Jean. Thank you, Mr. Speaker. Let's pray. Our gracious God and Father of all those who treasure your Son, the Creator of the heavens and the earth, the giver of all good gifts, you tell us that your mercies are new every day.
And so today we seek your mercy as this body strives to provide governance for the people of this great state. We pray that you'd give each representative the courage to make decisions that honor you and are for the good and the joy of the people of Arkansas, that you would give them the ability to listen and to speak clearly and boldly, that you would grant them the compassion and the conviction of truth. Forgive us, Lord, where we have failed to defend the cause of the weak and vulnerable and those that are relegated to the margins of society. Father, I pray for the ending
of the desire for abortion, the ending of children without any home, and that we would understand our greatest needs for justice, equality, and forgiveness and peace are settled only through the precious blood-stained cross in the empty tomb of Jesus Christ of which we gain access through faith in him. I pray that these men and women will be leaders in the cause of liberty, in personally serving you, the king, in doing the work you have assigned them to do with diligence, in leading their families with integrity, and in fighting the enemy that stirs up pride and greed and
self-righteousness. Father, I pray that you would remind each lady and gentleman here today that they have no authority except that which has been given to them by you, and that you would remind them that they are accountable, not ultimately to the people, but to you. I thank you for the kindness in allowing us to live in this time, in this state, underneath this leadership before me today. May they act with the courage of Daniel in the face of political pressure, the faith of
David in the face of tyranny, the zeal of Job in breaking the fangs of the unrighteous, and the wisdom of Solomon, all for the glory and fame of your son. And it's in his name that we pray. Amen.

He said his Benton Panthers had fallen to my Greenwood football team, who's here today, and the gallery. And he said, you know, you need to get a resolution together to recognize your state champions.
That's something that we do down here in the house. And so being the new guy that I was, took a little while to get my paperwork together. I had to talk to the coach. And by the time I got things ready, well, the wrestling team was going to the state championship. And the boys' wrestling team had won dual state. And I said, well, let's just bring the wrestling team down, too. And he said, well, hold on. Next week is individual state. And then we've got the girls' wrestling team state. And, well, by the time we gathered all our state champions, we decided to just put them all in one bus together and bring them down here in one load. So we have with us members of the Greenwood football team, wrestling team, and also golf.
Evan Griffin was the overall golf champion. So I'd like to recognize him in the gallery. Additionally, we have two coaches here today with us. One is Coach Rick Jones. he's the football coach. Coach Jones had a very successful career. He had his 300th win this year as a high school football coach. So to do the math on that, if you follow football, that's 10 wins a year for 30 years. That's quite an accomplishment. And that's pretty good, but we also have Coach Ronnie Williams with us here today. Coach Ronnie Williams is our junior high basketball coach. He's also our golf coach. Coach Ronnie Williams had his 1,000th win this year. So again, to put that
in perspective if you're a basketball coach a thousand wins that's 20 wins a year for 40 years so those are quite quite an accomplishment i want

So this is a great day for me and a very exciting day. I would like to draw your attention to this story that's occurred in my district. So how I found out about it, I was sitting in my Frederica, my apartment where I live.
I was watching the statewide news and I saw this awesome story. And then as I was watching it, I was like, wow, that happened in my district. So I was like, I have to do something about this. And I'm sure a lot of you saw it. It also got attention on Good Morning America. So it's really an awesome thing. But for those of you who didn't, Tanner Wilson and Brandon Qualls are high school students at Caddo Hills High School, and of course in Arkansas. Due to a disability, Brandon uses a wheelchair, and Tanner noticed how tired he became having to manually wheel himself all over the campus.
So Tanner decided to do something about it. And Tanner went and got a part-time job. he saved his own money for three years to purchase his best friend an automatic wheelchair. When this story gained national attention, people started asking Tanner, why did you do this for your friend? And he just said, because he is my friend and I really want to do him a favor. I just want to commend him and thank him and thank them. They're all seated over my right shoulder, by the way, up in the VIP section. I just want to thank them for being a good example, frankly, for me and for all of us.

the animal abuse law was signed. The law is still in effect today. At the time, we did not know how effective the law would be.
So the purpose of 1778 is amending what we think is the inefficiency of the Act 33. So what does the law say? The owner has to supply an animal in his or her custody with a sufficient quantity of wholesome food and water. an animal in his or her custody with adequate shelter that is consistent with the breed,
species, and type of animal. The law tries to protect our children. The beating of a dog in front of a child is an everlasting nightmare that remains with them throughout their life. Knowing or having reason to know that a child is present and may see or hear an act of aggravated cruelty to a dog or a cat will receive an enhanced penalty for the offense committed in the presence of a child. There is a financial cost to our citizens. Over
five million dollars are spent just providing shelter to abuse, stray, and abandoned cats and dogs in Pulaski County alone. That is over five million dollars in just one county. Do you want to know why Arkansas has a black eye when it comes to animal abuse? Here's just a couple examples. Joyce Johnson from Madison County faced 29 felony counts, 266 misdemeanor counts of cruelty to animals. She was
order to pay $500 fine. Of the 295 charges, 293 charges were dismissed. Now this article made national headline. 56 dogs found, shot, and killed in Arkansas. The Searcy County Sheriff said two people from a lumber mill came across the dead dogs in a remote forest area. The sheriff thinks someone brought the dogs to the woods, fed them a poison-type hot dog, and then shot them.
He said, systematically, just start shooting and just leaving them lying, not even making sure that they were dead. I just want, I just can't imagine somebody doing that, said the sheriff, Joey Pruitt. Investigators have recovered evidence, but has not named any suspect. but the sheriff's office has told local that they do believe that the perpetrator is not stealing people's pets.
But that was a possibility. Let's make the crime more personal. What if it was your pet? Today, social media has brought more attention to animal abuse. For instance, the story about little Boo, who was savagely beaten with a spade so badly his legs were almost severed and abandoned next to a railroad track. Rue lost his front legs and lives with only two of his back legs.

