Now we all know it takes a really good team to do this. They were fast and you could even if you didn't get to see the game you missed a great game because the other team was frustrated with how well these girls played that day and just did a great job while they were down there. And we know it takes a great team to win a state tournament but it takes a super great team to win back-to-back state tournaments and these girls have done that not only that their program is so strong that uh six out of the last nine years they've been down there in the class a tournament at finalists in the class a tournament so so with that i'm going to ask that the resolution be read in its entirety mr speaker mr clark please read the

Moore, Jr. and to congratulate him on his induction into the Tourism Hall of Fame. And Robert Moore Jr. is a farmer and a politician, and he was inducted into the Arkansas Tourism Hall of Fame on February of 2019. He served in the House of Representative District Number 12 for three terms and also served as the Speaker of this House for the 88th General Assembly. He was appointed to the Highway Commission by the Governor Mike Beebe. And like many of you colleagues, Robert has just kept on serving and giving back to his community. So I encourage all of you to join me in the recognition of his contribution and congratulate him on his induction into the Arkansas Tourism Hall of Fame. And whereas Mr. Moore worked along with the Arkansas State Police for the extension of the Delta Heritage Trail and secured funding for the paved levy trail on which the levy fest was hosted for 10 years. And whereas Mr. Moore and his wife Beverly have donated property to Arkansas City, the Shea County, and Arkansas State Parks for the establishment of the city, county, and state parks. and whereas Mr. Moore's contributions to Arkansas are extensive from heading and guiding executive agencies to farming the state's land to crafting laws. So I'd like to recognize we have them in the West Gallery, the Lady Bearcats from Melbourne. So this is my alma mater, I guess you would say, where I went to school, where I played basketball, and I'm very proud of them for winning the 2A state championship, and I just wanted to let everyone know this is their first five-on-five state championship. The last time, they've won once before, it's my understanding, in 1973. That was before my time, Representative Wardlaw, back when it was three-on-three. So this is their first five-on-five state championship, and just a little tidbit that one of someone that I know and work with told me about these ladies is their coach. I went to school with their coach, probably with most of their parents, but they do team building exercises in the beginning of the year and then throughout the year to try and build that cohesiveness. So I'm told that this group of girls has been frog gigging outside my back door. Look at them, they're all laughing, outside my back door where I live in the pond. And as you know, today sports have gotten kind of violent, and they bring a lot of class to it. In 2013, our Medicaid spending was $4.5 billion, and this bill today is $8 billion. We're on a road that we cannot pay for. Unfortunately, Representative Miller's bill failed in a committee today, a bill that I think would help this be foreseeable in the future, but it's not. I'm really concerned about the minimum wage increase yesterday because all of our providers for senior citizens, development delay, those kids, all those kids are in trouble. because down the road, with this minimum wage increase, we're going to see tens of millions of dollars increase in Medicaid. We're in trouble, and I'm going to vote against this bill today because we need to look at it. We need to plan for the future, and I just don't see one.

And one of them brought to my attention that he had had a situation where he had a cafeteria employee, I believe, who had worked for the school district for 10 years. And apparently he assumed, as did his other staff, that they had, she had passed the background check. But apparently she had not. Some other employees, 10 years later, determined or found out or provided the superintendent with information that she had a mild treatment of children charged against her. And we got to checking into it and come to find out there is no requirement for the State Department of Education to inform the superintendent when someone fails or passes. Now, I think they have access to a registry, but when you're running through all your employees and you're trying to hire them, it's kind of difficult. Now, in this bill, we're not asking for any information about the crime, the up and down, the bad of the occurrence. All we're asking is that the superintendent be advised, yes or no. You can, yes, employ this employee, or no, you can't. And that's all we're about. Now, all the other information, and I want to make that very clear, because when we first submitted the bill, Chairman Cozart brought to my attention that it might be a violation of privacy. for giving me this opportunity to finally get a chance to bring this great piece of legislation legislation before you. This is a piece of legislation that many of you have signed on to, and you know the history of this. We started talking about these issues about the third week of the legislative session, and we met for about seven straight weeks to consider all the factors that now you're coming to hear about here as we present this bill. There's been a lot of conversation, and I'll try to save most of the time to answer your questions if there are any, But the legislation just does two things clearly. One, it provides a stopgap measure, financial band-aid, for a few providers that have ran into financial, if you will, some financial peril due to the minimum wage increase. It's not an end-all. It's not something that's going to take care of all of their problems, but that's a small part of the bill. The second part of the bill, which is the teeth of the matter that has, in my meeting with DHS, they told me that that's the problem with the bill. This is a real problem. It's not the money. The real problem is we do not want to see this put into statute. Well, I thought that was insulting, and some of you were in the meeting. We come here, 135 of us, we're elected to come here and make laws so that when we're not here, be it through not being elected death or whatever the case may be then the laws of the state are carried out that will protect the citizens the businesses everybody that live in this state so for them not to want us to put into statute regulations and rules that would provide for just good governance and good guidance for these measures that's all the review process did will do is put into statute the rules and regulations. We do it all the time in state government. Throughout state government, that's what we do. That's what we're elected to do. We do not make policy via executive order. An executive order or anything from the executive branch is not how we make policy. Now, in a perfect world, what we do is we work with the executive branch. We work with all branches of government to formulate good policy. Sometimes that works smoothly, sometimes it don't. In this particular case, for whatever reason, DHS had failed for many years to review the many providers in the state for the services that they offered to some of our most vulnerable citizens. They did not do it. They acknowledged that publicly and privately that they had not done it. So what happens in this state when something does not happen? A citizen, a business, they call upon us, the ones that they have elected to represent them, to go and speak and advocate for their issues. That's what we've done during those seven weeks as we try to bring this legislation together. We wanted them to come to the table. DHS generally will come to the table, and they will offer, well, I think this will work. This won't work. When you look at this this way, this never happened, never happened to after the bill was filed, they came to the table or they did not come to the table. They start calling some of you. And then all of a sudden, I got a call from my good friend Kelly Link, and he wanted to let me know, hey, we agree with what you're doing. We think it makes sense, but this is the way we want you to do it. The governor is going to issue a letter this afternoon about four o'clock. And when the governor issues this letter, that's what we want you to use. I said, whoa, Kelly. I said, we're a legislative body. I said, now, the way we do it here is stakeholders come together, we meet with one another, we listen to one another, we consider one another, and then we try to formulate good policy that will be representative of everyone's input. We don't take a letter from anyone and say, we're just going to do this. I asked the