And again I think if you read the statements from all the parties involved there is a ton of confusions and I appreciate in respect that they're willing to do an internal evaluation in and try to get understanding of what happened but the think the fact that they're having to do that requires us to take some action and so again I think you're going to innovate two issues which means that two separate committees should probably be involved in this discussion at first is the creation of the contract itself in its attempted ratification in our committee I think there's questions how that contract came to be it's not much different than contracts that we've had in his previously sent to audit are for much lesser amounts in that that had been any under investigation for quite some time now when we have an individual that was hired without a conversation amongst the board that was the best I can tell in even representation from the board the recommendation of one board member you had then you know the back and forth in the fact that there was really no board approval for the contract that was ultimately you know initially signed and then in ultimately signed none of that was approved and done correctly and make that appearance and so with it i'd make a motion that first that we see and page thirteen adam twenty one okay sorry page fifteen item nine to add it prefer the review. Madam sector if you would introduce yourself and your recognized give report yes good morning christian putting them secretary department of human services as directed by section fifteen about thirteen of two thousand twenty two i'm appearing to report the architect legislative council the status of our efforts to increase reimbursement rates under the living choices assisted living waiver dhs as continuing work necessary to implement act one ninety eight twenty twenty three which authorizes dhs to establish cost reporting for medicaid funded assisted living facilities and as you all know we've completed our first cycle of that mirrors and start for provided a draft report for review by all stake holders prior to completion of the final version on january sixteenth twenty twenty four dh received the rate study report from myers and stuff for and shared this information to all providers the rate say report also was presented to alc hospital and medicaid study subcommittee on february seventh additionally the cost report analysis was posted for public comment with that period ending on february sixteenth which was last alcee meeting DHS has compiled all the comments and posted responses as of march fourth twenty twenty four and those responses are a linked in the letter that you all received in your packets today you can find those online further in october twenty twenty three d has petitioned cms for approval to implement current appendix key rates in use for alpha imbursements as the permanent rates for the duration of the living choices waiver these rates are eighty one fifty nine for urban facilities and eighty five sixty seven for rural. Formal cms approval of these rates was received on january twenty fourth with an effective date of march first dhs now plans to petition CMS for approval to implement the new rate of eighty six seventy three which represents the highest resulting rate from the rate study report that was completed in addition dhs will also engage providers to discuss programmatic and policy change requests submitted during public comment. Further we're also updating the living choices provider manual to reflect the cost reporting requirements in act one ninety eight and these changes have been submitted for internal review and we anticipate submitting them to alc very soon. We're also continuing our broadbased review of the entire medicate system to assess options for longterm sustainability of the medicaid program assisted living payment rates and programmatic structure are part of this review in your cost reporting from medicaid funded assisted living facilities will now be completed on an annual basis with determinations presented to lc when they're completed that concludes my report. Because it seems like now the urban data the cost study showed it was cheaper operate in the urban they're going to they're actually going to receive cover bonus whereas the other ones are just going to be reimbursed to the cost could use talk through that rate now yes I will try to answer your questions when doing the cost report in previous years I think all the way back to twenty fifteen there were four tiers for this rate it was then collapsed into one rate in during the pandemic it was then divided back out into two rates urban and rural and then during the cost reports and the discussion of inflation factors and access fees last year's report I don't believe broke it out urban in rural I would have to go back to confirm that we did we chose to collapse it into one rate for simplicity it was night trying to penalize anyone and we were using everyone's cost this was the first time that we had almost a hundred percent participation in the cost report also so we had a direct reflection of their expenses do you plan on requesting any add on costs to the cms cm CMS rate or this is this is the final we do not plan to ask for add on costs we are going to continue conversations with providers about programmatic and policy changes that were identified during the cost study as well as considerations for inclusion in how we work with our alpha providers okay then one other question to representative fights request that's going to come up to the chairs to the committee when you track where the residents from the facility that closed when will you also do a study of the cost that follows themselves for example they ended up going to a nursing home where they ended up going to in home your facility can we track what the ongoing cost is versus had they've been allowed to stay at the facility where they were is that doable or not. Can you get us report at some point because all through this transformation process that we've been doing for sale not started with the administration but the prior we've never been able to get an answer of how much we're actually saving so i'd really appreciate if we could get some type of number showing what this consolidation is actually saving that should be a it'd be a good idea so we can actually tell our constituents while we're doing all this we actually are saving money yes ma'am and it'll you know what the arkansas initiative that's going right now with mackenzie that's one of their main objectives is to be able to provide that okay appreciate that could can continue mr chair okay the other question I have is in the budget that was proposed I think there was about a one point seven increase over all in the budget so did that increase include this increase so the one point seven budget that was presented to us last week did it incorporate these rate changes representative would you like a mister to come the table as the budget director for a state yes sir thank you. And. It just happens to be one more chair there rubber breakdfa it's not an easy question it's not all GR one point seven six's grnats that was in the rsa there are a lot more avenues that could it could be paid from federal could be special revenues could be other other items I will tell you just to be transparent I think community corrections will have a problem and we may have to help them out with that there are increase was quite a bit also there a couple of smaller entities that will have to help out but for the most part agency should be able to handle it but most of most of this will not be great but most of it will be with a federal revenue special revenues and in a and others okay so reading them between the lines what you just say it was not included in the budget that was presented to us last month that's right yeah I just want to make sure it's clear that this entire four million what it whatever the final number was and that that is not a hit on that one point seven six I just want to make