this is what I'd like to share. Out of 913 total animal cruelty charges over the period of 2011 to 2018, 148 were felonies and 765 were misdemeanors. Of the 148 aggravated animal cruelty, which includes animal fighting,
only 67 resulted in conviction. Only 17 people served any jail time, three for just a single day. Where we saw significant jail time, the defendant was also concurrently convicted of one or more felony crimes against people. Of the 765 misdemeanor charges filed, only 191 resulted in conviction. Of those convictions, only 18 people served any jail time, usually in conjunction with the other charges, such as drug or assault charges.
72 convicted resulted in fines, mostly $150. 14 had sentences suspended, and the rest were given probation or community service. According to the FBI, animal abuse is highly correlated with impersonal human-to-human violence. Serial killers often torture or kill small animals from an early age. And men who commit child abuse or domestic violence very frequently harms household pets as well.
You remember these names? Ted Bundy, David Berkowitz, also known as the son of Sam, Jeffrey Dahmer, all engaged in animal cruelty early in their life. Cynthia Hodges from Michigan State University College of Law writes, Cruelly to animals and violence toward people have something in common. Until recently, however, violence towards animals have not been considered to be related to violence towards children and the elderly and other forms of domestic violence.
A correlation has now been established between animal abuse, family violence, and other forms of community violence. A growing body of research indicates that people who commit acts of cruelty toward animals rarely stop there. These people need evaluation. In this Bill 1778, this will be provided based on the court's opinion. Someone asked if some organization put me up to running this bill.
The answer is unequivocally no. I have been working on this issue for five years publicly. I'm running HB 1778 for Arkansans throughout the state because we love our pets and we want them to be treated in a humane way. It is wrong. Over the past six days, we have reached over 52,000 positive responses to HB 1778 on social media.

Okay, so in telling you what the changes are, this is basically what the change, and thank you Representative Love, because we talk about the first offense. Now remember this, nothing changes unless it's a dog or a cat. So Act 33 is still intact,
but if the abuse goes to a dog or cat, we've changed it a little bit. Basically what it does is the fine was $150 to $1,000 on the first offense. Remember this is the discretion of the court, not this bill, but the discretion of the court. What we've said to try to send a message, we need to raise that, it's a misdemeanor, and we need to raise that up to $2,500. The jail time or whatever the court would do has not changed.
The only thing would be is the court does have the option to raise the fine. As Representative Fike had done when we looked at children driving into a school zone, we raised them because we think that's a deterrent. The second offense, which was $400 and up to $1,000, has been changed if it's a dog or cat. And what it does is it still stays at $400, but it lifts the top number up to $2,500.
The third offense becomes a Class D felony. That was changed because that was what used to be the fourth offense, and we felt like by the third time someone would know that they're committing a bad crime. Anyway, so that is basically what is being proposed here.
I think the most important thing of this is having the court be able to do a psychological evaluation so that if we have a troubled person, that we can catch it early. With that, I'll be open for any questions. Representative Blake, for what purpose? Question? You're recognized. He left, I'm

Thank you, colleagues. Here just last week, I questioned Representative Cervillo about this bill, and he said, what are you worried about? This bill does nothing. It doesn't do a thing. Well, if you're talking about enforcement of cruelty, he's absolutely right. It doesn't do anything. As a matter of fact, it's probably hurtful because the fines, one of the things that he didn't talk about was the increased fines, increased penalties, you know, serving in
jail for a day to a year, those things. When you put that onto a judge, or even law enforcement, and they're looking at somebody out here that they may know, may not know, that's made a mistake, or is actually being cruel, they could possibly be less reluctant, they could actually be reluctant to enforce those rules because of the severity of what's going to happen to them. I mean, it's happened with, you know, fining people that throw their trash out and that
type of stuff. State police were less reluctant to write those tickets because it was so severe. As far as Representative Love, your situation with your dog chained up, there's nothing in this bill that says you're exempt. It all comes down to what somebody decides and the allegation that is made, whether you're going to pay a $1,000 fine or a $2,500 fine or whatever it might be, because it's not in there. See, that's the thing, is that Representative Savillo come down here and he spent a lot
of time telling you what he thinks, but nothing about what he knows, because apparently he doesn't realize that this bill is actually working. Over 450 people have been prosecuted. People have been fined. People have gone to jail. Now, maybe not to the severity that he wants, because these particular fines and severity and the law and stuff is actually worse than what you would get if you got convicted of a DUI.
Endangering other people, apparently, is not as severe in his eyes. But let's go back to the whole thing on this thing. We talked about this bill was signed into law in 2009. Well, in 2008, I helped work on this bill. I sat down with Farm Bureau. I sat down with people from the Capitol. and we spent months ironing this particular piece of legislation that he is trying to change, this effective law, a law that works. We spent months working this out to get it where it could pass out of this chamber.
It passed, got signed into law. In 2010, then Attorney General Dustin McDaniels in Washington, D.C., was given an award by none other than the Humane Society of the United States saying that Arkansas's legislation, the bill that he's trying to alter, is model legislation, the best that they've ever seen. but apparently it's not good enough because here again we come in and we start opening this up and
chipping away at it get an increase of a fine let's make little things more serious as far as what you can be caught doing or whatever what's going to happen to the hunting dogs let's face it if you've been out in in the country and you've seen people with their hunting dogs that they run, that dog looks like it's starving to death when they take it out of the kennel. You know, you take a fat hunting dog out there and take it and turn it loose and it starts running, it's going to have a heart attack and die on you somewhere.
Two or three days later, because it hasn't been picked up, because they haven't found it, it truly looks like it's just near death. Are we going to take all those hunters that have the tradition of hunting with dogs, and I don't hunt with dogs, but are we going to take them and then put it, basically, I, as somebody that sees one of these dogs and reads the collar and go, they've abandoned this dog. Let's put them in front of a judge.
Let's go ahead and roll the dice and see how it works out for them. The severity of this particular punishment that they are putting, that he is changing, is too much. As he said, everything he talked about initially, you know, appropriate food, water, shelter, all those things are already in the bill right now. He didn't really talk about what's actually changed. He skipped over that. And that's the severity of the punishment.
Now, nobody wants to see a dog abused or a cat abused. It's terrible. But here in Little Rock, the animals that you have and the cost that it comes to the citizens, this bill will not do one thing to stop that. The only thing that will stop it is people, your law enforcement, enforcing the laws that are on the books. It's just like so many other things, you just keep raising up the punishment because that's the easy thing to do.
The enforcement is the tough thing. And frankly, we don't need a statewide change in a law that is effective and is working to address a local problem. With that, I would appreciate a no vote on this. It's a good bill, it's a good law, it has worked and it is working. Unfortunately, there's always bad people who do bad things and we want to make sure law enforcement addresses those people and deals with those folks and they've got the
tools to do it right now with the existing law. I would appreciate a

