lawsuit in order really to get those records and so what this does is it closes the loophole and it says that if after filing suit. The person who requested the records has obtained from the defendant a significant or material portion of the public information then you're entitled to fees unless the court finds that the position of the defendant was substantially justified so and that's what the bill does one of the amendments that we work through is that we clarify and section one which is a do not codify section that this will not affect any

but what this legislation does is it brings Arkansas online with the American cancer society's recommended guidelines and national standards for colorectal screenings by lowering the screening age from fifty to forty five and I believe that this will save hundreds of lives every year across our state and we have I have worked with insurers including Blue Cross blue shield that add to ensure that by lowering that age from fifty to forty five that the colonoscopy will continue. There's a lot of people that died of colon cancer there's a lot of people that survived colon cancer we have one amongst us. And he's my friends. And I am so glad and blessed that god provided. The opportunity for Lance Eads to be a survivor. Because he's going to come and speak on this bill in support of it because he's a cancer survivor of colon cancer. And I appreciate his bravery and I appreciate him being a
survivor telling his story. My grandmother died of colon cancer. My and friends. And. Desiree griz walled Auster has been last year to calling cancer. And so this legislation is before you can read it lowers it lowers the age from fifty to forty five but it deserves our attention it deserves our attention because this is a policy that's actually going to change things and help save lives this is this is a bill
that's actually going to be good effective policy to make sure that people now started at the age of forty five are going to be able to have those screenings and have them paid for and then have the follow up colonoscopy also paid for and covered under their insurance which is going to prevent a lot of headache and heartache down the road and a lot of financial problems for that family and for that patients and so you know it's incredibly important that we understand and that we speak for any of those that are out there
listening that if you get a screen name then your chances of surviving colon cancer is ninety percent you have to have early detection you have to get the screenings you have to go to your doctors and you need to get these exams because if they find it early enough they will be able to save your life and you will be able to beat the cancer. You know I know people that are young and as young as twenty one years old that hi Colin Oscar bees that have had polyps
removed from their Collins. And I called and got the appointment and then they were working everything out and then they say oh and I got a concert you'll need to bring your copay of the seven hundred fifty dollars.
And I just said hell no I'm not gonna do that now I shouldn't have done that but it is a consideration for a lot of people unfortunately I'm now Senator on the Arkansas. Health benefits program and I recently at the behest of the same women that are always on me to do the right thing. Had a colonoscopy and fortunately I did there's no cancer anything found but it made me think about how I put my
life at risk over three hundred dollars hi Conforti the seven fifty I just decided more spending at that time I hope your bill or I'm really asking would your bill help stubborn type what people like me to go to some that might save their life. That is the question. I don't know if I can help your case. In particular you that
You know what I think it's important that we understand that the American cancer society as well as the United States prevention and task force on prevention studies made the recommendation to lower the age from fifty to forty five and so it is important that our insurance companies follow along that recommendation nationally and that they do cover the expenses of the screening test and ask medical technology improves it's important that we
have the ability for those patients who are paying insurance to be able to have those screenings paid for and covered under their insurance plans and then if there is a positive that there would be then follow up colonoscopy because yes it could save your life and you know if you can prevent that then you know you can save yourself from an extensive surgery and you know the risk of not being able to survive something that's absolutely survivable and you
know that's my whole hope is that people will understand and put things into perspective we we can pass laws all day long but if a person doesn't have a perspective about what their life is worse to them and if you know six hundred dollars for an MRI that may be out of pocket is worth it for them then you know I think we need to do a better job of understanding financial perspective right because you might not think twice about spending I don't know six
hundred dollars on something else and so. When it comes to Madison and when it comes to health care in accounts to technology that's available people need to understand. There are times where you have to spend the money and you need to spend the money on yourself and on your loved ones because then that means that they could be with you longer and you can't put a price on those days and you can't put a price on that time that you got with your loved one when they survive that cancer. If this bill from moving from fifty to forty five eliminates that possibility for one person it's worth it to me and who knows the people that we've known maybe if they would've gotten screened a little bit earlier that might still be with us that if passed on because this cancer so it's very preventable death from this if they get the early detection early screening and I would very much love my colleagues to support this bill thank you. I hope you know if you ever wondered ever wondered why you put some off and then. Years later when it happens to you say well it's not only done that I wouldn't have to be going through this back in two thousand seven my dad had colon cancer. And the. I learned them by talking to the doctors it's two most preventable types of cancer or colon cancer and breast cancer. All you have to do it's a it's a very simple procedure but for
