present House Bill 12:13. This bill simply modernizes the capacity to care for Arkansans to align with the training, um, and scope for athletic trainers and physical therapists. Uh, it does a couple of things. One thing it does is it clarifies the definition of healthcare provider as it pertains to student concussion education. Uh, this is to amend somewhat of the working list of the AAA currently uses, and this is following a previous ISP um that was Agreed upon and also references
that these individuals have to be properly trained, uh, regardless of their, um, I guess, certification. Um, it also amends definitions of an athlete in an athletic trainer practice. Uh, currently to be an athlete, you must be part of an organized sport, um, so I mentioned this committee, so for example, if you tore your Achilles tendon in the legislative basketball game, uh, technically, the athletic trainer who assessed me was operating in a gray area because I was. May or may not have been an athlete, uh, despite
All the evidence to support my athletic prowess. Um. Finally, it also updates how an athletic trainer practices. Um, so what this does is this move it uh includes the the scope that these athletic trainers have in their field work, which is a much more acute, arguably more um complicated setting in that expands that into the clinical setting under the direction or consultation of a physician. So with that, I will.

Arkansas, there's a provision for neuropsych techs to work in Arkansas under the supervision of a neuropsychologist, a neuropsych tech has some very specific training, uh, to be a neuropsych tech. What we're doing with this bill is we're softening that training and creating a new title called Just a Sock Tech. So a sock tech will now be able to practice under this new law, um, with the qualifications of having a bachelor's degree in psychology and be able to practice under just a general psychologist, not a specifically. neuropsychologists. This is expanding the workforce and creating a broader group of
people that are able to come in and practice, uh, with the psychology degree and a very professional way. The other thing we're doing is we're expanding it so that the so techs that we're creating will be able to help with fitness to proceed exams. These are exams that are very difficult in creating a backlog right now in our county jails with regard to, uh, people that are waiting to be evaluated for their fitness for trial mentally, um, and so we're hopeful that by expanding this to this group, we're gonna be able to allow. Psychologist, a, a better way to sort of undo that backlog. So, um, it's a good bill. It's
agreed upon through the psychologists and we would be happy to answer your questions. Seeing that, thank you. I appreciate

This is the Some of you guys know last round was a little more difficult with the ag boards. So I took a lighter approach and just doing the ag reports. This is a department bill. There's 6 ag reports right now. State Plant Board, Buffalo River Conservation Committee, Arkansas State meat inspection program, farm to school, research and promotion boards and Department of Annual Report. So right now, the Department of Ag has to do 6 separate reports and submit them to the governor and post them
online. All this is doing, the department would like to do it all in one report. The same information is still there, still have to deliver. to the governor, still have to put it on the website. to be on the committee and the proposed amendment would, um, Provide that exactly 3 registered foresters from the commission plus non-commissioned ad hoc members and a UAM representative served on the committee. As a result of, of commission hearings, uh, would benefit from the input of Forester members, uh, without issues of being able to reach a quorum, which has been the problem and the need for this legislation. It comes from the Department bag at their request. And with that, I'll entertain any questions.

Good morning. Um, so I'm presenting Bill House Bill 1307, which is a
pretty straightforward bill. It's designed to ensure that we have transparent and responsible management of our university endowments, um, for colleges and universities and basically what that means is we don't want to play politics with the endowments of our universities and colleges. The singular goal is to protect these funds by ensuring that the funds are invested responsibly to maximize returns and to serve the interest of Arkansas taxpayers to
ac com pl ish this, HB 1307 amends the uniform Prudent Management of Institutional Funds Act, known as UPIFA, um, to prioritize financial responsibility by prohibiting investment decisions based on environmental, social, or governance decisions or ESG decisions that do not yield the best financial returns. However, if a fund Does, is it an ESG fund and it does yield the best return, you can still invest in it. So this is not prohibit investing in any funds. It simply says you have
to invest in the best interest of the endowment. Um, it also adds some enhanced transparency and accountability by requiring, uh, documentation if they, if someone is investing in a fund that doesn't abide by these rules or and it also requires just an annual review of the funds that you're invested in to make sure that we're, uh, returning. the best returns for the universities. So in summary, this bill reinforces the original intent of the National UIFA, which is long term financial health, donor trust, and prudent
financial management by ensuring that public funds are managed in the best interest for Arkansas citizens. And with that, I'd

Like Mr. Speaker. Um, I'd like to tell you how this bill come about, um, I was at a national convention last, um, last
summer, and, um, there was a presentation made in uh, they were telling about a lady that was, I think 92 years old up in um Minnesota. And uh she was on fixed income and was unable to make uh her uh tax payments on her, I believe it was a um. Duplex maybe but um. They, um
They rocked along there for several years and in the $2700 that she ended up going into a little over $12,000. By that time, the state moved to take her property. Unfortunately, they sold it for $40,000 and didn't give her back any of her equity. Or, or, you know, the, the difference between the 12,000 and the 40,000. So I approached that, um, that group and, and then ask them, you know, is there any, any, uh, body in there. Or in statutes in Arkansas that would allow that to happen. And
so they did some research and found this particular part of our code would allow that to happen. And um this is the same group that took it to the Supreme Court in 2023. Supreme Court ruled that that wasn't taking, that you can't take property without just compensation. So, um, that's basically why this builds on the floor today. We need to distract this language out of the, uh, uh, out of the code, uh, the land commissioner's office is in full support of the bill. They they even sent their attorney to help me present in the, uh, in the committee.

