you'd even humble me today. Again or thank you for being with our state and we need your prayers and need your presence in our life as we go through the pick up from this tornado and so I list of many of the people around here and other places that are doing that we pray for our emergency assistance people we pray for our law enforcement. Lord we just ask that we as a people would love and trust one another. Then we would just an. Look to you for guidance and
direction we pray for our governor and the people that are around her and help her with all the decisions in the things that are going for that and for this recovery effort the lord today I pray for these people in this chamber specifically. That is they aren't running this race and getting things done and nearing the end of it that you would just give them strength today. Some of them may have been up late last night and had a long week in the running to the finish line and I pray lord that
you would help them run and not grow weary that you would let them. Just be on your shoulders and not grow faint did you to stay in their relationships with their family during this time help them through phone calls or facetime or just text and bind them together and orders are making these decisions at the end I pray that you'll help them not a compromise where their needs not to be compromised but where there needs to be unity that they can find that find it for our state and for the betterment of.

health education centers or a heck programs for the better part of fifty years UAMS through these a heck programs has trained and number of positions that have made a difference across the state of Arkansas in addition these programs have specifically benefited the rural areas of the state of Arkansas I believe we have with this today. Appropriation they have no new general revenue they will be doing any increases either fund balance. As prescribed for the of governors balanced budget. House bill eleven thirty three
secretary of state. it's flat this call it is not general revenue house bill eleven sixty nine she's eleven sixty eight department of labor licensing board it has special revenue no general revenue and it is also flat. Department of corrections. This also has a twenty million dollar increase and a general revenue which will pay additional money to our.
guard correctional guards and also try to help recruit more guards of to be a member to the Department correct. House bill twelve thirty one public safety appropriation. This does have the increase of about six point six million for the state troopers. That in the governor's balanced budget. Senate bill fifty one. Part of Human Services same story is held flat Senate bill fifty two same story no G. R. increase. Senate bill fifty three department Human Services now this one is the Medicaid budget and they will be operating any increases out of of balances in their budget. And talking to the Department Human Services of they could be spending somewhere between a hundred to two hundred.
Be an additional dollars depending on what the Medicaid does and who gets taken off the road this next year but they'll be spending that out of fund balances. Of Senate bill fifty four as a part of human services division of aging. It is G. R. and it is flat the part of education is Senate bill sixty one S. the Technical education that's mainly taken out of federal funds no general revenue.
Senate bill sixty four energy environment. It's general revenue at all it has is a small increase on the matching and and the call was. Senate bill seventy three department of education this is the blind and deaf school. Of. They do have a slight increase of about I think three million dollars in their budget but it was approved by by the governor's letter. Senate bill seventy six barber of education.
Appreciation this is where the large moneys in the four hundred million dollars additional learned money and we'll get to have a funding that is we get to the G. RSA and GME the S. R. RSA and the a one time schedule. Of Senate bill. Eighty three the part of agriculture which flat. Senate bill one ten essay you tech it's flat. And the last one is Senate bill one twenty three you A. M. S. it does have a five million dollar
increase on general revenue as in the revenue stabilization and agreed on with the governor. Do I need to take any of these other backs. And do I have any questions on any of the. specifically at that bill again I was just trying to kind of comprehend where that was coming from when I bought when I talk to the U. age if I was talking real money not appropriations right just and and what I'm gonna do. And and the budget chair's gonna do specially on these balances that ripping it down July one we're going to get we're gonna get a number of what are balances or an education and DHS and at the end of the year the fiscal year the next June thirtieth we need to let the
members know how much money we've spent out of these balances so we'll know how to plan but basically what mark why in the the of DHS people tell me I public kind of give me an estimate of what we think it will take to run our Medicaid program calls when they're not getting any new General Revenue and their estimate and it just depends on how many people are on the road and there's they're they're trying to purchase some of them all of it could be an estimate between one hundred million and
two hundred and fifty million dollars now DHS. Has about eight hundred million dollar. Of fund balance taking care that so that that's what they're gonna be operating off of. Follows. are you are you familiar enough with this enough this is where the subsidy comes from that will go to Blue Cross some of that Medicaid. Subsidizes some of their coverage you're talking about Arkansas works and stuff like

before I got in this chamber I've heard of people on the radio talking about how great Fred was at Little Rock Central and I never really got to to know what that what it was like and so or when I was asked to do this resolution I start doing some research on on what Fred accomplished what during his time at Little Rock Central read some of this to you. Fred read as a tenth grader Little Rock Central was the first African American to be on the as a full time starter on the varsity. During his time at Little Rock Central they won two state
championships got a second place finish and one overall state championship which we don't do now that was at the time you to have all the schools place other than champions from each one and they would all play Little Rock Central one that overall championship but the most important thing for me I've covered a lot of athletes and championships and things of that nature but this was really impressive. During his time at Little Rock Central he average average thirty points per game at Little Rock Central he said in all time
scoring record of forty points in one game and score and score a hundred and twenty five points over four games while at Little Rock Central now for many people especially that our fans the Razorbacks in Arkansas school. Representive Allen did not attend AA Arkansas college but he went on to do great things because the one on the middle Tennessee state where he excelled not only in the classroom but he also did that on the basketball court as well so with that being said I want to have representive Allen come

Six million. Twenty four million. Two years ago I mean skews me last year a year ago as a two point nine five percent increase. And go over some of the highlights as we know. Start with the of the first line on the Division of elementary and secondary education. We put a hundred fifty million dollars at a general revenue
into the large act and when we get to the one time schedule there's more money that we put into the large act on one time money off of surplus and where you find that figure if he's if the changes is a hundred eighteen million. And if you go to page two. And you look up for the education freedom accounts there's another thirty one million on that add those two totals up and that gives you the hundred fifty million that you've been hearing about on the increase in education. We do have a no the three
hundred fifty thousand. That is going to the literacy council's. It has been added to this. And if you go under general education to the education facilities you'll see the seventy million has been taken out. That's what we bring to our education facilities but as we get to the one time schedule. You'll see what we're finding that so it is getting funded it's just be taken out of the RSA and we're going to replace
it with one time money. if you get to the child care grants. You'll see an increase of seven million and the early childcare which is a two and a half million that's just a swap if you go down to the general education you'll see a negative. Seven thousand on Medicaid grants DHS grants and early childhood what we did we we swapped it out of the ATS and took it up education so that's
just a war from DHS to education. The of family and of children services and under of DHS usually the six point six million dollar increase that's for foster care. There's also a two point two million in aging and behavioral health increase that is mainly for programs of behavior that will be introduced into our county jails to try to get some
rehabilitation only offenders. The other big change is we're going to. Forty million dollars. Other department of corrections. Twenty million of that. Is for health insurance increases and twenty million of that is for staffing increases for the department of correction. Our next big increases the
division of Arkansas state police of six point two million. And that's to upgrade. Four positions. And reclassify. Sort of about ten thousand dollars in positions and add five million dollars in overtime. And add seven hundred and forty one thousand to their general operating budget for state police now we're doing a trooper
school but we'll see that in the one time to the of funding on the one time she. The only significant change other than on higher education the all the increases in the parentheses a decrease usually is the productivity funding drove every bit of that and that's a former that's been said in honor of the performance of the schools with the exception of two thanks the U. A. M. S. five million which we just
talked about in the bill. They're getting a five million additional dollars and if you look at the U. A. P. B. land grant. There was two thousand dollars for their land grant of match from the federal dollars we took that out of the budget and we'll see it on the one time schedule also. It's fun on the one time to get your. That's a two thousand to me. I'm glad you're awake.

