sure if all of you know, but Representative Leiterman's mother-in-law had a stroke, and so he's there with his wife, taking care of her. So I agreed to Jack that I would run this bill today for him. So y'all please keep their family in your prayers. HB 1955 is an important bill to keep Arkansas competitive for jobs and fair to employees and employers both. Current case law has nullified the current statute that allowed employers to have a claim. This bill will not change the employer's obligation to provide coverage regardless of who's at fault. It only applies when a third party is found at fault. This bill will ensure workers' comp provides an opportunity to have a claim for losses incurred for the workers' comp provider, such as lost wages and hospital bills. So to bring it down to terms where you and I can understand it, those of us who aren't lawyers or involved in that on a daily basis, if I had an employee that's delivering products to a store, and while he's there, the guy on the forklift runs over his foot, And that's my employee whose foot got run over, but it was not my employee who ran over his foot. It's someone else's employee that ran over his foot. So there's a third party involved. So with workers' comp, as an employer under workers' comp, I'm obligated to pay that employee all of his hospital costs, whatever comes, his lost wages while he's off from work. And then when they go through the lawsuit, there's a third party involved, the person, the other employer that ran over his foot. So there's a third party involved. So when the settlement comes, automatically the lawyer and the court cost comes off the top of the settlement. We all know that's what happens here in the state. And what's remaining, now what we're trying to do is that the person who's the employer that had the workers' comp case can make a claim to get the money back that they put out in the hospital bills, the doctor's visits, and the lost wages while they were gone. It's really simply where it's at there. So let's see what else Jack wanted me to say here. So when we get done with this, you know, workers' comp is important in Arkansas. One of the things that we can attract businesses here is that we have a great workers' comp rate, and we don't want that to be lost. There's not everything we can offer to big businesses coming here, but workers' comp low rates is one thing that we can offer. So some other folks have asked why we're doing this, because we have good workers' comp rates. It's simply that we want to be sure that we can continue that in the future. In 2016, we passed legislation to close the death and permanent total disability fund, and because that's ending, it's going to incur more liability onto those folks that have workers' comp and those folks that are self-insured. recognized to speak against the bill. Colleagues, I'm against this bill as I've ever been against anything in my life. It's immoral. Representative Bentley, as she said, she's not a lawyer, and so there's some things that escaped her. She keeps workers' compensation on her employees because it's the law. You don't have any choice. It's not something you can do. You can be a self-insurer if you like, like Walmart or Tyson, somebody like that can do that, but it's a required law. Little history. 1993, there was something called the Grand Bargain, and there was fighting between the working population and the employers, and they passed some laws in 1993 that amended our Workers' Compensation Act, and it said absolutely a worker could not sue that worker's employee, and I'm going to just use the him instead of the female, the gender, he could not sue his employer no matter what if workers' compensation covered that employee. Absolutely barred from suit. Now, if you don't keep your people covered under workers' compensation, you can sue, and I've seen that happen a couple of times, and some of us have. Well, here's the way it works. When you get hurt on the job, the worker's compensation carrier pays for your injuries. And if it's the cause of the injury is a third party, other than the employer or the employer's other employees, like getting hurt by a fellow worker. Somebody brings a suit. Let's just use an easy example. You're driving a delivery truck, and another truck from another business pulls out in front of you, causes the accident, and you get hurt severely. You will be paid workers' comp, about two-thirds of your weekly wages. It's not 100 percent, but about two-thirds of your weekly wages, up to a maximum, I think, of 450 weeks worth, and that's with a severe catastrophic type injury. You may then sue that company or that driver that pulled out in front of you for your damages because you haven't been fully and wholly compensated by your carrier. You've only gotten two-thirds of your money. They will pay for your medical bills, your workers' compensation carrier, and you can recover those. Now, here's what this bill doesn't let you understand. The way the current law works, when you go to court and you get a verdict in your favor for your medical bills and your lost wages and your lost future wages and your future medical bills and your pain and suffering and in a few instances, such as a drunk driver or something, maybe even punitive damages, then you don't get to take that money home. You go back in front of the Workers' Compensation Commission and the Workers' Compensation judge hands out the money to the parties as they are entitled. First of all, the lawyers do get paid. They've worked, they've invested the money, they've recovered the judgment. Number two, under current law, the employee is made whole. Whole. Remember, only got two-thirds of their wages, so that other third is paid to them first. Future wages have not been paid by anybody. They get paid their future wages. Future medical care that's going to have to come out of that employee's pocket, they get paid for that. What am I forgetting? Those are the out-of-pocket actual damages that that employee is reimbursed from that settlement. Then the judge says, okay, we've got this much money left, Mr. Workers' Compensation Insurance Company, let's pay you. How much are you out? Well, we're out two-thirds of their