Thank you Mr chair my colleagues I'll be brief with this and then assets resolution be read in its entirety but I this resolution recognizes achievements of an individual that is in my district and has operated the observatory among many other things that he's done in his life for over fifty years is a privately funded observatory that is not only nationally but internationally recognized so with that I'll asset the resolution be ready sometime. whereas in nineteen seventy one under the design and directorship of our cans and P. clay share the first facility of Arkansas sky observatories a SO was constructed in central Arkansas with more than with more state of the art scientific research centers to follow and we're as Mr shared and A. O. develop one of the first confirmation stations for the Harvard Smithsonian I a you a minor planet center director Brian Marsden within only two years serving correct professional astronomers for nearly fifty years in the

April fifth twenty twenty one dear Speaker Shepherd president Hickey members of the General Assembly pursuant to article six section fifteen of the Arkansas constitution I inform you today
I have vetoed house bill fifteen seventy I was told this week that the nation is looking at Arkansas because I have on my desk another bill passed by the General Assembly that is a product of the culture war in America I don't shy away from the battle one is necessary indefensible but the most recent action of the General Assembly while well intended is off course and I must veto just as importantly as a House bill fifteen seventy becomes law then we are creating new standards of legislative interference with physicians and parents as they deal with some of the most complex and sensitive matters involving our use it is
indisputable that the population of miners who struggles with gender I incongruity and gender dysphoria is an extreme minority but while they are minority they deserve the guiding hand of their parents in the consulting of medical specialists possible fifteen seventy would put the state and if if it's a definitive oracle of medical care overwriting parents patients and healthcare experts well in some instances the state must act to protect the life the state should not presume to jump to the middle of every medical human an ethical issue possible fifteen seventy as opposed by
the leading Arkansas medical associations and the concern expressed is that denying this practice medical care to trans gender youth can lead to significant harm and the young person from suicidal thoughts to social isolation increased drug use in Arkansas gender reassignment surgery is not performed on anyone under eighteen if house bill fifteen seventy simply prohibited gender reassignment surgeries that I would sign the bill. But the bill is overbroad extremely does not grandfather those young people who are currently under hormone treatment in other words the young people who are currently under the doctor's care will be
without screaming when this law goes into effect that means they will be looking to the black market or go out of state if they can afford it this is not the right path to put them on finally understand that the General Assembly will likely override this veto house bill fifteen seventy has overwhelming support when it passed the first time I'm hopeful that my action to cause conservative Republican legislators to think through the issue again and hopefully come up with a more restrained approach that allows a thoughtful study of the science and ethics surrounding this issue before acting thank you and I look forward to continue our work on the many areas of of
agreement that we have in common with respect and appreciation I am sincerely Asa. Represent Lundstrum for what purpose. Mister Speaker privilege matter. seventy. Thank you Mr Speaker. We've been through this bill so I won't hit every single point. But I do think it's important to have a few things that have been discussed.
First of all I want to thank a few folks. I want to thank family council family Research Council heritage foundation focus on the family the state's McAdam me Franklin Graham and our own Surgeon General Greg Bledsoe. And the women's liberation Fund one of the left radical feminist groups who've come out in support of this bill. On addressing specific issues that were just addressed that H. B. fifteen seventy is a product of cultural war that is true it is a product of cultural war
because our children stand as pawns right now they're minors and their children and they need to be protected from two things well surgical and chemical sex change procedures I'm thankful that the surgical is not occurring but the chemical is. That H. B. fifty seven is off course no it's not of course it's a specifically targeted on course built to protect children in Arkansas and we should be very proud of protecting our children.
If H. B. becomes law H. B. fifteen seventy comes law we are protecting the standards now. We're setting a standard and we should set the standards of the highest standards. I think it's important to review some of the things that we do and the state we tell children under twenty one you can't have alcohol you can't have a tattoo. Yes my. We even tell women under the age of thirty that you can't have a
tubal ligation because there might be regret. We even say no on behalf of the state of Arkansas for children not to have sexual intercourse because they don't understand the long term consequences under fourteen is considered rape. If the governor brought up that H. P. th H. B. fifty seven overrides parents health care for inpatients we have done that before on a number of things try taking your baby home from the hospital you can't do that without a car seat.
This is an FDA not approved procedure this is experimentation on children with long term health effects cardiovascular C. rebroadcast girl of the brain is not fully developed this is harmful to children they need to get to be eighteen before we make those decisions. Leding Arkansas medical associations oppose it. You know what. Even medicine sometimes is wrong we should never experiment on children ever.