the agony that and the change of life that my dad went through with having the colostomy and have to live with it which finally killed. this is such a simple simple thing that we we can do to prevent such a horrible thing are coming out of it so you know I can't imagine anyone voting against this but I just want to say it's something it's something that we can prevent we know we can prevent doctors of. Push this for many many years but sometimes we just put things off and put things off I've
talked to friends and urge them to get one and they said well you know I just don't want to. I don't want to drink all the garbage and cultural that's such a small price to pay for saving your life and going through and having to deal with cancer so I just encourage you to vote for this bills good please let. and somebody can use three Q. alongside science of reading so it's not being and totally is not being totally but they have to have some reading but it is it can be used as a supplement yes because we had a lot of kids learn visually yeah that's what's troubling me is we have so many ways that children learn and become concerned when we say they can only learn this way no the that's the that's what we had done in the past and that's not we will see the sign to reading we know works for more kids and any other does pop FOR
but we're not banning any other but we want to be sure the science reading is in place right and just for the record at one point we were eighty one percent reading literacy before the signs reading and I guess we have to be more deliberate would you agree and the fact that we must teach our children and teach them constantly yes thank you. I have a daughter that was diagnosed with dyslexia not as a young person but as a sophomore in college. And she struggled with this she just worked harder and had people say well you're just lazy you don't really want to spend the time and all this and through my life I've seen how. This issue has involved. A and how we've learned so many things and one things we've learned is how
the brain works and we have some brilliant scientists out there one that comes to mind Dr Tim Conway in Florida and he is worked with many states including The son of one of our state representatives is also involved in this issue of this is not. April this is something can be dealt with if the the young person and and not already problems are exactly the same. but by going through the process
that Senate Clark's bill helps create we're just going to reach so many more kids and and more kids will be able to read you know K. three you're you're learning your rate fourth grade above your reading to learn as I've probably said this well more than once those kids that don't get it by the third grade a high proportion of those are the people is to seeing in productive life end up in department corrections and other things because they give up on the positive side of life so
this is a great bill it it moves in the right direction and I appreciate a good vote thank you. Occurred I recall having a conversation with my friend who was a third grade teacher who. You know obviously we the whole world wish was just shaken to its core when that horrible incident occurred at sandy hook and my friend who was a third grade teacher said instead of my student asking me what's on the menu for lunch. Or when is recess the question was midshipmen where do we go and where do we hide if somebody
comes and start shooting at us this is a question from our third grade students. And so that started my relationship with Dr Cheryl may with the criminal justice institute who I worked with to create and write the school safety act back in twenty eleven to twenty thirteen.
So from that it has gone through several revisions and a lot of people have worked on this but at the end of the day what the piece of legislation has at in front of you is to creates at an update to this legislation that is based on the recommendations from the Arkansas school safety commission and that school safety commission was created by the governor after parkland Florida in twenty eighteen so the purpose of that commission was to advise the governor and to the department of education I'm on school safety across Arkansas so I'm at the request
of the governor the criminal justice institute Arkansas center for school safety which was created as a result of my initial legislation they were directed to develop and to administer an extensive school safety assessment survey and I will like to say that over ninety seven percent of the schools responded to that survey which is tremendous that we had a ninety seven percent and put on the school surveys about school safety so what this legislation does is take those
recommendations from that survey and puts it into a bill to ensure that schools are collaborating with local first responders in conducting audits in lockdown drills the completion of a comprehensive school safety audits using best practices every three years ensuring that schools share floor plans with appropriate local first responders recognizing the Arkansas center for school safety as a state school safety clearinghouse for training and resources that will assist public and private schools and implementing
effective school safety strategies and assist public schools in meeting the requirements of the proposed legislation and also is providing youth mental health training for school counselors school resource officers and licensed public school personnel and implementing effective school re. Source officer programs and schools to not only protect mitigate respond to but also to help prevent violence in schools so this is a comprehensive overview of the legislation I'm happy to answer any questions

resource officers complete a specialized training. Senator you're recognized thank you senator thank you members this is the second of which is kind of a companion to the other bill that Iran and what this does is it requires that there be a memorandum of understanding with the school with their local law enforcement which is very very important because you might have a school within a county jurisdiction or within a city jurisdiction and right now some do have memorandums of