question. I said, so in this letter that's going to come, they later turned it to an executive order. It went from a letter to an executive order. So it grew a little bit in stature, if you will, but not really. So I asked them, what will this letter include? And more importantly, who will it include? Well, we talked to DHS, and DHS just wants it done this way. I said, what about the providers? I said, what about everyone else that's involved, all the stakeholders that's involved in this process, did you bring them to the table? Well, no, we did not do that. Well, I said, this is what we've done. We've brought everybody to the table for about seven weeks, and I've invited all of you, all you send me, stand back there and announce, and many of you have come. Over 40 of you have signed on to this piece of legislation because we did it the right way. We did it the way that we do business here and we should do business here. If DHS has something to offer in the way of changes, amendments, to make it better, bring it, let's do it. So finally, they said, we're ready to meet. They heard you say, hey, we're not going to accept it like you're doing it. You need to meet. I went to committee, and that committee, Representative Payne made a great statement. He said, Representative Murdoch, I hear what you're saying, but will you consider what DHS is saying, and will you pull it down and meet with them? Now, I think I could have got it out of committee that day. I had the support. But what I wanted to do is be an example of doing it the right way, the democratic way, the way we do business here. I pulled it down. The next day, DHS sent me a document. Kelly Link sent me a document, which was an executive order. I text Kelly I said Kelly is this your way of meeting with me because we have not discussed anything that goes into this so he said yeah we'll meet with you so they agreed to meet but when we agreed to meet when they agreed to meet and we met all that was offered was this we really don't like that you're going to put in the statue we really don't like that you're going to do what you were elected to do we want you just to take the executive order and then allow DHS to do what to do. Well, ladies and gentlemen, like I used to tell my children, if you allow daddy in your business, then daddy going to create what you're going to be able to do more than you want him to. If DHS had done what they were supposed to do and charged to do and admitted that they have not done, then we would not have been called upon to do it. Now that I'm called upon and we've spent the time and we've invested in this and we've come up with a piece of legislation that's representative, that's inclusive, and that's responsible, then I would be remiss if I did not come before you today to present this legislation. Now you know I know that there's games at play. There's all kinds of inaccurate information that's being brought to you. But I wanted to come to this well to have an opportunity for you to ask me that question. Those questions. Because some of you, many of you, and I dare to say all of you care about the facts of this matter versus what someone else told you to do. So I stand before you presenting this bill that does those two things. It provides a stopgap measure for a few providers that determined that they needed some help. Several providers came to the table and they said, hey, we can make it through as long as the review is going to come pretty soon. then we'll be able to wait. But it's not that they don't need it, but they didn't have to be a part of this first group. So that's a one-time thing that is what that stopgap financial measure will be. Then after that, the review process will go on, and it's to be determined. If you look at the legislation, that review process is to be determined. It's not any guarantee rate increases, no guarantees. The only thing that I want and that we all should want is that everyone come to the table and it would not be done by mandates or by orders. Lance and Carmen Smith are the proud parents of their son, Crosby. Crosby was diagnosed at 15 days old with cystic fibrosis. He's super excited. He's been waving at me from the gallery since they got up there. And essentially, just to bring awareness to this issue, since I didn't have a resolution, I just want to take this moment to tell you that they've been great activists within the community of cystic fibrosis, they've helped to raise nearly $100,000 to help find a cure for cystic fibrosis. members house bill 1800 creates a major historic restoration tax credit major being a it would be a major project it's a little background we have a historic restoration tax credit available now it's really only good for projects worth up to about one and a half million dollars for that one and a half million dollar project that would qualify for about a $140,000 tax credit. This is something that, this is one of those things I could tell you that all our neighbors do, right? All our neighbors give 25% credit for major historic restoration projects. We don't have that currently. So this would be a separate system but modeled after the existing. So the qualifications to qualify for the tax credit would be the same as the existing system, but this new one would be only for projects worth more than one and a half million dollars. Now, one key thing that I need to clear up, if you looked online and you saw a fiscal impact statement, that's for the original draft of the bill where I tried to actually fund the tax credit. It's been amended as it sits today, it's not actually funded. Took the governor's advice and we amended the bill and used language that we have in the movie tax credit. So basically it says this major historic tax credit fund is created and here's how you would qualify for the tax credit, but there's no funding there unless we decide to put it there, which we're not doing in this bill. So this would create the tax credit, this create the qualifications for it, so on and so forth. So I won't go on down the road if somebody came to the governor say and said we think restoring this hotel would be a major economic benefit economic development project and the governor agreed he could for example for example there's no agreements take two three million dollars out of quick action closing and with council approval put it into this fund and then we could fund that tax credit but with the passage of this bill there's no funding there we would have to take future action to actually fund the credits. Without a death certificate, families cannot access funds, insurance funds, that is, turn off utilities, make bank changes, and oftentimes cannot obtain pertinent information. This bill will require those who sign death certificates to do so within three business days. They'll also require them to use the Department of Health's electronic system, which we've had in place for about five years, which is called e-RAVE. Currently, about 78% of the hospitals, hospice, and doctors already use it. Once set up, it is something the staff can do for them. The problem is with the others who do not and most of the times will not. The small group is keeping Arkansas families from closure, creating extra days off work, and unnecessary burdens. Instead of using typewriters, postal service is sometimes taking months and months to get them. More than half of the other states have a mandatory electronic process, which processes swift service for families. Texas has a 99% utilization rate and penalties that are more than double this proposed bill. This bill creates a $250 penalty for those who don't use the system. And amendments from the hospital administration or hospital association and physicians were adopted to make this bill fair to them. It doesn't apply in cases that are sent to the mental examiner. where the cause of death needs to be determined. The bill has been requested by and supported by the Arkansas Funeral Directors Association representing nearly 400 funeral homes in Arkansas. They've identified that the failure to use eRAVE in the delayed death certificates as the number one problem in Arkansas's funeral service. I'd appreciate a good vote. Legislation is very, very needed not to get into the weeds with too many people. There are some things that do not need to be disclosed when there's an ongoing investigation for sanctity of life purposes. The legislation passed out of state agencies this past week, but with one caveat, and that was a desire or a request for us to meet with FOIA. Two and a half hours later this past Friday, I met with FOIA task force, Representative Gray, Hope Police Chief, Arkansas Municipal League and several more police chiefs. Collaboratively, this was what was determined. Disclosure of the individual's identity could reasonably be expected to endanger the life or physical safety of the individual or