Denying transgender health care this bill does not deny health care I want to say that again this bill does not deny health care it does not deny counseling it does not deny health care to say that is wrong anybody that says that is choosing to lie and is choosing to scare children and their parents I would ask that that not be said this bills stay specifically on one subject and that is it counseling is important it's extremely important. We need mental health care to do anything else is wrong.
Finally. We need to remember that we need to protect children. We must follow the science. We are told along these days following the science well when a sperm in a get together and those jeans collide. Guess what a boy or girl is created those children need to know that their loved they're seen they're protected they have health care they have counseling.

to reiterate that I want to thank the doctors and I want to thank the parents and I want to thank the the Braves use that have come out and talked about their experience and their knowledge. And their choices and I do not think that these children need to be protected from their whole their own parents of. Yes counseling's important but so is medication and that the chemical stuff saves lives.
And I agree we must follow the science and I agree we must follow best practices because this is life saving care in lots of cases and I just ask you to. Put aside politics put aside lobbyist put aside everything and to search your own heart and think about these parents in these children and their doctors because I feel like if they could have the same conversations that they've had
with the governor and others in the last couple of weeks with all of us I think that most of us would come to the same conclusion so I please ask you not to override this veto thank you. These children right now with this procedure going on have a
nineteen times higher suicide rate. That should all make our hearts stop. They deserve health care they deserve not to be experimented on. This is not best practices the food in my drug administration has not approved this because it doesn't work these children need care and love. They're gonna be children now in in in ten years from now we're gonna be wondering where were the adults where were the people that had the courage to say no. I'll close with this.
Cowardice asks the question is it safe. Expediency asks the question is it politic conscience asks the question is it right. And there comes a time when one must take the position that is neither safe nor politic nor popular but because conscience tells one it is right Martin Luther king. added to ensure that the expense would not exist in the absence of the campaign I think the amendment addresses the concerns more closely matches that positive ethics commission ruling so that candidates are not having to go every time for case by case approval appreciate the reconsideration I'd appreciate a good vote. I certainly understand the need for child care why you're campaigning we had our very first campaign when my daughter was under one years old that daughter is now twenty one we've had three additional children after that for a total of four my husband and I together have had about twelve different campaigns I know what it's like to care for young children while also on the campaign trail and I want to tell you what I did and
what my husband did we brought along. And that's a beautiful thing we need to engage our youth engage our children so that they can see. But there's a world outside of them. They went with us to the parades they went to work with us to the debates they went with us to all these meetings some of the meetings they'll probably tell you were extremely boring but they certainly learned how to sit still and be quiet and those meetings that we felt like they probably wouldn't enjoy quite so
much or might be crying or something like that I'd kindly ask someone who was there would you mind assisting and helping my my children in another room I brought crayons people are always willing to help on those rare occasions when we couldn't bring our kids along you know what we did we asked a friend and supporter someone who wants to help in your campaign but doesn't really know how they can help and so our kids might go over for a playdate with another friends and they had a great
time we engaged our students right to engage our well I guess they are students too but we consider children in our campaign it was beautiful I don't regret any of that. Now what we're talking about today is using campaign funds I don't think there's anybody who has ever donated to my campaign or to my husband's campaign and expected us to use it for child care. That is a personal expense my
children are personal. They are not a campaign I had my children before the campaign I have them during the campaign and I have them after the campaign. They are not a campaign expense. There are personal. And the law very much says that a candidate shall not take any campaign funds as personal income.
And it goes on to say the purposes of this section a candidate who uses campaign funds to fulfill any commitment obligation or expense that would exist regardless of the candidate's campaign shall be deemed to have taken campaign funds as personal income my children or commitment my children have obligation my children are expense. It's our duty and responsibility. Now I will say that just a little side note here sometimes
having those kids with us at these events certainly bring up some interesting memories that we can look back on I do remember one time holding my my daughter who at that time was still in diapers and I'm speaking at an event with my husband and. We kind of had a little accident and there was quite a puddle. You know it's not always the easiest thing to bring them along I get that. But if we follow this logic that it's okay to do this.
Because Monday nights we normally would be home with their kids and instead were out campaigning. Follow me would wear this avalanche can go. While we're out on the campaign trail my house is a mess a huge mess can I now hire a maid to clean my house. The grass starts growing tall outside because my husband can't quite get around to mowing it is quickly. Can I now start using.