wages, we're out these medical bills. And then they take that money and they pay the workers' compensation carrier. and they get their money back to the extent of the money that's available. Now, why would money not be available to pay all of that? Well, maybe the person that committed the tort against you run over you, so to speak. Maybe they didn't have enough insurance. Maybe they weren't insured at all. Maybe the truck you were driving had some bad brakes on it. And the judge or the jury says, well, yeah, he pulled out in front of you, but if you'd had good brakes on your truck, you could have got stopped, so we're going to apportion 60% of the fault to that guy and 40% to your employer, so all you get is 60% of your actual damages. That's apportionment of fault. That exists in the law today. So there might not be enough money to pay everybody everything they're out as the result of this. This turns the law on its head. This says that the employer, by the words of the act, says that the employer and the employer's insurance company has an absolute first lien. That's the quote. They get their money first, and the poor employee, who's out at least one-third of their wages they've lost, Out future medical expense, walks away with less or nothing if there's not enough money to take care of that. This is to benefit the insurance companies. It doesn't do anything else. We have the third lowest insurance rates on workers' comp in the country. It has nothing to do with making us more competitive. We are, the two states that have lower rates than we do are Indiana and North Dakota. So, this doesn't have anything to do with the lawyers. Lawyers get paid first. This has to do everything with the person that gets hurt. Now, remember, years ago, 1993, and really before that, we all agreed as a state that we would pay reduced benefits absolutely for sure to the injured worker, but the injured worker had to give up their right to sue the employer for the negligence or the negligence of a co-worker. And we say, we're not going to give you everything, but we're going to give you enough to survive and we're going to pay your medical bills. I am not a workman's comp lawyer, and I would not practice workman's comp law in part because It is not, as it is situated, that beneficial to employees or to those who practice before it, before the commission. As Representative House pointed out, this is compromise legislation. Now in a case of an on-the-job injury, Workman's Comp doesn't pay everything, but what Workman's comp does is it requires that you use a company doctor in the event that you're hurt on the job and then you go back to work as quickly as possible notwithstanding any pain and discomfort that you may have. What one does when there's a third party case is one sues in the event that person has injury. We've had real gross injuries before to come to our knowledge as people in this state. Some of them involve tractor collisions where people have permanent loss and do not die. For them, it may be better to die than to live for a long time, but the cost of care is long term for a person who's a quadriplegic, for instance, or the concern of that person who is a long-term injured person who has children, their needs are going to be long-term, but the workman's comp situation does not address their needs. All of you have family members who are likely or could be affected by those circumstances. Now, workman's comp pays some of the bills and it pays some of the money. It says two-thirds, well, we regulate that and we have limitations on what the competents are required to do. But nothing actually compensates people for their losses in lawsuit situations, in settlements. I mean, a settlement is by definition a situation where the wrongdoer and the injured party reach some agreement which neither of them is pleased with, but it does not necessarily provide the windfall that some of us think occurs. People who are seriously hurt are the ones who are affected by this. The Workman's Comp Commission rarely gets involved in these kinds of cases. Now, what is it we're trying to do? We're trying to protect the insurance company. And the insurance company has not, to my knowledge, demonstrated that it needs it. the rates that have been cited by Representative House are absolutely de minimis but the needs of people in our state who get hurt are greater. Now I came here not to just echo what he said but I want to tell you how the federal government deals with this in terms of collection of debts. If you are injured in an automobile accident, and you are not necessarily made whole in a third-party situation or in any situation where you recover, the government, through Medicaid and Medicare, which pays out medical bills, is entitled to recover its money. So we cannot settle a case without also getting the consent of the government. By law, we must get the consent of the government before we enter into a negotiated settlement. And in those circumstances, the government takes into account in recovering its bills, sometimes which may be in the hundreds of thousands of dollars, the circumstances of the injured party. And the circumstances may result in the government seeking all of its money, some of its money, or none of its money, but it's a humane consideration taking into account the circumstances of the injured party. In this situation, we, in effect, say we don't take into account those things. Off the top, the insured insurance company, it's not the company, it's the insurance company, will get its money back in full. That's not right. And at least as we wind down, bearing in mind, we came here to do justice for our people and to act in their best interest. We do not act in their best interest when we continually say that their needs are subordinate to those who are powerful and who have greater disproportionate resources. I've seen changes in the legislature during this session. I hope that your sensitivity will allow you to address this matter in a way which will cause you to give deference to the remarks, the well-considered and well-presented remarks of Representative House, because they're on point and they speak to justice. That's what is required by our vote on this bill.