Speaker. The way that the law currently stands right now, we have 106 cities of the first class. And if that city does not partake in APERS, the retirement program, that city is mandated by a state law that when that mayor retires in certain areas of retirement,
that they are given 50% of their salary that they have received as mayor. they have not put anything into the system, not a penny. The city has not set aside any money of this for future retirement, any amount for future retirement. They are retiring and getting 50% of their salary. Our auditors came to me and said, not only are they getting 50% of their salary,
they're getting 50% of the current mayor's salary. So if they are not the current mayor when they're retiring, let's just say they were mayor 10 years before and they were making $50,000 a year and the current mayor is making $100,000 a year, they're now going to retire at that $100,000 a year salary. Then on top of that, the other thing that we're trying to address is that this is a
state mandate. And I'd like to give that control of what the retirement is for each city back to the city to allow the city to decide what's best. Because what's best for a city of 10,000 people is far different than what might work for a city of 100,000 people or 250,000 people. So what this bill does, worked with the Municipal League. They are in full support of this bill. This was their amendment to help the cities figure out how to handle this.
It would allow an actuarial study to be done by the city that would give them the opportunity to decide what should their mayoral benefit be instead of the state saying this is what it is. Representative Blake,

Colleagues, I present to you today House Bill 1928, which very simply makes our government more transparent by requiring audio recording of all public meetings, and I'll say to you that in the time, since the time that I filed the bill, oh, and storage of those recordings for one year. So in the time that, between the time that I filed the bill and now, I've made several
amendments to it in response to representatives of our local governments. The first one was to exempt volunteer fire departments. The second was to extend the implementation date for second-class cities and incorporated towns for another year. So that implementation would start July 1, 2020. To add an enumerated statement, which already applied, but add an enumerated statement to exempt executive session.
So when boards and commissions may go into executive session, this would not apply. And then just to specifically define what this would entail, so as not to require audio taping if two or more of us go to a ball game. It would very specifically state that this applies to scheduled, official scheduled meetings. special meetings and called meetings colleagues I would also point out one
thing to you that over the last I would say five years especially but even ten years since you've seen the commonality of your larger agencies recording or video recording meetings are digital technology and internet technology social media technology has become a whole lot more sophisticated. And so this is something that is low cost or in many cases, no cost.
And I believe that because we are balancing between the advances in technology with the need to be more as transparent as we can be to our people and allow citizens to become more involved in and aware of what's happening with government that there was very strong bipartisan support for this bill. I don't know if you could find another bill, maybe one or two, filed this session that
would include Vivian Flowers, Nicole Clowney, Marsh Davis, Representatives De La Rosa, Dotson, Glover, Godfrey, Gonzales, Hodges, Love, Lowry, Payton, Scott, Cervillo, Walker, Warren, and Womack. recently I had a friend that had been in the hospital for a couple of months they got out a couple of days later somebody had she got I got a call at six o'clock in the morning somebody had stolen a car rear-ended her car that was parked on the street and totaled it she had bought the car a couple of years ago for six thousand dollars and in the meantime the value of the car had fallen below four thousand dollars so i arranged for her to go get a get a little loan
a little car at the used car lot and when she went to get her tags she found that the taxes were more than i told her they would be because i assumed that when her car was totaled she was going to be like everybody else when you get when you trade a car in you take the the the trade-in value off of the sale of your the cost of your vehicle and you're taxed on the net cost if you don't do a trade-in and you sell your current car within 45 days of buying a new car then you can
write you can get a refund on that portion of the used car that you sold there's a provision in the law. Of course, I knew that she was wrong when she told me that you didn't get to write that off. And so I called the Department of Finance and they said, no, that's the law. And so I knew they misunderstood that on a local level. So I called Little Rock and they said, no, that's the law. And I said,
how can that be the law? And they said, well, we don't consider the sale of
a automobile to an insurance company a sale. Why don't we do that? And it's real simple. If you if you looked at the financial
impact on the bill on the second page it says state code 2652103 says the transfer of a vehicle in an insurance to an insurance company as a result of a settlement agreement is specifically excluded from the definition of the sale and does not qualify
for the sales tax. Why? Because another provision in the code says that when your car is totaled, the insurance company, in order to make you a whole, doesn't just have to pay you for the value of your vehicle, but they have to reimburse you the sales tax. but there is no sales tax on a vehicle below four thousand dollars so if you bought a vehicle today that cost four thousand and fifty dollars and next week it was totaled and it had now become
worth thirty nine hundred dollars you would get no sales tax reimbursement for because that insurance company isn't going to make you whole just on the insurance so there's a bubble if you will. And it only affects people who buy a car above the $4,000 and while they own it and before
it's totaled falls below that $4,000 mark. Insurance is not going to make you whole because there is no sales tax on any vehicle below $4,000. So it's just a glitch. I never heard of it,
never thought about it until I had a constituent. And for somebody that's in that stage, They're in their 70s, cancer twice, heart attacks, amputations, and can't make more than $7 a month above their government aid, and they have no help. And we ding them simply because the glitch was that they are not made whole by their insurance. So the provision in this is real
simple. If the settlement for that total vehicle does not include sales tax, then DF&A will treat this like any other sale.
They will treat it as sale to an insurance company as a result of a settlement. They will treat it
just like if they had taken it as a trade-in or if they had sold it within 45 days. And with

