in opioid overdoses in particular fentanyl and and in an effort to try to protect our communities to try to protect our citizens we have drafted this legislation which essentially does three things it establishes a death by delivery statute that provides a method to hold accountable. parties for delivering fentanyl or other drugs to a person who then dies as a result of the ingestion of fitting or other drugs regardless of whether the end user voluntarily ingested the drugs are not so with that we create aggravated death by delivery which carries a twenty to sixty or life penalty we create death by delivering the first degree which is a Y. felony with ten to forty or life we create death by delivery in the second degree which is in a felony which is a sixty six to thirty penalty or if there's some mitigating factors that could be lowered to a B. felony which is five to twenty there's also increased penalties for trafficking because we want to hold traffickers accountable those who were praying on our citizens and our and our miners and so we have a penalty in here that he is A unclassified felony from twenty twenty five to sixty or life with a million dollar fine and then we also address predatory more predatory marketing of signal to minors so this is to alleviate the rainbow effect and all the the marketing that that might appeal to minors and then we also had in here we remove the fentanyl test strips from the definition of drug paraphernalia and I want to create our say thank you to representive Boyd for actually working on us without making sure that that was included in this legislation he's been a huge advocate for doing that and rightfully so so also want to give credit to representative mark berry for his efforts on this issue as well and then of course all of the sponsors on this legislation so with that I'm happy to take any questions. House Bill fifteen twenty nine House for fifteen twenty nine The representative ray incentive today is to establish the Arkansas to help build diploma program and Senator Davis you're recognized thank you madam president and this bill is designed to assisted alts getting high school diplomas and workforce credentials we currently have over three hundred thousand adults in our state without a high school diploma so and this bill just provides for more flexible and been provider model that is outcomes based it's important to note that because there are accountability measures and that will be reported back to the state and there's requirements in there and on that and also and any provider that enters into it and an agreement or contract with the state will not get paid unless they produce high school diplomas for the students and for these adult learners so it's outcomes based if they don't do the job they don't get paid and I think that's a really good our allies for the state and the taxpayers I know that the adult and folks are doing great work across our state but our need for providers in the space is great as I said earlier there are over three hundred thousand people in the state of Arkansas without a high school diploma and this will not take funding from them I want to be very clear on that and this will be and within the department of commerce the money they have found some revenue in that and skill skills development fund we work with the department of workforce services department of commerce the governor's office and the department of education and to try to ensure that we can do this in the right way that I'm happy to take any questions. The current and all that and organizations to participate in this as it's currently written is that correct they were specifically excluded from that on on this bill now I'm not no the point of this bill is not to exclude them what I'm saying is some people in the calendar in the adult education space saw it and the missions are very similar trying to graduate people with a high school diploma and get a workforce credentials and so I just wanted to clarify that this bill does not mess with the adult and programs across our state it's just a different pathway for people to be able to get a high school diploma and I agree one hundred percent with what you're trying to do here I just want to clarification that the current bill that organizations and I believe they probably didn't help five like a lot of other organizations are in our five state Are not going to be able to access these funds we want to expand the what we're trying to do we all agree we want to do that but this this particular bill will not allow existing adult as to access the signs. this is an outcomes based model so like our adult ed programs across the state get funding annual annually and regardless this will just be certain providers and that get paid based on the outcomes they produce so I don't want to say yes or no to that I mean I think that the answer is no but I don't want to give you a firm no I just can't imagine where they would apply are you know try to get out and be and enter into a contract when they're already getting state funding for this very thing do you see what I mean like there already yeah they have an existing program that they would like the pilot and and access there's not an absolute unequivocal none of that they live is that what I'm here yeah I think the answer's no on that because there are already doing this and get funding but I can get that answer to you I get that answer to you thank you. The other thing that so that's going to run all the way through K. through twelve but the other thing that she has done is to appoint a chief workforce officer so if you look on your desk there's muddled around all your other stuff but you will find these two documents there these are documents that I had put together through the bureau of legislative research sometime back but if you look on this thing