member of the individual's family within the first degree of consanguinity. House Bill 1920 is an act concerning the consolidation of venture capital programs in the state to amend the Venture Capital Investment Act of 2001 and to repeal the Arkansas Risk Capital Matching Fund Act of 2007 and for other purposes. This bill was brought to me by the Arkansas Development Finance Authority, better known as ATFA. This bill is agency legislation that the governor has approved. It creates efficiencies by consolidating five programs with the same overall goal into two programs. By simplification, this bill will make the programs easier to administer by staff and the ATFA board and easier for the users of the program. To provide you some background, APFA was tasked with implementing the state's venture capital programs beginning in 2001 with the passage of the Venture Capital Investment Act. Since 2001, four other programs related to venture capital have been created by the legislature or through federal agencies. The purpose of each program is to help startup technology companies source and secure venture capital funding. These companies are critical to the state's economy because they typically employ high-skilled and high-wage employees. One of the specific goals of the program is to support companies that pay salaries higher than the local or state average salary. The existing program goals are consistent with Governor Hutchinson's economic development goals. Current assets of all programs combined are approximately $40 million, with approximately $37 million in investments and approximately $3 million in cash. Previous funding sources have included the Arkansas Science and Technology Authority, the U.S. Department of Treasury State Small Business Credit Initiative, and the Governor's Quick Action Closing Fund. The existing programs are funded from the existing cash funds. The programs receive no annual funding from the state budget, or any other source. All previous funding for the programs was received prior to 2014. To summarize, this bill creates efficiencies by consolidating five programs with the same overall goal into two programs. This bill maintains the same overall goal of the existing programs, which is to increase the availability of venture capital for Arkansas technology companies. This bill does not create any new programs. It does not create any new funding or add any funding to the budget. This bill is also consistent with the governor's transformation plans as it will generate operational efficiency over the long term. Explain the bill. Thank you, Mr. Speaker. So this bill originated from the non-emergency transportation procurement issue that we had across the state starting in January, but most specifically in central and north-central Arkansas. DHS went to a different, they procured, they bid out a new net provider. That net provider took, I believe, four of the seven regions of the state, and that net provider actually had no vehicles of their own. And so they were trying to subcontract. They couldn't find subcontracts. So what happened to my constituents and a lot of your constituents is they went without transportation. They couldn't get to dialysis. They couldn't get to their pain management appointments, and they were going through withdrawal, they didn't get to their early intervention day treatment programs, they didn't get anywhere. The few times I had people picked up, I had them left at pharmacies or had them left at doctor's offices where they were there for hours. So I worked on that for weeks and weeks. It ended up in the end, the non-emergency transportation providers' contracts were canceled for lack of performance, for better legal words. And so what I was trying to do was ensure that the way we procured that in the past didn't happen again. So this bill sat out there for probably a month as I was trying to work on exactly what to do. What they had asked for was a non-emerge, or was an RFP process, but I felt that that RFP process, it kind of locked us into one procurement style, and I didn't know that I necessarily agreed with setting that policy. So we worked with DHS, and some of the net providers worked with DHS is more accurate. And so what we came up with was this. DHS shall adopt rules, I think it's before January 2021, because we won't bid these services out, or we shouldn't bid them out for roughly another six years. But they shall adopt rules to attest to the operational stability of any company that is to be awarded the contract. I'm hopeful that in those rules, they will look at readiness reviews and actually making sure that as a new company takes over, they actually have the necessary vehicles and the necessary cameras and everything they need to actually perform the job. And that goes into the other piece was transition planning to make sure that our constituents are taken care of and they get to their appointments like they're supposed to do. It was none of their fault that this happened, but they're the ones who actually paid the price for that. And then also I put in this bill that any procurements must follow the federal regulations. So the IFB that they used before, it was awarded solely on cost. So they say they looked at other qualifications in just qualifying the bids, but then they look solely on cost. So what I'm saying is they have to actually follow the federal regulations that surround non-emergency transportation, because there are some actually set, where they have to look at other qualifications such as experience, performance, references, and not just the cost of the procurement itself. So Hopefully this helps us six years from now and we'll have a much better transition during this bidding process. I'd be glad to take any questions. Seeing none, I'd appreciate a good vote. You may remember during the Governor's State of the State Address, one of the things that he talked about was he would like to see blockchain technology come to our state, and that's what this bill does. This bill lays the framework to allow blockchain technology to come to our state. As a matter of fact, he called me right before session to let me know that he had told a group that was meeting in northwest Arkansas about this bill, and they were very excited to see this come to our state. Colleagues this deals with an area of law that it kind of nuanced again that child maltreatment stuff, but if you've had anyone in your family or you've known anyone who was involved with a foster care case where termination of parental rights was considered, you know how serious it is, how lasting an impact it can have on many, many lives. Parent counsel, the persons that are appointed to represent parents who don't have the ability to contract with an outside attorney, parent counsel are appointed to represent the parents in these kinds of cases, and they said that we really looked at things a little bit too strictly, and we would like to have the court be able to look at things a little bit more broadly with regard to efforts made by parents towards the last minute, the 11th hour of a permanency plan. What does that mean? When kids are removed and put into the foster care system, you generally see that there is a plan that's laid out that can last up to a year for parents to have the ability to rehabilitate themselves or the circumstances on which the children were removed. If towards the end of that year, no progress or little progress has been made, the court can entertain a petition to terminate parental rights. This makes two changes to the law such that parents who come in kind of at the last minute, but because of circumstances, perhaps they were jailed, perhaps they had reasons that were beyond their control for them to come in to the case early on, their efforts when they do come in can be considered and given proper weight. It really gives a little bit more discretion to the judge to consider. It doesn't make any responsibilities on the judge to change their feeling about it, but it really does offer a door to parents to give a little bit more hope that if they were in circumstances that prevented them from doing a permacy plan early on, they can come in and still make every effort to try to get their children back. Thank you, Mr. Speaker, colleagues. The question that I was asked before I came down here is why are we doing this now on distracted driving? why are we making it a primary offense? Well, folks, we already have this law as a primary offense. The problem is we're not in compliance with federal law, and therefore there's things left on the table that could come back to Arkansas. This bill, Senate Bill 534, amends our existing distracted driving law. It was entitled Paul's Law. Paul's Law was enacted nearly a decade ago, and I'm sure you will agree that technology has changed dramatically in the last 10 years. As a primary