With the exception of four items and I'm old I will start with those four items. We have a transfer for the historic rehabilitation income tax credit a forty million we
talked about that the Arlington the veterans in the Lafayette hotel. That is going straight. Two of the department for tax credits on bills rehabs that that's going straight to it there will be no. No committee that have to go through. The other thing that is is that the U. A. M. S.. There's twelve million dollars going to you A. M. S.. Of. A group of of citizens that L.
rate or their their hospitals going to phone. They have purchased the old hospital down there with local money of forty million dollars I was in on the meeting with doctor Patterson and lot of members of the U. M. S. they're going to take it over and and run that but will be only locally. They need some start up money. as as is bill to so this helps get that hospital bill one UAMS thanks that they can make money off of it making a vibra
hospital but that after this is passed that go straight. To that account. The other thing is is that for economic development and we do this all the time we've added thirty five million of one time money for the quick action closing for human make Donald and his people over economic development to be able to close deals and make deals on economic development that's a practice that we've done for quite some time so those three entities go straight. Of to their respective accounts.
The only other difference we have one a three fifths set aside is we have a hundred million dollar. Which will mainly be in the governor's pot now listen I listen. It's a simple majority the governor have to write a letter. Those to peer committee and have to be approved through peer and then we'll go to the vote of the full council. And it takes a fifty one percent margin to do any of this so
we've got it were no legislator or no governor no one person can direct this other money we're talking about without approval of the county. At a fifty one percent margins so don't run out here and say we gave the governor a blank check for a hundred million dollars because we didn't do it. All right we'll go all the all the stuff that takes a three fifths vote governor got to write a letter goes to peer committee to get approved and then the the rest this stuff
takes a sixty percent vote ratio. The fund. That's going to start off with two hundred fifty million dollars this year. And next year for the facilities we member we took that seventy million out of the budget. This will fund facility for locals who. The next is we put three hundred and thirty million to build a new prison. Now when that gets built and where it's going good bill has
not been determined but that's money we're putting aside one time for construction for the prison and that also takes oversight every bit of this of the General Assembly. We've also put back two hundred million for the crime lab. Of two hundred million for infrastructure grants and matching set aside this could be highways this could be bridges dams anything infrastructure will have the money sitting
there on an eighty twenty or ninety ten Max water we need to do with the federal government we have a pool sitting there but that also takes the proof. Of what we've been doing in the past we also have fifty million dollars for the UAMS cancer center. Of when you member that the fifty million dollars we have for the school safety is broke up under two years. Basically thirty seven and a half million the first year twelve and a half million the second year a total of fifty million dollars for school
safety projects. All right in the second year which will not be in this one but if we need additional money for adequacy and twenty twenty five we've got another forty five million set back in year two it will not be the current year that were were adopted. Teacher scholarships or twelve million four year wanted to twenty four twenty five of these or for teachers that are
advancing themselves getting masters you specialise degrees this is this money to set aside and that's inside the learned Jack. We set aside twenty million dollars a one time money to buy vehicles for state police in any state agency that needs. And that's a practice we've done a lot is but one side one time money out to buy capital improvements on cars. The fifteen million for the large
act this is the voucher program. This is where we parked additional fifteen million we've got to thirty one million of that inside the RSA. If in case there are more people that we anticipate that are using the vouchers we have the fifteen million additional dollars to spend but we don't have to if the request aren't there. Let's go to We were talking about the south
Arkansas hospital. All right in the next one is the performing funds set aside the performers Fund this is the raises this is what we staff for several years ago for raises we have about seventy million in that account it's a good healthy account so we've got to come up with with raises and kolos we've got a hairy to do this we don't have to transfer that money there but if if they need additional dollars the council can review it and transferred if they see fit.
Charter school facilities. Need to enhance your bill charter school facilities we put twelve million dollars down and one time money. Of state police trooper school we're adding a second super school and that cost is six point four million with one time money of we're down on our state police we have a lot of six hundred ten.
Rob for positions in what we're a little under five hundred we need to start adding to our state police so we're we're adding on a second school that will. Pacific specifically go after existing law enforcement people that are in counties city police departments to costly for if they want to be a state trooper they'll have a little less training they have to do when it will get them up to standards. Of the U. A. P. beforehand rant that I misspoke it's at two thousand the two million dollar
for both years twenty four twenty five is the next item. The teacher education program set aside this is learns Act this is the training the teachers are going to get we've got one point one million of one time money for twenty four and twenty five. A bill that myself and Senator Flippo grand there's a million dollars to go into the pregnancy centers throughout the state they've got to apply for these grants that funded on the first year.
The next we've already talked about the hundred million dollars that goes to the governor with with prior approval and a majority vote of council of a hundred million dollars for the simple majority set aside. We have forty seven million dollars for EBD which are insurance program. I thank always need money so you need to put some money in there because insurance costs go up. And to the game and fish set aside they had some projects.
All the lone oak fish hatchery there's several things they ask for twenty we put ten aside but remember. They've got to get a letter from the governor and we've got to approve it on a three fifths vote so there's ten million set aside. Of we had some money for the rapid DNA testing inside a budget. If we need some more we've added three hundred seventy thousand more dollars for the rapid a DNA test to help solve crimes.
Vardan over the quick action closing money. Economics to stem if similar set aside for various grant to stuff that's ten million dollars that also takes council approved. And. This merit the marijuana money. Which is been pulled away from you A. M. S.. Of he is going to go into account because they've got their funding in this with you a message with. this is going to help with the school lunch programs in the schools and the Of health and the health set side need to food insecurity programs that were about the employment and that'll be we thank thirty million dollars. The Drug forced set aside we have another two and a half million dollars to of help fund our drug task force throughout the state. And then the last to set aside
his law two hundred forty thousand eight hundred twenty thousand this year on twenty thousand next year to give our planning and development districts throughout the state that are made got one some additional funds for one time money. And the last one come from representive Ladyman. Is the eight point eight million dollars in year two for the human development centers there from human development centers are in pretty bad shape this gives the money one time money
to fix these up so people can have some dignity and live in the in in the my understanding I haven't been doing but some of are in pretty bad shape. and the last one. With there's no figure in there is a law enforcement stipe and. We did that last year there's thirteen million dollars from last year that we can still do which would be. Campus police highway patrolman.
And as we open this up we found out we had more policemen they with all people requesting we're not going to do that this time but we will when we get all the numbers in the figures out we will do that in council with the vote of the council with a letter to the governor in the interim. And that's your one time schedule a grand total of one point four million four billion the first year three hundred eighty million in fiscal year twenty five. And I'll take any questions.

