I'm sorry points then there there's several of the governor point some I think there's some other is that are ex officio but they are people that are appointed by the governor and I believe others I don't have that list in front of me but those of us to vote for the county clerk's our voices are not heard because we have no we have no part of the process as far as the election commissioners are concerned is that correct. How widespread is this problem that we are supposedly responding to because it's a big deal to move us away from the folks we're closest to that we voted for to the to an unelected body that's just a big deal so there must be some I mean any number of problems out there that you can site that we ought to change the law for this that that's what I'm asking you will center I don't really want to get into the specifics because there's been some issues that have occurred that have and some of them in the paper and so I'm not been to see more investigation going on on that this is about a process of dealing with them not trying to say that it happened this many times or ten times that many times or whatever but whatever the violation it would if if they if the this is to ascertain was it indeed a violation or to the person that made the complaint. And then on section two this is important part of this bill it says county employees detailed as election official now the word detailed we struggle with that former representative Doug House now this is to Attorney General helped us come up with that he reached back into his military background as I'm sure that Senator Wallace does that were detailed when you're put on a detail you have a specific limited job to do and this details county employees to be to help carry out elections it makes clear that the they comply with directives of the County Board of election commissioners related to if they are related to the election and they can can assigned to other election officials the supervision of those election officials again by a vote of a quorum of all members of the commission now this is some to clarify and and is good in some cases goes back to the bill I had a moment ago the County Board of election commissioners may not change a duty delegated to a county employee if that duty is expressly governed by state or federal law as a practical matter we know that employees of the county Clerk and sometimes other county elected officials are. At what this bill does is really fixes a a loophole so when we passed and debated about and thought over then hits carried a couple sessions ago one of the things that we were doing was providing opportunity for people with this additional training to have the ability to carry a government buildings throughout the state including municipal buildings well what what is happened is they are using the ability to post a sign that was a is a tool that's being provided to private businesses in order to be able to prohibit people from carrying and public buildings so the the philosophy behind the the policy behind the enhanced care was these people went through all this additional training should have ability to carry in these government buildings in order to to protect himself wherever they go so just basically it really is clean up to Texas tech to technicality that the people are using to to get out from underneath the intent of the legislation and I appreciate a good vote. Senate bill six fourteen Senator Breanne Davis seven six fourteen by Senator Davis to amend Arkansas law concerning paid canvassers to amend the law concerning the compensation paid canvassers and clear emergency members will know there's emergency clause on this bill twenty four votes are required Senator Davis you're recognized thank you and this bill deals with paid canvassers in a way that's meant to protect the integrity of our ballot initiative process it guards against fraud by doing a couple of things that requires US in Arkansas residency prohibits pain can't canvassers on a person at your basis it ensures those that have already broken the law are not interested in changing laws or Arkansas state constitution it also helps ensure that our canvassing process have legal challenge by and a few things also its first laws amended the background check provision and it also wants us with other states in regards to their residency and the person that you're payment and requirements and it follows a circuit court precedent at the new provisions in this bill are Patton patterned after similar provisions and other states have done and have already survived a legal challenge and and it also includes a severability clause in case the court strikes down any part of it and and as I mentioned it's got an emergency clause I'll take any questions are there any questions for Senator Davis senator Chesterfield you're recognized. And I guess where I live it yeah I can see the bill a little problematic because you now have to be a resident of Arkansas where is I'm three miles from Missouri at eight miles McCollum and none of those people now be eligible for these jobs yeah that's correct and and quite honestly and I think that's really important because this just deal specifically with and Constitutional amendments and as we all know I think and the purpose behind us being able to change our constitution is really supposed to be citizen let and it says to be a movement from people across all counties that want to see and it's their way to use their voice to change our constitution and and so I think it makes perfect sense that they need to be an Arkansas resident it is to be somebody here who's passionate about the