offense, this is already law, but it's not current because it doesn't address that new technology nor the current language used by the federal government. This bill will put us in compliance with NHTSA, the National Highway Traffic Safety Administration, and bring us in compliance with those regulations and will then enable the Arkansas State Police and other agencies to apply for and receive safety grants and other incentives. It's important for you to know that this is a good amendment to an existing law, but vernacular is important and the correct language in our code matters to apply and receive federal funding. And right now, ladies and gentlemen, we are leaving that money on the table in Washington and not bringing it back home to Arkansas, where it can be used for educational programs to improve the safety of our driving public. This bill does the following. It defines texting and devices as used in federal definitions. It allows courts to have a base fine of $25. Currently in Arkansas, the base fee is up to the judge. And folks, that's one of the reasons we're leaving that money in Washington, because we don't have a baseline for our minimum fees. It excludes devices like GPSs and music players and CB radios and things like that. It allows for making phone calls, performance of official duties for first responders, reporting illegal activity, helping an emergency in similar circumstances. But it clearly provides restrictions on the following. Children under 18 years of age, complete prohibition of using a cell phone, except in an emergency 18 to 21 years of age hands-free and or in an emergency school zone prohibition which you have already voted on in this chamber already this session and highway work zones a complete prohibition except in an emergency most importantly this is well thought out comprehensive legislation becoming good public policy that will definitely save lives. It has the support of numerous organizations, including the Arkansas State Police, the Arkansas Children's Hospital, the Injury Prevention Center, and other law enforcement agencies. With that, I'm open to any questions that you might have, but remember this is a bill that is amending an existing law that is 10 years old.

the bill. Thank you, Mr. Speaker. Thank you, colleagues, for those whistles of support. I appreciate that. Currently, under the law, a manufacturer, any equipment that he purchases directly that is directly involved in the manufacturing process, he gets a tax break on that. There's an exemption. However, under the same current law, if he purchases equipment that is used to repair or modify equipment that is used in the manufacturing process, he gets no tax exemption on that. That bill 582 is going to change that to where he will get a tax exemption on the equipment that he purchases that is used to modify or repair the equipment that directly involved in the manufacturing process. That's what I know about this particular bill. The other thing I know about this bill is there is a fiscal impact. In fiscal year 20, it will be about $116,000, in fiscal year 21, a little over $200,000, and then in fiscal year 22, $265,000. The fiscal impact is so insignificant as far as DFA is concerned, they have no problem with this bill, they're just neutral on the bill. It's not an issue to them. With that said, however, $100,000, $200,000, $265,000 to that manufacturer could mean he hires an additional employee. He hires two additional employees. He expands his business. He hires carpenters and other personnel that comes in and works on that expansion. To him, $100,000, $200,000 is a significant amount of money. And that's why I would ask for a good vote. explain the bill thank you mr. speaker and colleagues no I do not have a steel mill bill today but I do have a bill that that has potential of those steel mill workers that's making all that money to do save a little bit of it Senate bill 584 as a line for savings empowering people to exercise personal responsibility for their own financial future the recent federal government shutdown brought much-needed attention to the fact that most Americans don't save enough for emergencies much less for retirement a a home, or higher education. SB 584 will provide Arkansans an opportunity to exercise personal responsibility for their finances by adding the option to their state income tax forms to direct deposit all or a portion of the refund into a savings account. Currently, there is only one option for direct deposit in a bank account. According to National Conference of state legislatures, tax refunds are often the largest lump sum payment a family receives all year. Data from Prosperity Now reveals that in Arkansas, only half of the population had emergency savings over the last year. That's $1.5 million. I mean, that's 1.5 million people who don't even have a saving account. Behavioral economics research shows that when we make it easy to save, people will save. Providing an easy way for people to save some of their tax refund will increase saving rates and boost economic opportunity, according to national research projects on financial security and mobility. Adding a second direct deposit line to state income tax forms makes the process of saving easier and helps Arkansans take control of their financial destiny and with that I would appreciate a good vote thank you. This bill is an act to authorize and require the issuance of a title for a motor craft and to create the Arkansas Motor Boat Registration and Titling Act on any boat that's manufactured and sold after January 1, 2020. So this does not require any existing owner to go back and retitle a boat. but this is on boats that are manufactured after January 1st and sold after January 1st, 2020. This bill is supported by Game & Fish, law enforcement, and lending institutions. It has no known opposition. It does five things. One, it provides proof of ownership. Secondly, theft protection. is the one we've all been waiting for. We'll get this one over with, and y'all quit getting the emails, I promise. Well, maybe. I can't promise that. I hadn't sent them. Okay, Senate Bill 184 simply removes, under the supervision of, and replaces it with, in coordination with in the Nurse Practice Act. This is for Certified Registered Nurse Anathesis, removes supervision requirement, and replaces within coordination with. It was funny this morning on a totally different bill, I got a text from a lobbyist that I found out later is actually working against this bill. This didn't apply to this, but he said, we all know the way to kill a bill is to muddle and confuse the issue, you have to ask yourself why are they just now raising these bogus arguments? I thought, wow, how much does that apply to this bill? It's not the one he's talking about, but there's been lots of misinformation about this that started out in committee. One of the first things that said, I'll hit the highlights of things that have been said, that CRNAs are not safe, removal of supervision is not needed, they mentioned dental deaths in Texas, that CRNAs just wanted to open up pain clinics, and that if we do this, that we won't get reimbursed from Medicare anymore. All those things are false. of the letters that we got, you would think that the people who are sending these, and a lot of them being physicians, don't realize how CRNAs practice today. In rural settings, currently, in all of our critical access hospitals in the state, CRNAs do 100% of the anesthesia care in critical access hospitals. That happens today. If they weren't safe, we would all know about it. There have been no complaints to the nursing board about CRNAs maiming people or anything else. so we know that they're safe because we know that they're out there practicing today there's 600 plus cRNAs out in the state practicing today there's 200 something anesthesiologists other letters would leave you to lead you to believe that cRNAs are supervised by anesthesiologists which is the case in some of our larger hospitals it is not the case in in all hospitals for some hospitals, that model works really well for them and they'll be able to keep that model. We are not dictating to hospitals here how they have to practice. If they decide that they need supervision of CRNAs in their hospital then they can put that in their policies and they can keep operating just like they are today. We're not looking to change that at all. There was actually a letter sent from a doctor at UAMS on UAMS letterhead that spoke about, well, started in about how unsafe CRNAs were to start with and went through a bunch of different things, how unsafe they were. And at the bottom of the letter, if you'll give me just a minute, actually I may not have printed that out, but she, anyway, this doctor accused the Heart Hospital of operating illegally by using unsupervised CRNAs in practice, resulting in