The successful treatment is with the IV IG infusion patients still have to work through a primary care physician or go to one of the doctors at UAMS our
children's hospital to get approved for this only four people for four patients were approved for the treatment in two thousand twenty two. We're trying to make it were Medicaid comes into line with the policy that is now in place we would cross BlueShield and the other states around us. A patient properly diagnose should not have to have built difficulty getting this treatment. There have been many kids who have committed suicide with this disease we have a treatment now

It's released arrested sentenced release it is a joke the current system that we have and this bill will completely change that. Particularly with regard to truth in sentencing and I want to talk about that Attorney General said many times is absolutely correct the current system that we have in Arkansas is deceptive when someone gets twenty years prison time in Arkansas the reality is is that often means three years and the public has no idea when the public reads the headline in the newspaper that someone was sentenced to twenty years in the
Arkansas department of corrections they think that that means twenty years they don't know in reality that means three years when they see someone gets a sentence for ten years they don't know that that means eight months. But often times that is the reality in Arkansas it's deceptive and it needs to change in this bill will change that I want to give you some examples when I talk about the revolving door and the repeat offender which I'm gonna talk about a little bit more it's the same
people who are committing crimes over and over again. And we have to start holding these people someone to give you some examples this was from a database that the Attorney General began to keep just from press reports this is not anything that he had to gather from the parole board just reading the newspaper and look at what's in the TV you can learn about these incidents is an individual in Arkansas sentenced to for first degree murder. For twenty years in the Arkansas department of corrections was
released after only serving a hundred and eighty months and four months after being released committed capital murder the information it was filed in that case said that he shot the victim three times in the head with a firearm left him laying on a gravel road for forty eight hours before the body was found once again released after having served a portion of his sentence never should have happened. Never should have happened. Another example an individual sentenced to twenty years in the department of correction for simultaneous possession of drugs
and firearms and felon in possession of firearms this was someone who had a lengthy criminal history twenty years in the department of corrections two hundred forty months was released after having served a hundred and thirty one months just a little over half his sentence about a year and a half after being released re arrested for first degree murder. For shooting another individual was ultimately sentenced in that case to six hundred sixty months in the Arkansas department of corrections once again if he had a certain if you have served the sentence that he was given that
second murder never would have happened. Another another instance an individual who had at least seventeen previous felonies as most recent being for residential burglary and felon in possession of firearms was sentenced to ten years. But was released after having served less than three not even quite twenty five percent of his sentence three years after being released
charged with second degree murder alleged to have run over a man with a vehicle in his own front yard once again if he would to serve that ten year sentence he would not have been out three years later to run over and kill someone. Another example sexual assault in the second degree this was someone who was sentenced to the department of corrections and given ten years in the department of corrections for sexually abusing a thirteen year old girl was required to register as a sex offender was released after having served only thirty three months just a little over a quarter. Of his sentence. And was re arrested for internet stalking of a child for stalking a thirteen year old girl on social media sending her explicit photos and text never should have happened that person would have been in prison. And and serving the sentence that they were given never would have happened. Got two more examples that I want to leave you with an individual who was sentenced to the department of corrections for aggravated assault and felon in possession of a firearm he
was given a hundred twenty month sentence he was released after having served only thirty five aggravated assaults of violent crime. Released after having only served thirty five months. Was re arrested for capital
murder arson abuse of a corpse just about three years after his release the public fire department responded to a residential fire and as the flames are being distinguished they extinguish they discovered a badly burned body inside the residence the cause of death was determined to be a gunshot wound once again if that person had been serving their entire sentence they never would have been out to kill another person. Like they did last one that I leave you with the battery in the first degree under this bill that's on the eighty five percent less this person was given ninety six months in the
Arkansas department of
corrections for battery first degree was released after having only served twenty two months. And about one year later after his release charged with manslaughter for stabbing his half brother multiple times pled guilty to that manslaughter never should have happened another our cans and he would be alive today but for our broken. Parole system so this bill will change that in very important ways I want to I know that we've been here a long time were likely already to go home but I want to give you a quick explanation of how this is going to change things for the most serious and violent offenses that we recognize in Arkansas law we're creating a classification called felony an eligible to release broke receiver and release credits that means you have to serve one hundred percent of your time. What kind of offenses are we talking about they're talking about capital murder murder in the first degree kidnapping aggravated robbery rate pandering or possessing visual or print media depicting sexually explicit conduct involving a child transporting minors for prohibited sexual activity internet stalking of a child sexually grooming a child aggravated residential burglary the most serious violent and sexual offenses that we recognize in Arkansas law under this bill they're gonna have to do one hundred percent of their time. Not gonna be able to be released
and go kill again and go rape again and go stop thirteen year olds on the internet again. The second portion of the truth in sentencing pieces what I call the eighty five percent bucket and that's what we call restricted release felonies there fifty three crimes that fall under the restricted release felony once again we're talking about some of the most serious violent felonies that we recognize in Arkansas law and sexual offenses involving children I'm talking about murder in the second degree manslaughter negligent homicide were where a person was intoxicated kidnapping if it's a B. felony terroristic act sexual indecency with a child sexual extortion this is just to name a few grooming a child for future sex trafficking and what this does is this mirrors the federal system many years ago the federal system eliminated parole and under the federal system you
have to serve eighty five percent of your time. This will mirror the federal system in that regard if you're convicted of one of the serious heinous offenses you will have to just like in the federal system survey five percent your time and I wanna make a point the Attorney General's made this point many times and it's very true if you talk with law enforcement around the state is what they tell you there's one system that the criminal spear and is one system that the criminals laugh at when criminals are arrested for these types of crimes the first question is am I going federal or am I going state if you tell him I'm going federal you're going federal they cry if you tell them they're going state they laugh because they know the system that we have is a joke once again this changes that. There are two other what I would call buckets regarding early release of the potential for early release. That's the fifty percent and twenty five percent no more in Arkansas will people be released after having only serve one six that their sentence which is currently the case for many crimes in Arkansas for instance sexual assault in the second degree which is a very serious sexual crime often times involving children that is currently a one six parole eligibility crime this bill changes that this bill eliminates all one six parole eligibility offenses you will do a minimum under this bill at of
at least one quarter of your time if not one half if not eighty five percent if not all depending on the offense one of the other really important changes in this bill. Currently if you're in prison Arkansas you don't have to do anything really to be eligible for release one at one day that the day just comes in your number's called and you're just eligible for release this bill changes that if you want to be released early in Arkansas from this point forward you're gonna have to earn the release. And that's what we call it early release credits or earned release credits and that means that the inmates have to earn the release will have they are in the release they can do that by participating in educational programs. earning trade designation so you get a GED get your high school diploma you earn a trade certificate you participate in workforce training you do the behavioral programming and you behave while you're in prison. And I know that's a revolutionary thought because oftentimes doesn't happen some of the folks that I mention had multiple disciplinary kind of infractions while they're in
prison and still put it right back out on the street. After having only served a fraction of their time this changes that and says if you're going to prison you have to earn your release you're not just entitled to it and I think that's very important change. So that is largely the truth in sentencing piece we also deal very harshly with repeat offenders once again it's a small number of people who are committing the vast majority of crimes in Arkansas if you look at the prison population prison population Arkansas right now is about seventeen thousand people.