Let me just say, and I don't want to belabor the point because we've already heard speakers speak against this bill who I think have made excellent points, but this is a great bill if you're an insurance company. It's a terrible bill if you are an injured worker. just to briefly kind of explain and echo some of the points that Representative House made, if you are an injured worker currently, because we have the workers' compensation system in Arkansas, you cannot sue your employer. Your exclusive remedy, if you are injured on the job, is through the workers' compensation system, okay? So you can't sue your employer. If a third party, though, is responsible for that injury, you can bring a suit against the third party. And then what money you recover from the third party goes into the workers' compensation system, and they decide how it's divided. But the key point to keep in mind when that division is made is whether or not that injured worker, the way we look at it now, whether or not that injured worker has been made whole. If that injured worker has not been made whole, then they keep all the money that's left. If they have been made whole. Then at that point, the insurance company, which insures the employer, okay? So we have the employers, but they have workers' compensation carriers, and those are basically their insurance companies, unless they're self-insured. But if you're self-insured, you're talking about an employer that's so big that they can afford to self-insure themselves. But basically, what this bill would do would say it puts the workers' compensation carrier, the insurance company, ahead of the injured worker in line to get paid. And like Representative House said, that is just immoral. And I want to make a point that's not been made yet, which is these workers' compensation carriers, like every insurance company, take premiums, okay? You pay a monthly premium or yearly premium or however you pay it, but you pay them premiums. And like every insurance company, they insure against the risk based on what they're paid in a premium. But what they want is they want to have their cake and they want to eat it too. They want to get their premiums every month and you better pay them on time because if you don't then they're going to cancel you. And they will take every opportunity that they have to deny, delay, and defend against every claim and use every effort that they have to avoid having to pay out any money. But if you recover any money, now what they want is they want their premiums but they also want to be first in line to get all their money back, and that ought to be offensive to us, and that's why this is a terrible bill if you're an injured worker. It's a great bill if you're an insurance company, and I think most of us, the people that go in that voting booth and punch that button for you, they are real people who get injured on the job, and they need our support, and they're who we're supposed to be here for, and that's why I would urge you to vote

This is completely out of character for me on this bill because I have said I was going to be a yes vote on this bill. And I was a yes vote in committee when we let it out. I believe it had 11 votes to let it out of committee. And not to say anything to Mr. Speaker about it, but I actually feel that this bill should have gone through judiciary instead of public health as I felt that I can say that I was ill-equipped to understand this bill. And so one of the things, some of the members in the chamber have been getting text messages that this does not affect that $6,000 that goes to the widow upon death. This bill on page 3, line 2, says, well, I'll just start with line 1. The purpose and intent of this subsection is, and this is the underlying new language, provide an employer, carrier, or self-insured entity an absolute lien in any settlement with or judgment against a third-party tortfeasor. This absolutely gives the insurance company the ability to recover all their damages before our constituents get theirs. What happens if there's not enough money to even pay the insurance company back? Then our constituents get absolutely nothing. So more than anything, I wanted to come down here. I'm actually a little bit nervous right now because I wanted to come down here and say, I voted for this in committee. I've listened to testimony. I'm actually sitting back there reading through the law books trying to figure all this out. I'm all for some reform if it's needed. of epitomizes to me what this session has been like. We've got lawyers on one side saying one thing. We've got lawyers on the other side saying anything. You guys are getting texts from some lobbyists. We're getting texts from other lobbyists. and so I'm just going to give you my heart where it's at and vote where you will. But I will tell you one thing. Right now, workers in this state are only guaranteed one-third. With this bill, they're guaranteed one-half. When this bill passes, we're still the most generous state in the South when it comes to helping our employees. If you look around at Texas, I'm going to read you in Texas. Recovery rights, they get their attorney fees, and their court costs are paid first, then the employee carrier is paid next, and the remaining balance goes to the employee. And you would say, why would that be? When you look about what Representative Gasway brought the exact thing, right now an employee gets double recovery. When they go to the Workers' Comp Commission, they can get a settlement from them for their cost, and then when the settlement comes for the third party, then they can get some more money. So they can get double recovery. That more than covers for the third of their wages they lost when they were there. That's the whole purpose of it. Okay, so we've talked about Texas. In Oklahoma, recovery rights, their form of theirs is attorney fees, and the court cards are paid first. than the employee and the carrier, either receives two-thirds of the remaining recovery, this is all third party, okay, of the entire amount, which is less, or whichever is less, and the remaining balance goes to the employee. Again, this is only with third party settlements. It's