the deaths of patients. So she accused them of killing people by using unsupervised CRNAs. Number one, that doctor did not have permission to send that out on UAMS letterhead. UAMS trains anesthesiologists, and they're starting a program to train nurse anesthetists. They are neutral on this bill. They have no opinion on it whatsoever. That doctor also had to write a retraction letter saying she did not have permission to send that out on UAMS letterhead. and Dr. Cam Patterson that's the head of UAMS had also had to send an apology letter out to the heart hospital as did Dr. Kimbrough that wrote that letter. As far as the Texas dental deaths go that were mentioned in committee we had BLR do a little bit of research on that to see exactly what the case was there. There were 19 cases. I'll read what BLR said about it. They did a blue ribbon study in Texas to figure out what exactly was going on there. BLR found the study. They found six cases as major sedation anesthesia events, cases that resulted in mortality or permanent morbidity, and was directly related to mishandled sedation anesthesia and 13 cases as mishaps, resulting 13 cases of mishaps, cases and adverse events occurred without permanent injury and was directly related to mishandling of sedation anesthesia. In these 19 cases, no CRNAs were named as providing the anesthesia sedation, so there has been one thing after another that's misleading information out there on this. They are just trying to confuse the issue. CRNAs are perfectly safe to work with. The issue of pain clinics. CRNAs can open pain clinics today with a doctor. That's not going to change. And the reason that won't change is because it still has to be a doctor that orders anesthesia. CRNAs have no prescriptive authority. They can't order the prescription. There has to be a doctor that orders it. There's always going to be a doctor in the presence of these nurse anesthetists as the doctors are performing surgeries. There's not going to be CRNAs out there putting people to sleep for no reason. There will always be a doctor there in the case of a surgery or major operation or something like that where the pain clinics come in is that they are qualified to do nerve blocks and certain procedures like that. We're not talking about pain clinics that, you know, just distribute pills. We're not talking about the pill mill pain clinics that we think of today when we talk about this or when we talk about the pain clinics. As far as the Medicare issue, Medicare allows states to decide if they want supervision or not. So there's currently 40 states that do not require supervision in any of their legislation or code, medical board rules, nursing board rules, or anything like that. 17 of those states have decided to completely opt out of supervision with Medicare. But as long as we have the supervision language in our code, we wouldn't ever even have the option to opt out of the Medicare supervision. But there's 40 states that do not have supervision in their code, only 17 that have opted out. I think that covers most of the main points that I wanted to hit. Do you all have any

recognize speaking against the bill thank you mr speaker i was going to ask how you knew, Representative Richmond, that that wasn't an anesthesiologist who is a medical doctor that was administering your anesthesia in any of those five circumstances. So a little context for me. My son is an anesthesiologist in the Army. He became a medical doctor at UAMS. I know a lot of the kids that are, I still consider kids, that went through school with him. And while I was in the Army for more than three years, I practiced risk management at three, well, two of the Army's bigger hospitals. So I look at a lot of research. It's very important to me. So when we started getting emails and calls about this, I started trying to pull together some things. And I wanted just to share with you some of the information that I think may have been, and I can interpret differently than what you've heard already. So just to be really clear, the differences between the CRNA and an anesthesiologist is really not what's so big here. It's about risk and safety of patients. Although a nurse anesthetist is a nurse, can be a nurse anesthetist with six or so years of training, an anesthesiologist trades in his 13th year of training after high school. He's going to take his boards. In fact, his oral boards are tomorrow, Wednesday, God willing. So you have to know it's controversial and scary, right, because of all the information that you've received. So about that opt-out thing, in 2001, the Fed said that you can opt out, you can still get Medicare, but you can opt out of having supervision if you're a CRNA. The states have to do it, you have to have the authorization in the law, the governor has to get with the nurse board and the medical board, and this is a step to allow that to happen. But let me tell you, Of those 17 states that have opted out in the last five years, only one has done it. That was Kentucky. And in fact, before that, the last one that did this opt-out was 10 years prior, and then it was California. So think, if this was such a great and safe thing for people to be doing, wouldn't we be seeing the trend to be escalating and more states doing it? In fact, because of the statistics and the concerns with regard to this no supervision concern. I don't think we are. The number 40 was referred to, and I got that a couple of times. About 40 other states have removed supervision, so I went to look at that. In fact, that number is really misleading because many of the states require more supervision, and I've got the list of every state if you want to look, and of the five that don't require supervision or collaboration, one is Alaska, one is Montana, one is Utah. Obviously, we're looking at very rural sites where maybe a surgeon or doctor couldn't get someplace quickly. The states that require different and might not have supervision in their language have things like ordered by physician, physician direction, direction and supervision, consultation and or collaboration with physician, or a written protocol. So they might not have the word supervision in their language. They have something even more strong. So you keep hearing about this, and you may have seen the email. I certainly saw a lot of them that said this is about rural health care access. And the truth is, CRNAs are absolutely doing the bulk of the care. They even have a provision where they get paid the same thing as anesthesiologists in critical access health care sites, which is a great thing. We pay a lot of money, and we expect to have the best care, and we want to do that. But every one of those still has supervision or some kind of oversight where somebody is looking over by a medical doctor. If you think that rural hospitals are having trouble recruiting surgeons because of this issue, you probably didn't talk to very many surgeons or rural hospitals this weekend, and I did. I also found four recent studies on whether opt-out states have greater rural inpatient or outpaced health care access, and all four of those studies concluded no. I'll be happy to get them for you. Even the AANA website states there's no increased liability for doctors that supervise CRNAs. The people that did contact me to vote yes for this bill attached studies from 1998. Again, the opt-out requirement started, or the ability to do that was in 2001, and I saw one from 2010. They didn't attach the 2017 research that statistically shows that surgery procedures where CRNAs work without physician supervision, that's not what we have right now, but it's what it would be if this bill passes. They have worse outcomes, more complications, and they require additional treatment. That 2017 study, I have it on my desk, estimates that these cost individuals an average of $1,800 higher per surgery. What's even scarier in this language, though, and what you need to know is no other state in the nation has language like this. It's not defined in coordination with, it's nowhere else. It's open to interpretation, and when you do that, lawyers make a lot of money, and I'm a lawyer, and words matter. And in this case, when it's not defined, it leaves, again, open interpretation when there's been a bad outcome, because that's when the suits are going to happen. Are you willing for that bad outcome to have happened to a family member or to a constituent? We recently debated practicing telemedicine without a face-to-face visit. Getting medical treatment over the phone from someone that might coordinate with your anesthesia provider in an emergency puts people at risk. People with money and people in places like the big cities are always going to have access to the doctors, the anesthesiologists, to the best equipment. We are putting people in rural health care at risk if this bill passes. So the biggest statistic that I want to consider as I vote on this is that 2012 research that found that states that have opted out of the requirement for CRNAs to be supervised by a physician have shown an 80% increase in risk of complications and adverse outcomes for patients, and a separate study showed that where there are complications, the death rate increases to 7 per 1,000 surgeries. One is too many. Is it an acceptable risk for you to take, to open the door, to be the only state in the nation with undefined language such as this? It's too big a risk for me. I ask you to vote no