understanding some do not I think they all should because it's very very important to have clear dialogue clear communication about chain of command and you can see that language in this bill as to what those memorandums of understanding would require also and you have some situations where the school resource officer might be working for both the school and for the local law enforcement agencies so those roles and responsibilities of the school
resource officers as well as the clarification of as of financial responsibilities need to be very clear between the two parties so and if you look in the bill also this allows for the department of education to promulgate rules and regulations and working with the Arkansas center for school safety on the memorandums of understanding so they're going to put together you know kind of a a a model I guess not memorandum of understanding that
that we would like to see at put in place for our school resource officers I think it's really important for school resource officers to have appropriate training and that's the second part of this bill so as yes there is a we have in the bill eighteen months I think we preferred twelve months I think there are others that preferred two years and so eighteen as where they landed on that language and so but again that is training after
they have been gone through the training. For a law to be a law enforcement agent themselves but we would say you know we would absolutely strongly advocate that training for school resource officer is very different because you're on a campus with kids And so includes a variety of things but one of the things that we want to make sure that it includes is youth mental first youth mental health first aid on so you can see that part of the bill there's also a requirement for a refresher course to to be Hill held after
five years of initial training and then second the last part two is that a school a public school district superintendent or school principal he does have a school resource officer on their campus needs to also complete a one hour training because that employee is very different than the other employees on their campuses and how they interact and so I think it's very important for the people that are in charge of that school campus to else understand that new dynamic of having a school resource officer making sure that all works
together so I'm happy to answer any questions this was a bill that was developed like I said in coordination with all the stakeholders to get us to a piece of legislation that was agreed to. Thank you Mr president houses affect training command whenever there's a crisis situation school so how does it terminate if it's a school resource officer has jurisdiction whether to local police department is addresses some other part of the
bill I was confused because I had a memorandum how that works it doesn't this bill does not determine the chain of command but what it says is y'all need to determine that and have a memorandum of understanding as to what that chain of command looks like and how you're going to effectively respond to an incident on that campus so it really says to the school district and to the local law enforcement agency with a house that jurisdiction and not like I said it could be a county sheriff's office or it could be
the police offices cities jurisdiction or it could be a combination of both what we're saying is you need to have that dialogue on that conversation and you all need to have a memorandum of understanding so that's very very clear how that and unfolds in a response. Senate foreign recognize the follow up so if. The school district. Does the local PD and enter into a discussion and they can't resolve the issues of chain command the other things.
Well the school with the school not be able to actually deploy a school resource officer because I didn't sign a memorandum that's my question is so if I'm working with PDSA no no we want jurisdiction by the law and we can't reach understanding and I don't signed a memorandum of the school board can I still have a resource officers that preclude me from doing that case there is that conflict. I think the objective of this is that it's it is it says shall enter a memorandum of understanding with the local law
enforcement agency with jurisdiction so it's it's clear that a school district board of directors that accepts as a school resource officer shall enter into a memorandum of understanding with local law enforcement. And Kerry is causing a school districts have their own police departments now and in the way that bill as written was for it it was designed to be just like
higher ed how they can have their own police departments on campus so do they not like jurisdiction was already written into that law and so I'm just curious like how that impacts and school police department says they already have jurisdiction laid out and and if this is needed here do we think that it's needed with higher and. On campus you know because they they have the same law. Campuses and schools right I mean so what what again this addresses it doesn't it doesn't
change if a school wants to do that what we're saying is there needs to be coordination. Because it's not just going to be the schools police department that's going to respond I mean if you have a shooting on campus it's not just going to be the school resource officer or the campus police department that's only going to be the responding law enforcement agents it's going to also be your your police or sheriff's office or whoever is within that jurisdiction that they are residing in and so what this
bill does is that we're saying we need to have clear communication y'all need to communicate clearly so everybody knows what's the plan. So that we can all make sure we know what the plan is we know how this is going to be executed and that's going to print that's that's going to save lives and so that's that's really what the bill does it does that doesn't affect anybody's ability to you know to have a police department that's what they choose to do what we're saying aye you need to have some coordination with your local law enforcement as well.