not between the employee and the employer, it's when there's a third party involved. The Workers' Comp Commission, they've been brought up twice. Let's bring up again the Workers' Comp Commission. They sat down with the chairman of the self-insured, and they worked on the language of the bill, and at the end of the meeting, they said they had no oppositions to the bill. Okay, so they are neutral. I want to make sure to clarify with that. The premiums that we're talking about are paid by the employer each month. The employer pays out their premiums. Again, with tort reform, current case law has nullified the statutes that we have in the books, and that's why we're bringing this forward. That's why we've fought for tort reform, because current statute that we have in place has been nullified by case law in the state. That's what I want to bring up for sure. This bill does nothing to change funeral benefits at all. So when we throw up widows, and some folks here have even got fake emails from there. So when you start getting fake emails about a bill, and the opposition of a bill, it sure makes me start looking at it and wondering why they would throw up fake emails on this. So again, with this bill passing, we will still be the most generous state in the region when it comes to helping our employees. No one's trying to hurt their employees. The last thing on earth I want to do is help my employees. We're just trying to keep our workers' comp rates good in this state because of some things that are coming up in the future, and all we're trying to be sure they have a claim to part of it, only half. And the bill again states that the employee will get no less than half of the settlement with a third party, no less than half. So if you get no less than half, I don't see how you can say that the insurance company that's provided workers' comp is getting ahead of the employee. So with that, I'm going to do

Colleagues, last session I ran a bill that was passed out of the legislature for electric bikes, electric bicycles, and so I was approached this session if I could do something similar for electric scooters, and so I agreed to do that, and we filed a bill early in the session. There's been sort of an ongoing discussion throughout most of this session, really between industry and the municipal league. That was really the two stakeholders we tried to get to work together. And so I have another bill out on this. Representative Whitaker amended this morning, but this is really an identical bill to what we're doing there as well. But the sticking point with the Municipal League was on a local control piece of the bill, and we stripped that part out of it. So now the industry and the Municipal League cities are on a point where they're in agreement on this bill. And so what this bill does, really there's four parts to it. It defines what electric motorized scooter is and what a scooter share operator is. Scooter share operator being the companies like Lime that you all have seen here in Little Rock. Bird is another one. So it puts those definitions into law. There's another section on just a couple of safety provisions. One, that they can't be operated by anyone under the age of 16. And when you use the apps, you have to put in your driver's license. also another piece in there about this there's a limit there of 15 miles per hour again those are both just sort of safety precautions that industry supports and that really it's already done with the current scooters that programs that we have now another section on the insurance requirements and then the last section is on data sharing between the scooter companies and the cities so it kind of just sets up a basic statewide framework that industry and cities I think everyone's on board with I haven't heard any opposition to this current version just provides a little predictability and certainty statewide as these companies look to expand further outside of Little Rock and Russellville I think are the only places they're at now I want to thank Representative Whitaker he's been helpful on this bill final filing an amendment for me on the other one thanks to the Transportation Committee for helping me I think make a good bill better I think this is just a good start for these you know this new technology that we have coming into the state with these electric scooters again I think everyone's been able to work together to come to an agreed-upon bill so with that I take any questions represent Godfrey

This is the bill you heard a lot about earlier in the session about stealing all the money from the kids from their school lunches, which wasn't what that was about, but there was another bill. This is a bill that they changed around to, and Senator Clark and Senator Elliott came together to work on a great bill, and so this is a bill in the national school lunch category is actually NSL. It has nothing to do with national. It's all state money and it is money that we use to try to close the gap. And that process has been a little slow and it's not been working correctly. And since 2005, we have spent $2,686,000,000 plus on this program and it just hasn't reached the success it needs. So what they have come up with and Thanks to Senator Elliott for interjection into this. They have come up with some good language on this. But it will take a lot of the schools that aren't performing and let the Department of Ed show them some ways to help them to do this. And it will pull some of this money away from the things that they're not using, shouldn't be using NSL money for. And it has got way out of hand, and we use it for a little bit of everything. So it's going to pull some of that back and write it back. But if a school is performing at 40%, they should be all down way low. But if they start getting up where they're 40% to 50% of their kids are not performing, then it's going to actually have some interjection from the State Department, can show them some programs that will help them. If they get a little higher, then the state will actually come. Not going to take it over. Now, this is nothing about takeover, but it will have more. they'll increase that to give them more things to help