resolution for former state senator jim argue. My two predecessors for the C. centers will bonded David Johnson have been better to me than I deserve but if you want to know who to blame for me being here it's it's senator jim argue. When I was a kid there are a lot of politicians that I knew about gym Margie was really the only politician that I'm actually doing so to me he embodied what it meant to be a public servant and to be a state senator in particular at the time for me as
a kid he was larger than life and it's not only because he was six five Just his spirit and his heart and he took me under his wing as a kid and treated me like a friend in like in like an equal and he did this in spite of the fact that I was a teenage boy who was friends with his daughter. And the. And throughout my life he he meant toward me when I was in law school I I wrote an article about some some laws that have been passed down here in the wake of Lake View and he sat
down with me in his office for hours and went through papers after papers and and mentored me and then of course when I ran for the legislature for the first time in two thousand fourteen he served as a mentor to guide me through it throughout that entire process and and I really wouldn't be here today if it weren't for Senator argue. Tragically in may of two thousand eighteen we Law Center argue after a short illness and I'll just read a few highlights from the from the resolution. I noticed jim.
He was the son of an and Reverend James are you long time pastor of the church jim joined at age fourteen and was a member of Intel's desk death Pulaski heights United Methodist Church jim grew up attending a little rock public schools and graduated from hall high. And then from Hendrix college in nineteen seventy three. He embarked on a career in finance and investment after college. At before joining the United Methodist foundation of Arkansas's president nineteen eighty one. When he joined the United Methodist foundation of Arkansas
their assets were sixty seven thousand dollars and at the end of his career was a hundred and sixty four million dollars that's what he did for that foundation growing it into one of the largest United Methodist foundations in the country for the church that he truly loved. In nineteen ninety his friends got tired of hearing and complain about the state government and made a run for office and he ran for the house of representatives that year served in the House for six years I think with some of the members here today and in nineteen ninety six ran for the Senate where he served for ten years including as chair of the
Senate Committee on Education and as president pro tem of the Senate in his last biennium. Senate argue was revered for his intellect and leadership on Education during his time in the legislature and was a key architect in force on the go sharing the state's response to the Arkansas Supreme Court decision that require the education system in Arkansas to be reformed improved what we all know is the lake view decision he works clearly with a lot of his democratic colleagues in the wake of that but also with governor Huckabee and his Republican colleagues as well
they did what the Supreme Court required but in some of the members here today the one above and beyond what was imposed by the court. As his friend said in terms of his priorities here in the legislature education was first second third and last that was his property he viewed education as the opportunity to change a child's life forever his daughter Sarah who I grew up with overheard talking about GT classes when she was in fifth and sixth grade and she said that please don't take away my GT and his response was there I'm so happy that you have that
opportunity and every child in Arkansas deserves to have the same opportunity that you have that was his approach every every child deserve the same opportunities as is on. Always notify for voice in the legislature he sought to work across the aisle to make government work including sometimes by having as bills passed without his name on and in nineteen ninety seven the center for policy alternatives in Washington DC name senator argue a flaming fellow he was a national humanitarian award honoree by just committees of Arkansas they renamed leadership

page two of the bill at first it requires an indelible source of hot and cold running water and available source of electricity a source of potable drinking water a sanitary sewers sewer system and plumbing that conform to the applicable building housing codes an existing at the time of installation a functioning roof the building envelope in a function heating and air conditioning system to the extent that existed at the time of occupancy it also allows the tenant to renovate property it that's an agreement that set out a between the landlord and
tenant three it requires the landlord I disclose any of the defects and also allows the tenant to then respond to those in writing a knowledge that they are they accepting the defects are not accepting the defects They requires language correct the defects allows a tenant to vacate without a penalty again that's something that's important because that that'll allow that tended to hold on to their deposit so long as they haven't made you know done damage to property the required require repairs but will allow
them to vacate the property resolve themselves of the rental agreement and find a a property that is managed by different landlord and explicitly allows a tenant to install smoke and carbon monoxide detectors it prevents landlords from having an agreement that tries to and do anything that's in this act and then it also ensures that the code set that it code sections of municipality or county attraction actor has a stricter code section what we have here our state law would not supersede that stricter code
in and create a different violation. And in the end of the building in the something that was agreed to by everyone that was involved it takes is a few issues with unlawful detainers a statute first as written statute requires a Clerk to issue a writ of possession without examination the complaint by judge at this for close of opportunity for his dismissal if that it would have been appropriate if the judges review the complaint at this bill allows a fix for that the court is required to order the Clerk to issue a writ of possession which provides due process to an opportunity for review by the court and an opportunity disposal when appropriate and