issue or maybe not maybe they just want to be paid and to gather signatures and that's fine too but it's important that there Arkansas residents gathering signatures change the Arkansas state constitution okay or I mean we use for initiated acts to write not just constitutional changes and say that again I'm sorry I'm so like this the same canvassers this law would apply to people who are canvassing not to change the constitution also just state law and that's incorrect it doesn't it doesn't apply to any local initiative like ballot issues local things this is specific to Constitutional amendments. Well you mean ballot initiatives yes yes I'm sorry so it yes to those yes. Okay. What's the what's the rationale behind getting rid of the Hey personagens I mean a lot of companies pay on incentives performance but what's the rationale rationale behind that is just and the fraught aspect if you're if you're paid per signature then and you may be more of a more motivated to collect fraudulent signatures and so that you have a higher number to be paid but if you just say Hey we can pay by the hour or however they choose to pay then you're just being paid for collecting signatures doing the work regardless of how many you're collecting. In violation of the election laws as opposed to any every trying to limit that to election law or similar for all things like that I would see similar front things not specific to election laws but that specific to you things that you could call fraud fraudulent that call into question the character of a person that we don't want those people collecting signatures and they committed fraudulent acts before. This section is effectuated a victim was targeted specifically associated with the recognizable and identifiable group of class to share mental physical biological cultural political or religious beliefs or characteristics. It is also important to note that this action. The Trafford or weight release is only applicable after a defendant is found guilty of the four mention crimes. Also on page two lines two through six the bill is specific that Amir all or expression is not a sufficient reason for this penalty of delayed release it must be proved that a defendant specifically targeted another individual with a violent crime based on the items listed on page one line thirty three and thirty four. This bill also reiterates on page three lines thirteen through twenty four that the bill is not meant to interfere with the US Arkansas constitution is not meant to serve as a basis for the action under the intrastate improvement act it is also not intended to expand or contract protections under the Arkansas civil rights law it also says this bill cannot be amended or any executive action. This bill also creates a registry to the Arkansas crime information center of persons who were sentenced under the offense of delayed release. And the penalty upon conviction under this bill requires that the defendant shall serve a minimum of eighty percent of the original political sentence for the violent crime which are convicted I'll try to answer any questions anyone has any. I know that this state like most other states I need to have a hate crime bill I'm sorry we have not managed to do that I described to everybody the best of motives but even the people who are on the bill don't say it's a hate crime bill. And I think that's an honest assessment of. The the bill and what it is not. But what I wish we did have. The first thing I guess is. If you're going to address an issue. You just have to name it. You know obscure in vagueness. I don't know what it is about naming things that have to do with people's identity and people talk about things like identity politics and generally when they do that they're talking about race or they're talking about gender or something along that nature the things that is so taboo for us that we just don't even talk about. And that is carried us right over to where we are now because we won't name what we say we're talking about and then we say we're talking about everything in this bill and a Senator Hickey says it's all inclusive well I'll submit to you and the problem that I have with this bill you can't be all inclusive. And still address books with been affected without name and who they are it's kind of like if you know as I said this morning if I had three children and one of them had chicken pox and I'll say oh this child really matters right now and I need to address this child so he will be okay and then somebody says to me well everybody needs to be okay well that's right but you're not going to. Give the medicine that you need to get to the one that's up thank did with the chicken pox to your other three kids. And that's a problem we have here. We are just covering up with the real issues are. And we have around eight thousand hate crimes reported that happened in this country every year. And every time somebody says to me when I say I think it's really important that you need to name the people who are affected by this bill or should be affected or that should be the meeting of hate crimes. I would say that somebody comes back in the England we're all just one group of people we are just this. But you know. It's not all those being affected by hate crimes. And crimes I wondered what to really be sure we understand the definition of hate crimes it's not just somebody if I just say Senator Dismang I just think you're not going to beat you up. You are part of a historical group that has been a part of a pattern of your being attacked because you're part of that group and the pattern is there that's not happening.