Well there's over three million people that live in the State of Arkansas that's a very small group of people many of them repeat offenders who are responsible for the vast majority of crime in one way that we in that revolving door and we do that in this bill is we say that if you're one one of those criminals who commits the offense that's on the eighty five or one hundred percent less you will have to do all of your remaining time so all of the sentence that you previously had you're gonna have to serve plus
one hundred percent of the new time that you're given. Also we eliminate. The eligibility to be released on the emergency powers act if you are on that one hundred percent or eighty five percent list. So that's largely the truth in sentencing peace this bill also increases penalties for some of the most serious crimes we recognized in the law manslaughter which goes from a C. felony to a B. felony so instead of ten years now manslaughter will carry up to twenty years negligent homicide which is currently a misdemeanor
given the course of conduct would become a D. felony which would carry potential six years promoting prostitution of a child under current Arkansas law is a D. felony means it carries zero to six years in the department of corrections under current law we're changing that to a B. felony city Kerry's five to twenty years in the department of corrections which is much more appropriate for anyone who would engage in that kind of conduct we're also enhancing penalties for the unlawful discharge of a firearm from a vehicle that's a drive by shooting. And we're enhancing penalties
for terroristic act committed in the presence of a child. Also we're enhancing penalties for fleeing one of the thing if you talk to law enforcement one of the most concerning things that they're saying I've heard representative Tosh reference this is people who are fleeing from our law enforcement officers in a vehicle and that endangers all of us and dangers anyone who's on the roadway in a particularly endangers our law enforcement officers as they try to pursue these people and bring them to justice and so we're increasing or enhancing penalties. For that conduct.
But I wanna say this about the bill. This is a what I would consider a very comprehensive and balanced approach that is the harsh portion of the bill which I think is appropriate given the offenses that we're talking about again the most serious violent and sexual offenses that we recognize the law but we're also protecting victims and increasing our protect protections and funding to help are victims sprint since we're spending notification requirements for sex offense
victims upon early releases sex offenders we're closing the early release loophole for certain sex offender so what we do is we had specific provisions that will prohibit sex offenders from being released early rather otherwise eligible and we prohibit sex offenders out on early release from residing with minors the the public likely thinks that that's occurring now it's not. So specifically for those internet crimes we say that those offenders cannot live with minors. We.
Also add specific provisions in this bill regarding rehabilitation workforce training and re entry for inmates so once again we talk about a balanced and comprehensive approach we have multiple provisions in this bill that address mental health they expand funding for specialty court's that. Promote reentry by coordinating with workforce services for instance to prepare inmates for re entry by cooperation with community organizations. That we prepare inmates to
reenter the workforce by providing them with vital documents this is not occurring now when a person is released from prison so that they can get a job so they can get back on their feet one of the things that they often need or those vital documents so that they can make application for a job I'm talking about things like birth certificates social security cards working to workforce training records all of these things will be provided to an inmate upon the release of thank you get back on their feet and get out and get a job reintegrating to society we're providing a hundred twenty day
grace period the four inmates have to begin making payments on their fines and fees. And then I talked about expanding the specialty court's another very important provision here we want to deter people who suffer from addiction from ever entering the department of corrections to begin with and one of the ways that we can do that is by expanding our drug courts are mental health courts in our veterans courts so that people who are suffering from addiction can get the treatment that they need and they don't have to be sent to the penitentiary I which is much more appropriate so.
That's a. Thousand foot overview of what the bill does once again it's comprehensive and I think addresses of the entirety of the spectrum of our criminal justice system in Arkansas and in a lot of good ways so with that I'm happy to answer any questions. Represent valid for what purpose question for clarification you're recognized. Representative Gazaway I appreciate what you're trying to do early on in your presentation
you said that the parole system was broken now I served on parole. And when a person comes to the Department correction. We don't determine how long he or she stays there so when they meet that threshold. The parole board has to let him go. So are you saying that the parole board this insult on the way there was sentenced. Is making a difference. Yes so you asked a good question and so one of the things that
you talked about is that the parole board in some instances has no discretion. But to let these people out and you're right and we change that in this bill we eliminate the distinction or we eliminate discretionary and non discretionary crimes so that all the crimes now become discretionary in other words the parole board is not forced to let people out that they may not think should be let out and so that's one of the ways that this bill addresses that okay follow. In your in your bill I read part
of it not all of it is there anything in there for prevention intervention and treatment. Yeah absolutely just just like we talked about I talked about earlier there's a mental health pilot program that works been expanding in the county jails to work with folks who are suffering from mental illness who may not be fit to proceed to trial to try to help that move them through the system if they're truly mentally ill and not fit to be tried then they can be put in the appropriate facility that would be appropriate for them if they can
become fit for trial than it gets them ready for trial so that they can be a process to the system more quickly so that's a that's a mental health pilot program like I talked about expanding specialty court's we're talking about about four and a half million dollars to be dedicated and it's not the funding pieces not in this bill but I've been given assurances this going to happen but that's for a half million dollars that's dedicated to expanding drug courts so that people with addictions once again we're not incarcerating people with addictions we're
trying to treat their addiction make sure that they get the help that they need expanding mental health courts so that once again those who suffer from a mental illness can be diverted from going to the penitentiary get treatment veterans courts for those who served in may I suffer from posttraumatic stress or other things maybe the underlying reasons for their crime. Once again for half a million dollars to expand those programs so that those folks can get at the needed help that they need so absolutely there is money dedicated and programs that are
recognized in this bill for treatment. I guess my question is I understand what you all are are trying to do. My next question bills over a period of several years how are we going to be able to sustain this because it looks as if we're going to spend a lot of money locking people up and I get that part because. Some people need to be locked up.
Thank you have some people down there that are worthy of being set free so I guess my question is how will we pay for all of this over. So you're asking good questions And and that's an appropriate question what the cost. One of the things that I would respond with that I'm going to answer your specific questions one of the things that I would respond is what is the cost if we don't. What is the cost. To the family members that I
just read about who had loved ones murdered by people who should have been in prison. What's the cost to them what's the cost of the thirteen year old girl who sexually assaulted or raped by someone who should have been in prison. But wasn't because our parole system is broken what is the cost to our communities specifically take Little Rock for instance there were more murders in the city of little rock last year than in the city's entire history. What's the cost to our community if we don't do this.
What what is what's the cost in terms of economic development for the city of little rock that can't get a business to come here because the murder rate so high what's the cost if we don't do this. And I say that it's too high I understand that these things cost money but the public our Kansans deserve safe communities Little Rock deserves to be a safe community and there's a cost if we don't do this and we're paying that cost every day. Those victims who had loved ones murdered they paid the cost.