Campaign money to mow that grass. I hope not. And then yesterday we just passed another bill that brings this into even more questions that we might be able to use it while we're actually in office. So I hope that you can stand up and understand this is a personal expense I understand the need but this is not the way we solve the problem thank you president Collins for what
purpose question you're recognized thank you can we use these expenses as campaign expenses now under the current law from the other ethics commission's ruling said the ethics commission ruled but that's not law. We are the lawmakers and we can change it and as a matter of fact I've asked BLR to put together a bill that would specifically say that we will be taking childcare out make it very clear that it can't be used for that so I would appreciate a
good vote on that too when I bring that bill forward thank you. Represent Mayberry spoken against the building would like to speak for the bill represents eve you're recognized speak for the bill. Members last time this bill was brought up there were some pretty valid questions as related to carryover funds and as a result of that distant by a bill is brought back to rules all that has been clarified you can only use it while you're engaging in campaign active you can't use it once you become elected into the question of

The use of campaign funds to pay a candidate's childcare expenses shall not be considered a taking of campaign funds as personal income if the campaign funds are used to pay for child care for the time the candidate is engaged in campaign activities it's already permissible this bill would simply make it law and you don't have to go that the commission asked this question every time it comes up when you have an opponent I

Federal Election Commission treats streets federal candidates I do share representative Mayberry is concerned about you know where might we go in the future but I would just say this bill is so narrowly tailored that it doesn't include any of the other things that we're worried about and so because of that I feel comfortable voting for today thank you. Arkansas is only one of two states us in Mississippi the in this region that have us that don't have some form of post adoption contact agreements Palk is his or referred to will allow the options to be open if all
parties agree this is entirely voluntary those who want clothes adoptions continue to have them but this law would allow open adoptions if adoption if adoptive and birth parents want the open adoption. Worked with the shared beginnings Arkansas coalition of Marshallese and the equality adoption attorneys on this piece of legislation it's a you know good for the the Marshallese residents of my district and also there's many other people in the state that

program here in Arkansas which allows a person with a disability to save money to meet their own needs without the fear of losing public assistance such as Medicaid since then about every session we've come with a few little updates here and there federal rules change we've understood more what we need to make the program better so here I am back to you again the able plans are authorized by that five twenty nine section of the IRS code.
Which is the same plan that authorizes the five twenty nine educational savings plan so this bill makes some of the changes that are in current statue that were technical and major in that technical in nature there were some a little bit of language that was left over there that referred to educational plans so we're scratching out some of that to to take that out there because that's not a part of this at all and since we wanted to go in and do that we thought what can we do to make this plan better and we really want to make it equal to what that five
twenty nine college savings plan is all about so it defines what part of a non qualified is taxable in alignment with federal regulations and then thirdly it aligns the five twenty nine education plans which contributions above the five thousand dollar limit on deductibility from Arkansas income tax may actually be carried forward so you can carry forward the amount that you contributed. Essentially this makes the able
plan equal to the five twenty nine college savings plan what's allowed in one will be allowed in the other and I hope that you all can agree that what we allow someone who's trying to save for an educational plan that we should allow the same benefit to someone with a disability who was also trying to possibly save for an educational plan or something else I appreciate a good vote. We're asking them to explicitly state in their findings on whether the a life extension of these electric utilities are in the public's best interest I'm open for any questions. clarify and expand the prescription limitations in the Arkansas Medicaid program and Johnson you're recognized explain the bill thank you Mr Speaker colleagues so to understand what this bill does I think you need to first understand current state in Arkansas with regard to fee for service Medicaid so currently in Arkansas as an adult your allotted three prescriptions a month there are some exemptions to that right now the exemption list includes things like nor can I smoking cessation products and contraceptives we're adding to that exemption list so we're adding diabetes medicines high blood pressure medicines
cholesterol medicines blood thinners currently in Arkansas you only get through this prescription so if you happen to be on diabetes medicine blood pressure medicine the blood dinner in a cholesterol medicine you're faced with choosing each month which of those three prescriptions you gonna get which one you have to pay for there's a process in place takes to task for a waiver but people to re apply for that waivers every six months currently Medicaid doesn't deny this waiver so this is just needless paperwork to repeat these people through and making them have to make difficult decisions about which medicines they need this