you when you register your vehicle when you go to dfna and register the vehicle you don't do that when you sell it you do that when you purchase it yes so whoever you
sold the vehicle to if they if they bought it above the four thousand they when they go register it you gave them a bill of sale it says four thousand fifty dollars and when dfna says sees that went over four thousand dollars they're going to pay sales tax on the four thousand and fifty dollars okay yeah okay this only has to do with somebody who has is buying a new vehicle not doesn't have to be brand new but they're buying another vehicle and the sales tax and they get ready to pay their sales tax. So if you have a trade-in, let's say you buy a $30,000 car today
and you traded in a $10,000 car, you're going to pay tax on $20,000. Yes. If you buy a $30,000 car today and you didn't trade in your car, and in 45 days you sell your car you're currently driving for $10,000, you take that $10,000 bill of sale to DF&A and they're going to give you credit just as if you had done a trade-in. That's current law. You got 45 days. And if you go 46 days, you don't get that. You don't get that credit because some people don't
trade in their vehicle. They sell it themselves and they can't sell it until they've got a new one. And so this is only deals with people who buy a car that's value was above $4,000 and they paid the state sales tax and when they got an insurance claim because it was totaled the insurance claim does not include the sales tax because the insurance company is not going to pay you sales tax on something that is not due which is a sales tax on a car below four thousand dollars okay thank you i can tell by looking and i got it i couldn't believe it either
so right now if i buy a four thousand dollar car and i go get tags i'm gonna have to pay sale i don't pay sales tax on it. If I bought the car today for $4,100, I'm going to pay the sales tax on a $4,100 vehicle. If next month it is totaled and the insurance company says your $4,100 car that you bought last month is only worth $3,900 and they're going to write me a check for $3,900, that bill, that check that I get from them is not going to include sales tax because there is not
sales tax on a vehicle that's fallen below $4,000. So this hickey only happens to an owner who owns a low-end car that was purchased above $6,000 and while they own it falls below $4,000 and the insurance company hasn't made them whole. Now if the insurance company will pony up and pay you sales tax that's not due, that's great and wonderful. But this says if
you're not made whole that this will be allow this state to recognize and make you whole any other questions
clear as mud i would appreciate a good vote this is a this is a tax fairness bill and i guess i can well let me say this and maybe i won't have to come back very seldom do we get to do things that there's been unless you're in that place we just don't know you don't know what you don't know and until you're trying to help a constituent or a friend that's in a stuck in a position and you can't figure out why they're stuck and obviously it's it's a bureaucratic

House Bill 1930 by Representative Gray to authorize the Director of the Department of Finance and Administration to delegate certain debt collection authority to a third party and to declare an
emergency. Representative Gray, you're recognized to present the
bill. Thank you, Mr. Speaker. This is another bill from DF&A, one of their package bills. I'd like to thank Representative Vaught again. I don't know why I took these bills because she's been presenting every one
of them in committee for me. What this bill does is it allows the FNA to start a pilot program to attempt to collect on uncollectible debts.
They would select a vendor, and only one vendor, to do this. It would be a pilot program just for the
year of 2020 with them to report back to the legislature by March. I think it's March 1st of 2021 with how the program went and how it was successful. The bill spells out exactly how that vendor would be paid, and it would be paid a certain percentage by dollar amount scaled or tiered, I guess you would say, based on what their collections are. The bill also lists out what amounts could or what debts could be collected.
It talks about, let me see, it's on page two, because that was one of the questions I got. Bad debt would be they've issued a certificate of indebtedness or a lien. for taxes. After the time for which judicial relief has expired, the director has determined it to be uncollectible. So it's essentially just a pilot program for them, and they would like the opportunity to see if they can collect any of those uncollectible debts. So I'd be glad to take any questions.

you. Representative Gray, I kind of have a problem with this because they've got a bunch of folks over there at DFA and that we have not been told, how much is this going to cost us? Is it 25% of six million dollars? How much are they turning over? And then they're beyond good banking practices when they're going six or eight months to wait to take some action against
somebody. And, you know, two to three months is a bad debt. It's due, and we ought to be collecting it. And also, we do not know the total indebtedness from bad debts to the state of Arkansas. And I personally think it is substantial because of some of the way they pursue it. But how much is this going to cost us?
Yes, sir. So first thing is, I don't know the total indebtedness to the state of Arkansas. That
is something I would like to know as well. That's a great question that I cannot answer. And as far as what it's going to cost us, the fiscal impact essentially came back as unknown. So it won't cost us anything out
of our current budget. What it will cost us will be a percentage of what is collected. And so the tiers, as it goes through, I believe it starts with, here we go, it starts at 8%.
So for the first $250,000, the contractor would be
compensated at the amount equal to 8%. And then it goes down. So then when it goes to 7% for all monies in excess of a million, it goes to 6%, and it eventually makes it down to 2%. If they were to collect over $25 million, it goes down to 2% of what's

misleading if that were to happen I'm not saying that we might open this and And that might happen. If it did, it would be something that the Attorney General's office, I would think, would look at and investigate. You know, I use, I've used debt collectors in the past in medical practices. And we have very sensitive information. And, you know, they are required, we are required to follow HIPAA when submitting that information to the debt collector. And there are certain terms in this bill that essentially say what can and can't be sent to that debt collector in trying to collect that debt. So with that, I'd just like a good vote to allow the state to try this pilot program out for one year.

was a constituent-driven issue. bill is designed to try to protect our children. This is a bill that was brought to my attention from a mother who had found a prepaid cell phone in the possession of her 13-year-old daughter. It had been given to her. She had not purchased this for her. She was unaware that she had this phone. So she's a mother who, just like a lot of us, want our kids to have access to cell phones.
That's not a problem. There's no evil or wrong in that. But as a parent, if you're monitoring their their cell phone use, which is something I think as parents we should be doing, looking at the apps they're using, looking at when and where they're texting. She was taking up her child's phone at night so she wouldn't be texting, and she found this burner cell phone, this prepaid cell phone that she was using to interact with this gentleman, and it was bothersome to her that someone could purchase one of these phones without her knowledge and give this to her child. And so the idea behind this bill is to do what is presently not against the law.
So presently right now it's not against the law for me to purchase one of these prepaid phones and give it to your child. What this bill does is now makes that against the law. It does not include parents, grandparents, temporary guardians, custodians. We included in this bill also the language fictive kin, which I have to be honest, I had to Google. And fictive kin is not by marriage or not by blood. So we tried to be inclusive. The intent of this bill is not to prevent legitimate people from purchasing these prepaid phones for their kids.
There's nothing wrong with these prepaid phones as a modality to try to utilize cell phone technology. The simple idea of this bill is to say, you shouldn't be able to purchase a phone for my family member, my child, without my knowledge. And I'd be happy to try to answer any questions about the bill. For what