Colleagues like Representative Birch, I spent the weekend visiting with my hospital administrators throughout my district who are 100% in favor of this bill because every day throughout the vast majority of the hospitals in Arkansas, there's not anesthesiologists around. The only anesthesiologists around are here in Little Rock or in Fayetteville. They're not in rural Arkansas. Every day, those CRNAs are doing an awesome job taking care of patients like they have for hundreds of years. It's just the facts. Nurses were doing it before doctors were doing it. So they're doing safe care, proven care, and tomorrow they're going to take care of 90% of our patients, over 90% of our constituents are going under. It's going to be with a CRNA, and they're going to do an awesome job. This is perceived liability, not liability. We know that everyone in there is still liable, but it's perceived liability, and I've talked with folks that are very concerned about their podiatrists, their general surgeons. They haven't studied anesthesiology. they don't know how to put a patient out and they're right in the order to put it out because they trust the CRNA to do it I'm not going to be a broken record but our healthcare costs are skyrocketing this is one step in the right direction to do a tiny, tiny speck of competition and we can't sit back and say we're going to keep doing the same old thing and wonder why our costs are continuing to go up and up and so I can tell you that the administrators at my hospital are 100% in favor of this and I will be voting for this bill and I appreciate a yes vote thank you

Thank you. Broke the mic. Thank you, Mr. Speaker. I just want to address a couple of issues. In Arkansas last year, there were about 300,000 patients that underwent surgery, 300,000. Now, you've heard the comment that 90% of people CRNAs are doing their anesthesiologist. That may be true, but two-thirds of that 300,000, two-thirds, 200,000 of them are done by CRNAs that are under supervision by an anesthesiologist. That's a fact. They're not done in coordination with, they're done under the supervision of the physician that's there. So the biggest key issue that I have is when this all came out through the Senate, there was a mandatory language that was offered to address some of these situations. And all the mandatory language said was, where there's an anesthesiologist, you keep the words under direct supervision. That's what they do today. That's what's happening out there in the world today. It's not going to change. So just leave that. Out in the rural access, rural hospitals, the language that was offered to use in coordination with, but they wanted something else, and they just asked the medical society, asked that the doctor that's responsible for that sign the chart. Those were reasonable, reasonable amendments that would accomplish their goals. Those were rejected. So I think that the language that was offered directly dealt with what the CNAs have complained about for years and that they weren't actually being supervised by the physician that's there at the time of surgery. Why they want to completely change this, it's beyond me. So with that, I don't know why this legislation is needed. It's not going to change really what's going on out there in the world. bill. Thank you, Mr. Speaker. So this bill, I have to go a couple different routes with this bill because I'm going to tell you guys, I'm going to start here. I'm going to start with the personal side of it. I'm kind of getting hammered back home from this bill because as Representative Brown spoke to the bill, Kevin Spears is the administrator of Stone County Hospital in Mountain View, Arkansas, and that's in my district. I have not been told personally that he is in favor of this bill, And I have not been told by the administration of his parent hospital, White River Health System, that they are in favor of this bill. And it's my understanding they are neutral on this bill as they employ an anesthesiologist who has nine CRNAs that he supervises and that he works with. They have a model that works great for them. And so what I want to say with this is, I'll try not to make it personal again. And I had another email from a physician from Stone County. I believe the entire chamber got it. I have great respect for that physician. He's a surgeon. But his wife's a CRNA, and he failed to put that in his email out. When he sent it out to everybody, he's with a business there in Mountain View. So this kind of got personal for me as I feel like I've been getting attacked on this bill because everybody's trying to hit me because I'm Stone County and I was on the committee. So this bill failed once with, I think it got nine yes votes, or might have got ten yes votes. And then it passed the second time with 11 yes votes. So it's been very controversial. But my question this whole time has been, what are we trying to fix? That's why I brought up my hospital, because the model they employ, they have an anesthesiologist, and that model works great. I think there are some hospitals in the state that don't have an anesthesiologist on staff, and their model works great. But no matter whether you have an anesthesiologist or you don't have an anesthesiologist, anesthesiologist, you still have physician supervision. There's still a physician in that operating room with you supervising. Nowhere in the current scope bill does it say it has to be an anesthesiologist supervising. It has to be a physician with a higher level of education and training supervising what's going on in that OR. So my question is, what is it that we are trying to fix? Because I haven't been, I don't see how it's broken anywhere in the state. I don't see how we can make it any better. This doesn't add to quality. This won't bring anybody else to rural Arkansas. Where are all the hospitals at in rural Arkansas coming and saying, apparently I have one in Stone County saying that, although I'm not entirely sure that the other, you know, White River Health System has supported that decision, saying this will help us. They have plenty of CRNAs and they have an anesthesiologist already. In coordination with isn't defined in this bill, So why don't we define it? Well, we don't want to define it. It's not defined in any other state scope bill in Arkansas or, according to Representative Birch, that she could find nationally. It's not there. So why not just remove that section altogether? Why don't you just strike out the coordination, the supervision and coordination with a licensed physician? If we don't need anything, if they're going to coordinate with physicians anyhow, then just strike that entire language and be done with it. But that's not what we did. I was told that a compromise was offered up between the anesthesiologists and the CRNAs to essentially better define the bill to rural Arkansas. If you say it's about rural Arkansas, then let's do that. And all that Representative Gonzalez, I know he'll probably speak to that when he comes down. But essentially, I was told that they came to the table multiple times trying to ask for that. If that's what this is about, it's rural Arkansas, then let's make that about this. And they were refused. So I would like for Representative Gonzalez to address that. So with that said, I just don't know, and that's what we could never figure out. We were going back and forth and back and forth. There's Representative Gonzalez I was looking through. We were going back and forth and back and forth in committee. What's this actually about? It's about liability. No, it's not about liability because where are the doctors lined up or the physicians lined up saying, you need to save us from liability? And have you ever, since we've been down here, how many groups have actually said, such as the CRNAs are trying to say here, give us more liability? They don't do that. So my question and the question for most of the public health members that were against this is, what is it we are trying to do here? This doesn't fix anything. So with that, I can tell you, I got passionate, and it got a little personal for me with my hospital getting involved. But with that, I plan to vote no. And I'd appreciate anyone else that wanted to follow suit and vote no as well.