them with. It will give you a chance. These are all things that need to be used for these kids from grade 3 through 10 to scoring those levels to help them. They're not getting their ACT. They're not getting up to where they need to be on their ASPIRE test. So this is all to deploy instructional strategies and resources with this money. This bill was brought by parent counsel. There's no known opposition to the bill. It creates a definition under the codes for imminent harm. Currently under Arkansas Code annotated 927303, there are 66 different definitions beginning with abandoned infant and ending with victim of human trafficking. This adds the 67th definition, and under the Child Maltreatment Act, this adds a 27th definition. It's become very difficult in court to be able to articulate that imminent harm did not exist when it's undefined, so that's the basis for adding the definition. This bill will streamline the process and make uniform the criminal background check procedures for the 17 occupations professions listed in this bill. The uniform list of disqualifying offenses that create a five-year ban to getting a license to ensure public health and safety is protected in this bill. It creates a waiver process with specific factors. A board, a commission, or agency can consider to waive the five-year ban. It also cannot consider most offenses after five years, and the applicant will have shown once they have shown they have been rehabilitated. This bill is supported by the Association of Arkansas Counties and the County Judges Association, this is part of their 2019 legislative package. This is a clean-up bill. This is an easy one. It simply corrects an error in the law that was created in 2011. Currently, if a county wishes to auction surplus property and they want to auction that property on a traditional on-the-ground auction with an auctioneer, then they publish that auction, that notice of auction in the newspaper two times over the course of two consecutive weeks. However, if a county wishes to auction the property only over the internet, then they publish that auction on the internet auction websites for eight consecutive days before the sale. This current process is the result of a bill Senator David Wyatt sponsored in 2011. That bill plainly provided the publication of sales over the internet are to be on the internet auction website for eight consecutive days before the sale. The proof of publication is retained for records and legislative audit, and the report of sales is made to the county quorum court. This is the process counties have been using since 2011, and this is the process they wish to continue to use. Recently AAC discovered that also in 2011, Representative Tim Summers carried a bill for AAC that specifically related to county treasurers. In a mistake, an error was made that included the words Internet sale as being required to be published in the newspaper. This recent discovery has created some confusion among some of our county officials and they would like to get this cleared up. bill thank you mr. speaker colleagues this is an agreed on bill between Southland gaming and racing and the Southland dog trainers right they've had a nonprofit that is continued to contribute more and more things and all this bill does it allows in the racing Commission's okay with it It allows Southland out of their purses or their payable winnings if the trainers all agree to take a certain percentage out and contribute to this nonprofit fund. What's happened over the years, they've had this mission to protect dogs and adopt dogs out, and it's grown greater and greater, and they're always having to call around and get checks. This just says the trainers agree on it, Southland agrees on it, out of their payable winnings, which is their purses, it's their own money, they still pay taxes on it, it doesn't take any state revenue out of what would go to the racing commission or state funds, that they can then put that in their dog trainers non-profit. I just want to read you some of the things that they did last year. They have an injured dog fund, so every dog that is hurt is put in the program and rehabilitated for adoption. The charities across the state, they give out $100,000 to 17 charities one night every year. They give another $250,000 to schools, Boy Scouts, CASA, and other community groups. and they spend over $100,000 a year in local adoptions of greyhounds and another $150,000 on the adoption of all dogs in programs. So this just allows them, it's an agreement that they agree to, to take a percentage of their purse money and put in this fund for these uses. Questions?

It is an act to amend the law concerning the Child Maltreatment Investigations Oversight Committee and for other purposes. SB 537 modifies the Legislative Child Maltreatment Oversight Committee to provide for additional members in order to make the committee more workable. This is a legislative committee that reviews files from the child maltreatment system so that we can make needed changes to improve the state child welfare system. This is the only legislative committee that has closed meetings and they are closed to protect the privacy of children and families and it allows discussion in conjunction with review of cases so we can be more informed and better work together to improve our child welfare system. This bill as amended clarifies who serves on that committee. Someone from the governor staff has been added so that someone is there to report back to the governor. It had originally expanded the scope of the committee to also review dependency neglect cases as well as maltreatment cases but the bill was amended to satisfy the judge's concerns it also allows for reporting of information to state and government officials as may be needed to carry out child protection but ensures that no confidential information the committee receives shall may be public or shall be used in any manner outside the role of the committee to review maltreatment cases in the system so the bill makes minor changes to membership of this committee to ensure that it works as best it can to improve our child welfare system, and I'd entertain any questions.