It came to me from my constituents back home in District 59 in Craighead County. And what some of my constituents said, when we passed out the half-cent sales tax, or we renewed or sent it to the folks, they asked me, well, why couldn't you come up with the money some other way rather than, you know, renewing this tax, which was supposed to end, and I understand their frustration with that, but why couldn't you find the money for that?
I know that there are three or four people in this chamber who had alternate bills that tried to do just that. I know some of them talked to me about good ideas that they had in those four bills. So I got to thinking about all that, all those emails and phone calls that I was getting, and a lot of them said the same thing. I thought, well, why couldn't we do that? Now, we all know that we needed the money for roads, and I voted for that. and I think we need that money, and we needed to get that going.
But why can't we now, through a process, look at how we can reduce the sales tax by that half cent that we just passed? Why can't we look at that? So what this bill does is it asks the Tax and Revenue Committee to look at how can we identify savings, growth in income, or efficiencies in state government
and two years from now pass a bill to reduce sales tax by a half percent. I think that's reasonable. I think we could do that if we really put our minds to it and if we have an organized process. So what this would do, the Revin Tax Committee would be charged with meeting on a regular basis, trying to identify savings, growth, or efficiencies, and keep a list of these things so that when we come back or when some of us come back in two years,
whoever's lucky enough to win their election, that they could run a bill to reduce the sales tax. I think we could do that, and this is an organized way to do it. So that's why I propose this bill. I think it's a good thing. I think it's responsive to what our people back home want us to do, and I, for one, want to try to do that, and I'd be happy to take any

Thank you, colleagues. This is what I call the big boy towing bill. This is not
the everyday wrecker trucks. This is a major effort by federal, state, local governments, and law enforcement agencies around the country to keep traffic flowing. Arkansas has, through the Traffic Incident Management Program, begun to examine key factors that contribute to unnecessary delays in traffic flow and examine methods for improving communication, safety, and quick clearance in major traffic
corridors. Faster detection of and response to highway incidents saves lives. The tow industry is an integral part of the first responder team and a key factor in determining how quickly normal traffic flow can be restored. The enhanced heavy duty license will give law enforcement a valuable tool when identifying and selecting tow companies that are properly trained and prepared to handle major traffic accidents involving heavy trucks, tractor-trailer rigs, and catastrophic incidents.
The legislation is not intended to prohibit or penalize a properly licensed tow company from towing heavy-duty vehicles that have broken down on the interstate system or have been involved in a minor incident from continuing to provide that service or interfering with owner preference. Law enforcement will need a different mindset to make this program work as it should. Embracing tow company partnerships, sharing equipment to reduce costs, and the ability to travel outside the assigned region will need to be understood and addressed in their policies and procedures.
In a very practical sense, it changes rotation policy as we know today. Change is needed. The legislation is needed to effectively manage and to implement the change. Arkansas is a major east-west corridor for the trucking industry. It is vital to the economy of the state and safety of the motor and public that our major transportation system remains open. It is incumbent of the tow industry to take a lead role in ensuring that happens while crafting reasonable, fair legislation and rules governing traffic incident management.
The two counties in my district, in my house district, are Hempstead and Nevada County. I-30 runs right down in the middle of it. This is why the Arkansas Towing and Recovery Board had asked me early on if I was interested in this bill. Again, this is big boy towing. What I'm going to emphasize, the everyday vehicle that hydroplanes and runs off into the median, and that needs just a helping hand, needs a cable extend to it to be towed out, this is not what we're talking about.
This is major stuff, has been approved by the Arkansas State Police, Arkansas Highway Police, and I went blank on the third one. The RDOT, it's hard for me to remember, instead of saying the Highway Department, RDOT have all embraced this. Non-consent, what this means is, well, who's consenting? Who's dispatching? Who wants these big wreckers to come? That is the officers, the officer has the initial consent.
Again, this is not everyday towing. Many, many times I have been involved in situations that may require, in my capacity, it may be dark. It looks like I need three or four more records. One was on a bridge, and a trailer was kind of hanging off. Next thing you know, I sent a response to a particular record that was the closest ASAP to get here, and they wind up bringing about four wreckers here. The job was done because every time, every second that the officer is out there on the interstate, it is severe.
Lives can be lost. We need that interstate open. So, again, this is not the everyday. This is to establish requirements for heavy-duty non-consent rotation is what this is for wreckers. Any questions? For what purpose,

the presidential bill. Speaker, colleagues, this is an interesting bill that wound up in agriculture the first time, and they had to reroute it to public health. So there's some interesting things that go with this. This bill, House Bill 1761, does not impact legal and safe fertility procedures.
This bill puts a safeguard in place to protect young women who are being solicited to sell their eggs for cash and to make sure the young women are aware of the risk and the possible side effects of the hormone injections that they would be receiving. to ensure that egg harvesting is performed by a licensed physician in a hospital or clinic that is approved by the Arkansas Department of Health. This procedure is very evasive
and could cause a lifetime of regrets. Childbearing is a wonderful thing for all of us, But we must make sure that young women are not exploited, that solicitation for this shows up on Craigslist and other places that must be monitored if not stopped. We're not wanting to harm the few doctors in Arkansas who are up front with their patients and with their donors and to do things the right way.

give the crowd a second to get back to their seats. House Bill 1890 seeks to give the Department of Education some flexibility that they don't have today. So back in 2015, a law was passed that allowed teachers to voluntarily give up their planning time if they wanted to, to teach extra students for additional pay.
It's a good program, and this bill keeps that in place. And it was for grades 7 through 12. but when we did that we took the maximum student allowance out of the standards for accreditation and put them into statute which was still all right until 2017 we extended that program and that that number to apply to grades five and six as well so now it's grades five through 12 and the reason for that was you've got fifth sixth graders that are in middle school
that are teaching some 7th grade students, so there's some overlap. Well, the problem with that is we've kept the 150 max in statute, and now that's causing problems for elementary schools who also have 5th and 6th grade teachers. So what my bill proposes to do to fix this issue is leave the program as it is. We will still allow teachers to voluntarily choose to teach additional students over the maximum, but it puts the maximum back into the standards of accreditation
and lets the Department of Education lay those out depending on the type of class and the age of the class because class size still stays in place so that remains, that's part of this too, it remains but it puts that total max for the day back in the hands of the Department of Education so that we don't have this one size doesn't fit all number stuck in our statute which is too big for some teachers and too small for some other teachers. There's errors that are occurring on both ends of that. In some cases, they're block scheduling,
and teachers can be required to teach more than $150 without getting the extra pay because of the way it's defined. And then we've got some elementary schools where if they teach any fifth graders at all whatsoever, they're demanding extra pay because they taught a fifth grader, but the way the class sizes are, they easily teach more than $150 in a day because of the way it's calculated. So I'm just trying to give the department the flexibility back to set those. It was done for decades where it was in the standards of accreditation, and I think that's where that number needs to go back to to let them divvy it
out, but we still want to keep the program where they can make extra pay if they want to teach extra students, and I'll take any questions.