is a very simple bill, um, As all of you know, Governor Sanders plans to make Arkansas
the outdoor recreation capital of North America. Um, this bill is one of the bills the governor referenced in her natural state Day press conference, and it is intended to clarify the rights and responsibilities of both the outdoor recreation operators and the participants in these activities. So this bill was modeled after Colorado, West Virginia, Virginia, and Idaho. We looked at all of those statutes and modeled this legislation after that. So the crux of this bill is real simple, mountain biking,
rappelling, those type activities are inherently dangerous, and if you choose to engage in those activities, you are assuming the risk of those activities. That's all this bill does. Um, again, this is part of the governor's legislative package. There's no non-opposition. Saying no questions, I'd appreciate a good vote. Representative Maddox has explained the bill.

Thank you Mr. Speaker, colleagues, I'll try to be somewhat brief, um, However, I do think I have to explain some
of this bill because there's been some what I
would say disinformation placed out there about this bill. So again, I'll try to be brief, but I, I'm gonna try to explain it. So let me start by saying what this bill does not do. This bill does not expand alcohol sales in any way in this state. All this bill does is allow grocery stores and convenience stores to sell the product that they are currently selling. There's absolutely no expansion of that. And those products, as you probably know, are beer and
wine only. So these grocery stores and convenience stores are selling these products. It just allows them to deliver these products. In 2021, this legislature passed a statute, as most of you remember who were here, and we carved out an exception, and we allow liquor stores and microbreweries to deliver their products now. So I want to be real clear, liquor stores can deliver liquor. And can deliver all of their products under a law that we
passed in 2021, OK? So we carved out a winner and we carved out a loser, and this bill helps rectify that situation. This bill does allow for third-party delivery. There's been some questions about that, so I want to talk about it. This third-party delivery statute was modeled exactly after the Texas third-party statute. Third party delivery statute. Exactly after that. They passed that in 2021. Um, every state
that surrounds to see if I can do it. Texas, Oklahoma, Mississippi, Missouri, Louisiana, Tennessee, they all allow their grocery stores and convenience stores to deliver beer and wine. Every single one of them. 2/3 of the country allows the delivery of beer and wine. So this is not some radical policy shift. This isn't anything that's not happening. It's happening all over the country, and I can say, I mean, I think we can safely say that there are no problems. Now, how can I say that? For instance,
Texas is in session right now, and there's no bill to repeal delivery or repeal third party delivery. All of the states around us do it. They haven't
repealed it, which means it's working. That's all this bill does. Um, there's been so much
disinformation, I have to discuss it. Anyone who engages in this delivery will receive annual in-person training. So let me say that again. Annual in-person training, so stricter than the
law that we have now, um, they will have to receive that in-person training. Um In this training, ABC will oversee and they will teach them how to spot for fake IDs, how to spot 4. ABC has been involved throughout this process. Obviously, they can't endorse, but they have no objection. I think I can say that. You know, I want to talk about some things that um we're not changing. So In Arkansas, it's a class D
felony to knowingly sell alcohol to a minor. So if anyone does that, they've committed a class D felony punishable by up to 6 years in prison. Um ABC is gonna tell them that in their training. A delivery driver, if you do this, you've committed a felony, um, punishable by prison time. If there are problems, ABC will revoke their delivery permit, which obviously they do not want because they want these permits.
So the question is, in all seriousness, why the grocery stores want these permits, want to be able to to, excuse me, to deliver because they want, because their customers are asking for it. So right now, as a customer of a grocery store, they, they bring you your groceries, but they cannot bring you the one bottle of wine that you would normally it also with their groceries and their customers are clamoring for it. So we're giving the right for them to serve their customers, we're leveling the
playing field from the carveout that we did in 2021. Um So what does this do? This promotes competition. Who wins when there's competition? The consumer wins every time. You get better with competition. The consumer wins. Pricing service, etc. So all this does, I would characterize this bill as a free market capitalism bill as a competition bill. These stores, to be clear,
are not selling anything new that they don't already sell. OK. Same thing, they just get to deliver just like the, um, you know. Sometimes in here we get to right or wrong or do something, fix something that we did. We're gonna fix something we did in 2021 and level that playing field. And allow for competition. Um I know this is a hard vote. I do. I know this is a hard vote for, but what I would, the last
thing I want to close with is this, um, Like it or not, some people are gonna choose to partake in beer and wine in our state. They just are. You know, and we, we can be for that or against that. It doesn't matter. What this bill does is it gives them another opportunity to stay home. To stay off of our streets. And to keep us safe. That's

So right now, frankly, um, a lot of people have their groceries delivered to their house, and you don't have to go out there even. Um, it's just on your porch. This is not that.