is now expanding that from three months to six it is allowing them now to have these other medications added to the sense of lists and so this is a good bill that's going to expand health care in Arkansas and and prevent hospitalizations and I'd be happy to try to answer questions about this bill. eighty is a bill I think that will be very good work force for certain situations in our state the intention of H. B. seventeen eighties to allow a long term care facilities the opportunity to be involved in two types of education medication assistance and LPNs this bill is not intended to have any negative outcomes are ramifications for any existing programs in colleges or hospitals and this bill would not mean the every long term care facility would do their own training this would allow a long term care facilities the same opportunities as hospitals and
colleges have now it does not create a separate set of rules or exemptions for them just the same opportunity. My understanding that we in training portions more is the most controversial for this in this bill this would simply allow long term care facilities the same ability to apply for state boards of nursing Stoffer these programs if a particular area of the state is saturated the potential program could not get enough clinical slots and pass a feasibility study the board would not approve that program any potential program
would have to show that they met all the criteria related instructors labs clinical sites this bill is intended to a companion bill the representive eleven passed yesterday before that bill was passed even though we had rules in place for medication assistance we did not have the Medicaid the Medicaid co so we weren't able to proceed with that program hi a business in my district is that we have constituents that really feel very comfortable at home but they do not want to travel and they would not travel to to your school to get this training but they're comfortable to grade out
of high school become a CNA and if they're doing well as a CNA what they become a medication assistant make more money. Progress maybe to become an LPN and this would allow that to happen I think is a very good workforce thank I think we great a rule areas and other areas of the state and with that I'd take any questions of somebody might have. This is a bill that came three insurance and commerce a I brought it to the insurance department of late after the session started and they said that they had they had wished that it'd been part of a their package they looked at before the the session because they actually favor this is is basically drafted on a premise of what occurs in other states called storm chaser legislation
you know all of us that are homeowners we certainly wish that we could get our roofs replaced periodically without it costing us anything and what happens many times is if a storm comes through a hail storm whatever some of these roofing company some of them not so reputable they come through and they tell you that they can replace your roof and it's not going to cost you a dime that they're going to figure out a way maybe by putting a sign in your front yard giving you an advertising
premium and you will not have to put up money for the deductible this amounts to what is an unfair trade practice in the insurance department really frowns on it dramatically what we have done with this legislation if we have required that the roofing company would provide to the homeowner a statement that would be in twelve point type that would indicate that the responsibility of paying a deductible is solely the responsibility of the

power as a judge sitting in the domestic relations division of circuit court in DHS court has the power to declare paternity and then section five eliminates the involuntary termination of a punitive father who was not provided notice or was dismissed from the case for lack of contact or deemed not to be the father that's important because if it's determined that your rights were involuntarily terminated it affects your ability if you're ever brought into court
DHS cases in the future that's an automatic right for DHS to be able to proceed toward termination this says that they can't count that as an involuntary termination in other words it would be a voluntary termination so they can't be used against these parents in the future that's a good thing for parents who find themselves in DHS court. And then eliminates the need for further notice to putative fathers who do not establish significant contacts or found not to be the biological father otherwise dismissed from the
case one of the things that he's also see throughout these bills the idea about significant contacts if you've got a parent or an alleged parent who has not been involved in the child's life at all they not have any significant contacts with the child then at some point. of our dual incentive offerings this bill caps the amount of tax credits the state can issue at four million per year which is the historic average annual amount provided by DFA but that the on Senate program the substance of the incentive remains unchanged the amount of incentive a qualified production can aren't is still the same but this bill adds new ways for productions to improve their incentive for those who may not know the current rebate allows
for a twenty percent incentive on qualified expenditures and up to thirty percent incentive for hiring in state workers. We've expanded the way to earn the thirty percent production can hire military veterans are members of the National Guard. I make expenditures majority on veteran businesses. This bill was created with the valuable assistance of the FNA and a EDC and I want to thank them for their help in constructing this bill along

There are situations that have come to light around the country including in the state of Arkansas with the advancements in technology and specifically genealogy research where. Apple had discovered that who they thought were their biological parents were not are not in fact their biological parents and that doctors who were involved in there in the fertility treatment of their mother for instance is in fact their biological father and so
because of that we have seen states around the country that are beginning to address this issue Texas in twenty nineteen passed a law on this issue Indiana and twenty nineteen passed a law on this issue California has a law on this issue and so we're attempting to address it now in Arkansas as these other states have generally what the bill does is in section one we say that the statute of limitations for fertility treatment fraud it may be commenced at any time and so that's consistent with