Bill 1933. Thank you Mr. Speaker, colleagues. Before I begin with an explanation of this bill I want to first tell you how it is that I came to sponsor this bill and how this idea
first originated. Following the 2017 legislative session, actually in November of 2017, there was a young girl in my community of Perigold, 13 years old, who was in the sixth grade at Greene County Tech, who made the tragic decision to take her own life. And that news spread throughout the entire community and filtered down all the way to the third grade, where my daughter, who was eight years old
at the time, came home and began to ask my wife and I questions about why a young student and fellow student of hers would make a tragic decision to take her own life. And that was a very difficult conversation to have with my eight-year-old daughter. And so following that experience, I began to look at what we had in Arkansas with respect to bullying because it came to light after this tragic event that this young girl was being bullied at school.
And my wife, who was a teacher at the school who teaches art and gifted and talented, had heard that this young girl had been bullied, as had my daughter. And so at that point, I began to look at what we have in place as far as our policies in Arkansas with respect to anti-bullying. And what I found is that we actually have a very good definition of what constitutes bullying. A couple of legislative sessions ago, we added cyberbullying to our bullying policies, which was a good step forward.
But what I've also found is one thing that we don't do, and this is one of the central pieces of this bill, is that we do not require parental notification if there is a bullying event at school. And so I'll get into that in just a second. But as I began to look into this issue more, one of the things that I came across were the 2017 CDC statistics with respect to suicide and bullying in Arkansas. And I want to tell you about those because, quite honestly, it was shocking to me. According to the 2017 CDC statistics, in Arkansas,
high school students rank number one in the nation by percentage of high school students who have reported having been bullied on school campus. Number one in the nation with respect to high school students who have reported feeling sad or hopeless. Number one in the nation with respect to high school students by percentage who have contemplated committing suicide and made a plan as to how they would commit suicide. And number two in the nation with respect to the high school students by percentage who have actually attempted suicide. And so
in light of that, it became very obvious to me that we have a real and serious problem in Arkansas that needs to be addressed. And so again, as I began to look at these issues and I looked at what our policies were, that's how I arrived at this bill. I did work with the Department of Education and the School Administrators Association and many of you may have may know and may remember that before the session, I filed a bill, I pre-filed a bill, actually, House Bill 1003. There was a very extensive anti-bullying policy.
It was based on a New Jersey law. And what I found out pretty quickly is what works for New Jersey and what may be good in New Jersey doesn't necessarily translate well to Arkansas. And so that was a 13-page bill, and now we have about a five-page bill. But I think this addresses some of the more important issues with respect to bullying and will hopefully make a difference. And so with that being said, I want to explain what the bill actually does. First, with respect to professional development, it says that school board members should for one time have two hours of professional development on school safety and student discipline.
And within school safety and student discipline are the issues of bullying and suicide prevention. And then also two hours of professional development for teachers that will be on the rotation that the teachers have with respect to bullying prevention and a recognition between the incidence of bullying and the risk of suicide. Section 4 of the bill, we add cyberbullying to the definition of bullying. We had passed a statute to criminalize cyberbullying a couple of sessions ago,
but now into the anti-bullying policies that we recognize on the state level, we've added in the definition of cyberbullying to that, which I think is very important. And then the next part is the parental notification part. And again, this is the piece that a lot of other states have that Arkansas doesn't have. And so let me explain to you why I think that this is important. And what this would require is that in the event that there is a credible bullying incident, and I want to make that very clear because I think that's important, that it's a credible bullying incident.
So if the school looks into it and they say, yeah, this wasn't anything, this isn't truly bullying, this was just some kid making an offhand remark one day, then it doesn't even apply. But if the school officials determine that there has been a credible bullying incident, then as soon as reasonably practicable, the school is to notify the parents of the alleged victim of that bullying. And so why is that important? Because what we would fear the most is that there is some kid at the school who's suffering in silence, who is being bullied every
day at school, who goes home and doesn't tell their parents. Their parents have no idea what's going on, the school, while they may know and while they may be aware of incidents that have occurred, have not notified the parents, and then the child goes home and makes the decision to take their own life. And so if the parents or guardians know, then they can intervene and try to help their child in the event that they're experiencing those things at school. And then the second part of the parental notification is to notify after an investigation. And so what it does is it gives
the school five days to complete an investigation into the incident of bullying. And in the first bill that I filed, I had 10 days. And as I talked with my local superintendent, I talked with Commissioner Key, I talked with Dr. Abernathy at the School Administrators Association, they all told me 10 days is too long. If the school hadn't completed it in 10 days, that's a problem. And so they all recommended that it be five days, and so that's why I have five days. But at the end of the five-day investigation, if the school determines that it is, in fact, true bullying, then they'll notify the parents or guardians of the perpetrator of that bullying incident.
And why is that important? Many of you, I'm sure, like me, and what we would hope of most parents is, is that if you learn that your child is bullying and really mistreating other kids at school, I'm going to have a very frank conversation with my daughter and I'm sure you would with your kids too that that kind of behavior better stop and it better stop immediately and so we hope that all parents would intervene but they can't intervene if they don't know and so this would cause them to be notified one of the other things that it does
is it requires that the Department of Ed and they agreed with this this bill is based on recommendations also that were made to me by the Department of Ed but it requires the Department of Ed to issue a guidance document for school districts and for parents that discusses a few things that I think are important. Because what I learned as I talked with my local superintendent and others is there's still some ambiguity out there in the minds of some of our school principals and staff
as to what actually is and is not bullying. You know, that's not always clear. And so the guidance document would provide school districts and, again, principals and other school officials with best practices with regard to prevention, reporting, and investigation of and a response to bullying in our schools, a clearer definition of bullying that provides examples regarding conduct of what does and does not constitute bullying. because we live in a society today where everybody's offended. You know, no matter
what you do or no matter what you say, somebody's going to take offense, and not everything is bullying. I mean, you know, we live in a cruel world. People are going to be mean to you, and part of social development is learning resiliency, learning how to deal with these things, learning how to deal with life when people aren't kind to you. People are not always going to be nice to you, and that's not necessarily bullying, and so this guidance document that the Department of Ed will issue that will give some examples to our schools on what is and is not should hopefully
provide some clarity so that we can deal with those issues, and then we also also ask that the after the conclusion of the investigation that there be a written report made, and then the last section. We also provide some protections for faith-based schools, and I want to make this clear. Non-public schools are not required to comply with this. They're encouraged to, but they're not required to. But in the event that a faith-based non-public school,
this section will not be interpreted to prohibit or abridge the legitimate statement, expression, or free exercise of the beliefs or tenets of any faith by the religious organization operating the school or by the school's faculty staff or student body and so we write in some protections for private schools that aren't currently there and then last section adds in the definition of cyber bullying and so with that there are any questions I'm happy to answer them seeing none I would appreciate a good vote thank you