People have had children rate they've paid the cost and so there's a cost if we don't do this but to your point. The governor's office with the budget now believes that we can afford this we dedicated and it's a lot of money to expand presence but they believe based on projections that we can afford to expand presence by about three thousand beds now we need we may need more than that and I think you know ultimately there may have to be more expansion but we have tried to be number one wise stewards of
the tax money and be responsible with what we have to address these issues while being fiscally responsible with our taxpayer money and it once again the governor's office and others have been involved in these discussions believe that we can't afford this. Represent back for what purpose question you're recognized tell concerning the and I'm parties raw fries here but these aren't credits for early release or whatever is that applied to those start to apply to people that are currently incarcerated
now are would star from this point forward how's that work yeah that's a great question I meant to address that in my initial presentation so there are a couple of effective dates that are very important for this bill number one when we talk about the one hundred percent offenses those don't begin until January one of twenty twenty four we talk about the eighty five percent offenses does will not begin until January one of twenty twenty five and a couple of reasons for
that number one we talked about the capacity issue and so before we make a bad situation worse by changing or parole laws we need to get some run way so that we can build out the capacity so that we have the capacity to hold the folks are going to be sentenced under this new law so delaying the effective date helps with that the other reason is as prosecutors defense attorneys judges everyone who works in the criminal justice system needs to be adequately trained on the the changes that we're going to make here so that they're well aware and not.
To harshly punishing people too harshly and keep him in prison longer than they should so but to your direct questions about the early release credits at when this bill becomes effective. The the old parole system will still exist on those people who were sentenced before the effective date of this bill will fall under the old parole system and I'll be subject to the old parole laws the early release credits will begin to for people who are sentenced after the effective date of this bill. President Springer for purpose question you're recognized thank you Mr chairman of thank you the representative Gazaway of few months ago the Secretary of appeared in a meeting for he
talked about for lack of a better word rehabilitation plans for the member the prison and inmates there over a seventeen. Prison systems and I did not hear you speak to that all those plans something that's a part of this. Absolutely so there are provisions in this bill and we don't get too far in the weeds of telling the department of corrections exactly how to do their job but there are provisions in this bill that direct the department of
correction to develop educational behavioral workforce training and they're already doing many of these things but they're going to expand those as would be the most appropriate for the offenders that are incarcerated the department of corrections so they're going to do a complete overview of and this bill directs that a complete overview of the programs that they have and try to tailor those to better meet the needs of the people who are currently incarcerated this bill does directed to do that now again we didn't get really into
the weeds in the specifics of how they should do it but I trust Secretary preparing the folks at the department of corrections dexter Payne and others to develop those programs as would be appropriate. VOL recommends thank you so. I understand what you just said so that were are we considering appropriating the additional funds for a staffing persons to assist in. Would you speak to that please so there my understanding is
that department correction budget was increased for for specifically for those purposes over previous years we also the director of the sentencing commission and those who can work with the department of corrections like I said this is a game changer in terms of criminal justice and so there's gonna have to be more money devoted to training staffing and getting getting everyone up to speed up for the implementation of this bill and so yes there has been specific money dedicated to do that.
For more final question okay so will there be a process to review and evaluate as to whether or not these plans have been developed would do what is necessary to rehabilitate those persons that are there because as I recall the Secretary saying is that there are things that that were in place now that are not working and that he thought that they could develop some place to make sure that the recidivism that takes place now will not occur once they completely implement the plan
without inmates being released earlier so would you speak to that please. Yeah and like you I mean I've just I've talked with with the Secretary prepare you about it I just heard him make the same assurances that you've already make that they are reevaluating the programming and that they're going to do their best to tailor that to the inmates that they're serving in a better way than they are now they're doing some things now they're doing some good things now but they understand there's some things they can do better and they've committed I think Secretary purpureus committed publicly that they're going to do that
this bill directs them to review that so. Represent flowers for what purpose question you're recognized thank you Mr Speaker Represent Gazaway can you give us a sort of broad stroke break down of. What money will go to what so if you you mentioned to represent Allen that I think you said four
point five million dollars will be dedicated to prevention intervention and treatment so. As it relates to For example re entry or specifically to mental health if that wasn't included in that four point five then the three thousand new beds can you just kind of give us a. Brought breakdown of what that funding looks like so the four point five million approximately that I talked about that's for
the specialty court's there's the mental health program in the county jails and I can't recall off the top of my head the amount of money that's being devoted there but that's in cooperation with DHS and I know those discussions have taken place and that the money's gonna be appropriated so that they can administer that program it once again I don't have the exact figure this is not an appropriation bill representative gene and others are more familiar with department correction appropriations can probably give you some idea about the increase
but there are increased funds for all of those things that you talked about. Seeing no further questions members thank you and I would appreciate a good vote thank you. Thank you Mr Speaker and I thank you representative Gazaway you know I I think Jimmy does great work on on everything and this is no exception he is listen to a lot of people work very hard along with people from the governor's office and Senator Gilmore and and the attorney general's office the light on this bill it does a lot of good things you know I I really think that some of the improvements for making a special records is gonna make a huge difference in people's lives I'd like to see how the rest of it plays out but
I'm optimistic that we can make some positive changes with some of things in this bill but I do want to talk about the biggest part of this bill sort of the headline of this bill which is the truth in sentencing part. And that really is longer sentences I mean I think we just have to be clear that what we're doing is extending sentences for a large number of people in our criminal justice system. And you know when I think about any bill I think we all probably feel the same way we think
there's a problem that we need to solve there's a solution that we need to solve it with and then there's a cost and we have to analyze all three of those pieces together the problem to me that I see in Arkansas that I think we talk about all the time we all pretty much agree is crime public safety crime is too high crime is a problem it's stubborn we need to get it down need to prevent and reduce crime. The solution that is being
proposed here is longer sentences and that is the big problem with this because longer sentences does not effectively reduce crime and I don't say that just offhand as something I think or it's just what are philosophically believe this is studied extensively this is been review that's one of the biggest questions of our time DO longer sentences extending them does
that effectively reduce crime the answers come back over and over again is no the department of justice publish something and it says direct quote increasing the severity of punishment does little to deter crime. And there's other things there's the meta analysis of a hundred and sixteen studies that came out just recently that looks at it analyzes the analysis the No effect of custodial compared with noncustodial sanctions is considered a criminological fact. Now does that mean that we
should have no prison no I don't think so I think prison serves an important role first of all it's a punishment you know we we do as a society want to punish people because that's appropriate and it we also have some benefits to taking them off the street certainly and there is probably a mile the turn of faxes senses but the problem what what what we're doing here is taking moderate length sentences and severe like sentences and making them more severe and the proof that that
works is not there and I know we talked about it in committee and I ask for this proof in the proof wasn't there because the proof doesn't exist. But there is a cost of the third piece of the problem solution cost analysis is the cost the cost is that it's the biggest cost is money we are going to have to build a new president in large part because of this bill and I think that the estimate somewhere around five hundred million dollars and who knows if it's going to be more than that or not and then there's on going because we have to house these
prisoners we have to provide healthcare for these prisoners they become our responsibility for better or worse for much longer than they were going to be before this bill. If there was a pay off if it was proven that this was going to reduce crime I agree with representive guys where there's very little cost I wouldn't be willing to pack I think it's probably the top priority of our state to make sure that we're ensuring and improving public safety but this bill doesn't do
that I don't think that this bill is the truth in sentencing part is actually going to reduce crime the other parts might have a chance to make more of an impact. I do want to just just briefly comment on a couple of other things that the representative mentioned that the bill does And then I'll get out of the wild. it could be that there's a different goal here that it's not to reduce crime. When represent gas service after he talked a lot about crimes committed by people who had formerly been incarcerated.