what we're talking about is two hundred and fifty five million dollars. State and federal money. That that doesn't count the higher ed doesn't count K. through twelve but that we spend on exactly the same kind of programs we're talking about here. Obviously a lot of them are working in the money isn't being well spent. So one of the things that the chief workforce officer is going to be doing he's been tasked with is going through and trying to identify how do we do a better job of using these resources for better outcomes we have exactly the same people targeted in all of these programs in this one that we're talking about in all of these other federal and state programs were all trying to get people better educated with more skills and in into the work force off of it Medicaid off of ten of off of food stamps out of prison all those kinds of things so all these dollars that are already being spent are trying to provide that effort so the governor has done a great job of thinking kindergarten through career but also appointing somebody who's going to take a look at how are we spending these two hundred fifty five million dollars my request to you is please don't add one more million dollar program on top of what we're already spending the same amount of money I mean millions of dollars for to do the same thing thank you. But we don't get the results out of those dollars so the question is do we want to move forward and that's part of what the governor has been talking about is how do we move to a new a new future. We can't move to a new future if we keep doing the same things that we've been doing and we keep adding one more program after another. And what are the results we never know what the results of those things are obviously everybody and better even after it's been all this money so I would suggest let's give the chief workforce officer an opportunity to identify and work with other people to figure out how we do a better job of what we're spending before we add anything else sure fees for this bill he would tell us calendar. This tell you about all the different programs that tell you they're trying to reach what that what the activities are in there and in some cases it does have how many people they serve and how much money they've spent. But every single one of these things the goal is to get people into the workforce. Give them get the my high school diploma or GED and the skills to be able to to operate and get off of some of these programs but we obviously are doing that. What are. This is. Thank you madam president and as was just stated that she for force officer does support this bill and senator Patty I want to respond to your question I have an answer and the answer is yes they can so clarity on that and I just want to speak to some of the comments from Senator English and with all the programs that we have been saying that we don't have result we don't get results and all these programs are the same and we're not getting results from them and that is exactly the need for this that bill and this provides a different pathway and it is outcomes based so if the provider is is not graduating students and getting a high school diploma for them they're not going to be paid so we are throwing money at a lot of different things and as you can probably see on the charts that were on our desk from Senator English but this isn't throwing money at anything this is only paying the provider if they achieve outcomes and results for people to get that a high school diploma so I think that's really important and and I think she said you know look we still have a huge number of people three hundred thousand people across our state that don't have a high school diploma and we have all these programs out there we have got to create a different pathway for people to be able to get a high school diploma but I agree with what she said about the The accountability portion what are they doing how do we know what they're doing and are they being successful well maybe we don't have the answers to that based on the information she provided that I can tell you that in this bill on page six there's a whole section on annual reporting so the provider that has eight any of the providers have a contract with the state for this has an annual reporting requirement back to us in on page seven there's a whole section on accountability and if they are not producing and graduating students if they're spending two money to graduate this kid's they will no longer be an eligible provider so we have accountability metrics in here to ensure it. That what they are doing in this program is successful and we're going to know and you know we're gonna hold them accountable and and know that they're doing what they said they would do through the annual reporting requirements that are mandated in this bill so as I said we're be able we are able to find Mr existing revenue we worked very closely with the department of commerce with the department of workforce services with the governor's office with the department of education the state chamber supports this bill the chief workforce officer supports this bill this has been a team effort to ensure that we create a new pathway a different pathway for the three hundred thousand thousand our Kansans across our state that currently do not have a high school diploma so that we can get them into the workforce they can get a good job make money provide for their families for themselves and have a successful life so we've got work to do and this provides another pathway to it and it provides the accountability that we need in our state for programs like this thank you for your time and I ask for a good vote. I've seen it happen and I've seen it used to. For most schools it would be innocuous no question but we have schools hundreds of thousands of dollars to keep.