you're recognized to present the bill. Thank you, Mr. Speaker. Colleagues, this is an issue that I've worked on with the Attorney General's Office and the UAMS Psychiatric Research Institute that follows one of the recommendations
from the Governor's School Safety Commission, which issued its report at the end of last year. Many of you may be aware of that. One of the recommendations from the Governor's School Safety Commission is that schools create an avenue or a means by which students can anonymously report tips of school threats and that they can also report incidents of bullying and things along those lines. And so what I did is I worked with, again, the Attorney General's Office,
who had been looking into these programs for at least the last couple of years. And this is actually modeled off a program in the state of Utah called the Safe UT Program. But several other states have instituted these types of anonymous tip reporting programs, Colorado was the very first state to do it in the wake of Columbine. And so they have a program called Safe to Tell. Again, Utah has Safe UT, and that's what this will be modeled after.
Arizona has a program that we looked at. Oregon has a program that we looked at. And I actually, in October of last year, traveled to Utah with the Attorney General's office to look at exactly how the program operates, meet with the officials there, and this is something that we hope to bring to Arkansas. Ultimately, there will be an app that will be created that will be a free download for every K-12 student in the state is what we hope ultimately, and that they will be able there to access crisis counseling in the event that
they're suicidal, in the event that they're having, you know, self-harm issues or any other psychiatric issues, depression, and also to be able to report school threats. And so, again, this has the support of the Attorney General's Office, the UAMS Psychiatric Research Institute, Dr. Cheryl May with the Criminal Justice Institute, who chaired the Governor's School Safety Council. I worked with her on this as well. And so, with that, it does not require
an appropriation. It just sets up a fund. And so, once the money is available, money can be put into that fund but this does not require an appropriation or any money at this time and so with that I'm happy to

non-emergency transportation issue that we were having up in the 10 county district, 10 county area up near my district. DHS, I kind of, I dropped this bill, then DHS got with me and thought they wanted an amendment, and then they came back and said, you know what, we're okay with it as it is, just go ahead and run it. So they knew what the issue was. So what the kind of the second part to that non-emergency transportation issue was back last year, they essentially DHS promulgated rules and regs so that the children and adults with developmental disabilities were no longer
allowed to use the non-emergency transportation services that were available. And that essentially either forced the parents to do, to take the children or even their adult children to the centers or find other transportation or it forced the centers to provide transportation and some of those centers didn't have buses and it takes 18 months to two years sometimes to get the buses you have to order them you have to have them equipped properly so a lawsuit was filed against the state and the state went ahead and did an emergency procurement for those services for
those net services it was kind of a disaster because the procurement was done so late long story short, what I'm trying to do with this is essentially say that the either-or model has to apply. That was what we had prior to January 1st of this year. The DDTCS centers and the CHMS centers did it differently. DDTCS had their own bands. That was the model they worked under. CHMS did not. They used net services for the most part. And so when we combined that program into
early intervention day treatment centers, they were trying to come up with, DHS was trying to come up with a one-size-fits-all model, and it was pushed out, in my opinion, way too fast before the centers were able to accommodate and get bands. So what we're saying with this model is that the Department of Human Services shall provide or offer coverage of non-emergency transportation for services, transportation services for individuals receiving daily developmental disability service that includes adult day services or early intervention day services which
is for children so with that said i just i just want all our constituents covered with net services so with that i'd appreciate a good vote thank you representative

This positive change, no fiscal impact,
efficiency and effectiveness is what this is all about. physicians when they get near the end of retirement. Every year, a physician as a nurse has to redo their licensing with the board and has to do the CEU units. But some of them are of their own choice, do board examinations for different national organizations. As they get towards retirement, they don't want to spend the money to renew them. and I wholly respect each and every one of your decisions and your beliefs. We can debate the death penalty today if you would like to, but I do not believe that we should because the death penalty is the law in the state of Arkansas, and it is strongly supported by our Kansans. Every poll I've ever seen shows the estimated approval among our Kansas at 70-plus percent for the death penalty. However, death penalty opponents have engaged in what I would call nefarious tactics to try and stop the use of the death penalty in the state of Arkansas. Death penalty opponents are harassing and putting intense public pressure on manufacturers who supply the drugs that are necessary to carry out the death penalty in our state.
Unfortunately, these pressure tactics are working and impeding the state's efforts to get the necessary drugs. Under current state law, the identities of sellers and suppliers are not subject to disclosure under FOI, but the packaging and inserts are available under FOI. This legislation is the most efficient way to get this process back on track. This legislation will prevent the disclosure of drug manufacturer information, which will hopefully make it easier to obtain these drugs. This statutory change would prohibit the release of information that would identify manufacturer, supplier,
compounding pharmacy, or any person in the supply chain. This legislation will also reduce unnecessary litigation by giving the Supreme Court the sole jurisdiction to hear the disputes about whether the proper drugs are being employed. A reliable supply of drugs that are necessary to carry out these executions will assist the state in administering the sentence that has been handed down to these defendants by juries of their peers. The families of these victims deserve justice and the to have some closure, and that is exactly what this legislation does. In our committee the other
day, I failed to point out that Texas and Tennessee have already enacted very similar statutes. To be frank with you, colleagues, the passage of this bill is the only way that we're ever going to be able to institute the death penalty and carry out the sentence that was handed down by juries in Arkansas as if we pass this bill. The AG's office is in support of this bill. The governor's Office is in support of this bill, and