One is it seems as though what we're doing with the bill, the purpose of the bill, is to actually put the law to match what's already in practice. It sounds like this is what we're already doing. It doesn't necessarily match the terminology in the law, so we're correcting that. As for coordination not being defined in the law, neither is supervision. The one thing I wanted to point out was that actually, if you just continue reading in the existing language, it says administration of anesthetics under the supervision of, but not necessarily in the presence of, a licensed physician, so on and so forth. We heard a lot of things said in and out of committee. We've heard a lot of things said today on both sides of the issue, and most of them really weren't by legislators. A lot of things coming from two groups of people, professions, that I have a tremendous amount of respect for. This is from anesthesiologists, and this is from CRNAs. These are both colleagues that I've worked with for many years and have a lot of respect for, but it feels like they got off topic really quick. This bill is not about the competency of CRNAs to do their job. CRNAs are very well trained. I trust them to provide anesthesia to anyone in my family. As Representative Davis pointed out, they are not currently required to practice in the presence of a physician. They are currently allowed to practice free from the presence of a physician. What we're doing by changing this word supervision to coordination, in my mind is creating confusion. Confusion over who's in charge and who's really responsible and possibly confusion during a critical time in a patient's care. Currently in the ER, if a patient goes south, I know who's in charge. I'm in charge. If a patient goes south and it's a trauma, I'm in charge until the surgeon arrives. The surgeon is more qualified than me to manage that trauma patient, and now he's in charge. I think the worst thing you could possibly do is create a situation where now you have confusion in the operating room over who's really supervising the patient. Coordination is ill-defined. I don't think the way the current statute is written is good, and I made that comment in committee. I've talked to Representative Gonzalez. I feel like this could be markedly improved. I'm voting no against this bill because I think it's confusing. I don't think it improves the status quo, but I think there is room to improve the status quo. And as I've said to Representative Gonzalez, if this doesn't pass, I'm committed to working with him to come to some sort of compromise that I think will make the situation better for both the CRNAs and the anesthesiologists. When this bill first came out, of all the scope of practice bills, this was probably the one that scared me the most until I realized that the CRNAs were already providing anesthesia to patients. And then I was really confused about what the hassle is. This, and the question I was going to ask Dr. Johnson, or Representative Johnson, pardon me, was if that's hospital policy, how the hierarchy is set, who's in charge in the room, or state statute dictates that. I believe that the hospital has policies and procedures. This is permissive language that doesn't change anything in a facility if they still choose to have an anesthesiologist in charge in that room. Currently, under state law, we have CRNAs administering anesthesia to patients underneath the supervision of a podiatrist who may have zero training or experience in anesthesia. So they are supervising somebody that is better trained than they are in that particular field. So I think the coordination with is more applicable. We've had two people down here speak against this that are saying it's okay to do this in rural Arkansas, but just not in the cities. If it's okay in rural Arkansas, why is it not okay in the cities? I mean, I just don't understand if they're willing to allow this to happen in rural Arkansas, and it's up to the facility to tell their employees who's in charge in that emergency room. I mean, this all comes down to people like to throw around local control. Let the facility determine who's in charge in the emergency room. Thank you.