Well there are of course going to be people who do that whether they do that after their sense on parole or after parole but the truth is almost everybody who goes to prison in Arkansas not to mention anywhere else is gonna get out at some point and so the idea that the revolving door stops or this bill is false. People don't go to jail for life on every crime we could do that I wouldn't favor that but that would be a way to stop the revolving door that might be the
only way to stop the revolving door but as it stands if they do a hundred percent of their sentence and it's twenty years thirty years not going to twenty they're still going to get out at forty or fifty and they might again commit a horrible crime so we're not solving that with this what we are going to do. Is make present a more dangerous place. You go in for instead of five seven ten years you're going in
for fifteen twenty twenty five years there is a fax of institutionalization people become more habituated to the president fireman and they do the outside world it's dangerous for staff it's dangerous for other prisoners and when they get out they're gonna be less able to rejoin the world and civilized society after having spent such a long time behind bars the other thing that's related to the danger in prisons is the foreign release credits
so yes you can earn with good behavior and work programs and things like that up to fifteen percent release time for some crimes none for other crimes the motivation to participate in these programs the motivation to behave after you hit that fifteen percent maximum or for a hundred percent crime there's it's zero then what's your motivation to behave well behind bars I mean you may be genuinely motivated to do it and hopefully that's the case but the incentive that exists in our
current system is gone with this and I think that's gonna make prison a more dangerous place. there are a lot of things that we need to be doing to reduce crime I think it's the most important thing we can do pretty much in this body but I want to just read you in this the last thing I say these are the things that the evidence shows actually reduce crime and many of them we have no control over there just are broad demographic trends aging population reduces crime
increased wages increase employment increase graduation rates increased consumer confidence increased police personnel and changes in police strategies so what we can do on every single one of those issues most of the I mean not the aging population but on most of those issues there are things we can do those of the root causes of crime and those are how we combat crime particularly with respect to police and I would love to see investment and that that would reduce crime I don't think this bill is going to
effectively reduce crime that's why I'm in now thank you. Represent Collins is spoken against the bill would anyone like to speak for the bill represent for a. You're recognized to speak for the bill. Thank you Mr Speaker colleagues I'm not gonna give a long speech but I do want to tell you a brief story But first I'd I do think it's worth repeating the excellent and stellar work the representative Gazaway and
senator Gilmore have done on this bill it is taken months and months of tireless effort. When I worked in the lieutenant governor's office it was very routine for us to take meetings with constituents. And I took a meeting one time along with at the time lieutenant governor Griffin that I will never forget. There was a woman I think her name was Rebecca who called from Meena.
And she wanted a meeting with the lieutenant governor and typically when people call in they live hours away all offer to set up a phone call or something like that but she was very insistent that we meet in person and she wanted to meet about the parole problem and the reason I share this is because this is how I was referred by my eyes were first opened this problem and when she came to meet with us she told us the story of her family and the
story of a man named Brian bliss Travis. And she told me what Brian Travis did to her family. He murdered her entire family. In a quadruple homicide he murdered her daughter who was thirty nine years old CD forty three years old. He murdered their uncle. He murdered their nine year old son Riley. Any murdered. Their two year old daughter a slim.
Ryan Travis was a parole a. But it wasn't just your garden variety parole E. he had been paroled nine times. And I will never forget looking at that grandmother. And looking at seeing the look in her eyes when she told me the story of this man the demand for old nine times who murdered her entire family. And since that time I have felt very passionately that this problem needs to be fixed.
And the bill that represented Gazaway and senator Gilmore have come up with. Is not just tough on crime as he explains it is also smart on crime and it helps fix this problem of the revolving door of criminal justice in our state. And it helps in this dangerous game of catch and release that we play. Was violent repeat offenders and that is while be voting yes today. Reserve raise spoken for the
bill would anyone like to speak against the bill represent flowers you're recognized speak against the bill. I suppose that I I will start by also thinking represent Gazaway for his work and of course I'm going to go into any of the things why can't support the bill but
I know what it's like to work really hard. On a bill and and for the right reasons. I'm not going to speak against. The focus on lengthening the sentences. Just because I know that's the meat of this I know that that's the and you've already heard representative Collins speak to
that point so I won't be repetitive in that way. And representative ray just recited a very harrowing story that any of us. Would respond to and want to fix and want to prevent. I'll just say this. No matter how long we keep people in prison. If we don't spend resources. Time and energy.
And rehabilitation and I'm talking about this for the people who already made at the prison. Whether it's ten years twenty years thirty years. They will get out. And if we have not invested in education. Literacy.
Made decisions to not invest in school nurses. Two when we're going to address the lit the the finding. To eliminate the DD Lewis for the developmentally disabled. Not not spending money you're quibbling over how much we will will or won't spend on our two largest industries agriculture and tourism. And then of course we have made the terminations that why we
lower our taxes. And determine. We should expand presence. We have one state hospital. In the whole state one state hospital. And over the years that I've been here every session there's been a fight about reimbursing our community mental health
centers to the point that many of them have closed down. We know that a majority of people in prison. Have mental health issues and have very low literacy rates. But we're about to have a ten year impact. Because nobody heard anything about the money. A ten year impacting the fiscal impact statement associated with
this bill. Of a hundred and sixty three million eight hundred and thirty thousand two hundred and eighty two dollars. But we're going to spend four point five million. On specialty court's we don't know how much we're going to dedicate to mental health. We can do better and for that reason I will be voting no and I ask you to join me.

I give I've given representative Gazaway a lot of grief this session since my jury duty bill but I want to tell you and I joked with the red vote on most of his bills this will not be one of all Jamie Gilmore worked their tails off on this
I mean I watched from the sidelines listen to the conversations I will tell you we all know there's a crime problem in this state. This bill will address that to reply to representative Collins comments. True this may not completely deter crime but I know one thing in one day it'll stop those that are incarcerated from committing repeat violent crimes against our Kansans and that is a deterrent and the reason we should vote for this bill the other thing I'll say we talk
about money and how much this cost how much does it cost our Kansans with the crimes that are committed against them every year in the State. Put a dollar amount on that if it's your family or your property this is a good bill this is a solid bill and I ask you all to support and vote yes represent Shepherd for what purpose. And those are things that we need to work on I'm certainly committed to working on those things but I wanna make this point which is that our Kansans deserve protection now. The. Time it would take to address some of the long term solutions that we talk about education poverty lack of opportunity these are
things that take decades but our Kansans deserve protection now you should be able to go on a morning walk in Arkansas now without fear of being abducted and raped and murdered you should be able to go on an evening walk without fear of being mugged you should be able to stop at the gas station at night without having to look over your shoulder. You should be able to live your life in peace without some constant fear of crime that you're gonna be mugged ducted kidnapped and murdered okay when you're out at night in Little
Rock. Our Kansans deserve protection now and this bill will do it and I wanna make one other point. You know there's this idea out here that we're locking up all these low level drug offenders nonviolent offenders that's just not the case if you look at the data to very small portion of the prison population is made up by nonviolent drug offenders. The fact is. This bill targets the most serious. Heinous crimes that we recognize
in Arkansas law murder rape aggravated assault aggravated residential burglary this bill addresses the people were afraid of not the people that were mad at that should be the public policy of the state I think it's a good bill not appreciate a good vote thank you very much president Gazaway is closed for the bill the question before the House is the passage of Senate bill four ninety five prepared machine madam Clerk. Department back taken over. That came out of the out of the executive branch. That did not come because of any. illegal behaviors of misuse of funds by the promotion boards. Every audit that was done on those boards came back clean. I am back playing so there's no issue with them. Abusing their prior misusing the funds or any of those things all right. So that's what you have to think about now if this bill doesn't
pass. We still have the other bill that we can bring back. Right so it's not like we don't have an option. And I'm telling you you could see all the information I got in the emails that were sent to me in opposition to this bill I thank you would believe and think the same way that so I would appreciate another vote on this bill and the opportunity to bring up the bill back.