In past sessions, we've heard the ALC Higher Ed Subcommittee had a presentation by then Representative Letting, now Senator Letting, on the ever-growing number on student loan debt, and it's crippling. Right now, the total, I think when he reported it was $1.2 trillion nationwide, now it's up to $1.5 trillion, and in the state of Arkansas
alone, it's $11 billion in student loan debt. A lot of that happens because students just see it as easy money. They borrow more than they really need. Academic advisors are certainly limited in what they can say to the students in terms of giving them counsel and as a matter of fact that's one of the references that is in the bill is that we put in place higher ed put in place financial counselors as much as if federal law allows because right now there are limitations
on what can be said to to a student as far as their capacity to borrow congress is actually acting upon this. Senator Clark has referenced that there's been conversations with our congressional delegation, our senators, and their support for doing something to deal with the ever-growing amount of student loan debt. Right now, one in four Americans is burdened with student loan debt. Just one of the very simple things that a financial advisor or financial
counselor could tell a student is that they can never discharge that debt. Even if they file bankruptcy, that debt, that student loan debt is going to follow them for the rest of their lives. And that's something that a lot of these students, 17, 18, 19 years old, they don't know that. They just think, well, you know, I'll worry about that later. So what this puts in place is that higher Ed would make available, shall, it is a requirement, shall, if federal law allows, place a financial
counselor in a consulting role with the student, and at the time that the student signs the document to borrow a student education loan, if the student signs the document on the property of the state-supported two- or four-year institution, that financial counselor would also have to sign on off of it. Now, there is an option to this, and I wanted to make sure that you understand this. However, the signature of a parent or a legal guardian of a student under this subdivision may be substituted if a financial counselor does not sign the document as required.
So, what that's basically saying, as long as the student, the parents know, they know, and they've signed off on the student borrowing that amount of money, then they can sign in lieu of the financial counselor. This is really just something to help the students. One of the things that the higher ed is trying to do more and more in academic advising is to give them research, give the students research on how they can actually graduate in four years by taking 15 hours a semester.
Now, that just seems like simple math. But there's a program called 15 to Finish that has done research and found that even freshmen will perform better if they take 15 hours as opposed to 9 or 12. A lot of them will only take 9 because that's the bare minimum that they have to take to be able to earn Pell Grants. So this financial advisor, there are already financial counselors at higher ed. This is no extra cost. They would just shift a financial advisor over to work with the students on the distribution and on the processing of student loans.
And that is a summary of the bill that I'm running for Senator Clark, and
I'm open for any questions. Representative Payton. Question. You're recognized. I really commend what you're doing here. I think it's very important that they seek quality counseling and advice in these decisions that they're making. my curiosity is what are the uh what is a financial counselor what are the credentials what are the code of ethics that they follow or are they just going to be a a miss advisor instead
of a beneficial advisor i'm sorry are they going
to be a what well i mean are they going to be a beneficial advisor or are they going
to be a puppet of the school is what i'm trying to say Well, the intent is that they would be a beneficial advisor of actually pointing out the fact that while there may be a locked-in interest rate that's low right now, it could increase over time. Information, like I said, that they would not be able to discharge the debt. Just really all of the kinds of planning. So I don't know that they're going to be a rubber stamp for the university because the university understands that this is a critical issue as well.
Students borrowing more. You know, a lot of them are borrowing more than their tuition and their fees so that they can buy cars or they can buy furniture for their apartments, and that's problematic. You may have a
follow-up. So I guess my question is the credentialing of the financial advisor, are they licensed? Are they credentialed? Do they act under a certain code of
ethics? I don't know that there are any specific credentials. They are people that are already within the financial counseling or the financial advising
section of the university, and they're knowledgeable about all of these different loan programs. As
far as the code of ethics, I really couldn't speak to that. I'm sorry. Thank you. Representative Cavanaugh, for what

I didn't ask you this earlier, but in committee, I don't see an age limit. So if we've got an older person that's going to school, 25, 26, they're going to have to get their parents okay?

What this bill does is it is regarding the district court realignment, which I know we've all heard a lot about. This bill simply moves Pike County into the 36th Judicial District, and it adds one judge, which is based upon the caseload. This was unanimously approved by the DECRAB Board, which I hate that acronym, but that stands for – wait.
I don't know what y'all are thinking, but – District Court Resource Assessment Board. And so they're a unanimous plan in support. The AOC supports it, and there's no opposition. I'd appreciate a good vote. Representative Maddox has explained the

The proponent of the bill left the chamber, so I could not speak to it. But I don't see how we can allow federal offices, Social Security offices, who work in the federal government, to make arrests in our state courts and then come into the state courts and prosecute those persons. That's merging two separate corporate entities.
The United States is one and the state of Arkansas is another. and I don't think that that overlap is contemplated. Now it may be that we're talking about Social Security people within the state but the law does not make clear nor did the explanation so that's my concern. this bill. I'm just reading the title. I was going to get a question in real quick and try to find out if the bill does what the title says. But I want to tell you, the U.S. Constitution started off saying that the federal government would not have a standing army. And there was a reason for that. It was to protect state sovereignty. Now, we've already violated that part of the U.S. Constitution on many occasions, but these federal authorities have all that they need to come to the state of Arkansas and deal with local authorities if they need to arrest somebody. They can go to
a local judge. They can go to the local sheriff. They can go to the Arkansas prosecutor or attorney General, and they can get warrants and they can arrest people. We do not need more federal authorities stomping on our state's sovereignty. And so I'd appreciate it if you vote against it. Senator Payton has spoken against the bill. Would anyone like