you're recognized to close for the bill. I was just told to make it quick, so I'll try to wrap this up pretty fast, Monty. So just to address a few of the things that were set up here against this, the doctors don't have to be liable for the anesthesia care that they have less training in, okay? There is a perceived liability, yes, the CRNAs and the physicians and everybody else will get named in a lawsuit. That happens today, but with that language of supervision in there, it puts them at a perceived greater liability than what they have to be at for something that they are not as trained as the CRNA that's working underneath them. The people who do the most risk management, insurance companies. That's their business model. They do it for a living. Medical malpractice is not any higher for a CRNA than it is an anesthesiologist, and actually the rates have dropped over the years, so it's gotten cheaper. And if this wasn't safe in the 17 states that have opted out, would they not rescind their opt-out? It's very simple. All the governor has to do is send a letter saying, we no longer want to opt out. But that's not been the case. They have not opted out. Some of the studies that were cited were, you know, from 2001 or whatever they said was after the opt-out. Well, in 97, the federal government just completely removed supervision in Medicare. The Bush administration came in and gave the state's authority to opt out. So there was a little confusion there in that time frame between 97 and 2001 when all that happened. But now states do have the authority to opt out. you heard talk about the definition of supervision that's in our current law. It says under the supervision of, but not necessarily in the presence of. So I would say, you know, that's even less defined than coordination that we're trying to replace it with. Last session, it was offered to strike all of that language like was mentioned in an amendment here, and that was fought against. There's no way that they wanted that to pass. Nobody brought an amendment to me, the House sponsor of this bill, until yesterday afternoon when it was on the calendar. It was the first I had heard about an offer of an amendment from the Medical Society. Now granted, the Medical Society doesn't really like me much, so they don't really want to work with me. But, you know, never mind that, I am the House sponsor, so they could have brought me an amendment. But that did not happen. And like Representative Penzo said, why would it be okay to have unsupervised CRNA in a rural area but not in an urban area? I mean, if they're safe for one population, they're safe for another. The lives of our rural population isn't any less important than our urban population. The CEO of Stone County Medical did send a letter. I have that letter right here. What SB 278 does is it codifies the Eighth Circuit Court's opinion on abortion clinic regulations in the Arkansas Department of Health rules and regulations. Abortion patients will have the access to a 24-hour telephone consultation with either a registered nurse or a physician associated with the abortion facility. The abortion facility shall have written procedures for emergency transfers. The abortion facility shall be within 30 miles of a hospital that provides gynecological or surgical services. The abortion facility shall have an emergency drugs and equipment on site. This bill also requires abortion doctors to report any abortion that results in a live birth and includes penalties for failing to comply with the abortion reporting requirements. This bill also amends the Women's Right to Know Act of 2015 by requiring a signed form listing acknowledging all possible complications from abortion from 48 hours to 72 hours. Folks, this is a good bill, again, that protects our mothers and our children, and I'd appreciate a good vote.

Thank you, Mr. Speaker. This is not a scope of practice bill. Okay, Senate Bill 468 is a bill that addresses the excessive regulations that Arkansans currently have in place in the unskilled home care marketplace. The unskilled caregivers help clean, cook, assist others with activities of daily living, and provide respite care for the other caregivers. This bill requires the Department of Health to adopt new rules of provision of unskilled home care in Arkansas using the advice of a temporary advisory council of industry stakeholders that is created for a finite purpose and for a very limited period of time. It'll only go through November 1st of 2019 to ensure that the regulations are more consistent with home care regulations in the surrounding states. This will remove the requirement that our RN must visit a client's home who's receiving unskilled care every 62 days to observe the unskilled caregiver. Currently a nurse has to go out and a skilled individual nurse has to watch unskilled activities being taken place by the caregiver. Instead this bill would require that new rules be adopted to require a qualified supervisor to visit the home at a frequency that is aligned with the client's needs. Qualified supervisor is defined in this bill and it mirrors the definition from Texas. Because these services are unskilled services, it is not necessary to have a nurse, watch a caregiver clean, prepare meals, etc. In addition, the current payment model from DHS does not support an RE incoming to a client's home. This bill would eliminate that unfunded mandate. Having said that, there are still RNs from both DHS and Optum that are still involved in assessing these individuals, and this bill does not change that. Lastly, the rules currently require that a physical office be kept within a 50-mile radius of the client's home. This bill would extend that radius to a minimum of 100 miles. This bill will reduce unnecessary government regulation, will facilitate our regulations being more in line with Texas and Missouri and will allow home care providers to more efficiently provide care to their clients. I've talked to Representative Miller about this as he is involved with receiving this type of care, as is my sister, I believe I've talked to you all about that before, she was diagnosed about two and a half years ago with ALS, so she has unskilled caregivers come into her home and help her you know with bathing and cooking and things of that nature and it makes no sense that a nurse comes out to tell them if they're doing those things adequately the company can send out someone else to make sure that employee is providing the appropriate services i don't think a skilled individual needs to be overseeing non-skilled activities if have any questions, I'd be happy to answer them. The Game and Fish Commission wanted me to share with you that the current cost of a lifetime hunting and fishing license to the general public is $1,000. The proposed cost for the Disabled Veterans Lifetime Hunting and Fishing License is $52.50. This bill would double the reach of eligibility for disabled veterans and from currently 7,000 disabled veterans at 100% disabled to cover 14,000 additional veterans who are 70% disabled or greater. The Game and Fish Division, Department of Game and Fish worked diligently with the Department Veterans Affairs to get this language correct and charging the one-time cost allows the agency to get federal certification for conservation grant dollars for ongoing projects. It allowed municipalities to accept payments with credit and debit cards, including their transaction fees charged to the municipality. known at that time some municipalities that own utilities embed those transaction fees in their charge. Act 195 has the same potential, has the potential to create audit problems for these municipalities, thus the need for Senate Bill 583 today. Neither Act 195 nor today's SB 583 have emergency clauses, so if SB 3 is passed today, they will both take effect 90 days following signing die, correcting this problem before it becomes an issue. bill. Thank you, Mr. Speaker. Senate Bill 480, I understand, was presented in the House Insurance and Commerce Committee very ably by Representative Ferguson. I should have allowed her to come do this instead. This was brought by the Arkansas Hospital Association. It simplifies and clarifies contracting standards between healthcare providers and insurers, specifically by doing several things. One, it establishes the fundamentals of a healthy contract, which would be that providers and insurers should be free to contract separately with other parties. At any time, both parties should have access to a complete contract, including all amendments. Both parties should be aware in advance if any unilateral changes to a contract are made. Contracts should be reopened for negotiation at least every three years. And then lastly, terminating an existing contract should not be necessary for a contract renegotiation. The major insurance companies that this really has been addressing, Blue Cross and Centene, they removed their initial opposition to this, and the insurance department is neutral. As far as I know, there's not any known group opposed, so I'd appreciate a good vote.

And what that means, typically now with most insurance providers, you go to the hospital or the doctor and you sign a form saying it's okay for them to send the check to the hospital or doctor. And the advantage of that is that they know what your deductible is, they know what the allowable is, they know what your co-pay is. They take all that out and then they apply the allowable, not the amount they charge, but the allowable to your account. And then if there is a remaining bill, they send you a statement. In some cases, insurance don't allow assignment of benefits, so they send the check to the patient and the patient's completely confused, they don't get it to the doctor, then they end up going to collections or having a big bill. So all this says it says the patient may assign benefits. They're not required to, but just if they want to assign the benefits and let the hospital or doctor's office carry, take care of all those applying payments and then bill them, they're allowed to.