That wasn't the the issue with me the issue is with these boards their promotional boards or not they are not a governing board. have a rice mill in my district. And I'm wanting to know how this would affect that rice mill would they have to pay into this and who would they pay in changing the language okay that exists in this bill and then how would it be impacted with the other bill thank you so that then change.
One six cents collected all each bushel. Of grass that money funds the boards if funds research and it funds the marketing so the people that are producing the product when they take their products to the mill the mill selects that and it's paid into the night and then those funds are disbursed the FNA with all the controls all right that it takes to spend any of the money. manage this money by putting it the department of ag it does not cost these farmers and these meals and these producers anything that was testified in committee we have represented painters word and it says it doesn't cost them anything and we're not expanding government which is another myth that's out there they're not gonna hire another person and I will do anything so just remember we look in these bills it doesn't say that is gonna be housing farm bureau and her bill it says they can contract with a private

What we do in Arkansas has an impact across all the other agricultural states as members of the legislature we have an opportunity to express our thanks to the people that are producing these products for us. What's mentioned is are left out often times is we didn't always have an act department and when the previous bill under which we
now operate all those promotion boards were operated out of farm bureau with out to the overs without an ag department even in existence so that's a new thing. As has been said. Both in committees two times we met yesterday both bills satisfy any constitutional issue there was in the selection of the actual board members in fact the governor appoints the members of
all the boards in both bills subject to confirmation by the Senate so the governor has the most power still to select those people. All the monies that are collected from the Czech Office will be housed in the Arkansas treasury they are not housed outside of this capital or the Department of acting those will all be overseen by the department of ag only contracted
out to those who know the services. I gave you an example yesterday but I wanted to thank for people that came and testified in our committees Derek Helms president of the soybean association he's a soybean farmer a dairy farmer and peaches now you really have to a minor a guy who does that. That's very diverse Joe Christiansen president skews me chairman of the rice research and promotion boards from
Craighead County Tommy young from Jackson County is the chairman of the corn and grain sorghum corn wheat board and Jennifer cook a first generation Faulkner County beef council who represents twenty three thousand beef up producers. All of those testified they would like if we read both bills. Both have much the structure the same what it does is allows those promotion boards the
president's and chairman's who we heard from yesterday testimony in committee for and against both bills for. H. B. eighteen forty three against SP five oh six not the governor not against the governor the act. Secretary whatsoever they bought it for them. They want to be in charge of an example was given if an ornamental corn. Should be research for studying.
And this promotion board says that sounds like a really good idea let's Research ornamental corn. With the producers of corn for field corn that are paying the check off want to be able to say that would be a really cool project to research but we don't want our checkoff money to go for ornamental corn research that's the kind of decision making at the level we're talking about and I will just close with the example I gave
yesterday on my way to my son's wedding. I was looking at a mom a cow and a calf. I was looking at whether I was going to lose a kaffir not and that calf did not make a world of difference to me on the way to my son's wedding. My husband looked at that and saw a cow. Not going to lose two hundred dollar cap we're gonna lose a two thousand dollar cow but not only that I'm going to lose the income for the future from that
two thousand dollar investment in that pile who's going to keep producing the milk every single day for me. Now which do you want making the decisions me over here who's thinking well that's just a that's just a minor loss or the farmer who actually knows the investment and the costs they're making not only real time but for the future that's the difference I'm just saying I'm for the farmer I would really
love to be able to give them the structure they would like to continue the promotion and research for their check off money and with that I'll take any questions represent Vaught for what purpose a question you're recognized thank you Mr Speaker I'm miss hop a representative hawk in committee I just want you to remind me because I think I remember did as secretary ward say that farmers would still be on these boards that that's what they intended to do is just an ID farmers governor governor

Is in an executive branch bill or did this come from the grass roots farmers. So that would be the difference in my opinion thank you. The governor supports this bill Secretary ward supports this bill we've been working on this bill with the act boards from producers since February.
This is not changing anybody's livelihoods. This is not touching our producers money. This is just making sure we obey our own constitution. And not giving one entity a power. The Secretary of said that the boards will have full and an enemy on what they do. And if people get recommended.
The Secretary gave his word to make recommend help write those recommendations to the governor. Again this came from the producers we work with them. representative Michael Landon them meant to amend the regional airport at and create a procedure for annexation and attachment. During this bill I sat I sought
out the input from the prior mayor the current mayor as well as past and current members of the board. It has not been an easy issue to resolve. The purpose of this bill is to amend the regional airport Act. Regional airports are created under the regional airport Act they're owned and operated by the regional airport authority and they're governed by a board of directors there are three regional airports here in Arkansas. The stub city and acts are laid out specifically and require good faith negotiations as well as required special factors and considerations to be addressed. I Northwest Arkansas five cities and two counties came together
and contracted to create a regional airport they agreed to place the airport in an income unincorporated area of Benton County they did this to avoid any territorial disputes among the cities. The groundbreaking was in nineteen ninety five two years later the city of papal account of a hundred sixty five people so the special election to annex the land the airport site on. The seven governing cities and counties had no input in this annexation. At the next legislative session
the airport began their attempts to de annex so this is not a new issue. Again this bill will create a process for regional airport authority to annex to R. It is a complex and thorough process if the annexation that goes through multiple letters of intent mediation and even if necessary a court judgment. If the airport successfully detaches the city would at
minimum continue to receive bond payments until all debts financial obligations are fulfilled this process in this specific case could take between eight and fourteen years. This at this time however we continue to receive payments and give them plenty of time for growth and development. The desire of this bill is to be fair to the five cities in the entirety of the two counties involved who created this authority. Northwest Arkansas airport is the only regional airport
there's been an explain non member authority it is a very unusual situation. When the Northwest Arkansas airport was envisioned. It was to be in a non incorporated part of the county so that no one would own it this regional airport Act and it's amendments are designed to allow any Arkansas regional airport to operate. With good faith and this city resides in the area and which I have lived for forty three year. This is. Filed with the county Clerk on January eleventh nineteen ninety five.