We are putting something in state law that's never existed before. to six forty four first page it just simply states person victim misdemeanor offense involving an election a violation is barred from serving in subsequent elections person convicted of a felony actually there were some agraria in that matter so just stated in a law that collected or if you're convicted of a felony would bar you from participating in future on second page it talks about an establishes a process that whenever there are complaints that are given or violations and
if you go to the back portion of the bill the back portion bill establishes a process in working with the attorney general's office to establish a hotline number for individuals to be able to call in if they see anything that they suspect is irregular about of voting of voting procedures it provides a process for the Attorney General. To be able to receive those complaints and those will be subsequently submitted also joint performance review record
also there is in there provisions that if somebody turns in a frivolous complaint that they could be charged with a misdemeanor if it's determined to be fit privilege the state board of elections going back to the front of the bill those complaints will be referred to the state board of elections but also to the Joint performers Review Committee that will begin the process of determining or investigating those complaints that are given if in the event the joint performance review will have the authority to make
the recommendation that the state board of election commissioners takeover conduct an election in the county in question at the violations or violations are considered severe enough by the Joint performers Review Committee that would threaten the county's ability to conduct a full fair and impartial election that is a process where by joint performance review can make that recommendation to them whether they do or not is up to them but it does provide that Avenue for that to be done in the event state board election does take
over a election in a county it would also provide the ability for any term back funds that would cover the cost of the election in the event the state board election commissions has to step in and take over it it would provide that ability for only that money associated with that to be diverted to cover the cost of that that would have been paid out otherwise so we're just making sure that the money flows through And again the process by the Attorney General is set up for them to be able to receive those complaints and for JPR pick it
up after the certification I'll be glad to answer any questions. an election or is this something that you envision happening weeks or months later it's after the certification election fact I think the time frame is built in to their to where would be afterwards so that we could look into those matters should it be and and that's part of the process of setting up the Attorney General to be able to handle and receive those calls because sometimes I'll give you examples was shared in the committee if the Clerk is the question right now the Clerk or the prosecutor or the ones that can receive those complaints the
situation is what if it's a prosecutor The Clerk that the complaints are being called in on it's kind of a you know that it can stop right there if it doesn't if it doesn't go any further and to cite the example I gave a while ago and we all know if you've ever sat on legislative audit this is no disrespect prosecuting attorneys sometimes I don't always get is actively involved as we think they ought to never gave those two examples earlier of such a reason why I think anyway that we need to establish this process so that we can have a

And that is when you submit an application for an absentee ballot in order to get your ballot your signature on your application has to match your
signature from when you register to vote. now I research voting nineteen ninety nine in my signature from today prior to match my signature from from yesterday much less nineteen ninety nine and you know as my parents when they register roll they rested in nineteen seventy one I'm sorry mom and dad for selling you out on that but I'm guessing there signatures don't match for if they were to submit an absentee ballot from when they register to vote in nineteen seventy one now earlier this session we had a piece of legislation brought by the same.
Member of the House to say that we cannot have sworn statements in place of a voter ID and the rationale for that legislation was that the poll workers and election officials are not qualified to evaluate hand writing and now with this bill we're forcing them to evaluate hand writing in order for a member of our community to be able to get their absentee ballots and I'll make the same point now that I did then I don't want any person to be able to wrongfully vote I'm one hundred percent
against that but I'm also one hundred percent against any citizen of Arkansas not being able to cast their vote and I guarantee with this requirement in place they're going to be people who submitted absentee ballot application who don't get their ballot because their signature doesn't match whatever their signature was when they register to vote and it's going to be people who are disabled and elderly by and large you aren't able to to get their ballots and vote so that's the one piece of the bill that I wish would be removed otherwise I might as I said I think there's some good things in the