sure that there's a portion of it that will be coming out of gr but that portion that was coming out of GR for this was not included in the budget that was presented to us last week is that correct or not that is true okay my net leads to the next question why was that if we know this was come in how come it was not included we didn't know exactly what the number was going to be they've been working on this for for quite some time but as I said the most agencies where it shouldn't have a problem absorbing this I will point out that what DIS is done in the last four or five years have been lowering rates and so the actual cost for it services if you look at it over that period of time it's still going to be less than they've been cutting rates bone by several million dollars a year. And so now it's it's time they've cuttle too far they're trying to give some of the recoup some of that so it was built into the budgets before it shouldn't be a problem now okay end so when we're looking at the appropriations that we did we're going to do for these in your staying multiple and can absorb it did we deep since they are moving are we moving any additional services is this no services removement or we're just actually increasing what we're charging. I believe they're increasing existing services so we're not adding in additional services to them that is correct we're not adding any okay all right alright thank you mr chair thank you. Sarahi recognize yes love that question you know just one thing you said other items would you explain that are you talking about restricted reserve accounts or what what would you be in reference to and if you say other items no so sometimes other other revenues such as central services constitutional officers find there are other avenues that this could be paid out of another and I just lumped those together but yeah again I like that question because anything that we see you know sensor i'm all for where we are with the one point seven six appalled the governor if we can actually do that but as we're doing as we're going through these next years if there's things that are recurring that are coming out of our restrictive reserve or other funds that were not in there then that unintentionally of misinterpretation of this budget so I appreciate the representative bringing that up and our hope by other members will be watching that closely as we move along thank you. Yes san hammer you just get back into sector hudson you're allowed to answer that yeah I just really stick that kind of pig back on center hickey's question and also represented cabinets. You know the the analysis that was done in terms of the the role that the f a had to approve these coming forward you was determined well enough the worst fish finding. And we do believe that existing GR is adequate within within the agency so it was taken into account except for the the notations that the robert may protect the community corrections one piece of this that I think has to get done particularly as we look at mckenzie but one of the things that the issues doing right now is identifying ways for that four million dollars to be reduced assistant avoided expense we have some inefficiencies and some unnecessary expenses that are currently in the bills that are going to the agencies they're being built for things that they're not using. Let me know they've signed up contracts for that we need to get out of and so there's an opportunity to fix some of this not on the revenue side below the expense of all inside and we've had meetings the agencies to identify what those opportunities are phone lines that can get discontinued I mean we're advertising I think in the white pages you know for the for telephone books and i'm not seeing one of those in a long time maybe you've seen them i've not seen them in in years things like that we need to be able to. To get out of help help reduce the expenses that's why make sure you all had that piece of information as well. Sent hammer you recognize. Thank you miss shared and jim to old dresses question some of the spin around here while those thought that embedded within the agencies or pockets of money that if they would have been flushed out you could have done things like what you're what you do and do you feel that where you are now the position the cheerion and with sectors that are in the position there in that they're going to be additional pockets or continue to be found because sometimes it seems like there's a deep embedded culture beyond the level of leadership that that just makes some of those things that you just mentioned hard to find so you feel pretty pretty good about the direction you're going in as far as continuing to have find these pockets within the agencies to be able to get this budget to the one point seven mention well my mom personal experience is that you know have obviously never. Spent more than what I should ride to me that's there's a tendency that's in the agencies when you get toward the end of the year in may. And you have access GR that is an opportunity to go order some things go order or office applies ago you engage in some purchases there otherwise not really necessary for that month's operations. And so I look at our historical pattern of the number of of the agencies you've had to come forward and say in the middle of the fiscal year you know I need a supplemental appropriation because I run out of money it it happens occasionally it doesn't happen across the board. It in that tells me their agencies do have adequate funds in hand. And I think we also need to understand a little bit more detail what that spending pattern is toward the end of the fiscal year the government has been very clear in her communications to the departments you know we should not be rushing to spend money in the year we all be turning that back southern the journal similar could make decisions about how that surplus is going get allocated thank you. Representative later thank you miss chairman there have been request i'm over here to come up with a savings report on the consolidation of the departments and I think that's great we need that but I think there also if you do a report like that there should be a cost of boyden's column that I know this you might not even be able to do this but what i'm saying is it we're avoiding a lot of costs by consolidating it departments so this is an example if we had ten departments that had the same base of system that they're using and the update came out and we had to buy ten. Updates versus one where you're using a central system you're that would be a cost of winds so I mean I think to be fair if we're going to look at what we're saving we need to look at what we're avoiding in cost increases they understand my question so if you're able to do that I would appreciate that column being in a report any report that you send to us. Yeah. Yes what I can provide that as well thank you represent kevin are you recognized thank you mr chair and I something secretary hurts and that you say I cannot made a light gonna mark it in how that goes so when you say that you believe that they had the funds available to sort of this additional cost well if we are believed that they had the funds we had to know that these rights were coming so what i'd like to know is how long after we approved the budget last week. Did you approve these rates. The. I believe I sound the letter. Friday of last week I think. Was that not the last day that we had budget hearings. And there was that was the day that we had last day we have budgetings yes correct so I guess. That's where my rub and all they say is my rob is not in the fact that you're having to ask for the increase my robe is that she didn't bothered included in what you were presenting to us for three days last week in your telling me you approved it on friday the last day hearing that is that my rob with this. So i'm just gonna be completely honest i'm a know on this thank you. The. How you see no further questions we have emotioned to review to have a second.