Recorded on February twenty seventh of nineteen ninety five. Ninety five percent of the land on which XNA recites today was voluntarily annexed before any airport land was bought later that year this is correct County wreck. It doesn't help to not say the truth. Voluntarily ninety five percent of the land was annexed by
voluntary land owners into Highfill city limits before the airport bot. Six hundred and twenty one acres on April twenty fourth nineteen ninety five. Ninety five percent of the land. Annexed into the city Highfill voluntarily by landowners. Leding purchased by the airport six hundred twenty one acres from one landowner in April of
nineteen ninety five. The airport did not set up at the airport. And by land and then the city decided to annex all around the airport as is repeated over and over again. In nineteen ninety seven the other remaining five percent of the land went to an election to which is often referred to as the hundred and sixty nine people that were registered voters in the city of Highfill
that went to vote and D. and annex. Their land into the city of Highfill. Hundred and sixty nine registered voters in Highfill. In nineteen ninety seven over thirty five hundred residents there today. Of those hundred and sixty nine registered voters fifty four percent fifty four voters or thirty two percent. Voted in a special election. To annex into Highfill of those
fifty four who voted forty said they wanted to annex into Highfill fourteen of the fifty four said they did not want to de annex so seventy four percent of those who voted in a special election of which thirty two percent of the total voters could vote voted to annex into the city of Highfill I speak for them today because they have had very little voice in this argument.
I want a healthy safe affordable fan tastic low cost fare airport nine miles from where I live that's where this airport is. What this bill does and it has been amended a number of times. But was not brought back to the Senate committee after this amendment was signed out of committee without the city being able to look at the senators who heard the first bill with annexation or taxation.
Commission as part of it and be able to answer questions for them I would just like to say. As has been said five major cities. Two major counties. Those five mayors to county judges have all said they are neutral on this bill they are not going to take sides. However the surrounding small town mayors of sanitation hi Phil of course the city that is
in question here the cities of gentry Allen springs Cave Springs and sanitation are all against this bill and here is why and I will close. This bill leaves on answered questions. If the airport D. annexes from the city. S. the airport doesn't pay sales taxes the business is where you buy a sandwich and a and a hamburger or park those are the sales taxes that every city
collects we know that cities live on sales taxes any business within the city limits collects the sales tax send it to the state it comes back to the city if the airport under the new bill without all these questions being answered before we pass a new airport bill before we have a fiscal impact done. What a city we are talking about killing a city.
I kid you not. Taking their sales tax away if the regional airports. Detaches under this new law. Does the sales tax in that airport go to the airport. No because the airport doesn't isn't authorized to collect taxes does it go to the city now that the airport doesn't reside in the city limits it's its own
property in the middle of a city. Who collects that sales tax that question is not answered in this new bill. And I would just ask. The airport has. Right. Twenty four million dollars last year eleven million dollars to amortization and depreciation not expenses. For the city of Highfield six hundred thousand dollars of
sales tax out of one million dollars in sales tax this town has a dollar general and a gas station at an airport. All the sales tax collected at that airport that comes back to the city now goes to water and sewer. And lights and police and fire. What happens to those sales taxes is unknown under the current law I'm merely asking because I want a thriving
airport and I want a thriving city. Growing city that needs sales tax like every single one of your cities. Depend on. Let's not pass a bill that does not answer those questions and up turn a bill a lot from nineteen ninety nine. That says. The property and operations of an authority and airport
authority shall be exempt from any an act of any rules regulations or ordinances permit requirements and enforcement by the municipality. That's what the unit is a polity is giving up. They don't can't tell the airport any rules they can't give any regulations to the airport they can't put any ordinances on the airport they can't put any permit requirements for enforcement on the municipality and here's why. Here's the other side of that.
Municipality may an act and collect a sales tax a liquor tax a hotel motel and restaurant tax on the operations located on the property of the authority but other taxes or fees enacted by the city pertaining to the property or operations of the authority. Require the approval of a majority vote of the board of directors of the authority. The authority now has.
They had an active sales tax on top of sales tax if they want to they can act all number of fees that they want to what they can't do is an act a sales tax because only cities counties and the state can do a sales tax what they're asking to do is D. annex from the city. And not pay the sales tax after even who knows if this lady annex can they collect the sales tax and pay the bonds for the
eight to fourteen years that representative back landed referred to will they be able to collect that money and pay those bonds if that's unclear and this is amended very rushed new bill. That was read done since last Thursday and I would just ask at this time to vote no save a city given two more years to work out an agreement. And not pass the General Assembly to comment before a court decides who's right in
this case and settle this for them we're not we don't need to do that you don't need the State General Assembly to come into your city and decide between you at a regional airport that needs to be between them and with that I'd ask for a no vote. Not one of them said on this board not everyone of them have ever put a red cent in the building or maintaining this
airport so I'm glad to have opinions and if at some point they'd like to approach the authority about being part of it I'm sure people are all yours if they can go ahead and help us pay for it help us maintain it help us market it help us grow it help us bring in those low airfare airfare airlines we'd be all for it. But for today what we're asking is a process to make an orderly transition back to what we thought we had in the first place thank you and I appreciate

Well it's been an interesting day that's for sure and I'm sorry this is a long discussion but I'm glad that we're able to have such a thorough discussion on this I am most of you know me and you know that I am slow to say anything against someone I will tell you however I don't appreciate someone saying that I'm not telling the truth and so I am telling you the truth the truth is there is an annexation in nineteen ninety seven for seven thousand acres if that annexation have been completed in nineteen ninety
five we would have annexed a second time. So we did and cable and X. seven thousand acres in nineteen ninety seven. Washington County judge Hector deacons should have sent most of you a text telling you that he was for this bill so the county judges for this bill happening. The airport to get our Highfill levies a two percent sales tax at the airport all the vendors the parking they received two percent of that sales tax none
of that money is spent back on the airport the it's not spent to improve the roads is not spent improving airport it is not spent on police or fire. Hyphal has their own police and fire the airport has their own police and fire and they take care of their own roads this amounts to about six hundred thousand dollars that goes to high full every year this money is not goes to pay off the bonds that I pay full has taken out. If this goes through those bonds
will be completely paid off so if the money's going to pay the bonds in the airport pays the money into the bonds are paid off hi so should come out the same place they started so that should be a wash the goal is not to hurt Highfill in any way hi Phil is a lovely city it is a growing city it continues to grow and all the surrounding cities like Cave Springs and Centerton or also continue to grow because that's what the airport will bring his growth all the airport wants to do is to be able to manage the managed by.
It's authority which consists of five cities in two counties in to be non incorporated. Again I know this is a difficult situation there's a lot of information that is calm I appreciate you all sitting patiently in hearing all sides of the story I just want to summarize by saying when the airport was envisions it was envisioned to be and not incorporated part of it in county so that no city would own it and there would be no territorial disputes.
This bill gives an opportunity for the airport I feel to come to an agreement of either staying together or detaching they can make that decision themselves this just lays the groundwork to allow the airport authority to operate as it was designed and intended and with that I ask for a good vote.