other sexual offenses search statute limitations for instance rape sexual assault in the first degree sexual assault in the second degree and incest those are offenses that can be commenced at any time and so fertility fraud because you're dealing with an offense that where there was fraud involved that often is not discovered for a long time and a good period of time after the fact that we amend the statue imitations to say that can be brought any time section two creates the new criminal offense of fertility
treatment abuse one of the interesting things we begin to look at some of the other statutes in other states in Texas they added this type of conduct to their sexual assault statutes because in a way it is a sexual assault because you're using an authorized sperm for instance infertility treatment on someone who didn't consent to it and in a way that is a sexual assault we look at the art of that in the Arkansas statutes that didn't fit well and so we created the new statute of fertility treatment abuse and
what that says is person commits fertility treatment abuse if the person is a healthcare provider in the course of performing assisted re. Shin procedure on a person knowingly uses on authorized human reproductive material that'll be a Class B. felony that's punishable by five to twenty years in the Arkansas department of corrections that's one to fence the second offense that you'll see in section three is fertility treatment fraud and that's for the miss representation of the type of material that's used in those fertility treatments so we have
multiple types of fertility treatments infertility pregnancy surrogacy and ifs a doctor involved in those treatments for instance uses an unauthorized act someone thought they were receiving an egg donation from one person turns out it was from someone that it wasn't authorized again on authorized firm that is with the purpose to defraud that would be fertility treatment fraud and we've classified that is a Class C. felony that's three to ten years in the Arkansas department of
corrections in this section for creates a civil remedy for those who have been harmed by this conduct that they would have the ability to bring suit against the healthcare provider that without their consent without their permission to perform this kind of the this act a criminal act against them they would have the ability to bring a civil suit and would be entitled to certain damages and so with that happy to answer any questions. discussion committee got out of committee failed here. Well it back down amended we're going to begin a committee it's come out of committee again This Is Your before today the changes we made or try to dress two specific issues one was we try to make it an opt in process so we put parents first in this process so now parents have to get permission for kids to participate in this community school process additionally we try to type of the language about the data to make sure that it was gonna be kept private to
make sure no additional data mining would happen in the committee school concept not when I came down here this session believe it or not this was not a because I was looking to champion this is a bill I think that from from a colleague and to be honest when I started this process I didn't know a lot about community schools having read about them listen to the testimony we had in committee which was favorable this last time in favor of the schools I bought into the concept I think it's a good concept I think this is a good bill that will define some of the terms we need for these schools and help provide
that desi with the opportunity to set up some guidelines for the schools and so with all that said I'd be happy to answer questions. I appreciate a good vote thank you. Thank you Mr Speaker I know I spoke against this before and I do I always appreciate when folks go back and make changes I also after we had this discussion went back to the same people heard from before and more I did some more research on this as well. And what I found was people still have many concerns if this bill doesn't pass today I was point as was pointed out last time. All the good things that schools are doing. They can continue to still do.
People came before us in the committee and point out a lot of good things at their schools are doing I know I could come before and you walk into I'm sure this is a good thing my schools doing this is a good thing my school doing all things done by local schools. By local people. With local control. So this bill fails today all that can continue to happen. Not one but if it stops. If this bill passes the concern that I have and the concern that
person after person I reached out to teachers principals superintendents school board members parents more parents more parents grandparents I sent this bill just about everybody I could because it concerns me when I first saw it did pass out of the Senate. Easily and what I read I thought well I don't think this is a good idea. Let's test it so I sent it out to people without telling them how I felt you tell me how you feel. And concern after concern was this.
Is not what we want we can already do these good things we have local control we parents we school members know what we wanted this is a new agenda with federal grants. Confederal strings. I had people reach out to me repeatedly have you heard that bill again I sent them the moments in fairness this is what is going to do these the changes they made people still had the same concerns. People ask me when you can hear it. They're concerned about what
this does to local control and the agenda they can come in with this. With these federal grants. I see that some of the legislative intent was pulled from this but when I went out and looked at the federal legislation on community schools. It was almost verbatim. That really concerns me. So. I want to voice my concerns and the concerns of my constituents. On this bill and hope that you will vote against it.

cost which is going to help lighten the load on on some of the consumers out there another words be able to extend things out of a much lower interest rates for a longer period of time to help us not tell the truth blotter this right off the bat so.