way regarding the training It is a good thing when we have SROs in our schools and they know our kids and they know the culture of our kids and they know how to deal with kids but the cultural aspect is the thing that I'm most concerned about as I said yesterday in the committee itself. It is awfully tiring to the US for beyond the black person in the room. And always having to make this
speech and I will say to you it is very tiring and how I wish more of us would even learn this are just speak up about it. Because it's not even fair for us to keep presenting things and talking about issues and have Senators Chesterfield or me or in this case I'm talking about myself because I'm just so tired of doing this but here is the problem that I want you to think about and that I wanted to be on record about for all the people
who are making these decisions the sponsor and the administrators association did work together to change it from two years to be trained two full years to eighteen months that's a compromise. But I I think it is still way too long so my request and what I wanted everybody to think about doing especially so we don't end up continuing to see unless you've been support somewhere under a rock you've seen what's happened to black
boys and girls in our schools with SROs and that is by no means every SRO but it is by every means too many boys and girls who have suffered at the hands of an SRO that I can't swear this is the reason but I know it's a big part of what goes on you don't know the culture of the kids you don't know how to be responsive to a child maybe with a disability or you don't know that when a child says something that is your responsibility to find a way to
react because you're the adult and you should be trying. So might ask of people who are going to make sure your SROs are trained if you don't do anything else in the first month make sure they are trained with cultural competence because you can do that online there's no excuse for putting an adult and our schools who does not know about the culture of the kids he or she has work are working with so that's my S. the thing I want to say publicly.
Be sure we have adults who know how to work with their kids I'm please don't take this lightly if you do get online and go look at somebody throwing a girl flat on the floor and stomping on her and that kind of thing. I don't want to look at it if you don't know what I'm talking about otherwise I do think we need this bill it is a good bill but it is lacking in that regard regardless of that attempt to compromise thank you. Senate has spoken on the bill
anyone else who we speak for against the bill. Anyone else to speak for against the bills the nines Senator Davis got to give me more than that on the bill. Not only speak on it because I have questions but we're out of the question period so. My concern is that it does go beyond just M. jurisdiction it talks about and like in there in a year it has to include the
process of selection for school resource officer the process for evaluation and and other things like there is a reason that we gave schools the ability to have school police departments and because they were arguing with cities over or over. When the police officers could be on campus so originally they were sort of borrowed right like the school would take a city police officer or county officer that would be and title the school resource officer in the
school would help pay for it but then that city that city police department or the county could take that police officer off campus at any time and so then you are left without officers on campus even though they were school resource officer said there was a very specific reason for giving schools the ability to have their own police departments and also it allow them to hire maybe retired officers and so that we could have better training experience
officers on campus dealing with kids and so I'm I'm just concerned that that the MO you is not just about jurisdiction but it's about and the process for selection of officers in evaluation which is something that we try to get away from originally when we ran that school police department bill the first time so those are just my concerns on it and I those questions came up after the time for questions so I just wanted to address those. To establish a process to review presidential executive orders to allow the Attorney General to review presidential executive orders and to address implementation of a presidential executive order under review center guarding recognized thank you for the under the bottom
ministration we seen an unprecedented use of the executive order. In less than twenty four hours after taking office Biden issued fifteen executive orders more than the last four presidents did during the first two weeks as of today. Bein has issued more executive orders than any other president in recent history during that same time if you look at these issues that he's addressed it's a wide range of controversial issues such as promoting government intervention engineer
identity Lessing border security and stopping the building of the wall allowing government funded abortion for non profits and much more. Senate seeking legislation legislative approval track in the sense that the complex issues Biden has a side to rule with the pen. To be fair bond isn't the only executive branch you've done this last twenty thirty years it's become a more more problem where the executive branch's uses negative orders Sir to
surplus are to supplement and go around the legislative authority. This is become a problem for the states so that the state of Arkansas needs to set up a process to address to protect our citizens and make concrete actions if needed. This bill would do three things. Referred to allow the General Assembly to review executive orders and the impact of the exact words will have on Arkansas. President had two hundred and twenty total executive orders in four years he almost had as many in four years as president Obama President Bush did why we didn't consider doing this a couple years ago obviously we know that the government doesn't function in Washington like it does in Little Rock but it appears we're trying to import something from Washington the calls government not to work in Little Rock so I just wonder why we didn't do
this under president trop when he was so much more prevalent with executive orders them this president. It's a great question because one if you look at the pace of the body ministration he's actually on pace to outdo the executive orders done by president trump secondarily while these issues were very important like I said I think this is an issue that's been going on for many years and it finally came to a head for many citizens who have been reaching out to me to address the sensitive issues now course president trump did pass and controversial executive orders
